On 12 March 2025, the Hungarian Government submitted a draft constitutional amendment to the Hungarian Parliament. The draft amendment stipulates that a person is either male or female and that children’s right to protection overrules all other fundamental rights, which would serve as the government’s intended legal basis to ban Pride festivals. It also proposes the suspension of dual citizens’ Hungarian nationality if their activities ‘jeopardise public order or national security’, which would likely be used by the Hungarian Government to expel and ban non-governmental organisations and journalists seen as representatives of foreign interests.

  • 1.Can the Commission confirm that Article 52(1) of the Charter of Fundamental Rights – as interpreted by the Court of Justice of the EU – would preclude such a categorical, absolute placement of one fundamental right above all others?
  • 2.How does the Commission respond to the fact that this draft amendment further exacerbates the effects of the Anti-LGBTI Propaganda Law and the Defence of Sovereignty Law, both of which are subject to ongoing infringement procedures, and does this change the Commission’s mind about the need for interim measures?
  • 3.Has the Commission expressed its concerns towards the Hungarian Government over the draft amendment’s likely incompatibility with EU law and will it take enforcement action if this draft amendment is adopted?
