  • MIL-OSI USA: Budd Joins Bipartisan Effort to Address Avian Flu Outbreak

    Washington, D.C. — Senator Ted Budd (R-NC) has joined a letter to the new Secretary of the U.S. Department of Agriculture (USDA) Brooke Rollins laying out a roadmap to enhance the agency’s response to the ongoing outbreak of highly pathogenic avian influenza (HPAI).

    The letter was led by Senators Joni Ernst (R-IA) and John Fetterman (D-PA) and co-signed by a total of 16 Senators.

    Congratulations on your confirmation as Secretary of Agriculture. We know many pressing concerns await you as you begin your new role. We write to ask that you enhance the U.S. Department of Agriculture’s (USDA) response to the ongoing outbreak of highly pathogenic avian influenza (HPAI) in our nation’s animal agriculture sector, which we greatly appreciate you announcing as a top priority in your testimony before the Senate Committee on Agriculture, Nutrition, and Forestry.

    The United States is now entering the fourth year of an outbreak of HPAI that has devastated farms, required the depopulation of more than 136 million birds on commercial poultry operations, and infected a small but growing number of farm workers. A new urgency is required from the USDA to address the evolving situation.

    We support measures that have been proposed to you by egg and turkey farmers, many of whose operations have suffered HPAI outbreaks. These measures include the following:

    • An aggressive, forward-looking strategy for vaccination in affected laying hens and turkeys, including the acquisition of vaccine stockpiles, field trials of vaccines, the development of more practical methods of vaccine administration, and outreach to trading partners to ensure trade is not significantly impacted and that they understand the need for vaccines and abide by international standards for maintaining trade.
    • An HPAI Strategic Initiative to engage experts within industry, universities, and government to expand knowledge and develop novel methods of prevention, detection, and response.
    • Movement controls that apply to all animals that present risks and support for states moving quickly through the first four stages of USDA’s National Milk Testing Strategy.

    Two related matters also require USDA’s attention. First, an interim rule issued in December 2024 requires biosecurity audits on previously infected farms, or farms placed within a buffer zone of a control area, to be eligible for indemnities. In principle, this change would appear to enhance biosecurity measures and accountability for indemnity, but the rule was rushed. As a result, nearly no auditors have been trained to complete these audits, and the audit itself was posted in draft form. USDA should provide adequate numbers of qualified auditors prior to enforcement of the rule.

    Second, current indemnity rates for laying hens and pullets are based on inaccurate data and are artificially low. We support a proposal by the egg industry to revise these calculations, relying entirely on data from USDA and land-grant institutions, in order to make indemnities fairer. HPAI indemnities are similar to disaster assistance for crops and livestock—the funds respond to a catastrophic situation that producers could not have averted and never fully make up for the entire loss. The indemnities also recognize that producers are legally compelled to depopulate their flocks in an HPAI infection—they do not have a choice. Even with revisions to indemnity formulas proposed by egg farmers, these payments will not come close to making producers whole for their losses. In reviewing indemnity activities, we would also urge you to ensure proper outreach to all farmers.

    We stand ready to work with you as you provide leadership on this vitally important issue, the largest animal health outbreak that the department has ever dealt with. Thank you for making the HPAI response a priority.

  • MIL-OSI USA: Wyoming Delegation Seeks Resolution to Decades-Old Stalemate in Wyoming Federal Land Management

    WASHINGTON, DC – U.S. Senators John Barrasso and Senator Cynthia Lummis along with U.S. Representative Harriet Hageman, all R-Wyo., reintroduced legislation today that would resolve the management status of thousands of acres of federal public lands in seven counties in Wyoming.

    The bill, which passed the U.S. Senate in December 2024, is the direct result of a collaborative process started under the Wyoming Public Lands Initiative (WPLI). The WPLI was created by the Wyoming County Commissioners Association in 2015 to seek locally driven solutions on the future of federal public lands that have been in management limbo for more than 30 years.

    “For decades, hundreds of thousands of acres of federal land in Wyoming has been locked up as Wilderness Study Areas. Locally driven processes like the Wyoming Public Lands Initiative (WPLI) give people in Wyoming the best chance to decide how to treat these lands,” said Barrasso. “Wyoming’s county commissioners, conservation leaders, and outdoor enthusiasts who participated in the WPLI process spent years carefully crafting this legislation. It strikes a balance between protecting the wild places that people in Wyoming love while expanding multiple-use areas that our state and our local economies depend on.”

    “Wyoming’s Wilderness Study Areas have kept federal lands in limbo status for decades, dramatically limiting access for maintenance and other purposes,” said Lummis. “Our legislation is the result of input from local communities and stakeholders on how we can best manage these lands according to Wyoming’s values.”

    “Our county commissioners have worked for years to require our federal agencies to properly classify the thousands of acres that have been stuck in administrative limbo, and this legislation is the product of a locally driven process to resolve decades of uncertainty on lands in Wyoming,” said Hageman.

    Background

    Wilderness Study Areas (WSAs) are a special designation for lands that are managed to protect wilderness characteristics until Congress specifically designated them as Wilderness or directs the Bureau of Land Management (BLM) to manage the area for multiple uses.

    WSAs were intended to be temporary designations. These particular temporary designations have persisted for more than 30 years.

    In 2015, the Wyoming County Commissioners Association (WCCA) initiated the WPLI to provide a framework for counties to discuss and resolve various public lands issues around the state. The process was intended to focus on resolving the status of the 45 Wilderness Study Areas around Wyoming. It allowed all 23 counties to “opt in/out” of the process based on suitability for their county and to determine the composition and rules of their committees.

    As a result of the WPLI process, the following seven counties in Wyoming have submitted their recommendations that are included in the legislation: Campbell, Carbon, Fremont, Hot Springs, Johnson, Natrona and Washakie counties.

    The legislation includes:

    – 5 wilderness designations totaling 20,381 acres
    – 3 designations of a “Special Management Area” totaling 27,711 acres
    – 10 release and manage as multiple-use totaling 99,750 acres
    – 2 policy directives

    Washington, D.C. During a hearing held today in the Senate Energy and Natural Resources Committee, U.S. Senator Ron Wyden, D-Ore., underscored that Elon Musk’s business dealings in China pose a serious threat to national security. 

    According to public reporting, Elon Musk is running the Department of Government Efficiency (DOGE) as a federal employee while remaining Tesla’s largest shareholder. Public filings indicate Tesla invested billions of dollars in China and annually produces nearly 1 million cars at a factory in Shanghai on land owned by the Chinese government.

    “According to public reporting, Tesla’s contract allows the Chinese government to revoke Tesla’s lease on the land at any time if it determines doing so is in the public interest,” Wyden said. “Now, on this committee, every one of us works for the AMERICAN public interest. And given that is our highest priority, I intend to come back and ask further questions about this in the days ahead.”

    Senator Wyden also questioned Dr. Geraldine Richmond, Presidential Chair in Science at the University of Oregon and former Under Secretary for Science and Innovation at the Department of Energy, on the national security consequences of Musk’s decision to make drastic and abrupt workforce cuts at the Bonneville Power Administration. Dr. Richmond emphasized that these cuts would undermine the grid’s safety and drive up energy prices for working families across America. 

    Last week, Senator Wyden demanded answers from the Trump administration in a letter regarding Musk’s workforce cuts at the Bonneville Power Administration.

    WASHINGTON – U.S. Senators Maggie Hassan (D-NH), Jim Banks (R-IN), and James Lankford (R-OK) are demanding answers from PowerSchool and Bain Capital executives following a significant cyberattack that compromised the personal data of thousands of students and staff nationwide. The Senators cite inadequate cybersecurity measures, delayed notifications, and poor communication from the company, whose software manages sensitive student and staff information for thousands of schools in the United States, including schools across New Hampshire. 

    “We write to express significant concern about the risks that students, staff, and school districts face after malicious actors stole their personal data in a cyberattack on your company’s information systems,” wrote the Senators. “According to recent reports, malicious actors breached PowerSchool’s SIS service and stole this sensitive data, putting students and staff at significant risk of identity theft. School district leaders who we have spoken with raised serious concerns about delays in your company’s response to the cybersecurity incident, including delayed notifications to impacted schools.” 

    “According to reports, your company failed to put in place basic cybersecurity safeguards – such as multi-factor authentication – that could have helped to prevent the cyberbreach,” the Senators continued. “Your company also has not clearly communicated a date by which impacted individuals will receive free identity protection and credit monitoring services. Your delayed and unclear communication is unacceptable, especially given the sensitive nature of the personal data that was stolen. We urge you to immediately notify all impacted individuals and provide them with these protective services.”

    Dear Mr. Gulati and Mr. Ward:

    We write to express significant concern about the risks that students, staff, and school districts face after malicious actors stole their personal data in a cyberattack on your company’s information systems. We urge PowerSchool to immediately notify all students and staff whose personal data may have been compromised, provide impacted individuals with identity protection services free-of-charge as soon as possible, and provide answers to questions regarding your company’s reported cybersecurity failings.

    More than 16,000 customers use PowerSchool’s software products to serve 50 million students in the United States.[1] Schools use PowerSchool’s Student Information System (SIS) service to manage student enrollment, attendance, grades, and records – as well as school staff records. These records could include dates of birth, Social Security numbers, home addresses, health information, and other private, personally identifiable information.

    According to recent reports, malicious actors breached PowerSchool’s SIS service and stole this sensitive data, putting students and staff at significant risk of identity theft. School district leaders who we have spoken with raised serious concerns about delays in your company’s response to the cybersecurity incident, including delayed notifications to impacted schools. While the breach occurred as early as December 19, 2024, you failed to detect it until December 28, 2024.[2] Moreover, you did not notify SIS customers of the incident until January 7, 2025 – nineteen days after the incident.

    Your company also has not clearly communicated a date by which impacted individuals will receive free identity protection and credit monitoring services. Your delayed and unclear communication is unacceptable, especially given the sensitive nature of the personal data that was stolen. We urge you to immediately notify all impacted individuals and provide them with these protective services.

    According to reports, your company failed to put in place basic cybersecurity safeguards – such as multi-factor authentication – that could have helped to prevent the cyberbreach. Moreover, since the cybersecurity incident, PowerSchool has reportedly hired a cybersecurity technology company to conduct an analysis of the incident. This is an important step toward accountability and regaining the trust of your customers and the public. We ask you to be transparent with the analyst’s findings, and we request your prompt and comprehensive answers to the following questions:

    • Please detail the timeline of events from the date that the SIS cybersecurity incident occurred through today.
    • How many individuals across the United States had their data compromised by the December 2024 cyberattack on SIS? Please provide a breakdown of the number of current and former students and school staff who were impacted by state and school district.
    • What assistance have you provided to states, school districts, and schools that were impacted by the data breach, and what supports will you provide them moving forward? 
    • How far back do the compromised records go? For instance, if a school used SIS services 10 years ago but no longer does, was that school impacted by the breach?
    • What assistance have you provided to states, school districts, and schools that no longer have an active SIS contract but are past clients and whose data was compromised?
    • Schools may use several PowerSchool software products. Were any of your other software products compromised by the cybersecurity incident? If so, was student and staff data accessed, and what are your plans to notify and support impacted individuals?
    • Please provide a date by which your company will fulfill its stated commitment to provide two years of complimentary identity protection and credit monitoring services to students and staff whose personally identifiable information was compromised. Do you commit to providing these services to all impacted students and staff even if it is not required by state law or your contracts? Did your company require multi-factor authentication for PowerSchool employees and contractors at the time of the breach? If not, why, and will you commit to requiring the use of this cybersecurity safeguard moving forward?
    • How swiftly did you notify federal, state, and local law enforcement about the cybersecurity incident, and are you cooperating with any investigations they may have underway into the incident?

    Thank you for your attention to this important matter. We ask that you reply no later than March 7, 2025.

  • MIL-OSI USA: Hawley Introduces Bill Demanding Accountability for ‘Every Penny’ of Ukraine Aid

    U.S. Senator Josh Hawley (R-Mo.) reintroduced the Inspector General for Ukraine Act, which would establish a new watchdog dedicated to auditing the billions of American dollars that have gone toward aiding Ukraine. 

    “American taxpayers shouldn’t have to wonder where their billions in aid to Ukraine went and what they’re funding there now. They deserve an accounting of every penny Congress shipped over there,” said Senator Hawley. “Let’s stand with President Trump to get peace in Ukraine and respect the American taxpayer again.”

    Oversight is particularly important given Ukraine’s history of corruption and recent findings exposing U.S. government waste and abuse. Senator Hawley’s legislation would cut through the current bureaucracy by establishing an independent inspector general to better account for every penny spent.  

    As President Trump works to negotiate an end to the war in Ukraine, Senator Hawley’s bill would allow Congress to play a vital role in protecting American taxpayer dollars. 

    Senator Hawley first introduced the legislation in March 2023 but the Democrat-controlled Senate voted down his proposal later that month.

    The Inspector General for Ukraine Act would:

    • Establish the Office of the Inspector General for Ukraine.
    • Empower this new Inspector General to conduct audits, investigations, and other oversight activities in Ukraine and oversee aid programs run by the Defense Department, State Department, and U.S. Agency for International Development.
    • Direct this new Inspector General to submit quarterly reports to Congress, which shall require detailed reports on the contracts and grants the U.S. enters into, the operating expenses of agencies receiving U.S. funds, and the Ukrainian government’s compliance with anti-corruption measures.
    • Authorize funding for these operations using the Ukraine Economic Assistance Fund.

    [WASHINGTON, D.C.] – Today, combat Veteran and U.S. Senator Tammy Duckworth (D-IL)—a member of the U.S. Senate Armed Services Committee—issued the following statement after Defense Secretary Pete Hegseth ordered the military to reduce the defense budget by 8% for the next five years, jeopardizing our servicemembers, our national security and military readiness:

    “Abrupt far-reaching cuts to our defense budget won’t make Americans, our servicemembers and their families safer. I’m all for trimming waste and making our government more efficient, but the most unqualified, unprepared Secretary of Defense in history ramming through cuts to a budget that funds all our military training, defense technology and servicemembers’ salaries will hurt our national security, our military readiness and our economy by causing damage to our Armed Services that could take years to reverse.”

    Duckworth voted in support of the bipartisan FY 2025 National Defense Authorization Act (NDAA) which authorized a defense budget of roughly $850 billion.  If the Trump Administration implements an annual 8 percent cut over the next five years, it could mean approximately $300 billion less in military spending through fiscal year 2030. 

    If Secretary Hegseth’s dramatic 8 percent cut to the annual defense budget is enforced, it would also mean the U.S. would fall short of President Trump’s call for all NATO countries to spend at least 5 percent of their gross domestic product on defense. In order for the U.S. to meet that level of defense spending, it would have to allocate about $1 trillion annually on the U.S. military budget.

    [WASHINGTON, D.C.] – Despite claiming to support IVF, Senate Republicans blocked an amendment led by U.S. Senators Tammy Duckworth (D-IL) and Cory Booker (D-NJ) from being included in the Senate’s budget proposal that would mirror their Right to IVF Act and help lower the costs of IVF treatment for the millions of middle-class Americans who need it to have children. This comes days after President Donald Trump signed an overly vague, toothless executive order requesting policy recommendations to ensure reliable access to IVF as Republicans continue to claim to support IVF treatment nationwide.

    “Senate Republicans once again had a chance to put up or shut up and prove that their self-proclaimed support for IVF is more than just lip service,” said Senator Duckworth. “Instead, they voted to block our amendment that would help lower costs for middle-class Americans who depend on it to build their families—after blocking our Right to IVF Act twice last year. So let there be no confusion: Senate Republicans may claim they support IVF, but their actions speak louder than words.”

    “My Republican colleagues once again had the opportunity to recommit to protecting reproductive freedoms and Americans’ right to make their own medical decisions,” said Senator Booker. “Unfortunately, they voted against making IVF treatments more affordable for the thousands of families across our country who depend on it to start and grow their families.”

    Duckworth’s Right to IVF Act—co-lead by Booker and U.S. Senator Patty Murray (D-WA)—is comprehensive legislation that would establish a right to IVF and other assisted reproductive technology (ART), expand access for hopeful parents, Veterans and federal employees and help lower the costs of IVF for middle class families across the country. Despite many of them publicly claiming to support IVF for the millions of Americans who rely on it to build their families, nearly every Senate Republican voted against the bill in June and again in September last year. The September vote was the third time Republicans blocked Duckworth-led legislation that would protect IVF nationwide last year.

    The Right to IVF Act builds upon Duckworth’s previous legislation, the Access to Family Building Act that was also blocked by Senate Republicans early last year. After the Alabama Supreme Court ruling that put access to IVF at risk for families across that state, Duckworth led a group of Senate Democrats in calling for the passage of the Access to Family Building Act through unanimous consent—however, Republican U.S. Senator of Mississippi Cindy Hyde-Smith objected, ultimately blocking Duckworth’s effort.

    Duckworth was the first Senator to give birth while serving in office and had both of her children with the help of IVF. In 2018, she advocated for the Senate to change its rules so she could bring her infant onto the Senate floor.

    Washington, D.C.— Senator Tom Cotton (R-Arkansas), Chairman of the Senate Intelligence Committee sent a letter to Office of Management and Budget Director Russell Vought asking to prohibit U.S. government agencies, departments, and employees from using DeepSeek and artificial intelligence tools developed in Communist China.

    Dear Director Vought,

    I write to urge you to immediately prohibit U.S. government departments and agencies from using and accessing Deepseek and other artificial intelligence tools that were developed in the People’s Republic of China (PRC). 

    Federal employees are tasked with researching, developing, and implementing policies critical to America’s economic and national security.  Allowing those employees to use of PRC origin artificial intelligence (AI) or machine learning tools on government devices will almost certainly provide the Chinese Communist Party (CCP) with U.S. government data as well as advance information on our nation’s policies. 

    As you are probably aware, the PRC’s National Security and Data Laws compel PRC companies to provide any and all data to the CCP’s intelligence agencies.  This would, of course, include any information entered into the DeepSeek application or other AI tools.  Additionally, DeepSeek’s developers did not take steps to adequately secure their own databases or implement safety guardrails.  A cloud security firm quickly discovered a massive vulnerability in DeepSeek that left data publicly accessible, including users’ chat histories and other sensitive information.[1] In fact, several of our allies have already banned the use of DeepSeek for government purposes, including India[2] and South Korea.[3]

    While AI can be a useful tool for federal agencies seeking to improve efficiency and deliver value to the U.S. taxpayer, tools that provide our adversaries with advance warning of our government’s plans and policies should be prohibited.  With this in mind, I respectfully ask for the following:

    1. Any guidance OMB has circulated regarding the use of foreign adversary origin AI capabilities by federal agencies. 
    2. Any restrictions on the use of AI tools owned by companies based in China or other foreign adversary countries.

    REMARKS AS PREPARED
    Blackburn: Americans Know Our Fiscal Path is Unsustainable 
    Today, after four years of reckless spending and decades-high inflation under the Biden-Harris administration, our national debt sits at $36.4 trillion. In many ways, this number represents one of the biggest threats to our nation, as interest payments on the debt now eclipse our country’s total defense spending. Unfortunately, this problem is only getting worse. During the last few months of the Biden administration—October to December of last year—our country ran a deficit of more than $710 billion, up 39 percent from the same time period in 2023. The American people know our fiscal path is unsustainable.
    DOGE Has Already Discovered Billions of Dollars in Wasteful Spending
    Among many other reasons, that’s why they returned President Trump to the Oval Office with a mandate to restore government accountability. And since Inauguration Day, the President has been hard at work. In one of his first acts back in office, President Trump established the Department of Government Efficiency (DOGE). Led by Elon Musk, the agency has worked to uncover and eliminate waste, fraud, and abuse across the federal government. And to no one’s surprise, DOGE has found a lot of waste, especially with programs that should have never existed. In recent weeks, the agency has cut $33 million in Education Department grants to groups that push far-left ideas like critical race theory; $44.6 million in canceled leases for unused federal office space; $45 million in scholarships for students in Burma; $182 million in Department of Health and Human Services contracts that had nothing to do with health, including a $168,000 museum exhibit for Anthony Fauci; $1 billion in DEI programs; and on and on.
    Contrary to Democrats’ Dishonest Narrative, DOGE Is Restoring Government Accountability
    In addition, DOGE has worked to reform the mismanaged United States Agency for International Development (USAID). Under the last administration, the agency used its $40 billion budget to support left-wing and anti-American causes around the world, including terror-tied extremist groups in the Middle East. As DOGE uncovers the Left’s abuse of taxpayer dollars, Washington Democrats have tried desperately to paint the agency as unaccountable to the American people. But the exact opposite is true: DOGE, which reports directly to President Trump, is restoring government accountability by helping rein in the federal bureaucracy. That’s why, last week, President Trump issued an executive order to support DOGE, directing federal departments to work with the agency to reduce the size of the federal workforce. A downsize is desperately needed: the government employs more than 2.4 million civilian employees at a cost of hundreds of billions of dollars each year.
    Blackburn Introduced the DOGE Acts to Drain the Swamp
    To support these efforts, I recently introduced a package of bills called the DOGE Acts, which would hold the federal government accountable for managing taxpayer dollars. To drain the swamp, the bills would implement a hiring and salary freeze, direct agencies to reduce the size of their workforce by 5 percent within three years, and establish a commission to report to Congress on moving non-national security agencies out of Washington, D.C. In addition, the legislation would create a pilot program to determine federal employees’ compensation based on merit, not seniority. And they would require agencies to reinstate their pre-COVID telework policies—a measure that is especially crucial after just 6 percent of federal employees worked in an office full-time during the Biden administration. Perhaps most importantly, the DOGE Acts would cut non-security discretionary spending by 5 percent by fiscal year 2028 and every following year, saving taxpayers billions of dollars. When it comes to government spending, Tennesseans and Americans across the country demand accountability. With DOGE, Republicans are delivering on it.

  • MIL-OSI USA: News 02/21/2025 Blackburn, Ossoff Introduce Bill to Help Rescue Children from Violence by Recording Child Protective Services Interviews

    WASHINGTON, D.C. – U.S. Senators Marsha Blackburn (R-Tenn) and Jon Ossoff (D-Ga.) introduced the Generate Recordings of All Child protective Interviews Everywhere (GRACIE) Act, which would incentivize states to require the recording of all Child Protective Services (CPS) interviews with children and adults. Modernizing CPS interview protocols would increase the likelihood that child trafficking victims will be identified and removed from dangerous situations, including sex and labor trafficking, domestic violence, physical and emotional abuse, and other forms of violence.
    “Children are often silenced by their abusers, and we need to do everything in our power to ensure that does not happen,” said Senator Blackburn. “The GRACIE Act would help give more children a voice, increase domestic violence reporting, and strengthen the foster care system.”
    “We can never do enough to support vulnerable children in Georgia and across the country,” said Senator Ossoff. “Senator Blackburn and I are introducing this new bipartisan bill to strengthen transparency in State child protective agencies and help States better fund their operations.”
    BACKGROUND
    In the U.S., it is estimated 37.4% of children will be interviewed by CPS at some point in their childhood. These initial interviews can be traumatic, so we must do everything we can to ensure transparency and accountability during the process. CPS is the gateway to the foster care system, and approximately 60% of U.S. domestic child sex trafficking victims have engaged with the foster care system. Many of them undergo multiple interviews without one CPS staffer identifying them as child trafficking victims or removing them from real-time trafficking violence.
    CPS has a history of distorting the testimony of children who are trying to speak out about abuse and trafficking. As a result, children can remain in abusive and dangerous situations. CPS interview protocols are broken, and mandating all CPS interviews be recorded would be a good first step toward fixing this broken system.
    The U.S. Department of Justice (DOJ) has required recordings of all interrogations for nearly a decade, and state law enforcement departments often require police body cameras. Similar accountability measures are long overdue in the child protection space. It is imperative that federal and state legislation require at least audio recording – if not video recording, too – of all CPS interviews.
    THE GRACIE ACT
    The GRACIE Act would create a program within the DOJ to award states that require the recording of all CPS interviews with children and adults. This legislation includes provisions to protect the privacy and security of those recordings, so they are not shared with anyone outside of a law enforcement investigation. They would also only be retained for the amount of time needed to deal with the case.

    Continued New York State Investments Support The Southern Tier Region’s Comprehensive Strategy To Revitalize Communities And Grow the Economy By Focusing On Clean Energy Solutions
    Governor Kathy Hochul and Senator Charles Schumer today announced that BAE Systems is investing $65 million to expand operations in the Village of Endicott, Broome County. The company will add a total of 150,000 square-feet to its existing site to make way for the addition of a new battery production line and lab space, and new office space. As a result of the expansion, the company has committed to creating up to 134 good-paying jobs onsite. BAE Systems is a global defense, aerospace and security company with approximately 93,500 employees worldwide. The BAE Systems facility in Endicott designs, develops and produces a broad portfolio of safety-critical electronic systems from flight and engine controls to power and energy management systems. The company has been operational at the Huron Campus site since 2011.
    “BAE Systems’ decision to further expand its business represents yet another win for New York State and for the Southern Tier, which is laser focused on becoming a global hub for next-generation battery innovation efforts,” Governor Hochul said. “Since taking office, I have remained committed to bringing jobs back to Upstate New York. BAE Systems is a vital part of the Southern Tier economy, with a world-class workforce of over 1200 people, and selecting this area for their major battery production expansion is no accident.     The project involves the expansion of BAE Systems battery production line, including the purchase and installation of machinery and equipment to efficiently produce an energy storage system for electric/hybrid electric aircraft. This facility will include an automated state-of-the-art production line, an engineering lab, and an aftermarket center, and is expected to be fully complete in 2027.
    Empire State Development is assisting the project with up to $8.5 million in performance-based Excelsior Jobs Tax Credit Program in exchange for the job creation commitments. Broome County is also providing assistance for the project.

    Bolstering Next-Generation Battery Innovation
    Governor Hochul and Senator Schumer were instrumental in the company’s decision having worked closely with company officials to ensure that the project would move ahead in New York’s Southern Tier region which is laser-focused on supporting next-generation energy efforts – a top priority for the governor and senator.
    In January 2024, the Governor and Senator announced that the U.S. National Science Foundation had designated the New Energy New York (NENY) Storage Engine as a Regional Innovation Engine (NSF Engine), which was created by the Senator’s bipartisan CHIPS & Science Law. The NENY Storage Engine, anchored at Binghamton University in the Southern Tier Region, will receive up to $15 million in federal funding for two years and up to $160 million over 10 years to establish a hub that will accelerate innovation, technology translation and the creation of a skilled workforce to grow the capacity of the domestic battery industry. Through Empire State Development, New York State will match up to 20 percent for the first five years of the project as well as provide support through established programs. The NENY Storage Engine was chosen for its diverse, cross-sector coalition that will build a leading ecosystem driving battery technology innovation, workforce development and manufacturing to support U.S. national security and global competitiveness.
    Schumer has long fought to secure federal investment to boost the Southern Tier’s battery manufacturing and R&D. In 2021, Schumer created the Build Back Better Regional Challenge in the American Rescue Plan that he led to passage as Majority Leader. The senator personally advocated for the selection of the Binghamton University-led New Energy New York’s (NENY) battery hub proposal, helping deliver a $63.7 million federal investment with a $50 million funding match from New York State. In 2023, Schumer also delivered the prestigious federal Tech Hub designation, also created by his bipartisan CHIPS & Science Law for the Binghamton University-led NENY proposal.

    New York State’s climate agenda calls for an affordable and just transition to a clean energy economy that creates family-sustaining jobs, promotes economic growth through green investments, and directs a minimum of 35 percent of the benefits to disadvantaged communities. New York is advancing a suite of efforts to achieve an emissions-free economy by 2050, including in the energy, buildings, transportation, and waste sectors.

I joined my Democratic colleagues in introducing dozens of common-sense amendments that would make Americans safer, give children the resources needed to succeed, and lower costs for families.     Senator Luján introduced and co-led a series of amendments to the Republican budget that will protect access to health care, make our communities safer, and improve the quality of life for New Mexicans.     Keeping New Mexico Communities Safe
    Amid a nationwide shortage of police officers, Senator Luján introduced an amendment to provide increased resources for local law enforcement by funding the COPS Hiring Program. The COPS Hiring Program provides funding directly to law enforcement agencies to increase their community policing capacity and crime prevention efforts.     Putting Food on the Table

    Stopping the Flow of Fentanyl 
    As the fentanyl crisis devastates families in New Mexico and across the country, Senator Luján introduced an amendment addressing the need to have 100% screening using non-intrusive inspection technology to stop fentanyl and illicit activity from entering the U.S.
    Boosting U.S. Manufacturing 
    Senator Luján is committed to boosting domestic manufacturing and good jobs for New Mexicans. To create more American jobs, Senator Luján introduced an amendment to provide greater incentives for companies to manufacture right here at home unlike the first Trump Tax Scam that drove jobs overseas. 
    Protecting Medicare and Medicaid
    Republicans want to fund tax breaks for the wealthy and corporations by ripping health care away from Americans on Medicaid. New Mexico has the most Medicaid recipients per capita than any other state, and millions of children and pregnant women across the country rely on Medicaid to access health care. Senator Luján introduced an amendment to strengthen Medicaid for pregnant women and children under five years old. Senator Luján also co-led an amendment to ensure there is no reduction in benefits for people with Medicare and Medicaid. 
    Protecting Veterans’ Sensitive Data
    Senator Luján introduced an amendment to protect the sensitive, private information of veterans from being accessed by private companies including those owned by Elon Musk.
    Supporting Firefighters
    As New Mexico and Western states have been devastated by wildfires in recent years and months, Senator Luján co-led an amendment highlighting the vital role firefighters play in fighting wildland fires in the wake of the Trump administration’s hiring freeze and firings of federal firefighters.
    Supporting our National Parks, Forests, and Wildlife
    As federal employees at the Forest Service, National Park Service, United State Fish and Wildlife Service, and Bureau of Land Management have been recklessly fired in recent weeks, Senator Luján co-led an amendment highlighting the importance of reinstating these fired federal employees.
    Additionally, Senator Luján introduced 34 amendments that boost safety, lower everyday costs, fund critical health care programs, and improve disaster relief.

    U.S. Senator Deb Fischer (R-Neb.) and U.S. Representative Adrian Smith (NE-03) led their Nebraska colleagues in reintroducing the North Platte Canteen Congressional Gold Medal Act. The bill would award the Congressional Gold Medal to the collective individuals and communities who volunteered or donated food and other items to the North Platte Canteen in North Platte, Nebraska, during World War II. 
    U.S. Senator Pete Ricketts (R-Neb.) is an original cosponsor of the Senate legislation. U.S. Representatives Don Bacon (NE-02), and Mike Flood (NE-01) are original cosponsors of the House legislation.
    “During the world’s darkest time, a host of patriotic Nebraskans volunteered to give our service members a taste of home and of hope at the North Platte Canteen. Those volunteers included my own mother, Florence. I’m proud to reintroduce this legislation, which will honor the Nebraskans who ran the North Platte Canteen for nearly five years during World War II,” said Senator Fischer.“For four and a half years, the North Platte Canteen gave a sense of home to more than 6 million American troops traversing the country by train to serve in the Second World War. Volunteers from Nebraska communities came from as much as 200 miles away to lend a hand and provide meals, refreshments, and baked goods to up to 5,000 soldiers per day at the Canteen’s peak. This bill will honor this monumental patriotic effort as a great moment in American history. I thank Sen. Fischer for bringing legislation in the Senate and the entire delegation for supporting its introduction,” said Congressman Smith.

These volunteers served food but more importantly they brought love to a group of young people far from home and headed to far away places that they might never return from. Many were returning from experiences most can never imagine. This love (and food) left an indelible mark on all those that experienced it.     The North Platte Canteen was a railroad stop in North Platte, Nebraska, that was recognized during World War II for providing hospitality to soldiers traveling through the area. An estimated 55,000 people from 125 communities throughout Nebraska, Colorado, and Kansas contributed food, money, or time to serve the Canteen’s estimated 6 million visitors.
    The North Platte Canteen operated from Christmas Day, 1941 to April 1, 1946. It was the largest community-based canteen in the U.S. and one of the largest volunteer efforts during World War II.

    The chief executive of the private equity group that yielded a roughly $800 million profit from its investment in Steward Health Care is set to face the US Senate soon in his bid to serve as a top official at the Pentagon, and his company’s involvement in the now-troubled hospital chain is drawing scrutiny.

    The extent of Cerberus Capital Management chief executive Stephen Feinberg’s involvement with Steward were among the questions Senator Elizabeth Warren posed in a letter sent Monday night ahead of his upcoming confirmation hearing. The letter includes dozens of concerns the Massachusetts Democrat has over the billionaire’s nomination as deputy defense secretary.

    “Cerberus, under your leadership, has exemplified the concerns that I have long had about private equity firms: that its focus on debt-fueled acquisitions, managed for the short-term and for the benefit of insider executives, ultimately leaves the companies it acquires as hollowed-out shells and hurts workers, customers, and communities,” Warren wrote in the letter shared with The Boston Globe.

    Steward is listed as one of several companies Warren says Cerberus invested in that later went bankrupt or struggled financially, including Chrysler, gun maker Remington, defense contractor DynCorp, and grocery chain Albertsons.

    Democrats say they’re starting to find their footing to push back against Trump’s massive tax, immigration and defense bill. And their line of attack is simple: This bill won’t lower prices.
    “You promised the American people that you would immediately lower costs, ‘starting on Day One.’ However, weeks into your presidency, congressional Republicans are moving forward with legislative plans to increase the cost of living for hardworking Americans,” 32 Senate Democrats wrote Tuesday morning in a letter to Trump.
    Sens. Elizabeth Warren (Massachusetts), Jeff Merkley (Oregon), Ron Wyden (Oregon) and Amy Klobuchar (Minnesota) led the missive, which was obtained first by The Washington Post.
    It follows Rep. Brendan Boyle (Pennsylvania) and House Budget Committee Democrats’ 12-hour amendment-a-thon last week as House Republicans voted to advance their budget resolution to the floor. Boyle at the end of the session said the GOP was “betraying the middle class of this country and those who aspire to be in it.”

    A pair of Senate Democrats demanded Department of Government Efficiency staffers associated with Elon Musk vacate the Consumer Financial Protection Bureau, saying their presence undermines an agency responsible for regulating the billionaire’s yet-to-be-released payments venture.

    Senators Elizabeth Warren and Adam Schiff said Musk is “not only neutralizing the pro-consumer agency that will supervise X’s digital wallet – he is also potentially gaining access to confidential corporate data that could provide X with an unfair advantage over its competitors.”

    DOGE staffers descended on the agency earlier this month, upending operations, closing its headquarters and effectively rendering the agency dormant for the time being.

    WASHINGTON, D.C. – Today, U.S. Senator Maria Cantwell (D-WA), ranking member of the Senate Committee on Commerce, Science, and Transportation, and senior member of the Senate Finance Committee, released this statement following Senate passage of a Republican-led budget resolution, after votes on 30 Democratic amendments.

    “Tonight, Senate Republicans voted to give $4 trillion in tax cuts to corporations and the ultra-rich while failing to protect programs like Medicare and Medicaid,” said Sen. Cantwell. “Republicans voted ‘no’ on our efforts to make housing more affordable, and they rejected efforts to reduce grocery prices. This is the fifth week of the Trump Administration. He is not doing enough to lower the cost of everyday goods for working families and neither will this Republican budget plan.”

    The budget resolution passed 52-48. Senate Republicans now have to hammer out their differences with the budget approach the House is slated to consider, likely next week.

    Before passage, the Senate voted on 30 Democratic amendments to improve the bill, including:

    • An amendment to prioritize the needs of working families first and prohibit tax cuts for people making $1 billion or more. Failed 47-51. Cantwell voted YES.
    • An amendment to prevent giving tax cuts for the wealthy while food prices are still high. Failed 48-52. Cantwell voted YES.
    • An amendment to protect Medicaid and prohibit providing tax cuts for the ultra-rich if any cuts are made to Medicaid. Failed 49-51. Cantwell voted YES.
    • An amendment to make housing more affordable. Failed 47-53. Cantwell voted YES.

    Republicans voted all of these and dozens more Democratic amendments down.

    Republicans’ national budget will cut critical services for Coloradans, increase the deficit, and give tax cuts to billionaires

    Republicans voted down critical Democratic-led amendments, including Hickenlooper’s amendment to prevent energy price increases 

    WASHINGTON – Today, U.S. Senator John Hickenlooper released the following statement after he voted against the fiscal year 2025 Senate Budget Resolution:

    “The Republicans’ extreme budget proposal will cut critical services like health care to bankroll tax breaks for the ultra-wealthy,” said Hickenlooper.“We’re all for making government more efficient and cutting actual waste and abuse. This budget will not do that. It will increase inflation and our deficit, which is why I’m voting against it.”

    Hickenlooper voted “No” on the budget resolution after Republicans voted against critical Democratic-led amendments – including provisions to prevent cuts to Medicaid, Medicare, and the Affordable Care Act.

    Hickenlooper spoke on the Senate floor in support of his amendment to protect the low cost of energy by blocking Republican-led attempts to slow renewable energy development. Video of his full remarks HERE. 

    “Most of the energy that’s ready to go today is clean and affordable. Any action that blocks the rollout of [this energy] will raise prices for working Americans, it’s going to kill jobs, and cede complete control of emerging industries to China,” Hickenlooper said on the Senate floor.  

    In total, Hickenlooper introduced and joined over 20 amendments to the 2025 Senate Budget Resolution to oppose Republican provisions that would harm Coloradans, including amendments to:

    Protect Affordable, Clean Energy

    Defend Essential Health Care

    • Protecting Maternal Health: Opposes legislation that would reduce health care coverage for moms and babies covered by Medicaid. Medicaid covers about 1.5 million births each year.
    • Defending Children’s Health Care: Opposes legislation that would reduce health care benefits for children enrolled in Medicaid or the Children’s Health Insurance Program (CHIP). In 2024, 37 million U.S. children were enrolled in Medicaid or CHIP. 
    • Protecting Health Care in Schools: Opposes legislation that would reduce funding for school-based health centers. Medicaid helps fund 3,900 school health centers across the country.
    • Protecting TRICARE: Protects health care access for military families, including reinstating the TRICARE reimbursement exemption for children’s hospitals.

    Safeguard the Federal Workforce

    • Protect National Park Service Workers: Requires the federal government to maintain a sufficient workforce to support recreational access and land management on Department of the Interior lands, including for the National Park Service and Bureau of Land Management.
    • Bolstering the VA Workforce: Establishes a reserve fund to reverse workforce cuts at the Veterans Health Administration, particularly for personnel who provide care in rural areas.
    • Supporting Funding for NIHPromotes U.S. competitiveness and innovation by protecting funding for research and development at the National Institutes of Health.

    Protect Immigrant Rights

    • Protecting Sensitive Locations from ICE: Establishes a reserve fund to prohibit school resource officers from assisting with immigration enforcement operations on children during school hours while on school property.
    • Affirming Birthright Citizenship: Hickenlooper’s amendment with Senator Rosen upholds the Constitution of the United States and affirms that birthright citizenship applies to all persons born or naturalized in the United States.

    Prevent Wildfires and Combat Western Drought:

    • Preventing Wildfire RiskHickenlooper joined an amendment with Senators Schiff, Bennet, Heinrich, Lujan, and Padilla to establish a reserve fund for sufficient staffing and resources for wildfire risk reduction.

    Budget resolutions guide federal spending and revenue policies for the year, but do not have the power of law. The Senate and the House must pass identical budget resolutions to start the larger budget reconciliation process.

    Budget resolution and budget reconciliation bills only require a simple majority to pass the Senate.

    WASHINGTON, D.C. – U.S. Senator John Barrasso (R-Wyo.) recently introduced legislation that would end handouts to China funded by American taxpayers by removing China’s outdated designation as a “developing country” in international treaties.
    The Ending China’s Unfair Advantage Act would prohibit any American taxpayer dollars from funding a United Nations treaty known as the Montreal Protocol and the United Nations Framework Convention on Climate Change (UNFCCC) until China is no longer defined as a developing country. China’s current designation as a developing nation under these treaties allows it to abide by a different set of rules and access funding – including American taxpayer dollars – from the multilateral funds.
    “American tax dollars have been funneled to China for decades because of special treatment from the United Nations,” said Senator Barrasso. “By maintaining its classification as a developing country, China keeps getting handouts from American taxpayers and gets to play by a different set of rules. This ridiculous and outdated policy must end now. This bill forces the United Nations to end China’s unfair advantage once and for all.”

    Background:
    Under the Kigali Amendment to the Montreal Protocol, developing countries are eligible for financial assistance through a special multilateral fund. The U.S. is the largest contributor to the fund, giving almost $1 billion.
    China has received nearly $1.4 billion from this multilateral fund over the years, due to their classification as a developing country under the Montreal Protocol.
    The U.S. is required to phase down production and consumption of hydrofluorocarbons, or HFCs, by 85% by 2036 and China has until 2045 to reduce HFC use by 80%. China is given an extra decade, under the Kigali Amendment, to produce HFCs. It is also allowed an extra 5% in HFC production and consumption.
    In 2023, the U.S. delegation at the 35th Meeting of the Parties to the Montreal Protocol (MOP35) proposed removing the PRC from the Protocol’s list of “developing countries.” Objections from the PRC and its supporters prevented its inclusion in the agenda.
    In 2022, the Senate passed an amendment declaring that China is not a developing country and that the United Nations and other intergovernmental organizations should not treat China as such. It also conditioned the Senate’s ratification on the administration submitting a proposal to remove China as a developing country before the next meeting of the Parties to the Montreal Protocol.
    Senator Barrasso introduced this bill in the 117th and 118th Congresses.

    U.S. Senator Kirsten Gillibrand is demanding answers on the closure of the 20-bed acute inpatient unit for veterans with substance use disorders at Castle Point VA Medical Center (VAMC) in Dutchess County. Castle Point VAMC provides lifesaving care to thousands of veterans in the Hudson Valley; the abrupt closure of the medical unit is leaving at-risk veterans with nowhere to turn. Gillibrand is calling on the VA to reopen the unit while it conducts its 120-day review to reevaluate staffing needs, and to provide additional information about its decision to close the facility, as well as potential alternatives to closure. She is also urging the VA to ensure transparency in future decisions regarding the provision of health care at VA facilities across New York State.

    “Castle Point VAMC provides care to over 7,000 veterans who have served our country, and the decision to abruptly close this acute inpatient unit will have devastating consequences for veterans seeking specialized substance abuse treatment,” said Senator Gillibrand.I am urging the VA to immediately re-open this critical medical unit to meet the acute needs of these veterans while it conducts its review and requesting that alternatives to closure be fully considered.

    “I am deeply disturbed by the abrupt, temporary closure of the E2 Unit at Castle Point VA Hospital. Most of us don’t know or can’t imagine the trauma our service men and women experience on a daily basis — which is why this unit is so vital to their well-being,” said Dutchess County Executive Sue Serino. “It isn’t just a facility; it’s a lifeline for our veterans between Albany and the Bronx, especially for those here in Dutchess County. I know firsthand that this unit saves lives, providing critical inpatient care and preparing veterans for rehabilitation. I urge the VA to reverse this decision immediately so that our veterans can continue to receive the care they so deserve.”

    “The closure of the E2 Unit at Castle Point VA Hospital is absolutely unacceptable. Worse yet is the closure was done without even letting veterans know it was happening,” said Adam Roche, Director of Dutchess County Office of Veteran Affairs. “I’ve witnessed firsthand the unbelievable care the nurses and doctors provide and how much they truly care about our veterans. The compassionate care this unit gives our Dutchess County veterans is simply not available elsewhere in the area. To yank this unit away is an injustice to those who have risked so much for our country. This decision must be reversed.”

    “The closure of the E-2 ward could have devastating effects on the Veteran Community of the Hudson Valley,” said Alyssa Carrion, Director of Veterans Programs at Mental Health America of Dutchess County. “This inpatient ward serves the most vulnerable of the Veteran population, those who have hit rock bottom, those who are finally ready for treatment, and those who are actively suicidal and reaching out for help. Closing E-2 has left us in a very difficult situation. Where do we take a Veteran who is ready NOW for treatment when the ward is closed? The VA pushes the importance of community connection and makes a decision like this without providing any prior warning or guidance to their partners in the community who get the Vets through their doors. We owe these services to those who served our nation, and the VA has a responsibility to provide them.”

    “The acute inpatient unit at Castle Point is a vital lifeline to our local veterans and it is unacceptable what is happening. This is one more barrier that may cause a veteran in need to say, ‘why bother’ and just give up,” said Thomas Bauer, Joseph P. Dwyer/Vet2Vet Program Supervisor at Mental Health Association in Orange County.The VA needs to do right by our veterans and their families and fulfill their own mission to care for those who have served in our nation’s military and for their families, caregivers, and survivors, and not just pass us off to some other provider.”

    “As a fellow veteran and user of Hudson Valley services, I am deeply frustrated by the sudden 120-day closure of the acute inpatient unit at Castle Point VA Medical Center. Re-evaluating staffing should not come at the cost of disrupting critical care. Referring veterans elsewhere only adds unnecessary barriers for those already struggling to access help—help they have earned through their service and sacrifice,” said Gavin Walters, Facilitator of New York State Dwyer Coalition and Director of Greene & Ulster Counties Vet2Vet Programs at Hudson Valley National Center for Veteran Reintegration. “This facility has been a lifeline for many, and its abrupt shutdown forces veterans to take extra steps just to be seen and heard. Any gap in service is a disservice to our community. While veterans wait, an alternative unit should have been provided. The lack of communication with both veterans and community partners is unacceptable. We deserve transparency and inclusion in decisions that directly impact our well-being. I urge the Department of Veterans Affairs to immediately address this issue. The question remains—how can the VA improve its communication and commitment to those it serves?”

    I write to express my concern regarding the recent closure of the 20-bed acute inpatient unit at Castle Point VA Medical Center (VAMC) in Dutchess County, New York. My office has been informed that this critical medical unit was temporarily closed on February 1st as the Castle Point VAMC “re-evaluate[s] staffing needs” for 120 days. However, the abrupt closure of the acute inpatient unit will have devastating consequences for those veterans seeking detoxification and substance abuse care. Castle Point provides care to over 7,000 veterans who have served our country with bravery and honor. Losing this dedicated medical unit for Hudson Valley veterans risks worse health outcomes for some of our most at-risk veterans in need of specialized substance abuse care. I urge the VA to immediately re-open this medical unit to meet the acute needs of these veterans while continuing to conduct its 120-day review at the Castle Point VAMC.

    I am deeply concerned by the VA’s lack of communication and transparency regarding its decision to close the Castle Point VAMC’s acute inpatient unit. It is my understanding that the VA not only closed the medical unit without warning, but also failed to provide adequate guidance or support to the local community. While I recognize the need to evaluate the efficiency of its resources and the quality of its services, the VA should have undertaken this assessment while continuing to offer these important services to veterans in the Hudson Valley. Therefore, I request a written response by February 28, 2025, to address the following questions, concerns, and recommendations:

    1. Please provide a detailed explanation of the VA’s decision to temporary close the unit, as well as data on the usage rate of the Castle Point VAMC’s acute inpatient unit.
    2. Please provide details regarding your plan to distribute guidance and assistance to Hudson Valley veterans regarding how they can obtain comparable access to lifesaving care while the unit remains closed. Comprehensive information about alternative forms of care in the Hudson Valley through Community Care and other VA sites in New York State, as well as transportation logistics and travel pay reimbursement, should be shared with local veterans and their caregivers, municipal veteran service agencies, and veterans support and advocacy organizations.
    3. Please reopen the acute inpatient unit at the Castle Point VAMC while the evaluation of staffing needs is ongoing.
    4. Please provide the alternative options to closure being considered and your evaluation of those options, including the feasibility and advisability of adjusting the number of beds to meet the demonstrated need for medical detoxification and substance abuse care at the Castle Point VAMC.
    5. Please ensure that future decisions regarding changes to healthcare service provision at VA facilities in New York are communicated publicly with advance notice and allow for community input.

    WASHINGTON – U.S. Senators Bill Cassidy, M.D. (R-LA), John Cornyn (R-TX), and 28 Republican colleagues today sent a letter to the Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) Deputy Director Marvin Richardson urging him to align the agency with President Trump’s Second Amendment priorities as laid out in his recent Executive Order and calling on him to identify and rescind former President Biden’s unlawful firearms regulations, including the “Engaged in the Business” rule, pistol brace rule, so-called “ghost gun” rule, and “zero tolerance” policy under which ATF has revoked the licenses of federal firearm licensees (FFLs) over minor bookkeeping violations.
     “On Friday, February 7, 2025, President Donald J. Trump took decisive action to reaffirm law-abiding Americans’ Second Amendment rights in issuing his Executive Order, Protecting Second Amendment Rights.  We urge you to immediately align ATF’s rules and policies with the President’s strong support for the Second Amendment,” wrote the senators.
    “Under former President Joe Biden, ATF adopted numerous policies and rules that infringed upon Americans’ Second Amendment protections. President Trump’s Executive Order directs Attorney General Pam Bondi to review and develop a plan of action regarding President Biden’s unlawful firearms regulations. We ask that you work with the Attorney General to quickly identify and rescind these policies,” continued the senators.

    Dear Deputy Director Richardson:
    Thank you for your service in leading the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) during the presidential transition. On Friday, February 7, 2025, President Donald J. Trump took decisive action to reaffirm law-abiding Americans’ Second Amendment rights in issuing his Executive Order, Protecting Second Amendment Rights.  We urge you to immediately align ATF’s rules and policies with the President’s strong support for the Second Amendment.
    Under former President Joe Biden, ATF adopted numerous policies and rules that infringed upon Americans’ Second Amendment protections. President Trump’s Executive Order directs Attorney General Pam Bondi to review and develop a plan of action regarding President Biden’s unlawful firearms regulations. We ask that you work with the Attorney General to quickly identify and rescind these policies. In particular, we call your attention to the following anti-Second Amendment regulations and policies, which must be immediately rescinded:

    The engaged in the business rule, which is an unconstitutional attempt to move ATF to do all it can to impose universal background checks on law-abiding Americans. ATF has been enjoined, at least temporarily, from enforcing the rule because it violated the text of the Gun Control Act. 
    The pistol brace rule, which improperly reclassifies pistols equipped with stabilizing braces as “short-barreled rifles” (SBRs), thereby subjecting them to stringent regulations and serious criminal penalties under the National Firearms Act and the Gun Control Act. We are troubled by the fact that ATF promulgated this rule after it previously determined that attaching a stabilizing brace to a pistol did not render the pistol an SBR.  This rule threatens to put stabilizing braces out of reach of millions of gun owners, including disabled combat veterans who rely on them to be able to shoot heavy pistols. Furthermore, the rule made law-abiding Americans felons overnight for having lawfully purchased stabilizing brace equipped pistols. Multiple courts have already found the rule to be arbitrary and capricious under the Administrative Procedure Act, and it was ordered vacated by the U.S. District Court for the Northern District of Texas.  We appreciate the Government’s recent motions to hold ATF’s 5th and 11th Circuit appeals defending the rule in abeyance and to postpone oral argument, and ATF should work quickly to accede to the vacatur given the ongoing litigation. 
    The so-called “ghost gun” rule,  which cracks down on law-abiding hobbyists who are exercising their Second Amendment rights to privately build firearms—a longstanding tradition that traces back to the Colonial Era.  The regulations are currently before the Supreme Court, but ATF should act immediately to rescind this rule.
    The “zero tolerance” policy, under which ATF has revoked the licenses of federal firearm licensees (FFLs) over minor bookkeeping violations.  This policy violates a decades-long precedent of ATF working with FFLs to address these minor, unintentional violations and revoking FFL licenses only in cases of major, willful violations that threaten public safety. ATF should develop a program to restore the federal firearms licenses of those FFLs whose licenses were unfairly revoked—or surrendered under duress—where they did not engage in willful conduct (as understood prior to June 23, 2021, when the policy was announced) and do not represent at threat to public safety.

    In addition to promptly rescinding these rules and policies, we urge you to immediately destroy the hundreds of millions of ATF Form 4473 firearm transaction records and other licensee records that are over 20 years old. These records have no particular law enforcement value but do contain the sensitive information of millions of law-abiding gun owners.  ATF should likewise return to the policy of allowing FFLs to destroy Form 4473 in their possession that are over 20 years old, which the Biden Administration initiated in violation of the federal prohibition on gun registration.  Ending the policy of retaining these very old records will save money for the American taxpayer and counteract ATF’s unconstitutional rule change.  
    Furthermore, we urge you to “continue collaboration to improve the process for” National Firearms Act applications. Congress recently instructed ATF to make these improvements.  While NFA wait times have improved significantly, ATF must continue to “address ongoing delays in application processing times” until the archaic process is at least as efficient as the National Instant Criminal Background Check System. There is no reason that the right to purchase a firearm should be so greatly delayed; a right delayed is a right denied.
    The foregoing should not be considered a full accounting of every action or policy for which ATF may be held responsible under President Trump’s Executive Order but represent obvious and high priority places for ATF to initiate compliance.
    We look forward to working with you through the transition as you implement President Trump’s agenda and reorient ATF toward protecting Americans’ Second Amendment rights.

    WASHINGTON, D.C. – U.S. Senator Peter Welch (D-Vt.), Ranking Member of the Senate Judiciary Subcommittee on the Constitution, this week joined Senator Jacky Rosen (D-Nev.) and eight of their colleagues in introducing the Born in the USA Act, legislation aimed at blocking the implementation of President Trump’s unconstitutional Executive Order attempting to end automatic citizenship for children born in the United States. The Senators’ legislation would prevent any government funds from being used to carry out or enforce this directive, which blatantly violates the U.S. Constitution. Federal courts have temporarily blocked the order’s implementation, but the Trump Administration has appealed that ruling. 
    “If you’re born here, you’re a citizen. Trump’s executive order seeking to end birthright citizenship relies on an absurd reading of the plain text of the Constitution and would upend over a century of settled judicial precedent. This is the behavior of a wannabe king—not the leader of the free world,” said Senator Welch. “We’ll continue to defend the Constitution and fight Trump’s unconstitutional executive orders in the Senate and in the courts.” 
    “The U.S. Constitution is abundantly clear that if you are born in the United States, then you are a citizen,” said Senator Rosen. “I’m leading my Senate colleagues in introducing this bill to stop President Trump’s unconstitutional attempt to end automatic citizenship for those born here.”

The President cannot nullify a constitutional amendment and single-handedly strip lawful citizens of their legal status.
