    PALESTINIANS
    This afternoon, the Secretary-General has a scheduled appearance at the Committee on the Exercise of the Inalienable Rights of the Palestinian People. In his remarks, he will tell the committee, following the agreement that has been in effect, that we must keep pushing for a permanent ceasefire and the release of all hostages without delay. We cannot go back to more death and destruction.
    In speaking to the broader situation, the Secretary-General will say that in the search for solutions we must not make the problems worse. It is vital to stay true to the bedrock of international law. It is essential to avoid any form of ethnic cleansing and, of course, he will reaffirm the two-state solution. And you can follow those remarks on UN WebTV starting at 3 p.m.

    OCCUPIED PALESTINIAN TERRITORY
    Our Under-Secretary-General for Humanitarian Affairs, Tom Fletcher, is continuing his visit to Israel and the Occupied Palestinian Territory. On the political level, Mr. Fletcher held discussions over the past two days with Israeli authorities, including President Isaac Herzog, as well as officials from the Coordinator of Government Activities in the Territories (COGAT) and the Ministry of Foreign Affairs.
    Mr. Fletcher described these engagements as practical, emphasizing the need to build on the progress since the ceasefire and sustain the large-scale delivery of UN aid into Gaza. On the ground, Mr. Fletcher visited today different areas of the West Bank.
    In East Jerusalem, he visited Silwan neighbourhood where he met with residents facing home demolitions and the threat of forcible eviction by Israeli authorities.
    Mr. Fletcher also toured what is known as Area C of the Ramallah governorate, where he heard and saw the humanitarian impact of access restrictions on the livelihoods of Palestinian and their daily lives. These restrictions include Israeli checkpoints and of course the 712-kilometre-long barrier.
    And just a short while ago in Ramallah, Mr. Fletcher held discussions with national Palestinian NGOs, who are at the heart of humanitarian response efforts across the Occupied Palestinian Territory.

    GAZA
    In Gaza, our humanitarian colleagues report that our aid operations – together with our partners – continue to scale up across the Gaza Strip. We are also carrying out assessments to determine the needs of impacted and displaced families, particularly the most vulnerable.
    Across Gaza, 22 bakeries supported by the World Food Programme are now operational. And our health partners continue to provide health services as well. We and our partners estimate that more than half a million displaced Palestinians have now returned to the governorates of both Gaza and North Gaza, where there is an urgent need for tents and shelter materials. Our partners say they’ve transported 22 truckloads of tents from southern to northern Gaza yesterday to address these needs but we need to get more tents in.
    For its part, UNICEF continues to distribute nutrition support for infants. Across Gaza, the World Food Programme has provided lipid-based nutrient supplements to more than 80,000 children and pregnant or breastfeeding women since the ceasefire took effect. Humanitarian partners have screened more than 30,000 children under the age of five for malnutrition since the ceasefire took effect. Of those children under five screened, over 1,000 cases of acute malnutrition have been identified, including 230 cases of severe acute malnutrition.
    And to sustain learning activities across the Gaza Strip, education partners established three new temporary learning spaces yesterday in Gaza, Rafah, and Khan Younis governorates, benefiting some 200 children.

  • MIL-OSI Security: Leader of Drug Trafficking Organization Sentenced to 21 Years in Federal Prison

    SAN ANTONIO – A Honduran national was sentenced in a federal court in San Antonio today to 262 months in prison for his role as a leader of a drug trafficking organization.

    According to court documents, Marco Antonio Morales-Perez, 51, along with Pablo Torres-Zaragoza aka Jose Juan Zaragoza-Cardenas, 42, of Mexico, continued to lead an organization that trafficked methamphetamine and heroin to San Antonio and other areas of south Texas while they were both incarcerated at the Great Plains Correctional Institution in Hinton, Oklahoma on prior federal charges. Morales-Perez and Torres-Zaragoza used contraband cell phones that had been smuggled into the facility by drone to facilitate, broker and coordinate narcotics deliveries, relying on various contacts, acquaintances and intermediaries to ultimately accomplish the deliveries. Ultimately, more than 160 kgs of methamphetamine and 12 kgs of heroin was seized as part of the Drug Enforcement Administration’s investigative efforts.

    “The significant sentences of these two leaders of this sophisticated drug trafficking organization sends a strong message that we are equipped to investigate and infiltrate complex organizations to hold accountable those at the highest levels who are having dangerous drugs delivered to our community,” said U.S. Attorney Jaime Esparza for the Western District of Texas. “I’d also like to thank the many local law enforcement agencies along with state and federal partners who have provided the essential investigative support to help prosecute these drug traffickers.”

    Torres-Zaragoza was sentenced Dec. 4, 2024 to 262 months in federal prison. Five additional co-defendants indicted alongside Morales-Perez have also been sentenced. Jesus Alfredo Palacios was sentenced to 150 months in prison; Juan Del Hoyo was sentenced to 120 months imprisonment; Manuel Montoya received a 34-month prison sentence; Jose Adam Alejandre-Navarro was sentenced to 108 months; and Israel Villegas Alcantar received a federal prison sentence of 47 months.

    The DEA investigated the case with valuable assistance from San Antonio High Intensity Drug Trafficking Areas (HIDTA), the San Antonio Police Department, Bexar County Sheriff’s Office, Great Plains Correctional Facility, Hollywood Park Police Department, Castle Hills Police Department, Live Oak Police Department, Leon Valley Police Department, Texas Department of Public Safety, U.S. Marshals Service, and the Houston Police Department.

    Assistant U.S. Attorney Eric Fuchs prosecuted the case.

    This case resulted from the work of an Organized Crime Drug Enforcement Task Forces (OCDETF) investigation. OCDETF identifies, disrupts, and dismantles the highest-level drug traffickers, money launderers, gangs, and transnational criminal organizations that threaten the United States by using a prosecutor-led, intelligence-driven, multi-agency approach that leverages the strengths of federal, state, and local law enforcement agencies against criminal networks.

  • MIL-OSI USA: Boozman, Tillis, Murray Introduce Bipartisan, Bicameral Legislation to Support Purple Heart Families

    WASHINGTON––U.S. Senator John Boozman (R-AR) joined Senators Patty Murray (D-WA) and Thom Tillis (R-NC) to introduce the Purple Heart Veterans Education Act, legislation allowing veterans who received their Purple Heart after their service to transfer their educational benefits to one or more of their dependents

    “I’m proud to support policies that honor the promises made to the brave men and women who have worn our nation’s uniform,” said Boozman. “Ensuring that veterans, and especially Purple Heart recipients, are able to access the benefits they have earned for themselves and their families is a duty that Congress should always prioritize.”

    “Purple Heart veterans have made tremendous sacrifices to defend our freedoms, and we as a nation should do everything we can to support them and their families when they return—that includes ensuring all Purple Heart veterans have the full benefits they have earned,” said Murray. “As the daughter of a Purple Heart Veteran, this is personal to me—and I’m grateful to my colleagues on both sides of the aisle for joining me in this effort.”

    “Purple Heart recipients are heroes who honorably served our country at great costs, and this oversight that prevents servicemembers who received this distinguished award after their service from transferring their GI bill benefits to their dependents needs to be corrected immediately,” said Tillis. “I am proud to co-introduce this commonsense legislation to close this loophole and ensure every Purple Heart recipient and dependents are able to further their education.”

     Specifically, the Purple Heart Veterans Education Act would:

    • Permit an individual awarded the Purple Heart after their service in the Armed Forces to transfer their post-9/11 educational benefits to one or more of their dependents.
    • Allow flexibility by permitting the veteran to allocate different amounts, totaling 36 months of benefits, to their dependents. For example, one dependent may be designated 20 months and the other 16 months. 
    • Protect the veteran’s right to their benefits by prohibiting the use of their educational benefits to be treated as marital property or the asset of a marital estate. 
    • Honor the veteran’s legacy by allowing their dependents to continue using the unused benefits after their death. 

    The legislation is also cosponsored by Senators Rick Scott (R-FL), Angus King (I-ME), Jacky Rosen (D-NV), Steve Daines (R-MT), Ron Wyden (D-OR), John Cornyn (R-TX), Mark Kelly (D-AZ), Kevin Cramer (R-ND) and Michael Bennet (D-CO).

    Congressmen Mike Levin (D-CA-49) and Greg Murphy (R-NC-03) introduced companion legislation in the U.S. House of Representatives.

    The Purple Heart Veterans Education Act is endorsed by Disabled American Veterans (DAV), Iraq and Afghanistan Veterans of America (IAVA) and Veterans of Foreign Wars (VFW).

  • MIL-OSI Security: Missouri Man Guilty of Travelling to Louisiana for Illicit Sexual Conduct with Twelve-Year-Old Girl

    NEW ORLEANS –  U.S. Attorney Duane A. Evans announced that ERIC CHARLES FULLER (“FULLER”), age 54, from Springfield, Missouri, pled guilty on February 4, 2025, before United States District Judge Greg Gerard Guidry, to interstate travel with intent to engage in illicit sexual conduct, in violation of Title 18, United States Code, Section 2423(b).

    According to court documents, on or about December 7, 2023, law enforcement personnel, operating undercover online and pretending to be a twenty-nine-year-old mother with a twelve-year-old daughter, met FULLER on a social network and messaging application. Over approximately the next month, on numerous occasions, FULLER discussed his interest in engaging in various sexual acts with the “mother” and daughter.”  These discussions culminated in FULLER making arrangements to travel from his residence in Springfield, Missouri, to the New Orleans, Louisiana area to engage in sexual contact, individually and collectively, with the ”mother” and “daughter.” During his conversations, FULLER described the contact he anticipated as “highly taboo,” “highly illegal,” “risky,” “not the worst way to be,” and “a way to have a happier life.” FULLER drove from Springfield, Missouri on about January 11, 2024, and arrived at a predetermined location in Mandeville, Louisiana, on January 12, 2024, in order to engage in sexual conduct with the individual FULLER believed to be a twelve-year-old female.

    FULLER faces a maximum term of imprisonment of  thirty (30) years.  FULLER also faces at least five (5) years, and up to a lifetime of supervised release, up to a $250,000 fine and a $100 mandatory special assessment fee.  FULLER may also be required to register as a sex offender.  Sentencing before Judge Guidry has been scheduled for May 13, 2025.

    This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse launched in May 2006 by the Department of Justice.  Led by United States Attorneys’ Offices and the Criminal Division’s Child Exploitation and Obscenity Section (CEOS), Project Safe Childhood marshals federal, state and local resources to better locate, apprehend and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims.  For more information about Project Safe Childhood, please visit www.projectsafechildhood.gov.

    WASHINGTON, D.C. – U.S. Sens. Ted Cruz (R-Texas), John Fetterman (D-Penn.) and Elissa Slotkin (D-Mich.) introduced theBanning SPR Oil Exports to Foreign Adversaries Act. The bipartisan bill prohibits the sale or export of oil from the U.S. Strategic Petroleum Reserve (SPR) to China, Russia, Iran, North Korea, or any entity owned or controlled by those nations.
    Upon introduction, Sen. Cruz said, “The Strategic Petroleum Reserve is meant to protect the U.S. during crises, not supply our adversaries. Under President Biden, part of this reserve was sold, benefiting China’s strategic interests. There is strong bipartisan consensus around preventing such a sale from being repeated. I’m proud to work with Senator Fetterman and Senator Slotkin on this legislation, which will prevent U.S. oil reserves from being sold to adversarial nations.”
    Sen. Fetterman said, “The Strategic Petroleum Reserve protects America’s energy, economic, and national security. We must prioritize the safety of America and our allies – we cannot allow our adversaries to purchase oil from our critical energy reserves. This is a commonsense bill with strong bipartisan support.     Sen. Slotkin said, “Our Strategic Petroleum Reserve is meant to bolster our national security, and it should never be sold to hostile nations like Russia, Iran or China.     The companion legislation was introduced in the House by U.S. Rep. Chrissy Houlahan (D-Penn.-6).
    Rep. Houlahan said, “When I heard there was a loophole enabling our foreign adversaries to purchase oil from our strategic reserves, I was shocked and outraged. When gas prices rise, releases from the strategic reserve are meant to ease the financial burden for working families—not potentially end up in the hands of those who wish our service members, country, and NATO Allies harm. Closing this loophole requires a Congressional fix, and I’m proud to partner with Reps. Don Bacon and Jay Obernolte to do just that. We’ve seen support for it in the past; it’s time to get this bill across the finish line and signed into law.”

    BACKGROUND
    Sen. Cruz previously led a bipartisan effort to have an amendment similar to the bill included in the FY24 National Defense Authorization Act (NDAA). The amendment was agreed to by the Senate with overwhelming bipartisan support. The House companion bill, introduced by Representatives Houlahan (D-PA) and Don Bacon (R-NE), also passed the House unanimously as a part of the FY24 NDAA.
    The SPR, which was established by Congress in 1975 in response to OPEC’s oil embargo against the United States, exists to minimize the impacts of oil supply shocks on the United States. Today, as the world’s largest supply of emergency crude oil, it continues to protect and strengthen U.S. national, economic, and energy security. The U.S. Department of Energy manages the SPR and regularly conducts public sales of excess crude oil to the highest bidders through competitive public auction. During both the Biden and Trump Administrations, foreign companies with direct ties to our adversaries have won these auctions, giving anti-democratic regimes access to critical energy reserves.

  • MIL-OSI Global: Belarus election: how ‘Europe’s last dictator’ held onto power as his opponents were jailed or exiled

    The acclamation of Alexander Lukashenko as Belarus president for a seventh straight term was confirmed on January 26. The electoral authorities announced that the man known as “Europe’s last dictator” – the only president the country has had since it held its first “democratic” election in 1994 – had won 87% of the vote.

    Most western leaders have dismissed the result as a “sham”. Germany’s foreign minister, Annalena Baerbock, posted on X that “the people of Belarus had no choice”, while the Polish foreign minister, Radosław Sikorski, commented that he was surprised “only” 87.6% of the electorate had voted for Lukashenko: “Will the rest fit inside the prisons?” he asked.

    But the result was never really in doubt. Sikorski’s barb about jailing opponent figures is right on the money. Many of Belarus’s main opposition figures are already behind bars and the rest are in exile. And, just to make sure of things, well before the campaign started – in January 2024 – Lukashenko changed the law so that only those people who were had lived permanently in Belarus for 20 years could stand for the presidency. This meant that the most prominent opposition leader not now in prison in Belarus, Sviatlana Tsikhanouskaya, was ineligible.

    Tsikhanouskaya fled after the election to avoid the fate of her husband, Sergei Tsikhanouski, who was arrested in 2020, two days after declaring his candidacy for the election. He has since been jailed for 18 years on charges of “preparation of mass disorder” and “incitement to hatred”. Tsikhanouskaya was herself tried in absentia and sentenced to 15 years for high treason, inciting social hatred, attempts to seize power, forming an “extremist” group and harming national security.

    So with no real opposition allowed to stand, Lukashenko’s reelection was pretty much a foregone conclusion. A survey conducted by the think tank Chatham House at the end of 2024 found that about one-third of Belarusians said they supported Lukashenko – and most of these people also commented they thought the country was going in the right direction.

    Keeping Belarus out of the war was a major factor for these voters. A further 41% professed to be neutral. When it came to electoral integrity, 36% agreed or somewhat agreed that the result was predetermined. Among pro-democracy voters that number rose to 77%.

    Government in exile

    Tsikhanouskaya leads a government in exile from Lithuania, heading what her team has called a “united transitional cabinet”, tasked with “ensuring the transition of power from dictatorship to democracy, and promoting fair and free elections”. The cabinet is supported by a national coordinating council of 70 members which is elected on a two-yearly basis and who main function is to establish the ground rules for a “ democratic and rule-of-law-based state”.

    Tsikhanouskaya’s efforts have been supported by a range of countries, including the US which, in August 2020, urged the Lukashanko regime to “actively engage Belarusian society, including through the newly established National Coordination Council, in a way that reflects what the Belarusian people are demanding, for the sake of Belarus’ future, and for a successful Belarus”.

    But being a leader in exile means it is difficult to bridge the barrier to Belarusians at home.

    Political prisoners

    Other opposition figures are mainly still in prison. Sergei Tsikhanouski was recently was charged with violating prison rules, which will increase his existing 18-year sentence.

    His fellow opposition leader, Viktar Babaryka – who was also arrested in the run-up to the 2020 election – was given 14 years on trumped-up up charges. His assistant Maria Kolesnikova, who took over from him as a protest leader, was jailed after publicly destroying her passport so she could not be forcibly exiled by the authorities.

    Although not part of the political opposition another prominent figure, Ales Bialiatski, a human rights activist who won the Nobel peace prize in 2022 was sentenced to ten years in jail in 2023 for smuggling and allegedly financing the 2020 protests.

    Overtures to the west

    Since the summer of 2024, 200 political prisoners have been released, a possible sign that Lukashenko wants to reset relations with the west. He did something similar in 2015, the year after Russia annexed Crimea.

    At the time his release of six opposition activists was seen as a possible sign the Belarus leader was concerned his country could be at risk from Russian aggression and he was looking to keep with the EU and the US.

    Kolesnikova was recently allowed a prison visit from her father for the first time in nearly two years. Meanwhile a journalist was given access to Babaryka in jail and allowed to record a video of the jailed dissident for his daughter.

    If the release of prisoners and reappearance of the two jailed dissidents are indeed an attempt to reset relations with the west, the fact he still has more than 1,000 political prisoners behind bars will give Lukashenko plenty of diplomatic leeway.

    But given Lukashenko’s close alignment with Russian president Vladimir Putin and the fact that he allowed Belarus to be used as a launch pad for Russia’s invasion of Ukraine, it is unlikely that many western countries will be won over.

    Lukashenko has shown himself to be an irritant many times over the years. In 2021, the year before Russia’s invasion of Ukraine, the Belarus leader was roundly criticised for trying to spark a migrant crisis in neighbouring Poland, Lithuania and Latvia. Belarus was reportedly flying Iraqi and Afghan migrants from the Middle East and bussing them to the border where Belarusian troops were trying to push them across.

    As far as armed resistance to Lukashenko is concerned, the Kastuś Kalinoŭski Regiment, a group of Belarusian volunteers has been fighting as part of Ukraine’s armed forces since March 2022. The regiment’s stated aim is to help Ukraine fight off Russia and become part of the EU and Nato and to strive for Belarus to do the same.

    The next election is due to be held in 2030. Alexander Lukashenko will be 75.

  • MIL-OSI Global: What Trump’s proposal to ‘take over’ Gaza could mean for Arab-Israeli relations

    US president Donald Trump has made the extraordinary suggestion that the US should seize control of the Gaza Strip and permanently remove its Palestinian inhabitants. Speaking to the press at the White House alongside the Israeli prime minister, Benjamin Netanyahu, Trump said the US would “own [Gaza] and be responsible”.

    When pushed on the practicalities of such a move, Trump replied that the US would “do what is necessary” and develop the land into the “riviera of the Middle East”. “It’ll be something that the entire Middle East can be very proud of,” he said.

    The secretary of state, Marco Rubio, later wrote in a post on X: “The United States stands ready to lead and Make Gaza Beautiful Again. Our pursuit is one of lasting peace in the region for all people.”

    Trump’s declaration has been celebrated by many on the Israeli right, who have long supported the removal of Palestinian residents from Gaza. But it has also been met with anger across the Arab world and beyond.

    Francesca Albanese, the UN special rapporteur on the occupied Palestinian territories, called Trump’s proposal “incitement to commit forced displacement”. Some politicians have described his comments as an endorsement of ethnic cleansing.

    Trump first uttered his desire to “clean out” Gaza a week before this announcement. This prompted foreign ministers from Saudi Arabia, the United Arab Emirates, Qatar, Jordan and Egypt to sign a statement affirming their rejection of efforts to “compromise Palestinians’ unalienable rights, whether through settlement activities, or evictions or annex of land or through vacating the land from its owners”.

    The statement, made by a group of states not generally known for operating in a unified manner, ended by congratulating Rubio on his appointment. But the message to the Trump administration was clear: the two-state solution is the only viable solution to the Israeli-Palestinian conflict.

    Trump’s latest proclamations will deepen schisms across the region between Israel and its Arab neighbours, and prompt questions about the future role of the US in the Middle East.

    Egypt and Jordan’s response

    Any attempt by Washington to seize control of Gaza, which would almost certainly involve military force, would evoke parallels with 1948 and what is known in Arabic as the nakba, or “the catastrophe”.

    At that time, many Palestinians had to flee their land in what is now Israel, setting in motion decades of conflict between Israel and neighbouring Arab states. Acts of terrorism in the intervening years have cost thousands of lives on all sides.

    Trump’s call for Arab states to take in Palestinians from Gaza – who he says have no alternative but to abandon the coastal strip – ignores the strength of feeling across the world about the Palestinian issue.

    Egypt, for example, has long rejected the idea of housing Gaza’s population, amid growing socio-economic pressures and longstanding fears of Islamist violence. And Jordan has been steadfast in its desire not to host more Palestinians, having already provided refuge for people fleeing Palestine in 1948 and 1967. It has, more recently, also become the main destination for refugees from Lebanon, Syria and Iraq.

    On February 5, Egypt’s foreign minister, Badr Abdelatty, met with the prime minister of the Palestinian Authority, Mohammed Mustafa, in Cairo. According to an Egyptian foreign ministry statement, the pair jointly rejected Trump’s proposal for a US takeover of Gaza.

    Egypt and Jordan have both signed peace deals with Israel. But relations have not always been cordial, and the destruction of Gaza has exacerbated these tensions. Trump’s latest comments, as well as those from the Israeli right, will only worsen the situation.

    Relations with Saudi Arabia

    During Trump’s first term, his administration secured a significant diplomatic victory by brokering the Abraham accords. The accords, all of which were signed in the latter half of 2020, normalised relations between Israel and the United Arab Emirates, Bahrain and later Morocco.

    The signatories to the Abraham accords have been conspicuously quiet about Israel’s actions in Gaza. And it remains to be seen what effect Trump’s proposed Gaza takeover could have on relations between these states. The United Arab Emirates, Bahrain and Morocco have, at the time of writing, not yet announced their response.

    Saudi Arabia, on the other hand, has remained the jewel in the diplomatic crown seemingly out of reach both for the Trump administration and that of his successor, Joe Biden. The kingdom occupies a prominent place within the Arab and Muslim world by virtue of its custodianship of the two holy mosques of Mecca and Medina.

    Crown Prince Mohammed bin Salman, Saudi Arabia’s de facto ruler, has taken an increasingly hard line on normalisation with Israel in recent months, suggesting that such a deal would not be possible without the establishment of a Palestinian state.

    In a statement released on February 5, the Saudi foreign ministry said it rejected “any attempts to displace the Palestinians from their land”. And bin Salman has affirmed the kingdom’s position that it would not establish ties with Israel without a Palestinian state.

    During his press conference, Trump suggested that Saudi Arabia was not demanding a Palestinian homeland. But statements from Saudi officials since then contradict this narrative and point to increasingly divergent views on Gaza – and indeed, the future of Palestine – between Riyadh and Washington.

    Fundamentally, Trump’s remarks are the latest in a long line of bombastic diplomatic flourishes that appear designed to provoke as much as to enact policy. But in this case, even rhetorical provocations will have consequences for already strained relations between Israel and the wider Arab world.

    IAM Rail Division representatives joined members of Congress and leaders from fellow U.S. rail unions in calling on Congress to act on rail safety two years after the toxic East Palestine train derailment. 

    “On behalf of all our members, our hearts still go out to the people of East Palestine. They want answers, they want results and so do we,” said Transportation Communications Union (TCU/IAM) National Legislative Director David Arouca. “The so-called Precision Scheduled Railroading (PSR) era has been nothing short of just cutting head counts to the bone and then harassing those who remain to pick up the slack.”

    TCU/IAM represents various crafts, one of the largest being carmen, who maintain, repair and critically inspect rail cars all across the country. 

    “Whether it’s our carmen being harassed to perform safety inspections on insane timelines or signalmen maintaining our national network of safety detectors, we’ve all been saying the same thing: PSR is going to kill people,” said Arouca. “We need legislation passed now to reduce the risk of another East Palestine. The time to act was yesterday. Rail safety is not, nor should it ever, be a partisan issue.”

    IAM District 19 President and Directing General Chair Reece Murtagh was also present to answer questions for the press. Members of Congress joining rail included House Transportation Committee Vice Ranking Member Emilia Sykes (D-Ohio), House Rail Subcommittee Ranking Member Dina Titus (D-Nev.), House Transportation Committee Member Troy Nehls (R-Texas) and House Transportation Committee Member Chris Deluzio (D-Pa.).

    The rail leaders demanded that Class I railroad companies adopt the Federal Railroad Administration’s (FRA) Confidential Close Call Reporting System (C3RS), which allows rail workers to report safety concerns without retaliation from employers. 

    While addressing the public with his own press conference in East Palestine, Ohio on the disaster’s anniversary, U.S. Vice President JD Vance, who co-sponsored the bipartisan Railway Safety Act as Senator, said that passing legislation “is a very viable and a very reasonable goal.” 

    Senator Maria Cantwell sent a letter to U.S. Senate Committee on Commerce, Science, and Transportation Chairman Ted Cruz urging him to “advance the re-introduced Railway Safety Act to ensure President Trump and Vice President Vance have the tools they need to hold the railroads accountable for improving safety. “

    “Rail safety is not a partisan issue or a regional issue, it is a human issue,” said Congresswoman Sykes. “I am proud to work with my colleagues on both sides of the aisle on and off the Transportation Committee to put forth a piece of legislation we can be proud of, but we can only truly make it right for the people of East Palestine if we actually pass meaningful rail safety legislation.”

    “I think we have a real opportunity here,” said Congresswoman Titus. “I think we can get it done, just reintroduce those bills, bring it together in a package, and move it forward. I’m committed to it, other members of Congress and the great representatives from unions are, so I’m leading this with optimism.”

  • MIL-OSI Global: Turkey’s earthquake reconstruction efforts must balance speed with fairness

    Two years after the devastating 2023 earthquakes in Turkey that killed about 60,000 people and caused the collapse of 57,000 buildings, the country’s recovery remains slow, fragmented, and heavily politicized.

    Despite large-scale reconstruction efforts, branded the “Reconstruction of the Century,” there is no clear strategy or timeline, and affected communities are still excluded from decision-making.

    Given the scale of destruction, reconstruction efforts will likely take years. Large-scale government housing projects on city outskirts are being prioritized due to their speed and the ease of land acquisition. However, these developments often come at the cost of uprooting established communities, pushing people into peripheral areas with limited access to services like transport and education and fewer economic opportunities.

    Temporary accommodations like container cities continue to deteriorate. Overcrowding, inadequate sanitation and unreliable access to clean water, electricity, health care and education are widespread. Women face heightened safety risks, and schools are overwhelmed, forcing many families to relocate unwillingly or leaving children with no option but to hitchhike to school.

    ‘Disaster of the century’ narrative

    From the outset, Turkey’s political leadership framed the 2023 earthquakes as the “disaster of the century,” using their scale to deflect scrutiny from governance failures. Weak enforcement of earthquake regulations and systemic negligence played a key role in the destruction, yet officials have avoided accountability.

    This narrative was reinforced by contractors facing trial, who claimed the devastation was caused by an extraordinary natural event rather than poor construction practices or regulatory failures. By portraying the disaster as unavoidable, they have sought to shift responsibility away from those who contributed to the destruction.

    The rapid removal of debris further weakened efforts to establish accountability. Clearing ruins so quickly erased critical evidence that could have explained why some buildings collapsed while others remained standing. Many structures were never properly assessed, and legal cases against those responsible have struggled to move forward due to missing documentation.

    Survivors seeking justice remain trapped in lengthy legal battles with little hope for accountability. Among them are initiatives like Families in Pursuit of Justice and the Association for the Survival of the Champion Angels, led by relatives of victims, continue to demand accountability from contractors and officials.

    It is important to note that earthquake-induced ground motions in a few localities did exceed the parameters defined in the building codes, but this should only have resulted in damage, not total building collapses.

    Land expropriation and legal battles

    Turkey’s construction industry, closely tied to political power, has benefited from disaster recovery, reinforcing existing economic and political hierarchies. Large-scale reconstruction projects serve as an economic engine, giving firms with close government ties an advantage while sidelining local communities.

    The awarding of large-scale projects without competitive bidding has fuelled concerns that reconstruction is prioritizing political and economic interests over the needs of local communities.

    One of the key mechanisms enabling top-down reconstruction is the designation of reserve areas, a legal tool allowing the state to expropriate land for redevelopment under the justification of disaster recovery and urban renewal. This process has often led to forced displacement, particularly in areas with high land value or where redevelopment aligns with broader political and economic interests.

    This is evident in Akevler, a neighbourhood in central Antakya, where residents received sudden expropriation orders, even for structurally sound or repaired homes. Many launched legal challenges, marking their buildings with signs reading “Do not demolish; in court” to resist state-led destruction.

    In November 2024, there was a significant legal victory for residents when a court issued a stay within the reserve area in Akevler. The court cited “irreparable harm” and ruled that demolitions and evictions could not proceed without due legal process. This decision also extended to vacant parcels, reinforcing concerns about arbitrary land seizures.

    Beyond urban areas, rapid recovery decisions have also disregarded environmental concerns. In Defne, Hatay, earthquake survivor Çiğdem Mutlu Arslan has been fighting to protect her family’s ancestral olive grove. In July 2024, a contractor — citing post-disaster road construction — cut down 32 of 40 trees, some more than 150 years old, without an expropriation decision.

    Determined to resist further encroachment, Arslan set up camp on her land, documenting the destruction and raising awareness of how recovery policies are exacerbating environmental degradation. Her struggle reflects broader post-disaster consequences, where recovery efforts threaten communities, heritage and the environment.

    ‘Building Back Better’

    While these struggles highlight the shortcomings of post-disaster recovery, there are potentially better and fairer ways to approach reconstruction. Building Back Better (BBB) has become a central principle globally accepted, shaping expectations for reconstruction.

    Introduced by the United Nations after the 2004 Indian Ocean tsunami, BBB promotes rebuilding stronger, more resilient and more equitable communities rather than simply restoring pre-disaster conditions. BBB prioritizes disaster-resistant infrastructure, social equity and sustainability to reduce future risks.

    Yet, BBB faces significant challenges. The tension between rapid reconstruction and long-term resilience often leads to trade-offs, where speed takes priority over equity and sustainability. Vulnerable communities, particularly low-income groups with insecure land tenure rights, frequently receive inadequate attention, exacerbating pre-existing inequalities.

    For BBB to be effective, recovery strategies must be inclusive and adapted to local contexts. However, many disaster-prone regions lack the social safety nets and institutional capacity to implement BBB successfully. Additionally, the framework’s broad and ambiguous goals often result in inconsistent applications, where vulnerabilities are reinforced rather than addressed.

    A more effective path forward

    Drawing from these examples and considering the global discourse around post-disaster recovery, a more effective approach must prioritize social justice, transparency and long-term resilience. Several key measures should be considered:

    A people-centred recovery: Reconstruction must prioritize affected communities rather than external economic or political interests. Ensuring access to stable housing, education and health care while addressing existing inequalities is crucial. Organized civil society groups can assist with articulating needs and developing community-driven plans. Decentralized access to financing for communities coupled with technical support can help with realizing these plans.

    Transparency and accountability: Decision-making must be open to public scrutiny, and legal rulings must be enforced.

    Challenging dominant narratives: Moving beyond narratives that frame disasters as inevitable is critical. Acknowledging governance failures and addressing systemic issues will be key to preventing future tragedies.

    Balancing speed with resilience: While urgent needs must be met, reconstruction should incorporate more sustainable planning to prevent future displacement and social impacts.

    Reforming the construction industry: Ensuring the effective enforcement of regulations and addressing systemic gaps in oversight are essential to reducing vulnerability to future disasters.

    Without these measures, Turkey risks repeating past mistakes, deepening inequalities and failing to provide stability for disaster-affected communities.

    When I think about the importance of mentorship in our industry, one person is top of mind: Ken Fischer. Our professional relationship spanned decades, and he fundamentally shaped who I am today.

    Over Thanksgiving in 2008, Ken and I traveled to the UAE on IADC business, then to Oman for the IADC Well Control Middle East Conference. I was IADC’s VP of Membership at the time; I’d been working with Ken since 1996, a year after I started with our Association in what’s known today as the IADC Bookstore.

    We were staying at the Grand Hyatt Muscat Oman, and the hotel was hosting a Thanksgiving dinner for its American guests. Ken and I got our plates and sat out on the patio, and that’s when a seemingly ordinary moment changed the trajectory of my career and my life.

    After our meal, Ken pulled out a scrap piece of paper that had the cab driver’s phone number from the night before. He started drawing out a leadership assessment grid, listing key attributes like vision, leadership, management, and technical competency. Then, he began evaluating several individuals—including me—and grading them on each of these attributes.

    The exercise Ken drew out and the conversation that followed were straightforward, because that was Ken’s way, but they changed my life. There were two things that made this moment transformative for me.

    Most importantly, this was the first time anyone had pulled me aside and told me that they thought I had potential. He believed in me at a time when I didn’t yet believe in myself. He showed me that I have something to offer, even though it took me a while to fully believe what we discussed that day.

    Secondly, he provided a clear, honest roadmap for my personal and professional growth. We talked about my weaknesses and the areas I could improve in, which motivated me to take action.

    At the time of our conversation, serving as IADC’s president was simply nowhere on my radar. But I kept that piece of paper with me, a constant reminder of Ken’s wisdom and encouragement. Years later, in 2015, I was honored to be given an opportunity to serve as IADC’s President—a journey, I believe, that truly began with that simple but powerful conversation in Oman.

    A few years ago, I visited Ken at his ranch during his battle with cancer. I pulled out the same worn piece of paper from Oman. He was astonished I still had it, and I told him what a pivotal moment that had been for me. I’m so grateful I had the opportunity to express to Ken how much he meant to me and what an impact he’d had on my personal and professional life before he passed away.

    Mentors like Ken don’t just guide careers—they change lives. They see potential in young professionals and nurture it with care, wisdom, and genuine belief. In our industry, these connections can be a truly invaluable resource.

    To everyone reading this: If you have a mentor who’s inspired you, tell them. Let them know how much you appreciate them and the impact they’ve had on you. And if you’re in a position to mentor others, don’t underestimate the profound impact you can have on someone with a simple, encouraging conversation.

    In the face of escalating costs and funding challenges, the Isle of Wight Council has today (Wednesday) unveiled its budget for 2025/26, with a spotlight on community protection and essential improvements.

    The draft budget seeks to tackle the substantial pressures on public finances while safeguarding the wellbeing of residents and preserving the essential frontline services that many Islanders depend on.

    The financial climate for local government remains tough, with costs climbing faster than income and funding. The council faces the daunting task of additional spending of £15.8 million in children’s services and adult social care next year, merely to maintain services at existing levels.

    This significant increase is driven by rising demand and the need to ensure vulnerable residents receive the care and support they require.

    In response, the council proposes a five per cent council tax increase, including two per cent specifically for adult social care. This is in line with the majority of councils across the country, which are facing similar pressures, although some authorities are contemplating increases as high as 15 to 25 per cent. The Isle of Wight Council is striving to keep increases as low as possible.

    The council’s strategy relies on careful use of reserves to manage its underlying budget deficit over time. However, it’s crucial to maintain these reserves at responsible levels to ensure financial stability and to be able to continue providing services at sustainable levels.

    Of the £1.5 million savings needed next year, efficiencies and income generation will deliver the required savings without cutting services. This includes streamlining operations and exploring new revenue streams to maintain service levels.

    After listening to the needs of local businesses and residents, the council is proposing to freeze parking charges at their current levels for the second consecutive year. This measure aims to alleviate the financial strain on household budgets and support the high street. Additionally, crossing charges on the floating bridge will remain unchanged.

    The council will also continue to invest in highway drainage schemes to reduce flooding and fund repairs to footpaths and bridleways damaged by the recent winter storms. These investments are crucial for maintaining safe and accessible infrastructure across the Island. A key highlight of the budget is the investment in schemes to support coastal protection, crucial for protecting the homes and livelihoods of residents in vulnerable coastal regions.

    This includes repairs or improvements to promenades, seawalls, railings and groyne refurbishment, which are essential for mitigating the impacts of coastal erosion and climate change.

    The budget also includes improvements at Beaulieu House, the children’s disability residential and respite home in Newport, ensuring it can continue to provide essential services and support to those in need. These upgrades will enhance the facility’s capacity to deliver high-quality care and support. Meanwhile, the council is introducing schemes specifically designed to help young people who are leaving the care system find stable and long-term housing options.

    The budget also prioritises responsible repairs and renewals in public spaces. By maintaining and improving the public realm, the council aims to create a safe, functional, and welcoming environment for all residents and visitors. This includes replacing play equipment, litter bins and benches where necessary.

    In addition, the council has planned investments in capital schemes for school maintenance and adaptations to disabled residents’ homes as part of a £13 million capital programme. These projects will improve educational facilities across the Island and enable disabled residents to live independently in their own homes.

    Furthermore, there is more planned investment in the Gouldings care home in Freshwater and the Parklands Dementia Hub in Cowes, building on the significant improvements already made in these important facilities.

    Council leader, Councillor Phil Jordan, said: “Despite the challenging financial climate, our commitment to protecting and improving our community remains steadfast. We are dedicated to ensuring our community continues to thrive, even in the face of economic pressures.

    “One of our top priorities is the protection of our coastal areas. By investing in coastal infrastructure, we are taking proactive steps to safeguard our coastal regions from erosion and flooding. This investment goes beyond infrastructure; it’s about securing the homes and livelihoods of our residents.

    “The council continues to advocate for fair funding for the Island from the government. By maximising spend from minimal funding, keeping charges down, investing in capital schemes, balancing the budget responsibly, using reserves wisely, and re-structuring where possible, we are working hard to minimise any adverse impacts on our residents.

    “This draft budget is about balancing our financial responsibilities with the needs of our community, and I believe it strikes  that balance effectively.”

    Looking ahead, the council acknowledges the need for ongoing savings and has forecast a savings requirement of £2.5 million for 2026/27 and £2 million per annum for the subsequent years, to ensure long-term financial sustainability.

    The budget will be considered by the council’s Cabinet on Thursday, 13 February, and by Full Council on Wednesday, 26 February.

  • MIL-OSI Global: Trump’s Gaza threat shows the Middle East is both safer and more turbulent post-war

    United States President Donald Trump’s suggestion that the U.S. will take over war-torn Gaza and create a “Riviera of the Middle East” has been immediately condemned by the international community, including American allies and adversaries alike.

    His threats come just two weeks into the ceasefire deal between Israel and Hamas, and risk undermining the regional diplomatic efforts that made the ceasefire deal possible.

    Structured in three phases, the ceasefire agreement involves the exchange of Israeli hostages for some Palestinian prisoners; the withdrawal of Israeli forces along the Philadelphi and Netzarim corridors; and the return of vital humanitarian assistance needed to rebuild a war-torn Gaza — not to “clean it out,” as Trump has proposed.

    In the post-war landscape — and amid Trump’s threats as he stood next to Israeli Prime Minister Benjamin Netanyahu at the White House — Israel now likely finds itself in a paradoxical situation: both better and worse off.

    On the one hand, Israel is more secure than ever before. It has leveraged the shock of the Oct. 7 attacks to reshape the regional balance of power, demonstrating military strength and restoring deterrence.

    On the other hand, Israel’s relentless bombardment of Gaza, its unwillingness to yield to public pressure and its perceived disregard for international law and the rules-based order have isolated the country, arguably turning it into a pariah on the world stage.

    Capitalizing on catastrophe

    Historically, Israel has implemented a counter-insurgency strategy known as “mowing the grass,” designed to weaken its adversaries through limited targeted military campaigns that deliberately stop short of full destruction.

    The strategy never intended to address the root causes of the conflict. Rather, it focused on preventing Hamas from launching large-scale, credible attacks against Israel.

    Oct. 7 was precisely what “mowing the grass” sought to obviate. The security lapse, however, inadvertently created ripe conditions for Israel to justify — even for a limited time — a much larger and more destructive campaign against Palestinian militant groups. A window had emerged, and Israel seized it.

    Israel’s ground and aerial campaign over the past 15 months has significantly weakened the group, although, as demonstrated by a recent show of force, it has not been eliminated.

    The Israeli military’s control over key border points, the destruction of tunnels used to carry out attacks and smuggle weapons and the targeted killings of political leaders may make it difficult for Hamas to inflict similar levels of carnage again any time soon.

    Hezbollah in the north

    Like in Gaza, the Israeli government used Hezbollah’s relentless rocket attacks to justify a separate military campaign deep into Lebanese territory.

    In the span of a few weeks, the offensive reportedly killed more than 4,000 Hezbollah fighters, destroyed key weapon caches and critical infrastructure and pushed the group north of the Litani River, approximately 30 kilometres from the Israeli border.

    Israel further shocked the world when it simultaneously detonated pagers and walkie-talkies used by Hezbollah militants. This was followed by a string of targeted killings that included Hezbollah’s long-time leader, Hassan Nasrallah, and his then-successor, Hashem Safieddine.

    The decapitation of the Hezbollah’s chain of command, combined with its failure to mount an effective counteroffensive, revealed that the group is far weaker than projected. This, in turn, forced Hezbollah to make significant concessions and capitulate to a ceasefire agreement that worked against its interests.

    The wider region

    The Iran-backed Houthi movement in Yemen also entered the conflict by seizing Israeli and western-owned ships and launching a series of drone and missile attacks toward Israel.

    But Israel responded with greater force, showcasing its ability to conduct large-scale missile, drone and aerial strikes thousands of kilometres away in Yemen.

    And for the first time, Israel and Iran engaged in direct tit-for-tat escalatory exchanges, sparking fears of an all-out regional war. Israel’s defence systems, backed by allies and neighbouring countries, successfully thwarted hundreds of Iranian missiles.

    Israel’s response successfully bypassed Iran’s anti-missile defence systems, sending a decisive message of military superiority. Israel also demonstrated its intelligence advantage by assassinating Hamas leader Ismail Haniyeh in Iran while he was residing at a compound secured by the Islamic Revolutionary Guard Corps.

    The collapse of Syria’s Assad regime also created a power vacuum, prompting Israel to conduct hundreds of airstrikes aimed at destroying weapons abandoned by the Syrian army, surface-to-air defence missile systems and to seize strategic territory close to its border.

    Israel’s increasing presence within Syria and dominance over the airspace now makes it considerably easier to intercept the supply chain between Iran and Hezbollah.

    All for a cost

    Israel’s push to deter its adversaries and restore its standing as the regional powerhouse, however, has come at a high price: its reputation.

    Diplomatically, some of Israel’s closest allies, including Canada, France and the United Kingdom, have either banned or restricted arms sales to Israel.

    The once-universal support for Israel in the U.S. from both the Republican and Democratic parties became considerably strained. The United Nations General Assembly also voted overwhelmingly for the Security Council to consider admitting Palestine as the 194th member — a move viewed by Israel as a reward for Oct. 7.

    Israel also faces a public relations crisis at the International Criminal Court, where it is currently on trial for allegedly violating the Genocide Convention in relation to Palestinians in the Gaza Strip. Likewise, the court issued a warrant for Netanyahu and former Defence Minister Yoav Gallant for “intentionally depriving Gazans of food and directing attacks against civilians.”

    The ripple effects of Israel’s actions have spilled overseas, affecting much of the world, and especially the younger generations’ public opinion of the conflict.

    In the U.S., for example, a Pew Research Report found that Americans under 30 are considerably more likely to sympathize with Palestinians than Israelis. The results are similar in Canada, with youth between the ages of 18 and 24 reporting support for Hamas over Israel by a two-to-one margin.

    Is Israel more or less secure?

    While Israel’s response to Iran and the “axis of resistance” have positioned the country into a safer, more militarily dominant position than before the war, the consequences of this strategy may be short-lived.

    The images from Gaza — the loss of civilian life, displaced families, and starving children with no viable prospect of a future — have shifted public opinion against Israel. This has frayed diplomatic relations with once-dependable allies — although apparently not the U.S — upended the wider Middle East peace process, and fuelled a resurgence of antisemitism, especially on college campuses, not seen since before the Holocaust.

    But most of all, Israel’s response to Oct. 7 may unintentionally serve as the most powerful recruitment tool for future cycles of Palestinian violence. To many, especially the youth around the world, it is possible that future violence may come to be viewed as a legitimate form of resistance.

    And if that is the case, coupled with the unlikely prospect of Israel permanently deterring Iran and its proxies and with an American president who is in favour of relocating Gaza’s entire population and taking over the territory, Israel could find itself in a more precarious situation than ever before.

  • MIL-OSI Security: Rochester Woman Pleads Guilty to Wire Fraud, Money Laundering in Feeding Our Future Scheme

    MINNEAPOLIS – A Rochester woman pleaded guilty for her role in the $250 million fraud scheme that exploited a federally funded child nutrition program during the COVID-19 pandemic, announced Acting U.S. Attorney Lisa D. Kirkpatrick.

    According to court documents, from approximately December 2020 through January 2022, Ayan Jama, 45, knowingly participated in a scheme to defraud a federal child nutrition program designed to provide free meals to children in need. Rather than feed children, the defendants took advantage of the COVID-19 pandemic—and the resulting program changes—to enrich themselves by fraudulently misappropriating millions of dollars in federal child nutrition program funds.

    According to court documents, Jama was one of the principals of Brava Rochester in Rochester, Minnesota. In September 2020, Jama’s Brava Restaurant and Aimee Bock applied for enrollment in the Federal Child Nutrition Program under the sponsorship of Bock’s non-profit, Feeding Our Future. A co-conspirator enrolled Brava Restaurant in the Federal Child Nutrition Program after the co-conspirator first prepared application paperwork at the direction of Salim Said, the co-owner of Safari Restaurant in Minneapolis, which was another business involved in the scheme to defraud the food program.

    From late 2020 through 2021, Jama and other conspirators claimed Brava Restaurant was serving approximately 2,000 to 3,000 daily breakfasts and lunches to children, for which they fraudulently claimed and received millions of dollars in federal child nutrition program funds. To accomplish his scheme, Jama and her co-conspirators submitted fake attendance rosters purporting to list the names of children who purportedly received their food at sites. These rosters were fraudulent in that the names on them were fake or did not correctly reflect the number of children that were fed.

    According to her plea agreement entered today, Jama claimed Brava Restaurant had served more than 1.7 million meals in Rochester as part of the Federal Child Nutrition Program in a little over one year, a number substantially higher than the actual number of meals served. Based on these fraudulent claims, Feeding Our Future paid out over $5.3 million in federal child nutrition program reimbursements for meals purportedly served to children by the defendant and her co-conspirators. Jama knew her receipt of such funds was fraudulent because she and other conspirators intentionally submitted inflated meal counts. Jama’s Brava Restaurant ultimately received $4.3 million directly from Feeding Our Future and over $900,000 from Safari Restaurant, co-owned by Salim Said.

    As part of their scheme, Jama and her conspirators coordinated the establishment of shell companies through which they received and dispersed funds from the federal child nutrition program. Specifically, on January 7, 2021, Salim Said paid to register six different shell companies with the state of Minnesota for Jama and others. For Jama, Salim Said paid to register East Africa LLC. In 2021, Jama deposited at least $407,070 in misappropriated Federal Child Nutrition Program funds into her East Africa LLC bank accounts.

    Jama used the federal child nutrition funds to pay for personal expenditures unrelated to feeding children, including $254,041 to purchase a home located in Rochester, Minnesota, $168,000 to purchase a home located in Columbus, Ohio, and $356,795 to purchase property on the Mediterranean Coast in Alanya, Turkey.

    Jama pleaded guilty last Friday in U.S. District Court before Chief Judge Patrick J. Schiltz to one count of wire fraud and one count of money laundering. Her sentencing hearing will be scheduled at a later date.

    The case is the result of an investigation by the FBI, IRS – Criminal Investigations, and the U.S. Postal Inspection Service.

    Assistant U.S. Attorneys Matthew S. Ebert, Joseph H. Thompson, and Harry M. Jacobs are prosecuting the case. Assistant U.S. Attorney Craig Baune is handling the seizure and forfeiture of assets.

  • MIL-OSI USA: Booker Joins Kaine, 36 Senators in Raising Alarm Over Trump Administration Chaos at Critical National Security Agencies

    WASHINGTON, D.C. – Today, U.S. Senator Cory Booker (D-NJ), a member of the Senate Foreign Relations Committee, joined a group of 37 Senators led by Tim Kaine (D-VA), in a letter to Secretary of State Marco Rubio expressing their deep concern regarding the growing chaos and dysfunction at the U.S. Department of State and the Trump Administration’s illegal attempt to destroy the U.S. Agency for International Development (USAID). USAID is a critical pillar of U.S. national security strategy, providing lifesaving aid and development support around the world to help ensure stability. Yesterday, personnel at USAID were not permitted to enter the agency’s headquarters, and Elon Musk announced that President Donald Trump agreed to close the agency and move it under the State Department – which Trump has no legal authority to do. The Trump Administration, led by Musk, has also furloughed thousands of senior career civil servants, including two top security officials who denied Musk and the Department of Government Efficiency access to classified documents and systems.

    “…We are deeply concerned by reports of not only growing chaos and dysfunction at the Department of State, but the Administration’s brazen and illegal attempts to destroy the U.S. Agency for International Development (USAID). Mass personnel furloughs of dubious legality and abrupt, blanket stop-work orders without regard to relevant appropriations laws are causing immediate harm to U.S. national security, placing U.S. citizens at risk, disrupting life-saving work and breaking the U.S. government’s contractual obligations to private sector partners,” wrote the Senators.

    The Senators continued, “The Administration’s failure to consult with Congress prior to taking these steps violates the law and impedes Congress’s constitutional duty to conduct oversight of funding, personnel and the nation’s foreign policy. The Administration’s failure to expend funds appropriated on a bipartisan basis by Congress would violate the Impoundment Control Act.”

    “Foreign assistance is critical to supporting U.S. strategic interests around the world. Foreign assistance protects U.S. national security, advances U.S. values, and ensures the U.S. is the partner of choice for everything from defense procurement to cutting edge scientific research. China, Russia and Iran are already moving rapidly to exploit the vacuum and instability left by the U.S.’s sudden global retreat,” wrote the Senators.

    They continued, “Every Administration has the right to review and adjust ongoing assistance programming. However, attempting to arbitrarily turn off core functions of a critical U.S. national security agency, without Congressional consideration or any metric-based review and absent legal authority to do so, is unprecedented and deeply disturbing.”

  • MIL-OSI United Kingdom: Southport perpetrator Prevent Learning Review

    Security Minister Dan Jarvis gave an update on the Prevent Learning Review – jointly commissioned with Counter Terrorism Policing following the Southport attack.

    With permission, Madam Deputy Speaker, I will make a statement updating the House on the government’s response to the Southport murders.

    The attack in Southport in July last year was one of the most appalling and barbaric crimes committed in this country.

    For young children and adults to be attacked in this way and 3 young girls killed is utterly heartbreaking. The Home Secretary and I would like to thank those people who showed great bravery in attempting to stop the attack.  

    For this foul act of violence to happen while children were enjoying themselves at a dance class at the beginning of the school holidays is beyond comprehension.

    Our thoughts and prayers are with the families of the 3 girls and all those injured as they continue to live with the trauma of that dark day.

    No one should have to go through what they have, and we are steadfast in our commitment to ensuring they get every possible support.

    Madam Deputy Speaker, responsibility for this abhorrent attack lies with the perpetrator. Axel Rudakubana has been sentenced to life imprisonment. He will serve a minimum of 52 years in prison.

    And Mr Justice Goose said it is highly likely that he will never be released.

    When the Home Secretary addressed the House on this case last month, she outlined the multiple interactions the perpetrator had with state bodies in the years before the attack. This included police, social services and mental health services.

    There are serious questions about how various agencies failed to identify and collectively act on the warning signs.

    All those questions must be answered – we owe that to the families, who deserve the truth about what went wrong.

    That is why the government is committed to understanding and addressing the failings in this tragic case through a comprehensive public inquiry.  

    It will examine the issues raised in this case but also wider challenges around rising youth violence.

    We are moving swiftly to set up the inquiry.

    We will consult the families to ensure all critical issues are addressed while remaining sensitive to the needs of those most affected. We expect to announce further details about the inquiry next month.

    While we do not pre-empt the conclusions of the inquiry, there are areas where action can and must be progressed immediately.

    Prevent is a vital part of our counter-terrorism system. We must endeavour to identify those susceptible to radicalisation early and before they go on to commit terrorist acts.

    Prevent receives nearly 7,000 referrals every year and our hard-working frontline staff have supported nearly 5000 people away from terrorism since 2015. We must get Prevent right.

    That is why the Home Office and Counter-Terrorism Policing commissioned a rapid Prevent learning review immediately after the attack.

    These are usually internal technical reviews intended to identify swift learning and improvement for Prevent.

    But the importance of the families needing answers has meant that, today, following close engagement with the families, we are taking the unusual step of publishing the Prevent Learning Review.

    And I can update the House that the perpetrator was referred to Prevent 3 times between December 2019, when he was aged 13, and April 2021, when he was 14. Those referrals were made by his schools.

    The first referral reported concerns about him carrying a knife and searching for school shootings on the internet. The second referral was focused on his online activity relating to Libya and Gaddafi. His third referral was for searching for London bombings, the IRA, and the Israel-Palestine conflict.

    On each of these occasions, the decision at the time was that the perpetrator should not progress to the Channel multi-agency process.

    But the Prevent Learning Review found that there was sufficient risk for the perpetrator to have been managed through Prevent.

    It found that the referral was closed prematurely and there was sufficient concern to keep the case active while further information was collected.

    The review is clear on the concerning behaviours that the perpetrator demonstrated. It highlights his interest in the Manchester Arena attack.

    That he talked about stabbing people.

    And it flagged that some of the grievances that could have been a motivation, were not fully considered.

    The review also highlights the perpetrator’s clear vulnerabilities and complex needs that may have made him more susceptible to being drawn into terrorism.

    The review concluded that:

    1. Too much focus was placed on the absence of a distinct ideology, to the detriment of considering the perpetrator’s susceptibility, grievances, and complex needs.
    2. There was an under-exploration of the significance of his repeat referrals and the cumulative risk, including his history of violence.
    3. There were potentially incomplete lines of enquiry.
    4. And that at the time, the perpetrator could have fallen into a Mixed, Unclear or Unstable category for Channel due to his potential interest in mass violence.

    Indeed, the overall conclusion of the review is that he should have been case-managed through the Channel multi-agency process, rather than closed to Prevent.

    This would have enabled co-ordinated multi-agency risk management and support.

    Madam Deputy Speaker, the Prevent Learning Review made 14 recommendations for improvements to Prevent.

    We have accepted these findings and rapid action has been taken to implement the recommendations.

    Counter Terrorism Policing have conducted in-depth assurance visits to every region to determine whether the issues identified in this case have been resolved by operational improvements made since 2021.

    Urgent work is underway to address the findings.

    The Prevent Assessment Framework was launched in September and is now in place across all regions. It was developed by experts and is being used to triage and risk-assess all Prevent referrals. It will improve decision-making at all stages of the Prevent system. Roll-out of this tool has been accompanied by rigorous mandatory training.

    We have begun an end-to-end review of Prevent thresholds to ensure Prevent can deal with the full range of threats we see today, from Islamist extremism, which is the most significant terrorist threat the UK faces, through to the fascination with mass violence we saw in the Southport case.

    This internal review will complete in April and further strengthen the approach to repeat referrals, and ensure that clear policy, guidance, and training is in place.

    We have completed the first stage of a policy review into how Prevent supports referrals who have mental ill-health or are neurodivergent.

    Actions for improving the operational approach have been identified and will be implemented swiftly, with oversight from the new Prevent Commissioner.

    We are also strengthening our approach to the oversight of referrals that do not meet Prevent thresholds, to make sure that people receive the right support.

    Next week, a pilot starts in several local areas to test new approaches to cases that are transferred to other services.

    And, of course, the government has appointed Lord Anderson as Interim Prevent Commissioner. This is the first time that Prevent will have a dedicated independent oversight, in its history and this will ensure Prevent is always held to the highest standards.

    His first task is to review the perpetrator’s Prevent history, drawing on the Prevent Learning Review. This will identify whether there is further learning, examine improvements made to Prevent since 2021, and identify any remaining gaps that require further improvement. 

    Lord Anderson will complete the review within his term as Interim Commissioner, which will end with the appointment of a permanent commissioner in the summer of this year.

    But it is simply not enough to focus only on this case. We need to take an even more robust approach to identifying learning swiftly and driving that learning through the Prevent system.

    The Prevent Commissioner will be tasked with overseeing a new approach to Prevent learning reviews that enables rapid debriefing and urgent action after incidents, but also provides a clear framework that binds other agencies into the joint learning process.

    Transparency and enabling public scrutiny is also fundamental.

    And that is why we will take steps to publish the findings of other independent Prevent learning reviews where there has been an incident of national significance.

    So, Madam Deputy Speaker, next week, we will publish the Prevent Learning Review into the appalling attack on Sir David Amess to enable further public scrutiny of this important programme.

    Madam Deputy Speaker, the first duty of government is to ensure the security of our country and the safety of our people, because nothing matters more.

    And while we can never undo the hurt and pain caused by this unthinkably wretched attack, we can, we must and we will do everything in our power to prevent further atrocities.

    As the Prime Minister said, Southport must be a line in the sand for Britain.

    If that means asking difficult questions about shortcomings or failures, so be it.

    If it means holding institutions and processes to account, we will do so without fear or favour.

    And if changes are required to protect the public and combat the threats that we face, then this government will not hesitate to act.

    I commend this statement to the House.

  • MIL-OSI Security: Attorney General Loretta E. Lynch Delivers Keynote Address on Counterterrorism and International Cooperation

    Thank you, Dr. [Robin] Niblett, for that kind introduction; for your leadership here at the Royal Institute of International Affairs; and for your lifetime of dedicated work in the service of international cooperation and global security.  I also want to thank Prime Minister [David] Cameron and the members of Her Majesty’s government for their hospitality during my visit to the United Kingdom.  And I’d like to thank this group of distinguished colleagues, inspiring leaders and devoted public servants for participating in this important conversation.  It’s a privilege to join you here today as we honor the unique bond between our nations; as we reaffirm the cherished values and ideals that we share; and as we rededicate ourselves to building the stronger, safer, and more united world for which we have fought together in the past, and toward which we continue to strive today.

    The United Kingdom and the United States have long been close partners and staunch allies and the connection between us – which Winston Churchill referred to as our “special relationship” – is one with deep roots and a rich history.  Almost all of America’s founders proudly considered themselves Englishmen and many were hesitant to shed that honorable title, even after the start of the American Revolution.  And the revolution itself – though it pitted us against one another in armed conflict – was inspired by the ideals of the British Enlightenment: responsive government, robust rights and liberties, and the fundamental equality of all people.      

    Those ideals have been a source of mutual understanding and shared strength ever since – and while they have been threatened by injustice within our nations and hostility from beyond our shores, they have continued not only to endure, but to expand.  Through the courageous struggles of prominent leaders and humble citizens; of freed slaves and former colonial subjects; of suffragists, ethnic minorities, religious dissenters and gay and lesbian advocates – we have extended the rights of liberty, equality and justice.  Through the tremendous courage and sacrifice of our countrymen –in two World Wars, in battlefields of Korea and today in the skies over Syria and Iraq– we have defended our beliefs against tyranny and oppression.  And together, we have come to the aid of others inspired by the principles that we share.

    Today, the values that have guided and defined us for centuries are facing a persistent threat: the rise of global terrorism and extremism – a scourge that has inflicted its pain on both of our nations in the recent past.  Ten years ago, this great city endured devastating attacks on its public transportation system, and you suffered another attack in the Underground only this week.  In the United States, as you know, we have also suffered terrorist attacks and we are currently investigating last week’s tragic shootings in California as an act of terror.  And as recent events in Paris, Beirut, and Mali remind us, we are far from alone in being targeted by these agents of violence.  These attacks are carried out with a single, repugnant purpose: to harm, frighten and intimidate anyone who believes in open and tolerant societies; in free and democratic governments; and in the right of every human being to live in peace, security and freedom.  As two nations who serve as beacons of those ideals to people around the world, we have a special responsibility to take on this terrorist threat, and to prevent it from causing the destruction it is so desperate to inflict.

    As Attorney General of the United States, my highest priorities are the security of our country and the safety of the American people.  At the Department of Justice, we are working tirelessly to uncover and disrupt plots that take aim not only at the United States, but at nations around the world.  We are acting aggressively to defuse threats as they emerge.  And we are vigorously investigating and prosecuting individuals who seek to harm innocent people.  To stop plots before they can be brought to fruition, we are going after individuals engaged in preparatory activities like fundraising, recruitment, planning and training.  Our approach has yielded important results: since 2013, we have charged more than 70 individuals for conduct related to foreign terrorist fighter interests and homegrown violent extremism and we continue to take action designed to monitor and thwart potential extremist activity. 

    But no nation can fight terrorism alone.  As our world continues to grow more interconnected and interdependent, cooperation and joint action are more essential than ever to combating cross-border threats like terrorism, cybercrime, corruption and human trafficking.  And while modern technology has helped to widen the circle of opportunity for so many citizens around the globe, it has also provided new channels that criminals can exploit for their own ends.  Online, violent ideologies can rapidly proliferate and spread and threats can leap borders and oceans in an instant.  No nation can exist in a bubble of isolation; no country can imagine themselves immune from world events; and the security of each state increasingly depends on the security of all states.  The words of four centuries past ring ever true today, “no man is an island entire of itself.”  In this environment, our strategic understanding and our common humanity demand that we supplement nationwide vigilance with international cooperation.

    That is why the United States is working with organizations like INTERPOL and EUROPOL to share information on foreign fighters.  It’s why we have provided resources, including FBI agents, to support INTERPOL’s Fusion Cell, which investigates the training, financing, methods and motives of terrorist groups around the world.  And it is why we have crafted information-sharing agreements with more than 45 international partners to identify and track suspected terrorists – a partnership that has now provided INTERPOL with approximately 4,000 profiles on foreign terrorist fighters.  From efforts to degrade terrorist capabilities, to building cooperative networks that help to preserve and share information and evidence after an attack, we are demonstrating our deep commitment to collaboration worldwide. 

    Let me give one example of how critical it is that we work together.  Terrorists, like other criminals, count on the difficulties that law enforcement agencies have in sharing information across borders – difficulties that are magnified now that electronic information may be stored in many different countries and may quickly disappear.  But starting some years ago, criminal justice experts from the U.S., the UK, France and the other G7 countries created the 24/7 cyber network – a rapid reaction system that now links approximately 70 countries.  Thanks to that system, after the recent horrific attacks in Paris, French investigators were able to work immediately with the U.S. Department of Justice and with U.S. Internet Service Providers, to preserve data from social media accounts and webpages identified as connected to the attacks, and to seek emergency disclosures to protect lives.  It is this kind of innovative thinking about international information sharing that we need to increase.

    Of course, it is also important to emphasize that our efforts to fight terrorism must always be compatible with safeguarding privacy and civil liberties – exactly as the 24/7 cyber system is designed to be.  Often, in conversations like this one, there is an implicit assumption that our safety must be balanced against our rights and our values; that there is a necessary trade-off between the hopeful optimism of our ideals and the cold reality of our national security.  But the view that we must abdicate our values to maintain our security presents a false choice.  Rather, our security exists to protect our values, because they are the wellspring of all that we are.  Progress within our nations has always been driven by our desire to live up to our ideals – of inclusiveness and opportunity, of equal rights and equal justice – and if we curb those rights in a misguided bid for short-term security, we betray not only our ancestors; not only ourselves; and not only our children – but all those for whom the United States and the United Kingdom represent the possibility of a better, freer future.

    In this regard, I am proud to say that the Obama Administration, with the support of Congress, has made the protection of civil liberties and privacy a priority in the fight against terrorism.  The record is a remarkable one: President Obama has created unprecedented transparency regarding our guidelines for collection and use of signals intelligence, including signals intelligence collected in bulk.  The President nominated and the senate has confirmed, an independent Privacy and Civil Liberties Oversight Board, as envisioned by Congress.  And just last week, independent public advocates were appointed to advise the Foreign Intelligence Surveillance Court, as called for by the USA Freedom Act.  

    Moreover, in all of these efforts, as President Obama has made clear, our goal is to extend privacy protections not only to U.S. citizens, but to foreign nationals as well.  That is why, after years of negotiation, I am very happy to say that we were able to initial in September the U.S./EU “Umbrella” Data Privacy and Protection Agreement regarding law enforcement information.  And it is why – in a truly unprecedented step – the Administration has supported legislation to extend judicial redress rights to foreign nationals for privacy breaches regarding law enforcement information – legislation that, thanks to strong Congressional support, already has passed our House of Representatives, and is now pending in the Senate.  

    These actions are not only unprecedented, but reflective of the United States’ deep commitment to the principles they protect, as well as the importance of our relationship with our European partners in this struggle.  That is why it is particularly disappointing that the European Court of Justice – in a case based on inaccurate and outdated media reports – recently struck down the Safe Harbor Agreement in the Schrems decision.  And it is highly concerning to us that data privacy legislation advancing in the European Parliament might further restrict transatlantic information sharing – a step that not only ignores the critical need for that information sharing to fight terrorism and transnational crime, but also overlooks the enormous steps forward that the Obama Administration and Congress have taken to protect privacy.  It is important that all of us – on both sides of the Atlantic – work to set the record straight regarding our commitment to protect not only the safety of our citizens, but also their civil liberties and privacy.

    But one thing I am confident of in our work on these issues and in the larger fight against terrorism – we will not lose ourselves to fear.  We will respond to this and other threats the way we know best – by reaffirming the very ideals that distinguish us from those who wish us harm: freedom of speech; religious tolerance; the open exchange of ideas; and government that represents the will of its people.  These are the principles of Runnymede and Philadelphia, of the Glorious Revolution and the American Revolution – the principles that we have risen to defend time and again and emerged victorious.  For centuries, these ideals have inspired countless men and women around the world to seek the better life that is the promise of humanity and to demand that the elemental dignity of all mankind be recognized and respected.  And we must keep their promise alive.  

    There is no doubt that we come together at a time of uncertainty, facing dangerous threats and determined adversaries.  But in this moment of global challenge, we remain dedicated to the task that remains before us and to the work that so many have given their last full measure of devotion to fulfill.  Our nations may have been bloodied, but we will remain unbowed – in defense of our citizens, in solidarity with our allies and in allegiance to the values that make us who we are. 

    The road ahead will not always be easy.  We will encounter more times of uncertainty and setbacks.  But as we move forward in the work that will secure our homelands and prove our principles once more, we are fortified with the strength of our time-tested traditions, by the partnership of our longstanding allies and by the legacies of the brave men and women who fought to make our nations everything they are today.  I am confident about the road ahead.  I know that our promise will endure.  And if we can lean on our faith in our enduring values – and hold fast to our unshakeable belief in the cause of justice and the rule of law – then I have no doubt that out of a long and difficult night of challenge, a brighter day will come.

    Remarks as prepared for delivery

    Thank you for that introduction, and for the opportunity to be a part of this important discussion. 

    As you all know, foreign governments and other non-state adversaries of the United States are engaged in an aggressive campaign to evade U.S. sanctions regimes and acquire sensitive U.S. technology.  In so doing, they threaten our economy, our prosperity and, most importantly, our national security.  Disrupting these national security threats is among the highest priorities of the Department of Justice, and the National Security Division. 

    But the responsibility of protecting our nation from these threats is a shared one.  Your clients – the companies you represent – and thus, you, have a critical role to play. 

    Because our companies have our nation’s crown jewels in their possession.  They house information targeted by thieves ranging from foreign powers bent on economic and military superiority, to individual criminals who know the market demand for this information, to terrorists who wish to create weapons of mass destruction. 

    Of course, companies have a responsibility to comply with the export control and sanctions regime.  We must also recognize that our companies are not immune from becoming unwitting victims of thieves and spies.  We live in an age where the threats we face are not limited to unlawful shipments and deliveries of goods.  Threats are also posed by insiders and through cyberspace.  Therefore, to protect what we value, our national assets, companies must learn how to comply with the law and how to protect themselves. 

    That is why it is good to see such a strong turnout.  Lawyers are on the front line helping clients adapt to an ever evolving export control regime.  Lawyers shape strategy – hardening collective defenses and counseling companies on best practices. 

    For example, sitting here today, you know to help your clients comply with export controls and sanctions.   Regimes designed to keep export controlled data and trade secrets out of the hands of rogue nations or terrorists.

    But have you had the chance to counsel those same clients when a cyber-hacker exfiltrated that information?  If you have not, unfortunately, it may only be a matter of time.  Cases involving the theft of export-controlled information via hacking are no longer uncommon. 

    Recently, we’ve brought cases where hackers targeted cleared U.S. defense contractors and stole massive amounts of sensitive data related to military technology, including export-controlled software.  These cases are not the first of their kind, and they will almost certainly not be the last.

    You have the power to help your clients protect themselves.  In a modern, interconnected world, there is quickly emerging a blending of practice areas.  Trade controls blends with data privacy, and export controls and sanctions trigger questions not only of compliance but of cybersecurity. 

    It is a fascinating time to be a practicing lawyer in this area, but one that brings with it grave responsibility. 

    Today, we’ll talk about a broad range of issues that go into being a modern export control practitioner. 

    National Security Division

    But first, I can explain a bit about the National Security Division of the Department of Justice. 

    The National Security Division was created in the wake of the September 11th terrorist attacks, in part in response to a specific recommendation from the WMD Commission.

    The Commission identified intelligence failures that contributed to the attacks.  It highlighted the danger of the so-called wall between foreign intelligence and law enforcement.  We needed to be able to connect the dots.  We needed to change.

    So in 2006, Congress created the National Security Division, creating the first new litigating division in the Department in almost half a century.  The National Security Division brings all of the department’s resources to bear.  We bring down the wall, uniting prosecutors and law enforcement officials with intelligence attorneys and the Intelligence Community.

    We are responsible for executing the highest priority of the Department of Justice – to protect this nation from the full range of national security threats we face.  We are proud to have this essential mission. 

    At the top of our priority list is protecting our nation from terrorist threats.  In recent days, you’ve heard everyone from the president to the attorney general and the director of the FBI speaking at length about the steps we are taking to combat that threat each and every day.

    Just yesterday, we arrested Jalil Ibn Ameer Aziz, 19, a U.S. citizen and resident of Harrisburg, Pennsylvania, on charges of conspiring to provide, and attempting to provide, material support to the Islamic State of Iraq and the Levant (ISIL).  Aziz is alleged to have served as an intermediary between ISIL supporters.  Passing location information, including maps and a phone number, to assist persons seeking to travel and travel to and wage jihad with ISIL.

    Although it may not seem so at first, fighting terrorism and preventing the illegal export of U.S. technology are interrelated goals.  Take the case of Feras Diri.  Diri is indicted in the very same district as Aziz.  We allege he was involved in a scheme to illegally export U.S. goods to Syria in violation of U.S. sanctions.  Some of these good were dual-use items.  It doesn’t take much to imagine the consequences of those items falling into the wrong hands once it reaches Syria. 

    One of the most significant national security threats we face, is the protection of our nation’s assets – including export controlled information, as well as other sensitive information that may be targeted by nation states and terrorists.  In so doing, we take an intelligence-driven, threat-based approach.

    We have an entire section devoted to this work – the Counterintelligence and Export Control Section, or simply CES.  We changed the name as part of a restructure to reflect the significance of export control and sanctions enforcement.  This year, CES also finalized a new Strategic Plan, setting forth an aggressive, comprehensive approach.  We know from experience that those seeking to do us harm will look for any available vulnerability to exploit.  They use all tools against us; it is our responsibility to do the same.  Our strategy is driven by the intelligence picture we see, which helps us prioritize and focus on the areas of most significant threat.

    Our Priorities and Our Regime

    Two of our highest priority areas involve China and WMDs.  Both are subject to export controls and regulations.

    Our economy profits from exports, and we support the flow of goods across borders.  But we must balance economic gain with the real threat to national security posed by certain technologies falling into the wrong hands. 

    That is why our export control regime is so important.  It is the best way to keep sensitive military and dual-use technologies, or even information that could be used in weapons of mass destruction, from ending up in the hands of terrorists and other adversaries.  They protect our innovation from being turned against us.

    With an ever-growing and evolving set of threats targeting our sensitive technologies and information, we must be vigilant. We must look at how transactions could make us more vulnerable, and do everything in our power to mitigate those vulnerabilities.

    Take China – despite a long-standing U.S. arms embargo, China continues to surge efforts to acquire advanced U.S. military technology.   China seeks U.S. persons with expertise to illegally provide services and know-how related to sensitive, export-controlled U.S. technology for military gain.  As an example, they targeted U.S. experts on jet engines to assist in developing Chinese-made engines.  If successful, our military edge over China is reduced; our country is put at greater risk.  Knowing what China seeks and why is essential to any sound export compliance and training program. 

    Iranian Sanctions

    Likewise, a high priority remains Iran.

    Earlier this year, the United States, Iran, the E.U. and five other nations reached a Joint Comprehensive Plan of Action (JCPOA). 

    The sanctions relief specified in the JCPOA does not go into effect until Implementation Day – which does not occur until after Iran has completed all necessary nuclear steps, as verified by the International Atomic Energy Agency.

    Even after Implementation Day, sanctions relief will not affect most laws and regulations enforced by the Department of Justice. 

    With few exceptions, U.S. or foreign persons involved in the export or re-export of U.S. goods or services to Iran remain subject to prosecution under the Iranian Transactions and Sanctions Regulations, as do U.S. persons involved in Iranian transactions.

    The only sanctions relief relates to:

    • the export, re-export, sale, lease or transfer to Iran of commercial passenger aircraft, parts and services for civil end-uses;
    • the import of Iranian-origin carpets and foodstuffs; and
    • certain transactions involving Iran by foreign entities owned or controlled by a U.S. person.

    Looking beyond the sanctions to other U.S. export regulations, the JCPOA will have no effect on the International Traffic in Arms Regulations (ITAR) and Export Administration Regulations (EAR).  Likewise, our commitment to prosecuting cases where defense articles on the U.S. Munitions List (USML), defense services and items subject to the EAR are exported to Iran remains as strong as ever.

    So as a practical matter, what does this mean?  Bottom line, companies and individuals, whether U.S. or foreign, need to remain vigilant when it comes to any possible commercial or financial interactions with Iran.  We will continue to investigate and, where appropriate, prosecute U.S. export control and sanctions cases involving Iran under our domestic authorities.  Because anything else is simply unacceptable. 

    The export control and sanctions regime in place exists to protect this nation from the proliferation threat.  From sensitive information and technology that could pose a grave danger in the wrong hands making its way to terrorists.  From our innovation being used to develop weapons of mass destruction or ballistic missiles. 

    Iran remains a designated state sponsor of terrorism, and we will not take our eye off of countering Iran’s efforts to support international terrorism and other destabilizing activities in the region.

    Corporate Misconduct

    U.S. companies – particularly in large international corporate structures, must understand this reality. 

    The risks – not only compliance-based risks, but security risks – must be front of mind, and we hope that as the lawyers who counsel, advise and represent these companies, you will talk frankly about them.  

    At the Department of Justice, we continue to prioritize corporate misconduct related to export control and sanctions violations.  The deputy attorney general issued guidance and directed changes to the U.S. Attorneys’ Manual to reflect the department’s sharpened focus in this area including on individual corporate defendants.

    To provide you clarity as you advise clients, we will provide guidance to make clear our current practices on voluntary self-disclosure of export and sanctions criminal violations.  We want to be transparent about our process and the factors we consider when assessing voluntary self-disclosures.  That way, the benefits for your clients are clear, and you can provide clear counsel.

    Because when a company voluntarily self-discloses export control and sanctions misconduct, fully cooperates and appropriately remediates, we will grant the company a significantly reduced penalty.  That can include a non-prosecution agreement (NPA), a reduced period of supervised compliance, a reduced fine and forfeiture and no requirement for a monitor. 

    If one or more aggravating factors are present to a substantial degree – like numerous willful shipments of defense articles to a foreign terrorist organization – a more stringent resolution might be necessary.  In all cases, however, the company that voluntary discloses will find itself in a better position one that does not.

    We are also discussing these issues with our regulatory partners to help you understand how the Department of Justice fits in to the broader regime.  The Department of Justice guidance we ultimately issue on VSDs will not supplant or supersede obligations to regulators.  Our ultimate goal is to be more transparent, so that companies will have more certainty about the benefits of self-disclosure are when dealing with prosecutors.  In the end, we think this is good for our national security mission and good for business.

    Voluntary self-disclosure is responsible.  But even if you choose not to pursue the route of voluntary self-disclosure and cooperation, your corporate clients need to remain vigilant or they may suffer serious consequences.

    Time and again, we have shown that willfully facilitating illegal transactions will not go unpunished. 

    Earlier this year, Schlumberger Oilfield Holdings Ltd. (SOHL), a wholly-owned subsidiary of Schlumberger Ltd., one of the largest oil and gas services companies in the world, pleaded guilty and agreed to pay a penalty of over $232 million for conspiring to violate the International Emergency Economic Powers Act (IEEPA) by willfully facilitating illegal transactions and engaging in trade with Iran and Sudan.

    What it ultimately came down to, was that one subsidiary failed to adequately train its employees to ensure that all U.S. persons, including non-U.S. citizens who resided in the United States, complied with Schlumberger Ltd.’s sanctions policies and compliance procedures. 

    We will not hesitate to prosecute individuals and entities that facilitate illegal transactions in violation of U.S. sanctions.     

    Vigilance is essential.  Policies and procedures are simply not enough.  They must be fully executed and reinforced.  Simply “checking the box” by implementing an export control and sanctions compliance program without the proper support or follow through will not insulate a company from prosecution.

    Another point to keep in mind is the need to know your markets and your people.  When you’re part of a large corporate family with many segments located overseas, some subject to very different export control laws in foreign countries, you have be careful to ensure that conduct illegal in the U.S. does not become practice here.  If you have doubts, check with your regulator.  Something a foreign national employee does overseas may have been entirely legal there, but once transferred here, is a crime.

    When working with your clients on these and other difficult issues, implore them to be vigilant.  These are complicated areas, and it takes sound advice and a high level of scrutiny to ensure compliance.  

    Insider Threats

    Unfortunately, compliance is only one piece of the puzzle.  Because, in addition to the compliance risks that are common in global operations, your corporate clients – and, in fact, even potentially their outside counsel –also are vulnerable to the threats from insiders and hackers. 

    Insider threats – threats from trusted employees and contractors – is now a significant problem.  And they are threat to national security when they steal sensitive export-controlled technology.

    For instance, Mozaffar Khazaee stole materials from each of three defense contractors who employed him, including materials relating to the F35 Joint Strike Fighter.  He attempted to illegally export a shipping container’s worth of those proprietary, export-controlled materials to Iran in order to gain employment there.  After pleading guilty, he received 97 months in prison. 

    Although that sentence sends a strong message to any insider who would consider violating the trust of his or her employer, deterrence alone is not enough. 

    So what can you do to address this problem?  Report incidents of suspected insider theft as soon as they are detected.  Create detailed internal training and compliance programs designed to neutralize threats before they even occur, and provide evidence of willful or knowing conduct in the event an insider is not deterred. 

    Cyber-Enabled Export Violations

    That helps with threats from within our perimeters.  But unfortunately, we also face them from outside our borders.  That is why another of our export control enforcement priorities is to combat cyber exfiltration of sensitive U.S. technologies, including ITAR-controlled technical data.

    In the digital age, foreign nations and their agents can now steal information, including export-controlled technical data and technology, without setting foot on American soil.  Left unchecked, cyber espionage can erode our strategic advantages across commercial and military spectrums.

    When possible, we will use investigations, arrests and prosecutions, to disrupt efforts to steal from you and your clients.  We will also look to use all other legally available tools to deter, like sanctions, designations, diplomacy and other tactics. 

    But your partnership is critical.  You can harden your defenses, create resilient systems, evaluate your cyber hygiene and cooperate with law enforcement when your defenses simply aren’t enough.

    That is why we at the National Security Division and others throughout the U.S. government, including the FBI, have made cooperation with the private sector a key component of our export control strategy. 

    Outreach

    We work with U.S. companies, across all industry sectors, to ensure that our national security interests are protected.  We have spent time and energy in face-to-face sit downs so that we may better understand the concerns and challenges faced by U.S. companies, share guidance and information, and be there to help with protection, detection, attribution and response.  We can warn our companies that manufacture or sell targeted U.S. parts and technology when certain bad actors are seeking the particular parts and technology they make.

    Corporate outreach helps sensitize industry to the threat and thereby maximizes the prevention of export control and sanctions violations.  We believe that through such efforts we can help stem the flow of those sensitive goods out of the U.S. to malicious end-users that would use them to threaten our national security interests and the safety of our warfighters. 

    It’s likely that many of you here today have clients that we’ve already met with recently to discuss these types of issues.  If you do not, we would certainly welcome the opportunity to do so in the future.

    Conclusion

    In conclusion, we recognize that our export control laws and sanctions regimes are complex and have a significant impact on the U.S. economy.  But they are there to protect against the many threats we face.

    And you play a critical role in that effort.  You and your clients can successfully negotiate the current export control and sanctions regimes and help keep America safe.

    Scrutinize closely each and every transaction undertaken with a foreign counterparty, whether a good or a financial transaction.

    Make sure that you understand the relevant compliance and sanctions regimes and how they apply.

    Make a voluntary self-disclosure to the National Security Division when you discover a willful violation of U.S. export control laws.

    Develop robust training and compliance programs.

    Focus not only on internal compliance, but on the threats posed by insiders and through cyberspace.

    Harden your cyber defenses.

    Develop a relationship with law enforcement, so that we may share valuable information with you to help you protect yourself, and be there to help you respond when your defense may simply not be enough.

    Profits may be the lifeblood of our corporations, but cutting corners here in the interest of the bottom line, is potentially catastrophic.  You and your clients risk enforcement actions, financial penalties and prison time.  But perhaps more significantly, doing so can provide a dangerous capability to an adversary who wishes to bring about damage, destruction or death to many.  So understanding and addressing how to comply with these regimes and neutralize these threats is not only the responsible thing to do, but the only thing to do. 

    The National Security Division will continue to approach export controls and sanctions with a broad and varied toolkit.  We will continue to vigorously pursue and prosecute those who violate our nation’s export control laws, but that is not how we define success.  Success is working with you to increase education and compliance and to prevent sensitive controlled technologies from falling into the wrong hands.  We will combat threats posed by insiders and through cyberspace.  And we will coordinate with our colleagues throughout the federal government to use an all tools approach – prosecution, listing, sanctions and other means of disruption – to combat national security threats.

    With the careful calibration of these tools and with an eye toward mitigating vulnerabilities and defending against threats, we can protect the national security while simultaneously fostering economic growth and job creation.

  • MIL-OSI USA: Member of Al-Qaeda in the Arabian Peninsula Sentenced to 44 Years in Prison for Terrorism Offenses

    Minh Quang Pham, also known as “Amim”, 41, was sentenced today to 44 years in prison and a lifetime of supervised release for attempted suicide bombing in alliance with al-Qaeda in the Arabian Peninsula (AQAP), a designated foreign terrorist organization.

    “The defendant was sentenced for an attempt to commit an act of terrorism and plotting a suicide bombing on behalf of AQAP,” said Devin DeBacker, head of the Justice Department’s National Security Division. “The Justice Department will not rest in seeking justice for acts of terrorism and will continue to thwart any attempt to jeopardize global security.”

    “Pham coordinated with known terrorist Anwar al-Aulaqi on a plot to conduct a suicide bombing at Heathrow International Airport which could have killed or injured many people, but fortunately that plan was stopped,” said Assistant Director David J. Scott of the FBI’s Counterterrorism Division. “Pham also tried to recruit others to commit acts of terrorism. The FBI will work with our partners to hold accountable those who align themselves with terrorist organizations and attempt to carry out acts of violence.”

    “Minh Quang Pham’s actions were not just an affront to the safety of this country, but to the principles of peace and security that we hold dear,” said U.S. Attorney Danielle R. Sassoon for the Southern District of New York. “Today’s sentencing underscores our collective resolve to stop terrorism before it occurs, and place would-be terrorists in prison.”

    According to court documents, in December 2010, Pham informed others that he planned to travel to Ireland while residing in London. From Ireland, he traveled to Yemen, the principal base of operations for AQAP. Pham traveled to Yemen in order to join AQAP, wage jihad on behalf of AQAP, and martyr himself for AQAP’s cause. After arriving in Yemen, he swore an oath of loyalty to AQAP in the presence of an AQAP commander.

    While in Yemen in 2010 and 2011, Pham provided assistance to and received training from Anwar al-Aulaqi, a U.S.-born senior leader of AQAP. Al-Aulaqi advised Pham to return to the U.K. for the purpose of finding and making contact with individuals who, like Pham, wanted to travel to Yemen to join AQAP. Al-Aulaqi also provided Pham with money, as well as a telephone number and e-mail address that Pham was to use to contact al-Aulaqi upon his return to the U.K. In addition, Pham exchanged his laptop computer with al-Aulaqi, who provided him with a new “clean” laptop to take with him when he returned to the U.K. so that the authorities would not find anything if they searched his computer.

    In or about June 2011, prior to his departure from Yemen, Pham approached al-Aulaqi about conducting a suicide attack whereby he would “sacrifice” himself on behalf of AQAP. Al-Aulaqi personally taught Pham how to create a lethal explosive device using household chemicals and directed Pham to detonate such an explosive device at the arrivals area of Heathrow International Airport following Pham’s return to the U.K. in 2011. Al-Aulaqi instructed Pham to carry an explosive in a concealed backpack and target the area where flights arrived from the U.S. or Israel. During this time, Pham made videos depicting his preparation to carry out that attack. In one video, Pham is shown wiring an electrical device for the use of making an explosive device. In another video, he sketches an explosive device to be contained in a backpack, and in a third, Pham wears a backpack with wiring for explosives on it, which he turns on in the video.

    During this time, around June or July 2011 — shortly before Pham returned from Yemen to the U.K. — Pham recorded a video in which he attempted to recruit and encourage individuals in the West to engage in violent jihad abroad or in their home countries. In this video, he also expresses a desire to martyr himself. At the outset of this video, consisting of an approximately 13-minute-long monologue, Pham states that, “America itself is not fighting a war with a group or an organization, they are fighting with the army of Allah, the believers.” He continues, in part, “We have that opportunity, that ability to be in their midst, in their land . . . and I advise the brothers inshallah to, whatever you can, to gather and prepare and strike the enemy in their own land . . . The saying, a thousand cuts, you hit them with as much as you can until inshallah the enemy will bleed to death.” During his time in Yemen, Pham also assisted with the preparation and dissemination of AQAP’s propaganda magazine, Inspire. Pham, who has college degrees in both graphic design and animation, worked directly with now-deceased U.S. citizen, Samir Khan, who was a prominent member of AQAP responsible for editing and publishing Inspire.  

    Pham also received a six-page document entitled “Your Instructions” from al-Aulaqi in Yemen, which provided detailed instructions on how Pham was to commit his suicide attack at Heathrow. The document from al-Aulaqi instructed Pham, “[d]o not do anything for the first three months” and “[y]ou should target Christmas/ New Year season[.]” The instructions from al-Aulaqi provided explicit direction about the importance of using shrapnel to kill as many people as possible, including that “[t]he proper use of shrapnel is as important as the main charge itself. The detonation wave from a main charge of AP by itself is most likely not going to cause the death of anyone except those who are in its immediate vicinity. It is the shrapnel that would do the job. You may imagine this IED as a shotgun that is firing in all directions.” The document therefore instructed Pham to take “special care” with the “proper arrangement and choice of shrapnel,” and to “poison” it to inflict maximum death.

    On July 27, 2011, Pham returned to the U.K. Upon his arrival at Heathrow, U.K. authorities detained Pham, searched him, and recovered various materials from him, including a live round of 7.62mm caliber armor-piercing ammunition, which is consistent with ammunition that is used in a Kalashnikov assault rifle, a type of weapon for which Pham received training from AQAP in Yemen. U.K. authorities released Pham and cautioned him for his possession of the live round of ammunition, before, in December 2011, arresting him pursuant to their authorities under U.K. immigration law. In searches of Pham’s residence, other locations, and vehicles, U.K. authorities recovered several pieces of electronic media. Among other things, a forensic analysis of Pham’s electronic media showed that he was accessing speeches and writings of al-Aulaqi as late as December 2011 — months after Pham’s return to the U.K.

    On May 24, 2012, a grand jury returned an indictment charging Pham with terrorism offenses and U.S. authorities sought Pham’s extradition from the U.K. He was provisionally arrested with a view towards extradition on June 29, 2012, and he was extradited to the United States on Feb. 26, 2015. On Jan. 8, 2016, Pham pleaded guilty to terrorism offenses related to certain of the same underlying conduct. On May 27, 2016, Pham was sentenced by U.S. District Judge Alison J. Nathan principally to a term of 40 years in prison. On Sept. 12, 2017, the U.S. Court of Appeals for the Second Circuit affirmed Pham’s conviction and sentence. Thereafter, Pham made a motion that, based on intervening Supreme Court decisions, resulted in the vacatur of one of the counts of his conviction. Ultimately, the government, with Pham’s consent, moved to vacate Pham’s earlier convictions. On April 8, 2021, a grand jury returned a superseding indictment, reinstating certain charges and filing other new charges against Pham, and which formed the basis for Pham’s May 11, 2023, guilty plea and conviction.

    The FBI Washington and New York Field Offices investigated the case. The Justice Department’s Office of International Affairs, Metropolitan Police Service/SO 15 Counter Terrorism Command at New Scotland Yard, Crown Prosecution Service, and the Home Office provided assistance in the investigation, extradition, and prosecution of the case.

    Assistant U.S. Attorney Jacob H. Gutwillig for the Southern District of New York and Trial Attorney John Cella of the National Security Division’s Counterterrorism Section prosecuted the case.

  • MIL-OSI Security: Principal Deputy Associate Attorney General Bill Baer Delivers Remarks Highlighting Elder Justice at the State Of Financial Fraud in America Event

    Thank you Robert for that kind introduction and for your leadership and dedication as CEO of Financial Industry Regulatory Authority (FINRA).  And thank you to the Stanford Center on Longevity and the FINRA Investor Education Foundation, for hosting this conference and for the great work that you do.  It is an honor to join with the many people in this audience who dedicate their lives to combatting financial fraud and protecting elderly Americans.  This is a noble and enduring effort.   

    As many people here know, financial fraud targeted at the elderly is a serious problem.  At the beginning of 2011, the first Baby Boomers reached the age of 65.  I reached that milestone myself just last year.  Indeed, 10,000 Americans turn 65 every day, and the percentage of Americas over 65 is growing.  5.8 percent of this group experiences identity theft in a given year.  I had that ugly experience just last month. 13.8 percent experiences consumer fraud in a given year.  4.5 percent of people over 50 experience financial fraud in a five-year period.  While there are varying accounts about how much the overall financial loss is, it is well into the billions of dollars.  

    Statistics aside, we are here together because we know all too well that this is a problem that takes a personal toll.  Almost all of us know someone who has been the victim of financial fraud.  And while it affects people of all ages, it can be especially devastating for elderly people, many of whom are dependent on their savings and are concerned about their own mental decline or other people’s perception of their mental decline.  

    I recently saw letters written by the victims of a set of schemes that we took action against.  One described having sent “hundreds of checks” for a company’s “great offers” and tried to explain to the fraudster that “due to bad eyes, [he] has to use magnifying glasses to read” and had “been caught paying many times for th[e] very same offer.”  Another, believing that the con men would send him a promised gift, tried to explain that he had sent his prior payments by money order and was now enclosing cash, “all [he] can send.”  Another explained that when she gets the vast inheritance she’d been promised, she would use it to help her family, the homeless and needy children.   

    The nature and scope of elder fraud varies tremendously.  At the Department of Justice, we see small, family based schemes, such as caregivers tricking elderly victims out of their savings or abusing powers of attorney.  We see institutional schemes, such as nursing homes that provide unnecessary services or bill for services never provided.  And we see global fraud networks that are—quite literally—organized crime.  These schemes involve networks of businesses with careful divisions of labor.  They target millions of Americans, maintain lists of victims, and, once someone has been duped, target those people again and again. One recent victim wrote a letter explaining: “Each day I keep getting more and more offers and it’s almost impossible for me to keep up with them.” 

    Large and diverse problems like this require broad based solutions.  We at the Department of Justice know we can’t solve this problem alone.  Coordination is essential not only with our federal partners, but with local, state and international authorities.  And public and private partnerships are key to our understanding of the scope of the problem and to the lasting success of any solution.

    Research into basic questions, such as why are elderly people vulnerable, and how can we detect fraud and abuse, is critical to attacking the problem.  The FINRA Foundation and Stanford Center on Longevity launched the Financial Fraud Research Center five years ago.  As some of your ongoing research has demonstrated, there is a natural decline in cognition as people age, especially ability to think fast and process new information.  The elderly are sometimes lonely or otherwise socially isolated. Some are uncomfortable with technology.  Many have pools of relatively liquid retirement assets.  Some are dependent on caregivers.  All of these factors make the elderly particularly susceptible to certain schemes. 

    There is much more to learn.  The Department of Justice has invested in partnerships to help us all better understand the causes and risk factors associated with elder financial exploitation.  For example, just a few weeks ago, we announced an award of nearly $800,000 to the Urban Institute and the University of Southern California to develop and test prevention programs that will address elder abuse, neglect and financial exploitation.  To enhance our understanding of financial exploitation by conservators and guardians, last year our Office for Victims of Crime funded a project to search for innovative, evidence-based programs and practices that successfully detect and remedy conservator fraud.  And people like you are furthering our understanding.  This conference is highlighting emerging research on susceptibility to fraud and fraud prevention.

    Beyond efforts to understand how and why elder fraud occurs, continuing dedication to enforcement is required to stop it.   This is not a partisan issue.  We have seen Democratic and Republican administrations alike express a shared commitment to using all tools in the Department of Justice’s enforcement arsenal.  Back in the 1990s, under Attorney General Reno, the Department of Justice created the Elder Justice Initiative to centralize information, facilitate training, and coordinate within the Department and across the federal government.  During the Bush Administration, the Department of Justice initiated an elder mistreatment research grant program, funding cutting edge research on elder abuse and financial exploitation that continues today.

    During this Administration, Congress created the Elder Justice Coordinating Council as part of the Affordable Care Act to facilitate interagency cooperation at the highest of levels.  At the Department of Justice, we formed the Attorney General’s Advisory Committee’s Elder Justice Working Group, which is comprised of U.S. Attorneys from across the country who are dedicated to improving our information sharing on financial scams targeting the elderly.  And just this year, we created ten regional Elder Justice Task Forces that operate throughout the country, partnering with state and local law enforcement and prosecutors to enhance our collective response to elder financial fraud and abuse. 

    Our Elder Justice Initiative has also been assisting with community capacity building.  This includes supporting the training of local law enforcement and prosecutors.  And to enhance civil legal aid to seniors, in June 2016, the Department of Justice, in collaboration with the Corporation for National and Community Service, launched the Elder Justice AmeriCorps, the first-ever army of lawyers and paralegals to help elderly victims of abuse and exploitation.  The program will support 300 AmeriCorps members throughout the country and is expected to reach over 8,000 older adults over the next two years.

    A multi-faceted problem requires coordination between different federal agencies; it demands a whole of government approach.  Mail is involved; we must coordinate with the Postal Inspection Service.  Money is involved; we must coordinate with the Treasury Department.  People target the elderly; we must coordinate with agencies that serve the elderly, such as the Social Security Administration.  

    And more and more, we are seeing schemes that are highly complex and global.  Stopping these schemes require extensive cooperation—not just with state and local authorities, but also across the federal government and with our international counterparts.  For example, the Department of Justice’s Consumer Protection Branch co-chairs the International Mass-Marketing Fraud Working Group, a network of civil and criminal law enforcement agencies from Australia, Belgium, Canada, Europol, the Netherlands, Nigeria, Norway, Spain, the United Kingdom and the United States.  

    We can point to meaningful progress.  In the past several years, we have successfully shut down several international lottery scams where con men and women have contacted elderly victims in the United States, told the victims they won cash and prizes, and persuaded them to send thousands of dollars in fees to release the money.  Of course, the victims never received cash or prizes in return.  In a series of cases, perpetrators made calls from Jamaica using Voice Over Internet Protocol technology that made it appear as if the calls were coming from the United States.  They convinced victims to send money to middlemen in South Florida and North Carolina, who forwarded the money to Jamaica.  We have had great success breaking up these networks through joint efforts between Jamaican law enforcement and U.S. agencies including the Postal Inspection Service, Department of Homeland Security, U.S. Marshals Service, Federal Trade Commission and Internal Revenue Service.  Since 2009, the Department of Justice has prosecuted or is prosecuting over 100 individuals linked to such lottery schemes, and has convicted and sentenced over 40 defendants.

    We have had similar success going after global “psychic schemes.”  Con men and women send letters purportedly written by “world-renowned psychics” stating that they had a vision revealing that the recipient has the opportunity to obtain great wealth.  The letters appear personalized, refer to the recipient by name, and often contain portions that appear handwritten.  The solicitations urge victims to purchase products and services that will ensure this good fortune.  Investigations by the Department of Justice and Postal Inspection Service, among others, revealed the complexity of these schemes.  Not only were there the fraudsters themselves, but there were separate companies performing different roles, such as processing victim payments and maintaining databases of consumers who responded to solicitations.  In a two-week period, one company in the United States processed as much as $500,000 in payments for just one psychic scheme.  We have discovered similar companies in Quebec, Hong Kong, Switzerland and France.  

    Perhaps the most significant example of cooperation to date were our wide-ranging enforcement actions taken in September of this year to dismantle a global network of mass mailing schemes targeting elderly and vulnerable victims.  The schemes involved a network with components in Canada, France, India, the Netherlands, Singapore, Switzerland, Turkey and the United States.   The network included an India-based printer that manufactured solicitations and arranged for bulk shipment to U.S. victims; a mailer in Switzerland; list brokers in the United States who bought and sold lists of victims so that once victims had fallen prey, others could target them; a “caging” service in the Netherlands that collected money; and a Canadian payment processor that, for more than 20 years, helped dozens of international fraudsters gain access to U.S. banks and take money from Americans.  Stopping this network involved coordination between the Department of Justice, Department of Treasury, Postal Inspection Service, Federal Trade Commission, Iowa Attorney General’s office and counterparts in other countries.  Just to give you a sample of the coordinated actions, on Sept. 22, 2016: 

    • The Treasury Department’s Office of Foreign Assets Control blocked assets from the Canadian payment processor and a network of individuals and entities across 18 countries.
    • The Justice Department filed criminal charges and a civil injunction against a Turkish mass mailer. 
    • The Justice Department brought a series of civil actions to shut down companies based in the United States, India, Switzerland and Singapore.  These companies were responsible for mailing millions of multi-piece solicitations to potential victims throughout the United States.  
    • The Justice Department entered into a consent decree with two Dutch “caging” businesses that collected and forward money.  Our efforts were coordinated with Dutch authorities who executed search warrants on the businesses and took control of the Dutch post office boxes used to receive victims’ funds.   
    • The Federal Trade Commission filed a case against a related mass-mailer, printer, and list broker.  
    • The Iowa Attorney General negotiated a compliance agreement with two firms that brokered victim lists.

    Of course, what matters even more than going after these schemes is preventing people from falling prey in the first place.  Here too, federal agencies are working in cooperation and dedicated to the effort.   The Department of Justice has distributed educational materials about these kinds of scams, the U.S. Postal Inspection Service has developed an electronic press kit for media outlets, my former colleagues at the Federal Trade Commission operate a “Pass It On” campaign that encourages people to share information about frauds that affect older Americans, the Social Security Administration is educating beneficiaries through its network of over 1,200 field offices nationwide, and the Consumer Financial Protection Bureau has produced a mail fraud alert placemat in coordination with Meals on Wheels America to distribute to seniors nationwide.  Similarly, private organizations that work in the area of elder justice and consumer protection are doing their part.  For example, AARP will be posting information through its Fraud Watch Network.  And the Consumers Union, the policy arm of Consumer Reports, is alerting consumers about a variety of elder scams.  

    Going forward, the Department of Justice will continue to work with private, local, state, federal and global partners.   And we urge all of you to tell us where the Department can do more.  The federal government’s work on behalf of the elderly began long before this Administration, and it will continue long after.  I expect that my successors, and my successors’ successors, will share our commitment to making sure our parents, grandparents and friends age with grace and dignity.  And I look forward to all of you, who have worked so hard in this area, working with the next Administration to combat financial fraud and protect elderly Americans.  Thank you again for having me here today.

  • MIL-OSI United Nations: New Permanent Representative of Austria Presents Credentials

    The new Permanent Representative of Austria to the United Nations, Gregor W. Koessler, presented his credentials to UN Secretary-General António Guterres today.

    Between 2020 and his most recent appointment, Mr. Koessler served as Director-General for Bilateral Affairs and European Union Common Foreign Policy in his country’s Ministry of European and International Affairs. He was the Director of the Austrian Foreign Minister’s Cabinet from 2019 to 2020.

    Prior to that, he was his country’s Ambassador to the Kingdom of Saudi Arabia, and Non-resident Ambassador to the Sultanate of Oman and the Republic of Yemen from 2012 to 2019.  From 2009 to 2012, he was Head of the Directorate for Property Management in his country’s Ministry of European and Foreign Affairs, and from 2007 to 2008, he was Head of Cabinet for the State Secretary in that Ministry.

    His other roles included Head of Cabinet for the Special Coordinator of the Stability Pact for South-Eastern Europe from 2002 to 2007 and Director of Cabinet for the High Representative for Bosnia and Herzegovina from 1999 to 2002.

    Mr. Koessler holds master’s degrees in contemporary history and philosophy from the Leopold Franzens University of Innsbruck, Austria, and in international economics and conflict management from the Johns Hopkins University, United States.

  • MIL-OSI Security: Deputy Attorney General Rod Rosenstein Delivers Remarks at the Interpol 87th General Assembly

    It is a privilege to join you at this 87th INTERPOL General Assembly.  I am grateful to the United Arab Emirates for hosting our conference. Thank you President Kim Jong Yang for your exceptional leadership and for providing stability to INTERPOL.  

    Our theme this year is innovation.  Many digital innovations affect law enforcement, from the rise of cybercrime, to the increasing importance of electronic evidence, to encryption and the dark net. 

    In addressing these innovations, we must respect the primary value that is constant in our work: the rule of law.  Law provides the framework for civilized people to conduct their lives.  At its best, law reflects moral choices; principled decisions that promote the best interests of society, and protect the fundamental rights of citizens. 

     The term “rule of law” describes the government’s obligation to follow neutral principles and fair processes. The ideal dates at least to the time of Greek philosopher Aristotle, who wrote, “It is more proper that law should govern than any one of the citizens: upon the same principle, if it is advantageous to place the supreme power in some particular persons, they should be appointed to be only guardians, and the servants of the law.”

    The rule of law is indispensable to a thriving and vibrant society.  It shields citizens from government overreach.  It allows businesses to invest with confidence.  It gives innovators protection for their discoveries.  It keeps people safe from dangerous criminals.  And it allows us to resolve differences peacefully through reason and logic.

    When we follow the rule of law, it does not always yield the outcome that we prefer. In fact, one indicator that we are following the law is when we respect a result although we do not agree with it. We respect it because it is required by an objective analysis of the facts and a rational application of the rules.

    The rule of law is not simply about words written on paper.  The culture of a society and the character of the people who enforce the law determine whether the rule of law endures.

    Since we met last year in Beijing, the news media has reported several prominent challenges to the rule of law, including the lawless attacks on Sergei and Yulia Skripal and Jamal Khashoggi.  Last month, international attention focused on INTERPOL, as a result of the disappearance of President Meng Hongwei.  Such events give rise to questions about whether our member countries abide by shared principles.  In evaluating our actions at this General Assembly, observers may ask whether our votes reflect the values that we profess. We must stand for the rule of law.  

    INTERPOL exists to promote international police coordination and discourage departures from the law. We represent diverse forms of government. But if we serve with integrity, each of us functions as a trustee for our fellow citizens.

    When our successors look back on how we dealt with the issues of our era, they will ask whether we honored our fiduciary duties.

    First, did we develop the knowledge to understand our challenges?

    Second, did we inculcate the wisdom to solve them?

    Third, did we demonstrate the courage to defend our principles?

    Fourth, did we maintain the resolve to achieve our goals?

    I traveled here to speak about INTERPOL’s role in responding to the major innovation of our lives: the rise of a cyber-connected world. 

    The Internet holds immeasurable promise as a repository of ideas, and as a forum for speech and commerce.  It connects citizens across cultures and countries.  It is accessible to the rich and the poor, the powerful and the powerless.  It creates efficiencies and innovations that immensely improve our lives.

    But like every innovation that offers opportunities for good, the Internet also can be exploited by wrongdoers. Today, there is a growing divergence between the Internet as it is, and the Internet as it could be.

    Malicious actors use the Internet for evil ends.  Cyber criminals employ modern technologies to damage information systems, steal data, commit fraud, violate privacy, attack critical infrastructure, and sexually exploit children. They also launch misleading schemes to influence people’s opinions, seeking to foment division and disrupt democratic processes.

    The Internet enables attacks on businesses, government agencies, and individual citizens that cause damage costing billions of dollars.  And new technologies allow criminals to conceal themselves, which frustrates law enforcement’s efforts to keep honest citizens safe. 

    We must acknowledge the divergence between the Internet in theory and the Internet in practice. Closing that gap will ensure the viability of an open Internet governed by the rule of law.

    Enforcing the law on the Internet requires rapid and accurate detection of criminal activity; cooperation among law enforcers from different nations; prosecution of accused criminals in judicial systems that provide due process of law; and just punishment of guilty offenders.  It means not tolerating virtual online locations where crime is unchallenged.  It means not condoning physical safe havens for cyber criminals.

    Detecting, disrupting, deterring, and prosecuting malicious cyber activity are among our highest law enforcement priorities in the United States.  The cyber threats we face are varied and evolving, and our resolve to keep our people safe must extend to every corner of the Internet.

    My office recently issued a comprehensive report about our work to combat cybercrime.  It describes the global challenges posed by cyber-enabled crime.  It explains how hostile cyber actors damage computer systems, steal data, engage in cyber fraud, violate personal privacy, infiltrate critical infrastructure, and pursue malign foreign influence operations.  The report also details our efforts to detect and disrupt those threats, and our commitment to inform citizens about the dangers.

    The perceived anonymity of the Internet attracts many criminals, including terrorists and those trafficking in child pornography, illicit weapons, illegal and deadly drugs, murder-for-hire, malware, and stolen identities.  The barriers to entry are low.  Criminal opportunities are on offer for anyone with an Internet browser and an inclination to break the law.  

    Yet our police agencies repeatedly demonstrate that with the support of international partners, we can find and dismantle malign internet operations.  We identify anonymous users who commit illegal activity, seize their infrastructure and proceeds, and pursue criminal charges against them.  Criminals operating on the dark web should be on notice that our investigative tools allow us to expose them.

    We must not allow cybercriminals to hide behind cryptocurrencies.  Virtual currencies have some legitimate uses.  But bad actors are using them to fund crimes and to hide illicit proceeds.  For example, Bitcoin was the exclusive method of payment for the WannaCry ransomware attack that spread around the globe, causing billions of dollars in losses. 

    In addition, fraudsters use the lure of coin offerings and the promise of new currencies to bilk unsuspecting investors, promote scams, and engage in market manipulation.  The challenges of regulating, seizing, and tracing virtual currencies demand a multinational response.  We must work together to make clear that the rule of law can reach the entire blockchain.

    To that end, last year, prosecutors in the United States announced the indictment of Alexander Vinnick and the virtual currency exchange he allegedly operated. That exchange received more than $4 billion of virtual currency. It was designed without any means to control money laundering, so predictably it served as a hub for international criminals seeking to hide and launder ill-gotten gains. 

    We filed criminal charges and assessed a $110 million civil penalty against the exchange for willfully violating our anti-money laundering laws, as well as a $12 million penalty against Vinnick.

    To prevent virtual currency from being abused by criminals, terrorist financiers, or sanctions evaders, all of us must implement policies that mitigate the risks posed by the new technology.  My country includes virtual currencies in our anti-money laundering regulations.  And the Financial Action Task Force urges all nations to make clear that global anti-money laundering standards apply to virtual currency products and service providers. We must guard against abuses of digital currency.

    We also need to protect against abuses of encrypted communications.  Encryption can be useful in the fight against cybercrime.  Encrypting data makes it more safe and secure.  But the proliferation of warrant-proof encryption also poses a challenge to effective law enforcement. 

    Encryption technologies designed to be impervious to legal process impede our ability to access investigative data.  In September, the chief law enforcement officials of the United States, the United Kingdom, Canada, Australia, and New Zealand joined together to issue a “Statement of Principles on Access to Evidence and Encryption.”

    While acknowledging the benefits of encryption, they called for urgent, sustained attention and informed discussion about the increasing difficulty law enforcement agencies face in accessing evidence of criminal conduct.

    We will continue to work closely with technology companies to establish responsible practices that consider both privacy concerns and public safety imperatives.

    On the Internet, data is decentralized, information flows across continents, and online activities are dispersed across global networks. Cybercrime knows no borders.  As a result, international cooperation is indispensable.  INTERPOL is central to that cooperation.

    We must ensure that appropriate criminal laws are enforced.  Each of us must do our part to bring malicious actors to justice.  We rely on international partners to locate, arrest, and extradite cybercriminals so that they may be held accountable.  Cybercriminals should find no safe haven, either on the dark web or within national borders.

    In the United States, we continue to faithfully discharge our responsibility to extradite fugitives. In the last five years, we extradited 95 Americans, honoring inquiries whenever the requesting state presents sufficient evidence of criminality.

    For example, last year the United States sent Shawn Gregory Towner to Ireland.  Towner was arrested in Ireland in 2006 after authorities found him watching images of child sexual abuse on his laptop in Dublin, but he fled to the United States after being released on bail.  My country located Towner and sent him to Ireland to stand trial. 

    We process extraditions without regard to the nationality of the offender. 

    But that cooperation must be reciprocated.

    International cooperation was essential to our successful dismantlement of the Kelihos botnet, a global network of tens of thousands of infected computers.  Criminals used the network to harvest login credentials, distribute hundreds of millions of spam e-mails, and install ransomware and other malicious software. 

    In 2017, prosecutors obtained judicial orders authorizing law enforcement to neutralize the botnet by seizing control of malicious domains and redirecting traffic to servers we controlled. 

    Disabling the botnet was only part of the equation. The criminals responsible for creating and administering the botnet also should be held accountable. American prosecutors charged Peter Levashov of St. Petersburg, Russia for multiple offenses stemming from his control and operation of the Kelihos botnet.  Levashov is a cybercriminal who operated multiple botnets with impunity for nearly two decades. 

    Spanish authorities arrested Levashov and extradited him to the United States. In September, Levashov was found guilty in a fair and public judicial proceeding.

    Levashov’s extradition represented effective coordination with our foreign partners.  Unfortunately, not every case is a success story.  In some instances, nations shield their citizens from the rule of law with schemes that waste resources, cause needless delay, thwart investigative efforts, and undermine justice. 

    Consider the prosecution of accused hacker Aleksey Belan.  Belan is a Russian national who was indicted in the United States for massive computer breaches on American companies.  After the United States issued an arrest warrant, Belan was reportedly arrested in 2013.  But he was permitted to return to Russia. 

    A second indictment alleges that in 2014, after Belan returned to Russia, Russian intelligence agents recruited him to carry out one of the largest data breaches in history, stealing information from more than 500 million individual email accounts of people around the world. 

    The rule of law suffers when cybercriminals are given safe havens.  The United States will continue to promote the rule of law by identifying, exposing, and seeking to extradite perpetrators who harm innocent people.  And we will continue to support legitimate investigations and prosecutions conducted by our INTERPOL partners. 

    At the same time, we will expose schemes to manipulate the extradition process.  We will identify nations that routinely block the fair administration of justice and fail to act in good faith, with a sincere commitment to holding criminals accountable.

    As cyber threats grow in scale and sophistication, we increasingly need to search throughout the world for evidence, witnesses, and defendants.  Our responses must be as innovative as the criminal activity. We depend on expeditious international cooperation and coordination in dismantling malicious criminal operations. 

    Child exploitation cases provide a useful model for international coordination.  INTERPOL’s International Child Sexual Exploitation image and video database uses image and video comparison software to identify and locate child sexual exploitation victims and their abusers.  The database has led to the arrest of nearly 6,300 offenders. Recently, it helped authorities rescue five victims in Spain.  That is a superb example of innovative law enforcement.

    In my country, we play a leading role by identifying cases in which child exploitation materials are generated from or hosted in other countries.  Then we disseminate the information to the appropriate INTERPOL member countries. Our partners often request follow-up information to assist in their own investigations. Last year, almost nine million investigative leads were distributed through this program, resulting in many arrests and prosecutions. 

    Children around the world are safer when our law enforcement agencies work together – quickly, and with methods like those pioneered by INTERPOL.

    Finally, I am proud that the United States takes seriously our responsibility to help secure evidence that our international partners need for their investigations.  We receive thousands of requests for mutual legal assistance each year, and we do all that we can to comply.  We employ expert attorneys and staff dedicated to assisting with foreign requests for electronic evidence.  We devote additional resources when necessary to meet your needs.

    We call upon each of you to do the same.  By devoting appropriate resources to international cooperation efforts, we can properly address the increasing threat of cybercrime.

    My country recently enacted a new law to remove legal impediments to compliance with foreign court orders in cases that involve serious crimes.  The legislation demonstrates our commitment to the vision of the Budapest Convention on Cybercrime, the primary treaty for harmonizing national interests and enhancing international cooperation against cybercrime.  Sixty-one nations have fully ratified the treaty, agreeing that national laws should include authority to compel providers to disclose data they control, even when it is held elsewhere. 

    New cyber conventions are sometimes proposed that would limit the free flow of information between nations. But that would dangerously impede efforts to investigate cybercrime. It would protect criminals and allow cyber threats to proliferate and grow in scale and sophistication.  That is untenable in a world in which criminals using computers shielded by layers of anonymity can harm innocent victims in any one of our nations, anywhere in the world. Such limitations would be a step backward, not an innovative law enforcement approach.

    No nation should exempt itself from just and reasonable law enforcement cooperation. No nation will be more prosperous, more secure, or more respected because it supports cybercriminals. 

    My fellow delegates, there is a parable about three stonecutters asked to describe what they are doing.  They answer in varying ways. The first stonecutter focuses on how the job benefits him. He says, “I am earning a living.” The second man narrowly describes his personal task: “I am cutting stone.” The third man has a very different perspective. Instead of focusing solely on his work, he explains what it means to others: “I am helping these stonecutters build a shrine.”

    Similarly, each of us helps to construct a legacy. INTERPOL delegates should always support leaders and policies that promote international police coordination and preserve the rule of law – in practice, and not just in theory. We must uphold the rule of law, so it will be there for us when we need it.

  • MIL-OSI Security: Deputy Attorney General Rod J. Rosenstein Delivers Remarks at the “SamSam” Ransomware Press Conference

    Good morning. I am joined by Criminal Division Assistant Attorney General Brian Benczkowski, New Jersey U.S. Attorney Craig Carpenito, and FBI Executive Assistant Director Amy Hess.

    Also on stage are the two prosecutors handling this matter: Assistant U.S. Attorney Justin Herring, and Computer Crimes and Intellectual Property Section Senior Counsel William Hall Jr.

    A federal grand jury in New Jersey indicted two Iranian citizens for a three-year scheme that involved hacking into computers of hospitals, municipalities, public institutions, and businesses. It involved a high-tech, sophisticated extortion plot.

    The defendants allegedly hijacked victims’ computer systems and shut them down until the victims paid a “ransom.”

    The conspirators collected more than $6 million in extortion payments and caused more than $30 million in losses.

    Many of the victims were public agencies with missions that involve saving lives and performing other critical functions for the American people. 

    The indictment was returned on November 26, and unsealed today in Newark, New Jersey. It alleges that Faramarz Shahi Savandi and Mohammad Mehdi Shah Mansouri used sophisticated software to execute their computer hacking and extortion scheme.

    Acting from inside Iran, the men developed and deployed a form of ransomware that they named “SamSam.”  Ransomware is a destructive computer code that encrypts victims’ computers and then holds the computers “hostage” until a “ransom” fee is paid.

    Starting in January 2016, the defendants gained access to victims’ computers by exploiting cyber security weaknesses.  After gaining access to the computers, they remotely installed ransomware.  The ransomware encrypted computer data, crippling the ability of the victims to operate their businesses and provide critical services to the public. 

    The victims included two major municipalities – the City of Atlanta, Georgia and the City of Newark, New Jersey.  The defendants also sought to interrupt critical transportation infrastructure by infiltrating the Port of San Diego, California, and the Colorado Department of Transportation. 

    In addition, the defendants infected the computers of six health-care related entities from across the country, impairing the ability of these businesses to provide health care to sick and injured people. 

    The defendants chose to focus their scheme on public entities, hospitals, and municipalities.  They knew that shutting down those computer systems could cause significant harm to innocent victims.

    The indictment alleges that the defendants demanded payment from their victims in the form of the virtual currency known as Bitcoin.  Bitcoin contributes to the increasing sophistication of criminal schemes.  It is a common currency for criminal schemes, including websites that distribute child pornography and deadly opioid drugs, and ransomware and other tools of extortion.

    The defendants allegedly communicated with victims using Tor, an encrypted computer network designed to facilitate anonymous communication over the Internet. 

    We support the use of encryption to safeguard private information and strengthen cybersecurity.  But this case highlights another example of the challenges posed to law enforcement by encryption designed to resist law enforcement. 

    Sophisticated encryption technologies like the Tor network are used by cybercriminals to commit serious offenses.  These sophisticated technologies pose a real threat to the government’s ability to keep people safe and ensure that criminals and terrorists are caught and brought to justice.

    Every sector of our economy is a target of malicious cyber activity.  But the events described in this Indictment highlight the urgent need for municipalities, public utilities, health care institutions, universities and other public organizations to enhance their cyber security. 

    Publicly revealing this nefarious hacking scheme makes it harder for the perpetrators, and others like them, to do business in the future.  As a result of the Indictment, the defendants are now fugitives from justice.  They face arrest and extradition to the United States in many nations that honor the rule of law. 

    We call on all civilized nations to prevent their citizens from using the internet to perpetrate fraud schemes in foreign countries.

    By making clear that criminal actions have consequences, we deter schemes to victimize the United States government, businesses, and citizens, and we help to protect foreign allies.

    This case demonstrates the Department of Justice’s commitment to identifying and prosecuting cybercriminals, regardless of where they base their operations. 

    We are grateful for outstanding work and collaboration between American and international law enforcement partners in this investigation.  In particular, I want to thank two United Kingdom agencies – the National Crime Agency, and the West Yorkshire Police – and two Canadian agencies, the Calgary Police Service, and the Royal Canadian Mounted Police.

  • MIL-OSI Security: Twenty-Nine Individuals Sentenced to 378 Combined Years in Federal Prison for Running Armed Fentanyl and Methamphetamine Trafficking Ring

    EVANSVILE- 29 defendants have been sentenced to a combined 378 years in federal prison for their roles in a large methamphetamine and fentanyl drug trafficking organization that operated in Southern Indiana.

    According to court documents, between January 2020 and November 2021, the following 29 individuals conspired together to distribute a total of nearly 500 pounds of methamphetamine and over three kilograms of fentanyl. This investigation led to the seizure of over 80 pounds of methamphetamine, over 560 grams of fentanyl, and $240,000 in United States currency.

    Jeramey Smith served as the leader of the drug trafficking operation. Smith began obtaining multiple pound quantities of crystal methamphetamine from Julian Green in early 2020 until April of 2021 when he changed his source of supply to a cartel linked individual based in Houston, Texas. In June of 2021, Smith was robbed of a large amount of cash and was unable to pay his supplier for the lost product. Smith resorted back to Green to obtain the crystal methamphetamine.

    DeJarnett was one of Smith’s top methamphetamine customers, often purchasing up to 20 pounds at a time. After Smith obtained the methamphetamine from either Green or his Mexican source of supply, he then distributed the methamphetamine to mid -level distributors in Indianapolis and Evansville.   

    In September 2021, Smith branched out to also begin selling large quantities of fentanyl-laced pills. Smith would obtain fentanyl powder from Markey and/or Moore, who would then press the powder into pills. Smith then used his same distributors to distribute the fentanyl throughout Southern Indiana. Law enforcement seized an automated pill press during the course of the investigation. Smith also used violence and intimidation to further his drug business by having his distributors robbed of their drug proceeds at gun point.

    Additionally, several members of the drug trafficking used firearms to protect themselves and their profits. In total, law enforcement officers seized over 30 firearms from the defendants during court-authorized searches at multiple locations in Indianapolis and Evansville.

    This case was investigated by the Drug Enforcement Administration’s Evansville Resident Office, with the FBI, Bureau of Alcohol, Tobacco, Firearms and Explosives, Evansville Vanderburgh County Joint Task Force, DEA Indianapolis and Indianapolis Metro Drug Task Force providing valuable assistance. The sentenced were imposed by U.S. District Court Judge Matthew P. Brookman.

    Acting U.S. Attorney John E. Childress thanked Assistant United States Attorneys Lauren Wheatley and Jeremy Kemper, who prosecuted this case. 

    According to the Drug Enforcement Administration, as little as two milligrams of fentanyl can be fatal, depending on a person’s body size, tolerance, and past usage—a tiny amount that can fit on the tip of a pencil. Seven out of ten illegal fentanyl tablets seized from U.S. streets and analyzed by the DEA have been found to contain a potentially lethal dose of the drug.

    One Pill Can Kill: Avoid pills bought on the street because One Pill Can Kill. Fentanyl has now become the leading cause of death for adults in the United States. Fentanyl is a highly potent opioid that drug dealers dilute with cutting agents to make counterfeit prescription pills that appear to be Oxycodone, Percocet, Xanax, and other drugs. Fake prescription pills laced with fentanyl are usually shaped and colored to look like pills sold at pharmacies. For example, fake prescription pills known as “M30s” imitate Oxycodone obtained from a pharmacy, but when sold on the street the pills routinely contain fentanyl. These pills are usually round tablets and often light blue in color, though they may be in different shapes and a rainbow of colors. They often have “M” and “30” imprinted on opposite sides of the pill. Do not take these or any other pills bought on the street – they are routinely fake and poisonous, and you won’t know until it’s too late.

  • MIL-OSI: New Chargeflow Research Shows that As Many as 80 Percent of Chargebacks Are Abusive

    TEL AVIV, Israel and WILMINGTON, Del., Feb. 05, 2025 (GLOBE NEWSWIRE) — Chargeflow, the pioneering chargeback platform tailored exclusively for online businesses, today announced a new research report, The Psychology of Chargebacks: Uncovering Why Consumers Dispute Charges. Featuring insights from 701 consumers, the research shows that customer demands for immediate issue resolution and other factors are leading to soaring incidents of unfriendly fraud that could be costing merchants as much as $117 billion annually.

    According to Mastercard’s 2024 Outlook: Strategic Insights for Issuers and Merchants report, U.S. chargeback transaction volume is expected to reach 146 million chargebacks in 2026. In its latest report, Chargeflow provides details that look beyond this growth to show why customers are choosing to file chargebacks over resolving issues directly with merchants.

    Prompt Customer Service is Critical
    Customers who have experienced issues with a merchant expect the situation to be resolved quickly. In fact, many give merchants zero opportunity to remedy a problem. When asked how long they would typically wait to file a chargeback after encountering an issue, 23 percent stated they would file immediately. Another 38 percent stated they would wait just 1-3 days, while 23 percent said they were happy with response times between 4-7 days. The bottom line, customers are giving merchants’ customer service teams little to no time to identify the issue and de-escalate any problems before disputes are filed.

    Lack of Immediate Communication Opens Door for Chargebacks
    Customers value merchant communications when it comes to resolving issues. According to the research, 64 percent say it’s important they receive immediate communication from a merchant regarding a complaint, with an additional 31 percent saying it is somewhat important. Their goal is unanimous–90 percent of consumers report they typically try to resolve a matter with the merchant before initiating a chargeback.

    While customers seek resolution, their patience quickly runs thin. According to the research, 85 percent of customers are likely or somewhat likely to move forward and file a chargeback if a merchant doesn’t respond to their complaint within a reasonable timeframe. With such demands, it should come as no surprise that 80 percent of those who initiated a chargeback said they were never contacted by a merchant with customer service teams that are likely understaffed and overburdened.

    Dispute Policies Encourage Chargebacks
    Overworked teams are not the only issue. Customer-first dispute policies also lead to chargeback success rates that do little to dissuade customers from acting—only 12 percent report having had a chargeback denied. Eight percent of respondents said they had a chargeback refuted for insufficient evidence, 3 percent said their claim was denied because merchants provided counterevidence, and 2 percent for a policy violation. With that level of success, it’s not surprising that 98 percent of consumers have had a neutral to highly satisfactory experience with the chargeback process offered by their bank or credit card.

    “The industry is acutely aware that chargebacks are soaring but there is far less clarity on what’s driving this surge. This research shows that a lack of patience on the side of customers is driving a vast majority of chargebacks that are not only unnecessary but also costing merchants billions of dollars,” said Ariel Chen, Co-Founder and CEO of Chargeflow. “This situation is exacerbated by the use of customer-first dispute policies which make it more appealing to file a dispute than to work with customer service teams towards a resolution. Stopping this cycle requires merchants to improve their support systems to the point where resolving an issue is a more attractive option to customers.”

    Bad Customer Experiences Also Drive Chargebacks
    Customer reliance on chargebacks is not only tied to perceived poor service resolution. The Chargeflow research found a direct correlation between customer experiences and chargeback. For example, when asked about the likelihood of initiating a chargeback if they encountered an issue with a purchase, 27 percent of respondents stated they were highly likely, and 35 percent stated they were somewhat likely. Only 11 percent of customers said they are somewhat unlikely and very unlikely. This finding is consistent with the core theme that consumers view chargeback as a standard tool for addressing perceived problems with a merchant.

    Lack of Awareness Leads Consumers to Unknowingly Committing Friendly Fraud

    Chargeflow’s The Psychology of Chargebacks report found that nearly 80 percent of chargeback cases result from friendly fraud. Despite this figure, this new research finds that most customers are unaware they are engaging in such activity. When asked if they initiated a false chargeback (when they knew the merchant was in the right and they should not), only 2.9 percent of respondents said they had done so. That means close to 97 percent believe they have not incorrectly filed a chargeback—rates that cannot be correct.

    In fact, the research found that only 9 percent of respondents said they filed a chargeback because they disagreed with a brand, its values, or its customer experience. As a result, consumers likely believe that they have rightly used their customer protections and not purposely or maliciously attached merchants.

    Survey Methodology
    This survey features data gathered from responses from a population sample of 700 people. Of this group, there was a near-even split between four age demographics: 18-34 (20 percent), 35-44 (28 percent), 45-54 (27), and 55-99 (25 percent). Forty-four percent of respondents listed as Male and 56 percent as female. The margin of error rests at 4 percent, with a confidence level of 95 percent.

    When Donald Trump assumed power in the United States for a second time, it was initially assumed that it didn’t bode well for Ukraine.

    During his first term, Trump maintained questionable connections to Russia. Furthermore, his claim that he would end the Russia-Ukraine conflict in a day — with Russia still occupying much of Ukraine — led many analysts to believe that any such policy would favour the Russians.

    These fears, at least so far, have not come to pass. In Trump’s inaugural address, many of the items he highlighted on the campaign trail figured prominently.

    Noticeably absent, however, was Ukraine. When it comes to Trump’s “America First,” philosophy, Ukraine and Russia have seemingly lost significance.

    Strategy of distraction

    Trump, with his bombastic nature, dominates the media cycle. His proclamations, social media statements threats and insults occur with such regularity that it’s difficult for anyone to keep pace.

    Just as one news item comes into focus, a new comment or ultimatum overtakes it.

    In many ways, this works to Trump’s advantage. People can be too distracted by the latest outlandish statement to pay close attention as Trump pursues his ambitious domestic policy goals. Lost in the media turmoil of Trump’s executive orders, tariff threats and heightened deportation campaign has been a shift on Russia and Ukraine.

    Ukraine, for Trump, is a secondary concern. His priorities, first and foremost, are domestic and aimed at remaking America.

    As such, rather than being driven by any foreign policy goals, Trump’s engagement with Ukraine and Russia will be determined by how he perceives he can benefit domestically in return. His calculations, in this regard, appear to have shifted.

    Complicated relationship with Ukraine

    Trump’s relationship with Ukraine during his first term was, to put it mildly, difficult. His infatuation with Russian leader Vladimir Putin, and Russia’s open disdain for Ukraine, caused him to largely ignore the country.

    When he did pay attention to Ukraine, it was as part of an effort to acquire information to damage his presumed political rival, former president Joe Biden. This effort resulted in Trump withholding aid from Ukraine unless it acquiesced to his demands.

    Trump’s position on Ukraine, however, has shifted over time. His antagonistic relationship with President Volodymyr Zelenskyy has seemingly improved.

    While there are still tension points, most notably when Zelenskyy visited Pennsylvania during the U.S. presidential election campaign, Trump has moderated his comments on his Ukrainian counterpart. Ukraine’s purchase of American equipment and ammunition, furthermore, supports Trump’s focus on domestic production.

    Lastly, Trump has expressed interest in accessing Ukraine’s rare earth metals. China currently dominates the rare earth metal market, which puts the U.S. at a disadvantage due to the minerals’ importance for future technological innovation. That means Trump has a stake in Ukraine’s future.

    These developments don’t mean the relationship is perfect. Instead, Trump is unlikely to be a burden to Ukraine, and this development is in part due to his declining view of Putin.

    Trump/Putin relationship

    The initial assumption of many analysts when Trump came to power again was that he would immediately favour Putin. The close relationship between the two is well-documented, and has been open to considerable speculation as to why Trump courted such favour with Putin in his first term.

    Trump, however, has upped his rhetoric against Russia since assuming the presidency. First, he threatened Putin with additional economic sanctions. Second, he stated that he would like OPEC to increase oil production and therefore inhibit Russia’s war effort by undermining its primary source of revenue.

    Why the pivot? It likely goes to the core foundation of Trump’s persona: he likes winners. Regardless of the ultimate outcome of the Russia-Ukraine war, Russia and Putin have displayed considerable weakness in execution during the war. The Russian military, once feared globally, has largely proven to be a paper tiger.

    While Russia still has several advantages in the war, it is only doing so by leveraging its future. According to Trump, Russia is in “big trouble” in terms of its economic woes. Trump is not alone in this view. Analysts, as well as perhaps Putin himself, recognize the serious challenges facing the Russian economy.

    It’s not just economically that Russia has leveraged its future. To avoid straining the Russian people, Putin has reached a deal with North Korea, which is providing soldiers for the war against Ukraine.

    Furthermore, Russia has deepened ties with Iran in exchange for Iranian drones.

    What Putin has provided North Korea and Iran in exchange for these soldiers is unclear. That said, Russia can only provide any technological exchanges for these soldiers and drones one time, as once shared, the same technology cannot be part of other arrangements. This reality limits Russia’s influence in the years ahead.

    The new art of the deal?

    Trump, almost certainly, wants to make a peace deal on Ukraine. It would burnish his reputation as a statesman while simultaneously demonstrating American strength and influence to the world at a minimal cost to the U.S.

    The terms of that deal, however, have shifted in the face of Russian weakness.

    That’s why it’s not surprising that the mercurial Trump has pivoted his stance on Russia. Until Russia can display the strength that Trump thought it possessed, he’s unlikely to do the Russians any favours in the future.

    The Isle of Wight has been included in the government’s fast-track plans for devolution.

    The Isle of Wight Council, alongside Hampshire County Council, Portsmouth City Council, and Southampton City Council, received confirmation today (Wednesday) that their joint expression of interest in the government’s devolution priority programme has been accepted.

    This acceptance marks a pivotal step towards the creation of a new mayoral strategic authority, aiming to transfer power and funding from Whitehall to the Solent and Hampshire region while enabling local councils to collaborate on strategic, region-wide issues.

    The mayoral strategic authority will not replace local councils, but rather work closely with local authorities in the region to develop and deliver their plans with most of its focus on responsibilities which are currently held by Whitehall.

    Councillor Phil Jordan, Leader of the Isle of Wight Council, said: “Currently, central government and Whitehall departments make some key strategic decisions about policy and funding for the Island and the wider area.

    “Devolution would shift more of these policy-making powers and additional funding to local authorities such as the Isle of Wight Council.

    “This change is expected to provide greater local control over vital areas such as major transport infrastructure, and health services, giving residents more power to shape the things that are important to them and ensuring robust local accountability.”

    As part of devolution proposals, a mayor would, subject to agreement and approval, be elected in the spring of 2026 to head up the new strategic combined authority. The mayor would promote the interests of the wider region to central government with the aim of driving local economic growth.

    The government is due to launch a public consultation in the spring to gather residents’ views on the plans. Any devolution deal would then undergo scrutiny and approval by Isle of Wight councillors.

    To facilitate devolution, the government has agreed to defer this year’s Isle of Wight Council elections by 12 months. However, this postponement is contingent on the necessary legislative changes being laid down and approved.

    The government has not yet confirmed arrangements in relation to town, parish, and community council elections.

    Councillor Jordan added: “Given the pressing deadlines, this decision by government is understandable and provides us with the necessary time and capacity to focus intently on this critical work.

    “By collaborating across political parties and engaging with local communities, we can ensure we secure the best possible outcomes for our residents.”

    He added: “The devolution proposal is incredibly promising, with the potential to deliver significant advantages to local residents and businesses.

    “It offers a unique opportunity to tailor decisions to local needs and priorities. This would enable us to shape our own future while potentially attracting significant funding to improve quality of life and promote business growth.”

    The U.S. Census Bureau and the U.S. Bureau of Economic Analysis announced today that the goods and services deficit was $98.4 billion in December, up $19.5 billion from $78.9 billion in November, revised.

    December exports were $266.5 billion, $7.1 billion less than November exports. December imports were $364.9 billion, $12.4 billion more than November imports.

    The December increase in the goods and services deficit reflected an increase in the goods deficit of $18.9 billion to $123.0 billion and a decrease in the services surplus of $0.6 billion to $24.5 billion.

    For 2024, the goods and services deficit increased $133.5 billion, or 17.0 percent, from 2023. Exports increased $119.8 billion or 3.9 percent. Imports increased $253.3 billion or 6.6 percent.

    The average goods and services deficit increased $4.7 billion to $83.8 billion for the three months ending in December.

Deficits were recorded, in billions of dollars, with China ($25.3), European Union ($20.4), Mexico ($15.2), Switzerland ($13.0), Vietnam ($11.4), Canada ($7.9), Germany ($7.6), Taiwan ($6.9), Ireland ($6.2), South Korea ($5.6), Japan ($5.5), India ($4.9), Italy ($4.1), Malaysia ($2.5), France ($1.1), Israel ($0.8), and Singapore ($0.4).

    • The deficit with Ireland decreased $3.1 billion to $6.2 billion in December. Exports decreased $0.1 billion to $1.2 billion and imports decreased $3.2 billion to $7.5 billion.

    For 2024, the goods and services deficit was $918.4 billion, up $133.5 billion from $784.9 billion in 2023. Exports were $3,191.6 billion, up $119.8 billion from 2023. Imports were $4,110.0 billion, up $253.3 billion from 2023.

    The 2024 increase in the goods and services deficit reflected an increase in the goods deficit of $148.5 billion, or 14.0 percent, to $1,211.7 billion and an increase in the services surplus of $14.9 billion, or 5.4 percent, to $293.3 billion.

    The goods and services deficit was 3.1 percent of current-dollar gross domestic product in 2024, up from 2.8 percent in 2023.

    • The deficit with Taiwan increased $26.1 billion to $73.9 billion in 2024. Exports increased $2.4 billion to $42.3 billion and imports increased $28.5 billion to $116.3 billion.
    • The surplus with the Netherlands increased $12.7 billion to $55.5 billion in 2024. Exports increased $8.3 billion to $89.6 billion and imports decreased $4.4 billion to $34.1 billion.

    Impact of Canada Border Services Agency’s (CBSA) Release of CBSA Assessment and Revenue Management (CARM)

    The CBSA introduced a new accounting system (CARM) on October 21, 2024. As a result, importers in Canada have experienced delays in filing shipment information. These delays affected the compilation of statistics on U.S. exports of goods to Canada for September through December 2024, which are derived from data compiled by Canada through the United States – Canada Data Exchange. A dollar estimate of the filing backlog is included in estimates for late receipts and, following the Census Bureau’s customary practice for late receipt estimates, is included in the export end-use category “Other goods” as well as in exports to Canada. This estimate will be replaced with the actual transactions reported by the Harmonized System classification in June 2025 with the release of “U.S. International Trade in Goods and Services, Annual Revision.” Until then, please refer to the supplemental spreadsheet “CARM Exports to Canada Corrections,” which provides a breakdown of the late receipts by 1-digit end-use category. This spreadsheet will be updated as late export transactions are received to reflect reassignments from the initial “Other goods” category to the appropriate 1-digit end-use category.

    Upcoming Changes to the Real (Chained-Dollar) Series

    Effective with the release of the February 2025 statistics on April 3, 2025, the Census Bureau will continue to use the Bureau of Labor Statistics (BLS) U.S. Import and Export Price Indexes to calculate the chained-dollar series (exhibits 10 and 11). The BLS will be implementing changes to the indexes with the release of the February 2025 U.S. Import and Export Price Indexes on March 18, 2025. The changes to the indexes could impact the chained-dollar values. Please refer to the BLS notice for additional information on the Upcoming Change to Data Source for Import and Export Price Indexes: U.S. Bureau of Labor Statistics.
