  • MIL-OSI USA: DelBene, LaHood, Dunn, And Schrier Introduce Legislation to Preserve Patient Access to Accountable Care

    Today, Representatives Suzan DelBene (WA-01), Darin LaHood (IL-16), Neal Dunn (FL-02), and Kim Schrier (WA-08) introduced the Preserving Patient Access to Accountable Care Act. This bipartisan legislation would continue incentives that enable Medicare providers to participate in value-based health programs, which are designed to improve the quality of care for seniors while lowering costs.

    Specifically, this bill would extend incentive payments for qualifying participants (QPs) in advanced alternative payment models (APMs) at 3.53% through payment year 2027 and freeze the scheduled increase in qualifying thresholds.

    “Our health care system needs to move from volume to value to deliver better care at a better price. Health care providers and hospitals participating in Alternative Payment Models are leading this change, but the federal government needs to keep in place the right incentives to continue this shift,” said DelBene. “The Preserving Patient Access to Accountable Care Act will help pay providers and health systems for the quality of care they deliver instead of the amount.”

    “Alternative Payment Model incentive payments are essential to ensuring that Americans have the highest quality of care possible,” said LaHood. “I am proud to champion and be joined by my colleagues in introducing the Preserving Access to Accountable Care Act to ensure that physicians and other healthcare providers are able to deliver high-quality, well-coordinated, and cost-effective comprehensive care. By continuing the incentives and maintaining the current qualifying thresholds, this will help sustain and grow participation in value-based payment models.”

    “Alternative Payment Models ensure that patients receive the best possible care while rewarding providers for delivering high quality care at an affordable price,” said Dunn. “Congress must encourage this commonsense approach to healthcare, which will keep costs low while improving patient outcomes.”

    “Alternative Payment Model incentive payments are an effort to make our health care system more efficient by rewarding providers for transitioning to value-based care models that don’t compensate based on numbers of visits or procedures, but based on patient outcomes,” said Schrier, M.D. “Value-based care is one way to ensure high quality, efficient care for seniors. I’m proud to join my colleagues in introducing this bipartisan legislation, which will extend APM incentive payments and thereby offer a range of practices to improve care for Medicare recipients.”

  • MIL-OSI USA: Congressman Raja Krishnamoorthi, Nine Colleagues, Introduce Bipartisan Legislation to Preserve and Protect Medicare for Physicians and Patients

    WASHINGTON – Today, Congressman Raja Krishnamoorthi (D-IL) joined with nine of his Democratic and Republican colleagues in reintroducing the bipartisan Medicare Patient Access and Practice Stabilization Act, legislation which would support physicians and protect access to care for those receiving Medicare benefits. With staff and operating costs continuing to climb, declining reimbursement rates could lead to layoffs, reduced services, and permanent closures of care facilities, especially in underserved and rural areas.

    On January 1, 2025, Medicare reimbursement cut of 2.83 percent went into effect despite a physician shortage in America. and that Medicare reimbursement for physician services have declined 33 percent from 2001 to 2025, according to the American Medical Association. With the Centers for Medicare and Medicaid Services (CMS) estimating a projected 3.6 percent increase in practice cost expenses this year alone, physicians could see a total 6.43 percent cut unless Congress takes action.

    Joining Congressman Krishnamoorthi are Reps. Greg Murphy (R-NC), Jimmy Panetta (D-CA), John Joyce (R-OH), Raul Ruiz (D-CA), Mariannette Miller-Meeks (R-IA), Kim Schrier (D-WA), Claudia Tenney (R-NY), Ami Bera (D-CA), and Carol Miller (R-WV).

    “America’s seniors deserve timely access to the best quality of care from physicians in their own communities, but Medicare reimbursement cuts gravely endanger that access,” Congressman Raja Krishnamoorthi said. “Our bipartisan legislation would not only prevent those dangerous cuts but also ensure that seniors continue to have access to the high-quality medical care they deserve.”

    “Physicians in America are facing unprecedented financial viability challenges due to continued Medicare cuts. Access to affordable and quality health care for millions of seniors is in severe jeopardy,” Congressman Greg Murphy, M.D., said. “Doctors see Medicare patients out of compassion, not for financial gain. The cost of caring for a Medicare patient far outpaces the reimbursement that physicians receive for seeing them. On top of that, the expense of providing care continues to rise due to medical inflation. This inflation, coupled with declining reimbursement rates, creates enormous financial pressures on physicians, forcing many to retire early, stop accepting new Medicare patients, or sell out to larger, consolidated hospital systems, private equity, or even insurance companies. This bipartisan legislation prevents further cuts, provides a modest inflationary adjustment to help ease the cost of care, and ensures Medicare remains viable for both doctors and patients.”

    “Over the past 22 years, adjusting for inflation, physicians have essentially taken a 26% pay cut from Medicare,” Congresswoman Kim Schrier, M.D., said. “Their reimbursement has been flat or declining, while overhead costs have increased by about 47%: rent, labor, equipment, and insurance. I cannot think of another profession whose compensation has dropped by 26% over 2 decades. Physicians have been holding their breath, year after year, hoping that Congress will act to avert these devastating decreases in reimbursement. Without adequate reimbursement, solo and small practice physicians—most often in rural or underserved areas—are already closing their doors. It’s up to Congress to ensure that physicians are fairly compensated and can continue to practice, so that all Medicare patients have access to high-quality, affordable care, and I am proud to co-sponsor legislation that will achieve just that.”

    “President Trump campaigned on tariffs as a tool to level the playing field between American workers and industries and our foreign competitors,” Golden said. “I don’t agree with Trump on everything, but he’s right that the old deal stinks, and we need a new one.” 

    “Tariffs push back against decades of free trade and globalization that prioritized low prices above all else.     Trump Launches Trade War That Will Raise Prices, Hurt Jobs

    Bellevue, WA, February 1, 2025

    Today, Representatives Suzan DelBene (WA-01) and Don Beyer (VA-08) released the following statement after President Trump imposed sweeping tariffs on some of our largest trading partners.

    “President Trump just started a trade war that will raise prices on American families and invite retaliation against American businesses, workers, and farmers. This is a tax on everyday goods that will hit the pocketbooks of middle-class families at the grocery store, the gas station, and the pharmacy counter. Trump says this is a negotiating tactic, but everyday Americans and small businesses will suffer while he and his billionaire friends are insulated from the economic pain this will cause.

    “This is a blatant abuse of executive power. No president should unilaterally be able to put in place these broad-based tariffs that will have far-reaching economic impacts in communities across the country – Red, Blue, and everything in between. Congress must reassert its authority by reining in this egregious misuse of the law.”

    Background

    • Today, Trump put 25% tariffs on all goods from Canada and Mexico, with a 10% tariff on Canadian oil exports. He also placed a 10% tariff on Chinese goods.
    • These tariffs are similar to the ones Trump proposed on the campaign trail and are estimated to directly raise prices on consumer goods by $2,600 to $4,000 a year for the average American family.
    • The Wall Street Journal Editorial Board called Trump’s tariffs, “The Dumbest Trade War in History.”
    • Sen. Rand Paul posted today, “Taxing trade will mean less trade and higher prices.”
    • In January, DelBene and Beyer reintroduced legislation that would prevent the President of the United States from imposing import tariffs under the guise of a national emergency without Congressional approval.

    Today, Congresswoman Rosa DeLauro released a statement in response to President Trump’s 25 percent tariffs on nearly all trade with Canada and Mexico:  

    “I am all for the smart use of tariffs — they are an important policy tool that Democrats and Republicans have used to defend critical domestic industries. I worked with President Trump in his first term to make our trade agreement with Canada and Mexico fairer for American workers, and I am ready to do so again.

    “President Trump claims to be using these tariff threats to urge greater cooperation on addressing the flow of fentanyl into the U.S. If his goal is truly to stem the tide of fentanyl, there’s an action he can take that would make a difference: closing the de minimis loophole, which allows fentanyl into the U.S. through uninspected low-value shipments. He has the authority to do this today with the stroke of a pen.

    In a statement, Congressman Crow said:

    I am deeply concerned about reports that Buckley Space Force Base in my district will be used for mass deportation efforts. 

    Pulling our military into politicized and contentious domestic immigration enforcement dishonors the service of our troops and distracts them from the important work of defending our nation. 

    Perhaps most disturbingly, it could force our service members to assist in the detention and deportation of peaceful members of the community. The President is threatening to go after our neighbors, family members, business owners and friends in order to create a narrative that most immigrants are violent criminals. This is simply not true.

    Trump’s Reckless Trade War Will Hurt American Families, Businesses, and Workers

    While noticeably going softer on China, Trump’s tariffs hurt key allies and top trading partners Mexico and Canada

    “Donald Trump has plunged our country into a dangerous trade war and the American people will bear the cost. Thanks to Trump, American businesses will be saddled with higher costs, which could lead to higher prices on goods Americans need. Prices will likely go up the grocery store, as people still feel squeezed at the checkout counter. The price of homes is expected to increase, as materials used to build homes become more expensive, which comes as homeownership remains unaffordable to many. 

    For millions of Americans still grappling with inflation, Trump’s tariffs will be a gut punch. History should inform us that another trade war could cause devastation again. The last time Trump picked a trade fight, Wisconsin dairy farms suffered the brunt, contributing to record-level family farm bankruptcies and billions in bailouts. Trump resorted to costly bailouts to cover for his failures and have left farmers weaker in the long term.  

    In his second term, Trump continues to use tariffs as a political scheme, this time against our top allies and trading partners. Tariffs can help American industries and support our workers if they are used deliberately and carefully, but Trump’s across the board tariffs are neither. As our allies impose retaliatory tariffs, the damage will get worse. Donald Trump hasn’t even been in office for a month, and he is already breaking his promise to lower the cost of living.”

    “I oppose President Trump launching a trade war with Canada and Mexico, who are already retaliating. It will be a blow to the middle class, working people, and the vulnerable.

    “President Trump’s trade war on Canada and Mexico, which are part of the USMCA trade agreement, driven by his 25% tariff on nearly all imports from those countries, will drive up prices on all Americans. All three countries in the USMCA have, until now, acted based on the rules and norms set up by that agreement. It was President Trump who initially proposed the renegotiation of NAFTA into the USMCA, and I was among the Democrats who helped negotiate the agreement and secure wins on labor and other key provisions. The USMCA passed Congress with bipartisan support.

    “I condemn President Trump launching a trade war that absolutely guarantees price increases on key products as well as retaliatory tariffs that will affect exporters across many states.     The Crown has today shown its commitment to settling with Ngāpuhi by initialling the proposed transfer of Kororipo Pā to Ngāti Rēhia, Treaty Negotiations Minister Paul Goldsmith and Conservation Minister Tama Potaka say.

    “This initialling is an important step in beginning to provide reparations to Ngāpuhi and will be the first redress the Crown provides,” Mr Goldsmith says.

    “Ngāti Rēhia has long sought the return of Kororipo Pā, and since 2022 Te Rūnanga o Ngāti Rēhia Trust has formally engaged with the Crown on its proposed early vesting. The Trust intends to hold the site as kaitiaki on behalf of Ngāpuhi.

    “I need to emphasise that public access to the reserve will not be affected.

    “Initialling the deed is a significant milestone. Before the deed can be signed, Te Rūnanga o Ngāti Rēhia Trust will seek support for the proposed vesting from its hapū members.

    “This initialling demonstrates our commitment to reaching a comprehensive Ngāpuhi Treaty settlement, which remains a high priority. I would like to commence negotiations with Ngāpuhi as soon as possible. 

    “Kororipo Pā will transfer to Te Rūnanga o Ngāti Rēhia Trust as a historic reserve and on-account of a future comprehensive Ngāpuhi settlement.”

    “This has been a long journey and I thank Ngāti Rēhia and others for their ongoing commitment to reaching a resolution,” Mr Potaka says. 

    “The Department of Conservation – Te Papa Atawhai and Ngāti Rēhia have a long-standing partnership and I’m glad that mahi will continue to protect the significant historic taonga and conservation values of Kororipo Pā.”

    IHC welcomed its new IHC Group Chief Executive Andrew Crisp at a pōwhiri in Wellington on Monday morning.

    More than 200 people gathered to welcome Andrew Crisp, who joins IHC from the Ministry of Housing and Urban Development.

    “I was fortunate to meet with some people with intellectual disabilities before I started and I heard their request for me to step up for people with intellectual disabilities and for IHC,” Andrew says. “I will answer that call.”

    Andrew joins the IHC Group at a key moment amid changes in disability funding, opportunities in social and community housing, a continued need to advocate for people’s rights and an ongoing determination for people with intellectual disabilities to have their say.

    He says he has three key initial priorities. “I want to listen, first and foremost, to learn and understand the whakapapa of the organisation, I want to connect inside and outside the organisation to gather a range of perspectives and I want to work with everyone to prioritise the resources on things that will have the most positive impact on the people we support.”

    IDEA Services Board Chair, and IHC New Zealand Board Member Suzanne Win formally welcomed Andrew emphasising the importance of the new role in the lives of many thousands of people looking to him to lead and make a meaningful difference in people’s lives.

    She reminded everyone that just three people have held this esteemed role and have each made an impact for people with intellectual disabilities – which is our mission and calling.

    “Last year IHC turned 75 and in the early years much change occurred as people with intellectual disabilities moved out of institutions and into communities,” said Suzanne. “There have been battles for equity in every policy area since – education, health, housing, employment, rights and more. It’s great to reflect on achievements, but only as we acknowledge how much more needs to be done.

    “We are proud to be a rights-based organisation. People have the right to good health care and education, a good home, equitable access to services and participation, autonomy and social connection.”

    Suzanne said that the organisation is excited to welcome a new champion to our sector and there are many challenges laid at his feet.

    “This is more than a job,” said Suzanne. “It is history and future thinking, advocacy and consistent quality delivery, disability and housing, community connection and individual support. Much expectation and hope is resting on your shoulders,” she said.

    “But you are not on your own. You join a team of thousands.

    “Some of us are vocal and some of us are quiet,” she said. “Sometimes we’re excited, sometimes we’re angry, sometimes we’re worn out and sometimes we’re energised – but we’re all unwaveringly and doggedly committed to our mission and we’re proud to be here.”

    Andrew already has visits to services and the wider organisation booked in the diary including to Waikato and Canterbury and he’ll be starting by visiting services and staff in Lower Hutt later this week.

    Golden elegant enigma seeks ‘2025 Bug of the Year’ crown
    A short-lived, strikingly stunning native mayfly known to fly-fishers and aquatic admirers yet seldom seen by the public may have its time in the spotlight this month as a nominee for the 2025 New Zealand Bug of the Year. While the adult yellow mayfly or piriwai only dances on this earth for a short while, the aquatic insect has a prehistoric past, with mayflies one of the oldest surviving winged insect orders on the planet, alongside dragonflies and damselflies.
    “The yellow mayfly should be celebrated as perhaps the most beautiful mayfly in Aotearoa New Zealand, if not the world,” says NIWA Freshwater Ecologist Brian Smith, who has put forward the piriwai for the coveted crown for both its looks and rather interesting personality and lifestyle. As one of New Zealand’s leading freshwater invertebrate taxonomists, Smith believes the unheralded yellow mayfly deserves more recognition.
    Part of the scientific name for the insect, Ameletopsis perscitus, means ‘very clever’ or ‘exceedingly sharp’, with the yellow mayfly living up to its name. “Draped in vibrant yellow, the sexually immature adult stands out in stunning contrast against the muted greens of its native forest surroundings. But this piriwai’s uniqueness extends beyond its alluring appearance. It is the sole species in its genus, and the only representative of the exclusively Gondwanan family Ameletopsidae in Aotearoa. Piriwai really does represent.”
    The life story of the yellow mayfly can only really be understood by appreciating how it overcomes the many challenges to its survival, Smith says. “Adults lead a very short life. They are unable to eat, and the female only has a few days to find a mate and deposit her impressive clutch of up to 8,000 eggs back into the stream.”
    He admits that beneath the adult yellow mayfly’s elegant and ephemeral beauty, lies a darker side, a very rare predilection among mayflies. “In its aquatic nymph stage, piriwai is a formidable predator. With lightning speed, the nymph ambushes and devours unsuspecting aquatic insects, employing powerful jaws concealed beneath a comically oversized head.”
    Smith is hoping that the enigmatic insect will capture the attention of the public in the 2025 New Zealand Bug of the Year, who have until midnight 17 February to vote for the yellow mayfly at New Zealand Bug of the Year. So far more than 8,000 votes have been cast. “This striking duality between the delicate, transient beauty of the adult and the predatory ferocity of the juvenile presents a fascinating paradox: a creature that is both a fleeting symbol of elegance and yet was a ruthless hunter.”
    This rather uncommon mayfly is distributed throughout the country from the Southland and Fiordland streams and up the West Coast and as far as the upper North Island’s rivers.
    There is the bigger picture too, about these insects that spent most of their lives as nymphs in freshwater, before emerging in spring and summer for their short adult lives. “Our waterways boast an extraordinary legacy of uniqueness with species of mayfly, stonefly, and caddisfly found nowhere else on earth. These insects are indicators of waterway wellbeing, vital to the health and balance of freshwater ecosystems, and the first to disappear as water quality degrades.”
    He says while the increasing pressures of pollution, habitat loss, and deforestation often shift attention to more visible and charismatic species like native freshwater fish, it’s equally crucial to highlight the plight of lesser known yet essential insects like Ameletopsis perscitus. “This nomination aims to shine a light on these overlooked gems, celebrating their beauty and raising awareness about their indispensable role in maintaining ecological health. Let’s champion the tiny, the vital, and the irreplaceable.”

    Few places in Aotearoa New Zealand can match the complex legacy of the Waitangi Treaty Grounds. As a wāhine Māori with whakapapa to the people of this place – and as the 37th person to serve as Governor or Governor-General – I am deeply connected and committed to this whenua and te pito o te whenua – and it is my privilege to speak here, on this, our nation’s marae.

    When James Busby constructed his house here in 1833, these grounds were an isolated outpost of British influence. Two years later, he joined my tupuna here at the signing of He Whakaputanga – and in 1840, it became the place where two peoples – of very different world views – committed themselves to a new kind of relationship in Te Tiriti o Waitangi.

    By 1932, these grounds – like the Treaty itself – were neglected and largely ignored by the powers that be. When Lord Bledisloe was brought here, and heard the history, he resolved to buy the property and gift it to the nation, so that it could become a place of pilgrimage for all New Zealanders.

    To enable both signatories to be represented on these grounds, Sir Āpirana Ngata led the construction of Te Whare Runanga – to complement the Treaty House and represent the iwi Māori of Aotearoa.

    This taumata was to be where the signatories of Te Tiriti could meet in dialogue. It has continued to play a role in growing our relationship.

    The 1940 Waitangi centenary commemorations have gifted us an iconic image of Sir Āpirana Ngata, leading a vigorous haka in celebration of the opening of Te Whare Runanga. It so perfectly captures his passion to revive pride in Māoritanga. His efforts, along with that of countless others, have borne fruit in the 21st century with the revival of te reo Māori, celebration of waiata and kapa haka with Te Matatini, and te Ao Māori reflected in film, literature, music, and performance.

    In 1835, our tipuna who signed He Whakaputanga wanted to consolidate their ability to be successful producers, entrepreneurs and traders. A century later, Sir Apirana Ngata was also driven to develop a stronger economic base for iwi Māori, with his vision of wellbeing and prosperity in all facets of life.

    As guardians of these grounds, the Waitangi National Trust Board has helped generations of New Zealanders to better understand the impact of our history, most recently in the two magnificent museums on this site. The new exhibition at The Museum of Waitangi Te Kongahu – He Kura Toi Tangata, which marks 50 years since the Waitangi Tribunal was established, reminds us of the histories uncovered during the Tribunal’s enquiries, the impact of its work, and its many achievements.

    So many of us will have vivid memories of times spent here. We feel the wairua of those who have stood and spoken and are no longer with us – and in time, we too will become part of the story of the Treaty Grounds.

    Whatungarongaro te tangata, toitū te whenua.

    Our mokopuna will continue the work of our tupuna and I am confident they will be better placed than my generation to take up the mantle of responsibility. They are hopefully better informed by history, they understand the need to care for the planet, and they are more used to living with complex identities in the 21st century.

    Let us therefore reflect on our journey in this beautiful country at Waitangi, and our part in its ongoing legacy.

    The Northern Territory Police Force have seized a large quantity of illegal nicotine vapes.

    Around 12pm on Friday 31 January 2025, police received intelligence of illicit substances at a residence in the Palmerston area.  

    Detectives from the Serious Crime Squad attended the location and conducted a lawful search of the premises which resulted in the seizure of numerous illicit substances .

    The seizure included a quantity of cannabis and 2335 units of nicotine vapes, with an estimated street value of $140,000. 

    A 21-year-old man and a 20-year-old woman have each been issued with a Notice to Appear at Darwin Local Court on 29 May 2025.

    Detective Sergeant Alicia Harvey said “These seizures are the result of the collaborative actions of Serious Crime Squad detectives and members of the Dog Operations Unit and Drug and Organised Crime Section.

    “Intelligence received from members of the community assisted with this result and we continue to urge anyone with information on the supply of illegal substances to contact Police on 131 444 or call Crime Stoppers on 1800 333 000.”

  • MIL-OSI Australia: A ground-breaking day at Newland Park

    The much-anticipated Regional Skate and Play Precinct at Newland Park has officially broken ground, marking a major milestone in a game-changing project for the Alice Springs community. 

    Member for Lingiari Marion Scrymgour was joined by Northern Territory Government Minister for Logistics and Infrastructure Bill Yan MLA, Alice Springs Mayor Matt Paterson, and representatives from MPH Construction to kick off the project with a sod-turning ceremony today. The sod-turn officially started construction on the development. 

    The precinct will include a regional level skate park that has been designed with thorough community consultation, as well playground equipment, green spaces and ample shading. 

    It will also include a pump track, 3×3 basketball court, dog park and expanded car parking to enhance opportunities for recreation and social connection. 

    The state-of-the-art facility is a joint project between three levels of government, with a $4 million commitment from the Australian Government under its Priority Community Infrastructure Program, $1.8 million from the Northern Territory Government and $2.8 million from Alice Springs Town Council.

    The City of Greater Bendigo is calling for expressions of interest from members of the community who live with disability, care for someone who does, or who work with people living with disabilities to join its Disability Inclusion Reference Committee (DIRC).

    City Manager Community Partnerships Andie West said the City established the DIRC in 2016 to provide advice to Council that supports greater social inclusion of people with disability.

    “The DIRC acts as a central point for City staff and Councillors when advice is sought on matters relating to the needs and requirements of people living with disability,” Ms West said.

    “The Committee assists the City to consider all types of access and inclusion when developing policies and strategies and undertaking projects, so it is an important role.

    “Committee members will be appointed for a two-year term and meetings will be held every two months.

    “Some preparation and reading will be required prior to meetings and at times Committee members may be required to visit sites within Greater Bendigo to provide consultation and advice on City projects or major developments.

    “We are looking for people with lived experience, unpaid carers of people who live with disability, representatives from local disability-specific agencies, and representatives from local organisations or networks that have influence on social inclusion for people living with disability to join the Committee.”

    Applications from people with diverse cultural backgrounds, including Aboriginal and Torres Strait Islander people, and people of all ages and abilities, as well as past and outgoing members of the Committee are welcomed.

    Pill testing, also known as drug checking, aims to reduce harms from illicit drug use and save lives.

    Victoria’s pill testing service started at Beyond the Valley (BTV) festival from 28 December 2024 to 1 January 2025.

    The Victorian Government has announced the next festivals and events to have pill testing during the 2024-25 music festival season. Victoria’s pill testing service will operate at:

    • Hardmission at Werribee Racecourse on 8 February 2025
    • Pitch Music & Arts Festival in Moyston from 7 to 11 March 2025
    • Ultra at Flemington Racecourse on 12 April 2025
    • The Warehouse Project at Port Melbourne Industrial Centre for the Arts (PICA) on 25 April 2025

    The drug checking service is free, confidential and anonymous. It will attend up to 10 festivals and events during an 18-month implementation trial. A fixed-site service is due to open in inner Melbourne in mid-2025.

    During the 4 day BTV festival, the mobile drug checking service tested more than 600 samples.

    Harm reduction workers at the service spoke to 700 festivalgoers. For more than 70%, it was the first time they had ever had an open, judgement-free conversation with a health professional about drug and alcohol safety.

    Nearly 40% of those using the service said they intended to use a smaller amount of their drugs following a conversation with a healthcare worker.

    A greener future: final sustainability collaborations guide released by the ACCC 

    On 18 December 2024, the ACCC released its final guide on sustainability collaborations.

    The guide is intended to alert businesses of when competition law risks may arise when considering sustainability collaborations (and when they are unlikely to do so), as well as the exemptions that may be available for collaborations in the public interest.

    The ACCC has sought to clarify its views on the operation of competition laws for such collaborations, acknowledging the importance of ensuring that businesses do not unnecessarily limit participation in lawful sustainability collaborations.

    The guide includes a 5 step checklist for businesses considering sustainability collaborations to help assess whether competition laws are likely to apply.

    Updates to the immunity policy for cartel conduct

    On 18 December 2024, the ACCC announced that it had updated its ‘ACCC immunity and cooperation policy for cartel conduct‘ (the Immunity Policy).

    The updates are intended to increase transparency about how the Immunity Policy is administered by the ACCC, and to update and clarify the requirements for immunity applicants.

    It is now a criteria for corporate conditional immunity (and corporate derivative conditional immunity) from ACCC-initiated civil proceedings that the corporation has implemented measures, or undertaken to implement measures, to mitigate the risk of future non-compliance with the CCA.

    The updated policy also confirms that, at the proffer stage, the ACCC will not generally permit representatives of an immunity applicant to attend ACCC interviews with a derivative immunity applicant. The ACCC will provide the immunity applicant with sufficient information to enable it to:

    • understand how its immunity application is progressing; and
    • identify and provide further material relevant to its immunity application.

    However, the ACCC will not otherwise disclose to the immunity applicant or its legal representatives the questions asked or the evidence given by a derivative immunity applicant.

    ACCC alleges price fixing cartel against Defence contractors and senior executives 

    In December 2024, the ACCC commenced civil cartel proceedings in the Federal Court against Spotless Facility Services (Spotless), Ventia Australia (Ventia) and four senior executives for alleged price fixing in relation to the supply of estate maintenance and operation services to the Department of Defence (Defence).

    Spotless and Ventia provide services to major Defence force bases under billion-dollar contracts. The ACCC alleges that, on three occasions between April 2019 and August 2022, Spotless and Ventia made or attempted to make arrangements or understandings containing provisions that had the purpose, effect or likely effect of fixing, controlling or maintaining the price at which Spotless, Ventia and a third company, BGIS, would supply these services to Defence. Spotless and Ventia are also alleged to have given effect to some of these arrangements or understandings.

    The three arrangements or understandings are alleged to have involved:

    • the exchange of text messages about what BGIS and Spotless would charge Defence;
    • communications between Spotless, Ventina and BGIS regarding seeking additional compensation from Defence; and
    • meetings in which one of the senior executives said words to the effect that Spotless, Ventia and BGIS should jointly ask Defence to pay a project management fee.

    The ACCC is seeking declarations, civil penalties, and costs against Spotless and Ventia and the four senior executives, as well as qualification orders against three of the senior executives.

    Viva Energy’s proposed acquisition of LOC Global not opposed subject to divestiture

    On 12 December 2024, the ACCC confirmed that it will not oppose (subject to undertakings) Viva Energy Group’s (Viva) proposed acquisition of the remaining 50% interest in LOC Global (LOC) from New World Corporation (NWC).

    LOC is a joint venture between Viva and NWC (with a 50% stake each) that operates over 100 ‘Liberty’ branded retail fuel and convenience sites across Australia. Viva conducts downstream fuel refining, importing, distribution and marketing in Australia. It is also the exclusive supplier of Shell-branded fuels and lubricants in Australia. Viva Energy and LOC overlap in the supply of retail fuel across metropolitan and/or regional locations in local markets across SA, Victoria, WA, NSW, Queensland and NT.

    In the absence of the undertaking, the ACCC was concerned that the proposed acquisition would reduce competition in certain local areas in Adelaide, Darwin, regional Queensland and regional Victoria, where LOC and Viva Energy compete closely and where there are few remaining competitors to constrain Viva.

    Viva committed to divest 14 retail fuel and convenience sites to Solo Oil Corporation (a wholly owned subsidiary of NWC).

    Furniture frenzy: Koala Living fined for false and misleading statements about consumer rights 

    Koala Living has paid a $56,340 fine after being issued three infringement notices by the ACCC for making false and misleading statements regarding consumers’ rights under the consumer guarantees and available remedies for faulty products.

    Koala Living has admitted to incorrectly informing consumers that:

    • remedies for faulty products were only available within a 72-hour period after purchase or the period of the manufacturer’s warranty;
    • Koala Living could independently determine the type of remedy provided for minor or major faults; and
    • delivery charges were not refundable.

    The ACCC’s investigation was initiated in response to consumer complaints. Koala Living has given a court-enforceable undertaking under which Koala Living has committed to:

    • provide additional compensation (amounting to 20% of the purchase price) to consumers to whom Koala Living represented that a consumer’s right to seek remedies for faulty products was limited to 72 hours and have not yet received a remedy;
    • establish a competition and consumer law compliance program and review and update its internal policies, procedures, complaints handling practices and training to ensure ACL compliance; and
    • publish corrective notices.

    Cleared for takeoff: Virgin and Qatar granted ACCC interim authorisation for cooperative conduct

    On 29 November 2024, the ACCC granted interim authorisation to Virgin Australia (Virgin) and Qatar Airways (Qatar) to engage in cooperative conduct under an integrated alliance. Subject to certain exceptions:

    • Qatar will become Virgin’s exclusive interline, codeshare and loyalty partner headquartered in the Middle East or Türkiye; and
    • Virgin will become Qatar’s exclusive interline, codeshare and loyalty partner headquartered in Australia.

    The ACCC has granted interim authorisation to allow Virgin and Qatar enough lead time to undertake the necessary planning discussions, marketing, selling and system alignment to permit Virgin to commence flying the new services by June 2025 if authorisation is ultimately granted.

    Virgin and Qatar have provided a court-enforceable undertaking under which they have committed to:

    • offering tickets to the new service as ‘subject to regulatory approval’ to ensure consumers are made aware of the nature of the tickets they are purchasing; and
    • if authorisation is not ultimately granted, re-accommodate passengers who purchased tickets for the new service during the period of interim authorisation.

    Interim authorisation remains in place until it is revoked, the application for authorisation is withdrawn, or the date the ACCC’s final determination comes into effect. A draft determination from the ACCC is expected in February 2025, with the final determination expected in March-April 2025. The parties are seeking authorisation for five years.

    The Northern Territory Police Force seized a quantity of kava in Nhulunbuy last week.

    On Friday 31 January 2025, Nhulunbuy police received information that a large quantity of kava was being transported to Nhulunbuy on a commercial flight.

    Local police attended the Gove Airport and conducted a search under the Kava Management Act (NT). As a result of the search, members located and seized 156.6kg of kava along with a large quantity of illicit tobacco products.

    A 27-year-old male and a 67-year-old female have been charged and bailed to appear in Nhulunbuy Local Court on 11 February 2025.

    Another 62-year-old male was issued with a Notice to Appear to appear at a later date.

    Senior Sergeant Danny Bell said, “Police will continue to target the transport and supply of all illicit substances into the Arnhem region.

    “We encourage all community members to play their part by reporting unusual or suspicious behaviour to police by either reporting it to their local police station or via Crimestoppers on 1800 333 000.”

    Washington, D.C. – In response to an increase in the rate of pedestrian fatalities across the United States, Congressman Kevin Mullin (CA-15), introduced federal legislation that aims to address the impacts of driver-controlled technology in vehicles.

    October is National Pedestrian Safety Month, and Rep. Mullin announced his Driver Technology and Pedestrian Safety Act, H.R. 10051.  

    According to the most recent data available, in just one year 7,522 pedestrians were killed in traffic collisions in the United States and 67,000 pedestrians were injured. This reflects an alarming trend of increasing fatalities over the past several years. One of the biggest recent changes is the proliferation of driver-controlled technology in vehicles, such as touch screens that have replaced traditional knobs and switches, which require an increased amount of drivers’ attention. This, combined with other changes in the environment and traffic patterns, may be leading to increasingly dangerous road conditions. However, there have not been significant national studies on this topic that could inform policymakers on how to better protect pedestrians and other road users.

    “However you move around – whether you take public transit, drive a car, or ride a bike – at some point all of us are a pedestrian. Safety on our roads is everyone’s responsibility, and Congress should take a leading role in helping us understand what we can do to protect our most vulnerable populations,” said Rep. Mullin. “The Driver Technology and Pedestrian Safety Act would help us understand how technology in vehicles, such as touch-screen displays, may be distracting drivers and contributing to America’s increasing rates of pedestrian deaths and injuries.”

    The bill would direct the Department of Transportation (DOT) and the National Academies of Sciences, Engineering, and Medicine to conduct a study on the effects of driver technology, including touch screen-based systems and user interface design, as they relate to pedestrian collisions. It would also evaluate the impact of time of day and changes in traffic, weather and the volume of commercial or “hired” vehicles on the road whose drivers rely heavily on screens. It would also require the DOT to provide recommendations on actions Congress or agencies can take, such as updating standards, to address the study’s findings.

    The bill is endorsed by AAA Foundation for Traffic Safety, Advocates for Highway and Auto Safety, and Truck Safety Coalition.

    “The increase in pedestrian fatalities in the United States during the past decade is a disturbing trend that’s been well-documented by national statistics. The AAA Foundation for Traffic Safety believes Rep. Kevin Mullin’s legislation to examine the correlation between driver interactions with vehicle technology and pedestrian safety can help to update design recommendations to better protect vulnerable road users,” said Dr. David Yang, President and Executive Director of the AAA Foundation for Traffic Safety.

    Washington, D.C. – When natural disasters strike, a community’s ability to respond and recover can hinge on the resilience of its lifeline infrastructure. After the deadly Hurricanes Helene and Milton devastated huge swaths of the country, a group of lawmakers are calling upon the National Institute of Standards and Technology (NIST) to develop long-overdue standards for lifeline infrastructure.  

    Natural hazards can “disable power, water, communications, liquid fuel and gas, and transportation services – referred to collectively as lifeline infrastructure. The loss of lifelines harms local economies, threatens human health, and compounds the challenges faced by communities as they recover,” wrote the lawmakers, led by Rep. Kevin Mullin (CA-15) in a letter to NIST. “During Hurricane Helene, roads and bridges were destroyed, over 4 million customers were left without power, and many also lost cell and internet service and access to clean water.” 

    NIST has taken a leading role in developing standards that help communities become more resilient to natural disasters including earthquakes, floods and wildfires. But much of these efforts have focused on the restoration of buildings and do not address lifeline infrastructure systems.   

    “Currently, there are no national guidelines for lifeline system performance, and those developed at the state and local levels often do not account for resilience or the interdependency between systems. This impedes efforts by communities and first responders to accurately predict and plan for lifeline service loss. Given this reality, we urge NIST to develop national, cross-sector, multi-hazard design guidelines for lifeline infrastructure, which would include model codes, resilience metrics, and performance goals,” the lawmakers wrote. 

    Communities are facing increased risks from natural disasters. Proactively investing in mitigation is crucial: for every dollar spent on prevention, communities save an estimated $6 in disaster response.  

    Rep. Mullin, whose California district is all too familiar with earthquakes, has also introduced legislation, the Earthquake Resilience Act, that would require NIST to develop guidelines for lifeline infrastructure resilience and restoration after an earthquake hits.

    On the first anniversary of Hamas’ brutal attack on Israel on October 7, 2023, Rep. Sara Jacobs (CA-51), the youngest Jewish Member of Congress, released the following statement:

    “Like millions of Jews around the world, I woke up one year ago today in complete horror. I am still grappling with the aftermath of that day – the loss of nearly 1,200 innocent people, the trauma of many more who were assaulted, raped, tortured, and kidnapped, the pain felt by San Diego’s sister city Sha’ar HaNegev, and the stark rise of antisemitism since. I remain heartbroken for all the families who are still living this nightmare because Hamas is holding their loved ones hostage and because of new attacks from Iran and Hezbollah. This attack was heinous, inexcusable, and will never be forgotten.

    “I’m focused on bringing the remaining 100 hostages home as soon as possible and finding tangible solutions to achieve long-term peace, safety, and security for Israelis, Palestinians, and the region.     Rep. Sara Jacobs (CA-51) and Sen. Tammy Duckworth (D-IL) continued their push to ensure the FY2025 National Defense Authorization Act (NDAA) preserves the requirement contained in both the House-passed and Senate-reported versions of NDAA that requires TRICARE coverage of fertility services, including in vitro fertilization (IVF). In a letter to House and Senate Armed Services Committee leadership, the lawmakers – who authored and successfully secured inclusion of the IVF coverage provisions in the House and Senate bills, respectively – called for service members and military families to receive the same level of IVF coverage that’s accessible to Members of Congress and Federal employees next year.

    Two-thirds of service members, who often spend their prime reproductive years in hazardous conditions and away from their partners, have reported experiencing family-building challenges after returning home. As a result, many TRICARE beneficiaries pay tens of thousands of dollars in out-of-pocket costs for fertility treatment. Expanding IVF coverage would strengthen recruitment, retention, and readiness efforts – all while supporting those who have sacrificed greatly for the United States.

    The lawmakers wrote:

    “Because of hard work conducted under your respective leadership of the Senate Armed Services Committee (SASC) and House Armed Services Committee (HASC), Congress is poised to ensure the final legislative text of the National Defense Authorization Act for Fiscal Year 2025 (NDAA) preserves language contained in both the House-passed and Senate-reported versions of the NDAA that require TRICARE cover fertility services, including in vitro fertilization (IVF).

    “Accordingly, we write to request that in negotiating the final conference report to accompany the NDAA, you ensure U.S. servicemembers and military families receive IVF coverage in 2025 that is on par with the IVF coverage Members of Congress and Federal employees will be provided access to in 2025 by taking one of these courses of action:

    • House recedes regarding Section 701 of H.R. 8070, and the final bill includes Section 705 of S. 4638;
    • Senate recedes regarding Section 705 of S. 4638 and the final bill includes Section 701 of H.R. 8070; or
    • The final bill merges and harmonizes Sections 701 and 705.

    “Since HASC added the provisions (sec. 701) requiring TRICARE cover fertility services, including IVF, by voice vote without controversy; and then House Republicans chose to preserve these Democratic-authored provisions in the version of the NDAA that the House narrowly passed along party-lines; we are hopeful that achieving fertility benefit parity between Members of Congress, Federal employees and members of the U.S. Armed Forces can avoid controversy and be preserved in the final NDAA that President Joe Biden signs into law.

    “In the coming months, Members of the U.S. House of Representatives and United States Senators will have the opportunity to select health insurance from 2025 marketplace plans that all include high quality, affordable fertility benefit coverage—including excellent IVF coverage that, absent action by Congress, will be far superior to the restrictive fertility benefit coverage offered to U.S. servicemembers and military families under current law. Under the Federal Employees Health Benefits program, Federal employees will also receive high quality fertility benefit coverage, including IVF, in 2025.

    “Importantly, every Member of Congress will be able to enroll in a 2025 marketplace plan that covers IVF services provided in accordance with widely accepted and evidence-based medical standards of care and the American Society for Reproductive Medicine’s (ASRM) professional guidelines—which includes coverage of at least three complete oocyte retrievals with unlimited embryo transfers from those oocyte retrievals, and standard fertility preservation services.

    “We strongly believe U.S. servicemembers and military families deserve fertility benefit coverage in 2025 that is at least comparable to what Members of Congress will receive.

    “It would be hypocritical for Members of Congress to enjoy high quality fertility benefit coverage next year, right on the heels of denying such IVF coverage to brave Americans willing to defend our country in uniform, and the dedicated military families that sacrifice to support their loved ones’ service to our great country. That is why we strongly agree with the position taken by a broad coalition of Military Service Organizations (MSOs) and Veterans Service Organizations (VSOs) that these MSOs and VSOs expressed to you in their October 10, 2024, joint letter:

    ‘The health care benefit is an earned benefit and an essential part of military compensation. Coverage should not be contingent on a service member’s willingness or ability to accept an additional service commitment. For that reason, we caution Congress against adopting Section 627 of S. 4638, which would require a service member benefiting from expanded reproductive health coverage to accept an additional service commitment of four years. Again, military members deserve coverage that is on par with civilian plans, and civilian plans make no such demands of their beneficiaries [emphasis added].’

    “We share the opposition of MSOs and VSOs to including Section 627 of S. 4638 in the final bill text because it falls woefully short of providing servicemembers and their families with comparable coverage to the coverage Members of Congress receive. Unfortunately, Section 627 goes beyond TRICARE fertility coverage requirements and injects controversial and divisive language relating to abortion services and embryonic personhood, which are contrary to the bipartisan tradition of the NDAA and distract from what should be our overriding priority: making sure that in 2025, U.S. servicemembers and military families receive high quality and affordable fertility services coverage that is on par with fertility benefits that Members of Congress and Federal employees will receive in the coming year.

    “Servicemembers are disproportionately impacted by infertility and face unique challenges in trying to start and build their families. Two-thirds of servicemembers, who often spend their prime reproductive years in hazardous conditions and away from their partners, have reported family-building challenges due to military service. Most TRICARE beneficiaries must pay out of pocket for fertility treatment, costing tens of thousands of dollars, all while navigating challenging duty station moves and a complex healthcare system bureaucracy.

    “Failing to provide high-quality IVF coverage through TRICARE would perpetuate an unfair system that forces military families to confront an impossible and unjust choice between serving their country in uniform or starting a family without the risk of financial ruin. We are gravely concerned that this will inevitably deter recruitment and retention efforts and ultimately decrease our Nation’s military readiness. Providing U.S. servicemembers and military families with robust IVF coverage is the least we can do for those Americans who have sacrificed so much for us.

    “We thank you in advance for your consideration of our request to make sure that we complete the mission of ensuring members of the U.S. Armed Forces achieve parity with Members of Congress and the civil service by finalizing a conference report and passing a NDAA that, for the first time in history, requires TRICARE cover fertility services, including IVF, without harmful and onerous restrictions that violate widely accepted and evidence-based medical standards of care and fail to comport with ASRM professional guidance.”

    The establishment of the President’s Advisory Council on African Diaspora Engagement was a deliverable announced during the 2022 U.S.-Africa Leaders Summit. The Council advises the President, through the Secretary of State, on issues involving the African diaspora and U.S.-Africa ties in an effort to enhance dialogue between United States officials and the African diaspora. In July, the Council conducted its first visit to the continent to strengthen ties between the United States and Nigeria through diaspora-led initiatives.
