  • MIL-OSI China: Chinese, foreign experts call for cooperation on ocean sustainability

    QINGDAO, Oct. 25 — More than 600 dignitaries, experts and scholars from 41 countries and regions shared ideas on deepening cooperation on ocean-related areas — including the economy, technology and ecology — at the 2024 Global Ocean Development Forum, which concluded on Friday in Qingdao City, east China’s Shandong Province.

    Peter Thomson, the United Nations secretary-general’s special envoy for the ocean, emphasized the urgency of ocean protection, noting that it is only through global cooperation that sustainable development goals can be achieved.

    Sun Shuxian, China’s vice minister of natural resources and head of the State Oceanic Administration, highlighted the steady growth of China’s marine industry and the continuous improvements in the country’s marine ecological environment.

    The two-day event saw the release of the 2024 China Ocean Development Index Report, which revealed that China’s marine development index grew at an average annual rate of 2.9 percent from 2016 to 2023.

    Zhang Zhanhai, chairman of the China Ocean Mineral Resources R&D Association, noted that with expertise in deep-sea equipment and technology, China is well-positioned to support the sustainable development and utilization of global seabed resources.

    Iceland’s Ambassador to China Thorir Ibsen highlighted China’s vital role in advancing the global marine economy. He also noted the long-standing cooperative relationship between Iceland and China in marine-related fields, as well as the growing marine trade between the two countries.

  • MIL-OSI Security: Chair of the NATO Military Committee: ‘Finland will never again navigate the darkness alone.’

    On 24 and 25 October 2024 Chair of the NATO Military Committee Admiral Bauer visited Finland, upon the invitation of its Chief of Defence General Janne Jaakkola. Admiral Bauer’s visit underscored the value of Finland as a NATO Ally and the important contributions it provides to NATO’s deterrence and defence.

    On Thursday 24 October, Admiral Bauer visited the Guards Jaeger Regiment and met with Finnish Defence Support Association members. This gave the opportunity to engage with members and meet current Finnish conscripts.

    In the evening, Admiral Bauer addressed the Finnish National Defence Course Association. This association brings together leaders from across society Finnish society who complete a prestigious national course covering in-depth topics of security and defence. Admiral Bauer’s speech praised the spirit of resilience engraved in Finland’s national defence and emphasised what NATO can learn from Finland’s Comprehensive Security Strategy and Total Defence Concept. 

    Admiral Bauer took the opportunity to discuss Finland’s transition to NATO membership, and looked ahead to the future of its membership in the Alliance.     On 24 October 2024, NATO kicked-off “Neptune Strike 2024.” This enhanced vigilance activity will take place across Europe, from the central Mediterranean and Adriatic up to the North and Baltic Seas and will run until 31 October 2024. During this period, NATO will take operational control of cutting-edge maritime warfare capabilities from numerous Allies, including multiple aircraft carriers and expeditionary strike groups that will be deployed across several operational domains.

    In total, some 20 surface vessels and submarines, along with special operations forces and numerous aircraft, are participating, with around 15.000 supporting personnel.   • MIL-OSI Security: Update 256 – IAEA Director General Statement on Situation in Ukraine

    Ukraine’s Zaporizhzhya Nuclear Power Plant (ZNPP) lost the connection to its only remaining 330 kilovolt (kV) back-up power line for a second time this month, once again leaving the facility dependent on one single source of the external electricity it needs for reactor cooling and other key nuclear safety and security functions, Director General Rafael Mariano Grossi said today.

    The IAEA team stationed at the plant was informed that the power line was disconnected for more than 26 hours between Monday and Tuesday this week due to unspecified damage on the other side of the Dnipro River. It took place three weeks after another disconnection of the same line. In both instances, the ZNPP continued to receive electricity from its sole 750 kV line. Before the military conflict, Europe’s largest nuclear power plant (NPP) had four 750 kV and six 330 kV lines available.

    “What once would have been unthinkable – a major nuclear power plant suffering repeated off-site power cuts – has become a frequent occurrence during this devastating war. The situation is clearly not getting any better in this regard. The nuclear safety and security situation at the Zaporizhzhya Nuclear Power Plant remains highly precarious,” Director General Grossi said.

    Underlining the persistent risks, the IAEA team has continued to hear explosions every day over the past week, although no damage to the ZNPP was reported.

    The IAEA team members conducted walkdowns across the site as part of their activities to assess nuclear safety and security at the plant, including observing the testing of an emergency diesel generator (EDG) of reactor unit 4. In meetings with plant staff, they discussed other important topics, such as the modernization of control systems for the site’s EDGs as well as updated procedures related to the ZNPP’s radiation protection programme.

    As a follow up to their visit last week to the cooling tower damaged by a major fire in August, the team members also discussed with the ZNPP how it will assess the extent of the damage, including the selection of an external contractor to carry out this work.

    The IAEA teams present at the Khmelnytskyy, Rivne and South Ukraine NPPs and the Chornobyl site reported that nuclear safety and security is being maintained despite the effects of the ongoing conflict, including air raid alarms for several days over the past week.

    At the South Ukraine NPP, the IAEA team was informed that reactor unit 1 was disconnected from the grid for about four hours on Tuesday evening due to a spurious signal to the unit’s protection systems without the reactor safety systems being activated. The root cause of the event is being investigated. The reactor – one of three at the plant – is again generating power for the grid.

    At the request of Ukraine, an IAEA team is visiting six electrical substations in Ukraine this week, as part of the Agency’s work to assess the status of the electrical grid infrastructure essential to nuclear safety that began in September. During the visits, the team reviews the operational consequences of actual and potential damage to substations which supply off-site power to the country’s NPPs.  

    Reliable access to off-site power is one of the Seven Indispensable Pillars for ensuring nuclear safety and security during an armed conflict outlined by Director General Grossi two and a half years ago. The safety of operating NPPs is dependent on a stable grid connection, but the situation in this regard has become increasingly precarious in recent months.

    The IAEA already has teams of staff stationed at all of Ukraine’s NPPs who contribute to maintaining nuclear safety and security during the military conflict.

    The IAEA is continuing to implement its comprehensive programme of assistance in support of nuclear safety and security in Ukraine, including by delivering requested equipment. This week, two spectrometry systems enhancing the analytical capabilities of the hydrometeorological organizations of the Ukraine’s State Emergency Service were procured and delivered, funded by Switzerland. It was the 71st equipment delivery to Ukraine, totaling over 12.1 million euro since the start of the armed conflict.

    In addition, the Agency has coordinated the delivery of the two static test benches from the Rivne NPP to the supplier for repair during an outage of reactor unit 2. The repair was funded by Norway. The repair should be completed by the end of April next year, when the repaired test benches will be returned to the plant to enable the unit’s restart. The equipment is used in the nuclear and other industries to stress test components, including hydraulic shock absorbers.

    Shanghai continues to lead China’s coffee market with 9,553 coffee shops, officials announced during a news conference on Wednesday at the opening of the Lujiazui Coffee Festival in Pudong New Area.

    Jin Wencheng, director of the Ministry of Agriculture and Rural Affairs’ rural economy research center, released the Global Coffee Industry Development Trends Insight Report and related index at the event, highlighting that China’s annual coffee consumption reached 280,000 metric tons last year, with customers patronizing approximately 157,000 coffee shops nationwide.

    Jointly launched by the China Media Group Shanghai Bureau — the financial program center of CMG — and the research center, the report further pointed out that the value of the coffee industry in China reached 265.4 billion yuan ($37.3 billion) in 2023, an increase of over 30 percent year-on-year. The number of coffee consumers in the country is close to 400 million.

    “The Chinese coffee market has seen significant expansion, emerging as a standout in the global coffee industry,” Jin said, adding that the report and index are constructed based on three key dimensions: industry scale, development quality and industry resilience.

    China’s coffee production increased from 114,000 tons in 2020 to 146,000 tons last year, the report noted. Yunnan province accounts for 98 percent of the national output, making it the primary coffee-producing region in China.

    “Refinement and branding are leading the high-quality development of the domestic coffee industry in China,” said Jin, noting that the proportion of premium domestic coffee products has significantly increased, reaching 22.7 percent this year.

    “Domestic coffee brands are rapidly emerging, and the fusion of coffee culture with tourism has become a new business model,” Jin added.

    On a global scale, coffee production has shown a growth recovery, according to the report.

    Last year, global coffee consumption reached 10.62 million tons, marking a 2.2 percent increase from the previous year, with a total daily consumption of 3 billion cups of coffee.

    Apart from the emerging market in China, countries and regions such as Brazil, the Philippines and South Korea are also experiencing rapid growth in coffee consumption.

    Shanghai, which has more coffee shops than any city in China, launched the ninth edition of the coffee festival on Wednesday, which will run until Oct 27.

    The Government has adopted a new strategy for Sweden’s global development cooperation on migration, returns and voluntary repatriation. The strategy comprises SEK 3 billion for the period 2024–2028 and is part of governing Sweden’s development assistance to strengthen synergies between migration policy and development assistance policy.

    The new strategy plays an important role in strengthening synergies between development assistance policy and migration policy, and is based on the priorities set out in the reform agenda and the Tidö Agreement.

    “Through development assistance, we will increase support in our neighbourhood, with the long-term aim of reducing irregular migration to Sweden and the EU. The strategy will also benefit Swedish interests and counteract the negative effects of irregular migration and forced displacement,” says Minister for International Development Cooperation and Foreign Trade Benjamin Dousa.

    With the new strategy, Sweden will meet global challenges linked to irregular migration and forced displacement, and promote returns and voluntary repatriation. In practice, this may involve support for reintegration, increased capacity of partner countries to manage migration and asylum, and functioning infrastructure in countries of origin and transit.

    The strategy will complement and reinforce other parts of Sweden’s work on migration and development assistance – globally, regionally and bilaterally.

    The European Anti-Fraud Office coordinated an action that led the EU Member States’ and Norwegian customs authorities to seize around 40,000 litres of illicit alcoholic beverages. The targeted action is part of operation OPSON XIII, the global initiative coordinated alongside Europol to tackle food fraud and ensure the safety of food and beverages across Europe. 

    The operation, which ran from December 2023 to May 2024, focused on identifying and removing counterfeit and substandard food and drinks from markets while disturbing the criminal network behind these illicit products. 

    As in previous years, OLAF led a targeted action focused specifically on illicit alcoholic beverages. The operation revealed sophisticated schemes aimed at infiltrating the EU market with products of inferior quality – mostly beer, homemade alcohol and wine. Fraudsters used deceptive packaging, falsified documents and false labels to sell these products to consumers. 

    The OLAF coordinated action involved customs authorities from 15 Member States and one non-EU country: Austria, Belgium, Bulgaria, Croatia, Denmark, France, Germany, Greece, Ireland, Italy, Lithuania, Norway, Poland, Portugal, Spain and Slovakia.

  • MIL-OSI Global: Declaration of Helsinki turns 60 – how this foundational document of medical ethics has stood the test of time

    The declaration of Helsinki recently turned 60, but don’t feel bad if you missed the celebrations. It probably passed unnoticed by most people not working in the medical field – and possibly even a good few in the field.

    If you’re not familiar with the declaration – adopted by the World Medical Association on October 19 1964 – here is an explainer on this highly influential document: how it emerged, how it evolved and where it may be heading.

    What is the declaration of Helsinki?

    The World Medical Association was set up in the late 1940s in response to atrocities committed in the name of medical research during the second world war. It was focused on promoting and safeguarding medical ethics and human rights.

    Agreed at a meeting in Finland in 1964, the first version of the declaration included principles that have become the cornerstone of global research ethics. These include the importance of carefully assessing the risks and benefits of research projects, and seeking informed consent from those taking part in research.

    The declaration has been hugely influential and has been incorporated into national guidelines relating to medical research around the world. (For example, in the UK it is cited in legislation and policy relating to research.)

    However, it is not legally binding. It has also, at times, been the focus of controversy. For example, following an intense debate in the early 2000s – about the use of placebos in drug trials and the ethics of conducting research in low-income countries – the US Food and Drug Administration removed reference to the declaration in its own guidance.

    The declaration updated

    It has been revised several times (the new version is the eighth edition), reflecting an evolving understanding of medical ethics, contemporary debates about when research would be ethical, as well changes in the nature and landscape of research.

    Some of these reflect important shifts in values and language. In 1964, the declaration stated that clinical research “should be conducted … under the supervision of a qualified medical man” – sexist language that has long since gone by the wayside.

    The 2024 version refers to “research participants” rather than “research subjects” – in response to a wider shift to greater inclusion of patients and research volunteers as partners in research. There are also new references to concern for the environment and sustainability, as well as attention to issues relating to stored data and biomaterial, such as tissue samples.

    Continuing uncertainty

    Some questions remain. One change in the recent document emphasises the importance of including participants from different backgrounds in research, including those who are potentially “vulnerable” in one or more ways.

    Older versions of the declaration emphasised avoiding research wherever possible involving children, older patients, pregnant women, those with mental illness and prisoners. This came from a need to learn from past scandals and avoid exploiting vulnerable groups.

    However, more recently, it has been recognised that excluding these groups can cause even greater harm, since it leads to a lack of evidence on how best to treat some patients. This then leads to disparities in health. For example, a large proportion of medicines commonly used for children lack high-quality evidence to support them.

    The 2024 declaration tries to balance the priority to include vulnerable groups in research with the need to protect and avoid research that could be feasibly performed in other groups.

    However, this highlights a deeper problem. Ethical problems arise when research is inhibited or discouraged.

    Regulation of research (as encouraged by the declaration) is hugely important, but it can also make it extremely difficult, time consuming and resource intensive to perform. Doctors may change practice based on experience, intuition or inspiration. If they do so outside of a trial, they are not required to seek the approval of any review body.

    As noted by a British paediatrician Richard Smithells in the 1970s: “I need permission to give a drug to half of my patients [to find out whether it does more good than harm], but not [if I want] to give it to them all.”

    One particular form of research that can be important to drive improvements in care are so-called comparative effectiveness trials. Within many areas of medicine, there are variations in practice, where some professionals will take one approach, while others will take another.

    Depending on which doctor you happen to see, (perhaps which clinic you attend, or which day of the week you become unwell), you might receive one treatment or the other.

    Since variations like this affect many patients, it would be important to determine which is the better option, potentially involving a randomised controlled trial, where one group of patients is randomly selected to receive the treatment and another group (the control group), a placebo. These trials take years to conduct and are very expensive to run.

    However, the declaration seems to encourage a one-size-fits-all approach and potentially implies that such trials should go through a formal and lengthy research ethics approval process, with participants providing explicit informed consent. However, many ethicists and researchers have argued in favour of a more slimmed-down regulatory approach focusing on what matters: do trials meaningfully add risk or burden to those that patients would have encountered outside the trial. And would taking part in research restrict patients’ ability to make meaningful decisions, and to make choices that would ordinarily have been offered?

    For example, imagine a trial of two different antiseptics that are commonly used for surgery. Being involved in the trial wouldn’t impose additional risk (since patients ordinarily receive those antiseptics), and it wouldn’t remove an ordinary choice, since it would be rare for medical professionals to ask patients which antiseptic they would like.

    The Declaration of Helsinki may be 60 years old, but it continues to both stimulate debate and inspire ethical practice in medical research. It has been newly revised but it is likely that innovations in research, such as the growing use of AI in medicine, will require further changes in the years ahead. It isn’t time to retire it yet.

  • MIL-OSI Global: As Colombia hosts a UN biodiversity summit, its own Amazonian rainforest is in crisis

    The city of Cali, in Colombia, is hosting the UN’s 16th biodiversity summit, known as Cop16. The summit, which runs until Friday, November 1, is focused on how countries will fulfil previous pledges to protect at least 30% of the world’s land and water and restore 30% of degraded ecosystems by 2030.

    It’s a noble aim, yet Colombia itself shows just how far we have to go.

    If you travel south east from Cali, over the Andes mountains, you drop into the Amazon basin. From there, rainforest stretches for hundreds of kilometres to the border with Brazil – and far beyond. This rainforest is the main reason Colombia ranks as the fourth most biodiverse country in the world. Nowhere else has as many species of birds. Only Brazil and China have more trees.

    But the region is experiencing an environmental crisis. I recently completed a PhD on the northern Colombian Amazon, in which I tracked how the rainforest is fast being deforested and turned into pastures for cattle ranches. I particularly looked at how this affects hotspots of plant and animal life in rugged valleys on the Amazonian side of the Andes – spectacularly biodiverse places even by Colombian standards – and looked at what can be done to protect them.

    This is not an easy part of the world in which to do such work – the NGO Global Witness ranks Colombia as the single most dangerous country for environmental defenders. While documenting legal and illegal cattle ranching, I was often reminded to be aware of exactly who I was contacting and to be wary of which questions I was asking.

    Activists and researchers often face violence from those who profit from deforestation, and I had to work closely with organisations and authorities that secured own safety. Very harrowing experiences are not uncommon.

    Despite these risks, many continue their efforts, driven by a deep commitment to protecting the Amazon and its biodiversity. Their bravery only underscores the urgent need for stronger protections and enforcement.

    Peace led to more deforestation

    For decades, the region was mostly controlled by the Farc guerrilla army. The Farc was largely funded by kidnappings and the drug trade, and wasn’t interested in large-scale farming.

    All this changed after the government of Colombia signed a peace agreement with the Farc in 2016. Since then, deforestation has increased, as both legal and illegal land tenants have acquired land for farming through what they call “sustainable development” practices. This mostly involves turning forest into pasture for cattle, the main driver of deforestation across Latin America.

    Things peaked in 2018, when 2,470 square kilometres of forest was lost in Colombia – equivalent to a circular area more than 50 kilometres across. Rates of deforestation have reduced slightly since then (though the data isn’t very reliable), but appear to be increasing once again in 2024.

    The recent increase might be attributed to the demand to produce more coca or rear more cattle, along with pressure from extractive industries like mining. The spread of roads and other infrastructure further into the rainforest have also opened up new opportunities.

    Billions more needed to stop deforestation

    In its 2018 Living Forest Report, the WWF included Colombia’s Chocó-Darién and Amazon forests in its list of 11 “deforestation fronts” across the planet. These fronts are where it projected the largest concentrations of forest loss or severe degradation would occur in the period till 2030.

    No wonder then that Colombia’s environmental crisis has drawn international attention. Countries like Germany, Norway and the UK have supported its efforts to reduce deforestation, pledging about €22 million under the UN’s reducing emissions from deforestation and forest degradation scheme (known as REDD+). This is a good start, but much more is needed.

    Indeed, the Global Biodiversity Framework, the international treaty that underlies the Cop16 negotiations in Cali, estimates we’ll need an extra US$700 billion each year to protect biodiversity.

    An important issue at the summit is therefore how to mobilise sufficient financial resources, particularly for developing countries. The previous global biodiversity summit, held in Canada in 2022, established that wealthy countries should provide US$30 billion annually to low-income countries by 2030.

    Ahead of this year’s summit, countries were expected to submit new national biodiversity plans detailing how they’ll meet the 30% protection goals. Most failed to do so – including Colombia. Despite this setback, delegates in Cali will hopefully develop robust mechanisms to monitor progress and ensure countries are held accountable for meeting their targets.

    Other critical issues include reforms to benefit small-scale farmers in the Amazon. The region’s current economic model is centred on reshaping the land and extracting resources, but it has not generated prosperity for these more sustainable farmers. That same economic model has also failed to protect the forest itself.

    The summit should also work towards recognising indigenous peoples’ rights and traditional knowledge, and including their voices in policy decisions, and must address violence against environmental defenders.

    These are all huge issues in Colombia and indeed any country where cattle farmers are eyeing up pristine rainforest. The summit in Cali represents a great opportunity for the world to seriously tackle the dual biodiversity and climate crisis.

These partnerships at the community, provincial, territorial, national, and international levels are key to providing service to Canadians. The Canadian Coast Guard is always looking to strengthen those partnerships and, as such, has recently signed two new agreements with international partners.

    On October 18, 2024, the Canadian Coast Guard signed a Memorandum of Understanding with the World Maritime University in Malmö, Sweden. It aims to strengthen collaboration in maritime and oceans education, training, and research. The five-year agreement will pave the way for innovative joint initiatives in maritime studies. This partnership reflects a shared commitment to sustainability, and fostering innovative solutions for the global maritime industry.

    The Canadian Coast Guard College and World Maritime University share close ties, as two world-leading maritime education facilities. They work together through exchange programs, information sharing, and joint testing projects, including the testing of alternative, bio-friendly types of fuel for future vessels for both Canada and Sweden.

    On October 24, 2024, the Canadian Coast Guard signed a second Memorandum of Understanding with the International Group of Protection and Indemnity Clubs in Ottawa, Ontario. The International Group of Protection and Indemnity Clubs is responsible for insuring over 90% of global cargo at sea. The agreement will lead to more timely engagement with shipowner representatives during incidents, and as a result will ensure more effective and efficient response to future marine pollution incidents.

    This includes containment and clean-up of oil discharges and hazardous substances in Canadian waters. The Canadian Coast Guard’s Compliance and Enforcement Program notifies vessel owners of any pollution threats or hazards, and ensures they take responsibility. Where necessary, the Canadian Coast Guard steps in to manage the situation, using a wide range of tools and equipment to mitigate the hazard, clean up the spill, and mitigate any potential environmental impacts.

  • MIL-OSI Banking: Charting the course: prudential regulation and supervision for smooth sailing

    Introduction

    Good afternoon, and thank you for inviting me to speak at this conference today.

    It is a privilege to be speaking today as the Chair of the Basel Committee, following my appointment by the Group of Governors and Heads of Supervision (GHOS) in May of this year.1 This is a position that has been previously enjoyed by only 11 people during the Committee’s 50 years. As a Reserve Officer in the Royal Swedish Navy, I would liken this honour as akin to taking the helm of a well steered vessel by seasoned captains. 

    As you know, the work of the Basel Committee since the Great Financial Crisis (GFC) – under the leadership of Nout Wellink, Stefan Ingves and, more recently, Pablo Hernández de Cos – has fundamentally reshaped the regulatory landscape for internationally active banks. The Basel Framework is the cornerstone of the international community’s response to the GFC. Since 2011, banks’ Common Equity Tier 1 (CET1) risk-based capital ratio has increased by over 70% and now stands at around 13.8%.2 Global banking system leverage has almost halved during this period, with an average Tier 1 leverage ratio of just over 6%.3 And banks’ holdings of high-quality liquid assets have more than doubled to over €12.5 trillion, with a corresponding Liquidity Coverage Ratio of over 135%.4

    The Basel III reforms have brought tangible benefits. In sailing, no matter how skilled you are, you can’t control the weather. However, you can prepare your boat with safety protocols and solid equipment. The Committee helps ensure that the global banking system is prepared for the unexpected. There is now an extensive empirical literature that suggests that the Basel III reforms have had an unambiguously positive net macroeconomic effect.5 The reforms have clearly strengthened bank resilience at both the bank and system-wide level, which in turn will help reduce the likelihood and impact of future banking crises. At the same time, banks, particularly strongly capitalised ones, have continued to meet the demand for lending from households and businesses.6

    Just as important as the effects of Basel III is the process by which the reforms were finalised. The Committee consulted extensively when developing Basel III – we do not operate in a vacuum or opaquely. It published no fewer than 10 consultation papers, which collectively spanned a consultation period of almost three years. It engaged extensively with a wide range of external stakeholders. Each consultation was accompanied by a rigorous quantitative impact study, which was supplemented by a half-yearly public Basel III monitoring exercise. So it is reassuring and appropriate to find that a recent academic study concluded that the Committee’s consultation approach is “one of the most procedurally sophisticated” processes among policymaking bodies.7 Moreover, member jurisdictions have undertaken their own rigorous domestic rule-making processes to transpose these standards.

    But the work to fix the banking system fault lines exposed by the GFC is not done. We need to lock in the financial stability benefits of implementing the outstanding Basel III standards in full and consistently, and as soon as possible. I take comfort in the recent unanimous reaffirmation by the GHOS to achieve such an outcome.8 The Committee has been actively monitoring and assessing the full and consistent implementation of Basel III and will continue to do so.

    As this is my maiden speech as Committee Chair, I will outline some high-level principles that I will be relying upon to help guide how I view the work of the Committee. I will also offer a few personal reflections on some topical issues. As a keen sailor, I should apologise in advance for my continued use of maritime language!

    Principle 1: Sail forward but always glance back

    My starting point is that we cannot afford to ignore, or forget, the lessons of history. This time is not different. There have been no fewer than 150 systemic banking crises since 1970.9 Just last year, we saw the most significant system-wide banking stress since the GFC, including the distress of five banks with total assets exceeding one trillion US dollars. While each banking crisis may have had its unique characteristics, the common thread throughout history is that we simply cannot predict when or from where the next crisis will emerge. We therefore need to ensure robust and durable resilience for the global banking system to withstand a range of potential shocks.    

    Banking crises have a profound impact on our economies and social welfare. In my home country of Sweden, the 1990s banking crisis and the GFC resulted in output losses of over 30% and 25%, respectively.10 These are not just numbers, but reflect economic hardships endured by citizens, including job losses and foregone growth potential. We must always remember this stark reality when regulating and supervising banks.

    And yet, despite the painful effects of banking crises, history suggests that the lessons from such events are often forgotten as part of a “regulatory cycle”.11 Memories fade over time, and a view takes hold that this time really is different. As the cycle turns, policymakers, supervisors and risk managers at banks sometimes become complacent and give in to pressures to dilute regulatory safeguards. Such a journey never ends well: it is only a matter of time until stormy waters reveal banks’ stress points and fractures.

    This is not a course that I intend to chart. The reality is that a banking system built upon leverage and maturity transformation will inevitably face episodes of distress. Misconduct, governance failures and imprudent risk management practices further increase the likelihood and impact of crises.

    To be clear, the first and most important source of resilience comes from banks’ own risk management practices and governance arrangements. The boards and management of banks should be the first port of call in managing and overseeing risks; they cannot outsource these functions to supervisors. Yet history suggests that some banks’ boards and senior management occasionally fail in their most elementary responsibilities. So it is critical that bankers, policymakers and supervisors do not forget the lessons from the past and take a medium-term perspective. Consider, for example, the recent growth in the use of so-called synthetic risk transfers (SRTs) by banks across several regions.12 Such transactions are intended to reduce banks’ capital requirements by “transferring” the risks associated with some exposures to a third party – often a non-bank financial intermediary (NBFI) – which provides credit protection or insurance. The Basel Framework allows for such transactions to take place subject to meeting certain criteria, and they may in instances be an effective risk management technique. However, I personally believe that we should not lose sight of the bigger picture and lessons from the GFC. In particular, we should ask ourselves: are there system-wide risks that warrant closer attention? For example, what are the risks if NBFI investors of SRTs are in turn borrowing from other banks? Is there sufficient transparency about the interconnections and potential spillover of risks between banks and NBFIs in these – and other – markets? A natural starting point to help answer these questions is to remind ourselves of the lessons from the GFC. 

    Just like a sailor needs steady winds, strong sails and safety gear for times of stress to ensure a smooth voyage, a bank requires strong prudential regulation and supervision to ensure stability. And its board and senior management should display the leadership and competency of a veteran captain. In addition, it is critical that the Committee remains vigilant and pursues a forward-looking approach to assessing risks and vulnerabilities to help reduce the risk of the global banking system being blown off course into financial storms.

    The Committee’s work should also continue to be anchored by rigorous empirical analysis and not succumb to short-term or specific interests of some external stakeholders. And the GHOS agreed to mark a clear end to the Basel III policy agenda in 2020 when it noted that any further potential adjustments to Basel III “will be limited in nature and consistent with the Committee’s evaluation work”.13 This is why the Committee is pursuing analytical work based on empirical evidence to assess whether specific features of the Basel Framework performed as intended during the 2023 banking turmoil, such as liquidity risk and interest rate risk in the banking book.14 On this note, we recently provided a progress report to the G20 which outlines the progress we have made in the area of liquidity risk.15 This is a good start, but there is still more work to be done. Structural changes affecting the financial system, such as the ongoing digitalisation of finance and role of social media, require policymakers and supervisors to remain alert and be open-minded as to whether any additional regulatory and supervisory measures are needed.

    Principle 2: All hands on deck

    My second guiding principle is the need for global and transparent engagement with a wide range of stakeholders.

    Financial stability is a global public good that requires cross-border cooperation. An open global financial system requires global prudential standards. Failure on this count could result in regulatory fragmentation, regulatory arbitrage and a potential “race to the bottom” leading to a dilution of banks’ resilience.16

    So I will strive to build on the strong track record of Committee members to cooperate and collaborate in tackling cross-border financial stability challenges and shoring up the resilience of the global banking system. We have witnessed the benefits of global cooperation throughout the Committee’s history, including with the Concordat, Basel I, II and III, and the Basel Core Principles, and of course more recently during the Covid-19 period and last year’s banking turmoil. And in a world facing major geopolitical uncertainty, and where the merits of multilateralism are sometimes questioned, it is even more critical for the Committee to remind all stakeholders of the necessity of cross-border cooperation.

    The need for cooperation is not just among Committee members themselves. Given the increasingly cross-sectoral and cross-cutting nature of developments affecting the global financial system – such as the ongoing digitalisation of finance, the growing role of NBFIs, the increasing nodes of interconnections among banks, central counterparties and NBFIs, or climate-related financial risks – the Committee will need to increasingly liaise with a wide range of authorities. This includes ongoing cooperation with central banks and supervisory authorities outside the Basel Committee’s membership, but also financial sector authorities in charge of overseeing conduct, resolution, deposit insurance, payment systems, securities and other NBFIs. In fact, for certain topics there may also be a need to go beyond the financial sector sphere and liaise with authorities with responsibility for accounting, competition, data privacy and security, just to mention a few.

    To this end, it is critical that the Committee continues to seek the views of a wide range of stakeholders, including academics, civil society, legislators, market participants and the general public. Even if we may have different views on specific elements of the Committee’s work, these engagements unquestionably enhance the Committee’s outputs by bringing in different perspectives.

    Principle 3: Keep your heading steady

    My third principle is the importance for the Committee to act as a lighthouse, cutting through the fog and stormy conditions.

    Bank regulation and financial supervision are an anchor to help prevent banks from drifting into risky waters that could endanger the entire economy. A resilient and healthy banking system is one that can best support households and businesses through the robust provision of key financial services across the financial cycle.17

    Let me give you an example from my home country. Before the pandemic, the initial set of Basel III standards were fully implemented in Sweden. These reforms significantly increased Swedish banks’ resilience to shocks. In addition, the Swedish authorities activated the Basel III countercyclical buffer and set it at 2.5%, with the aim to further enhance Swedish banks’ resilience. Doing so allowed us to release this buffer in response to the Covid-19 crisis, which in turn helped Swedish banks to absorb shocks and to lend to creditworthy households and companies throughout the pandemic. The releasability of this buffer facilitated its drawdown by banks in a way that made it genuinely usable.

    It may be tempting for some to argue that regulations should be watered down and that supervision should be less intrusive, in order to promote lending to specific sectors or to “unlock” economic growth. But, as with other areas of economic policymaking, any perceived short-term gains are usually more than offset by longer-term pain. Shaving off a few basis points of capital will not unlock a wave of new lending, but it will weaken your resilience. More generally, being well capitalised is a competitive advantage for banks and their shareholders, as it ensures that they can continue to grow and invest in profitable projects across the financial cycle. The Committee’s work should therefore continue to be centred around its mandate.

    To be clear, this is entirely compatible with stable and healthy earnings that are fundamental to banking and financial stability. So it is reassuring that the sample of banks for which we regularly collect data – many of which are represented here today – have over time been able to both meet new regulatory requirements, make healthy profits and pay out significant dividends. For example, in 2011 banks faced a CET1 capital shortfall from Basel III of about €485 billion. Since then, their profits have exceeded €4 trillion and banks have paid out over €1.3 trillion of common share dividends, while at the same time building capital and liquidity buffers to meet the new requirements.18

    More generally, the Committee will continue to focus its work on those prudential areas that require a global and coordinated response. Its outputs will continue to take the form of global minimum standards to provide a common financial stability baseline across jurisdictions. Jurisdictions are, of course, free to go beyond this baseline if the size and structure of their banking system and the associated risks warrant additional measures. Such measures only reinforce global financial stability. Just as importantly, we will continue to promote strong supervision, including by sharing supervisory experiences and, when needed, developing additional guidance to assist supervisors worldwide.

    In that regard, I am sure all of us can agree that it is in our collective best interest to have global standards. We may have different opinions about Basel III, but I think we can all agree that having a globally consistent level playing field is preferable to a patchwork of disparate regulations. A global compromise – however imperfect it may appear to some – is preferable to a free-for-all framework. Internationally active banks then have a common minimum regulatory baseline which they can manage their business around. Supervisors are able to better assess the relative resilience of their banks across jurisdictions. The scope for regulatory arbitrage is reduced. Level playing fields are enhanced. Now compare this with a fragmented bank regulatory world, where banks would have to comply with completely different rules across borders with no common minimum baseline. Such a scenario could also trigger a race to the bottom across jurisdictions, resulting in a frail regulatory framework that would threaten global financial stability and banks’ own viability. We would all be worse off in such a situation. It is therefore in your own interest to avoid such a scenario and to promote a common and consistent implementation of Basel III.

    Finally, we should keep the fundamentals of bank regulation and supervision in mind. While it may be tempting to focus on the “newest” trends affecting the banking system, we should not lose sight of the more traditional risks, such as credit risk and liquidity risk. Regarding the former, despite repeated headwinds over the past few years, the feared wave of financial problems for households and corporate defaults has yet to appear. Yet I am personally concerned about some stakeholders’ seeming complacency in assuming that the worst is over and that the seas are calm. It is a universal truth that a calm sea does not make a clever sailor.

    With continued uncertainty about interest rate trajectories and the economic outlook, hidden currents and unseen reefs could still pose a challenge. Banks and supervisors must remain vigilant to such risks.

    Principle 4: Sailing to simplicity

    My last principle is to ensure that the Committee continues to adequately balance risk sensitivity with simplicity and comparability. Finance and banking are complex activities, so there is perhaps an understandable temptation to match that complexity in the regulatory framework.

    Yet one does not always fight fire with fire. Undue complexity in prudential regulation can undermine the ability for a bank’s board and senior management to fully understand the risk profile of their bank. It can also impede supervisors’ ability to effectively assess the resilience of banks and create opaque opportunities for arbitrage. And while complex rules may sound conceptually appealing, they may also prove to be challenging to operationalise in practice.

    Banking is as much about risk as it is about uncertainty.19 In such a world, simpler approaches can sometimes be more robust and outperform more complex ones.20 So I personally think that policymaking initiatives should ensure that sufficient attention is placed at striking the right balance between risk sensitivity, simplicity and comparability.

    Conclusion

    In conclusion, the Committee will continue to be guided by its mandate of strengthening the regulation, supervision and practices of banks worldwide. In the near term, when it comes to Basel III, all GHOS members have unanimously reaffirmed their expectation of implementing all aspects of the framework in full, consistently and as soon as possible.21

    More generally, fulfilling our mandate requires us all to remember that:

    • Banks’ boards and senior management are the captains of their ships. You have both the primary and ultimate responsibility for overseeing and managing risks. Regulation and supervision can provide safeguards, but cannot and should not be a substitute for your role in managing your risks prudently.
    • Global bank prudential standards are a public good. We are collectively all better off in a world with global standards than in an autarkic one. Lobbying for deviations at a national level can perhaps provide short-term (private) gains but will ultimately threaten global financial stability. As internationally active banks, it is not in your interest to sail in such an environment.
    • We cannot forget the lessons from past banking crises to prepare effectively for the future. In a financial system undergoing profound structural transformations, such as the digitalisation of finance, the Committee should keep an open mind as to whether additional adjustments to the Basel Framework are warranted over the medium term. And we will focus on global financial stability issues that require a global response.

    As Chair, I am fully committed to leading the Committee in that direction.

  • MIL-OSI Australia: Qube’s proposed acquisition of MIRRAT raises preliminary concerns

    The ACCC has published a Statement of Issues outlining preliminary competition concerns with Qube Holdings Limited’s (ASX:QUB) proposed acquisition of Melbourne International RoRo & Auto Terminal Pty Ltd (MIRRAT).

    The ACCC is also seeking views on a court-enforceable undertaking offered by Qube, which it has put forward to remedy competition concerns.

    MIRRAT operates the automotive/Roll-on Roll-off terminal at Webb Dock West in Melbourne. The proposed acquisition would permit Qube to acquire sole operating rights for roll-on roll-off trade through the Port of Melbourne.

    Qube, through its wholly owned subsidiary, Australian Amalgamated Terminals Pty Ltd (AAT), operates automotive cargo terminals at the Port of Brisbane and Port Kembla, as well as a general cargo terminal at Appleton Dock at the Port of Melbourne.

    Qube is Australia’s largest provider of import and export logistics services including port-related activities of terminal management, stevedoring, processing, pre-delivery inspection (PDI) and delivery. 

    Webb Dock West is the key facility for the processing of automotive and roll on-roll off cargo through the Port of Melbourne, according to feedback received by the ACCC.

    “The proposed acquisition would result in Qube, which is one of Australia’s largest integrated terminal and freight logistics providers, owning a further interest in a critical component of the automotive delivery supply chain at the Port of Melbourne,” ACCC Commissioner Dr Philip Williams said.

    “We are concerned that the proposed acquisition may have a significant effect on competition in downstream services such as automotive stevedoring and pre-delivery inspection (PDI) services.”

    “If this transaction goes ahead, Qube would be operating the terminal while also being in active competition with other automotive stevedores or PDI providers,” Dr Williams said.

    The ACCC is concerned that Qube could raise the costs of access for rival stevedores and PDI operators, preventing them from competing effectively.

    Qube could do this by restricting access to the terminal or related services, raising prices and lowering the quality of terminal services.

    Concerns were also raised with the ACCC that Qube would have access to rivals’ commercially sensitive information as the terminal operator.

    Proposed undertaking

    Qube’s proposed undertaking, which would vary the current court-enforceable undertakings in place at Port Kembla and Port Brisbane, would:

    • require AAT to not discriminate between terminal users in favour of its own interests in the automotive supply chain by providing for certain price and non-price dispute resolution processes, ring fencing certain confidential information and report periodically on its compliance with the undertaking
    • provide independent oversight (including by an independent auditor), and
    • impose restrictions on AAT’s ability to introduce or change certain tariffs.

    “We are now seeking feedback on both the preliminary competition concerns associated with the acquisition identified in the Statement of Issues and the proposed undertaking, which has been put forward by Qube,” Dr Williams said.

    “While the ACCC has decided to publicly consult on the undertaking, this should not be interpreted to mean that this or any undertaking will ultimately be accepted.”

    The ACCC invites submissions in response to the Statement of Issues by 7 November 2024.

    Background

    MIRRAT’s ultimate parent company is Wallenius Wilhelmsen ASA (WW). WW is a Norway-based global provider of roll on roll off shipping and vehicle logistics and operates automotive terminals in Europe, the UK, the US and the Asia-Pacific. MIRRAT’s only operation in Australia is the automotive/RoRo terminal at Webb Dock West.

    MIRRAT operates Webb Dock West subject to a section 87B undertaking accepted by the ACCC on 27 March 2014 (MIRRAT Undertaking). The MIRRAT Undertaking was accepted by the ACCC in relation to MIRRAT’s acquisition of a long-term lease to operate the Webb Dock West Roll on Roll off terminal at Port Melbourne. The MIRRAT Undertaking commenced on 1 January 2018. It expires when MIRRAT ceases to operate the Terminal, which may occur on or before 30 June 2040, and when the ACCC confirms this in writing.

    The MIRRAT Undertaking includes a provision regarding change of control of MIRRAT’s business (that is, the operation of the Roll On Roll Off terminal at Webb Dock West). Under the change of control provision, control of the operation of the automotive terminal at Webb Dock West may only change to a new person or entity, if that person or entity has given a s87B undertaking to the ACCC that:

    • requires it to comply with the same obligations as are imposed on MIRRAT pursuant to the MIRRAT Undertaking, or
    • on terms that are otherwise acceptable to the ACCC,

    unless the ACCC has notified MIRRAT in writing that a s87B undertaking under the change of control provision is not required.

    Qube is Australia’s largest integrated provider of import and export logistics services. Its port-related activities include facilities management, stevedoring, processing, PDI and delivery. It manages and develops strategic properties such as inland rail terminals and related logistics facilities. It provides road and rail transport of freight to and from ports, operation of container parks, customs and quarantine services, warehousing, intermodal terminals, and international freight forwarding.

    In addition to being a terminal operator, Qube provides general stevedoring, automotive stevedoring and PDI services at each of its eastern seaboard ports. It provides general and automotive stevedoring through its affiliated entity ‘Qube Ports’. Qube provides PDI services through its 50% interest in K Line Auto Logistics which owns and operates PrixCar.

    AAT (Qube) operates automotive cargo terminals in Port of Brisbane and Port Kembla, as well as a general cargo terminal at Appleton Dock in Port of Melbourne.  The facilities are operated under a s87B undertaking accepted by the ACCC in 2016 (AAT Undertaking).

    The AAT Undertaking was accepted in relation to Qube’s acquisition of a 50 per cent shareholding in AAT, resulting in Qube holding 100 per cent of AAT. The AAT Undertaking commenced on 23 November 2016 (and was varied on 25 June 2018). It has no end date.

    The AAT Undertaking requires that any stevedore or transport operator may apply to have access to the site to service their customers. The access is on a non-discriminatory basis so that all parties are provided services to the same level. Stevedores or transport operators seeking access to the terminal can apply through AAT who will provide a stevedore licence or permit access to approved applicants. The full text of the AAT Undertaking can also be found on the ACCC’s s87B undertakings register.

    The proposed acquisition will give rise to a Change of Control for the purpose of the MIRRAT Undertaking. AAT does not propose to enter a section 87B undertaking with identical terms to the MIRRAT Undertaking. Instead, AAT (Qube) proposes that its operation of the Terminal would be subject to the AAT Undertaking already in place for its existing terminals with additional clauses including in relation to the Price Dispute Resolution Process.

    Equinor (OSE: EQNR, NYSE: EQNR) delivered adjusted operating income* of USD 6.89 billion and USD 2.04 billion after tax in the third quarter of 2024. Equinor reported net operating income of USD 6.91 billion and net income at USD 2.29 billion. Adjusted net income* was USD 2.19 billion, leading to adjusted earnings per share* of USD 0.79.

    Operational performance

    Equinor delivered a total equity production of 1,984 mboe per day in the third quarter, down from 2,007 mboe in the same quarter last year.

    On the Norwegian continental shelf (NCS), production increased by 2 percent compared to the third quarter 2023. This was due to high gas production from the Troll field and positive contributions from Aasta Hansteen and Oseberg. The increase was partially offset by extensive turnarounds, natural decline and reduced ownership in the Statfjord area.

    Internationally, new wells contributed positively to the production. However, the international production was negatively impacted by offshore turnarounds and hurricanes in the United States.

    In the quarter, Equinor completed nine offshore exploration wells with one commercial discovery. Four wells were ongoing at the quarter end. Two wells were expensed.

    Equinor produced 677 GWh from renewable assets in the third quarter, up 82 percent from the same quarter last year. The increase was driven by the addition of onshore power plants in 2024. The offshore wind parks Dudgeon, Sheringham Shoal and Arkona also contributed positively to the production.

    The progress at Dogger Bank A is slower than expected. Based on this, the expected growth in power production from renewable assets in 2024 is adjusted to around 50 percent.

    Strategic progress

    Equinor continued to optimise the portfolio through projects and strategic business development in the quarter.

    On the NCS, the Johan Castberg production vessel was securely anchored at the field in the Barents Sea and hook-up is on track for production start before year-end. In the quarter, Troll B and C became partly powered from shore, contributing to the company’s efforts to strengthen competitiveness and halve operated emissions by 2030.

    The recent acquisition of a 9.8 percent stake in Ørsted, gives Equinor exposure to premium offshore wind assets in operation and a solid project pipeline. In the quarter, Equinor also won an offshore wind lease in the U.S. Atlantic Ocean at an attractive price, adding optionality of around 2 gigawatt capacity to its existing portfolio. Furthermore, the company started recalibrating its portfolio of early phase renewable projects to reduce cost and focus business development toward core markets.

    Equinor continues to progress its low carbon solutions portfolio. The Northern Lights facility was completed on estimated time and budget. In the UK, two key partner-operated low-carbon solution projects secured funding from the government.

    Solid financial results

    Equinor delivered adjusted operating income* of USD 6.89 billion. USD 5.88 billion come from Exploration and Production Norway, USD 407 million from E&P International and USD 207 million from E&P USA. Marketing, Midstream & Processing delivered adjusted operating income* of USD 545 million, driven by LNG, power trading and geographical arbitrage for LPG. Adjusted operating income* from Renewables was negative USD 115 million, as the costs of project development exceeded the earnings from assets in operation.

    Cash flow from operating activities before taxes paid and working capital items amounted to USD 9.23 billion for the third quarter. Cash flow from operations after taxes paid* was USD 6.25 billion for the quarter, and USD 14.0 billion year to date.

    Equinor paid one NCS tax instalment of USD 2.87 billion in the quarter and total capital expenditures were USD 3.14 billion. Organic capital expenditure* was USD 3.08 billion for the quarter and USD 8.73 billion year to date. The organic capital expenditure* guiding for the year is adjusted to USD 12-13 billion. After taxes, capital distribution to shareholders and investments, net cash flow* ended at negative USD 3.42 billion in the third quarter. The Norwegian state’s share of the share buy-back programme of USD 4.02 billion in July impacted the net cash flow*.

    Adjusted net debt to capital employed ratio* was negative 2.0 percent at the end of the third quarter, compared to negative 3.4 percent at the end of the second quarter of 2024.

    Capital distribution

    The board of directors has decided an ordinary cash dividend of USD 0.35 per share and an extraordinary cash dividend of USD 0.35 per share for the third quarter of 2024. This is in line with communication at the capital markets update in February.

    The board has decided to initiate a fourth and final tranche of share buy-back for 2024 of up to USD 1.6 billion. The fourth tranche will commence on 25 October and end no later than 31 January 2025. This fourth tranche will complete the announced share buy-back programme of up to USD 6 billion for 2024. It will also conclude total capital distribution for 2024 of around USD 14 billion.

    The third tranche of the share buy-back programme was completed on 16 October 2024 with a total value of USD 1.6 billion.

    All share buy-back amounts include shares to be redeemed by the Norwegian state.

    The UK’s Permanent Representative to the World Trade Organization (WTO) and UN in Geneva, Simon Manley, gave a statement during The Maldives Trade Policy Review.

    Chair, let me offer a warm welcome to the delegation from the Maldives led by the Minister of State. Let me also express my gratitude, both to him and his team for their report and to the WTO Secretariat, for their report. I also thank you Chair, for your very good introduction and let me also pay tribute to our Discussant, my very good friend, Ambassador Murdoch, for an intervention. If I may say, for those of us that are of a cricketing bent, Ambassador, combined the elegance and power of your good friend Sir Viv Richards with the intellectual rigour of my own hero Mike Brearley.

    Reports analysis

    1. Chair, the Maldives experience exemplifies the benefits of open trade to sustainable development. You spoke of it as a shining example, I would agree with that. That openness has clearly been a factor in enabling significant infrastructure development, an increasingly diverse tourism sector (in which so many of us aspire to be customers) and a highly sustainable fishing industry – to which both the Minister and Ambassador Murdoch paid tribute.

    2. While the COVID-19 pandemic had a severe impact on the Maldives’ economy, as it did on ours and so many around this organisation, the tourism industry clearly drove forward a strong recovery. A tourism industry which is deeply appreciated by Brits, who come in such droves that the UK consistently features in the top four nationalities visiting your country. You may detect a theme here, Minister.

    3. The reports also demonstrate the continued strength in the Maldives’ trade in services sector, which increased by 47% from 2017 to 2022, driven by a 64% increase in travel service exports. If I may say, yet another example of how trade in services can drive sustainable development in developing countries, which I think is a wider point for this organisation.

    4. Redistribution of that revenue from trade has allowed Maldives, as others have said, to transform from an LDC to an upper middle-income country, classed as a high human development country according to the Human Development Index. So congratulations Minister, congratulations to you, your government and your team here.

    Bilateral trade

    1. Chair, as a fellow Commonwealth member, indeed you, the Maldives, and Ambassador Murdoch, we are coming together in Samoa for the Commonwealth Heads of Government meeting (CHOGM), the UK – Maldives relationship is marked by rich, historical and contemporary ties that are woven into every facet of the enduring friendship between our Governments, our businesses and our people.

    2. We collaborate closely on governance, security, counter terrorism, climate change, environmental protection. And if I may venture out of this building for a second, also on Human Rights, where if I may say, Maldives has played such an important role here in Geneva, punching well above its weight, particularly in its support to fellow SIDS and LDCs, through its role as the co-chair of the Contact Group on HRC membership. And, of course, trade are key areas of collaboration between our two nations. And they are areas of partnership which we will both be seeking to strengthen in Samoa this week.

    3. Protecting the Maldives’ thriving marine biodiversity, is a key objective in our relationship – not just for the enjoyment of the British tourists but also for the future and preservation of our planet. We have a shared interest in the entry to force of Fish I and the early conclusion of Fish II.

    4. Our ties extend to our businesses as well. Total trade in goods and services between the UK and Maldives was worth over half a billion pounds in the four quarters to the end of Q1 2024, and we are proud to be the third largest market for the Maldives’ merchandise exports, those fisheries that Ambassador Murdoch referred to.

    5. A British Business Group was launched in May 2024, as an opportunity to promote trade, and foster business and commercial partnerships and other links between our two nations.

    Business environment and women in trade

    1. Chair, let me encourage Maldives to continue its work to promote a business-friendly environment that supports economic diversification. And if I may add, with two hats, both as UK PR and co-chair on the working group on trade and gender we value its efforts in advancing women’s economic empowerment and its engagement on trade and gender equality at the WTO.

    2. Equally, let me highlight the SME Development Financing Corporation, established by the Maldives in 2019 to support financial inclusion for MSMEs, women and youth, again very admirable initiatives.

    UK support programmes [the Maldives Development Partnership]

    1. As I previously alluded to, a key area of partnership between our two nations is through our mutual environmental objectives. Under the Blue Planet Fund, the Ocean Country Partnership Programme focuses extensive work on Marine Pollution and Biodiversity. Meanwhile the Climate Action for a Resilient Asia programme is funding a Climate Finance Network programme on transforming the Blue Economy with Maldives MSME Empowerment and Blended Finance.

    2. This year, in these few weeks ahead of us, when we have the three Rio Convention COPs meeting in quick succession, it is essential that we work together to deliver on our commitments across all issues of environmental sustainability, an issue of such critical importance to the Maldives, as the Minister reminded us at the start.

    WTO and multilateral institutions

    1. The continued commitment Maldives has shown to the Multilateral Trading System, as a founding member of the WTO, and, more recently, Maldives’ engagement with discussions on environmentally sustainable trade practices is welcome. Others have suggested other areas where we could increase that participation here.

    2. We have also been pleased to see the progress that Maldives have made on the ratification of the Trade Facilitation Agreement, supported, I might add by the UK’s Accelerate Trade Facilitation programme. Just this month British colleagues were in Maldives for the validation of their National Trade Facilitation roadmap. We look forward to working with the Maldives to implement further measures.

    3. Fisheries, as we’ve reflected, is a huge pillar of the Maldivian economy, and the practice of pole and line fishing is one of the most sustainable methods for fishing. We urge Maldives to ratify Fish I, which will help us to deliver on SDG mandate 14.6. The UK is fully behind Maldives, and others, not least our distinguished permanent representative from Iceland, in securing agreement on the second phase of negotiations on Fisheries Subsidies at the very earliest possible opportunity.

    Conclusion

    1. In conclusion, Chair, let me thank you, the Discussant, and the whole delegation from the Maldives for your work on this Review and the accompanying Reports.

    2. Chair, Maldives is known as a beautiful holiday destination – many newlyweds travel from far and wide to see the rare white sands beaches and diverse sea life.     24 OCTOBER 2024 – Equinor delivered adjusted operating income* of USD 6.89 billion and USD 2.04 billion after tax in the third quarter of 2024. Equinor reported net operating income of USD 6.91 billion and net income at USD 2.29 billion. Adjusted net income* was USD 2.19 billion, leading to adjusted earnings per share* of USD 0.79.

    Operational performance

    Equinor delivered a total equity production of 1,984 mboe per day in the third quarter, down from 2,007 mboe in the same quarter last year.

    On the Norwegian continental shelf (NCS), production increased by 2 percent compared to the third quarter 2023. This was due to high gas production from the Troll field and positive contributions from Aasta Hansteen and Oseberg. The increase was partially offset by extensive turnarounds, natural decline and reduced ownership in the Statfjord area.

    Internationally, new wells contributed positively to the production. However, the international production was negatively impacted by offshore turnarounds and hurricanes in the United States.

    In the quarter, Equinor completed nine offshore exploration wells with one commercial discovery. Four wells were ongoing at the quarter end. Two wells were expensed.

    Equinor produced 677 GWh from renewable assets in the third quarter, up 82 percent from the same quarter last year. The increase was driven by the addition of onshore power plants in 2024.     Frontex co-led a large-scale international operation targeting maritime drug smuggling. The action was run by Belgian Customs from 16 September to 15 October 2024 under the Cannabis, Cocaine, and Heroin EMPACT priority.  

    The operation focused on combating cocaine smuggling via sea from Latin America to European countries, monitoring and inspecting vessels to detect cocaine smuggled via methods like drop-off/handover at sea, underwater attachment, and rip-on at sea. 

    It involved 12 European countries, the USA, Europol, and MAOC (N). It led to impressive results: seizing 930 kg of cocaine and 4,950 kg of hashish, as well as 4 arrests. Of the 525 ships analysed, 73 were checked. 

    Frontex provided technical and operational support with the deployment of an underwater drone, vessel trackers, analysts and Cross Border Crime Detection Officers to assist with rummaging and control inspections. Aerial surveillance was conducted jointly by Belgium and Frontex with daily flights, contributing to the operation’s success.

    MAJOR RISKS AND UNCERTAINTIES

    Trainers’ House’s business is sensitive to economic fluctuations.

    The general economic situation internationally and in Finland contains significant risks. The war in Europe and Middle East, the tense world political situation and the possible expansion of the crisis can cause rapid changes in the operating environment.

    Possible world trade restrictions and changes in the world political situation affect the exports of Finnish companies, which is reflected in the demand of the domestic market. The demand in domestic market will also diminish due to public cost-cuttings and tax increases. The change in domestic market demand directly affects Trainers’ House’s business.

    Compared to the level of the last decade, the high interest rate has a negative effect on economic activity. Inflation can also accelerate due to, for example, escalation of world political crises.

    The constant competition for the best employees affects recruitment and the commitment of key personnel. From the company’s point of view, the labor market situation has eased over the past year.

    The above-mentioned risks, when realized alone or together, have a significant impact on the company’s operations.

    The company divides the risk factors affecting business, earnings, and market capitalization into five main categories: market and business risks, personnel-related risks, technology and information security risks, financial risks, and legal risks.

    Trainers’ House has sought to hedge against the adverse effects of other risks with comprehensive insurance policies. These include statutory insurance, liability and property insurance and legal expenses insurance. Insurance coverage, insurance values and deductibles are reviewed annually together with the insurance company.

    The Management Team reports to the Board on a monthly basis on key business-related risks and, where necessary, risk management measures.

    The Group has the reporting systems required for effective business monitoring. Internal control is linked to the company’s vision, strategic goals and the business goals set on the basis of them.

    The realization of business objectives and the Group’s financial development are monitored on a monthly basis through the Group’s corporate governance system. As an essential part of the control system, actual data and up-to-date forecasts are reviewed monthly by the Group Management Team. The control system includes, among other things, sales reporting, an income statement, a rolling revenue and profit forecast, and key figures that are important to operations.

    Trainers’ House is an expert organization. The magnitude of market and business risks is difficult to determine. Typical risks in this area are related to, for example, general economic development, customer distribution, technology choices, the development of competition and the management of personnel costs.

    Risks are managed through the planning and regular monitoring of sales, human resources, and operating expenses, which enables rapid action when circumstances change. The risks of trade receivables have been taken into account by the recognition of expenses based on the age of the receivables and individual risk analyzes.

    The goal of Trainers’ House’s financial risk management is to secure the availability of equity and debt financing on competitive terms and to reduce the impact of adverse market movements on the company’s operations.

    Financial risks are divided into four categories, which are liquidity, interest rate risks, currency risks and credit risks. Each risk is monitored separately. Liquidity and interest rate risks are reduced with sufficient cash resources and efficient collection of receivables. Currency risks are low as Trainers’ House operates primarily in the euro market. In financial risk management, the focus is on liquidity.

    The success of Trainers’ House as an expert organization depends on its ability to attract and retain skilled staff. In addition to a competitive salary, personnel risks are managed through incentive schemes and investments in personnel training, career opportunities and general well-being.

    Technology is a key part of Trainers’ House’s business. Technology risks include, but are not limited to, supplier risk, risks related to internal systems, challenges posed by technological change, and security risks. Risks are protected against long-term cooperation with technology suppliers, appropriate security systems, staff training and regular security audits.

    Trainers’ House’s legal risks are mainly focused on the contractual relationship between the company and customers or service providers. At their most typical, they relate to delivery responsibility and the management of intellectual property rights. In order to manage the risks related to contracts and intellectual property rights, the company has internal guidelines for contractual procedures. In the company’s view, the contractual risks are not unusual.

    At the end of the review period, goodwill and other intangible assets recognized in the balance sheet have been tested in the normal way. The test did not reveal any need for impairment.

    The consolidated balance sheet of Trainers’ House has goodwill of EUR 2.1 million. The balance sheet value of other intangible assets is EUR 1.0 million. If the Group’s profitability does not develop as forecasted or other external factors independent of the Group’s operations, such as interest rates, change significantly, it is possible that goodwill and other intangible assets will have to be written off. Recognition of an impairment loss would have no effect on the Group’s cash flow.

    Due to the project nature of the operations, the order backlog is short, and predictability is therefore challenging.

    The description of potential risks is not comprehensive. Trainers’ House conducts continuous risk assessment in connection with its operations and strives to hedge against identified risks.

    PERSONNEL

    At the end of the review period, the Group had 107 (111) employees. As before, the company reports the number of employees converted to full-time employees.

    DECISIONS REACHED AT THE ANNUAL GENERAL MEETING

    The annual general meeting of Trainers’ House Plc was held on 27 March 2024 in Helsinki.

    The annual general meeting confirmed the financial statements and discharged CEO and the members of the Board of Directors from liability for the fiscal year 1 January – 31 December 2023. The annual general meeting also decided to adopt the remuneration policy of the governing bodies.

    The annual general meeting decided, in accordance with the board’s proposal, that the company does not distribute a dividend from 2023.

    Aarne Aktan, Jari Sarasvuo, Jarmo Hyökyvaara, Elma Palsila and Emilia Tauriainen were re-elected as members of the Board of Directors. In the board meeting held after the annual general meeting, the Board of Directors elected Jari Sarasvuo as the chairperson of the board.

    The annual general meeting decided that the board member’s remuneration shall be EUR 1,500 per month and the chairperson’s remuneration will be EUR 3,500 per month.

    Grant Thornton Oy was elected as the company’s auditor. The remuneration to the auditor is paid according to the auditor’s reasonable invoice.

    Group revenue was €2,305 million in Q3 2024, down -4.4% organically compared with Q3 2023 as expected. Overall, Group revenue in the third quarter reflects softer market conditions and is consistent with the business plan communicated on Sept 2nd.

    Eviden revenue was €1,093 million, down -6.4% organically.

    • Digital activities decreased high single-digit. The business was impacted by the general market slowdown in Americas and Central Europe and previously-established contract scope reductions.
    • Big Data & Security (BDS) revenue was roughly stable organically. In Advanced Computing, stronger activity in Denmark and France was offset by a high comparison basis in the prior year. Revenue in Digital Security slightly decreased, despite the growth of Mission Critical Systems, notably in Central Europe.

    Tech Foundations revenue was €1,212 million, down -2.6% organically.

    Americas revenue decreased by -10.5% on an organic basis, reflecting the current general slowdown in market conditions and previously-established contract terminations and completions.

    • Eviden was down double-digit, impacted by contract terminations and volume decline in Healthcare, Finance, and Transport & Logistics. BDS declined high single-digit due to volume reductions.
    • Tech Foundations revenue declined mid single-digit due to contract completions and terminations as well as scope reductions with select customers.

    Northern Europe & Asia-Pacific revenue decreased by -6.6% on an organic basis.

    • Eviden revenue declined mid-single-digit. A revenue increase at BDS due to new business in Advanced Computing with an innovation center in Denmark was offset by the decline of Digital revenue, reflecting a lower demand from Public Sector customers in the UK.

    Southern Europe revenue was down -0.7% organically.

    Book-to-bill ratio for the Group was 66% in Q3 2024, down from 84% in Q3 2023, reflecting softer market conditions and delays in contract awards as clients await the final resolution of the Group’s refinancing plan. This ratio is in line with the book-to-bill ratio for Q3 2023, excluding exceptionally large contract7.

    Book-to-bill ratio at Eviden was 73%. Main contracts signatures during the third quarter included the supply of an HPC to a leading player in the Aerospace sector, another HPC contract signed with a major French utility provider, together with control room utility solutions.

    Book-to-bill ratio at Tech Foundations was 60%, consistent with the seasonality observed in previous years, in particular in Q3 2021 (54%) and in Q3 2022 (58%). Main contracts signatures in the third quarter included several renewals to provide Hybrid Cloud & Infrastructure services in Financial Services, Public Sector, and Manufacturing industries.

    Stronger commercial activity is expected in the coming months in both Eviden and Tech Foundation, which would lead to a significant improvement of the Group book-to-bill ratio in the fourth quarter, as confidence in the Group’s financial sustainability has been restored.

    At the end of September 2024, the full backlog was €14.7 billion representing 1.4 years of revenue. The full qualified pipeline amounted to €5.7 billion at the end of September 2024.

    Human resources

    The total headcount was 82,211 at the end of September 2024, decreasing by -10.3% since the end of June 2024. Following contract completions in Americas and the UK, the Group transferred circa 4,900 employees to the new providers. Excluding these transfers, headcount has decreased by circa -5%.

    During the third quarter, the Group hired 1,839 staff (of which 91% were Direct employees), while attrition rate increased compared with Q2. The attrition rate over the past 9 months is in line with normal historical levels.

    Q3 cash position

    As of September 30, 2024, cash & cash equivalents was €1.1 billion, down €1.2 billion compared with December 31, 2023 primarily reflecting €1.6 billion lower working capital actions compared with the end of fiscal 2023 and €1.1 billion of new borrowings.

    As of September 30, 2024, net debt was €4.6 billion compared with €2.2 billion at the end of last year, reflecting primarily the reduction of working capital optimization down to €265 million.

    Cash consumption was €-3 million in the third quarter, excluding change in working capital optimization of €232 million.

    Full year 2024 outlook

    The Group expects for the full year 2024:

    • Mid-single-digit organic revenue decrease, corresponding to revenue of circa €9.7 billion
    • Operating margin of circa €238 million excluding additional provisions to be booked for some underperforming contracts8
    • Change in cash before debt repayment of circa €-783 million excluding the full unwind of the working capital optimization of circa €1.8 billion as of December 31, 2023.

    Financial restructuring process

    Atos expected to receive today the decision from the Court on its pre-arranged financial restructuring plan.

    Assuming the plan is accepted by the court, the next steps of the financial restructuring process would be as follows:

    November 12 – 22:
    • €233 million rights issue with preferred subscription rights
    Mid to end December:
    • Execution of concomitant reserved capital increases
    End of December 2024 or early 2025
    • Receipt of €1.5bn to €1.7bn of new money debt
    • Closing of the restructuring process

    Asset disposal processes

    The discussions with Alten regarding the sale of the Worldgrid business are progressing well and are on track.

    Following the communication issued on October 7, discussions related to the potential acquisition by the French state of the Advanced Computing, Mission-Critical Systems and Cybersecurity Products businesses of BDS are continuing based on a new proposal compatible with the financial restructuring plan of the Company.

    As communicated on October 15, 2024, Philippe Salle has been appointed as Chairman of the Board of Directors of the Company with immediate effect and as Chairman and Chief Executive Officer with effect from February 1, 2025.

    For the analysis of the Group’s performance, revenue is compared with Q3 2023 revenue at constant scope and foreign exchange rates. Reconciliation between the Q3 2023 reported revenue and the Q3 2023 revenue at constant scope and foreign exchange rates is presented below.

    In 2023, the Group reviewed the accounting treatment of certain third-party standard software resale transactions following the decision published by ESMA in October 2023 that illustrated the IFRS IC decision and enacted a restrictive position on the assessment of Principal vs. Agent under IFRS 15 for such transactions. The Q3 2023 revenue is therefore restated by €-15 million. The restatement impacted Eviden in the Americas RBU without impacting the operating margin.

    Scope effects on revenue amounted to €-154 million. They mainly related to the divesture of UCC across all regions, EcoAct in Americas, Southern Europe and Northern Europe & Asia-Pacific, State Street JV in Americas and Elexo in Southern Europe.

    Currency effects negatively contributed to revenue for €-10 million. They mostly came from the depreciation of the American dollar, Argentinian peso, Brazilian real, and Turkish lira, not offset by the appreciation of the British pound.

    eQ Community Properties Fund (AIF) has entered into a EUR 154 million senior secured loan arrangement with Deutsche Bank AG. The collateral portfolio consists of community and healthcare assets in the Helsinki Metropolitan Area and Tampere.

    In June, the fund also extended a EUR 253 million senior secured loan facility with its current lenders Nordea Bank, Danske Bank, Swedbank and Aktia.

    Through the recent successful arrangements, the Fund has broadened and strengthened its lender base, secured a long-term financing as well as extended its loan maturities and fixed interest periods.

    Today, World Polio Day, 24 October 2024, the Medicines and Healthcare products Regulatory Agency (MHRA) is highlighting our work training multiple World Health Organisation (WHO) polio laboratories around the world using an advanced molecular direct detection method that can halve detection times – supporting the global effort to eradicate polio and helping save lives.

    In collaboration with Imperial College London, the University of Edinburgh, Biosurv International and funded by the Bill and Melinda Gates Foundation, we have trained 25 countries in just over one year on the use of a technique called Direct Detection by Nanopore Sequencing (DDNS). This method can speed up the detection of polio outbreaks, saving public health authorities crucial time and money. This includes training laboratories in Pakistan, one of the last two countries where polio remains endemic, with the number of cases increasing this year.

    It is vitally important to detect polio early, as the infection moves rapidly within a population. By the time the first signs of polio appear in a country, many hundreds of people are typically already infected and can unknowingly pass on the virus to others who may not be fully vaccinated and protected. The virus – most commonly transmitted through contact with infected faeces via contaminated food and water – multiplies in the intestine, from where it can invade the nervous system and cause paralysis.

    Training worldwide in-country laboratories in rapid detection – using the DDNS method –enables samples to be tested in the country where the outbreak originated, rather than being sent to specialist laboratories abroad. This means the costs and delays of transport and testing can be reduced from an average of 42 days to an average of 19 days – a time saving that saves lives.

    A study published in Nature Microbiology last year, showed that our research, jointly conducted with partners, using the DDNS method to detect polio outbreaks can halve the detection time. This research indicated that DDNS tests done locally, in the Democratic Republic of Congo, over a six-month period were an average of 23 days faster than the standard method, with over 99% accuracy.

    Training laboratories in the DDNS method takes one to two weeks and is carried out by scientists from the MHRA, as well as colleagues from Imperial College London. It involves a combination of theoretical and practical sessions covering all aspects of the DDNS method from sample processing, nucleic acid extraction, PCR amplification, sequencing, analysis and interpretation of results.

    The training also encompasses methodological troubleshooting and utility of the detailed quality assurance programme associated with the method. The University of Edinburgh provides the bioinformatics expertise and have created purpose-designed analytical software to process the sequencing data produced by the method. Biosurv International support supply chains and participate in training and quality control review of data. 

    Javier Martin, Principal Scientist in Virology at the MHRA said:

    This worldwide training in the DDNS method for rapid detection of polio is a key strand in the global fight to eradicate polio, alongside vaccination programmes.

    Carrying out this work with our partners, which is the result of years of research, plays an essential part in managing outbreaks that threaten the global eradication effort and will help make polio a disease of the past.

    We are already initiating collaboration with laboratories in Africa training them to monitor different virus threats, such as Hepatitis E. The potential use of this faster detection technique has almost limitless possibilities for the protection of global health.

    Dr Alex Shaw, Research Fellow in the School of Public Health at Imperial College London talked about the potential that this DDNS method has for use with other diseases:

    The WHO has identified delays in detection as one of the major challenges facing their Polio eradication strategy 2022–2026. Training 25 countries in the past year to detect polio faster allows us to identify where outbreaks are and which polio strain is present much more quickly, allowing us to act at the earliest opportunity.

    This advanced sequencing technology is not only being used to strengthen poliovirus surveillance but is also easily adapted for the detection of other organisms. The worldwide training programme will, therefore, provide a foundation of skills and experience that can be redirected to the genomic surveillance of other pathogens, as needed.

    The most recent laboratory training programme was conducted in Angola and Tanzania and included scientists from Angola, Mozambique, Tanzania, Eritrea, Malawi and Rwanda. We conducted training at the MHRA South Mimms site for European laboratories in June 2024 (Germany, France, Finland, Netherlands, Italy and Ukraine).

    Scientists at the MHRA and their partners will continue to support the testing and validation of DDNS as a polio detection technique and to train WHO laboratories around the world in how to use it. We will travel to Thailand in mid-November 2024 to train scientists from Thailand, India and Indonesia. Additional training activities and implementation visits are planned for 2025 onwards.

  • MIL-OSI United Kingdom: Joint statement on the human rights situation in Xinjiang and Tibet

    Joint statement delivered by Australia, Canada, Denmark, Finland, France, Germany, Iceland, Japan, Lithuania, Kingdom of the Netherlands, New Zealand, Norway, Sweden, United Kingdom and the United States of America in the UN Third Committee General Discussion.

    I have the honour of delivering this joint statement on behalf of Canada, Denmark, Finland, France, Germany, Iceland, Japan, Lithuania, Kingdom of the Netherlands, New Zealand, Norway, Sweden, United Kingdom, United States of America, and my own country, Australia.

    These countries are all committed to universal human rights and have ongoing concerns about serious human rights violations in China.

    Two years ago, the United Nations Office of the High Commissioner for Human Rights’ assessment on Xinjiang concluded that serious human rights violations had been committed in Xinjiang, and that the scale of the arbitrary and discriminatory detention of Uyghurs and other predominantly Muslim minorities in Xinjiang “may constitute international crimes, in particular crimes against humanity”. 

    Subsequently, United Nations Treaty Bodies have taken similar views and made similar recommendations, including the CERD in November 2022 through its concluding observations and Urgent Action Decision on Xinjiang; and the CRPD, CESCR and CEDAW in their September 2022, March 2023 and May 2023 Concluding Observations.

     The Working Group on Arbitrary Detention has issued communications concerning multiple cases of arbitrary detention and enforced disappearances, and over 20 Special Procedure Mandate Holders have expressed concern about systemic human rights violations in Xinjiang.

    Relying extensively on China’s own records, these comprehensive findings and recommendations by independent human rights experts from all geographic regions detail evidence of large-scale arbitrary detention, family separation, enforced disappearances and forced labour, systematic surveillance on the basis of religion and ethnicity; severe and undue restrictions on cultural, religious, and linguistic identity and expression; torture and sexual and gender-based violence, including forced abortion and sterilisation; and the destruction of religious and cultural sites. 

    China has had many opportunities to meaningfully address the UN’s well-founded concerns.

    Instead, China labelled the Office of the High Commissioner for Human Rights’ assessment as “illegal and void” during its Universal Periodic Review adoption in July.

    According to the Office of the High Commissioner for Human Rights’ statement in August, the problematic laws and policies in Xinjiang continue to remain in place. The statement again called on China to undertake a full review, from the human rights perspective, of the legal framework governing national security and counterterrorism.

    Chair, as with our concerns for the situation in Xinjiang, we are also seriously concerned about credible reports detailing human rights abuses in Tibet.  

    United Nations Human Rights Treaty Bodies and United Nations Special Procedures have detailed the detention of Tibetans for the peaceful expression of political views; restrictions on travel; coercive labour arrangements; separation of children from families in boarding schools; and erosion of linguistic, cultural, educational and religious rights and freedoms in Tibet.

    We urge China to uphold the international human rights obligations that it has voluntarily assumed, and to implement all UN recommendations including from the Office of the High Commissioner for Human Rights’ assessment, Treaty Bodies and other United Nations human rights mechanisms.

    This includes releasing all individuals arbitrarily detained in both Xinjiang and Tibet, and urgently clarifying the fate and whereabouts of missing family members.

    Transparency and openness are key to allaying concerns, and we call on China to allow unfettered and meaningful access to Xinjiang and Tibet for independent observers, including from the United Nations, to evaluate the human rights situation.

    No country has a perfect human rights record, but no country is above fair scrutiny of its human rights obligations.

    It is incumbent on all of us not to undermine international human rights commitments that benefit us all, and for which all states are accountable.
