    “I will vote against the nomination of Mr. Jamieson Greer to serve as the United States Trade Representative. Despite Mr. Greer’s qualifications, he would be responsible for implementing President Trump’s haphazard and reckless trade policies, which I believe are harmful to Georgia businesses, farmers, and families. I am particularly concerned that, instead of advising the President on trade, Mr. Greer would be forced to appease President Trump’s chaotic tariff impulses.”

  • MIL-OSI USA: Hickenlooper, Bennet, Colleagues Introduce Bipartisan Legislation to Exclude Catastrophe Mitigation Payments from Income Taxes

    WASHINGTON – U.S. Senators John Hickenlooper and Michael Bennet joined nine of their Senate colleagues in introducing the bipartisan Disaster Mitigation and Tax Parity Act of 2025 to prevent disaster mitigation funds from being taxed as part of gross income. These funds help communities prepare for and recover from natural disasters.
    “Coloradans know the damage caused by wildfires and other natural disasters too well. This is a critical step we can take to keep our families and homes safe and give communities the resources they need to rebuild,” said Hickenlooper.
    “This commonsense legislation takes a critical step toward empowering individuals and communities to better protect themselves from the devastating effects of natural disasters like Hurricane Helene,” said Tillis. “By excluding qualified catastrophe mitigation payments from income tax, we are incentivizing property owners to make the necessary improvements that reduce damage and save lives. This proactive approach to disaster preparedness not only helps families rebuild faster but strengthens our resilience in the face of future disasters.”
    “The devastating fires in Southern California underscored the urgent need to empower homeowners to take proactive steps to keep their families and homes safe,” said Padilla. “As these disasters become more frequent and more extreme due to the climate crisis, we should incentivize — not penalize — taxpayers for protecting their homes. That’s why the Disaster Mitigation and Tax Parity Act would provide a tax exemption on payments from state-based programs for homeowner investments in critical disaster-related improvements.”

    The bill defines a “qualified catastrophe mitigation payment” as any amount received for making improvements to an individual’s property for the sole purpose of reducing the damage that would be done to such property by a windstorm, earthquake, flood, or wildfire.

  • MIL-OSI USA: Murphy: if Your Plan is to Destroy the Rule of Law, Kash Patel is the Perfect Person to Lead the FBI

    WASHINGTON—U.S. Senator Chris Murphy (D-Conn.) on Wednesday spoke on the U.S. Senate floor to sound the alarm on President Donald Trump’s blatant disregard for the rule of law. Murphy condemned Trump’s efforts to use the justice system as a tool to punish his critics and protect his allies, warning the confirmation of Kash Patel to lead the FBI would be a dangerous step toward dismantling American democracy.
    On the dangerous nomination of Kash Patel to lead the FBI, Murphy said: “If your plan is to destroy the rule of law and turn the Department of Justice into a political weapon that rewards loyalty and punishes dissent, then Kash Patel is the perfect person to lead the FBI, and that is likely exactly why he was chosen. […] He has an enemies list. He thinks that people who helped elect Joe Biden are criminals. […] Honestly, how on Earth are we going to let someone lead the world’s most important, most revered law enforcement agency, who is secretly in business with the Chinese Communist Party, who believes that the FBI organized the invasion of the Capitol, who runs a fake charity, who has a brand in order to make money off of his affiliation with Donald Trump?”
    Murphy called out Patel’s sham foundation: “While he believes this, he also knows that there’s a money-making opportunity in all of this. This is his logo: K$H. He’s a brand. He says all these things because he believes them, but also because it makes him a hero to the gullible conspiracy theorists inside MAGA. He uses them. He sells stuff to them: sweatshirts, T-shirts, lapel pins. K$H. Now if you buy this sweatshirt for $55, it says all net profits go to the Kash Foundation. But you know what we found out, unsurprisingly, is that in 2023, by selling all these sweatshirts and merch, the K$H Foundation had $1.3 million in revenues. Now it purports to support heroic whistleblowers with legal services and other support services. You know what percentage of that $1.3 million went to actual services? Less than 15%. Kash Patel pocketed almost all the money that he made from selling these T-shirts.”
    Murphy detailed how President Trump is brazenly using the Department of Justice to curry favor and punish critics: “Trump ordered the Department of Justice to cut a deal with the indicted mayor of New York City, Eric Adams. The deal was simple. If Adams pledged loyalty to Trump and agreed specifically to cooperate with Trump’s immigration raids in the city, Trump would look the other way regarding Adams’ corruption. The charges would be dropped, and Adams could keep stealing money as long as he was politically loyal to Trump. They didn’t hide this deal. Adams and a high-ranking Trump official literally went on TV to announce that they had formed an alliance based upon the release of charges in exchange for political loyalty.
    He added: “There is not a rule of law anymore. There is one set of law for people or entities who are loyal to Donald Trump, and there is one set of law for people who dare criticize him. That is not democracy. And if we don’t find a way, Republicans and Democrats, to come together to defend the rule of law, if we don’t say that what is happening today – deals being cut with corrupt politicians in exchange for their pledges of loyalty to Donald Trump – if we can’t speak with one voice about that kind of corruption, well, then our democracy is cooked.”
    He concluded: “The law loses all meaning when it becomes simply what the president, what the leader, on any given day decides. This is the worst possible moment to put a person like Kash Patel in charge of the FBI. It is heartbreaking to see so many of my Republican colleagues, many of whom I admire, put loyalty to Donald Trump ahead of loyalty to this country, and more specifically loyalty to that sacred principle, the rule of law. My prediction is that if you vote for Kash Patel, more than any other confirmation vote you make, you will come to regret this one to your grave.”

    MURPHY: “Thank you, Mr. President. Mr. President, the idea that men and women citizens are bound by a common set of laws that are applied consistently and universally, regardless of one’s income or political power or political affiliation, it’s a fairly modern invention. Because for thousands of years, laws were simply what rulers used to impose and maintain power, to control people. Laws were applied or crimes were invented for the ruler’s critics, and laws were ignored or waived away for those in favor with the regime.
    “Now early Americans had watched the British kings apply laws selectively, both in Britain and in the colonies, and they sought – our founders sought – to create a nation where all men were equal in the face of the law, and [where] the law was applied uniformly and justly. 
    “That idea – equal justice, the law applies to everybody regardless of who you support politically or who you are aligned with politically – was in many ways the founders’ most vital check against tyranny. That’s the difference between a democracy made of equal citizens and an autocracy where the law is simply whatever the ruler decides. It is a foundational principle of American constitutional democracy. It is not something that we can take for granted. 
    “Now, I will admit, likely every president has made a decision or decisions that compromised that belief in the rule of law. Often those decisions were related to one of the maximalist powers that the president supposes. That’s the power of the pardon. I, for instance, did not agree with President Biden’s decision to issue pardons to his family members. I thought that was excessive. I thought that compromised the rule of law. 
    “But this President’s contempt for the rule of law, Donald Trump’s contempt for the rule of law, is unprecedented. What we are all watching right now is Donald Trump throwing away the idea that laws apply to everyone equally. And it is astonishing to watch so many of my Republican colleagues fall in line. Some of them may be on board for the destruction of the rule of law because they want the Trump family to rule forever, but many of them know that this is wrong, what is happening, and their silence is heartbreaking. 
    “Donald Trump issued a statement over the weekend: quote, ‘He who saves the country does not violate any law.’ That’s a quote attributed to one of the most notorious dictators of the last half millennium: Napoleon Bonaparte. It’s a stunning claim that Trump, not the law or Congress, decides what is legal and illegal. 
    “If he had said that in 2017, maybe we could just write it off as Trump being Trump, as just bluster trolling. But this time he is actually implementing a methodical campaign to seize control of the law and apply it differently depending on whether you support him or oppose him. 
    “Take, for example, what happened on Friday night. Trump ordered the Department of Justice to cut a deal with the indicted mayor of New York City, Eric Adams. The deal was simple. If Adams pledged loyalty to Trump and agreed specifically to cooperate with Trump’s immigration raids in the city, Trump would look the other way regarding Adams’ corruption. The charges would be dropped, and Adams could keep stealing money as long as he was politically loyal to Trump. 
    “They didn’t hide this deal. Adams and a high-ranking Trump official literally went on TV to announce that they had formed an alliance based upon the release of charges in exchange for political loyalty. But when Trump told the highest-ranking Justice Department employees in New York City to execute the corrupt deal, they wouldn’t. The top official resigned rather than take part in the corruption. So did the next in the chain of command. By the time that Trump found someone who would implement the deal, seven DOJ lawyers and four of Adams’ deputy mayors had resigned because what was happening in plain view was a fundamental challenge, a fundamental corruption to the rule of law, a rule of law that up until today Republicans and Democrats had both revered. 
    “Meanwhile, other parts of Trump’s team are engaging on the other side of the ledger, targeting and harassing – using the law – the President’s critics. Because that’s what happens in a nation without the rule of law. Law enforcement lets loyalists like Adams off the hook and is overzealous in targeting critics. 
    “Let me give you just one example of what is happening right now as we speak. Last month, Trump’s new FCC Chairman opened an investigation into a single radio station that had the audacity to simply file a news report about an ICE raid that was happening locally. Multiple other sources filed similar reports with similar footage, but only one investigation was opened, and you guessed it, it was against the radio station that was owned by a high-profile critic of Donald Trump, George Soros. 
    “So the game is clear. Like, we can see it. They’re not even hiding it. There is not a rule of law anymore. There is one set of law for people or entities who are loyal to Donald Trump, and there is one set of law for people who dare criticize him. That is not democracy.  And if we don’t find a way, Republicans and Democrats, to come together to defend the rule of law, if we don’t say that what is happening today – deals being cut with corrupt politicians in exchange for their pledges of loyalty to Donald Trump – if we can’t speak with one voice about that kind of corruption, well, then our democracy is cooked.
    “Which brings us to the pending nominee to lead the FBI, Kash Patel. If your plan is to destroy the rule of law and turn the Department of Justice into a political weapon that rewards loyalty and punishes dissent, then Kash Patel is the perfect person to lead the FBI, and that is likely exactly why he was chosen.
    “Listen, Kash Patel is a joke. Many of my Republican colleagues know this. He has spent the last four years taking the most extreme positions inside the world of MAGA in order to make money for himself. 
    “For instance, he says that he can provide proof beyond a reasonable doubt that the FBI was behind the January 6 invasion of this building. Let me say that again. The man that my Republican colleagues are about to vote to lead the FBI believes that there is irrefutable proof that the agency he is about to lead secretly organized the violent assault on the Capitol. That is bananas. My Republican colleagues know that. That is a lie. And we’re about to put this guy in charge of the FBI? An agency that he claims organized a secret plot to invade the Capitol?
    “He wrote a book called ‘Government Gangsters’ and at the end he added an Appendix entitled ‘Enemies List.’ Like, straight out of the McCarthy era. He has a list – he wrote it down – of people he believes are enemies of America. And, shocker, they’re all Democrats, or Republicans who dared speak out and criticize Donald Trump. 
    “You’re going to put at the head of the FBI – the agency that can arrest anyone they want, put people in jail – a man who thinks that anyone who disagrees with Donald Trump politically is an enemy of the United States. Patel has further suggested that anybody who administered the 2020 election could be subject to arrest. Why? Because he believes in his heart that the election was rigged, despite the fact that Joe Biden won by seven million votes – far, far more than Trump won by in 2024. So anybody who helped rig the 2020 election is, in his mind, a potential criminal. 
    “This is off-the-wall stuff. But of course it is, because while he believes this, he also knows that there’s a money-making opportunity in all of this. This is his logo: K$H. He’s a brand. He says all these things because he believes them, but also because it makes him a hero to the gullible conspiracy theorists inside MAGA. He uses them. He sells stuff to them: sweatshirts, T-shirts, lapel pins. K$H.

But if there are enough people loyal to Donald Trump to buy anything Trump’s lieutenants sell on the internet, then fair game. 
    “To top it all off, just recently after his confirmation hearing, we also found out that Kash Patel has been a fashion consultant to a shadowy holding company controlled, it seems, by members of the Chinese Communist Party. Honestly, how on Earth are we going to let someone lead the world’s most important, most revered law enforcement agency, who is secretly in business with the Chinese Communist Party, who believes that the FBI organized the invasion of the Capitol, who runs a fake charity, who has a brand in order to make money off of his affiliation with Donald Trump? He has an enemies list. He thinks that people who helped elect Joe Biden are criminals. 
    “This is a really dangerous moment. It’s a really dangerous moment. This deal that Donald Trump just cut with the mayor of New York, it’s a big deal. It’s a big deal. I admit that prior presidents have made decisions that compromise the rule of law. But we’ve never seen anything like this, so brazen and out in the open, that the mayor of New York and a Trump official would go on national TV to announce that they had made an arrangement in which Mayor Adams could continue his corruption as long as he was politically loyal to Donald Trump. 
    “They did that out in the open on TV because it’s a signal to everybody else out there that the law will be applied differently to you if you are loyal to the president and that the law will be zealously applied to you, maybe in excess of the letter of the law, if you are a critic of the president. That’s why they went on TV, to show the world the corruption, as a signal that things are different now, that the law is not the law, the law is what President Trump decides the law is. 
    “The law loses all meaning when it becomes simply what the president, what the leader, on any given day decides. This is the worst possible moment to put a person like Kash Patel in charge of the FBI.   • MIL-OSI USA: On Senate Floor, Shaheen Blasts Trump Administration’s Reckless Firing of FAA Personnel Critical to Aviation Safety

    (Washington, DC) – On the Senate floor, U.S. Senator Jeanne Shaheen (D-NH) raised concerns for public safety after the Trump Administration recklessly decided to fire hundreds of Federal Aviation Administration (FAA) personnel critical to aviation safety. This week’s decision will further strain the system at a time when incidents and near-misses are at a high. Last week, Shaheen and U.S. Senator John Hoeven (R-ND) sent a bipartisan letter calling on Acting Administrator of the FAA, Chris Rochelau to urgently work with Congress to address air safety workforce staffing shortages.     I come to the floor today to call attention to the Trump Administration’s unconscionable disregard for air safety. 

    Last month, here in Washington, we saw the deadliest commercial aviation event on U.S. soil in over 23 years.

    And while this loss of life was horrifying, it was unfortunately not unimaginable. 

    In recent years, near misses at airports across the country have increased, and the incident at DCA illustrated just how quickly these dangerous situations can take a turn for the worst. 

    Several times last year, runway incidents were narrowly avoided, due in no small part to the heroic actions of certified professional air traffic controllers who staff our towers. 

    These controllers are hardworking Americans.

    They often log six-day weeks and ten-hour days—and that’s on a good week.

    So even before this week’s misguided and, frankly, stupid—I mean, I have to say, I think it’s a stupid decision to lay off hundreds of FAA workers and air traffic controllers who have been overworked and understaffed.

    And this is not a new problem.

    We’ve known about it for years. 

    For years in Congress, we’ve been sounding the alarm about the need to invest in our air traffic control workforce.  

    In last year’s FAA reauthorization bill, we worked in a bipartisan fashion to address this issue—to support our air traffic control workforce so they can do their vital, often lifesaving jobs effectively.

    By partnering with the National Air Traffic Control Union and the FAA, we successfully adopted a new staffing method, model, staffing model, in the reauthorization bill, and they’ve been making good progress, but of course we have more work to do.

    It’s important to acknowledge that any response to the tragedy at Reagan National Airport must include a commitment to reinforce all parts of our aviation safety workforce. 

    Controllers would be the first ones to tell you that they don’t work in a vacuum. 

    The equipment they use is maintained by hundreds of dedicated support personnel who go through years of highly specialized training.

    Many towers and facilities operate in buildings and on equipment that’s five, ten, even fifteen years old, and when something goes wrong, they need to know that there’s someone on call to fix things because lives literally depend on it.

    Americans need to know that the skies are secure and that their safety is a top priority. 

    Sadly, I can’t say that the actions we’re seeing from this administration does any of that. 

    Secretary Duffy said he wants to surge air traffic controller hiring.  
     

    I agree with him on that. 

    We can and we should hire more air traffic controllers, but not at the expense of the rest of FAA’s workforce. 

    We can hire any number of air traffic controllers tomorrow, but without the dedicated support staff that make their work possible, it wouldn’t matter. 

    So how is the Administration responding to the American people’s distress over increasingly frequent close calls and, indeed crashes, sadly, like the one we saw in Toronto this week?

    Well, over the weekend this administration fired nearly 400 FAA employees, some of them in my state of New Hampshire. 

    We heard an outpouring of concern over the weekend from controllers, pilots, airlines and passengers who want to know that they’re going to be safe when they fly.

    I’m sure the Administration must be hearing this too.

    But when asked about the impact of the irresponsible and reckless effort, this is what Secretary Duffy had to say, he said and I quote, “zero critical safety personnel were let go.”

    Well, so I’m not sure I understand this. 

    We’re telling the American people that if a communications system goes down while the plane is approaching the runway, the person who knows how to get it back up and running isn’t critical?

    That if the power goes out at an en-route facility while 747s are flying overhead, the eighteen fired maintenance personnel who know how to turn the lights back on won’t be necessary?

    That the staffers who develop innovative safety and flight procedures every time there is an incident, to make sure your plane takes off on time and arrives safely, are fair game to be fired?

    Because we just lost 13 of them. 

    And to anyone who’s worried about our national security, good news: According to this administration, the FAA employees working on a classified radar system to detect cruise missiles, aren’t all that important either, and they also were fired.

    So I’m going to say that again because this administration thinks that the civil servants at the FAA’s National Airspace System Defense Program are apparently not critical to our safety. 

    None of this makes me or my constituents sleep better at night, but I bet you it makes our enemies happy. 

    The Administration has tried to defend this by saying that everyone who [they] fired was probationary.

    They’d like you to believe that these are all brand-new employees. 

    Sort of the philosophy that the last one in, is the first one out. 

    But that’s not how the system works, and it sure as heck isn’t how you keep Americans safe. 

    In fact, employees who were promoted based on stellar performance within the last year, many of them who have been with the FAA for ten or fifteen years, are also labeled as probationary employees when they start their new positions.

    So in fact, the Administration just fired some of the people with the most experience, not the least.

    And this speaks to what is a bigger problem. 

    Time and again, we’re seeing this happen with so-called “government efficiency,” in quotes, experts. 

    Listen, like most of us in this chamber, I think we should do everything we can to make government run efficiently and effectively, but indiscriminately freezing hiring across the board, pushing out thousands of civil servants, makes that problem worse, not better. 

    Last week, hundreds of employees at the National Nuclear Security Administration were fired without warning. 

    This week, the Administration is scrambling to try and hire most of them back because they didn’t realize they oversee our nuclear stockpile.

    And the Department of Energy fired more than a thousand employees, including three-quarters of the State and Community Energy Program’s office.

    Now, I don’t know if the people who are making these decisions in the Administration even know what that office does.

    But I can tell you that in New Hampshire we depend on them because they help keep weatherization programs up and running, they support emergency operations in the wake of disasters.

    And with folks in New Hampshire dealing with some of the highest home heating costs, who are worried about how they’re going to keep themselves warm this winter, and states around the country still recovering from floods and fires and winter storms, I can’t imagine why anybody would think that it’s a good idea to get rid of the people who are helping make sure those programs operate. 

    And then on Monday, we found out that dozens of USDA employees, so the Department of Agriculture, who have been working to prevent bird flu, were fired. 

    And then the White House realized what they had done, they panicked and they tried to bring them back. 

    Now that’s on top of all of the people around the globe who have been monitoring the bird flu potential epidemic—who have already been fired with the closure of the U.S. Agency for International Development.

    And just this afternoon, we heard that nearly 500 employees at the National Institute of Standards and Technology would be fired, including almost 60 percent of the CHIPS office.

    So the effort that we stood up, that this Congress stood up, to try and make sure we could compete with China, with Taiwan in the production of semiconductors, which are included in almost everything we use from our cell phones to our refrigerators to our cars, 60 percent of those people are now gone.

    So who’s going to provide that effort that we need in order to compete with China? 

    These are the staff that make sure our high-tech semiconductor manufacturing industry stays competitive. 

    Example after example shows that the firings that Elon Musk has taken credit for have not been thought through. 

    Either he’s doing it deliberately in an effort to undermine the United States or he’s doing it because he’s so ignorant he has no idea what any of these people do or what their operations do.

    Either way, it’s inexcusable. 

    I heard from a constituent this week who works, who worked, past tense, for the New Hampshire Fish and Game Department for 24 years, and she just took a job as a wildlife biologist with the U.S. Fish and Wildlife Service last year. 

    Her job focused on implementing the Pittman-Robinson Wildlife Restoration Act. 

    As my colleagues on both sides of the aisle know, this involves conserving bird and wildlife habitat, hunter education and shooting ranges. 

    Its funds come not from taxpayer dollars, but from excise taxes on firearms, ammunition and archery equipment.

    And yet, her job was terminated under the guise of government efficiency. 

    She has a mortgage; she has kids in college who need health care coverage, but her main ask to me was to help put a stop to these firings and to simply help her get her job back because like most of our public servants, she cares about the mission of her work.

    Over and over, we’re seeing this administration take out irresponsible, reckless initiatives with devastating consequences for critical positions without taking a second to think through or learn about what those positions do. 

    And when things inevitably break as a result, they don’t own up to their mistakes. 

    Instead, they try to convince you that keeping the lights on at control towers or inspecting airplane engines, making plans to manage some of the busiest airspace in the country really isn’t critical to your safety. 

    Well, I don’t believe that and I don’t think you should either. 

    For the sake of the American people, we can and we must do better.

    I don’t think people elected Donald Trump to dismantle this country’s air traffic control system. 

    I think they elected him because they wanted to see inflation go down, they wanted to see their grocery prices reduced, they wanted to see help with rental costs, with mortgage rates, with energy costs and what have we seen in the weeks since Donald Trump got inaugurated?

    No effort to address any of those things. 

    All we’ve seen is an effort at retribution against his perceived enemies, at firing and undermining of services and programs within the government to serve the American people. 

    For the sake of our citizens, we must do better. 

    I’m calling on this administration to right this wrong as quickly as possible, before it’s too late.

    Senator Klobuchar: Thank you so much, Mr. Chairman, and I am truly looking forward to working with Senator Blackburn on this important Subcommittee. As many of you know, Senator Lee and I chaired the Antitrust Subcommittee for a long time, but I actually think this situation right now, with the possibility of moving on these bills, is going to be a very positive development.

    As Senator Blackburn just pointed out, despite the strong support that we have had from Senator Durbin and Senator Grassley and Senator Graham when he chaired this Committee, or was the ranking on this Committee, we’ve just continued to run into roadblocks to passing these laws, and it’s getting absolutely absurd.

    Senator Grassley is well aware of the antitrust tech bill that he and I lead, that hundreds and hundreds of millions of dollars are spent against it in TV ads, and despite the fact that the companies, FAANG [Facebook, Amazon, Apple, Netflix, and Google] as we call them, have agreed in other countries to some of these consumer protections that did not happen in America.

    I think that this piece of it—whether it’s Instagram’s promotion of content that encourages eating disorders, frightening rise of non-consensual AI-generated pornographic deep fakes, or the tragic stories of kids losing their lives to fentanyl-laced pills—will most likely be leading the way as we continue to push our antitrust and privacy and news bills.

    Just this month, this committee heard from Bridgette Norring of Hastings, Minnesota. Her son, Devin, was struggling with migraines, and bought what he thought was a Percocet over Snapchat to deal with the pain. But it really wasn’t a Percocet, it was a fake pill laced with fentanyl. And with that one pill, as we say, “one pill kills,” he died at age 19.

    For too long, the companies have turned a blind eye when young children joined their platforms; used algorithms that pushed harmful content—they have done that; and provided a venue for dealers to sell deadly drugs like fentanyl.

    We know that social media also increases the risk of mental illness, addiction, exploitation, and even suicide among kids. I will never forget the testimony of the FBI Director telling us that in just one year, I believe it was 2023, over 20 kids had committed suicide just because of the pornography and the images that had been put out there when they were innocently sending a picture to who they thought was a girlfriend or a boyfriend.

    That’s why this committee has taken this on on a bipartisan basis, and I am hopeful that this hearing will be the beginning of actually passing these bills into law.

    Representative Guffey, you and I met through Senator Cruz, and the bill that he and I have, the TAKE IT DOWN Act. We have an additional bill that Senator Cornyn and I have that’s really important, that’s passed through this committee, the SHIELD Act. And as you know all too well, the threat of dissemination alone can be tragic, especially for kids. We need to enact the Kids Online Safety Act, which, thanks to Senators Blumenthal and Blackburn, [has] passed the Senate on a 91-3 vote. As we know, some of these are stalled out in the House.

    We need to get the federal rules of the road in place for safeguarding our data. According to a recent study, social media platforms generated $11 billion in revenue in 2022 from advertising directed at kids and teenagers, including $2 billion in ad profits derived from users age 12 and under.

    I am supportive, as was mentioned by Senator Durbin, of the legislation that he and Senator Graham and Hawley and many others have to open the courtroom doors to those harmed by social media by making those reforms to Section 230. That legislation was enacted long before any of this was going on.

    And somehow, with respect to other industries, we’ve been able to make smart decisions to put more safety rules in place. Just ask those passengers that were on that flight that flipped upside down in Toronto, who were in those seats that were the result of safety rules that were put in place. And yet, when it comes to this, we just put up our hands and say, “no, they’re lobbying against us,” or “they have too [much] money,” or “we like some of the people that work there.” And we do nothing.

    And by doing nothing, instead of reaching some reasonable accommodations of settlements or things we can do on legislation, we just let them run wild at the expense of our kids’ lives. Thank you.

  • MIL-OSI USA: Cramer Questions Witnesses on WOTUS at EPW Hearing

    WASHINGTON, D.C. – The Senate Environment and Public Works (EPW) Committee held a hearing today to discuss how to improve the federal permitting process, which has long been a frustration for those trying to build infrastructure, housing, energy, and transportation projects. Recent efforts to streamline and reform the process have not gained consensus, but the EPW Committee is exploring bipartisan solutions to provide clarity and consistency in the permitting process.
    U.S. Senator Kevin Cramer (R-ND), Chairman of the EPW Transportation and Infrastructure Subcommittee, questioned witnesses on the 2023 Supreme Court decision, Sackett v. Environmental Protection Agency (EPA). The Sackett ruling explicitly defined Waters of the United States (WOTUS) and significantly narrowed the scope of federal regulation over jurisdictional waters. Despite the Supreme Court’s ruling in Sackett, paired with West Virginia v. EPA and the overturning of the Chevron Doctrine in Loper Bright Enterprises v. Raimondowhich peeled back bureaucratic overreach, Cramer stated the U.S. Army Corps of Engineers (Army Corps) still has not adequately responded to the ruling.

    Cramer asked Leah Pilconis, the General Counsel for the Associated General Contractors of America, and Carl Harris, Chairman of National Association of Homebuilders, “why do we even have to seek jurisdictional determination or permission when any home builder can read the law and see this isn’t a jurisdictional water? In other words, we don’t put a highway patrolman on every car on the interstate, just in case one of them speeds. We presume most of them are not going to violate the law. How can we simplify?”
    “The problem is that it’s not clear, and you can ask one person if something is jurisdictional and the next person if something is jurisdictional, and you might get two different answers,” responded Pilconis. “For the construction community we need clarity. It’s very difficult to move forward when you don’t know what is a Water of the United States. Not getting a permit when you are in federally controlled water has very significant civil and criminal penalties. The consequences and what’s at risk are huge for the developer, for the contractor. [Sackett v. EPA] did provide some guardrails. It provided some clarity, but what came out of that Supreme Court decision is not being implemented by the agencies. As Mr. Harris said, there are very unclear terms that have not been defined in the regulations, and that’s what’s causing a lot of confusion.”
    “Along with clarity, we need consistency,” replied Harris. “We need consistency between the [Army Corps] districts. If we could get true definitions of the terms that we were talking about, then our builders, our developers would know when they could take reasonable risk before they make a tremendous investment in the property and start moving dirt. We do need that consistency and clarity.”
    Cramer referenced permitting for electricity transmission projects. He warned against building out transmission and generation absent a planning process by local utilities and state regulators, and the potential for costs to be shifted to customers. “We have to find a federal backstop, but I think on linear siting for a transmission line should be the same as it is for a water pipeline or any other any other linear infrastructure. We can do that, but we do have to recognize those state regulators, having been one at one point myself.”

    Washington, D.C. – Today, U.S. Senator Ben Ray Luján (D-N.M.), a member of the Senate Committee on the Budget, delivered a floor speech calling out Republican plans to dramatically cut funding for programs that all Americans rely on like health, nutrition, and public services. He highlighted the staggeringconsequences for working families, including diminished access to health care and higher costs, at a time when federal employees are being illegally fired.

    Mr. President, over the past week, Elon Musk and Donald Trump have fired thousands of federal workers, many of them in New Mexico, without warning. The calls that I get to my office from constituents all across New Mexico express concern, surprise, and alarm. They don’t know what’s going to happen next. They’re worried about a project.
    A professional that I spoke to, who works for the Bureau of Indian Education and has a responsibility to help diagnose and support students with disabilities, asked, “Do I stay and help these kids? What’s going to happen with this stuff?”
    Now, whether it’s our neighbors who work to support the national labs to keep us safe, or friends who work at the United States Department of Agriculture helping our farmers and ranchers feed our nation, these illegal mass firings are impacting communities across every corner of New Mexico. Let me sum this up: what I keep hearing from New Mexicans every day is: Please help me. Speak up. Say something. Do something. Bring attention to what’s happening—to the harm that’s being caused in our communities, for all of our constituents.
    This isn’t about Democrats or Republicans. It’s about right or wrong. It’s about real people. Now, instead of protecting these jobs and helping our fellow Americans, Senate Republicans are pursuing a partisan budget resolution that will make it even harder for families to afford their health care, put food on the table, or get an education for their kids.
    Now, this is, quite frankly, chaos, and it’s chaos that the American people cannot afford. New Mexicans and Americans from all walks of life rely on the programs that Republicans are now attacking. These are programs that feed seniors, veterans, children, and the disabled. These are programs that house our veterans and keep folks warm during these winter months.
    And why are Republicans ripping these services away from people who need them? To fund this Trump tax scam—now it’s 2.0. The American people and constituents across New Mexico told me back in 2017, “This feels like a scam.” What Republicans are saying is that middle-class families are going to get everything in this tax cut. But what we saw play out was that if you were making millions of dollars, you did okay—you got the brunt of everything in this tax scam. Lying to the face of the American people. That’s what happened in 2017, and it certainly feels the same now.
    Now, let’s talk about one possible outcome of this budget resolution. In New Mexico, Medicaid covers 75% of births and supports around 92,000 children in my home state. Across the country, nearly 40% of babies are born with the help of Medicaid. For these babies and pregnant women, this program is vital—offering a chance to grow up healthier and have the best opportunity to succeed. We should all want that for our constituents. That’s not partisan.
    Now, unfortunately, Republicans have made it clear that they are determined to slash Medicaid. They tried it in 2017. When my Republican colleagues are interviewed and asked the question, “Are you going to cut Medicaid?” they certainly attempt, in every form and fashion, to say, “No, no, no, we’re not going to touch it—we’re just going to leave it up to the states.” Let me translate what that means.
    What Republicans in Congress are going to do is work to eliminate every federal dollar for Medicaid. There’s this acronym—FMAP—it’s a federal matching program to make Medicaid work across America. That’s what they’re going after. And if you visit with anyone across America who knows anything about how this program works, they will all tell you—without these federal dollars, this program goes away.
    This Republican budget resolution sets the stage for dismantling Medicaid, which could result in pregnant moms and babies losing health care. That’s just one possible outcome.
    As I said earlier, the American people deserve honesty and transparency. Look, I understand if my Republican colleagues want to do this. Just own up to it. Tell the American people what you want to do. Let them know. Just be honest with them. That’s the least the American people deserve.
    Last week in the Budget Committee, I offered a number of commonsense amendments to help lower costs for families, strengthen border security, safeguard health care, promote American manufacturing and businesses, and invest in public safety.
    Top of mind for many Americans, I offered an amendment to ensure that Elon Musk and his companies are not profiting off the same government that he’s dismantling. Elon Musk, who was not elected by the American people, is pursuing an extreme agenda to serve his own interests and greed—all while the American people are paying the price for it.
    If Republicans are serious about tackling the issues and lowering costs, let’s work together. You have partners here ready to do this for the American people. But my Republican colleagues know better than I that what’s happening under this president and Elon Musk is that the cost of goods continues to go up.
    I don’t know how many of you were at the grocery store this weekend in this chamber, but if you haven’t been—go by. Go by and try to buy some eggs. You will see a sign that limits you to maybe a dozen, maybe two, and you’re going to see the costs going up and up and up. Milk, butter—you look at it, you see it, you name it—it’s all increasing in price.
    What happened to President Trump saying on day one he was going to lower the cost of these goods for the American people? It’s not happening.
    Look, to sum this up—Americans will not be able to make ends meet if Senate Republicans dismantle the programs that make our country strong and secure to advance yet another tax scam.

    More than 85 percent of deaths in public mass shootings involving four or more fatalities were caused by assault rifles
    Washington, D.C. –  U.S. Senator Ron Wyden today said that he is joining legislation to raise the minimum age to buy assault weapons and high-capacity ammunition magazines from 18 to 21. 
    “If you’re not old enough to purchase alcohol, you shouldn’t be allowed to buy an assault weapon either,” Wyden said. “We need to be doing everything we can to stop America’s gun violence epidemic, including raising the legal age of purchase to 21. I am proud to support this bill that will help keep weapons of mass destruction out of the hands of teenagers.”
    Gun violence is a national crisis, claiming more than 46,000 lives in 2023 — the third-largest number of gun-related deaths in U.S. history. Assault weapons, originally engineered for military combat to maximize damage, are frequently used in mass shootings because of their ability to inflict catastrophic harm in mere seconds. Individuals under 21 have used assault weapons in some of the most devastating school shootings in U.S. history, including the mass shootings at Marjory Stoneman Douglas High School in Parkland, Florida, Robb Elementary School in Uvalde, Texas, and Sandy Hook Elementary School in Newtown, Connecticut.
    The same age requirement already applies to purchasing handguns from federally licensed dealers. This bill would expand the ban to assault weapons, large-capacity ammunition feeding devices, and related ammunition. Additionally, the legislation would bar most individuals under 21 from possessing these items, with limited exceptions for specific circumstances such as service in law enforcement or the armed forces.

    WASHINGTON, DC — U.S. Senators Jacky Reed (D-RI) and Sheldon Whitehouse (D-RI) joined 30 of their Senate colleagues in urging President Donald Trump to reject Congressional Republicans’ legislative plans to increase the cost of living for Americans.

    Last week, Congressional Republicans in both chambers approved for floor consideration their 2025 budget proposals, their blueprints for a large package that would raise costs for hardworking families and target critical services like Medicaid.

    “But the Republican budget plans do not focus on lowering costs, and in fact will raise costs for American families by forcing them to pay more for groceries, health care, education, and caregiving,” wrote the 32 U.S. Senators.

    Congressional Republicans’ budget plans will:

    Raise food costs: The Republican budget plans tee up extensive cuts to the Supplemental Nutrition Assistance Program (SNAP) and Meals on Wheels. 

    Raise health care costs: The Republican budget plans also pave the way for 15 Republican proposals to cut Medicare, Medicaid, and Affordable Care Act coverage. These Republican cuts would raise health care costs for over 160 million Americans.

    Raise education costs: The Republican budget plans set up cuts to programs that help families afford college, including Pell Grants and income-driven repayment plans, and tax scholarships for hard-working students.

    Raise caregiving costs: The Republican budget plans pave the way to cut programs that help families care for kids, people with disabilities, and aging loved ones. Cuts to these essential programs will make it impossible for many working families to live and work with dignity.

    “If Congressional Republicans are successful at passing their proposals, it will mean that families will pay more for food, healthcare, education, and caregiving – while Republicans plot more tax cuts for billionaires,” the Senators wrote. “We urge you to stand by the promises you made to the American people about lowering costs, including by committing not to sign any legislation that raises their costs.”

    Dear President Trump:

    We write to you today to urge you to honor the promises you made on the campaign trail to lower costs for American families. You promised the American people that you would immediately lower costs, “starting on Day One.”

    However, weeks into your Presidency, Congressional Republicans are moving forward with legislative plans to increase the cost of living for hardworking Americans. Congressional Republicans have released their 2025 budget proposals – their blueprints for a large legislative package that they hope to pass in the coming months.  Congressional Republicans have also circulated a “menu” of policies they want to include in that budget legislation.3But the Republican budget plans do not focus on lowering costs, and in fact will raise costs for American families by forcing them to pay more for groceries, health care, education, and caregiving.

    1. Raising food costs. The Republican budget plans tee up extensive cuts to the Supplemental Nutritional Assistance Program (SNAP) and Meals on Wheels. Republican cuts to SNAP will make it harder for senior citizens, disabled individuals, and working families to afford groceries. Republicans also want to defund meals for poor schoolkids, forcing already-struggling families to shoulder additional costs while grocery prices are skyrocketing, and slash funding for meals for elderly people.

    2. Raising health care costs. The Republican budget plans also pave the way for 15 Republican proposals to cut Medicare, Medicaid, and Affordable Care Act coverage. These Republican cuts would raise health care costs for over 160 million Americans who rely on these programs to make ends meet and stay healthy, and force the closures of community health centers, nursing homes, hospitals, and doctor’s offices across the country. The proposals especially target low-income seniors, children, and people with disabilities.

    3. Raising education costs. The Republican budget plans set them up to pass cuts to programs that help families afford college, including Pell Grants and income-driven repayment plans. These Republican cuts would hike loan payments for millions of Americans, drive families deeper into debt, and in some cases make it impossible for students to pay for school and achieve the American Dream.

    4. Raising caregiving costs. The Republican budget plans pave the way to cutting programs that help families care for kids, people with disabilities, and aging loved ones. Large cuts to Medicaid, Head Start, and other essential programs will make it impossible for many working families to live and work with dignity.

    The Republican budget plans are deeply troubling. If Congressional Republicans are successful at passing their proposals, it will mean that families will pay more for food, healthcare, education, and caregiving – while Republicans plot more tax cuts for billionaires. We urge you to stand by the promises you made to the American people about lowering costs, including by committing not to sign any legislation that raises their costs.

    Washington (February 19, 2025) – Senator Edward J. Markey (D-Mass.) and Senator Chris Van Hollen (D-Md.) today wrote to Department of Justice Inspector General Michael Horowitz about revelations that Assistant U.S. Attorney Denise Cheung was pressured to find evidence of a crime as a justification for freezing the release of billions of dollars in congressionally approved federal funds for the National Clean Investment Fund and the Clean Communities Investment Accelerator. These programs, which are part of the Greenhouse Gas Reduction Fund, leverage private capital to cut energy bills for families and small businesses, improve resiliency against climate change-fueled disasters, and create local economic opportunity while combatting climate change. Senator Sheldon Whitehouse (D-R.I.) and Senator Bernie Sanders (I-Vt.) also signed the letter. 

    In the letter, the lawmakers write, “The reports that Ms. Cheung was pressured to circumvent this standard suggest a deliberate attempt to weaponize the Justice Department for political purposes. Indeed, according to one report, ‘Cheung’s resignation came in connection with a Justice Department effort to assist President Donald Trump’s new head of the Environmental Protection Agency, who said last week that he would try to rescind $20 billion in grants awarded by the Biden administration for climate and clean energy projects.’” 

     
    The lawmakers continue, “Federal prosecutors have an obligation to comply with the legal ethics rules governing their conduct, including their duty to refuse illegal or unethical orders from superiors. Not even a month into the second Trump administration, several career prosecutors have already resigned rather than participate in legally and ethically questionable actions, igniting a crisis within the Justice Department. The Department must not become an instrument of political retribution or partisan maneuvering.” 

    The lawmakers urge the Office of the Inspector General, “to immediately open an investigation into the circumstances surrounding Ms. Cheung’s resignation, the directives she received, and the broader pattern of political interference in prosecutorial decisions. The integrity of our justice system depends on the independence of prosecutors and their ability to enforce the law free from political influence. If substantiated, these allegations represent an existential threat to the rule of law and demand swift corrective action.” 

    Senator Markey secured numerous provisions in the Inflation Reduction Act, including the creation of a $27-billion national climate financing network based on the National Climate Bank Act, which he introduced along with Senator Van Hollen. Following the passage of the Inflation Reduction Act in 2022, Senators Markey and Van Hollen and Congresswoman Debbie Dingell (MI-06) — the House lead on the climate financing legislation — welcomed the launch of the Greenhouse Gas Reduction Fund in April 2023.

  • MIL-OSI USA: Ernst Works with USDA to Fight HPAI, Protect Iowa Poultry Farmers

    WASHINGTON – Senators Joni Ernst (R-Iowa) and John Fetterman (D-Pa.), members of the Senate Agriculture Committee, are working closely with the United States Department of Agriculture (USDA) to provide a roadmap and enhance the agency’s response to the ongoing outbreak of highly pathogenic avian influenza (HPAI). They led their colleagues in sending a bipartisan, bicameral letter to the USDA outlining solutions they can collaborate on as the administration responds to the outbreak.  
    “The United States is now entering the fourth year of an outbreak of HPAI that has devastated farms, required the depopulation of more than 136 million birds on commercial poultry operations, and infected a small but growing number of farm workers. A new urgency is required from the USDA to address the evolving situation,” the lawmakers wrote. “We stand ready to work with you as you provide leadership on this vitally important issue, the largest animal health outbreak that the department has ever dealt with.”
    “It’s crucial to highlight the impact of avian influenza (HPAI) on Iowa’s turkey farmers. The 260,800 turkeys lost in 2024 and the current outbreak in 2025 emphasize the ongoing threat this virus poses to the Iowa turkey industry. Senator Ernst’s leadership in bringing attention to this issue is vital. A stronger focus on H5Nx vaccinations could help reduce the risk and spread of HPAI, giving farmers more tools to prevent and manage outbreaks. This kind of action will be key to safeguarding the livelihoods of farmers and the broader agricultural economy in Iowa,” said Gretta Irwin, Executive Director, Iowa Turkey Federation.
    “Poultry and egg farmers across Iowa are working diligently to navigate the challenges posed by highly pathogenic avian influenza (HPAI), but they can’t face this growing problem alone.     In the letter, the senators proposed:
    A forward-looking strategy for vaccination in affected laying hens and turkeys;
    Outreach to partners overseas to protect and maintain international trade;
    The establishment of an HPAI Strategic Initiative to engage with industry experts and develop methods for prevention and response;
    Support for states using the USDA’s National Milk Testing Strategy;
    Ensuring auditors are both in place and qualified to carry out biosecurity assessments; and
    Revising indemnity rates for laying hens and pullets to accurately compensate impacted producers.

    WASHINGTON — U.S. Senator Tim Scott (R-S.C.) reintroduced his Alan Shao II Fentanyl Public Health Emergency and Overdose Prevention Act. The legislation takes a three-fold approach to addressing the fentanyl crisis fueled by the expiration of Title 42 during the Biden administration. This legislation would allow the U.S. Department of Homeland Security (DHS) to expedite the processing and removal of migrants illegally entering the country in response to the fentanyl-related public health emergency. 

    “The former president left a disaster on our southern border that infected communities and families across our nation. A couple of years ago, my friend Alan Shao lost his son to the crisis curated by the Biden administration’s open border policies. This legislation is named in honor of his son to remind us that one life lost is one too many and that we can’t continue to sit idly by allowing devastation to rip through our homes,” said Senator Scott. “I am grateful to lead efforts to put an end to this public health crisis and clean up our border. I look forward to working with the Trump administration to ensure more Americans can live in a safer nation.”

    “The fentanyl crisis is a national emergency. It was driven by the Biden administration’s open-border policies and will require decisive, sustained, and specific action to stem. This bill will protect American lives and secure our border. I’m proud to work with my colleagues on this critical issue,” said Senator Cruz.

    “Sheriffs across North Carolina have told me that every one of our counties is a border county after four years of the Biden administration. To reverse this dangerous situation, I am proud to join Senator Tim Scott’s bill to speed up the removal of illegal aliens who pose safety risks to communities across the nation,” said Senator Budd. “The Trump administration needs more tools to get the southern border under control, and this bill would be another major step in the effort to restore law and order in our country.”

    In addition to Senator Scott, the bill is cosponsored by U.S. Senators Ted Budd (R-N.C.), Ted Cruz (R-Texas), and Bernie Moreno (R-Ohio). 

    Expedited processing and removal would apply to migrants who:

    • Are attempting to enter the US from Canada or Mexico illegally; 
    • Do not possess necessary travel documents for admittance into the US; and 
    • Are being held at a point of entry or a Border Patrol station facilitating immigration processing. 

    BACKGROUND

    The Alan T. Shao II Fentanyl Public Health Emergency and Overdose Prevention Act is named after the son of Dr. Alan Shao, the former Dean of the School of Business at the College of Charleston. Alan T. Shao II passed away at the age of 27 due to a fentanyl overdose. 

    Senator Scott’s legislation utilizes powers similar to those under Title 42, which allows the Department of Homeland Security to expedite the processing and removal of migrants illegally entering the country, and applies them in response to the fentanyl-related public health emergency.  

    According to the U.S. Drug Enforcement Agency (DEA), the agency seized more than 367 million deadly doses (2 mg of fentanyl equates to a deadly dose) in 2024. More than 100,000 Americans died from drug overdoses during 2023, with the majority of such deaths caused by fentanyl. 

    In addition to the Alan T. Shao II Fentanyl Public Health Emergency and Overdose Prevention Act, Senator Scott introduced the Securing Our Border Act, which redirects $22.4 billion of unobligated funding passed by Democrats to hire 87,000 Internal Revenue Service (IRS) agents and utilizes it to bolster security measures along our southern border.

    Furthermore, he introduced the Stifling Transnational Operations and Proliferators by Mitigating Activities that Drive Narcotics, Exploitation, and Smuggling Sanctions Act – or the STOP MADNESS Act, which would also ensure the president can sanction foreign governments that resist efforts to repatriate their citizens who unlawfully enter the United States.

    Today, U.S. Senator Kirsten Gillibrand announced legislation to raise the minimum age to purchase assault weapons and high-capacity ammunition magazines from 18 to 21, the same age requirement that already applies to purchasing handguns from federally licensed dealers. Individuals under 21 have used assault weapons in some of the most devastating shootings in U.S. history, including the 2022 mass shooting at a supermarket in Buffalo, NY, in which 10 people were killed.

    Gun violence is a national crisis, claiming over 46,000 lives in 2023 — the third-largest number of gun-related deaths in American history. Assault weapons, originally engineered for military combat to maximize damage, are frequently used in mass shootings because of their ability to inflict catastrophic harm in mere seconds. More than 85 percent of deaths in public mass shootings involving four or more fatalities were caused by assault rifles. Furthermore, shootings involving assault weapons or large-capacity magazines result in more than 2.5 times as many people being shot compared to incidents involving other firearms.

    “Guns are the leading cause of death for children and teenagers in America today. Year after year, deadly assault weapons inflict devastating and avoidable harm on our families, schools, and communities, causing children, parents, and teachers to live with the fear that the next school shooting may happen in their community,” said Senator Gillibrand. “The Age 21 Act offers a critical safeguard to prevent such tragedies, decreasing the threat of gun violence against our kids. I am proud to support this legislation, and I will fight hard for its passage this Congress.”

    The Age 21 Act’s restrictions on the sale of assault weapons, handguns, large-capacity ammunition feeding devices, and related ammunition to individuals under the age of 21 would apply to both federally licensed and private sellers. Additionally, the legislation would bar most individuals under 21 from possessing these items, with limited exceptions for specific circumstances such as service in law enforcement or the armed forces.

    The Age 21 Act was originally introduced by Senator Alex Padilla (D-Calif.).     Senator Gillibrand is a longtime champion for commonsense gun safety legislation. She wrote the Hadiya Pendleton and Nyasia Pryear-Yard Gun Trafficking and Crime Prevention Act, which formed the centerpiece of the Bipartisan Safer Communities Act’s (BSCA) anti-gun trafficking statute. So far, law enforcement has used the statute to take over 3,000 illegal guns off the streets and charge hundreds of suspected traffickers.     “The United States is now entering the fourth year of an outbreak of HPAI that has devastated farms, required the depopulation of more than 136 million birds on commercial poultry operations, and infected a small but growing number of farm workers. A new urgency is required from the USDA to address the evolving situation,” the lawmakers wrote. “We stand ready to work with you as you provide leadership on this vitally important issue, the largest animal health outbreak that the department has ever dealt with.”

    Washington, D.C. — Today, U.S. Senator Patty Murray (D-WA), a senior member and former Chairof the Senate Health, Education, Labor, and Pensions (HELP) Committee, questioned former Congresswoman Lori Chavez-DeRemer, President Donald Trump’s nominee to lead the Department of Labor (DOL), at a HELP committee hearing on her nomination. Murray pressed Chavez-DeRemer on the Trump administration’s unprecedented and unlawful efforts to hold up federal funding Congress passed into law, and whether it’s appropriate for Elon Musk—whose companies have repeatedly been accused of violating labor laws—to have access to sensitive, market-moving data at the Department of Labor. Murray also asked Chavez-DeRemer about how she would make sure the Department of Labor’s Wage and Hour Division and the Solicitor’s office would enforce our nation’s child labor law, as the number of minors employed in violation of child labor laws has increased dramatically since 2019—something Senator Murray has introduced legislation to combat.

    Murray began by pressing Chavez-DeRemer on Trump’s ongoing illegal funding freezes—and whether she will follow the law and ensure that funding passed by Congress and signed into law isn’t illegally held up by the Trump administration. “The Trump administration is flagrantly violating the bipartisan agreements in our appropriations law by refusing to spend money that Congress—in a  bipartisan manner—has passed for the American people. I’ve been hearing about it in my home state of Washington. I heard from an organization in Edmonds about whether or not it will now be able to provide support for our veterans who are seeking educational and employment opportunities as they transition to civilian life. I heard from a workforce training program that operates statewide about whether they’ll now be able to continue to pair workers with employers in the grocery industry.”

    “You should know that the chaos surrounding these funding freezes is causing real damage to people’s lives. So, I want to know: will you commit to following appropriations laws and the Impoundment Control Act?”

    Chavez DeRemer replied that, “The President of the United States has the power to determine what he’s going to do through his executive power. I have not been confirmed. I have not been read into all that.”

    “Ok I’m asking you: will you follow the law?,” Murray asked. “There is an Impoundment Control Act—will you follow that law?”

    “I will follow the law and the Constitution,” Chavez DeRemer replied.

    Murray pressed: “If you receive a directive to violate appropriations laws and withhold funding for workers, what will you do?”

    “I do not believe the President is going to ask me to break the law,” Chavez DeRemer said.

    Murray followed up: “But we have seen that across the board since he was put into office—where he is violating that law—so you will likely be asked. What will you do?”

    “Well it’s a hypothetical, I have not talked to the President on this issue,” Chavez DeRemer replied.

    Murray pressed again: “So you won’t commit to following the law if the President tells you to violate it?”

    “I will commit to following the law and I do not believe the President would ever ask me to break the law,” said Chavez DeRemer.

    Murray continued her questioning by asking about Elon Musk’s DOGE team accessing sensitive information at the Department of Labor—and the serious conflict of interest concerns it raised. “Last week, Elon Musk’s DOGE team came to the Department of Labor and got access to the Department’s sensitive information system. Musk’s companies have, as you must know, been repeatedly accused of violating labor laws—including workplace safety laws, discrimination laws, and wage and hour laws. In fact, OSHA has investigated Tesla and SpaceX. Now, Elon can access those investigations about HIS companies–because he’s gone in and gotten those records. He can also access sensitive, market moving data created by the Bureau of Labor Statistics. That gives him tremendous power to manipulate quarterly jobs numbers and other important economic data—to say nothing of raising potential insider trading concerns,” Murray continued.

    “Just to make this abundantly clear: Elon Musk is now in a position to use his unelected role to use confidential government data to advance his own corporate interests, while suppressing his competitors. Do you believe it is appropriate for someone with such blatant conflicts of interest to have access to those confidential economic and personal information?”

    Chavez DeRemer responded, “Thank you Senator Murray. If I have the honor of being confirmed by this committee and the full Senate, then I will have the opportunity—I have not stepped foot into the Department of Labor. And I understand…” 

    Murray continued: “Well, my question to you is will you protect the private information of people whose records you will be overseeing? Will you allow anyone—a billionaire, or anyone else—to come in and access that?”

    Chavez DeRemer evaded: “Again, because I have not been confirmed, I only see the reports that everybody else is seeing—I have not been read into that. If confirmed, I will…”

    Murray pressed: “You’re not answering the question.”

    Chavez DeRemer replied that, “If confirmed, I will support the Department of Labor. I think it’s important to support the Department of Labor. But I have not been…” 

    Murray pressed again: … the private information that you will be overseeing? Will you protect that?”

    “I would protect the private information. On this issue, I have not been privy to those conversations with the President—I have seen that. If confirmed, I commit to you that I will always protect the Department of Labor and those issues,” said Chavez DeRemer, finally.

    Murray concluded her questioning by raising awareness of the worrying spike in child labor violations over the last five years. “Well, let me ask you about child labor. It’s an area that I have been very worried about–the rise of child labor violations. The Wage and Hour Division at the department has actually seen a 31 percent increase in minors employed in violation of child labor laws since 2019. In the last administration, the Wage and Hour Division at DOL and the Solicitor’s office worked really hard to secure some really important victories against some really egregious violators. How will you make sure that the Wage and Hour Division and the Solicitor’s office work together to enforce our child labor laws in this country?” Murray asked.

    Chavez DeRemer responded, “Well, protecting… child labor is abhorrent. And nobody should stand for child labor exploitation. I will do everything in my power within the Department of Labor to double down on the safety of all American workers that are exploited–but especially child labor. And I would love to work with your office, if this is an important issue–it should be important to everybody, making sure that we protect against any child labor exploitation.”

    Throughout her career, Senator Murray has championed workers’ rights and fought to combat employment discrimination, including as the top Democrat on the Senate labor committee from 2015-2022—among other things, Senator Murray fought back against a proposed DOL rule by the Trump administration that would allow federal contractors and subcontractors to justify discrimination against women, LGBTQ+ people, and members of certain religious groups on ideological grounds. Last week, Republicans unveiled budget plans that set up deep cuts to Medicaid, threatening to shut down rural hospitals and rip away health care from tens of millions of Americans, including seniors and kids.

    Medicaid is the largest health insurance program in the country, providing health care coverage to more than 70 million Americans, and the consequences of any cuts to Medicaid would touch nearly every household in America. Medicaid covers 1 in 5 people living in the United States, including nearly half of all children, 31.5 million, and over 8 million seniors. Cuts to the program would mean ripping away health care from millions of families who count on it— including over 12 million rural Americans, as cuts would jeopardize rural hospitals and clinics’ ability to keep their doors open.

    Last month when Senate Republicans released their blueprint for a budget reconciliation bill, Senator Murray blasted it as “a precursor to Republicans giving massive tax cuts to billionaires while blowing up the deficit and grinding services Americans depend on—like Medicaid and SNAP—down to the bone.” At last week’s Budget Committee mark up of Republicans’ budget resolution, Murray—a senior member and former Chair of the Senate Budget Committee—laid out how their resolution is a roadmap to devastating cuts to programs from Medicaid to veterans benefits, and during the markup, Murray put forward six amendments to steer Republicans toward a bipartisan approach to spending, affirm Congress’ power of the purse, reverse massive arbitrary cuts to NIH, deliver transparency into the so-called Department of Government Efficiency (DOGE), and more.     Washington, D.C. – Today, U.S. Senator Patty Murray (D-WA), Vice Chair of the Senate Appropriations Committee and a senior member and former chair of the Senate Committee on Health, Education, Labor, and Pensions (HELP), responded to the Trump administration’s mass firings of dedicated workers across the Department of Health and Human Services (HHS) and its many subagencies. Thousands of HHS employees on their “probationary” period–i.e. those hired or promoted within the last 1-2 years–have already been fired, and more are expected to be in the coming days and weeks.

    ADMINISTRATION FOR CHILDREN AND FAMILIES (ACF)

    ACF is responsible for administering a variety of programs to help children and families thrive–including the primary federal child care grant program, Head Start, and Low Income Energy Assistance Program (LIHEAP), among many others. 

    Over the weekend, dozens of ACF staff were reportedly fired–including roughly 20% of the staff at both the Office of Head Start and Office of Child Care, which process grants supporting communities across the country, conduct oversight of those grants, and provide technical assistance to grantees.

    “It is outrageous that at the same time the child care crisis is holding back parents and hurting our entire economy, Trump is indiscriminately firing the workers who help child care and Head Start centers keep their doors open and ensure kids in their care are safe. You know what doesn’t help parents find and afford child care? Firing the people who help make sure there are more quality, affordable options in every part of the country,” said Senator Murray. “Trump and Elon are making child care more expensive and hard to get for working parents while they focus on passing massive tax cuts for themselves and other billionaires.”

    ADMINISTRATION FOR STRATEGIC PREPAREDNESS AND RESPONSE (ASPR)

    ASPR leads our country’s medical and public health preparedness for, response to, and recovery from disasters and public health emergencies–coordinating planning and response for when fires erupt, pathogens like COVID or bird flu emerge, and so much more.

    After claiming that employees working in emergency preparedness would be exempt from mass firings,  Trump and Musk began firing employees at ASPR this weekend.

    “We know all too well just how serious pandemic threats can get and what happens when we are not ready. It is painfully clear we need to be more prepared for public health threats, but Trump is undermining this agency and leaving us less prepared—even as the bird flu presents significant risks to our country. Firing ASPR staff puts our economy and our families in serious danger,” said Senator Murray.

    CENTERS FOR DISEASE CONTROL AND PREVENTION (CDC)

    CDC is charged with protecting the American people from health threats.

    Nonetheless, Trump and Musk have already fired hundreds of CDC employees, including staff responsible for monitoring public health threats and for addressing lab safety failures.

    “CDC is the backbone of our public health system–and on the frontlines of outbreaks and health threats across the nation. Trump’s decision to fire hardworking public health experts will make our communities less safe and less prepared to respond quickly and effectively when diseases put lives in danger. We are seeing right now how threats like measles, tuberculosis, and bird flu can spread without strong, trusted public health agencies—and Trump is all but ensuring these challenges will get more dangerous and more deadly,” said Senator Murray.

    CENTERS FOR MEDICARE AND MEDICAID SERVICES (CMS)

    CMS helps ensure over 100 million Americans have access to health insurance by overseeing Medicare, Medicaid, the Children’s Health Insurance Program (CHIP), and Affordable Care Act marketplaces. 

    The agency has long been understaffed and under resourced–and Trump and Musk have already begun indiscriminate firings at CMS. This includes staff responsible for inspecting nursing homes to ensure that families can have peace of mind that their loved ones are appropriately cared for–and at least 80 employees reportedly cut from the agency’s Center for Consumer Information and Insurance Oversight, which oversees the Affordable Care Act and protects Americans from surprise medical bills. Staff have also been fired from the CMS Innovation Center working on improving maternal health outcomes and more. 

    “Firing the people who help Americans get quality, affordable health care and who help ensure long-term care facilities are safe is as stupid as it is heartless. These firings aren’t some abstraction–they’ll hurt people who need help getting their kid covered or who should be able to trust the nursing home their mom lives in is safe,” said Senator Murray.

    FOOD AND DRUG ADMINISTRATION (FDA)

    The FDA is charged with protecting Americans’ health by ensuring the safety and effectiveness of medicines, biologics, and medical devices–and regulating food, cosmetics, tobacco products, and more. 

    Hundreds of layoffs have been reported at the FDA, which will jeopardize the agency’s ability to fulfill its critical mission. These include layoffs of staff responsible for reviewing medical device products, which could delay new products hitting the market.

    “From inspecting food to ensuring drugs are safe and effective to preventing food shortages and so much more, Americans depend on the FDA’s work every time they sit down for a meal or pick up a prescription. Sweeping layoffs will materially undermine this important work, leaving babies at higher risk of consuming contaminated formula, leaving patients waiting longer for lifesaving drugs to be reviewed and approved, and leaving our entire food supply more exposed to shortages, contaminants, or worse,” said Senator Murray.

    HEALTH RESOURCES AND SERVICES ADMINISTRATION (HRSA)

    HRSA is charged with improving access to care for vulnerable and underserved populations. The agency runs critical programs to bolster the nation’s health workforce, improve maternal and child health, support high-quality care in Community Health Centers and Ryan White HIV/AIDS clinics, address rural health needs, and more.

    Trump’s layoffs severely impact HRSA’s ability to deliver on these critical health care programs for communities nationwide. The layoffs reportedly include significant cuts to the staff hired specifically to support the modernization of the nation’s organ transplant system. Congress has worked in a bipartisan manner to strengthen this initiative by providing additional funding to address longstanding system issues and ultimately ensure that more organs are available for transplant. These layoffs will set back this lifesaving work for the 100,000 Americans waiting on an organ transplant.

    “HRSA builds the health workforce and helps connect people in every part of the country to the essential health services they need–from routine checkups to maternal care to HIV prevention and so much more. Indiscriminately firing these staff risks putting critical health services out of reach for so many Americans, and it is extremely troubling that staff charged with modernizing our nation’s organ transplant network, which has faced longstanding issues, have been fired,” said Senator Murray.

    NATIONAL INSTITUTES OF HEALTH (NIH)

    NIH is the nation’s premier medical research agency. Each year, NIH supports biomedical research that produces life-changing and, in many cases, lifesaving treatments and cures.

    Over 1,100 NIH employees have already been fired by Trump and Musk, including more than 130 employees at the National Cancer Institute and nearly 20% of the workforce at the National Institute on Aging, which funds Alzheimer’s disease research. This includes the Acting Director of the Center for Alzheimer’s and Related Dementias (CARD), alongside a number of senior scientists and principal investigators at CARD—leaving early career scientists and trainees without principal investigators guiding their work. Additional senior leaders at NIH are expected to be fired soon.

    The Trump administration is also continuing to hold up NIH funding, and its illegal and indiscriminate indirect cost rate change would create a massive funding shortfall for lifesaving research that patients and families are counting on. An estimated $1 billion in lifesaving research funding has already been prevented from going out the door to institutions in every state since January 20.

    “Trump isn’t just firing the scientists who put us on the cutting edge of biomedical research, he is taking the best hopes for patients desperately counting on new cures and treatments and throwing them in the shredder. Ousting top scientists and leaders at NIH–people who’ve spent decades gaining expertise and working to discover medical breakthroughs–does nothing to help patients searching for treatments that could save their lives. These firings create chaos–and dangerously set back NIH’s lifesaving work. Washington state is a hub for this work, and I’m already hearing from people in my state about how research into cancer, Alzheimer’s disease, diabetes, heart disease, and so many other deadly conditions will be upended by Trump’s NIH cuts and these reckless–and heartless–layoffs. This is not just going to delay research—it will halt clinical trials in their tracks, cut patients off from care, and hollow out our medical research enterprise in ways that will echo for years to come,” said Senator Murray.

    SUBSTANCE ABUSE AND MENTAL HEALTH SERVICES ADMINISTRATION (SAMHSA)

    SAMHSA is charged with improving services and support available to people across the country for substance use disorder and mental health. The agency plays a leading role in tackling the fentanyl and opioid crisis, and it oversees the 988 Lifeline. Nonetheless, Trump and Musk have also begun laying off dozens of SAMHSA employees.

    “After years of bipartisan work, we are just starting to make progress getting opioid overdose deaths to trend down nationally—and now Trump is jeopardizing that progress by firing employees at the agency responsible for much of this work. Trump’s decision to fire these workers undermines the work happening on the ground in our communities to improve and save lives,” said Senator Murray.

    Washington, D.C. — Today, at Senate Democrats’ weekly press conference, U.S. Senator Patty Murray (D-WA), Vice Chair of the Senate Appropriations Committee, spoke about Senate Republicans’ budget resolution that will be considered on the Senate floor this week, which makes middle-class Americans pay for tax cuts for billionaires like President Trump and Elon Musk.

    Senator Murray’s remarks, as delivered, are below:

    “While Trump is tossing our bipartisan funding laws into the shredder and Elon is decimating agencies with really zero concept of what our federal workers actually do—whether that’s managing the nuclear weapons stockpile or responding to bird flu—Senate Republicans are positively sprinting to make trillions in cuts that will hurt red and blue states so they can shower more tax cuts on the richest people in the world.

    “It is no mystery why billionaires like Donald Trump and Elon Musk love this plan: they are getting all the benefits, but they aren’t the ones footing the bill.

    “Middle-class Americans will pay for Republicans’ billionaire tax cuts, and the cost will be measured in shuttered family farms, families and kids kicked off Medicaid—losing their health care—and veterans losing out on hard-earned benefits.

    “I grew up in a family that knew what it was like to fall on hard times. My dad—a WWII veteran. He got too sick to work—he got MS. My mom kept us afloat with Dad’s VA benefits, food stamps, and the new job she got thanks to a federal workforce program.

    “It still wasn’t easy. But our government was there for them when the hard times came.

    “I know families are struggling now, just like my family struggled then. I hear from them every day. They are working so hard. They play by the rules. And they deserve—at the very least—the same opportunity my parents had when I was growing up.

    “And I am not going to stand by silently while Republicans try to sell that opportunity away to pay for even more tax breaks for billionaires.

    “Senate Democrats are going to make sure that the American people know this is the most flat-out pro-billionaire, anti-middle class budget we have ever seen.

    “There is zero chance we are going to let Republicans pass this pro-billionaire budget the easy way, without a fight. We’re going to put them on the record for everything Trump and Elon are doing to create real fraud, waste, and abuse.

    Washington, D.C. — Today, U.S. Senator Patty Murray (D-WA), Vice Chair of the Senate Appropriations Committee, held a virtual press conference with federal workers in Washington state who were recently laid off through no fault of their own and with zero justification, as part of Trump and Musk’s unprecedented assault on the federal workforce. The speakers underscored how the mass firings Trump and Musk have ordered over the last few days will severely jeopardize essential services that families in Washington state rely on—and leave us all worse off. A fact sheet compiled by Senator Murray’s office on some of the impacts in Washington state of these reckless mass layoffs is available HERE.

    Murray was joined for the press call by Gregg Bafundo, Former Lead Wilderness Ranger at the U.S. Forest Service’s Okanogan Wenatchee National Forest and a former U.S. Marine who lives in Okanogan County; Raphael Garcia, a veteran and former Management Analyst for the US. Department of Veterans Affairs (VA) who has served as the only management analyst for the Veterans Benefits Administration’s Disability Rating Activity Site at the Seattle Regional Office for the past 7.5 months; and Liz Krumpp, former Washington Constituent Account Executive at the Bonneville Power Administration (BPA), who retired from BPA in 2023 and resides in Olympia. Both Gregg and Raphael were let go last week as part of the Trump administration’s mass firings of federal workers.

    “Right now, President Trump, and his co-President Elon Musk are breaking American government. They are firing workers left and right—with no plan, no strategy, and no concern for who gets hurt,” said Senator Murray.“We know Trump’s firing spree isn’t about merit because they are targeting new employees, people who have been recognized for outstanding performance, and people who were recently promoted—who are now getting fired from their newly earned jobs. Trump and Musk are, by design, pushing out, some of our best performers—and fresh blood in the federal workforce. We know Trump’s mass firings aren’t about saving money. Otherwise, there would be no reason for them to fire hundreds of workers at the Bonneville Power Administration. After all, these positions are funded by ratepayers—by all of us in the Northwest—not from federal funding. And these are people who literally help keep the lights on. But no matter—they’re being fired on a whim because two billionaires don’t have a clue about what they do, and don’t care to learn.”

    “I swore an oath to serve our country—first in the U.S. Army and then at the VA—only to be abruptly terminated by the very institution that promised to care for those who have served,” said Raphael Garcia of Seattle, who was laid off through no fault of his own and with zero justification from the VA last week. “My termination isn’t just a personal tragedy; it’s a stark reminder that our federal government is dismantling essential support systems for Veterans and vulnerable communities. When cost-cutting means sacrificing dedicated, disabled service members and committed federal employees, it isn’t about efficiency—it’s about eroding the trust and dignity that our nation owes to those who answer the call to serve.”

    “For 18 years I have faithfully served the American People—eight as a US Marine and ten as a Wilderness Ranger. I have always put myself between the danger and my fellow citizens and now I have been cast aside as the parasite class or some kind of fraud. These heartless and gutless firings will lead to loss of lives and property,” said Gregg Bafundo of Okanogan County, who was laid off through no fault of his own and with zero justification from the Forest Service last week.

    “Bonneville is the source of nearly 50 percent of the electrical power that is consumed in the State of Washington and owns, operates, and maintains over 15,000 circuit miles of high voltage transmission from Montana, across Idaho, Oregon and Washington, extending into Wyoming, Nevada and California. Critically, Bonneville has over a dozen new transmission projects in the planning stageswhich its customers are asking forto serve the increasing demand for electricity and to interconnect new power generators being built. Bonneville is self-funded by selling transmission service or selling electrical power. That’s it. No federal tax revenues fund its work or its employees. Cutting its employees does not save the federal tax payer a dime,” said Liz Krumpp, who worked at BPA for 15 years before retiring in 2023 and resides in Olympia. These arbitrary lay-offs and hiring freezes will make it increasingly harder for the remaining employees to do their jobs and do them safely. Currently, its customers are asking Bonneville to expand its transmission system, not shrink it. Bonneville helps keep the lights on in the Northwest.  Its work costs taxpayers nothing.”

    Late last week, Senator Murray released a fact sheet detailing how Trump and Musk’s mass firings at all manner of federal agencies will hurt families, veterans, small businesses, farmers, and so many others across the country who need a government that works for them. Senator Murray has spoken out on the Senate floor against this administration’s attacks on federal workers, and recently sent an open letter to federal workers and a newsletter to her constituents in Washington state outlining her concerns with the administration’s so-called “Fork in the Road” offer. Senator Murray has also sent recent oversight letters demanding answers about indiscriminate staffing reductions across federal agencies including to HUD Secretary Scott Turner on reports of massive staff cuts at HUD, Interior Secretary Doug Burham on National Parks Service staffing cuts, and Acting USDA Secretary Gary Washington on the universal hiring pause for USDA firefighters, among others.

    “That is the height of incompetence. And these other firings are just as senseless and reckless.

    “In the middle of the bird flu threat—they are firing public health experts.

    “Weeks after the deadliest plane crash in years—they are firing FAA workers.

    “After the devastating wildfires recently—they are firing members of the Forest Service, and we’ll hear from one of them in a minute.

    “They are firing people who work in law enforcement, who do food and drug inspections, who research deadly diseases, and who are cleaning up nuclear waste.

    “I’ve spent years trying to get the Hanford cleanup the resources it needs. We’ve made so much progress—but it has still been understaffed, even before these pointless layoffs last week cut it down to a skeleton crew.

    “We know Trump’s firing spree isn’t about merit because they are targeting new employees, people who have been recognized for outstanding performance, and people who were recently promoted—who are now are getting fired from their newly earned jobs.

    “These are people who love their country and love their communities. They are people who work hard, make an honest living, and have families to support. And I’m so grateful to be joined by some of them today, who will speak about what they have been through.

    “And I’d like to say to them all—thank you for the work you’ve done for our country. You deserve so much better than how you’ve been treated.

    WASHINGTON, D.C. – Today, U.S. Senator Shelley Moore Capito (R-W.Va.), Chairman of the Senate Environment and Public Works (EPW) Committee, led a hearing on improving the federal environmental review and permitting processes.
    In her opening remarks, Chairman Capito spoke about the need to modernize our federal environmental review and permitting processes while maintaining critical environmental standards, as well as her desire to address these challenges in a bipartisan way. Additionally, Chairman Capito announced that the hearing record will remain open for over a month to give additional stakeholders an opportunity to share their experiences and input.
    Below is the opening statement of Chairman Shelley Moore Capito (R-W.Va.) as delivered.
    “Good morning again, and thank you all for being here. It’s very nice for you to come on such a critical issue to our nation’s future – the need to modernize our federal environmental review and permitting processes – something we’ve talked about endlessly, both to grow our economy and also to improve our environmental stewardship. I’m really excited about this hearing.
    “Our witnesses will share their valuable perspectives and set the stage for the EPW Committee’s work on this important topic. To ensure we take a holistic view of these issues, we will keep this morning’s hearing record open until March 21, to give all stakeholders the opportunity to share their experiences with the existing environmental review and permitting processes, identify challenges, and then, hopefully, to suggest potential solutions.
    “For too long, critical projects such as energy and infrastructure projects, along with industrial projects as well, have been trapped in a cycle of redundant reviews, shifting goalposts, and regulatory uncertainty. 
    “In my home state of West Virginia, I’ve seen firsthand how these drive up costs, these delays, not just for the projects, but for the American families who are paying for more energy, housing, and food as a result. 
    “Meanwhile, businesses lack the certainty necessary to make long-term investments, which can mean lost jobs, missed economic opportunities for communities, scarcity, and higher prices across the nation.
    “It can also mean that projects needed to deploy renewable energies, or to restore the environment, are also stifled.
    “The framework for our environmental review and permitting processes is grounded in landmark laws under this Committee’s jurisdiction. NEPA requires federal agencies to consider environmental impacts on major federally funded projects or before implementing their project.
    “Other environmental and resource laws like the Clean Water Act, the Clean Air Act, and the Endangered Species Act rely on permits and operational requirements to ensure that critical projects are able to come to fruition in environmentally responsible ways.
    “However, years of changes in guidance and regulations from administration to administration and a complex web of judicial rulings have resulted in an ever-expanding hodge-podge of often duplicative and contradictory requirements.
    “While this confusing and complex body of administrative and common law has grown over the past half century, Congress has not stepped in to provide the holistic clarifications or modernization.
    “In the absence of congressional action, certain parties have found creative ways to use the judicial process to delay, remand, or strike down projects and raise costs to discourage project sponsors from moving forward.
    “As a result, environmental review and permitting processes have increased costs and delayed or stopped projects, including projects that would help achieve the goals in our environmental laws.
    “Last week, the House Transportation and Infrastructure Committee heard testimony from Nucor about how the need to obtain a Clean Water Act permit triggered significant delays based on required reviews under the Endangered Species Act and the National Historic Preservation Act. 
    “These permitting delays nearly thwarted what will be among the most environmentally friendly steel production facilities in the world, and that will employ over a thousand people in Mason County, West Virginia.   
    “It literally took an act of Congress to permit the Mountain Valley Pipeline to move clean natural gas from West Virginia to our southern neighbors…Corridor H and Coalfields Expressway, two top highway priorities for the state of West Virginia that would improve safety and mobility, have both encountered multiple permitting delays under various environmental statutes.
    “West Virginia water line extensions, broadband projects, bridge replacements, have all faced federal permitting delays, and I’m sure my state is not unique. The problems we will explore today have been brewing for decades.
    “However, this Congress, we have an opportunity, I think, to deliver meaningful, bipartisan legislation that addresses these problems.
    “I am committed to working with Ranking Member Whitehouse, our colleagues on the Energy and Natural Resources Committee, and our House committee counterparts to produce a bill with meaningful reforms.
    “Durable and implementable environmental review and permitting process reform must be bipartisan to be successful. My guiding principles for this effort are straightforward, the legislation that we develop must help all types of projects, not just politically favored projects or projects that will support the infrastructure needs of some Americans but not others. We must provide clarity and transparency in the processes.
    “Finally, our legislation needs to look at every stage of these processes to find efficiencies while balancing public health, the environment, and the needs of our economy. Let me be clear, modernizing these processes does not mean cutting corners or weakening environmental and public health protections.
    “It means making the processes more efficient, more predictable, and more transparent so that the processes are not stuck in bureaucratic purgatory or endless litigation.
    “Hardworking Americans, small businesses, and entrepreneurs want a government that works for them, not one that keeps them waiting for the benefits that many of these projects promise to bring in their communities and household budgets.  
    “So, I look forward to the discussion today, and learning about our witnesses’ experience. I am hopeful that we can hear some consensus on the issues that this committee must focus our attention, so we can develop our legislation.  
    “With that – I look forward to hearing from our witnesses today and beginning the effort together to deliver real solutions for the American people.”

    WASHINGTON, D.C. – Today, U.S. Senator Shelley Moore Capito (R-W.Va.), Chairman of the Senate Environment and Public Works (EPW) Committee, led a hearing on improving federal environmental review and permitting processes.
    During the hearing, Chairman Capito questioned a panel of leaders from different industries and organizations about challenges they’ve faced while trying to implement projects important to American economic growth. In particular, Chairman Capito focused on the need to craft legislation that creates efficient and reliable timelines for National Environmental Policy Act (NEPA) and permitting processes and addresses endless legal challenges for projects. 
    HIGHLIGHTS:
    AGREEMENT ON CHANGES TO ENVIRONMENTAL REVIEW:
    Chairman Capito:
    “Both Republican and Democrat administrations over the last couple decades have recognized the need to address the environmental review process, and those administration have taken efforts, through changes to regulations and guidance, to do so. Despite these efforts, federal environmental review and permitting challenges persist…I would like to ask each of you, do you agree that Congress must come together to develop a bipartisan bill to tackle these challenging issues?”

    LENGTHY FEDERAL PROCESSES:
    Chairman Capito: 
    “Under current law and regulation, projects can take years or even decades to progress from concept to completing the NEPA process. What are the real world impacts of this lengthy timeline for projects on consumers of goods and services that your members produce?
    Leah Pilconis:
    “For the construction industry, delays cause uncertainty, and they also cause workforce instability. Our contractors can’t commit to hiring workers. They can’t order materials when there are delays on breaking ground for projects, often because they’re tied up for years with lawsuits, delays also drive up costs.”
    Carl Harris:
    “The cost of permitting adds to the cost of housing, and every time, as I said in my testimony, every time you raise the cost of a house $1,000, you lock out 106,000 family units. That’s substantial.”
    ADDRESSING JUDICIAL REVIEW: “I want to ask about judicial review, it came up in almost everybody’s testimony. Many projects are targeted with litigation all throughout the process. The resulting legal costs and projects delays can be enough to stop a project, which happened with our Atlantic Coast Pipeline in West Virginia.”
    BUILDING CONSENSUS: “I think we have a lot of commonality here, a lot of good ideas, and a lot of thought that I think are going along the same lines. I think we should think big, and then come down from big to where we can meet the sweet spot. Because, like Senator Curtis said, we’ve been talking about this for years, we haven’t quite gotten there. So, I’m committed.”
