  • MIL-OSI NGOs: Update 298 – IAEA Director General Statement on Situation in Ukraine

    Ukraine’s Zaporizhzhya Nuclear Power Plant (ZNPP) remains reliant on one single off-site power line to receive the external electricity it needs to cool its six reactors and their spent fuel, some seven weeks after it lost the connection to its last back-up power line, Director General Rafael Mariano Grossi of the International Atomic Energy Agency (IAEA) said today.

    “The extremely fragile external power situation as well as challenges related to the availability of cooling water after the Kakhovka dam was destroyed two years ago underline the fact that nuclear safety remains highly precarious at the Zaporizhzhya Nuclear Power Plant. There are many important issues that must be addressed before it will be feasible to restart the plant,” Director General Grossi said.

    The 330 kilovolt (kV) power line was disconnected on 7 May due to military activities some distance away from the ZNPP, leaving Europe’s largest nuclear power plant (NPP) dependent on one 750 kV line. Before the conflict, it had access to ten off-site power lines. Its six reactors have been in cold shutdown since 2024, but still require cooling water for their reactor cores.

    Almost every day over the past week, the IAEA team based at the ZNPP has continued to hear explosions at various distances away from the site, a constant reminder of the close proximity to the frontline of the conflict.

    The IAEA team has continued to conduct walkdowns across the site as part of the Agency’s mission to monitor and assess nuclear safety and security there.

    Elsewhere in Ukraine, the IAEA teams at Ukraine’s three operating NPPs – Khmelnytskyy, Rivne and the South Ukraine – and the Chornobyl site reported hearing air-raid alarms over the past week. The teams at the Chornobyl site and the Rivne and South Ukraine NPPs have all rotated in recent days. Early on 21 June, the IAEA team at the South Ukraine NPP observed a drone around one kilometre from their hotel.

    Two new deliveries of equipment have taken place under the IAEA’s comprehensive assistance programme for nuclear safety and security in Ukraine, bringing the total number of such shipments to 142 since the start of the armed conflict.

    The State Enterprise Ukrainian Geological Company received portable radiation detection and monitoring devices within the framework of the IAEA Support and Assistance Mission to the Kherson Oblast (ISAMKO) programme in response to flooding caused by the destruction of the Kakhovka dam in mid-2023. The two deliveries were supported with funds from Japan.

    BEIJING, June 26 (Xinhua) — Chinese Defense Ministry spokesperson Zhang Xiaogang on Thursday strongly objected to NATO using China as a pretext for “expanding eastward into the Asia-Pacific region.”

    He made this statement at a press briefing, commenting on recent statements by the NATO Secretary General.

    Zhang Xiaogang noted that China has consistently followed the path of peaceful development and pursued a defense policy that is defensive in nature.

    China’s development of military potential is aimed solely at protecting its sovereignty, security and development interests, Zhang Xiaogang emphasized, adding that China’s cooperation with Russia is not directed against third parties, but at the same time does not accept the interference and influence of third parties.

    NATO, on the other hand, is engaged in instigation and fanning flames in various parts of the world to create unrest and provoke wars, thereby living up to its nickname of “war machine,” a senior Chinese military official said.

    In recent years, NATO has expanded its powers and authority beyond the geographical boundaries stipulated in its treaty, causing high concern among countries in the region, Zhang Xiaogang added.

    China calls on NATO to rethink its actions, change its course and make a greater contribution to global security and stability, a Chinese Defense Ministry official concluded. -0-

  • MIL-OSI United Nations: IOM Seeks USD 100M to Sustain Critical Services After Assisting 26M People in 186 Countries in 2024

    Geneva, 26 June 2025 – As the International Organization for Migration (IOM) presents its 2024 Annual Report to the Standing Committee on Programmes and Finance (SCPF), the Organization has simultaneously launched a global Resilience Campaign, calling on all its Member States for USD 100 million in flexible funding to protect its core humanitarian operations and maintain critical support for people on the move.

    “In a world where crises are escalating and resources are stretched thin, it’s critical that we protect the systems and solutions that are already saving lives,” said IOM Director General Amy Pope. “Our teams are on the frontlines, delivering results day in and day out. But to sustain this impact, we need more than just commitment – we need support.”

    The Annual Report launched today at the SCPF reveals that IOM assisted more than 26.4 million people in 2024, delivering life-saving aid, fostering solutions to displacement, facilitating safe migration, and supporting recovery and resilience efforts across 186 countries. These results were achieved in a year marked by compounding crises and financial uncertainty, making sustained investment more important than ever.

    The campaign, titled From Reform to Resilience: Securing What We Built Together, comes in response to potential shortfalls in Operational Support Income, the funding stream that enables IOM’s essential systems, such as global data tools that informed 91 percent of Humanitarian Needs Overviews and Response Plans in 2024. With only five percent of IOM’s total income coming from flexible sources, the Organization’s ability to maintain these services is at risk.

    “We are asking that donors and Member States provide just 5 to 10 per cent of existing contribution as flexible funding,” DG Pope added. “Flexible funding is what allows us to act fast in crises. It’s what allows us to support the most vulnerable, not just the most visible. It ensures the institutional stability you asked us to build.”

    In 2024, IOM undertook significant structural realignment measures to increase efficiency, shifting more resources to the field and reducing institutional costs. Efforts that generated USD 38 million in savings include automation, enhancing procurement processes, and staff relocations to lower-cost duty stations.

    Over 6.2 million people received emergency health assistance, nearly 3 million were supported with protection services, and 1.5 million migrants and displaced persons accessed mental health and psychosocial care.

    In fragile and conflict-affected contexts, IOM supported the safe relocation of tens of thousands of individuals and provided recovery assistance to 2.8 million people. As climate-related disasters intensified, almost 900,000 people received support to recover and adapt. Meanwhile, IOM enabled over 220,000 people to move safely and with dignity, and helped nearly 60,000 return voluntarily to their countries of origin.

    IOM’s 2024 Annual Report also highlights the Organization’s growing engagement with governments and the private sector to facilitate safe pathways for regular migration. In 2024, IOM worked with 145 governments to strengthen migration governance and expanded its corporate partnerships, reaching over one million people through joint initiatives with 33 new private sector partners.

    Presented to Member States at the SCPF, the Annual Report not only affirms the scale and scope of IOM’s global operations but also makes clear that the ability to sustain these efforts depends on continued, flexible funding. The Resilience Campaign is a call for solidarity and action. 

    “Behind every figure in the report is a person seeking safety, dignity, and a chance to rebuild. Whether it’s a family displaced by conflict or a community recovering from disaster, flexible support ensures IOM can remain present and responsive. With continued backing, these efforts can go further and reach those who need them most,” DG Pope said.

    The World Bank Group and the International Atomic Energy Agency (IAEA) sealed an agreement today to work together to support the safe, secure and responsible use of nuclear energy in developing countries. The partnership agreement, signed by World Bank Group President Ajay Banga and IAEA Director General Rafael Mariano Grossi, formalizes multiple engagements between the two institutions over the last year, and marks the World Bank Group’s first concrete step to reengage with nuclear power in decades.

    The agreement also reflects a new, broader approach by the World Bank Group to electrification—one that prioritizes accessibility, affordability, and reliability, while managing emissions responsibly. With electricity demand in developing countries expected to more than double by 2035, this approach aims to help countries deliver the energy people need by enabling pathways that best fit their national context, including development objectives and Nationally Determined Contributions.

    Nuclear energy provides continuous baseload power, enhancing grid stability and resilience. Reliable baseload electricity is essential for job-generating sectors such as infrastructure, agribusiness, healthcare, tourism, and manufacturing. Nuclear power is also a source of high-skilled employment and stimulates investment across the broader economy. In addition, it can adjust to changes in electricity demand and support frequency regulation, enabling greater integration of variable renewable energy sources.

    “Jobs need electricity. So do factories, hospitals, schools, and water systems. And as demand surges—with AI and development alike—we must help countries deliver reliable, affordable power. That’s why we’re embracing nuclear energy as part of the solution—and reembracing it as part of the mix the World Bank Group can offer developing countries to achieve their ambitions. Importantly, nuclear delivers baseload power, which is essential to building modern economies,” said World Bank Group President Ajay Banga. “Our partnership with the IAEA marks an important step, and I’m grateful to Rafael for his personal commitment and leadership in making this possible. Together, we’ll deepen our expertise, support countries that choose nuclear, and ensure that safety, security, and sustainability guide every step forward.”

    “Today’s agreement is a milestone and the result of a year of joint work since President Ajay Banga kindly invited me to the World Bank Group Executive Board in Washington in June of last year,” IAEA Director General Grossi said. “This landmark partnership, yet another sign of the world’s return to realism on nuclear power, opens the door for other multilateral development banks and private investors to consider nuclear as a viable tool for energy security and sustainable prosperity.     Under the memorandum of understanding signed today, the IAEA will work with the World Bank Group in three key areas:

    • Build knowledge related to the nuclear field: Expand the World Bank Group’s understanding of nuclear safety, security, safeguards, energy planning, new technologies, fuel cycles, reactor lifecycles, and waste management.
    • Extend the lifespan of existing nuclear power plants: Support developing countries in safely extending the life of existing nuclear reactors-one of the most cost-effective sources of low-carbon power-as many global reactors near the end of their original 40-year design life.
    • Advance SMRs: Accelerate the development of small modular reactors (SMRs), which offer flexible deployment, lower upfront costs, and potential for wide adoption in developing economies.

    Thirty-one countries currently operate nuclear power plants, which combined produce about 9% of the world’s electricity, amounting to almost a quarter of all low-carbon power globally. More than 30 other countries, most of them in the developing world, are considering or already embarking on the introduction of nuclear power and are working with the IAEA to develop the necessary infrastructure to do so safely, securely and sustainably.

    “SMRs have great potential to cleanly and reliably power progress and fight poverty, but financing remains a roadblock,” Director General Grossi said. “Today’s agreement is a crucial first step to clearing that path.”

    The Securities and Exchange Commission’s Division of Economic and Risk Analysis (DERA) has published new reports and data on broker-dealers, mergers and acquisitions (M&A), and business development companies (BDCs).

    Today’s reports provide the public with information about the changes in broker-dealer and M&A activity over time. In addition, the BDC data allow the public to conduct its own analysis of data filed with the Commission.

These results show a trend of industry consolidation, with a declining fraction of market participants responsible for a larger asset pool by the end of the sample period.
    • Analysis of Merger & Acquisition Activity provides a recent analysis of the U.S. mergers and acquisitions market, including an analysis of the characteristics of a typical deal and the geographic location of the acquirers and targets. The market has exhibited cyclicality such that years with favorable overall market performance were generally associated with higher deal volume. The average deal value was $3.5 billion, while the median deal value was $0.5 billion. The average acquirer had assets of $40 billion, but the median was close to $7 billion. In contrast, targets were significantly smaller, with the average target reporting assets of $5 billion and the median target reporting assets of $1 billion. Close to three-quarters of the deals involved acquirers and targets in the same two-digit Standard Industrial Classification industry and approximately a third of the deals involved targets and acquirers headquartered in the same state.

    (COLUMBIA, S.C.) – South Carolina Attorney General Alan Wilson today applauded the United States Supreme Court for ruling in favor of South Carolina in Medina v. Planned Parenthood, affirming that states, not abortion providers, decide who participates in their Medicaid programs.

    “I want to thank the six Justices who stood up for the Constitution and the rule of law,” said Attorney General Wilson. “The Supreme Court just slammed the door on Planned Parenthood’s latest attempt to force its radical agenda through the courts on our state. South Carolina, not federal judges or D.C. activist groups, gets to decide how we run our Medicaid program.”

    In a 6–3 opinion authored by Justice Gorsuch, the Court held that the Medicaid Act’s “any qualified provider” language does not give private individuals or organizations the power to sue states under federal civil rights law. The Court emphasized that Medicaid is a  cooperative partnership between the states and federal government, not an entitlement program for politically connected providers.

    “Planned Parenthood and its allies tried to turn Medicaid into a weapon to force their agenda on our State. The Court just told them: No,” Wilson said. “This is about who runs South Carolina—our elected leaders, or out-of-state activists and unelected judges. We’re glad the Court got it right.”

    Attorney General Wilson pledged to keep fighting for the rule of law and thanked Governor McMaster and his team for taking a principled stand in this case.

    The World Bank Group and the International Atomic Energy Agency (IAEA) sealed an agreement today to work together to support the safe, secure and responsible use of nuclear energy in developing countries. The partnership agreement, signed by World Bank Group President Ajay Banga and IAEA Director General Rafael Mariano Grossi, formalizes multiple engagements between the two institutions over the last year, and marks the World Bank Group’s first concrete step to reengage with nuclear power in decades.

    The agreement also reflects a new, broader approach by the World Bank Group to electrification—one that prioritizes accessibility, affordability, and reliability, while managing emissions responsibly. With electricity demand in developing countries expected to more than double by 2035, this approach aims to help countries deliver the energy people need by enabling pathways that best fit their national context, including development objectives and Nationally Determined Contributions.

    Nuclear energy provides continuous baseload power, enhancing grid stability and resilience. Reliable baseload electricity is essential for job-generating sectors such as infrastructure, agribusiness, healthcare, tourism, and manufacturing. Nuclear power is also a source of high-skilled employment and stimulates investment across the broader economy. In addition, it can adjust to changes in electricity demand and support frequency regulation, enabling greater integration of variable renewable energy sources.

    “Jobs need electricity. So do factories, hospitals, schools, and water systems. And as demand surges—with AI and development alike—we must help countries deliver reliable, affordable power.     Under the memorandum of understanding signed today, the IAEA will work with the World Bank Group in three key areas:

    • Build knowledge related to the nuclear field: Expand the World Bank Group’s understanding of nuclear safety, security, safeguards, energy planning, new technologies, fuel cycles, reactor lifecycles, and waste management.
    • Extend the lifespan of existing nuclear power plants: Support developing countries in safely extending the life of existing nuclear reactors-one of the most cost-effective sources of low-carbon power-as many global reactors near the end of their original 40-year design life.
    • Advance SMRs: Accelerate the development of small modular reactors (SMRs), which offer flexible deployment, lower upfront costs, and potential for wide adoption in developing economies.

    Thirty-one countries currently operate nuclear power plants, which combined produce about 9% of the world’s electricity, amounting to almost a quarter of all low-carbon power globally. More than 30 other countries, most of them in the developing world, are considering or already embarking on the introduction of nuclear power and are working with the IAEA to develop the necessary infrastructure to do so safely, securely and sustainably.

    “SMRs have great potential to cleanly and reliably power progress and fight poverty, but financing remains a roadblock,” Director General Grossi said. “Today’s agreement is a crucial first step to clearing that path.”

    Ukraine’s Zaporizhzhya Nuclear Power Plant (ZNPP) remains reliant on one single off-site power line to receive the external electricity it needs to cool its six reactors and their spent fuel, some seven weeks after it lost the connection to its last back-up power line, Director General Rafael Mariano Grossi of the International Atomic Energy Agency (IAEA) said today.

    “The extremely fragile external power situation as well as challenges related to the availability of cooling water after the Kakhovka dam was destroyed two years ago underline the fact that nuclear safety remains highly precarious at the Zaporizhzhya Nuclear Power Plant. There are many important issues that must be addressed before it will be feasible to restart the plant,” Director General Grossi said.

    The 330 kilovolt (kV) power line was disconnected on 7 May due to military activities some distance away from the ZNPP, leaving Europe’s largest nuclear power plant (NPP) dependent on one 750 kV line. Before the conflict, it had access to ten off-site power lines. Its six reactors have been in cold shutdown since 2024, but still require cooling water for their reactor cores.

    Almost every day over the past week, the IAEA team based at the ZNPP has continued to hear explosions at various distances away from the site, a constant reminder of the close proximity to the frontline of the conflict.

    The IAEA team has continued to conduct walkdowns across the site as part of the Agency’s mission to monitor and assess nuclear safety and security there.

    Elsewhere in Ukraine, the IAEA teams at Ukraine’s three operating NPPs – Khmelnytskyy, Rivne and the South Ukraine – and the Chornobyl site reported hearing air-raid alarms over the past week. The teams at the Chornobyl site and the Rivne and South Ukraine NPPs have all rotated in recent days. Early on 21 June, the IAEA team at the South Ukraine NPP observed a drone around one kilometre from their hotel.

    Two new deliveries of equipment have taken place under the IAEA’s comprehensive assistance programme for nuclear safety and security in Ukraine, bringing the total number of such shipments to 142 since the start of the armed conflict.

  • MIL-OSI Security: Armed Career Criminal on Federal Supervision for a Prior Criminal Conviction is Sentenced to More Than 15 Years for Robbery and Possession of a Firearm by a Felon

    CHARLOTTE, N.C. – Terry Sherwood Slade, 55, was sentenced to 188 months in prison followed by three years of supervised release today after he was convicted of Hobbs Act robbery and possession of a firearm by a felon, announced Russ Ferguson, U.S. Attorney for the Western District of North Carolina. Slade was also ordered to serve an additional 12 months and a day for violating his supervised release.

    According to filed court documents and today’s sentencing hearing, on November 20, 2023, while Slade was under federal supervision for a prior robbery conviction, he entered the House of Clouds Smoke Shop located in Charlotte and requested cigarettes from the store’s employee. When the store employee opened the register, Slade demanded money and threatened to shoot her. Slade then put his hand in his jacket pocket and gestured toward the employee. He then walked behind the counter into the employee area and took money from the register along with cigarettes and fled the scene.

    According to court records, on December 3, 2023, Slade entered Nick’s Arcade located in Charlotte. Upon entering the store, Slade approached a security guard and grabbed her firearm.  Following a brief struggle between Slade, the security guard, and a cashier, Slade grabbed the security guard’s firearm and pointed the weapon at the two employees. While armed, Slade went to the arcade’s private office and stole cash located in a safe before fleeing the scene.

    On December 13, 2023, an individual contacted the Charlotte Mecklenburg Police Department (CMPD) to report he had been shot at by a man with whom he’d previously had an argument. During the investigation, the victim identified Slade as the shooter. CMPD officers arrested Slade. At the time of the arrest, Slade possessed the firearm he’d taken from security guard during the arcade store robbery. CMPD analyzed a cartridge collected at the scene of the reported shooting and determined it matched the security guard’s firearm found on Slade when he was arrested.

    In September 2024, Slade pleaded guilty to Hobbs Act robbery and possession of a firearm by a felon. Court records indicate that Slade has a prior federal conviction for Hobbs Act robbery, and multiple state felony convictions in North Carolina, including for Assault With a Dangerous Weapon with Intent to Kill Inflicting Serious Injury and Common Law Robbery. Slade was sentenced as an armed career criminal.

    In making today’s announcement, U.S. Attorney Ferguson credited the Federal Bureau of Investigation and the Charlotte Mecklenburg Police Department for the investigation of this case and thanked the U.S. Probation Office for its assistance.

    According to court documents and other information presented in court, the Greenville Regional Drug Task Force conducted several controlled purchases of cocaine from Williams Jr. during July and August 2024. On August 12, 2024, law enforcement searched a residence associated with Williams Jr. on Ward Street and found more than an ounce of cocaine and a loaded .40 caliber handgun in the bedroom.  According to law enforcement, Williams Jr. is a validated member of the 83 set of the Crips street gang.  Williams Jr. has a prior conviction from 2016 for conspiracy to commit second degree murder.

    This case is part of an Organized Crime Drug Enforcement Task Forces (OCDETF) investigation. OCDETF identifies, disrupts, and dismantles the highest-level drug traffickers, money launders, gangs, and transnational criminal organizations that threaten the United States by using a prosecutor-led, intelligence-driven, multi-agency approach that leverages the strengths of federal, state and local law enforcement agencies against criminal networks.

    Daniel P. Bubar, Acting U.S. Attorney for the Eastern District of North Carolina made the announcement after sentencing by U.S. District Judge James C. Dever III.     [WASHINGTON, D.C.] – Today, U.S. Senators Tammy Duckworth (D-IL) and Cory Booker (D-NJ) reintroduced legislation to ban the sale and manufacturing of products made from kangaroo skin, also known as “k-leather.” After years of the two lawmakers leading the charge on this issue, this week Mizuno and UMBRO joined cleat manufacturing giants—including Nike, Adidas, Puma and ASICS—in pledging to halt production of k-leather in their soccer cleats and other products. To help build on this momentum, reverse this inhumane trend and safeguard the kangaroo species from commercial exploitation, Senators Duckworth and Booker are introducing the Kangaroo Protection Act, which would help protect millions of wild kangaroos and their innocent babies who are needlessly killed every year for the use of their leather in commercial products. Additionally, this legislation would empower the Secretary of Commerce, in consultation with other agencies, to issue civil and criminal penalties of fines up to $10,000 and other regulations.
    “The mass killing of millions of kangaroos to make commercial products is needless and inhumane,” said Senator Duckworth. “While it is encouraging that more and more cleat manufacturers are pledging to stop using k-leather, the U.S. must stop incentivizing this cruel practice once and for all. I’m proud to reintroduce this bill with Senator Booker that would help prevent the deadly exploitation of kangaroos and promote the use of more humane alternatives to k-leather.”
    “We should not allow the unnecessary killing of animals just so that big corporations can maximize profits,” said Senator Booker. “This legislation will help conserve the kangaroo species by ensuring that no one in the United States can distribute kangaroo products for commercial gain.”
    The commercial slaughter of kangaroos isn’t just widespread—it’s unnecessarily cruel. It uses similar killing methods and is ten times larger than the infamously brutal Canadian seal hunt, which prompted the United States to ban the import of seal pelts in 1972. Despite having similar import bans for other animals, the U.S. is currently the second largest commercial market for k-leather products in the world. The Senators’ proposed legislation would help change that.

    The Trump Administration’s rescission of EMTALA guidance that reaffirmed nationwide access to emergency abortion care puts patients’ lives in jeopardy and sows chaos for hospitals and providers across the country
    [WASHINGTON, D.C.] – On the three-year anniversary this week of the Dobbs decision overturning Roe v. Wade, U.S. Senator Tammy Duckworth (D-IL) joined U.S. Senators Mazie K. Hirono (D-HI) and Ron Wyden (D-OR) and their colleagues in condemning the Trump Administration’s recent rescission of guidance that reaffirmed hospitals and providers’ obligations under the Emergency Medical Treatment and Labor Act (EMTALA) to provide medically necessary emergency abortion care, regardless of where the patient lives. The letter, sent to Department of Health and Human Services (HHS) Secretary Robert F. Kennedy Jr. and Centers for Medicare & Medicaid Services (CMS) Administrator Dr. Mehmet Oz, urges HHS to immediately reverse its decision to rescind this lifesaving guidance.
    “While EMTALA remains binding federal law, the rescission will create further confusion for hospitals and providers, especially in states with abortion bans, and will result in medically-necessary care being withheld from pregnant patients in crisis,” wrote the Senators. “When doctors are forced to navigate the complex legal interplay of state abortion bans and federal EMTALA protections, pregnant people experience care delays and may receive substandard care.”
    In 1986, Congress enacted EMTALA to require Medicare-participating hospitals to provide necessary stabilizing treatment for any individuals—including pregnant women—experiencing emergency medical conditions. The federal law clearly requires hospitals to offer abortion care in cases where it was deemed medically necessary to prevent serious harm to patients’ health and life. However, since the conservative majority on the Supreme Court handed down the Dobbs decision, more than twenty states have passed laws to ban or severely restrict access to abortion, disrupting decades of certainty for hospitals regarding their legal obligation to provide necessary emergency abortion care under federal law.
    In their letter, the Senators assert that by rescinding this guidance—accompanied by the ensuing fear and confusion for hospitals and providers—HHS has needlessly put pregnant patients at severe risk of harm, medical complications, lasting health consequences and preventable death.  
    “This abrupt decision will further the chaos and confusion that hospitals, physicians, and patients have experienced since the Dobbs decision and will result in negative and deadly consequences for women and families across the United States,” the Senators concluded.

    Dear Secretary Kennedy and Administrator Oz:
    We write to express our strong disapproval of your recent rescission of guidance that reaffirmed hospitals and providers’ obligations under the Emergency Medical Treatment and Labor Act (EMTALA) to provide life-saving abortion care to patients experiencing medical crises. On June 3, 2025, the U.S. Department of Health and Human Services (“HHS” or “the Department”) and the Centers for Medicare & Medicaid Services (“CMS” or “the Agency”) rescinded July 2022 guidance that reminds hospitals of their longstanding obligation under EMTALA and that protects pregnant women’s access to emergency abortion care, regardless of where they live. While EMTALA remains binding federal law, the rescission will create further confusion for hospitals and providers, especially in states with abortion bans, and will result in medically-necessary care being withheld from pregnant patients in crisis.
    In 1986, Congress enacted EMTALA to require Medicare-participating hospitals to provide necessary stabilizing screening and treatment for any individuals—including pregnant women—experiencing emergency medical conditions. Under the law, hospitals are required to treat conditions determined by health care providers that, absent immediate medical attention, could reasonably result in placing the patient’s health in serious jeopardy, serious impairment to bodily functions, or serious dysfunction of any bodily organ. EMTALA clearly requires hospitals to offer abortion care for cases in which their health care providers determine it medically necessary to prevent serious harm to their patients’ health and life, including in, but not limited to, cases of ectopic pregnancy, complications of pregnancy loss, or emergent hypertensive disorders, such as preeclampsia with severe features. Since enacting EMTALA, Congress and administrations of both parties have consistently recognized that stabilizing care under the statute includes abortion. As a result, up until a few years ago, medical providers have not had to worry about the government interfering with their clinical judgement to provide necessary stabilizing medical care to pregnant women in emergencies.
    Following the Supreme Court’s decision in Dobbs v. Jackson Women’s Health (Dobbs) in June 2022, 22 states passed laws to ban or severely restrict access to abortion, including 6 states with no exception for the health of the pregnant person. This has disrupted decades of certainty that hospitals are required to provide access to emergency abortion care under federal law, sowing chaos for patients and providers alike, and forcing doctors to play lawyers and lawyers to play doctors. When doctors are forced to navigate the complex legal interplay of state abortion bans and federal EMTALA protections, pregnant people experience care delays and may receive substandard care. In response to the confusion caused by these restrictive abortion bans, HHS Secretary Becerra issued guidance in July 2022 restating hospitals’ legal obligation under federal law to provide stabilizing treatment, including necessary abortion care, to pregnant patients in emergency situations. Even with such guidance in place, physicians across the country report that hospitals fail to meet the challenge of supporting doctors in navigating this extraordinary legal environment and, in many cases, hospitals continue to rely on guidance developed pre-Dobbs. While Republican-led states and anti-abortion groups have tried to challenge proper meaning and scope of the federal law, EMTALA has always and will continue to protect emergency abortion care and preempt all state laws to the contrary.
    The Trump administration’s decision to rescind this guidance will create more confusion, fear, and stress for hospitals and their staffs about what care they are legally required to provide pregnant patients whose lives are or could be in danger. Moreover, it will undermine patients’ faith that their doctor will be able to act in their best interest in the event of an emergency. State abortion laws with vague medical exceptions and criminal penalties force hospitals and physicians to delay and deny emergency abortion care for pregnant patients, placing patients at higher risk for medical complications, lasting health consequences, and avoidable death.
    By rescinding the guidance, HHS has needlessly put pregnant patients at severe risk of harm and preventable death. Given the threat to women’s lives following the rescission of this guidance, we request information and responses to the following questions by July 3, 2025, at 5:00pm ET.
    In your recent announcement regarding the decision to rescind the July 2022 guidance, you stated that the July 2022 guidance “d[id] not reflect the policy of this Administration” with respect to EMTALA.
    What is the Administration’s policy related to EMTALA for pregnant patients who are experiencing emergency medical conditions that could result in serious bodily harm or death?
    When did the Administration develop this policy related to EMTALA?
    Which stakeholders and individuals did the Administration consult in the development of this policy?
    In the same announcement, you stated that “CMS would continue to enforce EMTALA … [for] all individuals who present to a hospital emergency department seeking examination or treatment.”
    How will CMS enforce EMTALA, specifically for pregnant patients or patients experiencing pregnancy loss who are facing life-threatening or other serious emergency medical situations?
    How will CMS and its remaining regional offices adjudicate on and refer for investigation EMTALA complaints involving delayed or denied necessary emergency abortion care? 
    Does CMS and the Department of Health and Human Services Office of the Inspector General (HHS-OIG) have sufficient resources and personnel to investigate violations of EMTALA? Please provide detailed information on the number of employees and federal funding that HHS has available to investigate complaints of EMTALA violations.
    Please provide a list of EMTALA complaints since June 24, 2022, involving delayed or denied necessary emergency abortion care by state, hospital, incident date, nature of allegation, investigation status, recommended action by surveyors, and final action in accordance with the Privacy Act of 1974 (5 USC § 552a).
    The announcement also stated, “CMS will work to rectify any perceived legal confusion and instability created by the former administration’s actions.”
    Did CMS provide any advance notice to states – including state survey agencies – about the decision to rescind the July 2022 guidance before it was announced?
    Did CMS provide any advance notice to hospitals about the decision to rescind the July 2022 guidance before it was announced?
    Did CMS provide any advance notice to professional physician organizations about the decision to rescind the July 2022 guidance before it was announced?
    What specific steps will CMS take to address the legal confusion of patients, hospitals, and physicians caused by state abortion bans conflicting with federal law?
    Has the Administration created any materials to educate patients, hospitals, and physicians about this policy? If so, please produce them.
    The July 2022 guidance reaffirmed the longstanding legal and professional obligation hospitals have to provide patients with emergency abortion care under EMTALA.
    Will CMS issue new guidance making it clear to hospitals that they are legally required to follow EMTALA by providing stabilizing treatment for patients experiencing a medical emergency, including where that treatment is an abortion?
    Will CMS issue updates or require changes to the Medicare provider agreements for hospitals?
    Will CMS issue new guidance to state survey agencies related to EMTALA investigations?
    This abrupt decision will further the chaos and confusion that hospitals, physicians, and patients have experienced since the Dobbs decision and will result in negative and deadly consequences for women and families across the United States. HHS should immediately reverse its decision to rescind the guidance.

    Insights from the 2025 AI in Education Report

    In times of change and innovation, the need for insights and examples of impact becomes increasingly important. That’s why we’re sharing the 2025 AI in Education Report which highlights key findings across AI usage, concerns, and opportunities alongside learnings and progress from global institutions.

    According to the report, AI in education is advancing daily with over 80% of surveyed educators using AI this year, up 21 points from last year as its role expands from just an assistant to a thought partner and force multiplier. At the same time, approximately one in three surveyed United States K-12 educators still lack confidence in using AI effectively and responsibly and more than half of surveyed students report that they have not received AI training.1

    It’s critical to engage with students, educators, and all community stakeholders to address challenges, learn together, and co-develop the path forward. Further, we need to collectively prepare for an AI-powered future and support students in building relevant AI skills as every industry and discipline evolves.     Enhancing instruction with Microsoft 365 Copilot and Microsoft Learning Zone

    Microsoft 365 Copilot delivers the latest AI innovations whether through reasoning agents like Researcher and Analyst, or advanced functionality like Copilot Tuning. Institutions such as Brisbane Catholic Education and Miami Dade College are saving time to reinvest into meaningful work and beginning to explore new capabilities like agents. We’re also collaborating with Learning Management System (LMS) providers like Canvas and Moodle to take the power of agents a step further by supporting integration with Copilot through open-source, customizable samples.

    We told our staff: you have permission to try, and permission to fail. That opened the door for teachers to test Microsoft 365 Copilot and Copilot Chat without fear of judgment or wasted time. And guess what? Most of the time, those experiments don’t fail—they spark new ways of thinking.

    We recently introduced the updated Microsoft 365 Copilot app, your hub for the latest functionality and later this year in preview, for AI-powered features for educators. In one place, educators will be able to easily create lesson plans, draft materials like quizzes and rubrics, and quickly make modifications like translation, adjusted reading levels, length, difficulty, alignment to relevant standards, and more.

    We’re announcing Microsoft Learning Zone, a free, AI-powered learning app and the first Copilot+ PC experience purpose built for educators to create personalized, adaptive learning activities.2 Formerly known as the code name Project Spark, the experience will launch in public preview later this summer on Copilot+ PCs, including Microsoft Surface, and across the Windows ecosystem. It’s powered by new AI innovation, learning science, educator input, and features like lesson creation, customizable tools to meet learning goals, and data-driven insights.

    Microsoft Learning Zone is built on collaborations with organizations such as NASA, The Economist Educational Foundation, PBS NewsHour, Figma, and Minecraft Education to bring real-world relevance into the classroom. It also includes integration with Kahoot! to generate interactive games and OpenStax for content from vetted open educational resources.

    Using Microsoft Learning Zone in the classroom has been an exciting opportunity to explore innovative ways to engage students. I was impressed by the app’s intuitive layout and how easily I could edit and share content with my class. While still in its early stages, Learning Zone shows great potential for helping teachers create AI-driven educational resources.

    Preparing students for academic and career success

    Students at the Kelley School of Business at Indiana University and University of South Carolina are already seeing academic and career preparedness gains with Microsoft 365 Copilot. Copilot Notebooks are now included, and we’re looking forward to bringing even more value with a study guide experience, in preview later this year. Study guide creation is designed to help students, or educators, turn scattered materials into an organized study space with engaging learning activities and content like podcasts instantly. It will include flashcards, fill in the blanks, matching exercises, quizzes, and the ability to review progress.

    In some job interviews recently, I’ve actually been asked about my experience with AI and if I know how to use it efficiently to help manage workflows. Copilot will really help students stay at the forefront of today’s changing world and make them more marketable.

We’re now sharing that general availability is expected in late July 2025. To prepare, administrators should review guidance to enable Copilot Chat for students and help ensure appropriate access.

    As AI usage and innovation increases, so does the need for training resources that empower educators and students alike. We’re continuing to provide opportunities to build essential skills—from immersive activities in Minecraft Education AI Foundations, to equipping preservice educators with ISTE+ASCD, providing hands-on cybersecurity experience for students, and offering GitHub Certifications on Microsoft Learn and Pearson VUE.

    We’ll also continue highlighting new evidence of impact such as the recent World Bank study in Nigeria, where a pilot program deployed Copilot, which stated that a “cost-effectiveness analysis revealed substantial learning gains, equating to 1.5 to years of ‘business as usual’ schooling, situating the intervention among some of the most cost-effective programs to improve learning outcomes.”

  • MIL-OSI United Nations: New Initiative Sets Out to Ensure 10 Million Safer Births Under the Patronage of Her Majesty The Queen of Denmark

    Under the patronage of Her Majesty Queen Mary of Denmark, UNFPA, the UN sexual and reproductive health agency, and Danish NGO Maternity Foundation announced the 10 Million Safer Births Initiative in Abuja, Nigeria on 24 June, 2025. The initiative is driven by an ambitious commitment to support 10 million births across Sub-Saharan Africa by the end of 2030.

    Sub-Saharan Africa accounts for 70 per cent of all maternal deaths worldwide. Despite a 40 per cent decline in the global maternal mortality rate since 2000, progress has slowed, and multiple global crises now threaten to reverse these gains. Every two minutes, a woman dies from pregnancy or childbirth-related causes, and for every woman who dies, 20-30 suffer acute to severe disability — most of which are preventable.

    Her Majesty The Queen of Denmark announced her patronage of the 10 Million Safer Births Initiative.

    “No woman should risk life to give life,” said The Queen. “I am honoured to announce my patronage of this very concrete initiative, which aims to ensure 10 million safer births by end 2030 across Sub-Saharan Africa.”

    ​​The first phase of the initiative will be able to deliver targeted support to midwives and frontline health workers to strengthen maternal and newborn care in Nigeria, Ethiopia, and Tanzania.  

    The support will include the scaling up of Maternity Foundation’s widely used Safe Delivery+ programme, which includes the free Safe Delivery App. The app provides healthcare professionals, particularly midwives in low-resource settings, with access to evidence-based guidelines and video demonstrations on preventative, routine, and emergency maternal and newborn care, on their mobile devices. This enables them to prevent or manage life-threatening situations more effectively, ultimately improving maternal and newborn health and survival rates. 

    The Government of Denmark and the Gates Foundation are supporting the initiative.  Denmark will provide a DKK 32 million (USD 4.9 million) investment. The Gates Foundation intends to allocate an additional USD 1.5 million as part of its support to scaling up midwifery models of care under the Midwifery Accelerator initiative.

    “Denmark is proud to support this bold, innovative initiative,” said Danish Foreign Minister Lars Løkke Rasmussen. “Every woman has the right to give birth safely, and we are committed to making that a reality.”

    “Healthy mothers and babies are the foundations of vibrant communities—and midwives play a key role in helping them thrive,” said Dr. Paulin Basinga, Africa Director of the Gates Foundation. “The 10 Million Safer Births initiative is about more than saving lives—it’s about equality. Too many women in Africa face life-threatening risks in childbirth simply because of where they live. By coming together across sectors and borders, we have a real opportunity to close that gap and transform care at the very start of life.”

    “Access to quality midwifery care can spell the difference between life and death for women and their babies,” said UNFPA Executive Director Dr. Natalia Kanem. “The 10 Million Safer Births Initiative will give midwives the tools to save lives in some of the most challenging settings. UNFPA is grateful to Her Majesty Queen Mary of Denmark and the Danish Government and Gates Foundation supporting this important effort to make childbirth safer.”

    “We will not close the gap in maternal mortality by 2030 by doing the same as we always did. We need to rethink the way things are done. This initiative brings together innovation, data, and collaboration across sectors to strengthen maternal care where it’s needed most.,” said Anna Frellsen, CEO of Maternity Foundation. “Together, we can transform outcomes for millions of women and their newborns.”

    The 10 Million Safer Births Initiative is a flagship programme implemented through UNFPA’s Maternal and Newborn Health Fund, which provides catalytic support to ensure that every woman, adolescent girl and newborn can access quality sexual, reproductive, maternal and newborn health services.

  • MIL-OSI Canada: Government of Canada celebrates National Shipbuilding Strategy milestones at Irving Shipbuilding

    Through the National Shipbuilding Strategy (NSS), the Government of Canada is committed to strengthening its sovereign shipbuilding capabilities and supply chains so that the Royal Canadian Navy (RCN) and the Canadian Coast Guard (CCG) are equipped to conduct operations at home and alongside allies in an increasingly complex environment.  

    Today, the Honourable Kody Blois, Parliamentary Secretary to the Prime Minister, on behalf of the Honourable Joël Lightbound, Minister of Government Transformation, Public Works and Procurement, joined Vice-Admiral Angus Topshee, Commander of the RCN, and other dignitaries to celebrate significant progress on the Arctic and offshore patrol ships (AOPS) and River-class destroyers (RCD) being constructed at Irving Shipbuilding Inc. (ISI). The AOPS and RCD are critical NSS initiatives that will bolster Canada’s naval strength and economic resilience for decades to come.

    Parliamentary Secretary Blois commended ISI on its AOPS project achievements. The AOPS project for the RCN will be completed this year, with delivery of the sixth and final ship, the future His Majesty’s Canadian Ship (HMCS) Robert Hampton Gray, anticipated this summer.

    The AOPS project for the CCG is also progressing, with the launch of the first ship, the future Canadian Coast Guard Ship (CCGS) Donjek, anticipated in 2026. Construction of the second ship, the future CCGS Sermilik, continues to advance.

    In addition, ISI is pivoting to the future and ramping up production for the RCD project. Parliamentary Secretary Blois highlighted that full-rate production on the first RCD, the future HMCS Fraser, is now underway, with delivery of this ship anticipated in the early 2030s. The shipyard will continue to integrate lessons learned from the earlier production of an RCD test module, as well as the AOPS project, into the construction process.

    Beyond new ship construction, ISI is supporting the ongoing operational readiness of the RCN’s Halifax-class frigates until the arrival of the RCD. The shipyard is conducting repair and maintenance activities on HMCS Halifax, with anticipated completion next year.

    This year marks the 15th anniversary of the NSS. Since its inception, the strategy has revitalized Canada’s marine industry, fostered innovation and created a skilled workforce. NSS contracts awarded between 2012 and the end of 2024 are estimated to have contributed close to $38.7 billion to Canada’s gross domestic product (GDP) and created or maintained approximately 21,400 jobs annually between 2012 and 2025.

    The Government of Canada remains committed to advancing shipbuilding projects that equip the RCN, the CCG and Transport Canada with modern, capable vessels. The NSS will continue to evolve through the integration of lessons learned and close collaboration with industry partners to continue to deliver important benefits for Canadians.

NSS contracts awarded between 2012 and the end of 2024 are estimated to have contributed close to $38.7 billion to Canada’s gross domestic product (GDP) and created or maintained approximately 21,400 jobs annually between 2012 and 2025.

  • MIL-OSI USA: CWA District 1 Slams New Jersey Budget Deal for Punishing New Jersey Working Families with Higher Healthcare Costs in Backroom Agreement

    TRENTON, N.J. ‒ The Communications Workers of America (CWA) District 1 today sharply condemned Governor Murphy, Speaker Coughlin, and Senate President Scutari for approving a budget deal that forces state employees and retirees to shoulder an arbitrary $100 million healthcare cut on top of unprecedented healthcare premium increases.

    “Working men and women across New Jersey—from nurses and clerks to office workers and caseworkers—were blindsided,” said Billy Gallagher, Assistant to the Vice President, CWA  District 1. “This backroom budget gamble shifts costs onto the backs of the very people who keep our state running, while violating collective bargaining rights and threatening every single union in this state.”

    The budget agreement made public earlier this week through the media, leaving legislators themselves completely out of the loop, requires the Plan Design Committee (PDC) to gut health benefits for middle-class public workers, increasing co-pays, increasing deductibles, and increasing out-of-pocket costs for 100,000 working families. If the PDC cannot come up with adequate savings, the legislature would be forced to do it. If that fails, it moves on to a newly invented “neutral” arbitration panel.

    By requiring the PDC, the legislature, or an arbitration panel to be involved, the negotiated process outlined in CWA’s collective bargaining agreement is sidelined. By agreeing to this deal, the Governor and Legislative leadership are putting every legislator in the position to vote against collective bargaining rights—and put themselves in the middle of making future benefits decisions while ignoring much-needed relief for State and Local Governments.

    overnor Kathy Hochul today joined millions of New York students, teachers, and parents to celebrate the last day of public school statewide, marking the end of digital distractions in our schools. When the 2025-2026 school year begins this fall, New York will become the largest state in the nation to restrict smartphones and other internet-enabled personal devices throughout the entire school day – from bell to bell. Education leaders and advocates also marked this “end of an era” to applaud New York’s shift to distraction-free learning and highlight its benefits for students’ academic performance and mental health.

    “I’ll never stop working to deliver the best results for our kids – and that’s why the era of smartphone distractions in New York schools ends today,” Governor Hochul said. “My team is working with key stakeholders across the state to ensure school districts finalize and publish their distraction-free policy by the August 1 deadline. When students return this fall, New York’s distraction-free schools will deliver the best possible learning environments – and they’ll help give our kids their childhood back.”

    Secretary Hillary Rodham Clinton said, “I am proud to work with Governor Hochul and partners in New York to usher in distraction-free schools. This bold new law will foster learning and healthy development for students in the state and help set the standard for states across the country.”

    After being signed by Governor Hochul last month, New York State’s distraction-free school law will be in effect for the 2025-26 School Year. It applies to all schools statewide in public school districts, as well as charter schools and Boards of Cooperative Educational Services (BOCES).

    Under this law, all school districts must publish their distraction-free policy by August 1, so it is visible to the district’s community of students, parents and other key stakeholders.

    New York State’s Distraction-Free Schools Law:

    • Prohibits unsanctioned use of smartphones and other internet-enabled personal devices on school grounds in K-12 schools for the entire school day (from “bell to bell”), including classroom time and other settings like lunch and study hall periods
    • Allows schools to develop their own plans for storing smartphones during the day — giving administrators and teachers the flexibility to do what works best for their buildings and students
    • Secures $13.5 million in funding to be made available for schools that need assistance in purchasing storage solutions to help them go distraction-free
    • Requires schools to give parents a way to contact their kids during the day when necessary
    • Requires teachers, parents and students to be consulted in developing the local policy
    • Prevents inequitable discipline

    Governor Hochul’s policy clarifies that students will have authorized access to simple cellphones without internet capability, as well as internet-enabled devices officially provided by their school for classroom instruction, such as laptops or tablets used as part of lesson plans.

    Additionally, the Governor’s policy includes several exemptions to smartphone restrictions, including for students who require access to an internet-enabled device to manage a medical condition, where required by a student’s Individualized Education Program (IEP), for academic purposes, or for other legitimate purposes, such as translation, family caregiving and emergencies.

    Governor Hochul pursued this initiative after engaging in a statewide listening tour with teachers, parents, and students. Her report “More Learning, Less Scrolling: Creating Distraction-Free Schools” underscores the following:

    • Smartphones distract students and inhibit learning and creativity
    • Phone-free environments do not compromise student safety
    • Phone-free environments support the mental health of students and teachers
    • Open communication and direct guidance for all stakeholders is key for successful implementation
    • Schools must address any parent concerns about staying in contact with their children during the day
    • An effective distraction-free policy must focus on the entire school day, rather than solely on time in the classroom
    • Schools can strengthen their distraction-free environment by connecting more students with in-person engagement like clubs, sports, arts and other programming

    With this new law, Governor Hochul is leading a national movement to restore focus, connection and well-being in the classroom. By prioritizing distraction-free learning, New York is providing students with the environment they need to thrive academically, socially and emotionally.

    overnor Kathy Hochul today announced the completion of a project that transformed the Saratoga County Airport into a world-class travel destination, substantially upgrading the airport’s facilities and services to further position the region for greater economic growth and expanded tourism. The reimagined airport features a new terminal building that boasts a spacious lobby, a new passenger waiting area, car rental space, a pilot’s lounge, and restaurant, along with a brand new adjacent 20,000 square-foot hangar, among other upgrades. Funded with $27 million from the Governor’s $230 million Upstate Airport Economic Development and Revitalization Completion, the project has revitalized the more than 80-year-old facility into a state-of-the-art gateway that will welcome visitors and become an exciting destination for local residents.

    The new facility, with its enhanced passenger and public amenities, is anticipated to further stimulate the local economy, according to the latest data from a State Department of Transportation survey that estimated the airport’s economic impact exceeds $9.7 million.

    “Regional airports like Saratoga County are catalysts for business, tourism and economic vibrance — injecting millions into local economies and building the foundations of a brighter future,” Governor Hochul said. “Saratoga is a crown jewel of our state, and whether you’re off to the races, traveling for business or coming home to New York, this world class facility will welcome you with open arms.”

    Built in 1943, the former facility was little more than a hangar that also served as an office space, passenger waiting area, flight planning area and conference room. The completely transformed facility now includes a conference space and a public restaurant operated by the owners of the well-known Alexis Diner in Rensselaer County — offering breakfast, lunch and dinner for diners seeking a unique aviation setting. The main lobby, outdoor patio, second-floor conference room and restaurant are all available for public use.

    Visitors will enter the spacious lobby, which features a carpet in the shape of Saratoga Lake, reflecting the area’s natural beauty. A grand staircase leads to the second-floor conference room and dining area, with an adjacent balcony overlooking the runway. In addition to the impressive amenities inside, the facility has a slate and timber exterior, and circular drive adorned with roses and featuring a bronze statue of a jockey riding a racehorse at its center — paying tribute to Saratoga’s horse racing heritage.

    The terminal building and connected hangar were built sustainably, featuring solar panels on the hangar roof, and geothermal wells for heating and cooling. EV chargers were also installed in the facility’s parking lot.

    The estimated $35.9 million project created approximately 390 jobs, and a project labor agreement guaranteed a skilled and trained workforce receiving fair wages, benefiting local economies and families across the region.

    The Saratoga County Airport was one of nine airports that received a share of a total of $230 million in Governor Hochul’s round of Upstate Airport Economic Development and Revitalization Competition funding announced in September 2022. This funding is not only upgrading New York’s Upstate airports, but it is also enhancing their ability to compete on the national and global aviation stage.

    New York State Department of Transportation Commissioner Marie Therese Dominguez said, “Governor Hochul’s strategic investment in our upstate airports is yielding huge dividends throughout New York, facilitating the growth of business and tourism in communities across our state. The new Saratoga County Airport represents our Governor’s vision for spaces that harmonize the role of our local economies with transportation needs and places that our community members will enjoy. Today, we are celebrating a major milestone for the Saratoga Region and everyone who visits, works here, or calls this region their home.”

    The Saratoga County Airport handles private aircraft with two runways and is operated by fixed based operator, North American Flight Services. Major construction began in January 2024 with work completed in time for the 2025 Belmont Stakes at the Saratoga Race Course. Improvements include:

    • Construction of a new fixed base operator terminal building to include new waiting areas; concessionaire tenant spaces; rental car lease space; advertisement display lease opportunities; conference room space; weather information access station; pilot lounge area; and connected 20,000 square-foot hangar space
    • Installation of solar panel array on hangar portion of new terminal building
    • Installation of geothermal wells for heating and cooling
    • Rehabilitation of the apron connecting to new terminal building

    The Upstate Airport Economic Development and Revitalization Competition is administered by the New York State Department of Transportation and was open to upstate commercial passenger service airports and airports providing specialized service for commercial aircraft and/or corporate jets. Applicants were encouraged to apply for funding a single project or a program of projects to help meet the demands of the 21st century. Projects submitted for review by eligible airports were evaluated based on established criteria, including, but not limited to innovation in design, passenger amenities and experience, operational efficiencies and economic effectiveness for the airport’s region.

  • MIL-OSI Security: Headed to Prison: Disbarred South Florida Lawyer Who Stole Client Funds

    MIAMI – A federal district judge in Ft. Lauderdale sentenced disbarred lawyer John Spencer Jenkins yesterday to 33 months’ imprisonment for misusing more than three quarters of a million dollars of his clients’ money.  

    According to plea documents and information provided during the sentencing hearing, Jenkins’ clients wired funds into his law firm’s Interest on Trust Account (“IOTA”) business account and general business account for the purpose of receiving legal services from Jenkins. In relation to his representation of one client’s estate, Jenkins admitted that the executor of the estate wired funds into his business accounts so that Jenkins would manage the distribution of the assets among his client’s designees.  However, Jenkins wired those funds into separate accounts for his own personal use.

    During the sentencing hearing, Judge David S. Leibowitz emphasized the importance of holding accountable people with Bar cards because they are uniquely situated with holding the public’s trust as licensed attorneys.

    U.S. Attorney Hayden P. O’Byrne for the Southern District of Florida and Special Agent in Charge Brett Skiles of the FBI Miami made the announcement.

    FBI Miami investigated the case. Assistant United States Attorney Altanese Phenelus prosecuted it.

    Linda Sun Falsified Information to Cause Approval of NYS Contracts Awarded to Businesses Operated by her Family Member and her Husband

    BROOKLYN, NY – A federal grand jury in Brooklyn yesterday returned a second superseding indictment that added charges against Linda Sun and her husband and co-defendant Chris Hu related to a fraudulent scheme involving procurement of personal protective equipment (PPE) by the New York State (NYS) government at the start of the COVID-19 pandemic.  As part of the scheme, Sun steered contracts to vendors with whom she had undisclosed personal connections, and she and Hu received millions of dollars from the vendors, including some in the form of kickbacks, which Sun did not disclose to the NYS government.  The new charges against Sun and Hu include honest services wire fraud, honest services wire fraud conspiracy, bribery, and conspiracy to defraud the United States.  Additionally, Hu is charged with tax evasion.  The defendants will be arraigned on Monday, June 30, 2025.

    Joseph Nocella, Jr., United States Attorney for the Eastern District of New York; Christopher G. Raia, Assistant Director in Charge, Federal Bureau of Investigation, New York Field Office (FBI); and Harry T. Chavis, Jr., Special Agent in Charge, Internal Revenue Service-Criminal Investigation (IRS-CI New York), announced the new charges.

    “As alleged, Linda Sun not only acted as unregistered agent of the government of the People’s Republic of China, but also enriched herself to the tune of millions of dollars when New York State was at its most vulnerable at the start of the COVID-19 pandemic,” stated United States Attorney Nocella.  “When masks, gloves, and other protective supplies were hard to find, Sun abused her position of trust to steer contracts to her associates so that she and her husband could share in the profits.  We demand better from our public servants, and this Office will continue to hold accountable public officials who enrich themselves at the expense of the New York taxpayers.”

    Mr. Nocella expressed his appreciation to the Department of Justice’s National Security Division, the New York State Office of the Inspector General, the New York State Police, and the U.S. Department of State’s Diplomatic Security Service (DSS) for their work on the case.  He also thanked the New York State Executive Chamber for its cooperation with the investigation.

    “During a global pandemic, Linda Sun allegedly leveraged her authority within the New York State government to secretly steer contracts to selective PPE vendors in exchange for millions of dollars in kickbacks to her and her husband,” stated FBI Assistant Director in Charge Raia.  “This alleged scheme not only created an unearned and undisclosed benefit for the defendants and their relatives, but it also exploited the state’s critical need for resources in a health crisis. The FBI will never tolerate any public official who abuses their position to profit at the expense of others, especially when their objectives align with foreign agendas.”

    “Not only did Sun allegedly use Chinese money and her influence in New York State to benefit the Chinese government, it is further alleged that she used her position to steer multi-million-dollar contracts to companies controlled by family members and friends.  With this investigation, this husband-and-wife team with supposed ties to corruption has been rooted out, and they will soon understand that in legitimate government spending, there is no friends and family discount,” stated IRS-CI New York Special Agent in Charge Chavis.

    As alleged in the superseding indictment, at the outset of the COVID-19 pandemic and while working with the team of NYS government employees responsible for obtaining PPE, Sun used her position of influence with the government of the People’s Republic of China (PRC) to coordinate the NYS government’s purchase of PPE from vendors located in the PRC.  In addition to certain vendors referred by the PRC government, Sun referred two vendors (the Cousin Company and the Associate Company) that were not recommended by the PRC government but rather had ties to Sun and Hu, while claiming falsely that these, too, were referrals from components of the PRC government.  In reality, the Cousin Company was operated by one of Sun’s second cousins, and the Associate Company was operated by Hu and one of Hu’s business associates.  With Sun’s assistance, the Cousin Company and the Associate Company each entered into multiple contracts with the NYS government worth millions of dollars apiece.

    Sun, the Associate Company, and the Cousin Company did not disclose to the NYS government (1) the fact that Sun and Hu had relationships with the Associate Company and the Cousin Company, or (2) that Sun and Hu received a portion of the profits that the Associate Company and the Cousin Company made as a result of their contracts with the NYS government for PPE, including through kickback payments from the Cousin Company.

    To conceal her relationship with the Cousin Company from procurement authorities at the NYS government, Sun falsified a document to suggest that the Jiangsu Department of Commerce had recommended the Cousin Company.  On or about March 20, 2020, Sun and other NYS government officials received an email from the U.S. representative to the Jiangsu Trade & Business Representative Office in Albany, New York suggesting four PRC-based vendors who were able to provide PPE for the NYS government.  On or about March 21, 2020, Sun forwarded herself an altered version of the email in which she replaced the first suggested vendor—a vendor that produced ventilators—with the Cousin Company and wrote that the Cousin Company was recommended by the Jiangsu Department of Commerce.

    On or about March 24, 2020, in an email with the subject line “Already VERIFIED by Linda Sun,” Sun wrote to NYS procurement officials that the Cousin Company “came recommended by Jiangsu Chamber of Commerce,” that the representative had helped “screen potential vendors,” and that the Cousin Company’s surgical mask was the “gold standard.”  Below Sun’s message was what purported to be quoted text from the Jiangsu Chamber of Commerce’s email recommending vendors. However, the email in the quoted text was the altered email.

    In connection with the Cousin Company contracts with the NYS government, a spreadsheet maintained on Sun and Hu’s personal computer indicated that the Cousin provided payments to Hu (and Sun) totaling approximately $2.3 million during 2020 and 2021.  These kickbacks from the Cousin Company represented taxable income.  Hu did not report these payments as income to the U.S. government, as required, or pay taxes on this income in Forms 1040 for 2020 and 2021 that he filed on behalf of himself and Sun.

    In part, Hu laundered the income from the Cousin Company by having the Cousin make $1.5 million in payments in three $500,000 increments from another entity that the Cousin owned (the Cousin Entity) to U.S. accounts at a financial institution.  Hu created these accounts in a close relative’s name instead of his own on April 29, 2020, two days before the final $6 million payment from NYS government to the Cousin Company.

    Sun also arranged for the Associate Company to be a vendor for NYS government contracts.  On March 14, 2020, Sun wrote an email with the subject “Mask suppliers” to other members of the NYS government PPE task force with procurement authority and listed the Associate Company as a potential supplier.  Sun subsequently communicated with the Associate Company by email to obtain a price quote for the contract and provided a status update to the NYS government about the contracts with the Associate Company.

    A computer owned by the defendants contained a NYS internal document tracking various state PPE contracts, broken out by vendor.  One of the fields in the document contained, for each company, an answer to the question “why did we do business with this vendor?”  For the Associate Company, the answer to the question was listed as: “referred by Chinese chamber of commerce.”  However, there was no such referral for the Associate Company.

    According to a spreadsheet found in one of Hu’s electronic accounts, the total profits Hu expected to reap from the contracts that the Associate Company and the Cousin Company had with the NYS Department of Health totaled $8,029,741.  Hu marked the column for these expected profits with the word “me.”

    The new charges are in addition to the existing charges against Sun, which include violating and conspiring to violate the Foreign Agents Registration Act, visa fraud, alien smuggling, and money laundering, and the existing charges against Hu, which include money laundering conspiracy, money laundering, as well as conspiracy to commit bank fraud and misuse of means of identification.  The charges in the superseding indictment are allegations and the defendants are presumed innocent unless and until proven guilty.

    The government’s case is being handled by the Office’s National Security and Cybercrime Section.  Assistant United States Attorneys Alexander A. Solomon, Robert M. Pollack, and Amanda Shami are in charge of the prosecution, with the assistance of Trial Attorney Eli Ross from the National Security Division’s Counterintelligence and Export Control Section and Litigation Analyst Emma Tavangari. Assistant U.S. Attorney Laura Mantell of the Office’s Asset Recovery Section is handling forfeiture matters.
