  • MIL-Evening Report: Snakes are waking up. What should you do if you’re bitten? And what if you’re a long way from help?

    From the creeks that wind through inner city Melbourne to the far outback in Western Australia, snake season is beginning.

    Over the cooler months snakes have been in state of brumation. This is very similar to hibernation and characterised by sluggishness and inactivity. As warmer conditions return both snakes and humans become more active in the outdoors, leading to an increased likelihood of interaction. This may happen when people are hiking, dog-walking or gardening.

    The risk of being bitten by a snake is exceptionally small, but knowing basic first aid could potentially save your, or another person’s, life.

    When a snake bites

    Snake bite envenomation (when venom enters the blood stream) is a significant issue in Australia, with 3,000 cases annually and an average of two deaths.

    Snake bite should always be treated as a life-threatening emergency, and if you are bitten in rural or remote Australia, you will often receive an air medical emergency pick up to a regional or metropolitan hospital for advanced care.

    The effects of snake bites vary, depending on the species of snake and first aid measures undertaken.

    Australian standard first aid guidelines include:

    • calling for help (dialing 000 or activating an emergency beacon)
    • applying a pressure immobilisation bandage
    • resting.

    Why pressure is important

    Snake venom is carried within the lymphatic system. This is a collection of tiny tubes throughout the body that return fluid outside of blood vessels back to the blood stream.

    Muscles act as a “pump” to help the fluid move through this system. That’s why being still, or immobilisation, is vital to slow the spread of venom.

    A firm pressure immobilisation bandage, applied as tight as you would for a sprained ankle, will compress these tubes and help limit the venom’s spread.

    Ideally bandage the entire limb on which the bite occurred and apply a splint to help further with immobilisation. It is very important that the blood supply to the limb is not limited by this bandage.

    Never attempt to capture or kill the snake for identification. This risks further bites and is not required for specialist care. The decision about when to give antivenom (if any) is based on the geographical location, symptoms, the results of blood tests and discussion with a toxicologist.

    The tyranny of distance

    People living in rural and remote locations may also have limited access to health care, including access to ambulance services, snake bite first aid such as bandages and splints, and to antivenom.

    Availability and the prompt use of antivenom have been identified as crucial factors in the effective treatment of snake envenomation – but not studied in detail.

    Over one year (as a component of a larger three-year study) we collected information on the pre-hospital care and in-flight care with the Royal Flying Doctors Service Western Operations.

    During this time, 85 people from regional, rural, remote and very remote Western Australia were flown by Royal Flying Doctor Service to hospital for suspected or confirmed snake bites. Reassuringly, only five of these patients (6%) ultimately received a toxicologist’s diagnosis of envenomation.

    To move or not to move?

    Troublingly, 38 (45%) of the 85 snake bite victims continued to move around and be active following their suspected snake bite. This raises questions about whether people lack knowledge of first-aid guidelines, or whether this is a consequence of being isolated, with limited access to health care.

    Either way, our as-yet-unpublished research highlights the vulnerability of Australia’s rural and remote people. All patients eventually received a pressure immobilisation bandage, with an average time from bite to application of 38 minutes. Three quarters of the patients made their way to health-care site by foot, or private car, arriving on average 65 minutes after the bite.

    What needs to change?

    Our results indicate rural and remote Australians need innovative health-care solutions beyond the metropolitan guidelines, particularly when outside ambulance service areas.

    Basic snake bite first aid education needs to be not only reiterated but also a pragmatic approach is required in these geographically isolated locations. This would involve being vigilant, staying safe and, when isolated, always carrying emergency technology to call for help.

    Monday 30 September 2024 – Dhamana Guarantee Company Ltd (Dhamana) has reached a major milestone, marked at an event in Nairobi today.

    Investors in the new company put pen to paper at a signing ceremony, which will allow the company to kick-start operations.

    Dhamana aims to mobilise private sector finance to support the development of sustainable businesses. It will do so by issuing guarantees to commercially viable projects, businesses, and institutions that tackle the climate crisis and make progress towards the Sustainable Development Goals (SDGs).

    The draft law on the federal budget for 2025 and for the planning period of 2026 and 2027 has been submitted to the State Duma for consideration. The order to submit it was signed by Prime Minister Mikhail Mishustin.

    When drafting the new three-year budget, the Government proceeded from the need to fulfill social obligations to citizens and solve priority tasks outlined by the President.

    Thus, one of the main priorities is targeted support for pregnant women and families with children.

    Submission to the State Duma of the draft federal law developed by the Ministry of Finance “On the federal budget for 2025 and for the planning period of 2026 and 2027”

    In particular, over 4 trillion rubles have been allocated for monthly benefits in connection with the birth and upbringing of a child for 2025–2027. Over 1.7 trillion rubles have been planned for the provision of maternity capital, and over 12 billion rubles over three years for subsidies for housing for young families.

    It is proposed to allocate approximately 37.5 billion rubles to support regional demographic programs aimed at increasing the birth rate.

    The necessary funds have also been allocated for such important areas as hot meals for schoolchildren, payments to class teachers, major repairs and construction of new educational institutions, provision of medicines for beneficiaries, increasing the level of pension provision and resuming indexation of pensions for working pensioners.

    The draft budget allocates over 130 billion rubles to help citizens who find themselves in difficult life situations under the social contract program.

    More than 80 billion rubles are planned for the development of a long-term care system for the elderly and disabled who need such assistance.

    The Government’s priority tasks include the implementation of national projects. A total of more than 18 trillion rubles have been allocated for their financing (19 projects) over three years. Over 40 trillion rubles have been allocated from the federal budget over six years. Compared to the national projects in effect in 2019–2024, funding from the federal budget has been almost doubled.

    An equally important area is financial support for the regions. It is planned to allocate 3.3 trillion rubles annually for these purposes.

    The draft of the new three-year federal budget is based on the basic version of the socio-economic development forecast. It implies that in 2025–2027, economic dynamics will be on a moderate trajectory of 2.5–2.8% of GDP.

    Budget revenues in 2025 will amount to 40.3 trillion rubles, in 2026 – 41.8 trillion rubles, in 2027 – 43.2 trillion rubles.

    Expenditures in 2025 are planned at 41.5 trillion rubles, 44 trillion rubles in 2026, and 45.9 trillion rubles in 2027.

    The execution of the new three-year federal budget is expected with a deficit of 0.5% of GDP in 2025, 0.9% of GDP in 2026 and 1.1% in 2027. During this period, the non-oil and gas deficit will be reduced to 5% of GDP in 2027 (by 2.5 percentage points compared to 2024).

    The main sources of deficit financing in 2025–2027 will be government borrowing. The volume of government debt will remain at a safe level.

    Along with the draft of the new three-year budget, the Government also sent draft budgets of extra-budgetary funds and a number of other bills of decisive importance for public finances to the lower house of parliament.

    This year, the budget package was submitted entirely via electronic communication channels for the first time. This was the result of systematic work to improve the interaction between the Government Office and the State Duma.

    The Council of Ministers met at the Government Palace in Dili and approved the Draft State Budget (OGE) Bill for 2025, presented by the Minister of Finance, Santina José Rodrigues F. Viegas Cardoso, with a total value of US$ 2.6 billion allocated to the Central Administration, the Special Administrative Region of Oe-Cusse Ambeno (RAEOA) and Social Security, including the Social Security Reserve Fund. This amount includes an allocation of US$ 2.07 billion for the Central Administration, US$ 482 million for Social Security and US$ 62 million for the RAEOA.

    The 2025 State Budget Bill continues the strategy of implementing the priorities set out in the Government Programme, under the motto “Investment in strategic infrastructure, strengthening the economy and improving the well-being of citizens”. The Proposal is formulated based on the Strategic Objectives of the IX Constitutional Government, with a view to promoting the socio-economic development of the Nation through targeted investments in strategic infrastructure, economic strengthening and initiatives aimed at improving the well-being of citizens. The 2025 State Budget aims to promote economic development and improve the living conditions of the Timorese population, through a clear strategy focused on sustainable economic growth, improving public services and ensuring that the benefits of development reach all citizens.

    In terms of strategic infrastructure, US$227.3 million has been earmarked for the construction, expansion, rehabilitation and maintenance of road networks and bridges, as well as for the implementation of measures to protect against natural disasters, with the aim of improving connectivity and protecting communities from the effects of climate change. Funding is also provided for the rehabilitation of Presidente Nicolau Lobato International Airport and for the completion of the submarine fibre optic cable that will link Timor-Leste to Australia. The expansion of the internal fibre optic network will enable the provision of high-speed internet throughout the country from 2025 onwards. In the electricity sector, the budget foresees a significant increase in subsidies to the public company EDTL, EP, with the aim of improving and expanding the continuous supply of electricity, especially in rural and remote areas, ensuring a more stable and comprehensive service.

    In the natural resources sector, the proposal allocates US$40 million to improve industrial and oil and mineral extraction areas on the country’s southern coast, contributing to economic development and strengthening energy security.

    In the financial sector, an investment of US$5 million is expected in the capitalization of the Central Bank of Timor-Leste, with the aim of strengthening the stability and resilience of the national financial system.

    The bill allocates a significant portion of the spending, around US$406 million, to support civil society, health and social services. In human capital development, US$17.2 million is allocated to vocational and technical training programs, as well as to grant scholarships. Education will also receive US$145.8 million to build new schools, train teachers and strengthen the education management system.

    In health, the budget allocates US$99.2 million to improve the hospital network and health centers throughout the country, in addition to US$14.2 million for the acquisition and distribution of essential medicines and medical equipment.     HM Treasury has announced today that Nina Hingorani-Crain has been reappointed as a Non-Executive Director to the Board of NS&I (National Savings and Investments), as of 1 November 2024. The reappointment will be for a term of three years.

    Non-Executive Directors on NS&I’s Board ensure a sound strategy is in place to meet the organisation’s remit of raising cost-effective debt financing for the government. They also act as an external source of advice, have oversight of risk control, and ensure NS&I’s links with its outsourcing partners remain open and transparent.

    NS&I is one of the largest savings organisations in the UK, offering a range of savings and investments. All products offer 100% capital security because NS&I is backed by HM Treasury.

    Nina was first appointed as a Non-Executive Director in November 2021.     The Asian Infrastructure Investment Bank (AIIB) further solidified its long-standing partnership with the Republic of Uzbekistan through a series of agreements signed in Samarkand, Uzbekistan, at the Bank’s 9th Annual Meeting, its first in Central Asia.

    The agreements follow the signing of a three-year rolling pipeline for sovereign-backed financed projects by Uzbekistan President Shavkat Mirziyoyev and AIIB President Jin Liqun in Beijing. This strategic partnership established a solid foundation for the current agreements, aimed at supporting Uzbekistan’s sustainable development goals.

    At the Annual Meeting, the Bank and the Swiss State Secretariat for Economic Affairs (SECO) signed an agreement for a USD8.8 million contribution to support the Karakalpakstan and Khorezm Water Supply and Sanitation Project. This critical initiative aims to improve water resource management, sanitation services and flood risk management in some of Uzbekistan’s most water-stressed regions. The project aligns with AIIB’s green infrastructure and technology-enabled Infrastructure thematic priorities and is a key step in advancing Uzbekistan’s long-term goals for climate resilience and water security.

    Following this, AIIB signed a pivotal loan agreement with Asakabank, marking AIIB’s inaugural partnership with the financial institution. The RMB-denominated loan will expand Asakabank’s portfolio in renewable energy and energy efficiency and provide much-needed financial support for green investments. This agreement is a critical part of Uzbekistan’s energy transition strategy and highlights AIIB’s role in fostering climate-resilient infrastructure development across Central Asia.

  • MIL-OSI Submissions: Environment – Civil Society Groups call on Plastics Treaty negotiators to agree on a text that effectively tackles plastic pollution across its lifecycle

    Oct. 1, 2024 – Nairobi, Kenya—As countries conclude a Head of Delegations meeting today in Nairobi for an international legally binding agreement to end plastic pollution or the Global Plastics Treaty, civil society groups have been uniting their voices and held simultaneous actions to emphasize a call for a strong and effective global plastics treaty and show solidarity with high ambition countries, such as those in the African Group, Group of Latin America and the Caribbean (GRULAC), Pacific Small Island Developing States (PSIDS),  and the Philippines that have been advocating for strong treaty measures.

    The final scheduled plastics treaty negotiations will take place in Busan, Republic of Korea later this year. Since the process started in 2022, civil society groups, alongside Indigenous Peoples representatives and independent scientists have been calling on governments to ensure that the treaty includes legally binding measures that cover the whole life cycle of plastics, including rules and targets on the production and supply of primary plastic polymers to drastically cut plastic production with aims to phase out plastic production.

    “Over 400 million tonnes of plastics are produced every year, suffocating our planet and every living thing on it. Now is not the time to sacrifice ambition and submit to the lowest common denominator: a minority of countries blocking progress for their own short-term gain,” said Ana Rocha, Global Plastics Policy Director of the Global Alliance for Incinerator Alternatives (GAIA). “Indigenous Peoples, waste pickers, and Global South governments on the frontlines of the plastics crisis have long been at the forefront of the solutions, yet their critical voices have been sidelined. The intergovernmental negotiating committee must listen to the millions of people around the world demanding a strong treaty to end plastic pollution.”

    The groups also call for the elimination of chemicals that are hazardous to human health and the environment throughout the lifecycle of plastics, as plastics expose people to more than 16,000 chemicals and 4,200 of them are classified as hazardous to people and the environment.

    “A treaty that does not prioritize production reduction of primary plastic polymers (PPP) and eliminate chemicals of concern will only serve to perpetuate plastic pollution and the poisoning of Indigenous and environmental justice communities around the world who have been sacrificed by industry and enabling governments for generations,” said Frankie Orona, Executive Director of Society of Native Nations. “We welcome the common goal of the High Ambition Coalition (HAC) to end plastic pollution by 2040, while reaffirming that no amount of production of PPP is sustainable. The HAC should explicitly support, at minimum, a reduction target of 75% by 2030 if not sooner.”

    Additional demands include the support for reuse systems, a strong, dedicated financial mechanism to facilitate the flow of financial resources from the developed to the developing world, and measures for a just transition to safer and more sustainable livelihoods for workers across the plastic supply chain.  

    “As we reduce plastic production, it is essential we ensure a just transition to reuse and refill systems, which present numerous benefits for people and the environment,” said Marian Ledesma, Zero Waste Campaigner at Greenpeace Southeast Asia – Philippines. “In addition to reducing plastic waste, reuse and refill solutions can decrease greenhouse gas emissions, water consumption and material resource usage. These systems also bring socioeconomic gains for communities through reduced costs and risks arising from plastic pollution.  As integral solutions in ending plastic pollution, we need ambitious reuse and refill targets to be reflected in the treaty alongside reduction targets for plastic production and use.”

    “As we come towards the final round of negotiations, we must not sacrifice ambition for speed. Ambition means both legally binding control measures and finance to help solve the problem,” said Jacob Kean-Hammerson, Ocean Campaigner with the Environmental Investigation Agency (EIA).  “Ending plastics pollution is a generational effort we must undertake as a global community. Global North countries should join calls in the Global South for a new dedicated fund and ensure adequate funding to ensure we have a treaty that truly works.”

    Since the beginning of the INC process, civil society organizations, as well as many governments, have been calling for an open and transparent process that facilitates the widest possible public participation. Instead, observers have been met with limitations that have ranged from caps on attendance, restricted access to negotiations and relevant meetings, and curtailed opportunities to make formal statements. With possibly one last round of negotiations remaining, civil society groups renew their calls for greater transparency and participation in the process to ensure that the demands for a strong and effective plastics treaty are heard.

    “By not including pathways for robust observer participation, meeting organizers are contradicting established international norms and are ignoring and disrespecting the experience, knowledge, expertise, and distinct perspectives of Indigenous Peoples and other frontline and fenceline communities disproportionately impacted by plastic pollution across its life cycle,” said Merrisa Naidoo of GAIA Africa.

    Having a global plastics treaty is a rare opportunity to systematically end plastic pollution through a legally binding international agreement that covers the complexities of the plastic pollution crisis beyond waste management. As UN Member states are expected to wrap up negotiations by December 1st, 2024, in Busan, Republic of Korea, civil society groups will continue to urge governments to deliver a strong treaty that would be effective in truly ending plastic pollution, not a watered-down agreement that fails to holistically address the plastic pollution crisis, for the sake of meeting deadlines.

  • MIL-Evening Report: Qatar Airways is set to acquire 25% of Virgin Australia. Who will be the winners?

    Qatar Airways has announced plans to buy a 25% minority stake in Virgin Australia from its owner, US private equity firm Bain Capital.

    The two airlines have already had a strong relationship as “codeshare partners” since 2022. Codesharing is where airlines agree to sell seats on each other’s flights. This new announcement, however, is a big step up.

    All of this will, of course, be subject to approval from both Australia’s Foreign Investment Review Board and the Australian Competition and Consumer Commission (ACCC). But there could be a range of winners if it goes ahead.

    Perhaps most importantly for Australian travellers, the move means Virgin Australia will be able to compete as it once did on long-haul international routes.

    This is because a proposed “wet lease” agreement – in which one airline provides full aircraft, crew and relevant services to another – could see Virgin Australia start operating its own flights from Brisbane, Melbourne, Perth and Sydney to Doha as early as mid-2025.

    It’s also a win for Bain Capital, which had been trying to offload some of its stake in the airline after acquiring it in crisis in 2020.

    So with the prospect of a renewed international foothold for Virgin Australia, could we soon see more competition – and real consumer benefits – on the “Kangaroo Route” between Australia and Europe?

    Clearer skies for Qatar?

    As you might remember, Qatar Airways’ previous attempts to expand in Australia haven’t always gone smoothly.

    Today’s announcement comes little more than a year after Transport Minister Catherine King controversially blocked a request by Qatar to double the number of flights its state-owned airline Qatar Airways was allowed to fly into major Australian airports.

    Given the intense public backlash to this decision, it’s possible a renewed application by Qatar would have been more successful. A large expansion of flights by Turkish Airlines was later quietly approved.

    But this new deal may diminish the need to try again. By wet-leasing wide-body aircraft so Virgin Australia can operate its “own” long-haul routes to Doha (connecting into Europe), Qatar will effectively bypass the need to get government approval for the additional flights.

    The ‘Kangaroo Route’ still needs more flights

    Back in 2023, my calculations suggested Qatar’s application to expand should have been approved. Capacity on the Kangaroo Route was only back to 70% of pre-COVID levels. That meant the major players operating flights – including the Qantas–Emirates alliance – could charge significantly more than before the pandemic.

    Using the latest flight schedule data, we can show that the capacity between Australia and the Middle East is still 17% below what it was before the pandemic. If Virgin Australia’s proposed long-haul re-entry goes ahead, we could see much more capacity on these routes, and a formidable challenger to the Emirates–Qantas arrangement.

    Likely a win for Virgin and Qatar

    It’s easy to see why Virgin and Qatar might be excited. The deal will extend Virgin Australia’s reach – and that of its frequent flyers – into Europe and other destinations via Doha. But this goes both ways, and could also mean more demand on its domestic network.

    Similarly, the additional flights into Doha will feed Qatar Airways’ network, an airline that seems to be going from strength to strength.

    Despite historical troubles at Doha’s main airport, Qatar Airways is now one of the world’s largest airlines. It has once again been ranked as the world’s best airline by the independent air transport rating organisation Skytrax.

    Both airlines were also keen to point out benefits of the partnership they said would go beyond additional services and increasing competition in the Australian market.

    These include the potential to work together towards various sustainability initiatives and on developing Western Sydney’s aviation ecosystem, providing exciting new opportunities for employment and training.

    Not yet a done deal

    However, they’re still a long way from the finishing line. Whether this deal will actually materialise remains to be seen.

    It is worth noting this is not the first time Virgin Australia has been part-owned by an airline in the Middle East. Before Virgin Australia’s collapse into administration in April 2020, Etihad held a 21% equity stake.

    Further, it remains to be seen what aircraft Virgin Australia will actually get access to and how the service will be perceived. Qatar Airways is guaranteed a transaction win through the wet-lease, without taking on the brand and profit risks of operating these services.

    How much concern this will stir at Qantas also remains to be seen, but one thing is clear. Project Sunrise – Qantas’ plan to bypass the Middle Eastern hubs and connect Australia directly with Europe – could soon become much more important.

    Emirates is unlikely to emerge as the winner of this move, now set to face increased competition not only on services connecting Australia with the Middle East, but also across its broader network through Dubai.

    Qatar Airways acquiring a stake in Virgin Australia will also create interesting dynamics within the Oneworld Alliance, in which both Qantas and Qatar Airways are key partners. There are certainly interesting times ahead.

  • MIL-OSI Economics: Swaminathan J: Governance in Small Finance Banks – driving sustainable growth and stability

    Chairpersons and Directors of the Boards of Small Finance Banks; Chief Executive Officers of SFBs; Executive Directors, Chief General Managers and colleagues from the Reserve Bank of India; ladies and gentlemen. A very good morning to all of you.

    It is an honour to address this distinguished gathering in the inaugural conference of Board of Directors of Small Finance Banks organised by the RBI. As has been mentioned, this conference is in continuation of the Reserve Bank’s efforts to reach out to its supervised entities through a direct dialogue with their Boards and Top Management. Our objective is to reaffirm the importance of good governance for maintaining financial stability and fostering sustainable growth.

    In his address1 to the Directors of Public and Private Sector Banks last year, the Governor outlined a comprehensive 10-point charter that addressed key aspects such as the role of the Board, its independence, the importance of setting the tone from the top, etc. His speech serves as an excellent blueprint for regulatory expectations from the Boards of Directors, and I encourage you to review it if you haven’t already.

    Today, I would like to discuss three key issues with you: (i) the vital role of Small Finance Banks in promoting financial inclusion, (ii) the necessity of strengthening governance and assurance functions for sustainable growth, and (iii) important considerations regarding business models and risks that Boards should be mindful of.

    Important Financial Inclusion objective of SFBs

    As you are aware, the licensing of Small Finance Banks was introduced a decade ago, in 2014, with the primary objective of advancing financial inclusion. Beyond serving as a vehicle to mobilise savings, SFBs were also envisioned to extend affordable credit to underserved and unorganised sectors, such as small and marginal farmers as well as small business units, by leveraging technology to reduce costs and improve accessibility.

    India, today, stands at a pivotal moment in her development trajectory. In the last 75 years, we have transformed ourselves from an agrarian economy into one driven by industry and services. However, translating our GDP into higher per capita Gross National Income comparable to developed economies will require a comprehensive approach towards inclusive and sustainable economic growth. This will inter-alia entail education, skill development, employment generation, and more pertinently further deepening of financial inclusion. Thus, the goal for small finance banks is not ‘small’. On the contrary, it is very significant, as SFBs play a crucial role in extending financial services to the underserved, fostering entrepreneurship, and driving inclusive growth that will be essential for India’s progress towards becoming a high-income economy.

    In a developing country like India, it is imperative for the financial sector, including small finance banks to strike a balance between profitability and social objectives. This can be achieved through a strategic focus on sectors that deliver high social impact, ensuring that financial growth is aligned with the broader goal of inclusive development. It is therefore essential for SFBs to actively participate in extending credit under various Government Sponsored Schemes to promote greater accessibility of affordable credit, especially among the vulnerable sections of the society.

    As the target group of such lending is mostly the marginalised and underserved sections of the society, it is essential for the SFBs to adopt responsible lending practices. It is disheartening to come across egregious practices by some SFBs, such as charging excessive interest rates, collecting instalments in advance as well as not adjusting such advance collections against loan outstanding, levying of usurious fees, etc. It is also observed that grievance redressal mechanism is far from adequate in most SFBs.

    I therefore feel that periodically reviewing how your bank is fulfilling its financial inclusion objectives is an area that Boards should give much deeper consideration to. It is not just about meeting regulatory requirements such as priority sector lending but also about assessing the true impact of your efforts on underserved communities. Boards can reflect on whether the bank is genuinely reaching marginalised groups, such as low-income households, small businesses, and rural populations, and how effectively it is using technology and innovative products to bridge financial gaps, as these were the objectives of having a differentiated licensing for SFBs.

    Strengthening Governance

    An effective governance framework is the foundation of resilient and well managed institutions, especially in the context of banks. There needs to be a clear division of responsibilities between the Board and the management to ensure smooth functioning of the bank. While the Board is responsible for setting the overall strategic direction, establishing policies, and ensuring that the bank adheres to regulatory frameworks and ethical standards, the management is responsible for the execution of the Board’s strategy and operations. It is the Board’s role to provide oversight, asking the right questions and holding the management accountable for executing the bank’s strategy within the agreed risk appetite.

    In this context, it is imperative that the views of the Board are clearly articulated and documented in the minutes of the meetings of the Board and its various sub-committees. It is said that the ‘palest ink is better than the best memory’. Proper documentation serves as a vital record of the Board’s deliberations, decisions, and rationale behind those decisions, ensuring transparency and accountability in governance. Clear minutes not only provide a historical account of the Board’s discussions but also serve as a reference for future decision-making, helping to maintain continuity and clarity in governance practices.

    Boards should prioritise proper succession planning for top management. Having just one Whole Time Director (WTD) can create potential vulnerabilities, especially in times of transition or unforeseen circumstances. Without a well-thought-out succession plan, the bank may face leadership gaps that could disrupt operations and affect strategic decision-making. A broader pool of experienced leaders also contributes to better governance and more resilient management structures. We observe that while the SFBs are strengthening their Boards by bringing in new directors, some SFBs are yet to ensure the presence of at least two Whole Time Directors. I would request these banks to expeditiously consider appointing more WTDs.

    Empowering Assurance Functions

    Boards should accord due importance to assurance functions, namely, risk management, compliance and internal audit. These functions play a critical role in identifying and mitigating risks, ensuring compliance with laws and regulations as well as safeguarding the organisation’s integrity.

    Boards should ensure that heads of assurance functions are positioned appropriately within the organisational hierarchy and granted direct access to the Board. Dual-hatting, or combining assurance responsibilities with operational or management duties, undermines the independence and objectivity of assurance functions by creating conflicts of interest. Therefore, any dual hatting of assurance functions, should be avoided.

    Key risks to reflect upon

    Small Finance Banks have demonstrated strong growth since their inception, now accounting for 1.18 percent of total banking assets (as of March 2024). This is a substantial rise from 0.44 percent in March 2018. The deposit base has grown at a 32 per cent compounded annual growth rate (CAGR) over the last five years whereas net advances recorded a CAGR of 26 per cent. While the business growth in Small Finance Banks is indeed impressive, it is imperative that Boards remain vigilant for hidden and emerging risks that could jeopardise their long-term success.

    In this context, I would like to highlight a few areas that Boards could keep in mind.

    Business model

    Firstly, I would urge Boards to consider the sustainability of their growth strategies and business models by conducting a thorough review of both the liability and asset sides of the balance sheet. Specifically, they should assess whether there is an overdependence on high-cost term deposits or bulk deposits from a limited number of institutions. Additionally, they should evaluate any substantial asset exposures that could adversely impact the bank if they were to sour. These are essential aspects that the Board and its Risk Management Committee must scrutinise to ensure long-term stability and resilience.

    Credit risks

    Secondly, I would like to emphasise proper credit risk underwriting. While many banks have expanded into unsecured retail lending, hoping to leverage the diversification benefits it offers, there is an underlying correlation risk that becomes more pronounced during economic downturns. In such scenarios, the credit profile of a large segment of borrowers can be significantly impacted, leading to higher default rates. This highlights the importance of rigorous underwriting processes that carefully assess the creditworthiness of borrowers, rather than relying solely on automated systems or algorithms. Effective underwriting should consider a comprehensive range of factors, including income stability, credit history, and the overall economic environment, to ensure that loans are made judiciously.

    Further, while digital lending solutions have streamlined the process and made access to credit easier, on-the-ground presence for collections remains crucial. Resorting to coercive recovery practices as a means of mitigating risk is not a sustainable solution. Such practices not only harm the bank’s reputation but can also lead to legal and regulatory repercussions. A better approach is to implement collection strategies that prioritise communication and collaboration with borrowers. This includes strictly adhering to fair practices code and adopting an empathetic approach while dealing with stressed loan book.

    Cyber-security risk and third-party dependencies

    Thirdly, I would like to address the issue of cyber security and IT vulnerabilities. Being relatively new entities, SFBs have used technology to enhance their product offerings and customer service. However, with their increasing digital footprint, these banks face significant operational risks from growing cyber threats, digital frauds, and possible data breaches.

    The cyber security landscape is evolving rapidly, and SFBs must stay ahead of emerging threats to protect their customers’ data and maintain operational resilience. The SFBs should adopt robust business continuity plans and effective IT outsourcing strategies. There is also a need to ensure rigorous change management processes, comprehensive data protection measures, vigilant transaction monitoring, stringent access controls and network security protocols. These measures will help SFBs to significantly enhance their IT resilience against possible disruptions.

    Operational Risk

    Fourthly, while I have covered cybersecurity threats, I would also like boards of SFBs to be mindful of the larger issue of operational risks. During periods of rapid growth, the focus on increasing market share, launching new products, and acquiring customers can lead to a neglect of essential risk management practices. For example, hastily onboarding new customers without thorough KYC due diligence or rushing the deployment of technology solutions without adequate testing can increase the likelihood of frauds, errors and service disruptions. Growth is important for the success of Small Finance Banks. However, it must not come by overlooking operational controls.

    Another significant area of concern for operational risk is the high attrition rate among staff in Small Finance Banks. While the branch network and employee headcounts are expanding, the sector faces a very high attrition rate of nearly 40 per cent, particularly among frontline staff and junior management. Such elevated turnover, though mostly at the entry and junior management levels, poses substantial operational risks, as it can lead to a loss of institutional knowledge, disruption in service delivery, and increased training costs for new hires. To mitigate these risks, Board-level efforts are essential to focus on employee retention strategies at all levels. Further, the absence of succession planning for critical managerial positions is a common issue across SFBs, which requires immediate attention from Boards to ensure a smooth transition of leadership and maintain operational effectiveness.

    Conclusion

    In conclusion, SFBs with their outreach to rural and semi-urban areas, are intended to be one of the key enablers in credit offerings to individuals, weaker sections, entrepreneurs, SHGs/JLGs and MSMEs. They have a large role to play in achieving our aspirational goal of becoming a developed nation by 2047.

    As RBI celebrates 90 years of its foundation this year, we have set deepening financial inclusion as one of our cherished objectives for RBI@100. RBI, with its continued commitment towards a financially inclusive India, has taken several measures to support these segments ranging from Priority Sector Lending targets to the introduction of TReDS for MSMEs. A new chapter in this book is the Unified Lending Interface (ULI) platform which aims at “enabling frictionless credit” with the ‘new trinity’ of JAM-UPI-ULI, further propelling India’s growth story.

    SFBs should strive to harness this opportunity and other such opportunities offered by latest technological innovations for efficient and cost-effective service delivery. Further, with robust governance and effective board oversight, SFBs can capitalise on their strengths while meeting growth and stability objectives.

  • MIL-OSI Economics: Development Asia: Enhancing Environmental Safeguards in Financial Intermediaries

    A look at how ADB, a financial intermediary (FI) itself, appraises projects and manages them over the project cycle can help give a better understanding of how other FIs manage theirs. Multilateral development banks (MDBs) and governments follow the same logic flow when deciding whether or not to invest.

    First, a proposed project should meet the minimal criteria to be eligible for consideration and assessment. ADB has a Prohibited Investment Activity List, which identifies investment activities that do not qualify for ADB financing. Other FIs might have their own list to reflect their priority areas or discouraged investment. If a proposal already fails at technical and financial screening, it will be returned for revision or rejected outright without the need to proceed to environmental–social screening.

    Second, after passing the eligibility screening, a project’s technical feasibility and economic–financial viability will be evaluated in the feasibility study. This necessitates development of the project’s technical design, which is also needed to estimate the cost.

    The evaluation of environmental sustainability and social acceptability of a project was added in the 1970s and has gradually become stand-alone as the Environmental Impact Assessment (EIA). 

    The EIA aims to (i) aid decision making (e.g. drop or proceed with a project and conditions; (ii) improve the project design to minimize negative impacts (e.g. by adding pollution treatment); and (iii) mitigate the residual impacts through action plans such as the environmental management plan.

    Third, once the feasibility study and EIA show the proposed project meets technical-financial and social-environmental requirements, and related actions can be carried out, the FI (or government) can decide to approve the project and proceed with its execution.

    Since these assessments are time- and resource-consuming, their intensity and level of management need to match the level of risks and impacts. Most countries and MDBs classify environmental impacts into high, medium, and low level categories that require corresponding degrees of evaluation—full EIA, simplified EIA, and no assessment—and management. Likewise on the technical aspect, not all projects require a full feasibility study.

    Such impact categorization needs to take place during the proposal stage to determine the level of ensuing assessment. How can the impact level (i.e. category) of a proposal be judged? This is one of the major challenges for FIs, which has led to mis-categorization.

LanzaTech is extending the power of its gas fermentation platform—which can already produce commercial scale volumes of essential ethanol for apparel, packaging, surfactants, and sustainable aviation fuel—to produce large quantities of protein without straining land and water resources or impacting biodiversity. LNP has a complete amino acid profile and no allergenicity.

    LanzaTech has nearly two decades of experience biorefining carbon-rich feedstocks to produce ethanol as the primary product and protein as a co-product. Leveraging this experience, LanzaTech has developed a solution using CO2 that produces LNP as the primary product. As a leader in gas fermentation, LanzaTech is well positioned to access the $1 trillion and growing alternative protein markets with a cost-competitive product that leverages LanzaTech’s proprietary biorefining platform and that utilizes similar feedstocks to LanzaTech’s current operations. 

    LanzaTech is evaluating potential sites, in collaboration with several partners, for the first pre commercial facilities, planned to be operational in 2026. These facilities are expected to produce between 0.5 to 1.5 tons of LNP per day, and given the high protein content of LNP, 0.5 tons per day of LNP is roughly the equivalent of giving a typical complete daily intake of protein to approximately 9,000 people. 

    Commercial facilities are being designed to produce more than 30,000 MT per annum, or greater than 80 MT per day, with the first of these facilities expected to be operational during 2028. 

    LanzaTech is in the process of completing trials and testing in animal feed and pet food, and is underway with completing the U.S. Food and Drug Administration’s Generally Recognized as Safe (“GRAS”) certification process for LNP’s use in human nutrition formulations.

    The Center for Aquaculture Technologies has successfully tested LNP for fish feed applications and human food and beverage innovation firm Mattson completed thorough protein characterization and food prototyping for dish concepts such as smoothies, dairy-free cheese, and bread.

    LanzaTech has also partnered with the U.S. Navy Research Lab on a joint research and contract development project jointly funded by the Office of the Under Secretary of Defense for Research and Engineering, the Office of Naval Research, and the U.S. Naval Research Laboratory to evaluate the viability of creating nutritional proteins on military platforms.

    Before starting her animal feeds company, Nancy Githuku ran a small poultry and dairy farm in eastern Nairobi. “Business was alright,” she says, “but I had a big challenge accessing quality feeds. So I decided to venture into the business of sourcing and selling animal feeds.”

    Githuku saw a lot of potential to build her animal feeds business, but she had trouble finding affordable loans. “Most banks wanted me to produce collateral, like a title deed or logbook, as security for a loan, which I didn’t have,” she says.

    The lack of collateral for loans is common in emerging markets like Kenya, especially for women. Most property ownership documents for land, homes or cars are in the names of men. This makes it hard for women to get business loans or other forms of financial help. During the COVID-19 pandemic, businesses run by women were particularly hard hit, as credit from other sources like families and friends dried up.



    EIB Global, the European Investment Bank’s international development arm, has invested nearly €700 million in Kenya since 1976 to help small and medium companies work with local financial institutions. Through deals known as intermediated lending, the European Union’s financial arm offers financing to local banks so they can give more loans to small businesses.

    Githuku received a loan from the Co-operative Bank, which had in turn been backed by the European Investment Bank in one of these intermediated deals. “The funding I received didn’t require collateral or a guarantor,” she says. “This took a heavy load off my shoulder. And the interest rate was subsidised, meaning the loan was way more affordable than what was available in the market.”

  • MIL-OSI Banking: AI can boost growth and make Europe more competitive

    There are few more pressing questions facing European governments than how to drive economic growth and make the region more competitive. And it’s clear that one of the most important ways to boost the EU’s competitiveness is by harnessing AI for growth.

    A new report by Implement Consulting Group, commissioned by Google, estimates that generative AI could add €1.2-1.4 trillion to the EU’s GDP in ten years – the equivalent to an annual growth rate of 8%. The report also outlines how AI can significantly boost productivity across various sectors.

    This ability of generative AI to boost economic growth and competitiveness is particularly significant for Europe. According to Mario Draghi’s new report, Europe’s competitiveness has nosedived over the past decades: the EU’s share of global GDP has shrunk from over a quarter in 1980 to just 17% today. US productivity has surpassed the EU’s by 20% in 2022.

    But this report is about more than economic metrics — it’s about how AI can help people be more productive, fuel growth and support long term sustainable jobs of the future. 74% of workers in European countries see productivity-enhancing effects of generative AI, and 43% of workers in European countries expect AI to positively impact their job. Our new report estimates that the majority (61%) of jobs will be augmented by generative AI while around 7% face a long-term transition to automation. As with previous transitions, like the birth of commercial aviation or the worldwide web, new industries and careers will be made entirely possible by AI powered breakthroughs. This impact has the potential to be felt across society — from enhancing the quality and efficiency of public services to unlocking scientific breakthroughs and alleviating labor shortages by freeing up resources and boosting productivity.

    Europe’s productivity gap is largely down to slower technological development, innovation and adoption. As Mario Draghi says, “with the world on the cusp of an AI revolution, Europe cannot afford to remain stuck in the ‘middle technologies and industries’ of the previous century”. To catch up, the EU must unlock its innovative potential.

    A new agenda for AI backed growth

    This is why today, in addition to our Economic report, we’re also releasing our AI Opportunity Agenda: a series of recommendations for governments to seize the full economic and societal potential of AI. The Agenda outlines the need to revisit Europe’s workforce strategy, as well as investment in AI infrastructure and research, adoption and accessibility.

    1. Investing in research and development

    For the EU to truly compete in AI, it needs to make research and development a shared priority, as well as making funding more accessible. Without the right incentives to develop and commercialise AI innovation, Europe is stifling its talent and its chances of launching more home-grown tech unicorns.

    2. Building infrastructure to support innovation

    AI breakthroughs are only possible with the right high-performance computing technologies and data centres — and the renewable energy to support them. To enable AI innovation at scale, the EU will need to allocate more funding to financing such infrastructure — as well as incentivising and enabling the private sector to do the same.

    3. Improving skills and training programmes

    Technological growth will not be effective if people are left behind. Given its diversity, the EU must make sure technology benefits every business, economy and person. To do this, it needs to accelerate digital skills transformation, putting AI skills and education at the centre of a revitalised European Skills Agenda — and adding it to school curriculums.

    4. Promoting widespread adoption

    We ultimately need to ensure that AI is applied and deployed in a universally accessible and useful way. For the private sector, EU policymakers and AI developers must work together to develop outreach strategies to traditional industries and small businesses who have much to gain from AI adoption. For the public sector, member states must double down on existing initiatives to increase the public procurement of AI and developing bolder AI adoption targets.

    Developing good policy and responsible AI will need close coordination between governments, the private sector, academia and civil society. Through our AI Opportunity Initiative and other partnerships we’re committed to working with others to get this right. But, as Mario Draghi highlighted, change is also needed in the regulatory environment. Since 2019, the EU has introduced over 100 pieces of legislation that impact the digital economy and society. It’s not just the sheer number of regulations that’s the challenge – it’s the complexity. Moving from the regulatory-first approach can help to unlock the opportunity of AI.

  • MIL-OSI Security: Pennsylvania Man Sentenced to 25 Years in Prison for Transporting a Minor with the Intent to Engage in Criminal Sexual Activity

    SYRACUSE, NEW YORK – John Oathout, age 54, of Harrisburg, Pennsylvania, was sentenced on Friday to 25 years in prison for transporting a minor with the intent to engage in criminal sexual activity.  United States Attorney Carla B. Freedman and Craig L. Tremaroli, Special Agent in Charge of the Albany Field Office of the Federal Bureau of Investigation (FBI), made the announcement.

    As part of his guilty plea, Oathout admitted that after a romantic relationship ended with the victim’s mother, the victim’s mother permitted the defendant to take her daughter on overnight trips to Virginia and New York.  During the week of Thanksgiving 2021, the defendant arranged to pick up the 5-year-old child from her home in Delaware and transport her to a hotel in Kingston, New York, where he subjected the child to sexual contact. 

    In addition to sentencing Oathout to serve 25 years in prison, Chief United States District Judge Brenda K. Sannes also imposed a 20-year term of supervised release, which Oathout will begin serving after he is released from prison, at which time Oathout will also be required to register as a sex offender.

    The FBI’s Albany Division Child Exploitation and Human Trafficking Task Force investigated this case.  The Task Force includes members of federal, state, and local law enforcement agencies. Assistant United States Attorney Carling Dunham prosecuted the case as part of Project Safe Childhood.

  • MIL-OSI Security: St. Louis Nonprofit Executive Accused of More Than $2 Million Dollar Student Meal Fraud

    ST. LOUIS – The owner of a nonprofit was indicted Wednesday and accused of fraudulently obtaining more than $2 million in funds intended to feed low-income Missouri children, both before and during the coronavirus pandemic.

    Cymone McClellan, 31, of St. Louis, was indicted in U.S. District Court in St. Louis on four felony counts of wire fraud.

    The indictment says McClellan owned and ran a non-profit organization called Sister of Lavender Rose (S.O.L.R.). From about January 2019 to June 2022, McClellan and her nonprofit submitted false and fraudulent meal reimbursement claims to Missouri’s Department of Health and Senior Services (DHSS).  S.O.L.R. submitted reimbursement claims to the Food and Nutrition Programs for Children claiming that she served 860,876 meals to children but only bought enough food and milk to serve fewer than one-quarter of those meals, the indictment says. According to the indictment, McClellan defrauded the State of Missouri out of more than $2 million through her fraudulent reimbursement claims.

    The indictment says McClellan attempted to cover up her crime by providing bogus sign-in sheets to DHSS falsely claiming to have taken the attendance of meal recipients at certain food distribution locations. S.O.L.R. submitted management plans to DHSS falsely asserting that state meal reimbursement dollars were spent only in connection with the provision of meals to low-income children, and that the nonprofit did not use meal money to make purchases over $5,000. The indictment says McClellan spent $60,000 on a down payment on a house in Collinsville, Illinois and also bought five vehicles and a house in Florissant, Missouri.

    One of the addresses where McClellan informed the State of Missouri that she was purportedly preparing food for low-income children belonged to an adults-only nightclub called Elmo’s Love Lounge, the indictment says.

    The indictment seeks the forfeiture of the real estate, as well as a 2021 Chevrolet Traverse, a 2012 Chevrolet Express G3500 van, a 2020 Mercedez-Benz Metris van, a 2012 Ford E350 box truck and a 2018 Lexus RX SUV.

    Charges set forth in an indictment are merely accusations and do not constitute proof of guilt.  Every defendant is presumed to be innocent unless and until proven guilty. The wire fraud charges carry a penalty of up to 20 years in prison, a $250,000 fine or both prison and a fine.

  • MIL-OSI Security: Ra Medical Systems, Inc. & Physicians Pay Over $8 Million to Resolve False Claims Act Allegations of Illegal Kickbacks

    DETROIT – United States Attorney Dawn N. Ison announced today a series of three civil settlements, totaling over $8 million, related to, among other allegations, kickbacks that medical device company Ra Medical Systems, Inc. (Ra Medical), paid to various physicians across the country related to Ra Medical’s DABRA laser.

    Ison was joined in the announcement by Special Agent in Charge Mario M. Pinto of the U.S. Department of Health & Human Services, Office of Inspector General (HHS-OIG), Chicago Regional Office, Cheyvoryea Gibson, Special Agent-in-Charge of the Detroit Field Office of the Federal Bureau of Investigation, and Special Agent in Charge Patrick J. Hegarty, Department of Defense Office of Inspector General, Defense Criminal Investigative Service (DCIS), Northeast Field Office. 

    Ra Medical was a medical device company that was formerly headquartered in Carlsbad, California.  From 2017-2019, Ra Medical manufactured and sold a device known as the DABRA Laser.  The settlement with Ra Medical resolves the following alleged violations of the False Claims Act:

    • Ra Medical marketed the DABRA Laser for use in atherectomies, a procedure whereby plaque is mechanically removed from occluded blood vessels in patients suffering from peripheral artery disease. The U.S. Food and Drug Administration, however, had not approved the DABRA Laser for use in atherectomy procedures.
    • Additionally, Ra Medical knowingly marketed the DABRA Laser despite product performance issues causing frequent calibration and overheating problems, which posed a risk to physicians and patients, and prompted a recall in August 2019.
    • Ra Medical also knowingly offered and paid illegal remuneration to certain physicians to induce them to use the DABRA Laser in violation of the Federal Anti-Kickback Statute. The United States contends that the illegal remuneration consisted of cash payments and fees paid in connection with purported training events and consulting services. The United States further contends that RMS tracked utilization of its high-volume physician customers using an internal document titled “Who Deserve[] Love,” which was used to identify physicians that RMS should target with offers of improper remuneration. Two of the recipients of the alleged kickback payments were Elias Kassab, M.D. (Kassab), of Dearborn, Michigan, and David Allie, M.D. (Allie), of Lafayette, Louisiana.

    The Federal Anti-Kickback Statute prohibits offering or paying anything of value to induce referrals of items or services covered by Medicare and other federally funded programs.  The statute is intended to ensure that a medical provider’s judgment is not compromised by improper financial incentives.

    Under the terms of the agreement with Ra Medical, which was entered into pursuant to DOJ’s inability to pay settlement guidelines and was executed in December 2020, Ra Medical paid $2.5 million up front and would pay up to $28 million more if future financial contingencies were met.  In January 2023, Ra Medical paid an additional $5 million, after its reverse merger with Catheter Precision, Inc., triggered one of the contingencies.

    The settlement with Ra Medical remained under seal while the United States continued its investigation into Kassab and Allie, among others, who were alleged to have received improper kickbacks.  In a separate settlement, Kassab and two of his companies agreed to pay $450,000 to resolve the allegations against them.  In the third settlement, Allie and his consulting company agreed to pay $250,000 to resolve the allegations against them.

    “The United States will not allow doctors to hold out their hands expecting to be paid to use and promote a device,” said U.S. Attorney Ison. “The millions of people who depend on our federal healthcare programs deserve and expect medical decisions untainted by kickbacks, and this settlement reflects our commitment to pursuing not just the companies that pay illegal kickbacks, but also the physicians who willingly extract and accept them.”

Hegarty, DCIS Northeast Field Office.  “The settlement agreement announced today demonstrates our ongoing commitment to work with our law enforcement partners and the Department of Justice to investigate allegations of healthcare fraud.”

    The civil settlements resolve the claims brought by Robert Gruber, under the qui tam or whistleblower provisions of the False Claims Act.  Under these provisions, a private party may file an action on behalf of the United States and receive a portion of any recovery.  The qui tam case is captioned United States ex rel. Gruber v. Ra Medical Systems, Inc., et al., No. 19-12044 (E.D. Mich.).  The whistleblower will receive a combined $1,722,000 from the three settlements.  The claims resolved by the settlements are allegations only; there has been no determination or admission of liability.

  • MIL-OSI Security: Convicted Felon Sentenced for the Second Time in One Year After Failing to Appear in Court While on Supervised Release

    Salt Lake City, Utah – Thomas Fairbanks, 71, of Cache County, Utah, was sentenced today to an additional 30 days’ imprisonment for failure to appear in court for a sentencing hearing in a securities fraud case. The one month sentence will be served consecutively to his 27 months’ securities fraud sentence, which was imposed in April 2024. 

    According to court documents and statements made at the change of plea hearing, on May 24, 2023, Fairbanks failed to appear in front of U.S. District Court Judge Jill N. Parrish for his sentencing in a 2019 securities fraud case, after he was convicted by a jury on August 30, 2022. After his failure to appear, a warrant was issued for his arrest, and he was later arrested in February 2024. According to court documents in the 2019 case, the defendant was convicted of a securities fraud scheme in connection with his fraudulent company SupplyLine Partners. As part of the scheme, Fairbanks created a pitch deck to advertise the entity, ran seminars to find investors, and ultimately convinced at least two individuals to invest with him in his fake entity. SupplyLine was never a registered company nor was Fairbanks authorized to sell securities.

    Fairbanks took victims’ money and did not invest as he said he would, never returned the money and did not pay out the promised 6% interest. In total, Fairbanks defrauded two victims out of $270,232.

    The case was investigated jointly by the Utah Division of Securities and the FBI Salt Lake City Field Office.

  • MIL-OSI Security: Texas Businessman Accused of $1.9 Million COVID Test Kit Fraud

    ST. LOUIS – A Texas businessman has been indicted in St. Louis and accused of fraudulently seeking more than $4.5 million from Medicare for COVID test kits and obtaining more than $1.9 million.

    Rashid Naqvi, 51, of the Houston area, was indicted in U.S. District Court in St. Louis on September 4 on four counts of wire fraud conspiracy and one count each of obstruction of a federal audit and conspiracy.

    He appeared in court Wednesday and pleaded not guilty.

    The indictment accuses Naqvi of fraudulently obtaining $1,974,479 from Medicare from March 2023 through September 2024 by billing for numerous COVID-19 test kits that were sent to patients who had never requested them. Many of the patients were dead, the indictment says. Naqvi obtained victims’ Medicare Numbers and identifiers without their knowledge or consent by paying a total of $488,435 in illegal kickbacks to co-conspirators, the indictment says. It says Naqvi used two laboratories that he owned to submit the false claims to Medicare, Elite Diagnostics Inc. in Missouri and Astro Diagnostics Inc. in the Southern District of Texas.

    The indictment says Naqvi attempted to conceal his scheme by disguising kickback payments as payments for COVID test kits, creating a sham contract with one of the companies supplying the information and submitting false documents to Medicare investigators during an audit. He continued submitting false claims to Medicare even after patients called to tell him that they did not request or want the test kits, the indictment says. Naqvi sought a total of $4,579,850 from Medicare.

    Wire fraud is punishable by up to 20 years in prison, a $250,000 fine, or both. Obstruction of a federal audit and conspiracy are each punishable by up to five years in prison and a $250,000 fine.
