  • MIL-OSI Australia: Arrests – Aggravated assault – Palmerston

    The Northern Territory Police Force has arrested three females in relation to an aggravated assault that occurred outside a small shopping precinct in Palmerston yesterday afternoon.

    About 3:15pm, the Joint Emergency Services Communication Centre received reports of a female being assaulted by a group of four females. Police allege the female was struck to the head with a bottle and further hit with blunt objects before a male bystander tried to intervene and was also assaulted.

    The group fled the scene before police arrival but were arrested nearby a short time later and conveyed to the Palmerston Watch House.

    St John Ambulance attended and conveyed the female victim to Royal Darwin Hospital for medical assessment. The male was treated for minor injuries at the scene.

    Three females, aged 30, 58 and 59, are expected to be charged at a later date. One of the alleged offenders remains outstanding and Serious Crime detectives have carriage of the investigation.

    Anyone with information in relation to the incident is urged to contact police on 131 444. Anonymous reports can be made via Crime Stoppers on 1800 333 000.

  • MIL-OSI Asia-Pac: LCQ21: Measures to promote STEAM education

         Following is a question by the Hon Lillian Kwok and a written reply by the Secretary for Education, Dr Choi Yuk-lin, in the Legislative Council today (April 30): 

    Question:

         It is learnt that the Government is committed to promoting STEAM (i.e. Science, Technology, Engineering, Arts and Mathematics) education and has provided schools with support measures, including offering learning grant schemes, optimising curriculum framework and enhancing teacher training. In this connection, will the Government inform this Council:

    (1) of the frequency of upgrading artificial intelligence (AI) teaching equipment and the coverage of smart classrooms in various publicly-funded primary and secondary schools in Hong Kong over the past three years;

    (2) whether the Government will formulate guidelines and specifications in relation to AI ethics education and data security for schools; if so, of the details; if not, the reasons for that;

    (3) given that the Quality Education Fund (QEF) has implemented the e-Learning Ancillary Facilities Programme to promote co-operation between the education and business sectors for the development of e-learning ancillary facilities that meet local education needs, and that the QEF will also sponsor schools to use the deliverables of the projects under the Programme, of the number of schools which have purchased the e-learning ancillary facilities developed under the Programme with the subsidy of the QEF since the launch of the Programme, and the details of such ancillary facilities; and

    (4) of the number of schools currently adopting the teaching materials of the Enriched Module on Coding Education for Upper Primary Level and the Module on AI for Junior Secondary Level, and whether the Government will step up its efforts in promoting the adoption of such teaching materials by schools; if so, of the details?

    President,

         The Education Bureau (EDB) has been stepping up its efforts to promote STEAM (Science, Technology, Engineering, Arts and Mathematics) education and digital education in primary and secondary schools. Through a range of diversified strategies, including ongoing curriculum renewal, strengthening teacher training, optimising education ancillary infrastructure, providing resource support, and organising student activities, the EDB assists schools in harnessing innovation and technology (I&T) (including artificial intelligence (AI)) to enhance the digital literacy and competence of both teachers and students, and foster learning and teaching effectiveness, with a view to nurturing talent for the future. Meanwhile, we have been enhancing our efforts in promoting media and information literacy to enable students to use digital technology effectively and ethically in daily life and learning.

         Our consolidated reply to the written question raised by the Hon Lillian Kwok is as follows:

    Enhancing curriculum related to I&T (including AI)

         The EDB launched the Module on AI for Junior Secondary Level in the 2023/24 school year, with the aim of developing students’ understanding of AI and its applications. The EDB also launched the Enriched Module on Coding Education for Upper Primary Level to prepare primary school students for further studying the basics and applications of AI and big data in secondary schools. The Module on AI for Junior Secondary Level covers topics such as AI basics, AI ethics, societal impact and future of work, and enables teachers and students to learn about the ethics and appropriate application scenarios of AI, as well as relevant security topics such as personal data privacy and data security. At present, almost all publicly-funded primary and secondary schools have implemented the enriched coding education and AI education at the upper primary level and the junior secondary level respectively.

    Developing relevant learning and teaching resources

         Last year, the EDB launched the updated “Information Literacy for Hong Kong Students” Learning Framework (2024) to cover education on AI ethics and data security. Apart from this, the EDB has also been developing various learning and teaching resources, including those on AI ethics education and data security. In collaboration with the Hong Kong Police Force and the Journalism Education Foundation, the EDB has launched the learning and teaching resources on Cyber Security and Technology Crime Information and Media and Information Literacy respectively, which include content to enhance students’ ability to discern the authenticity of information and promote the proper use of social media.

    Providing professional development training for in-service teachers

         To tie in with the implementation of the above I&T curriculum modules, the EDB has continuously enhanced teacher training and strengthened the promotion and support for schools to adopt these modules. Since the 2023/24 school year, the EDB has organised 22 sessions of professional development programmes on AI education for the junior secondary level, with over 650 participating teachers. As for primary schools, a total of over 60 sessions of training programmes on coding education have been organised, with the attendance of over 1 550 teachers. The training programmes are conducted in both online and offline modes to benefit a greater number of teachers. In addition, the EDB has actively provided teachers with AI-related professional development programmes, covering topics like the development of AI, planning of applying AI in teaching and learning, as well as the application of AI tools in different subjects, and including such themes as safeguarding data security.

    Strengthening digital education ancillary infrastructure

         The Quality Education Fund (QEF) has included STEM/STEAM education as one of the priority themes and implemented the Dedicated Funding Programme for Publicly-funded Schools starting from the 2018/19 school year. From the 2018/19 to 2023/24 school years, the QEF approved over 1 200 projects related to information technology (IT) in education and STEM/STEAM education through the Priority Themes Funding Programme and the Dedicated Funding Programme for Publicly-funded Schools, with a total funding of over $1.1 billion. The measures included enhancing facilities and support for schools to develop school-based STEM/STEAM education.

         Moreover, to optimise education ancillary infrastructure, the QEF has allocated $500 million for the implementation of the e-Learning Ancillary Facilities Programme to develop e-learning ancillary facilities that meet local learning and teaching needs through co-operation between the education and business sectors. A total of 22 projects have been funded under the Programme and have commenced in the beginning of the 2023/24 school year. The learning platforms and resources developed under these projects deploy innovative technologies such as big data and AI to enhance learning and teaching effectiveness in a wide array of subjects/areas. The development period of each project ranges from two to three years. As at end-March 2025, around 400 schools participated in the collaborative development projects, involving around 31 000 students. It is expected that the deliverables of the projects will be successively released for subscription by schools in mid-2025 and will be available for use starting from the 2025/26 school year. The QEF will also sponsor publicly-funded schools to use the deliverables of the projects to facilitate the sustainable development of the projects. As the Programme is still at the development stage, figures on the numbers of subscribing schools and student beneficiaries, as well as the sponsored amount are not available for the time being.

    Providing resource support

         In applying digital technology to facilitate teaching, starting from the 2004/05 school year, the EDB has been providing all public sector schools with the Composite Information Technology Grant (CITG). Schools may deploy the grant flexibly, according to their school-based pedagogical needs, to purchase and enhance various kinds of hardware and software for teaching (including AI teaching equipment and smart classroom-related facilities), subscribe to Wi-Fi services, and strengthen their IT staffing support. In the 2024/25 school year, the rate of CITG for each school ranges from $275,355 to $898,390, depending on the school type and the number of classes. The grant rates will be adjusted annually in accordance with the movement of the Composite Consumer Price Index.

         Over the years, publicly-funded primary and secondary schools in Hong Kong have been flexibly updating the hardware and equipment in schools, having regard to the school-based circumstances and the learning and teaching needs of students and teachers. The relevant expenditures are subject to vetting by the school management committees/incorporated management committees. The EDB does not maintain relevant statistics on the updating of teaching equipment including AI equipment and the coverage rate of smart classrooms in schools.

  • MIL-OSI Australia: UPDATE: Operation Eclipse

    Police have seized more than $1.7 million worth of vapes and illegal tobacco and more than $80k cash following a truck stop on the states Far North last week.

    About 4.30pm on Friday 25 April, police at Far North Local Service Area, Traffic Services Branch and Serious and Organised Crime Branch stopped a refrigerated truck at Port Augusta at a drug transit route operation at Port Augusta.

    Police spoke with the occupants of the truck and searched the truck where they located and seized in excess of $1.74 million in vapes, $26,000 in loose tobacco and $80,100 cash.

    The seizure resulted in the arrest of a 32-year-old man and a 62-year-old man both from New South Wales, they were charged with unlawful possession and possession of tobacco products for sale.  Both men appeared in Port Augusta Magistrates court on 28 April where they were remanded in custody to next appear in court on 1 July.

    The refrigerated truck has been seized and will be the subject of confiscations proceedings.

    Operation Eclipse have taken carriage of the investigation which is ongoing.

    Operation Eclipse Commander, Detective Chief Inspector Brett Featherby said, “The seizure demonstrates the risk to syndicates should they seek to transport illicit tobacco through South Australia to other states.

    “Organised crime syndicates transporting illicit tobacco through transit routes in regional areas will be subject to a whole of SAPOL response to disrupt their criminal activity and financial operations.

    “SAPOL will pursue criminal charges when sufficient evidence exists and that includes those who are supporting and enabling that activity and take every opportunity to enforce the full extent of the confiscations legislation to seize assets of those involved,” he said.

    Operation Eclipse has so far resulted in 35 arrests for offences including blackmail, possess tobacco products for sale, arson, money laundering and serious criminal trespass.

    There have been 184 premises searched – 47 residential, 123 businesses and 14 storage facilities – in excess of $2.2 million in cash, three firearms and $17.97 million in tobacco products.

    Significantly, there have been 394 calls to Crime Stoppers since 2 October that have resulted in information being provided to police.

  • MIL-OSI Security: New Paltz Man Charged with Online Sexual Exploitation of a Minor

    ALBANY, NEW YORK – Max Fishkind, age 24, of New Paltz, New York, was charged today with sexual exploitation of a child.  United States Attorney John A. Sarcone III and Craig L. Tremaroli, Special Agent in Charge of the Albany Field Office of the Federal Bureau of Investigation (FBI), made the announcement.

    According to a complaint filed today, on September 23, 2024, Fishkind used, persuaded, induced, enticed and coerced a child into creating and sending him self-produced child sexual abuse material over Snapchat.  The child, who was 15 years old at the time of the crime, reported that Fishkind initially told the child he was 17 years old, but the child later learned that Fishkind was not a minor and stopped communicating with him. 

    The investigation into Fishkind began after the parents of a minor child residing in the state of Maryland reported to the FBI that their child had engaged in inappropriate sexual messaging with Fishkind, which included self-produced nude images of the minor that had been sent to Fishkind over Snapchat.  When the FBI learned that Fishkind had since moved from Houston, Texas, to New Paltz, FBI Albany took over the investigation, which resulted in the charge filed today. The charges against Fishkind are merely accusations.  The defendant is presumed innocent unless and until proven guilty.

    Fishkind made his initial appearance before U.S. Magistrate Judge Daniel J. Stewart today.  He was detained pending a detention hearing scheduled for May 5.

    If convicted of the offense, Fishkind faces at least 15 years and up to 30 years in prison, a fine of up to $250,000, and a supervised release term of at least 5 years and up to life. Fishkind may also be ordered to pay restitution to the victim of his offense and forfeit any devices used in the offense. A defendant’s sentence is imposed by a judge based on the particular statute the defendant is charged with violating, the U.S. Sentencing Guidelines, and other factors. Fishkind would also have to register as a sex offender upon his release from prison.

    The FBI is investigating this case.  Assistant U.S. Attorney Benjamin S. Clark is prosecuting the case as part of Project Safe Childhood.

  • MIL-Evening Report: Peace in our time? Why NZ should resist Trump’s one-sided plan for Ukraine

    Is it possible to reconcile increased international support for Ukraine with Donald Trump’s plan to end the war? At their recent meeting in London, Christopher Luxon and his British counterpart Keir Starmer seemed to think so.

    Starmer thanked New Zealand for its “support” for a “coalition of the willing” that would safeguard the implementation of a potential peace deal concluded by the Trump administration.

    But unless something drastically changes in the near future, all the signs point to the US president envisaging a Ukraine peace settlement on Russian president Vladimir Putin’s terms.

    According to that view, peace can only be achieved if Ukraine is prepared to accept that territories wholly or partially annexed by Russia now belong to Moscow.

    In 2014, Russia seized Crimea on the Black Sea. Following the illegal 2022 invasion, Russia claimed four parts of eastern and southern Ukraine as its own – Donetsk, Luhansk, Kherson and the Zaporizhzhia region.

    At the same time, Trump’s peace deal includes a provision that rules out NATO membership for Ukraine. This meets a key Russian demand that seeks to deny Ukraine’s sovereign right to choose its own security arrangements.

    According to Trump, Putin’s major concession is the promise that Russia will not annex the rest of Ukraine – something Moscow has been trying to do for the past three years.

    To accept this, however, liberal democracies such as New Zealand and Britain would be tacitly signalling they share common values and interests with the Trump administration and its apparent enthusiasm for a geopolitical partnership with Putin’s dictatorship.

    And in some ways, Trump’s Ukraine peace initiative is a bigger challenge for New Zealand than it is for Britain.

    Lessons of the past

    Like Britain, New Zealand fought in two world wars in the 20th century to advance, among other things, certain key international principles. These included state sovereignty and a prohibition on the use of force to change borders, principles subsequently enshrined in the United Nations Charter.

    But unlike Britain, New Zealand is a relatively small state that does not have a veto in the UN Security Council to protect its interests. Consequently, it is even more dependent on an international rules-based order for its security and prosperity.

    For New Zealand, Trump’s current Ukraine peace plan is a clear and present danger because it would set such a terrible precedent.

    Under the 1994 Budapest Memorandum, Ukraine gave up its nuclear weapons (left over from when it was part of the Soviet Union) in return for assurances from Russia, the US and UK that recognised Ukrainian independence and the inviolability of its existing borders.

    The Trump administration’s plan, however, insists Ukraine must accept the illegal and partial dismemberment of its territory to attain peace with Russia.

    Rewarding Russian aggression in this way is tantamount to a failure to learn the historical lessons of the 20th century. In particular, it seems to forget the period during the 1930s when Britain tried in vain to appease an expansionist Nazi regime in Germany.

    Trump’s peace plan basically endorses the idea that “might is right” and that it is fine for great powers or big countries to steal land from smaller countries.

    Adjusting NZ foreign policy

    In Trump’s top-down world view, multilateral institutions and international law are regarded as superfluous at best and an enemy at worst.

    In such a world, relatively small powers such as New Zealand, with “no cards to play” at the top table, must either submit to the dominance of great powers (including the US) or suffer the consequences.

    Moreover, there is a real risk that Trump’s stance toward Putin’s regime will be viewed as weakness by China, Russia’s most important backer. This could embolden Beijing to increasingly assert itself in the Indo-Pacific, including the Pacific Islands region, where New Zealand has core strategic interests.

    Trump’s plan for Ukraine brings into sharp focus what has already been evident from other recent trends: a domestic slide toward autocracy in Washington, the unilateral imposition of tariffs, and territorial threats against close allies Canada and Denmark.

    As European Union Commission President Ursula von der Leyen put it, “The West as we knew it no longer exists.”

    The transactional nature of Trump’s leadership – including that peace in Ukraine can be bought with mineral rights and territorial trade-offs – suggests the US can no longer be relied on to provide a security guarantee for liberal democracies in Europe or elsewhere.

    The current New Zealand government needs to find the self-confidence and resolve to admit Trump is backing Putin’s imperial project in Ukraine. And it needs to adjust its foreign policy accordingly.

    This does not mean Wellington should weaken its traditional friendship with the US.

    On the contrary, many Americans might expect and welcome the prospect of New Zealand clearly and publicly standing against their president’s dangerous alignment with an authoritarian regime at Ukraine’s expense.

    RAPID CITY – United States Attorney Alison J. Ramsdell announced today that U.S. District Judge Karen E. Schreier has sentenced a Porcupine, South Dakota, man convicted of Involuntary Manslaughter, the Unborn Victims of Violence Act, and Possession of an Unregistered Firearm. The sentencing took place on April 25, 2025.

    McKenzie Big Crow, age 20, was sentenced to a total of 12 years in federal prison for Involuntary Manslaughter, the Unborn Victims of Violence Act, and Possession of an Unregistered Firearm, to be followed by three years of supervised release. Big Crow was also ordered to pay $300 in special assessments to the Federal Crime Victims Fund.

    A federal grand jury indicted Big Crow in June 2024. In January 2025, he was found guilty following a federal jury trial.

    On August 20, 2023, near Porcupine, Big Crow was illegally in possession of a Savage Arms Model 62, semiautomatic rifle. The barrel had been sawed off, and the defendant had taped components of an Airsoft rifle to the gun to make it appear like an AK-47. Big Crow claimed he put the rifle in a backpack and that the gun discharged when he bumped the bag against a door. The gunshot struck 19-year-old Ashton Provost in the chest, killing her and her unborn child within minutes. The gun was later found hidden under Big Crow’s bed. On the day of the shooting, Big Crow had drugs in his system including marijuana, cocaine, MDMA (commonly known as ecstasy) and methamphetamine.

    “We commend the U.S. Attorney’s Office in the District of South Dakota for its decision to pursue charges under the Unborn Victims of Violence Act — recognizing the value of every life lost as a result of this crime,” said Special Agent in Charge Alvin M. Winston Sr. of the FBI Minneapolis. “This case highlights our shared commitment to justice for the most vulnerable and to holding violent offenders accountable to the fullest extent of the law.”

    This case is part of Project Safe Neighborhoods (PSN), a program bringing together all levels of law enforcement and the communities they serve to reduce violent crime and gun violence, and to make our neighborhoods safer for everyone. On May 26, 2021, the Department launched a violent crime reduction strategy strengthening PSN based on these core principles: fostering trust and legitimacy in our communities, supporting community-based organizations that help prevent violence from occurring in the first place, setting focused and strategic enforcement priorities, and measuring the results.

    This matter was prosecuted by the U.S. Attorney’s Office because the Major Crimes Act, a federal statute, mandates that certain violent crimes alleged to have occurred in Indian country be prosecuted in Federal court as opposed to State court.

    This case was investigated by the FBI, the Oglala Sioux Tribe Department of Public Safety, and the Bureau of Alcohol, Tobacco, Firearms and Explosives. Assistant U.S. Attorney Heather Knox prosecuted the case.

    Big Crow was immediately remanded to the custody of the U.S. Marshals Service.

  • MIL-OSI Security: Houston Man Guilty of Federal Controlled Substances Act Violations

    NEW ORLEANS, LOUISIANA – FULGENCIO CARDENAS-RIVERA (“CARDENAS-RIVERA”), age 35, a resident of Houston, Texas, pled guilty on April 15, 2025, before United States District Judge Brandon S. Long to possession, with intent to distribute, five hundred (500) grams or more of cocaine, announced Acting U.S. Attorney Michael M. Simpson.

    According to court documents, CARDENAS-RIVERA traveled into the Eastern District of Louisiana with approximately three kilograms of cocaine secreted in the trunk of the car he was driving, with the intent to distribute same.

    CARDENAS-RIVERA faces a mandatory minimum term of imprisonment of 5 years up to a maximum term of 40 years, a fine of up to $5,000,000.00, at least four years of supervised release following any term of imprisonment, and a mandatory special assessment fee of $100. 

    This prosecution is part of an Organized Crime Drug Enforcement Task Forces (OCDETF) investigation.  OCDETF identifies, disrupts, and dismantles the highest-level drug traffickers, money launderers, gangs, and transnational criminal organizations that threaten the United States by using a prosecutor-led, intelligence-driven, multi-agency approach that leverages the strengths of federal, state, and local law enforcement agencies against criminal networks.

    This investigation was led by the Drug Enforcement Administration – New Orleans Field Division Office and assisted by the United States Border Patrol, the Louisiana State Police, the Kenner Police Department, and the Jefferson Parish Sheriff’s Office.  The prosecution is being handled by Assistant United States Attorney Lynn E. Schiffman of the Narcotics Unit.

  • MIL-OSI Security: Tonawanda man going to prison for 25 years for production of child pornography

    BUFFALO, N.Y. – U.S. Attorney Michael DiGiacomo announced today that Michael E. Swain, 37, of Tonawanda, NY, who was convicted of production of child pornography, was sentenced to serve 25 years in prison and lifetime supervised release by U.S. District Judge Lawrence J. Vilardo.

    Assistant U.S. Attorney Aaron J. Mango, who handled the case, stated that between October 20 and November 1, 2021, Swain coerced five minor victims to engage in sexually explicit conduct for the purpose of producing visual depictions. Specifically, Swain communicated with a 15-year-old minor female who resided in Colorado using Discord, a social media platform. The communications included sexually graphic conversations, during which Swain requested that the minor female take sexually explicit videos and images and send them to him. In addition, Swain engaged in numerous sexual communications with the minor female from approximately 2019 to 2022, during which other sexually explicit images and videos were sent from to Swain. On February 28, 2023, the FBI executed a search warrant at Swain’s residence and seized a desktop computer tower, a laptop computer, and an external hard drive, all of which were found to contain child pornography.

  • MIL-OSI Security: Ukrainian Citizens Charged in South Florida with Illegally Voting in 2024 United States Presidential Election

    MIAMI – Two Ukrainian women with no United States citizenship have been charged with unlawfully voting in the General Election for United States President during early voting in Palm Beach, Fla., on Oct. 31, 2024.

    Svitlana Demydenko (Svitlana), 53, and her daughter, Yelyzaveta Demydenko (Yelyzaveta), 22, made their initial appearances in West Palm Beach federal court today.

    According to the criminal complaint affidavit, Svitlana and Yelyzaveta entered the United States in April 2021 on nonimmigrant visas. In August 2024, while living in Florida, Svitlana and Yelyzaveta registered to vote in federal elections using a system that requires certification of United States citizenship, which neither of them had.

    On Oct. 31, 2024, and still without United States citizenship, Svitlana and Yelyzaveta voted from Palm Beach in the federal 2024 General Election, which included election of a United States President.

    U.S. Attorney Hayden P. O’Byrne for the Southern District of Florida; Acting Special Agent in Charge Jose R. Figueroa of the U.S. Department of Homeland Security, Homeland Security Investigations (HSI), Miami Field Division; and Commissioner Mark Glass of the Florida Department of Law Enforcement (FDLE) made the announcement.

    HSI Miami Field Division and FDLE Office of Executive Investigations, Election Crime Unit investigated this case, with assistance from the Florida Department of State, Office of Election Crimes and Security; the Palm Beach County Supervisor of Elections; the U.S. Diplomatic Security Service; and the U.S. Department of Government Efficiency (DOGE). Assistant U.S. Attorney John McMillan is prosecuting the case.

    A criminal complaint is merely an accusation, and defendants are presumed innocent unless and until proven guilty.

  • MIL-OSI Security: Denver Man Sentenced to 194 months in Federal Prison for Being a Felon in Possession of Ammunition

    DENVER – The United States Attorney’s Office for the District of Colorado announces that Tyrell Braxton, 25, of Denver, was sentenced to 194 months in federal prison after being found guilty by a federal jury of being a felon in possession of ammunition.

    According to the facts established at trial, Braxton was charged in connection with a shooting that took place in the early morning hours on August 19, 2023, when a large group of people were gathered on the southwest corner of 28th and Welton Street in Denver.  Shortly before 4am, multiple gunshots were heard, and Denver Police officers were dispatched to a shooting.  Crime scene evidence collected on scene showed that eight different firearms were fired, resulting in 71 spent shell casings.  Video evidence captured Braxton shooting six times into a group of people, killing one man and injuring two women.  Braxton ran across Welton Street, but continued to fire his firearm eight more times.  Braxton fled the scene and was a fugitive before being captured. Braxton was on federal supervised release at the time for a prior unlawful possession of a firearm and had been released from prison in April 2023.

    “Tyrone Braxton’s wanton violence took another’s life,” said Acting United States Attorney for the District of Colorado J. Bishop Grewell.  “Our community is safer with him in prison.”

    “Fighting violent crime is our top priority, and we are unwavering in our commitment to eradicating violent criminals from our communities,” said ATF Special Agent in Charge Brent Beavers.  “The ATF Denver Field Division will continue to deploy all resources at our disposal and leverage every law enforcement partnership in pursuit of those who terrorize our communities with violence.”

    “The Denver Police Department appreciates our great partnership with the United States Attorney’s Office for the District of Colorado and the Bureau of Alcohol, Tobacco, Firearms and Explosives,” said Denver Police Chief Ron Thomas.  “Through the Project Safe Neighborhoods program, DPD and our partners worked to prove the dangers Mr. Braxton possessed to our community and this sentence demonstrates our collective commitment to safety.”

    United States District Judge R. Brooke Jackson presided over the sentencing.  The Denver Police Department and the Bureau of Alcohol, Tobacco, Firearms and Explosives handled the investigation.  Assistant United States Attorney Celeste Rangel and Special Assistant United States Attorney Leah Perczak handled the prosecution.

    Drug dealers behind lethal fentanyl will face life in prison or death penalty.
    WASHINGTON – On National Fentanyl Awareness Day, U.S. Senator Joni Ernst (R-Iowa) and Congressman Tony Gonzales (R-Texas) are increasing the criminal penalties to the strictest possible level for the drug dealers behind the fentanyl epidemic that is the leading cause of death for Americans 18-44 and contributed to around 87,000 overdose deaths.
    The Felony Murder for Deadly Fentanyl Distribution Act makes knowingly distributing fentanyl resulting in death a first-degree murder carrying a sentence of up to life in prison or even the death penalty.
    “I have seen firsthand how the scourge of fentanyl has inflicted incredible tragedy on communities across Iowa,” said Ernst. “I have worked for years to protect Americans and stop this deadly epidemic.     Background:
    Earlier this year, the Senate passed an Ernst-supported bill to classify fentanyl-related substances as Schedule I, to enable law enforcement authorities to target fentanyl traffickers, no matter how much they chemically tweak their products to take advantage of a legal loophole.
    After visiting the southern border, Ernst worked to increase penalties on individuals who fuel the border crisis and fentanyl epidemic.
    Her bipartisan solution to address the fentanyl crisis was also included in the National Defense Authorization Act for Fiscal Year 2024.
    Last week, Ernst introduced the BE GONE Act to codify a key part of President Trump’s zero-tolerance border crackdown by requiring illegal immigrants convicted of sex crimes to be deported.

    BACKGROUND:
    While nearly every state has a law protecting people from non-consensual intimate imagery (NCII), including 30 states with laws explicitly covering sexual deepfakes, these state laws vary in classification of crime and penalty and have uneven criminal prosecution. Further, victims struggle to have images depicting them removed from websites, increasing the likelihood the images are continuously spread and victims are retraumatized.
    In 2022, Congress passed legislation creating a civil cause of action for victims to sue individuals responsible for publishing NCII. However, bringing a civil action can be incredibly impractical. It is time-consuming, expensive, and may force victims to relive trauma. Further exacerbating the problem, it is not always clear who is responsible for publishing the NCII. 
    The TAKE IT DOWN Act would protect and empower victims of real and deepfake NCII while respecting speech by:

    Criminalizing the publication of NCII in interstate commerce. The bill makes it unlawful for a person to knowingly publish NCII on social media and other online platforms. NCII is defined to include realistic, computer-generated pornographic images and videos that depict identifiable, real people. The bill also clarifies that a victim consenting to the creation of an authentic image does not mean that the victim has consented to its publication.
    Protecting good faith efforts to assist victims. The bill permits the good faith disclosure of NCII, such as to law enforcement. 
    Requiring websites to take down NCII upon notice from the victim. Social media and other websites would be required to have in place procedures to remove NCII, pursuant to a valid request from a victim, within 48 hours. Websites must also make reasonable efforts to remove copies of the images. The Federal Trade Commission is charged with enforcement of this section. 
    Protecting lawful speech. The bill is narrowly tailored to criminalize knowingly publishing NCII without chilling lawful speech. The bill conforms to current First Amendment jurisprudence by requiring that computer-generated NCII meet a “reasonable person” test for appearing indistinguishable from an authentic image.

  • MIL-OSI New Zealand: Man sentenced after Operation Barber cuts at West Coast drug supply

    Police acknowledge the sentencing handed down in the Christchurch District Court this week in relation to the supply of drugs on the West Coast.

    Leo Smith, aged 22, was on Tuesday (29 April) sentenced to 10 months home detention.

    Operation Barber started in 2023 after Police received information relating to the supply of class B drugs across the wider region.

    Smith was identified as a person of interest, and Police conducted search warrants on 8 March 2024 at two addresses he was connected to.

    Police located and seized drugs, instruments, and cash, as well as his mobile devices.

    The operation has been hugely successful thanks to the dedication of the West Coast Tactical Crime Unit who were greatly assisted over the last 18 months by Christchurch Criminal Investigations Branch.

    As a result of our investigations, we have been able to uncover a number of associates working with Smith.

    Several other people were involved in the supply chain and supplying class A-C illicit drugs across the Greymouth and Canterbury regions.

    These offenders were unidentified previously, with little to no criminal history. They have now been convicted and more than $90,000 in cash has been forfeited across the wider operation.

    Police will continue to hold people to account who are supplying drugs and causing harm to our community.

    Washington D.C. – U.S. Senator Elizabeth Warren (D-Mass.), Ranking Member of the Senate Banking, Housing, and Urban Affairs Committee, wrote to private equity firm Sycamore Partners (Sycamore) regarding concerns that the firm’s proposed acquisition of retail pharmacy chain Walgreens may cost hardworking Massachusetts residents their jobs and create difficulties for patients who need access to lifesaving medications. 
    Sycamore’s multi-billion-dollar takeover of Walgreens has been touted as an attempt to keep the struggling retail pharmacy chain alive. However, private equity buyouts have a record of running already-struggling companies into the ground and producing devastating consequences for workers and communities, as witnessed by private equity’s looting of Steward Health Care, which resulted in two shuttered hospitals in Massachusetts. 
    “My primary concern is that Sycamore’s acquisition of Walgreens may lead to restructuring of the company that results in layoffs and pharmacy closures in the Commonwealth,” said Senator Warren. 
    Walgreens has already announced plans to close nine locations across Massachusetts, in addition to the six stores closed in the state within the past year. Many of the shuttered Walgreens stores are located in vulnerable communities, leaving thousands of residents without reliable pharmacy access. 
    Sycamore has a troubling history of leading the companies it acquires into bankruptcy, further harming already-struggling communities. 
    “These private equity buyouts…frequently lead to worse outcomes for employees and consumers: private equity firms sell off assets and close locations, employees lose their jobs, and consumers lose access to essential goods and services,” wrote Senator Warren.
    A review by the Private Equity Stakeholder Project (PESP) revealed that the Walgreens buyout will be heavily leveraged with debt, heightening the risk of bankruptcy and threatening the availability of critical services to customers and patients.
    “These are deeply troubling conclusions, suggesting that yet another private equity firm might leverage a failing health care chain to turn a profit at the expense of Massachusetts’ patients, providers, and taxpayers,” wrote Senator Warren.
    Millions of customers across the United States rely on Walgreens for primary care, essential medications, and household items, and if the Walgreens-Sycamore deal leads to even more store closures, customers could be left in “pharmacy deserts” without access to necessities.  
    “I seek assurances that Sycamore’s buyout of Walgreens will not damage the company further, and will not cost hardworking Americans their jobs or create difficulties for patients who need access to lifesaving medications,” concluded Senator Warren.
    Senator Warren requested a response identifying the impact Sycamore’s acquisition of Walgreens will have on workers and communities by May 13, 2025.

  • MIL-OSI Security: Hammond Man Sentenced for Receipt of Materials Involving Sexual Exploitation of Minors

    NEW ORLEANS, LA – Acting U.S. Attorney Michael M. Simpson announced that JOSEPH AUTHEMENT (“AUTHEMENT”), age 25, of Hammond, LA, was sentenced on April 16, 2025, for Receipt of Materials Involving the Sexual Exploitation of Minors, in violation of Title 18, United States Code, Sections 2252(a)(2) and (b)(1). 

    According to court documents, on March 11, 2024, Homeland Security Investigations (“HSI”)  obtained a federal search warrant to seize AUTHEMENT’s Apple iPhone.  On March 12, 2024, HSI special agents (“SA”) located AUTHEMENT at his residence in Hammond, LA.  The agents seized AUTHEMENT’s iPhone and located images and videos depicting the sexual exploitation of minors on that phone.  SAs later determined AUTHEMENT used a messaging application to download and purchase child sex abuse materials.

    United States District Judge Jane Triche Milazzo sentenced AUTHEMENT to sixty (60) months imprisonment, supervised release for (10) ten years upon release from imprisonment and payment of a $100 mandatory special assessment fee.

    This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse launched in May 2006 by the Department of Justice.  Led by United States Attorney’s Offices and the Criminal Division’s Child Exploitation and Obscenity Section (CEOS), Project Safe Childhood marshals federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims.  For more information about Project Safe Childhood, please visit www.projectsafechildhood.gov. 

    The U.S. Attorney’s Office would like to acknowledge the assistance of the U.S. Department of Homeland Security, Homeland Security Investigations, and the Rio Grande Valley Child Exploitation Investigations Task Force.  The prosecution of this case is being handled by Assistant U.S. Attorney Brian M.   • MIL-OSI Security: Jury Convicts Florida Man For Stealing $10.9 Million From Medicare

    Tampa, FL – United States Attorney Gregory W. Kehoe announces that a federal jury has found Lino Mallari Gutierrez, a/k/a “Joe Gutierrez,” (age, Palm City) guilty of conspiracy to commit health care and wire fraud, conspiracy to violate the federal anti-kickback statute, five substantive counts of health care fraud, and four substantive counts of payment of kickbacks in connection with a heath care program. After the jury verdict, the Court remanded Gutierrez into custody. Gutierrez faces a maximum penalty of 20 years in federal prison. His sentencing hearing is scheduled for July 24, 2025.  Gutierrez was indicted on August 22, 2023.

    According to testimony and evidence presented at trial, Gutierrez and his co-conspirators, including Jonathan Rouffe, owned and operated two durable medical equipment (DME) companies that collectively billed Medicare more than $10.9 million for medically unnecessary DME, of which more than $5 million was paid to Gutierrez and his co-conspirators. Gutierrez and his co-conspirators paid kickbacks to marketing companies in exchange for signed doctors’ orders for unnecessary braces, which Gutierrez and the co-conspirators then used to bill Medicare. The marketing companies used call centers to solicit Medicare patients and telemedicine companies to procure prescriptions for unnecessary braces for these patients. Gutierrez and Rouffe concealed their role in the scheme by putting the DME companies in the names of straw owners.

    As part of the conspiracy to commit health care and wire fraud, Gutierrez also filed false records with his employer and a private regulatory organization to conceal his involvement in the DME companies. Gutierrez and Rouffe were in the process of establishing four more DME companies with additional straw owners—including Gutierrez’s mother and two of Gutierrez’s friends—when the U.S. Department of Health and Human Services – Office of Inspector General (HHS-OIG) and the Federal Bureau of Investigation (FBI) identified the DME fraud through a national operation, which began in the Middle District of Florida, and through which dozens of co-conspirators were identified, charged, and convicted. Prior to law enforcement action, Gutierrez and Rouffe had already taken multiple steps to use these additional DME companies to bill Medicare for additional fraudulent claims. After learning of law enforcement action, Gutierrez moved Medicare proceeds from his account into other bank accounts under his control.

    Rouffe previously pled guilty to conspiracy to commit health care fraud. He was sentenced to four years in prison for his role in the fraud scheme.

    This case was investigated by the U.S. Department of Health and Human Services – Office of Inspector General and the Federal Bureau of Investigation. It is being prosecuted by Assistant United States Attorney Jennifer Peresie and Trial Attorney Margaret Mortimer of the Department of Justice Criminal Division’s Fraud Section.

    Councils to seize and crush fly-tipping vehicles to clean up Britain

    Waste criminals, fly-tippers and cowboy waste operators to have vehicles seized and crushed

    A new crackdown on cowboy waste operators will tackle soaring fly-tipping and clean up Britain’s streets, lanes and rural areas, the Government has announced today (Tuesday 29 April).  

    Councils will work with the police to identify, seize and crush vehicles of waste criminals. Drones and mobile CCTV cameras will be deployed to identify cars and vans belonging to fly-tippers so they can be destroyed.  

    Ministers have launched a rapid review to slash red tape blocking councils from seizing and crushing vehicles. Councils currently have to bear the significant cost of seizing and storing vehicles but under new plans, being consider by Ministers, fly-tippers will cover this cost, saving councils and taxpayers money.

    In addition, waste cowboys will now face up to five years in prison for operating illegally. Any criminals caught transporting and dealing with waste illegally will now face up to five years in prison under new legislation.

    Secretary of State for the Environment, Food and Rural Affairs, Steve Reed said:  

    Waste criminals and fly-tippers who blight our towns and villages have gone unpunished for too long.  

    That ends today. The Government is calling time on fly-tipping. I will not stand by while this avalanche of rubbish buries our communities. 

    Under the Plan for Change, this Government will seize and crush fly-tippers vans’ to clean up Britain’s streets.

    These measures support the Government’s Plan for Change and will help deliver its key mission of Safer Streets for the public, restoring communities’ faith in efforts to combat anti-social behaviour. 

    Waste crime is trashing communities across the country. Fly-tipping has skyrocketed by a fifth whilst the number of prosecutions has fallen by the same amount since 2018/19. The failure to punish these criminals has left our high streets, roads and countryside buried under an avalanche of rubbish.  

    The Environment Agency will also carry out identity and criminal record checks on operators in the sector so there is nowhere to hide for rogue firms. 

    It will be handed more resources as they will now be able to fund the cost of policing the industry through permits, boosting their powers and cutting costs for taxpayers. The reforms will also give them more power to revoke permits, issue enforcement notices and hefty fines.  

    Philip Duffy, Environment Agency Chief Executive, said:

    Waste crime is toxic. Criminals’ thoughtless actions harm people, places, and the economy, blighting our communities and disrupting legitimate businesses. 

    At the Environment Agency, we’re determined to bring these criminals to justice through tough enforcement action and prosecutions. That’s why we support the Government’s crackdown on waste criminals, which will ensure we have the right powers to shut rogue operators out of the waste industry.

    Executive Director of the Environmental Services Association (ESA), Jacob Hayler, said:

    For too long, criminality has run rampant across the waste sector. These illegal activities threaten the environment; damage communities and undermine legitimate recycling and waste operations. ESA has long campaigned for tighter rules, tougher enforcement and harsher penalties to deter criminals, so we very much welcome today’s reforms and hope that they are put to good use driving criminals out of our sector. 

    In particular, the proposed reforms to the carriers, brokers, dealers and exemption regimes, coupled with strong and effective enforcement from the regulators, could go a long way to help tackle the scourge of waste crime, with increased scrutiny and accountability making it much harder for criminals to operate in our sector.

     Councillor Muhammed Butt, Leader of Brent Council, said:

    Our residents have had enough of the dumpers who pollute their neighbourhoods with rubbish. These new powers will be a welcome addition to our arsenal, reinforcing our zero-tolerance stance on fly-tipping. We’ve already witnessed the positive impact of our focused efforts, and I am determined to use every tool at our disposal, including seizing vehicles, to reclaim our streets.

    The Government is making available £69 billion to council budgets across England – a 6.8% cash terms increase – and bringing forward the first multi-year funding settlement in a decade, to help fund key responsibilities like tackling fly-tipping

    The two bills protect victims of nonconsensual condom removal, known as ‘stealthing’

    Washington, D.C. – Today, Congresswoman Norma J. Torres reintroduced two bills designed to strengthen legal protections for survivors of sexual violence, specifically targeting nonconsensual condom removal, also known as “stealthing.” The bills, introduced at the close of Sexual Assault Awareness Month, to provide crucial legal recourse and financial support for victims of sexual assault.

    In 2021, California became the first state to make it a civil offense for someone to remove a condom without their partner’s consent. Since then, Maine and Washington State have passed similar laws. 

    The first bill, the Consent is Key Act, seeks to empower states to pass laws allowing civil damages for victims of stealthing by increasing funding for federal domestic violence programs. This would support survivors in their efforts to seek justice and compensation. 

    The second bill, the Stealthing Act of 2025, would create a federal civil right of action, allowing survivors of nonconsensual condom removal to pursue civil lawsuits against perpetrators for monetary damages.

    “Stealthing is not just an invasion of trust; it is a traumatic violation with far-reaching consequences, including unintended pregnancies and the risk of sexually transmitted infections,” said Congresswoman Norma Torres. “It is critical that we provide survivors with every tool they need to pursue justice, whether that’s through civil court or stronger state protections. With these bills, we send a clear message: survivors are not alone, and we are committed to helping them heal and seek accountability.”
