  • MIL-OSI Security: Kolm aastat pärast täiemahulist sissetungi Ukrainasse: Eurojusti toetatavad konkreetsed sammud vastutusele võtmise suunas

    Ühise uurimisrühma liikmed on tegelenud ühise õigusemõistmise strateegia väljatöötamisega, mis seab prioriteediks agressioonikuriteo ning piinamise, väärkohtlemise ja filtratsiooni kuritegude uurimise seoses ebaseaduslike kinnipidamiskohtadega, samuti genotsiidikuriteo uurimise.

    Alates märtsist 2022 on amet korraldanud 22 koordineerimisnõupidamist ühise uurimisrühma liikmete ja muude riiklike ametiasutuste vahel, kes uurivad Ukrainas väidetavalt toimepandud raskeid rahvusvahelisi kuritegusid. See on võimaldanud asjaomastel riikidel vahetada andmeid oma vastavate siseriiklike uurimiste kohta, arutada strateegiaid ja prioriteete ning koordineerida uurimismeetmeid.

    Eurojust on täielikult pühendunud ühise uurimisrühma olulise töö jätkuvale toetamisele ning on eraldanud oma tegevuse rahastamiseks ligikaudu pool miljonit eurot.

    Ühise uurimisrühma tööd toetavad Eurojusti hallatavad rahvusvaheline keskus Ukraina-vastaste agressioonikuritegude eest vastutusele võtmiseks ja raskete rahvusvaheliste kuritegude tõendite andmebaas (CICED).

    Rahvusvaheline keskus Ukraina-vastaste agressioonikuritegude eest vastutusele võtmiseks: edusammud agressioonikuritegusid käsitleva tugeva juhtumite menetlemise paketi osas

    Rahvusvaheline keskus Ukraina-vastaste agressioonikuritegude eest vastutusele võtmiseks on viimase kuue kuu jooksul teinud märkimisväärseid edusamme tugeva juhtumite menetlemise paketi koostamisel. See pakett tugineb ühisele agressioonikuritegude uurimis- ja õigusemõistmise strateegiale, milles Ukraina-vastaste agressioonikuritegude eest vastutusele võtmiseks loodud rahvusvahelise keskuse osalejad on kokku leppinud.

    Juhtumite menetlemise pakett on mõeldud edastamiseks võimalikule tulevasele erikohtu prokuratuurile või muudele jurisdiktsioonidele.

    Rahvusvaheline keskus Ukraina-vastaste agressioonikuritegude eest vastutusele võtmiseks on taganud ja tagab jätkuvalt selliste võimalike tõendite kogumise ja esialgse analüüsi, mis võivad olla seotud sõjaväe ja poliitilise juhtkonna kõrgeima tasandi isikutega. Uurimistegevust ei piira isikute ametikohad.

    Kuna agressioon Ukrainas jätkub, on üha rohkem tõendeid, mida Ukraina-vastaste agressioonikuritegude eest vastutusele võtmiseks loodud rahvusvahelise keskus aktiivselt uurib.

    Rahvusvaheline keskus Ukraina-vastaste agressioonikuritegude eest vastutusele võtmiseks on saanud täiendavat rahastamist ja 2025. aasta jaanuaris pikendati selle tegevust kuue kuu võrra. Selleks allkirjastati Eurojusti ja Euroopa Komisjoni välispoliitika vahendite talituse vahel rahalist toetust käsitleva lepingu muudatus.

    CICED: üle 3700 tõendusmaterjalide toimiku

    CICED on ainulaadne ja kohandatud kohtuandmebaas, mille Eurojust on loonud, et säilitada, analüüsida ja talletada raskete rahvusvaheliste kuritegude tõendeid. CICED võimaldab ametil toetada liikmesriikide õigusasutusi teises riigis asuvate tõendite tuvastamisel, mis võivad olla olulised nende enda juurdluste jaoks. Praeguseks on 16 riiki esitanud CICEDile üle 3700 tõendusmaterjalide toimiku.

    Jaanuaris 2025 võimaldas uus tõlkevahend liikmesriikide ametiasutuste esitatud tõendusmaterjale 19 keelest inglise keelde tõlkida. See pöördeline muutus on oluliselt kiirendanud ameti analüütilist tööd. Selle tulemusena on andmebaasi otsingufunktsioon täpsem ja liikmesriikide ametiasutuste teabepäringutele saab kiiremini vastata.

    Eurojust on teinud suuri jõupingutusi, et vastata liikmesriikide ametiasutuste taotlustele toetada raskete rahvusvaheliste kuritegude uurimist. Lisaks sellele on amet ennetavalt tuvastanud toimikuid, mida peetakse kasulikuks käimasolevate riiklike uurimiste jaoks.

    Taust:

    Alates sõja puhkemisest on Eurojust olnud Venemaa kuritegude eest vastutusele võtmise toetamisel esirinnas. Vaid kolm nädalat pärast Venemaa täiemahulist sissetungi 2022. aastal toetas Eurojust ühise uurimisrühma loomist, mis koosneb nüüd Ukrainast, kuuest ELi liikmesriigist, Rahvusvahelise Kriminaalkohtu ja Europoli osalemisest ning vastastikuse mõistmise memorandumist Ameerika Ühendriikidega.

    Ühine uurimisrühm võimaldab partneritel killustunud ja keerulisel operatiivmaastikul, kus käib sõda ja tõendid on laiali erinevate õigussüsteemidega riikides, vahetada teavet otse ja reaalajas. Samuti aitab see ühise uurimisrühma liikmetel oma uurimisi ühtlustada, kuna asjaomased riiklikud asutused saavad nüüd keskenduda oma juhtumite aktiivsele menetlemisele.

    Eurojust pakub ühisele uurimisrühmale õiguslikku ja analüütilist oskusteavet ning logistilist ja rahalist tuge.

    2023. aasta veebruaris käivitas Eurojust raskete rahvusvaheliste kuritegude tõendite andmebaasi (CICED), mis põhineb Eurojusti volituste kiireloomulisel muutmisel pärast sissetungi Ukrainasse.

    2023. aasta juulis loodud Ukraina-vastaste agressioonikuritegude eest vastutusele võtmiseks loodud rahvusvahelist keskust haldab samuti Eurojust ning see toetab koos CICEDiga ühise uurimisrühma tööd.

    Alates 2022. aasta märtsist on Eurojust aktiivselt osalenud Euroopa Komisjoni loodud ELi varade külmutamise ja arestimise töökonnas, mille eesmärk on tagada nimekirja kantud Venemaa ja Valgevene oligarhide suhtes kehtestatud ELi sanktsioonide tõhus rakendamine kogu liidus. Eurojust pakub töökonnale operatiivtuge, koordineerides liidu sanktsioonide jõustamist liikmesriikides kriminaalõiguse kaudu.

    Eurojust juhib koos Ukraina peaprokuratuuriga Ukrainas toime pandud rahvusvaheliste kuritegude eest vastutust käsitleva dialoogirühma riiklike uurimiste töösuunda. Selle töösuuna eesmärk on tuvastada raskete rahvusvaheliste kuritegude juhtumite põhiprobleemid ja pakkuda ühiselt lahendusi poliitilisel tasandil, näiteks seoses avatud allikatest pärinevate tõendite kasutamisega rahvusvaheliste kuritegude uurimisel ja nende eest vastutusele võtmisel Ukraina kontekstis.

  • MIL-OSI Security: Praėjo treji metai nuo plataus masto invazijos į Ukrainą: Eurojusto remiami konkretūs veiksmai siekiant atskaitomybės

    JTG nariai intensyviai dirbo rengdami bendrą baudžiamojo persekiojimo strategiją, pagal kurią pirmenybė teikiama agresijos nusikaltimų, kankinimų, netinkamo elgesio ir filtravimo neteisėtose sulaikymo vietose bei genocido nusikaltimų tyrimams.

    Nuo 2022 m. kovo mėn. Agentūra surengė 26 koordinacinius pasitarimus, kuriuose dalyvavo JTG nariai ir kitos nacionalinės institucijos, tiriančios įtariamus sunkiausius tarptautinius nusikaltimus Ukrainoje. Dalyvaujančioms šalims buvo suteikta galimybė keistis duomenimis apie atitinkamus savo vidaus tyrimus, aptarti strategijas ir prioritetus bei koordinuoti tyrimo priemones.

    Eurojustas yra visiškai įsipareigojęs toliau remti svarbią JTG veiklą ir skyrė apie pusę milijono eurų jos veiklai finansuoti.

    JTG veiklą remia Tarptautinis baudžiamojo persekiojimo už agresijos nusikaltimą prieš Ukrainą centras (ICPA), taip pat sukurta Sunkiausių tarptautinių nusikaltimų įrodymų duomenų bazė (CICED), o Eurojustas organizuoja jų veiklą ir juos valdo.

    ICPA. Padaryta pažanga ruošiant patikimą agresijos nusikaltimo bylų rengimo rinkinį

    Per pastaruosius šešis mėnesius ICPA padarė didelę pažangą ruošdamas patikimą bylų rengimo rinkinį. Šis rinkinys grindžiamas bendra agresijos nusikaltimų tyrimo ir baudžiamojo persekiojimo strategija, dėl kurios susitarė ICPA dalyviai.

    Bylų rengimo rinkinį ketinama perduoti būsimai galimo specialiojo tribunolo ar kitų jurisdikcijų prokuratūrai.

    ICPA užtikrino ir toliau užtikrina galimų įrodymų, kurie gali būti susiję su aukščiausio lygio karinės ir politinės vadovybės asmenimis, rinkimą ir preliminarią analizę. Tyrimai vykdomi nepaisant asmenų užimamų oficialių pareigų.

    Tęsiantis agresijai Ukrainoje, daugėja įrodymų, kuriuos aktyviai tiria ICPA.

    ICPA gavo papildomą finansavimą, o 2025 m. sausio mėn. jo veikla buvo pratęsta šešiems mėnesiams. Šiuo tikslu Eurojustas ir Europos Komisijos Užsienio politikos priemonių tarnyba pasirašė susitarimo dėl įnašo pakeitimą.

    CICED. Daugiau kaip 3 700 įrodymų rinkmenų

    CICED yra Eurojusto sukurta unikali, specialiems poreikiams skirta teismų duomenų bazė, kurioje saugomi, kaupiami ir analizuojami sunkiausių tarptautinių nusikaltimų įrodymai. CICED suteikia Agentūrai galimybę padėti nacionalinėms teisminėms institucijoms nustatyti kitoje šalyje esančius įrodymus, kurie gali būti svarbūs jų atliekamiems tyrimams. Iki šiol 16 šalių CICED pateikė daugiau kaip 3 700 įrodymų rinkmenų.

    2025 m. sausio mėn. nauja vertimo priemonė nacionalinių institucijų pateiktas įrodymų rinkmenas leido išversti iš 19 kalbų į anglų kalbą. Ši naujovė labai paspartino Agentūros analitinį darbą. Dėl to duomenų bazės paieškos funkcija yra tikslesnė, o į nacionalinių institucijų prašymus pateikti informaciją galima atsakyti greičiau.

    Eurojustas deda daug pastangų, kad reaguotų į nacionalinių institucijų prašymus padėti joms tirti sunkiausius tarptautinius nusikaltimus. Be to, Agentūra pati nustatė rinkmenas, kurios laikomos naudingomis vykdant nacionalinius tyrimus.

    Pagrindiniai faktai

    Nuo pat karo pradžios Eurojustas aktyviai pasisakė už Rusijos atsakomybę už jos įvykdytus nusikaltimus. Praėjus vos trims savaitėms po plataus masto Rusijos invazijos 2022 m., Eurojustas pritarė JTG, kurią dabar sudaro Ukraina ir šešios ES valstybės narės, sudarymui, TBT ir Europolo dalyvavimui, taip pat susitarimo memorandumo su Jungtinėmis Valstijomis pasirašymui.

    Susiskaldžiusioje ir sudėtingoje operatyvinėje aplinkoje, vykstant karui ir įrodymams pasklidus po skirtingas teisines sistemas turinčias šalis, JTG suteikia galimybę partneriams tiesiogiai ir realiuoju laiku keistis informacija. Tai taip pat padeda JTG nariams supaprastinti savo tyrimų eigą, nes dalyvaujančios nacionalinės institucijos dabar gali sutelkti dėmesį į aktyvų savo bylų rengimą.

    Eurojustas JTG teikia teisines ir analitines ekspertines žinias, taip pat logistinę ir finansinę paramą.

    2023 m. vasario mėn. Eurojustas, remdamasis po invazijos į Ukrainą skubiai pakeistais Eurojusto įgaliojimais, sukūrė Sunkiausių tarptautinių nusikaltimų įrodymų duomenų bazę(CICED).

    Eurojuste 2023 m. liepos mėn. įsteigtas Tarptautinis baudžiamojo persekiojimo dėl agresijos prieš Ukrainą centras (ICPA) kartu su CICED remia JGT darbą.

    Nuo 2022 m. kovo mėn. Eurojustas aktyviai dalyvauja Europos Komisijos įsteigtos ES turto įšaldymo ir areštavimo darbo grupės veikloje, kad užtikrintų veiksmingą ES sankcijų, taikomų į sąrašą įtrauktiems Rusijos ir Baltarusijos oligarchams, įgyvendinimą visoje Europos Sąjungoje. Eurojustas darbo grupei teikia operatyvinę paramą, koordinuodamas valstybių narių vykdomą Sąjungos sankcijų taikymą pagal baudžiamąją teisę.

    Eurojustas kartu su Ukrainos generaline prokuratūra pirmininkauja dialogo grupės dėl atskaitomybės Ukrainai nacionalinių tyrimų darbo krypčiai. Šia darbo kryptimi siekiama nustatyti pagrindinius iššūkius sunkiausių tarptautinių nusikaltimų bylose ir kartu siūlyti sprendimus politiniu lygmeniu, pavyzdžiui, dėl atvirųjų šaltinių įrodymų naudojimo tiriant tarptautinius nusikaltimus Ukrainoje ir vykdant baudžiamąjį persekiojimą už juos.

  • MIL-OSI Security: Three years since the full-scale invasion of Ukraine: Concrete steps supported by Eurojust on the road to accountability

    JIT members have been busy working on a common prosecutorial strategy, which prioritises investigations into the crime of aggression, crimes of torture, ill-treatment and filtration in relation to illegal detention sites, as well as the crime of genocide. 

    Since March 2022, the Agency has organised 26 coordination meetings between the JIT and other national authorities investigating alleged core international crimes committed in Ukraine. This has allowed involved countries to exchange data on their respective domestic investigations, discuss strategies and priorities, and coordinate investigative measures.

    Eurojust is fully committed to continuing to support the important work of the JIT, and has allocated roughly half a million euros to finance its activities. 

    The JIT is supported by the work of the International Centre for the Prosecution of the Crime of Aggression against Ukraine (ICPA) and the Core International Crimes Evidence Database (CICED), both of which are hosted and managed by Eurojust.

    ICPA: progress made on a solid case-building package for the crime of aggression

    In the last six months, the ICPA has made significant progress in compiling a solid case-building package. This package relies on a common investigative and prosecutorial strategy on the crime of aggression, agreed on by ICPA participants. 

    The case-building package is intended for transmission to the future office of the prosecutor of a possible special tribunal or other jurisdictions. 

    The ICPA has and continues to ensure the collection and preliminary analysis of potential evidence that may relate to individuals at the highest levels of military and political leadership. Investigative efforts are not limited by the official positions that individuals may hold. 

    As the aggression in Ukraine continues, there is a growing body of evidence that the ICPA is actively investigating.

    The ICPA has received additional funding, and in January 2025, its operations were extended for six months. To this end, an amendment to the Contribution Agreement was signed between Eurojust and the European Commission’s Service for Foreign Policy Instruments.

    CICED: over 3 700 evidence files

    CICED is a unique, tailor-made judicial database set up by Eurojust to preserve, analyse and store evidence of core international crimes. CICED enables the Agency to support national judicial authorities in identifying evidence located in another country that may be relevant to their own investigations. To date, over 3 700 evidence files have been submitted to CICED by 16 countries.

    In January 2025, a new translation tool enabled evidence files submitted by national authorities to be translated from 19 languages into English. This game-changer has greatly accelerated the Agency’s analytical work. As a result, the database’s search function is more precise, and requests for information from national authorities can be answered more swiftly.

    Eurojust has been working hard to respond to national authorities’ requests to support their investigations into core international crimes. In addition, the Agency has proactively identified files deemed useful for ongoing national investigations.

    Background:

    Since the outbreak of the war, Eurojust has been at the forefront of supporting accountability for Russian crimes. Just three weeks following the full-scale invasion by Russia in 2022, Eurojust supported the setting up of a JIT that now consists of Ukraine, six EU Member States, the participation of the ICC and Europol, as well as a Memorandum of Understanding with the United States.

    In a fragmented and complex operational landscape, with the ongoing war and evidence spread across countries with different legal systems, the JIT allows partners to exchange information directly and in real time. It also helps JIT members to streamline their investigations, as the national authorities involved can now focus on actively building their cases.

    Eurojust provides legal and analytical expertise as well as logistical and financial support to the JIT.

    In February 2023, Eurojust launched the Core International Crimes Evidence Database (CICED), based on an urgent amendment of Eurojust’s mandate, following the invasion of Ukraine. 

    The International Centre for the Prosecution of the Crime of Aggression Against Ukraine (ICPA), established in July 2023, is also hosted by Eurojust and, together with CICED, supports the work of the JIT. 

    Since March 2022, Eurojust has actively participated in the EU Freeze and Seize Task Force set up by the European Commission to ensure the efficient implementation of EU sanctions against listed Russian and Belarusian oligarchs across the European Union. Eurojust provides operational support to the Task Force by coordinating Member States’ enforcement of Union sanctions through criminal law.

    Together with the Ukrainian Prosecutor General’s Office, Eurojust co-chairs the workstream on national investigations of the Dialogue Group on Accountability for Ukraine. This workstream aims to identify key challenges in core international crime cases and jointly propose solutions at the policy level, for example on the use of open-source evidence in the investigation and prosecution of international crimes in the context of Ukraine.

  • MIL-OSI Security: Tri roky od komplexnej invázie na Ukrajinu: konkrétne kroky podporované agentúrou Eurojust na ceste k vyvodeniu zodpovednosti

    Členovia spoločného vyšetrovacieho tímu vypracovali spoločnú stratégiu trestného stíhania, ktorej prioritou sú vyšetrovania zločinu agresie, trestných činov mučenia, zlého zaobchádzania a filtrácie v súvislosti s miestami, kde sa obmedzuje osobná sloboda, ako aj zločinu genocídy.

    Od marca 2022 agentúra organizovala 26 koordinačných stretnutí medzi spoločným vyšetrovacím tímom a ďalšími vnútroštátnymi orgánmi, ktoré vyšetrujú údajné najzávažnejšie medzinárodné trestné činy spáchané na Ukrajine. To umožnilo zúčastneným krajinám vymieňať si údaje o svojich príslušných domácich vyšetrovaniach, diskutovať o stratégiách a prioritách a koordinovať vyšetrovacie opatrenia.

    Eurojust je plne odhodlaný naďalej podporovať dôležitú prácu spoločného vyšetrovacieho tímu a na financovanie jeho činností agentúra vyčlenila približne pol milióna eur.

    Činnosť spoločného vyšetrovacieho tímu je podporovaná prácou Medzinárodného centra pre stíhanie zločinu agresie voči Ukrajine (ICPA) a databázou dôkazov najzávažnejších medzinárodných trestných činov (CICED), ktoré prevádzkuje a spravuje Eurojust.

    Centrum ICPA: pokrok v súvislosti so solídnym balíkom na rozpracovanie prípadov týkajúcich sa zločinu agresie

    Centrum ICPA v uplynulých šiestich mesiacoch dosiahlo významný pokrok pri zostavovaní solídneho balíka na rozpracovanie prípadov. Tento balík vychádza zo spoločnej stratégie vyšetrovania a trestného stíhania zločinov agresie, na ktorej sa dohodli účastníci centra ICPA.

    Balík na rozpracovanie prípadov je určený na odovzdanie budúcemu úradu prokurátora prípadného osobitného tribunálu alebo iným jurisdikciám.

    Centrum ICPA zabezpečilo a naďalej zabezpečuje zhromažďovanie a predbežnú analýzu potenciálnych dôkazov, ktoré sa môžu týkať jednotlivcov na najvyšších úrovniach vojenského a politického vedenia. Úsilie vynaložené na vyšetrovanie nie je obmedzené oficiálnymi pozíciami, ktoré môžu jednotlivci zastávať.

    Keďže útočná vojna na Ukrajine pokračuje, hromadí sa čoraz viac dôkazov, ktoré centrum ICPA aktívne vyšetruje.

    ICPA získalo dodatočné finančné prostriedky a v januári 2025 boli jeho operácie predĺžené o šesť mesiacov. Na tento účel bol podpísaný dodatok k dohode o príspevku medzi agentúrou Eurojust a Útvarom Európskej komisie pre nástroje zahraničnej politiky.

    Databáza CICED: viac ako 3 700 dôkazných spisov

    Databáza CICED je jedinečná, prispôsobená justičná databáza, ktorú zriadila agentúra na zabezpečenie, analýzu a uchovávanie dôkazov najzávažnejších medzinárodných trestných činov. Vďaka databáze môže agentúra podporovať vnútroštátne justičné orgány pri identifikácii dôkazov nachádzajúcich sa v inej krajine, ktoré môžu byť relevantné pre ich vlastné vyšetrovania. Do databázy 16 krajín do dnešného dňa odoslalo viac ako 3 700 dôkazných spisov.

    Nový prekladateľský nástroj v januári 2025 umožnil preklad dôkazných spisov, ktoré predložili vnútroštátne orgány, z 19 jazykov do angličtiny. Tento prelom analytickú prácu agentúry výrazne urýchlil . V dôsledku toho je funkcia vyhľadávania v databáze presnejšia a na žiadosti o informácie od vnútroštátnych orgánov možno odpovedať rýchlejšie.

    Eurojust vyvíja veľké úsilie v záujme toho, aby na žiadosti vnútroštátnych orgánov odpovedal a podporil tým ich vyšetrovania najzávažnejších medzinárodných trestných činov. Okrem toho agentúra proaktívne identifikovala súbory, ktoré považuje za užitočné pre prebiehajúce vnútroštátne vyšetrovania.

    Kontext:

    Od obdobia vypuknutia vojny stojí agentúra Eurojust v čele podporovania vyvodenia zodpovednosti za ruské zločiny. Len tri týždne po komplexnej invázii Ruska v roku 2022 Eurojust podporil vytvorenie spoločného vyšetrovacieho tímu, ktorý v súčasnosti zahŕňa zástupcov Ukrajiny, šiestich členských štátov EÚ, účasť Medzinárodného trestného súdu (ICC) a Europolu, ako aj memorandum o porozumení so Spojenými štátmi.

    V roztrieštenom a zložitom operačnom prostredí, v ktorom prebieha vojna, a s dôkazmi rozptýlenými v krajinách s rôznymi právnymi systémami, umožňuje spoločný vyšetrovací tím partnerom výmenu informácií priamo a v reálnom čase. Členom SVT pomáha tiež zefektívniť ich vyšetrovania, keďže zapojené vnútroštátne orgány sa teraz môžu zamerať na aktívne rozpracovanie svojich prípadov.

    Eurojust poskytuje spoločnému vyšetrovaciemu tímu právne a analytické odborné znalosti, ako aj logistickú a finančnú podporu.

    Agentúra vo februári 2023 sprístupnila databázu dôkazov najzávažnejších medzinárodných trestných činov (CICED) po tom, ako po invázii na Ukrajinu došlo k naliehavej zmene mandátu Eurojust.

    Medzinárodné centrum pre stíhanie zločinu agresie voči Ukrajine (ICPA), ktoré bolo zriadené v júli 2023, takisto prevádzkuje agentúra Eurojust a spolu s databázou CICED prispieva k práci spoločného vyšetrovacieho tímu.

    Agentúra Eurojust sa od marca 2022 aktívne zúčastňuje na osobitnej skupine EÚ pod názvom Freeze and Seize (Zmraziť a zaistiť), ktorú zriadila Európska komisia s cieľom zabezpečiť účinné vykonávanie sankcií EÚ voči ruským a bieloruským oligarchom uvedeným na zozname v celej Európskej únii. Eurojust poskytuje osobitnej skupine operačnú podporu tým, že koordinuje trestnoprávne presadzovanie sankcií Únie členskými štátmi.

    Spolu s ukrajinskou generálnou prokuratúrou Eurojust spolupredsedá pracovnému okruhu v oblasti vnútroštátnych vyšetrovaní v rámci skupiny pre dialóg o vyvodení zodpovednosti za Ukrajinu. Cieľom tohto pracovného okruhu je identifikovať kľúčové výzvy v prípadoch najzávažnejších medzinárodných trestných činov a spoločne navrhnúť riešenia na politickej úrovni, napríklad pokiaľ ide o využívanie dôkazov z otvorených zdrojov pri vyšetrovaní a stíhaní medzinárodných trestných činov v súvislosti s Ukrajinou.

    Membrii ECA s-au ocupat asiduu de elaborarea unei strategii comune de urmărire penală, care acordă prioritate anchetelor privind crima de agresiune, infracțiunile de tortură, relele tratamente și filtrarea în legătură cu centrele de lipsire de libertate în mod ilegal, precum și privind crima de genocid.

    Din martie 2022, agenția a organizat 26 de întâlniri de coordonare între ECA și alte autorități naționale care anchetează cele mai grave presupuse crime internaționale comise în Ucraina. Acest demers a permis țărilor implicate să facă schimb de date cu privire la anchetele lor naționale respective, să discute despre strategii și priorități și să coordoneze măsurile de investigare.

    Eurojust este angajată pe deplin să sprijine în continuare activitatea importantă a ECA și a alocat aproximativ o jumătate de milion de euro pentru a finanța activitățile acesteia.

    ECA este sprijinită de activitatea Centrului internațional pentru urmărirea în justiție a crimei de agresiune împotriva Ucrainei (ICPA) și de baza de date cu probe privind cele mai grave crime internaționale (CICED), ambele fiind găzduite și gestionate de Eurojust.

    ICPA: progresele înregistrate cu privire la un pachet solid de constituire de dosare pentru crima de agresiune

    În ultimele șase luni, ICPA a înregistrat progrese semnificative în compilarea unui pachet solid de constituire de dosare. Acest pachet se bazează pe o strategie comună de anchetă și urmărire penală cu privire la crima de agresiune, convenită de participanții la ICPA.

    Pachetul de constituire de dosare este menit să fie transmis viitorului parchet de pe lângă un posibil tribunal special sau altor jurisdicții.

    ICPA a asigurat și asigură în continuare colectarea și analizarea preliminară a potențialelor probe care pot avea legătură cu persoane de la cele mai înalte niveluri din conducerea militară și politică. Eforturile de anchetă nu sunt limitate de funcțiile oficiale pe care le pot deține persoanele respective.

    Pe măsură ce agresiunea din Ucraina continuă, există din ce în ce mai multe probe pe care ICPA le investighează în mod activ.

    ICPA a primit finanțare suplimentară, iar în ianuarie 2025 operațiunile sale au fost prelungite cu șase luni. În acest scop, Eurojust și Serviciul Instrumente de Politică Externă al Comisiei Europene au semnat un amendament la acordul de contribuție.

    CICED: peste 3 700 de dosare cu probe

    CICED este o bază de date judiciară unică personalizată, creată de Eurojust pentru conservarea, analizarea și stocarea probelor referitoare la cele mai grave crime internaționale. CICED permite agenției să sprijine autoritățile judiciare naționale la identificarea probelor care se află în altă țară și care pot fi relevante pentru propriile lor anchete. Până în prezent, peste 3 700 de dosare cu probe au fost depuse la CICED de către 16 țări.

    În ianuarie 2025, un nou instrument de traducere a permis traducerea dosarelor cu probe depuse de autoritățile naționale din 19 limbi în limba engleză. Acest instrument revoluționar a accelerat foarte mult activitatea analitică a agenției. În consecință, funcția de căutare a bazei de date este mai precisă, iar solicitările de informații ale autorităților naționale pot primi răspuns mai rapid.

    Eurojust a depus eforturi pentru a răspunde cererilor autorităților naționale de a le fi sprijinite anchetele privind cele mai grave crime internaționale. În plus, agenția a identificat în mod proactiv dosarele considerate utile pentru anchetele naționale în curs.

    Context:

    De la izbucnirea războiului, Eurojust a susținut din prima linie asumarea răspunderii pentru crimele ruse. La doar trei săptămâni de la invazia pe scară largă a Rusiei în Ucraina din 2022, Eurojust a sprijinit crearea unei echipe comune de anchetă care este formată în prezent din Ucraina și șase state membre ale UE, cu participarea CPI și a Europol, existând și un memorandum de înțelegere cu Statele Unite.

    Într-un peisaj operațional fragmentat și complex, cu războiul în desfășurare și cu probe răspândite în țări cu sisteme juridice diferite, ECA permite partenerilor să facă schimb de informații în mod direct și în timp real. De asemenea, acest lucru îi ajută pe membrii ECA să-și raționalizeze anchetele, deoarece autoritățile naționale implicate se pot concentra în prezent asupra elaborării active a cauzelor lor.

    Eurojust oferă expertiză juridică și analitică pentru ECA, precum și sprijin logistic și financiar.

    În februarie 2023, Eurojust a lansat baza de date cu probe privind cele mai grave crime internaționale (CICED), pe baza unei modificări urgente a mandatului Eurojust, în urma invadării Ucrainei.

    Centrul internațional pentru urmărirea în justiție a crimei de agresiune împotriva Ucrainei (ICPA), instituit în iulie 2023, este găzduit tot de Eurojust și, împreună cu CICED, sprijină activitatea ECA.

    Începând din martie 2022, Eurojust a participat activ la Grupul operativ „Înghețare și punere sub sechestru” al UE, înființat de Comisia Europeană pentru a asigura punerea eficientă în aplicare a sancțiunilor UE împotriva oligarhilor ruși și belaruși aflați pe listă la nivelul Uniunii Europene. Eurojust oferă sprijin operațional grupului operativ prin coordonarea aplicării de către statele membre a sancțiunilor Uniunii pe calea dreptului penal.

    Împreună cu parchetul general din Ucraina, Eurojust coprezidează direcția de lucru privind anchetele naționale ale Grupului de dialog privind asumarea răspunderii pentru Ucraina. Această direcție de lucru urmărește să identifice provocările-cheie din cazurile privind cele mai grave crime internaționale și să propună în comun soluții la nivel de politici, de exemplu cu privire la utilizarea probelor din surse deschise în anchetarea și urmărirea penală a crimelor internaționale în contextul Ucrainei.

    KIG dalībnieki ir strādājuši pie kopējas kriminālvajāšanas stratēģijas, kurā prioritāte tiek piešķirta agresijas nozieguma, spīdzināšanas, nepieņemamas izturēšanās un filtrēšanas noziegumu saistībā ar nelikumīgām ieslodzījuma vietām izmeklēšanai, kā arī genocīda noziegumam.

    Kopš 2022. gada marta Aģentūra ir rīkojusi 26 koordinācijas sanāksmes, kurās piedalījās gan KIG dalībvalstis, gan citu valstu iestādes, kas izmeklē iespējamos smagos starptautiskos noziegumus, kas izdarīti Ukrainā. Tas ir ļāvis iesaistītajām valstīm apmainīties ar datiem par attiecīgajām iekšzemes izmeklēšanām, apspriest stratēģijas un prioritātes un koordinēt izmeklēšanas pasākumus.

    Eurojust ir pilnībā apņēmusies turpināt atbalstīt KIG svarīgo darbu un ir piešķīrusi aptuveni pusmiljonu eiro izmeklēšanas grupas darbības finansēšanai.

    KIG darbu atbalsta Starptautiskais centrs saukšanai pie atbildības par agresijas noziegumu pret Ukrainu (ICPA) un Galvenā starptautisko noziegumu pierādījumu datubāze (CICED), kuras abas uztur un pārvalda Eurojust.

    ICPA: panākts progress attiecībā uz pārliecinošas apsūdzības materiālu paketes sagatavošanu par agresijas noziegumiem

    Pēdējo sešu mēnešu laikā ICPA ir panākusi ievērojamu progresu pārliecinošas apsūdzības materiālu paketes sagatavošanā. Šī pakete balstās uz kopīgu izmeklēšanas un kriminālvajāšanas stratēģiju par agresijas noziegumiem, par kuriem ir vienojušies ICPA dalībnieki.

    Apsūdzības materiālu pakete ir paredzēta nosūtīšanai iespējamā īpašā tribunāla prokuratūrai vai citām jurisdikcijām.

    ICPA ir nodrošinājusi un turpina nodrošināt to iespējamo pierādījumu vākšanu un sākotnējo analīzi, kas var attiekties uz personām augstākajā militārās un politiskās vadības līmenī. Izmeklēšanas centienus neierobežo personas ieņemamie oficiālie amati.

    Turpinoties agresijai Ukrainā, pieaug ICPA aktīvi izmeklēto pierādījumu skaits.

    ICPA ir saņēmis papildu finansējumu, bet 2025. gada janvārī tās darbība tika pagarināta par sešiem mēnešiem. Šajā nolūkā tika parakstīts iemaksu nolīguma grozījums starp Eurojust un Eiropas Komisijas Ārpolitikas instrumentu dienestu.

    CICED: vairāk nekā 3700 pierādījumu lietu

    CICED ir unikāla, īpaši pielāgota tiesu datubāze, ko izveidojusi Eurojust, lai saglabātu, analizētu un glabātu pierādījumus par galvenajiem starptautiskajiem noziegumiem. CICED ļauj Aģentūrai palīdzēt valstu tiesu iestādēm identificēt pierādījumus, kas atrodas kādā citā valstī un kas var būt būtiski to pašu veiktajās izmeklēšanās. Līdz šim 16 valstis CICED ir iesniegušas vairāk nekā 3700 pierādījumu lietas.

    2025. gada janvārī jauns tulkošanas rīks ļāva valstu iestāžu iesniegtās pierādījumu lietas tulkot no 19 valodām angļu valodā. Šis revolucionārais rīks ir ievērojami paātrinājis aģentūras analītisko darbu. Tā rezultātā datubāzes meklēšanas funkcija ir precīzāka, bet uz informācijas pieprasījumiem no valstu iestādēm var atbildēt ātrāk.

    Eurojust ir daudz strādājis, lai reaģētu uz valstu iestāžu pieprasījumiem atbalstīt to veikto izmeklēšanu par galvenajiem starptautiskajiem noziegumiem. Turklāt aģentūra ir proaktīvi identificējusi lietas, kas uzskatāmas par noderīgām valstu veiktajās izmeklēšanās.

    Kopš kara sākuma Eurojust ir bijusi priekšgalā, atbalstot saukšanu pie atbildības par Krievijas noziegumiem. Tikai trīs nedēļas pēc pilna mēroga iebrukuma Krievijā 2022. gadā Eurojust atbalstīja KIG izveidi, ko tagad veido Ukraina, sešas ES dalībvalstis, Starptautiskās Krimināltiesas un Eiropola dalība, kā arī saprašanās memorands ar Amerikas Savienotajām Valstīm.

    Sadrumstalotajā un sarežģītajā operatīvajā vidē, kad karš turpinās un pierādījumi ir izplatīti dažādās valstīs ar atšķirīgām tiesību sistēmām, KIG ļauj partneriem apmainīties ar informāciju tieši un reāllaikā. Tas arī palīdz KIG dalībniekiem vienkāršot viņu izmeklēšanas, jo iesaistītās valstu iestādes tagad var koncentrēties uz aktīvu savu lietu veidošanu.

    Eurojust KIG nodrošina ar juridisko un analītisko kompetenci, kā arī loģistikas un finansiālu atbalstu.

    Eurojust 2023. gada februārī izveidoja galveno starptautisko noziegumu pierādījumu datubāzi (CICED), pamatojoties uz steidzamu Eurojust pilnvaru grozīšanu pēc iebrukuma Ukrainā.

    Eurojust paspārnē atrodas arī Starptautiskais centrs saukšanai pie atbildības par agresijas noziegumu pret Ukrainu (ICPA), kas izveidots 2023. gada jūlijā un kopā ar CICED atbalsta KIG darbu.

    Члени групи JIT активно працюють над спільною прокурорською стратегією, яка надає пріоритет розслідуванню злочину агресії, злочинів катувань, жорстокого поводження та фільтрації щодо місць незаконного утримання, а також злочину геноциду.

    З березня 2022 року Агентство провело 22 координаційні зустрічі між JIT та іншими національними органами влади, які розслідують ймовірні основні міжнародні злочини, скоєні в Україні. Це дозволило залученим країнам обмінюватися даними про свої внутрішні розслідування, обговорювати стратегії та пріоритети, а також координувати слідчі заходи.

    Євроюст повністю зобов’язується надалі підтримувати важливу роботу групи JIT, і виділив близько півмільйона євро на фінансування своєї діяльності.

    Робота групи JIT підтримується роботою Міжнародного центру переслідування злочину агресії проти України (ICPA) та Бази даних доказів основних міжнародних злочинів (CICED), які розміщуються та керуються Євроюстом.

    ICPA: досягнутий прогрес у розробці солідного пакету матеріалів справ щодо злочину агресії

    За останні шість місяців ICPA досяг значного прогресу у створенні солідного пакету матеріалів для укладення справ. Цей пакет базується на спільній слідчій та прокурорській стратегії щодо злочину агресії, узгоджену учасниками ICPA.

    Пакет матеріалів для укладення справ призначений для передачі майбутньому офісу прокурора можливого спеціального трибуналу або іншим юрисдикціям.

    Центр ICPA забезпечив і продовжує забезпечувати збір і попередній аналіз потенційних доказів, які можуть стосуватися осіб на найвищому рівні військового і політичного керівництва. Слідчі дії не обмежуються офіційними посадами, які можуть обіймати окремі особи.

    Оскільки агресія в Україні триває, зростає кількість доказів, які активно досліджуються ICPA.

    ICPA отримав додаткове фінансування, а в січні 2025 року його діяльність була продовжена ще на шість місяців. З цією метою була підписана поправка до Угоди про внески між Євроюстом та Службою інструментів зовнішньої політики Європейської комісії.

    CICED: понад 3 700 файлів доказів

    CICED – це унікальна спеціалізована судова база даних, створена Євроюстом для збереження, аналізу та зберігання доказів основних міжнародних злочинів. CICED дозволяє Агентству підтримувати національні судові органи у виявленні доказів, розташованих в іншій країні, які можуть бути важливими для їхніх власних розслідувань. На сьогоднішній день до CICED було подано понад 3 700 файлів доказів з 16 країн.

    У січні 2025 року завдяки новому інструменту перекладу було перекладено файли доказів, поданих національними органами, з 19 мов на англійську. Це радикально нове рішення значно прискорило аналітичну роботу Агентства. Завдяки цьому функція пошуку в базі даних стала більш точною, а відповіді на запити на інформацію від національних органів влади можуть надаватися швидше.

    Євроюст активно працює над тим, щоб відповідати на запити національних органів влади для підтримки їхніх розслідувань основних міжнародних злочинів. Крім того, Агентство проактивно визначає файли, які вважаються корисними для поточних національних розслідувань.

    З початку війни Євроюст був на передньому краї у підтримці відповідальності за російські злочини. Всього через три тижні після повномасштабного вторгнення Росії у 2022 році Євроюст підтримав створення спільної слідчої групи JIT, якa зараз складається з України, шести країн-членів ЄС, за участю МКС та Європолу, а також Меморандуму про взаєморозуміння зі Сполученими Штатами.

    В умовах фрагментованої і складної оперативної обстановки, коли війна триває, а докази розташовані в країнах з різними правовими системами, група JIT дозволяє партнерам обмінюватися інформацією безпосередньо і в режимі реального часу. Це також допомагає членам групи JIT оптимізувати свої розслідування, оскільки залучені до неї національні органи тепер можуть зосередитися на активному укладенню справ.

    Євроюст надає групі JIT юридичну та аналітичну експертну підтримку, а також матеріально-технічне й фінансове забезпечення.

    У лютому 2023 року Євроюст запустив Базу даних доказів основних міжнародних злочинів (CICED) на основі термінового внесення змін до мандату Євроюсту після вторгнення в Україну.

    Міжнародний центр переслідування злочину агресії проти України (ICPA), створений у липні 2023 року, також розміщений у Євроюсті і разом з CICED підтримує роботу групи JIT.

    З березня 2022 року Євроюст бере активну участь у роботі Робочої групи ЄС з заморожування та конфіскації, створеної Європейською Комісією для забезпечення ефективного застосування санкцій ЄС проти російських та білоруських олігархів, включених до переліку, на всій території Європейського Союзу. Євроюст надає операційну підтримку Робочій групі шляхом координації виконання країнами-членами санкцій Європейського Союзу через кримінальне право.

    Разом з Офісом Генерального прокурора України Євроюст є співголовою робочого напрямку національних розслідувань Діалогової групи з питань притягнення до відповідальності за міжнародні злочини, вчинені в Україні. Метою цього робочого напрямку є визначення ключових викликів в справах основних міжнародних злочинів та спільні пропозиції щодо рішень на політичному рівні, наприклад, щодо використання доказів з відкритих джерел у розслідуванні та судовому переслідуванні міжнародних злочинів в контексті України.

  • MIL-OSI Australia: Guns and cash stolen in Yorketown break-in

    Police are investigating after firearms and cash was stolen from a home at Yorketown overnight.

    About 1am on Monday 24 February, police were called to a home on St Vincent Highway after three men broke into the property and assaulted the occupant. The men stole a large amount of cash along with a number of firearms.

    The suspects also stole the victim’s Toyota sedan which has since been located at Minlaton.

    The victim, a 74-year-old man, sustained injuries to his head and was treated at the local hospital.

    Yorke Mid North police are investigating the incident and are seeking anyone with information to call Crime Stoppers at www.crimestopperssa.com.au or on 1800 333 000.

  • MIL-OSI Australia: Arrest – Aggravated robbery – Karama

    The Northern Territory Police Force is calling for information in relation to an aggravated robbery that occurred in Karama on Saturday morning.

    Around 4pm, police received reports that two male youths entered a licenced premises on Kalymnos Drive, one of which was armed with an edged weapon, and allegedly threatened staff with the weapon.  The youths then stole a quantity of alcohol and fled the scene on foot.

    Casuarina General Duties swiftly identified and arrested a 14-year-old male, who was later charged with aggravated robbery. The other male youth remains outstanding.

    The Northern Territory Police Force has charged an 18-year-old male with drug and firearm offences on Friday.

    Northern Substance Abuse Intelligence Desk members conducted a lawful search on a residence in Katherine East on Friday, where police located and seized 1.7 kilograms of Cannabis, drug paraphernalia, fireworks, ammunition and two firearms

    He was arrested without incident and has since been charged with:

    •             Supply Schedule 2 Dangerous Drug – Commercial Quantity

    •             Possess Schedule 2 Dangerous Drug – Commercial Quantity

    •             Possessing Tainted Property

    •             2 x Possess / Use Firearm whilst unlicensed

    •             Possess Ammunition without permit or license

    •             Fail to meet storage requirements

    •             Possess Fireworks outside approved period

    He was remanded to appear in Katherine Local Court today.

  • MIL-OSI Asia-Pac: DH continues to clamp down on illegal waterpipe smoking in no smoking areas (with photos)

         The Tobacco and Alcohol Control Office (TACO) of the Department of Health (DH) conducted an enforcement operation in Tsim Sha Tsui last night (February 21) against illegal waterpipe smoking activities in no smoking areas and a total of three fixed penalty notices (FPNs) were issued. The operation, codenamed “Pipepurge”, was the surprise inspection and enforcement action carried out by TACO against illegal waterpipe smoking in no smoking areas following the operation last Thursday.

         During the operation, officers from TACO (including plainclothes officers) carried out inspections and enforcement action at one bar in Tsim Sha Tsui, and issued a total of three FPNs to persons illegally smoking waterpipes. TACO’s investigation is ongoing, and prosecution may also be taken against operators of the bar who are suspected of aiding and abetting smoking offences. TACO will also refer the cases to the Liquor Licensing Board for appropriate follow-up action.

         Under the Ordinance, conducting a smoking act in a statutory no smoking area (such as indoor areas of bars or restaurants) is prohibited. Any person doing a smoking act in statutory no smoking areas is liable to a fixed penalty of $1,500. Moreover, where smoking products (including waterpipes) are sold, in bars or otherwise, the restrictions on the promotion and sale of smoking products stipulated in the Ordinance apply. Offenders are liable on summary conviction to a maximum fine of $50,000. Venue managers of statutory no smoking areas are empowered by the Ordinance to request a smoking offender cease the act; if the offender is not co-operative, the manager may contact the Police for assistance.

         In addition, under the Criminal Procedure Ordinance, any person who aids, abets, counsels or procures the commission by another person of any offence shall be guilty of the same offence.

         “The DH will continue to closely monitor and take stringent enforcement action against illegal waterpipe smoking. Last year (2024), TACO conducted 162 operations against illegal waterpipe smoking activities in no smoking areas. A total of 162 FPNs were issued against smoking offenders, while 89 summonses were issued to staff members and operators of the bars/restaurants for other related offences,” the Head of TACO, Dr Fung Ying said.

         Dr Fung reminded the public that waterpipe is also a smoking product, and its combustion of fuel (e.g. charcoal) releases carbon monoxide. Exposure to a low concentration of carbon monoxide can lead to a range of symptoms such as dizziness, headache, tiredness and nausea; whereas exposure to a high concentration of carbon monoxide can lead to impaired vision, disturbed co-ordination, unconsciousness, brain damage or even death. People should seek medical attention immediately if they suspect they are developing symptoms of carbon monoxide poisoning.

         Due to deeper inhalation and longer smoking sessions, waterpipe users usually inhale more toxins than they would when smoking cigarettes. A typical one-hour waterpipe smoking session exposes the user to 100 to 200 times the volume of smoke inhaled from a single conventional cigarette. Moreover, sharing a waterpipe apparatus increases the risk of transmitting infectious diseases, such as tuberculosis. 

         She cautioned against waterpipe smoking and the use of other smoking products. Smokers should quit smoking as early as possible for their own health and that of others.   • MIL-OSI Australia: More police set to start work as recruitment initiatives take effect

    More than 1,000 newly graduated police officers will start work across metro, regional and rural NSW this year – the largest number of recruits in two years to attest the Goulburn Police Academy and a major boost to frontline policing and community safety.

    This follows December’s notable attestation with more than 300 officers – the largest class in a decade – attesting and starting work at their new home stations across the state.

    Applications to join the NSW Police Force (NSWPF) have increased by more than 60 per cent since the Minns Labor Government announced paid study in October 2023 – with 3,360 people applying to join the NSWPF.

    Last year, the NSW Government introduced the ‘Be A Cop in Your Hometown’ initiative, allowing recruits from rural areas to serve in or near their hometowns after graduating from the Goulburn Police Academy. The next class to graduate will be the first to benefit from this new scheme.

    Today, we are pleased to report that 47 individuals have applied to return to regional locations under the program, and all will be deployed to these areas upon graduating from the Goulburn Police Academy.

    In the next class to graduate, nine recruits—seven men and two women—will be eligible to return to regional locations they have nominated, followed by another 23 in the class after that.

    Among them, one recruit is a mother of five who will be returning to her hometown of Coffs Harbour, and another is a father and daughter training together from Inverell.

    Under 12 years of the former Liberal Government, they had no plan for police recruitment, no plan for police retention and sent wages backwards for more than a decade.

    In fact, police officer turnover, more than doubled in the last term of the Liberal National Government, from 513 per year to more than 1286 per year.

    While we still have more work to do, this application and graduate data shows that the Minns Labor Government has been able to begin to arrest the slide in recruitment for New South Wales police.

    These initiatives are part of the Government’s broader, long-term plan to address the crisis in recruitment and retention of frontline workers, especially in law enforcement, and ensure the safety of our communities.

    This includes important initiatives including:

    • Abolishing the wages cap, ensuring fair and competitive salaries for police officers;
    • Delivering a historic wage increase, overwhelmingly backed by NSW Police officers with 96 per cent voting in favour;
    • Establishing a groundbreaking scheme to pay students while they study to become officers, resulting in a 67 per cent surge in applications over the past year; and
    • Launching two new targeted programs to attract both experienced officers and regional recruits.

    NSW Premier Chris Minns said:

    “When we entered Government, we committed to rebuilding frontline services, and I’m proud to say we’re making real progress in restoring our police force.

    “It’s a big job, it’s a very tough job, and we know how important police officers are, often risking their lives to keep us safe.

    “There’s still more work to do, but we’ve shown we’re prepared to take strong steps to back in our police force.”

    Minister for Police and Counter-Terrorism Yasmin Catley said:

    “These results show that the strategies we’ve put in place are working and that we are making real progress in addressing the recruitment and retention challenges that have long plagued the NSW Police Force.

    “While there’s more work to be done, we are confident that the tide is changing. We are attracting new recruits, retaining experienced officers, and making policing a more rewarding and attractive career.

    “This is just the beginning, and we will continue to build on this momentum to ensure that our police force is equipped and supported to keep our communities safe.”

    “I am enormously proud of these numbers, they are a turning point as we plan for the next generation of police in NSW.

    Today marks three years since Russia’s full-scale invasion of Ukraine./p>

    For three years, Ukraine has bravely resisted Russia’s illegal and immoral war of aggression.

    Australia mourns the loss of life of Ukraine’s citizens and defenders, and the generational toll of Russia’s brutality.

    Australia continues to stand with Ukraine.

    We have committed over $1.5 billion to help Ukraine defend itself, including more than $1.3 billion in military support through vital equipment for the battlefield and the training of Ukrainian forces.

    Australia has been clear since day one that Russia, and those enabling its illegal invasion, will face consequences.

    The Australian Government has today imposed further targeted financial sanctions and travel bans on 70 persons, and targeted financial sanctions on 79 entities.

    This constitutes Australia’s largest sanctions package since February 2022.

    The new sanctions target individuals propping up Russia’s illegal administrations in eastern Ukraine and Crimea, including so-called “ministers”, judges and prosecutors, and individuals responsible for conflict-related sexual violence and the forced deportation of Ukrainian children.

    The sanctions also target persons and entities involved in deepening military cooperation between Russia and North Korea, including the deployment of North Korean troops to the battlefield.

    Deepening Russia-North Korea military cooperation is a dangerous expansion of Russia’s war, with serious consequences for European and Indo-Pacific security.

    Targets in Russia’s defence, transport and finance sectors, and those spreading disinformation to undermine Ukraine and governments around the world, have also been sanctioned.

    Australia has now imposed a total of more than 1,400 sanctions in response to Russia’s full-scale invasion of Ukraine.

    The Government has taken decisive action to ensure Australians are not inadvertently fuelling Russia’s war economy.

    Today we have further tightened trade bans on Russia by prohibiting the supply of commercial drones and components, including the provision of related services.

    Guidance on the operation of these bans can be found on the sanctions guidance webpage.

    Once again, Australia calls on Russia to immediately end its war and adhere fully to its obligations under international law, including in relation to the protection of civilians and treatment of prisoners of war.

    Working with Ukraine and our partners, Australia supports a just and lasting peace for Ukraine.

  • MIL-OSI Security: Three charged and further arrest made in ongoing Hackney murder investigation

    Three men have been charged with murder as part of an investigation into the death of 20-year-old Jason Romeo in Hackney this week.

    Jason sustained stab wounds outside an address in Bodney Road, E5 at 17:59hrs on Tuesday, 18 February.

    A murder investigation was launched within the Metropolitan Police’s Specialist Crime Command and three men have since been charged.

    Raynolph Asante, 22 (13.03.2002) of Pembury Road, Hackney, Travis Mitchell, 21 (23.07.2002) of Bodney Road, Hackney and Rhamyah Bailey-Edwards, 21 (21.08.2003) of Williams Avenue, Walthamstow have been charged with murder.

    The three men will appear at Thames Magistrates on Monday, 24 February.

    The investigation into Jason’s death remains ongoing and on Saturday, 23 February, officers arrested an 18-year-old man on suspicion of murder. He remains in custody.

    NEW ORLEANS – CODY FRANCIS (“FRANCIS”), age 34, of New Orleans, was sentenced on February 13, 2025, by Chief United States District Judge Nannette Jolivette Brown.  FRANCIS previously pled guilty to conspiracy to commit theft of government funds, having stolen $11,378.27 from the United States Department of the Army by claiming reimbursement for the performance of military funeral honors ceremonies that never happened.

    The National Defense Authorization Act of 2000 authorizes military funeral honors for active-duty soldiers, retirees, and veterans.  At a family’s request, eligible persons can receive military funeral honors, including the folding and presenting of the United States flag and the playing of “Taps.”

    Chief Judge Brown sentenced FRANCIS to one year probation, 100 hours of unpaid community service, the payment of $11,378.27 in restitution to the Department of the Army, and a $100 mandatory special assessment fee.

    Acting U.S. Attorney Simpson praised the work of the United States Army Criminal Investigation Command.  Assistant United States Attorney Andre J. Lagarde of the Public Integrity Unit is in charge of the prosecution.

    The UN Secretary-General has strongly condemned the killing of a Tunisian peacekeeper serving with the UN Stabilization Mission in the Central African Republic, MINUSCA. 

    The ‘blue helmet’ was part of a long-range MINUSCA patrol to protect civilians, that was near the village of Zobassinda, in Bamingui-Bangoran prefecture, which came under attack on Tuesday night by an unidentified armed assailant.

    António Guterres expressed his deepest condolences to the families of the fallen peacekeeper, and to the Government and the people of Tunisia.

    “The Secretary-General recalls that attacks targeting United Nations peacekeepers may constitute war crimes under international law,” said a statement issued by the UN spokesperson’s office. 

    Call for swift justice

    “He calls on the Central African authorities to spare no effort in identifying the perpetrators of this tragedy so that they can be brought to justice swiftly.”

    The UN chief also reaffirmed the solidarity of the United Nations with the people and Government of CAR.

    Head of MINUSCA and UN Special Representative Valentine Rugwabiza also condemned the attack and said the “cowardly” act would not undermine the mission’s determination to implement its mandate “in the service of peace and stability” in CAR.

    Peacekeeping, relief efforts, continue to face challenges in DR Congo 

    The United Nations on Wednesday called on the M23 armed group to allow the unimpeded movement of UN personnel and humanitarian aid, as the violence in the eastern Democratic Republic of the Congo (DRC) continues to displace civilians.

    At a press briefing in New York on Wednesday, UN Deputy Spokesperson Farhan Haq said that the UN peacekeeping mission in the country, MONUSCO, was facing increasing restrictions in the Kivu provinces.

    M23 fighters denied the mission’s contractors access to Goma to deliver food to the MONUSCO bases and obstructed efforts to safely dispose of unexploded ordnance, including one posing a direct threat to peacekeepers and unarmed Congolese forces within a MONUSCO facility.

    “The UN Mission calls on the M23 to allow the unimpeded movement of UN personnel and to fully respect established humanitarian corridors,” Mr. Haq said.

    He added that on Wednesday, the remains of 18 soldiers – including two MONUSCO peacekeepers and 16 troops from the Southern African Development Community (SADC) mission – were repatriated to South Africa. 

    A MONUSCO peacekeeper from Uruguay, also killed in recent clashes, was flown home on Tuesday.

    Humanitarian crisis deepens

    Meanwhile, ongoing violence in South Kivu has led to further displacement. Earlier on Wednesday, local time, fighting in Ihusi, about 70 kilometres north of Bukavu, forced residents to flee to nearby towns and islands in Lake Kivu, Mr. Haq said.

    In North Kivu, UN and humanitarian workers continue to assess needs and provide emergency aid where security allows. However, transportation remains a major challenge, complicating efforts to deliver food and supplies.

    In Ituri province, attacks since 8 February have killed at least 59 civilians in Djugu, with many others wounded or missing. 

    “The UN Office for the Coordination of Humanitarian Affairs (OCHA) reiterates that all parties must protect civilians and allow access to the essential services they need to survive,” Mr. Haq said. 

    Greater inclusion and cooperation critical to prevent violent extremism

    For the third consecutive year, the UN commemorated the International Day for the Prevention of Violent Extremism as and when Conducive to Terrorism, observed on 12 February. 

    In a social media post on Wednesday, UN Deputy Secretary-General Amina Mohammed said that preventing violent extremism requires addressing its root causes, which are inequality and injustice. 

    “On this International Day, let’s commit to fostering inclusion, development, and human rights to build a future free from extremism and terrorism,” she said.

    Dialogue, trust and respect

    In a video message, the head of the UN Office of Counter-Terrorism (UNOCT), Vladimir Voronkov, said that prevention of violent extremism requires long-term multifaceted solutions that are rooted in cooperation across all sectors.

    He listed governments, international and regional organizations, civil society, educators, religious leaders, and the private sector, in this regard.

    “This involves strengthening communities, addressing grievances, empowering women, and youth, investing in education, and ensuring inclusive development for all,” he said.

    “It demands that we challenge hatred, misinformation, and the forces that seek to divide us, and instead foster dialogue, trust, and respect for human dignity.”

    Later at a commemorative event, Mr. Voronkov outlined some of his Office’s work to counter terrorism, such as providing capacity building assistance to beneficiaries to enhance their knowledge and skills in prevention.

    Future initiatives include partnering with the UN Interregional Crime and Justice Research Institute (UNICRI) to examine the emerging risks and opportunities of video gaming in Africa, as part of efforts to invest in new frontier issues.

  • MIL-OSI Security: New Orleans Man Guilty of Federal Controlled Substances and Federal Gun Control Acts Violations

    NEW ORLEANS, LOUISIANA – ARMOND BURNETTE (“BURNETTE”), age 35, of New Orleans, pled guilty on February 11, 2025 to a three-count indictment charging him with possession with intent to distribute controlled substances, in violation of Title 21, United States Code, Sections 841(a)(1) and 841(b)(1)(C), and possession of a firearm by a convicted felon, in violation of Title 21, United States Code, Sections 922(g)(1) and 924(a)(8).

    BURNETTE faces a maximum penalty of (20) years imprisonment, at least three (3) years of supervised release and a fine of up to $1,000,000, for possession with the intent to distribute controlled substances; and a maximum penalty of fifteen (15) years  imprisonment, up to three (3) years of supervised release, and a fine of up to $250,000.00 for the possession of a firearm by a convicted felon.  BURNETTE also faces payment of a $100 mandatory special assessment fee per count.

    According to court documents, on June 23, 2023, New Orleans Police Department (NOPD) officers observed BURNETTE who was wanted for multiple attachments, walking in the French Quarter.  NOPD officers approached BURNETTE but he fled and was arrested a short time later.  BURNETTE was found in possession of  a plastic bag with twenty-one (21) individually wrapped baggies containing fentanyl, and 3.39 grams of cocaine.  On April 25, 2024, NOPD officers conducting a drug investigation, observed BURNETTE exit a silver BMW in the 600 block of Iberville and enter a bar wearing a backpack.  Officers met BURNETTE as he was exiting the bar without the backpack.  Officers located the bag, that contained a firearm, near a poker machine inside the bar.

    Officers opened the bag and found a firearm.  Thereafter, officers searched the silver BMW and recovered one bag containing seven bags of fentanyl, a digital scale, and a small amount of methamphetamine.

    After searching the backpack , officers also recovered six dosages of Tapentadol, ecstasy pills, approximately 4 grams of cocaine, and  a stolen .40 caliber Smith & Wesson firearm.

    This case is part of Project Safe Neighborhoods (PSN), a program bringing together all levels of law enforcement and the communities they serve to reduce violent crime and gun track violence, and to make our neighborhoods safer for everyone.  On May 26, 2021, the Department launched a violent crime reduction strategy strengthening PSN based on these core principles: fostering trust and legitimacy in our communities, supporting community-based organizations that help prevent violence from occurring in the first place, setting focused and strategic enforcement priorities, and measuring the results.

    The case was investigated by the Bureau of Alcohol, Tobacco, and Firearms.  Assistant United States Attorney Michael E. Trummel of the Violent Crimes Unit is in charge of the prosecution.

  • MIL-OSI Security: Honduran Guilty of Illegally Using Social Security Number to Obtain Employment

    NEW ORLEANS, LOUISIANA – Acting United States Attorney Michael M. Simpson announced that CESAR ALVAREZ-ESPINAL (“ALVAREZ-ESPINAL”), a native of Honduras, pleaded guilty on February 20, 2025 to illegally using a social security number to qualify for employment, in violation of Title 42, United States Code, Section 408(a)(7)(B).

    ALVAREZ-ESPINAL faces a maximum term of imprisonment of five (5) years, up to three (3) years of supervised release, a fine of up to $250,000.00, and a mandatory special assessment fee of $100.00.  

    According to court documents, in November 2024, Homeland Security Investigations received information that certain individuals had used fraudulent Social Security cards in an initial application to obtain employment.  Prior to finalizing employment with their prospective company, the individuals were required to report to the Gulf Coast Safety Council.  The Gulf Coast Safety Council provides safety courses to applicants applying for work with companies that service petrochemical processing plants.  On November 13, 2024, ALVAREZ-ESPINAL arrived at the Gulf Coast Safety Council office in St. Rose, Louisiana to complete the safety course.  On that day, ALVAREZ-ESPINAL presented a fraudulent United States Social Security card bearing the name and United States Social Security number of a United States citizen, that he represented to be his own in order to obtain employment.

    Acting U.S. Attorney Simpson praised the work of Homeland Security Investigations in investigating this matter.  Assistant United States Attorney Jon M. Maestri of the General Crimes Unit is in charge of the prosecution.

  • MIL-OSI Australia: Charges – Recklessly endanger serious harm – Central Desert Region

    The Northern Territory Police Force has charged a 17-year-old male with recklessly endangering serious harm after an incident at a community in the Central Desert Region on Thursday morning.

    About 2:00am, police allege the male armed with an edged weapon threatened and assaulted his 16-year-old female partner, stabbing her multiple times in the leg. A 15-year-old female, known to the victim, attempted to intervene and was stabbed in the back before the offender continued to assault his partner by stabbing her in the back. The two female youths fled from the offender and were treated at the local clinic with serious injuries.

    Yesterday, Alice Springs members were deployed to the community to assist local police in safely apprehending the 17-year-old male.

    He was arrested and charged with:

    • Recklessly Endanger Serious Harm
    • Endangering others (being rescued)
    • Aggravated Assault
    • Breach of Bail
    • Served with a full non-contact DVO

    He was remanded to appear in court tomorrow.

    NEW ORLEANS, LOUISIANA – FERNANDO BRISTER (“BRISTER”), age 35, and resident of Bogalusa, Louisiana was indicted on January 31, 2025, announced Acting United States Attorney Michael M. Simpson.  Count One of the indictment charged him with distribution of Methamphetamine, in violation of Title 21, United States Code, Sections 841(a)(1) and 841(b)(1)(C).  Count Two charged him with being a felon in possession of firearm, in violation of Title 18, United States Code, Sections 922(g)(1), 924(a)(8), and 942(e).

    If convicted, BRISTER faces up to 20 years’ imprisonment, up to a $1,000,000 fine, and at least 3 years of supervised release for Count One.  For Count Two, BRISTER faces not less than 15 years imprisonment, up to a $250,000 fine, and up to 3 years of supervised release.  BRISTER also faces payment of a $100 mandatory special assessment fee as to both counts.

    According to court documents, on January 31, 2023, BRISTER knowingly and intentionally distributed methamphetamine, a Schedule II controlled substance, to an undisclosed person.  On February 6, 2023, BRISTER was a felon and  knowingly possessed a Glock Model 43, nine–millimeter caliber pistol and ammunition.

    This case is part of Project Safe Neighborhoods (PSN), a program bringing together all levels of law enforcement and the communities they serve to reduce violent crime and gun violence, and to make our neighborhoods safer for everyone.  On May 26, 2021, the department launched a violent crime reduction strategy strengthening PSN based on these core principles: fostering trust and legitimacy in our communities, supporting community-based organizations that help prevent violence from occurring in the first place, setting focused and strategic enforcement priorities, and measuring the results.

    Acting United States Attorney Michael M. Simpson reiterated that the indictment is merely a charge and that the guilt of the defendant must be proven beyond a reasonable doubt.

    The case was investigated by the Bureau of Alcohol, Tobacco, Firearms and Explosives and the Washington Parish Police Department. It is being prosecuted by Assistant United States Attorney Troy Bell of the Violent Crime Unit.

    Prime Minister James Marape has issued a strong appeal to all young men and boys in Papua New Guinea — stop abusing girls, mothers, and sisters.

    He made the plea yesterday before flying to Australia, emphasising the importance of respecting women and children in society.

    Marape urged young men to take their issues to him instead of resorting to violence against women and children.

    Marape also called for the nation to rise in consciousness to preserve the values and achievements of their fathers and mothers who fought for independence 50 years ago.

    “We want to give a special recognition to the fathers and mothers of our country, a generation and people of our country to be proud to be here today,” he said.

    He expressed his pain at seeing the continued cycle of abuse and disrespect towards women and children in the country.

    Marape’s message was clear: violence and abuse towards women and children would not be tolerated, and the nation must come together to ensure the safety and well-being of all its citizens.

    ‘Don’t do it to our sisters’
    “These are not two things that we want to take on. For every young boy out there, if you have an issue in society, I don’t mind you taking it upon me. But please don’t do it to the girls in the neighbourhood,” he said.

    “Don’t do it to our sisters in the neighbourhood. Don’t do it to our mothers and aunties in the neighbourhood.

    “In a time when our nation is facing a 50th anniversary, I call for our nation to rise in a consciousness to preserve what our fathers and mothers did 50 years ago.

    “Lawlessness, disrespect for each other, especially women and children amongst us. This is something that I speak at great lengths and speak from the depth of my heart.

    “It pains me to see girls, women, and children continue to face a vicious cycle of abuse and total abhorrence, abuse of children, rape,” he said.

    “I just thought these are important activities coming up. I want to conclude by asking our country through the media.

    “We are in another state of our 50th anniversary year.

    ‘Let us take responsibility’
    “We have many challenges in our country. But all of us, we take responsibility of our country. As government, we are trying our absolute best.

    “Citizens, public servants, private sector, all of us have responsibility to our country. Unless you have another country to go and live in, if property is your country in the first instance, I call out to all citizens, take responsibility in your corner of property.

    “Privacy alone cannot be able to do everything that you expect it to do.

    “I’m not omnipotent. I’m not omniscient. I’m not omnipresent.

    “I’m but only one person coordinating at the top level. Call for every citizen of our country.

    “As we face our 49th year and as we welcome our 50th of September 16,) we call this on every one of us.”

    NEW ORLEANS, LOUISIANA – LADONTE RICHARDSON (“RICHARDSON”), age 22, a resident of New Orleans, pled guilty on February 13, 2025, to possession of  a machinegun, announced Acting U. S. Attorney Michael M. Simpson.

    RICHARDSON faces a maximum term of 10 years of imprisonment, and/or a fine up to $250,000, up to 3 years of supervised release, and $100 mandatory special assessment fee.

    According to court records, on August 29, 2023, RICHARDSON posted a photo on his Instagram page with three train emojis, along with an emoji of a cellphone.  Investigators believed this to be an advertisement for selling Tapentadol pills, which are commonly referred to as “trains.”  On September 7, 2023, RICHARDSON posted another advertisement for drugs.  Based upon these posts, on September 8, 2023, a Federal Bureau Investigation (“FBI”) Task Force Officer (“TFO”) obtained  a search warrant for RICHARDSON’s Instagram account that showed RICHARDSON possessing firearms.  Specifically, on September 17, 2023, RICHARDSON live streamed himself on a video brandishing a firearm with a laser sight.  On September 21, 2023, an arrest warrant was issued for RICHARDSON for two counts of second-degree murder that occurred on December 7, 2022.  U.S. Marshals located and arrested RICHARSON in New Orleans.  A search of his residence revealed the same firearm brandished by RICHARDSON on his Instagram page, in a bedroom dresser.  The firearm was equipped with a switch.  The firearm was also stolen. 

    RICHARDSON admits possessing and knowing it was a machine gun.

    This case is part of Project Safe Neighborhoods (PSN), a program bringing together all levels of law enforcement and the communities they serve to reduce violent crime and gun violence, and to make our neighborhoods safer for everyone.  On May 26, 2021, the Department launched a violent crime reduction strategy strengthening PSN based on these core principles: fostering trust and legitimacy in our communities, supporting community-based organizations that help prevent violence from occurring in the first place, setting focused and strategic enforcement priorities, and measuring the results.

    The case was investigated by the Federal Bureau of Investigation and the New Orleans Police Department.  The case is being prosecuted by Assistant U. S. Attorney Mike Trummel of the Violent Crime Unit.

  • MIL-OSI Security: Kenner Man Enters Guilty of Possession of Child Sexual Abuse Material

    NEW ORLEANS, LOUISIANA – NOAH TORRES (“TORRES”), age 47, of Kenner, pled guilty on February 20, 2025, to Possession of Materials Involving the Sexual Abuse of Minors, in violation of Title 18, United States Code, Sections 2252(a)(4)(B), announced Acting U.S. Attorney Michael M. Simpson.

    TORRES faces a maximum sentence of twenty (20) years imprisonment, and/or a fine of up to $250,000.00, a term of supervised release of no less than five (5) years and up to life, after  release from prison, and a mandatory $100 special assessment fee.

    According to court documents, on Monday, July 24, 2023, TORRES was arrested at his Kenner residence by Special Agents with the U.S. Department of Homeland Security, Homeland Security Investigations, after the execution of a federal search warrant. TORRES admitted to possessing 219 images and 340 videos depicting prepubescent minors engaging in sexually explicit conduct.

    Sentencing in this matter is scheduled for May 22, 2025, before United States District Judge Eldon E. Fallon.

    This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse launched in May 2006 by the Department of Justice. Led by United States Attorney’s Offices and the Criminal Division’s Child Exploitation and Obscenity Section (CEOS), Project Safe Childhood marshals federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims.  For more information about Project Safe Childhood, please visit www.projectsafechildhood.gov.

  • MIL-OSI Security: Salt Springs — RCMP investigates fatal crash in Salt Springs

    Pictou County District RCMP is investigating a fatal crash that occurred in Salt Springs.

    On February 20, at approximately 3:45 p.m., RCMP officers, fire services, and EHS responded to a report of an overturned vehicle in the river under Hwy. 104 near West River East Side Rd.

    Responders located a Dodge Grand Caravan on its roof with two injured people inside. Fire services recovered the driver, a 75-year-old man, and the passenger, a 73-year-old woman, both of Cheticamp.

    The woman was pronounced deceased at the scene. The man suffered life-threatening injuries and was transported to hospital via EHS LifeFlight.

    The preliminary investigation is ongoing and is being assisted by the Nova Scotia RCMP Collision and Reconstruction Service team.

  • MIL-OSI Security: Three arrested on suspicion of murdering 20-year-old Jason Romeo

    Detectives are no longer appealing for the public’s help to locate three men in connection with an ongoing investigation into the death of 20-year-old Jason Romeo in Hackney.

    Jason died on Tuesday, 18 February, after being stabbed outside an address in Bodney Street, E5 at 17:59hrs.

    A murder investigation within Specialist Crime Command remains ongoing and on Friday, 22 February, three men were arrested on suspicion of murder. The men, aged 22, 21 and 21 remain in custody.

    Detective Superintendent Kelly Allen, leading the investigation, said:

    “I would like to thank the public for their support following an appeal issued yesterday to identify three men.

    “This investigation is progressing quickly and our officers are working tirelessly to get justice for Jason and his family.

    “We are continuing to appeal to anyone who may have information which could support this investigation to come forward. Specifically, around two men, we believe were in the area at the time of Jason’s death who officers are looking to identify. Anyone with any information is asked to contact us.”

    No public funds for companies complicit in genocide.

    The Scottish Greens will use an opposition debate on Wednesday to hold a vote on ending all Scottish Government support for companies who have armed and supported Israel’s genocide against Gaza.

    The Scottish Government has strongly opposed the bombing and collective punishment of Gaza. Despite this, since the assault began it has given over £1 million to companies that have armed Israel via Scottish Enterprise.

    This week one of those companies, arms giant BAE systems, announced profits of more than £3 billion for 2024.

    The party’s co-leader, Lorna Slater, said:

    “Israel’s assault on Gaza is one of the worst war crimes of this century. There is no justification for the collective punishment and mass killing they have inflicted.

    “The Israeli government has been condemned by the International Criminal Court and every reputable human rights organisation for the atrocities it has carried out against Palestinians, and now it is working with Donald Trump to ethnically cleanse Gaza.

    “The Scottish Government has rightly stood against the genocide, but it continues to give public money to the arms dealers who are directly enabling it.

    “Scotland can’t control UK foreign policy, but we can control where our public money goes and the companies and industries that we choose to support.

    “It’s time for the Scottish Government to put their money where their mouth is and end all subsidies for the war profiteers making such a killing.”

    In 2018 the Scottish Greens secured new requirements for Scottish public bodies to conduct human rights checks for grant applicants. Despite this, Scottish Enterprise has continued to fund the world’s biggest arms dealers.

    Ms Slater added:

    “If a human rights check still allows public money to flow to companies profiting from war crimes, then it’s clearly not fit for purpose.

    “Every MSP who is horrified by the destruction in Gaza should support our motion and call for an end to government grants to the world’s biggest arms companies.”

    Around 80,000 people in northeastern Colombia are suffering the devastating consequences of an armed conflict that escalated on 15 January of this year. Caught in the crossfire between armed groups, thousands have been forced to flee with nothing but the clothes on their backs while others remain trapped in their homes.

    Miguel Ángel López, the director of a funeral home in Tibú, used to recover bodies that appeared along the roads of one of Colombia’s most violent regions, Catatumbo. On 15 January, he was murdered along with his wife and their 10-month-old baby while driving a hearse toward Cúcuta, according to local media reports. Only their 10-year-old son survived.

    Less than 24 hours later, several former combatants who had signed the 2016 Peace Agreement between the Colombian Government and the FARC-EP armed group were killed.

    Since then, thousands have fled as a conflict between the National Liberation Army (ELN) and the FARC group 33rd Front has claimed the lives of at least 80 people and displaced entire communities.

    Targeted killings

    Diego Andrés García, who works for the UN refugee agency, UNHCR, and coordinates the response of UN agencies and other organizations, said more than 53,000 people have moved to urban centres such as Cúcuta, Ocaña and Tibú

    “Human rights leaders had to leave the area due to threats from the armed groups,” he explained “During their departure, there were massacres, targeted killings of leaders and family members being murdered.”

    Videos circulating on social media captured the horror of the violence: gunfights, neighbours fleeing on foot, by motorcycle or in boats and teachers from remote areas abandoning their posts, leaving 46,000 children without access to education.

    “I lost everything,” said María*, one of the displaced people assisted by UNHCR. “I had to leave with nothing. There was no time.”

    Thousands of people have been forced to flee the violence in Catatumbo, seeking safety in Cúcuta.

    House of thunder under fire

    Catatumbo, which means house of thunder in the Barí Indigenous Peoples language, is a remote and impoverished region rich in biodiversity and natural resources, crisscrossed by rivers and streams in the country’s northeast along the Venezuelan border.

    It is also contested territory due to its importance in mining, coca production and illicit trafficking coupled with the State’s weak presence. In recent months, the region has shifted from a tense co-existence between armed groups to an open war for control of the drug trade.

    Responding to the crisis, President Gustavo Petro declared a state of emergency in Catatumbo and deployed rapid reaction military units to Ocaña, Norte de Santander. On 17 January, the Colombian president also decided to break peace negotiations with the ELN.

    Emergency aid response

    UN agencies are now assisting displaced people by providing water, food, hygiene kits, blankets and mattresses to serve more than 46,000 displaced people who sought safety in Cúcuta, Ocaña and Tibú.

    In the initial phase of the emergency, agencies responded with local funds allocated for Norte de Santander, however, with more than 80,000 people affected, “the situation surpasses the capacities of local partners, institutions and even the national government,” UNHCR’s Mr. García said.

    The UN’s humanitarian coordinator, Tom Fletcher, approved the allocation of $3.8 million from the Central Emergency Response Fund (CERF) to Colombia, allowing for an expanded response to support protection efforts and provisions of shelter, water, sanitation, education, health, food security and nutrition.

    Thousands remain trapped

    The emergency funds also aim to reach thousands trapped in their homes in the mountain region.

    Nearly 8,500 people remain in remote hamlets they cannot leave and where aid cannot reach them, while another 19,000 are facing movement restrictions preventing them from reaching urban centres.

    “We are waiting for humanitarian access guarantees so we can deploy responses with our partners,” Mr. García explained.

    Cocaine wars

    Six decades of conflict in Colombia have claimed 450,000 lives and displaced eight million people, ending eight years ago, when the government and FARC-EP signed a peace agreement that has achieved notable progress.

    However, the FARC’s withdrawal from regions like Catatumbo had created a power vacuum quickly filled by other armed groups, including the ELN and dissident factions of the FARC.

    This shift reignited territorial disputes in Catatumbo, one of the most complex areas of the conflict due to its remote location along the Venezuelan border. The region is rich in oil and is the country’s largest coca-growing enclave, with multiple armed groups operating within it.

    Tibú, a municipality near the Venezuelan border, has the highest number of coca plantations in Colombia, with 23,030 hectares, according to a study by the United Nations Office on Drugs and Crime (UNODC). The Catatumbo region ranks third nationwide, with 43,867 hectares, following the Pacific region (107,078 hectares) and Putumayo-Caquetá (56,933 hectares).

    ‘Worst humanitarian crisis’

    Violence abruptly erupted in mid-January between the ELN and the 33rd Front in the region, forcing thousands to flee the fighting.

    “We left in fear,” said Sebastián*. “I left my little land behind. My family and I are now separated.”

    Diego Tovar, a former guerrilla and signatory of the peace treaty, told the UN Security Council at an emergency meeting on 22 January that “this is the worst humanitarian crisis we have faced in Colombia since we signed the agreement.”

    At the same meeting, Carlos Ruiz Massieu, head of the UN mission  responsible for verifying the peace accord, said Catatumbo, like many regions in Colombia, is still waiting for the dividends of the 2016 Peace Agreement, such as a comprehensive State presence that brings public services, legal economies, development opportunities and security.

    “It is in the absence of the State that illegal armed groups fight for territorial and social control,” he said.

    From books to shelter

    For now, UN agencies and partners are striving to deliver essential goods and services to those in need, including educational kits and mental health support for thousands of displaced children forced out of school and shelter for those who fled the violence.

    “We need to understand that this could be a prolonged emergency,” UNHCR’s Mr. García warned.

    Echoing the wishes of many of the displaced people around him, Santiago* said he simply wants to go home.

    “All we want is to return,” he said, “but we can’t.”

  • MIL-OSI Security: Alleged Member of Cartel Enforcement Group Extradited from Mexico

    SAN DIEGO – Edgar Perez Villa, an alleged member of a Tijuana-based enforcement group for the Cártel de Jalisco Nueva Generación, commonly known as CJNG, was extradited from Mexico to the United States on Thursday and made his first appearance in federal court in San Diego today.

    Perez Villa was indicted along with other alleged Mexican drug cartel enforcers in connection with their alleged violent support of heroin and methamphetamine trafficking.

    At today’s hearing, Perez Villa was arraigned and entered a not-guilty plea before U.S. Magistrate Judge Jill L. Burkhardt. The government asked that Perez Villa be detained on grounds that he is a significant flight risk. Judge Burkhardt scheduled a detention hearing for February 27, 2025, at 2 p.m. before Judge Michelle Pettit. The Court also set March 28, 2025, at 10:30 a.m. for a motion hearing/trial setting before U.S. District Court Judge Cynthia A. Bashant.

    The superseding indictment, returned on March 6, 2020, plus a related indictment returned on March 16, 2021, collectively charged Perez Villa, aka Cabo 89, along with other alleged cartel leaders – including Edgar Herrera Pardo, aka Caiman; Carlos Lorenzo Hinojosa Guerrero, aka Cabo 96; and Israel Alejandro Vazquez-Vazquez, aka Cabo 50, among others. They are charged with drug trafficking crimes.

    According to court documents, the defendants were leaders of a violent group of cartel enforcers known as “Los Cabos” who operated in Baja California to secure control of the region for CJNG.

    Los Cabos allegedly employed rampant violence to ensure that CJNG maintained the ability to traffic drugs through Tijuana and into the United States through San Diego. According to the indictment, investigators learned through judicially-authorized interceptions that the leaders of Los Cabos planned more than 150 murders, the majority of which took place in Tijuana, according to the filings.

    Los Cabos allegedly engaged in this violence in support of CJNG, one of the most dangerous transnational criminal organizations in the world.  The cartel has its hands in trafficking multiple deadly substances. It is responsible for moving tons of cocaine, methamphetamine, and fentanyl-laced heroin into the United States.  CJNG is also a prolific methamphetamine producer and chemical importer, using precursors procured from China and India. CJNG is one of the most powerful Mexican cartels operating within the United States.

    “For far too long, violent cartels have inflicted untold suffering through violence and drug addiction,” said Acting U.S. Attorney Andrew Haden. “Our fight against this reign of terror will not waver.”

    “Cartels use violence and intimidation to control the areas they terrorize,” said DEA Special Agent in Charge Brian Clark. “As an alleged member of Los Cabos, Perez-Villa spent years destroying the community through drug trafficking and violence. One by one, the DEA will hold these criminals accountable and bring them to justice.”

    This case is the result of ongoing efforts by the Organized Crime Drug Enforcement Task Force (OCDETF), a partnership that brings together the combined expertise and unique abilities of federal, state and local law enforcement agencies. The principal mission of the OCDETF program is to identify, disrupt, dismantle and prosecute high-level members of drug trafficking, weapons trafficking and money laundering organizations and enterprises.

    The Justice Department’s Office of International Affairs worked with law enforcement partners in Mexico to secure the arrest and extradition of Perez Villa.

    Child criminal exploitation and cuckooing to be criminal offences

    Two new offences from the government’s flagship Crime and Policing Bill will introduced in Parliament making child criminal exploitation and cuckooing illegal.

    Children and vulnerable people who are exploited by gangs for criminal purposes will receive greater protection, with two new criminal offences set to be introduced by the government next week.

    Landmark legislation will be brought forward to ban cuckooing, a highly exploitative practice where criminals seize control of a vulnerable person’s home without consent to conduct illegal activities like drug dealing.

    Another new offence will be created against adults who use a child to commit criminal activity. Both of these measures will be part of the government’s landmark Crime and Policing Bill, which is set to be introduced in Parliament next week and forms a key part of the government’s Plan for Change. 

    Current estimates show that approximately 14,500 children were identified as at risk or involved in child criminal exploitation (CCE) in 2023 to 2024, although this is likely an underestimate as many exploited children will not be known to authorities.

    However, under current legislation, only a small number of individuals have been charged for using children in criminal activity.

    This standalone CCE offence will therefore look to target those adults who unscrupulously groom and exploit children into criminal activity, such as county lines drug running or organised robbery, as well as increasing the opportunities for children to be identified.

    Those convicted of committing a CCE offence could face a maximum of 10 years in prison, sending a clear message that this form of child exploitation will never be tolerated.

    Home Secretary, Yvette Cooper, said: 

    The exploitation of children and vulnerable people for criminal gain is sickening and it is vital we do everything in our power to eradicate it from our streets.

    As part of our Plan for Change, we are introducing these two offences to properly punish those who prey on them, ensure victims are properly protected and prevent these often-hidden crimes from occurring in the first place.

    These steps are vital in our efforts to stop the grooming and exploitation of children into criminal gangs, deliver on our pledge to halve knife crime in the next decade and work towards our overall mission to make our streets safer.

    The new legislation also includes the creation of new CCE prevention orders, which may be issued at the end of criminal proceedings or upon application by police.

    These bespoke orders will ensure that courts can impose restrictions and requirements on individuals who pose a risk of exploiting a child for criminal purposes, such as limiting their ability to work with children, contact specific people or go to a certain area. 

    This will help manage the risk of offending, or reoffending, and breach of these orders (or failure to comply with any relevant notification requirements) will also be a criminal offence, with a maximum penalty of five years in prison. 

    Baroness Anne Longfield, Executive Chair of the Centre for Young Lives, said:

    The ruthless criminal exploitation of vulnerable children has been a brutal and lucrative business model for organised criminals for too long.

    It has had tragic consequences for thousands of young lives and has devastated families and communities.

    This change in the law is long overdue, very welcome, and will save lives.

    Mark Russell, Chief Executive at The Children’s Society said: 

    This new offence is a vital step forward that we have been campaigning for over the years. A standalone crime of child criminal exploitation (CCE) will finally shift the focus onto perpetrators, not victims. For too long, adults who groom children into criminal activity – forcing them to hold drugs or launder money or commit theft – have evaded accountability. Charges such as drug possession ignore the core truth; these are child abusers exploiting vulnerable young people.   

    To protect the 14,500 children identified at risk last year – and the thousands more unseen – these measures must be backed by three pillars; strong enforcement, training for safeguarding professionals and a statutory definition of CCE to help end the postcode lottery in victim support.   

    This is how we break cycles of harm: punish the exploiters, prioritise the victims, and put child safety first.

    In further measures to better protect vulnerable people, a new offence making cuckooing illegal will also be introduced.

    Dame Rachel de Souza, The Children’s Commissioner, said:

    As Children’s Commissioner, I know the criminal exploitation of children is a complex type of abuse that causes harm to victims in a way that has for too long been undercounted and poorly understood.

    Many children targeted by adult criminals themselves face punishment instead of support. Like too many child victims, they are often ignored and overlooked. Their voices and experiences must be listened to, if we are to create a child-centric justice system that puts safeguarding at its heart.

    Introducing this new offence and new prevention orders will help create that much needed clarity that exploited children are victims. I hope this will enable professionals to intervene at far earlier stages of intervention, backed by plans to create a unique identifying number for every child that helps services identify those in need of support.

    These measures will be introduced in the Crime and Policing Bill alongside the new CCE offence.

    It is commonly associated with drug supply, serious violence and antisocial behaviour, seeing people often with disabilities or those with substance misuse issues targeted by criminals for their own personal gain. 

    The introduction of this new offence will target individuals who take over the homes of vulnerable people for criminal purposes and punish them for the harm caused. It will carry a maximum penalty of 5 years in prison.

  • MIL-OSI Security: San Diego Gang Member Sentenced in Organized Crime Conspiracy

    SAN DIEGO – Odyssey Carrillo, a member of the Emerald Hills Bloods gang, was sentenced in federal court today to 168 months in prison for his role in a racketeering conspiracy involving coordinated violent crimes by street gangs.

    Carrillo is the ninth and final member of the conspiracy to be sentenced. He pleaded guilty to Conspiracy to Conduct Enterprise Affairs Through a Pattern of Racketeering Activity and Hobbs Act Robbery. According to court documents, the crimes committed by the enterprise included armed robbery, sex trafficking, prostitution, violence and other profit-driven illegal activities.

    The defendants were charged with racketeering conspiracy – the statute’s original inspiration was to combat organized-crime syndicates and mobsters. But as criminal street gangs have become more sophisticated and prolific in their illicit business pursuits, this statute has become an effective tool to address all aspects of coordinated violent criminal conduct.

    Previously sentenced defendants include Jerome Brunson, Cedric Jordan, Stephen Nathaniel Calhoun, Jr., Carl Moore, Maurice Johnson, Dajay Leon Scott, Taashawn Henderson and Sergio Valentin Louden.

    In his plea agreement, Carrillo admitted that he joined the conspiracy that engaged in a pattern of racketeering activity that included robbery, prostitution and sex trafficking. Carrillo further admitted to committing racketeering activity himself, including two specific armed robberies.

    Carrillo, Calhoun and Moore admitted to participating in the January 19, 2019, armed robbery of San Carlos Jewelers in San Diego and the February 11, 2019, armed robbery of the Bert Levi Family Jewelers in San Diego.

    Calhoun also admitted to robbing the Medicine Shoppe in San Diego by gunpoint on May 20, 2019. Calhoun and Moore both admitted to being Lincoln Park Bloods (LPK) gang members; Carrillo admitted to being an Emerald Hills gang member, a Bloods-aligned street gang that often works cooperatively with LPK. Calhoun and Moore were sentenced by U.S. District Judge Cynthia Bashant to 176 months and 105 months in custody, respectively.

    According to their plea agreements, in furtherance of the racketeering conspiracy, Jerome Brunson admitted to being an LPK member who participated in the November 19, 2019, armed robbery of a Jared’s jewelry store in National City. Judge Bashant sentenced Brunson to 57 months in custody. Dajay Scott and Sergio Louden admitted to being LPK members who robbed numerous women of their purses outside nail salons in January 2020. Judge Bashant sentenced Scott and Louden to 48 months and 72 months in custody, respectively.

    Cedric Jordan, Maurice Johnson, and Taashawn Henderson admitted to being LPK members who, during the course and in furtherance of the conspiracy, engaged in sex offenses related to sex trafficking and transportation for purposes of prostitution. Judge Bashant sentenced Jordan, Johnson, and Henderson to 63 months, 60 months, and 58 months in custody, respectively.

    “Every member of our community is put at risk when criminal street gangs engage in armed robberies, sex trafficking, and other violent criminal acts,” said Acting U.S. Attorney Andrew Haden. “This case is the result of outstanding teamwork and collaboration between our local and federal law enforcement partners. We will continue to hold these violent groups accountable, using the RICO tools at our disposal, to bring justice to crime victims and to make our community safer.”

    “Today’s sentencing reflects the hard work, determination, and collaboration of multiple agencies to dismantle an organized crime conspiracy,” said FBI San Diego Special Agent in Charge Stacey Moy. “The violent crime and gang threats are too diverse, too dangerous, and too all-encompassing for any of us to tackle alone. FBI will continue to work with our partners to disrupt violent crime, human traffickers, and violent gangs whose criminal acts devastate our communities.”

    This case is being prosecuted by Assistant U.S. Attorneys Mario J. Peia, Katherine E. A. McGrath, and Matthew Brehm.
