  • MIL-OSI USA News: Fact Sheet: President Donald J. Trump Fights Overcriminalization in Federal Regulations

    EASING THE REGULATORY BURDEN: Today, President Donald J. Trump signed an Executive Order to ease the regulatory burden on everyday Americans and ensure no American is transformed into a criminal for violating a regulation they have no reason to know exists.

    • The Order discourages criminal enforcement of regulatory offenses, prioritizing prosecutions only for those who knowingly violate regulations and cause significant harm.
      • Strict liability offenses, which don’t require proof of bad intent, are generally disfavored.
    • The Order requires each agency, in consultation with the Attorney General, to provide to the Office of Management and Budget (OMB) a list of all enforceable criminal regulatory offenses, the range of potential criminal penalties, and applicable state of mind required for liability.
      • Agencies must post these reports publicly and update them annually.
    • Criminal enforcement of offenses not publicly posted is strongly discouraged, and the Attorney General must consider the amount of public notice provided regarding an offense before pursuing investigations or charges.
    • The Order instructs agencies to explore adopting a guilty-intent standard for criminal regulatory offenses and cite the authorizing statute.
    • Agencies must publish guidance on referring violations for criminal enforcement, factoring in harm, defendant’s gain, and awareness of unlawfulness.
    • The Order does not apply to immigration law enforcement or national security functions.

    FIGHTING OVERCRIMINALIZATION IN FEDERAL REGULATIONS: President Trump believes that the United States is drastically overregulated and is taking action to protect Americans from unjust criminalization.  

    • The Code of Federal Regulations contains over 48,000 sections, stretching over 175,000 pages – far too vast for any citizen to fully comprehend, much less be criminally convicted over violations.
    • Many regulations carry criminal penalties for violations, including “strict liability” offenses that do not require proof of intent, meaning Americans can be convicted without knowing they violated a rule.
    • No one knows how many separate criminal offenses are contained in the Code of Federal Regulations, with at least one source estimating hundreds of thousands of such crimes.
    • The situation is absurd, unjust, and ripe for abuse, enabling government officials to target unwitting individuals and weaponize regulations against them.
    • Overregulation privileges large corporations, which can afford expensive legal teams to navigate complex regulatory schemes, while disadvantaging small businesses and individual Americans and stifling new market entrants.

    CUTTING RED TAPE AND DISMANTLING BUREAUCRACY: Since returning to office, President Trump has worked at lightning speed to slash regulations, streamline government, reduce the Federal bureaucracy, and drain the swamp.

    • President Trump established the “Department of Government Efficiency” to examine how to streamline the Federal Government, eliminate unnecessary programs, and reduce bureaucratic inefficiency.
    • President Trump launched a 10-to-1 deregulation initiative, ensuring every new rule is justified by clear benefits.
    • President Trump authorized buyout programs to encourage federal employees to leave voluntarily.
    • President Trump simplified the Federal procurement process.
    • President Trump required cost-effective commercial solutions in Federal contracts.

    ESTABLISHING PROJECT HOMECOMING: Today, President Donald J. Trump signed a proclamation establishing Project Homecoming to encourage illegal aliens to voluntarily depart the United States.

    • The proclamation offers illegal aliens a choice: leave voluntarily with Federal support and financial assistance or face strict enforcement and penalties.
    • It creates a streamlined process for departure using the CBP Home app, provides government-funded flights at no cost to illegal aliens, facilitates travel for those lacking valid travel documents, and offers a concierge service at airports to assist with booking travel and claiming an exit bonus. 
    • The proclamation establishes an “exit bonus” as a financial incentive for illegal aliens who agree to voluntarily and permanently depart the United States.
    • It launches a nationwide communications campaign to inform illegal aliens of the Project Homecoming program and of the consequences of remaining, including removal, prosecution, fines, wage garnishment, and property confiscation.
    • It directs a full-scale, aggressive deportation surge, including with an additional 20,000 officers, for illegal aliens who do not depart voluntarily.

    SHRINKING THE ILLEGAL ALIEN POPULATION IN THE UNITED STATES: President Trump is fulfilling his legal obligation to end this invasion and protect the American people.

    • Under the previous administration, the southern border was overrun by cartels, criminal gangs, suspected terrorists, human traffickers, smugglers, and illicit narcotics.
    • The Biden Administration’s lenient border policies allowed thousands of illegal aliens to enter the United States daily, with 40% of catch-and-release migrants totally disappearing.
    • At one point in 2024, illegal aliens made up 75% of arrests in Midtown Manhattan for crimes like assault, robbery, and domestic violence.
    • Illegal immigration strains American schools and hospitals, limiting their capacity to serve citizens, and diverts billions of dollars in Federal, state, and local social services from Americans in need.
    • In fiscal year 2023, the fiscal burden of illegal aliens was estimated to exceed $150 billion in taxpayer dollars, covering costs like health care, food stamps, housing, education, and emergency services.
    • By incentivizing voluntary departure, Project Homecoming aims to reduce these costs and restore resources for American citizens.

    ENDING THE INVASION: President Trump has delivered on his promise to secure the border and prioritize the needs of American citizens, taking immediate action to put an end to the previous Administration’s border crisis. Since taking office, President Trump has:

    • Declared a national emergency at the southern border.
    • Deployed additional personnel to the border, including members of the Armed Forces and the National Guard.
    • Restarted border wall construction.
    • Designated international cartels and other criminal organizations – such as MS-13 and Tren de Aragua – as Foreign Terrorist Organizations and Specially Designated Global Terrorists.
    • Suspended the entry of aliens into the U.S.
    • Called for enhanced vetting and screening of aliens.
    • Required the identification of countries that warrant a partial or full suspension on the admission of nationals.
    • Restarted the detention and removal of aliens who are in violation of Federal law.
    • Directed the Administration to resume the Migrant Protection Protocols – also known as “Remain in Mexico.”
    • Ended the use of the CBP One app.
    • Terminated all categorical parole programs, such as the “Processes for Cubans, Haitians, Nicaraguans, and Venezuelans,” that are contrary to President Trump’s immigration agenda.
    • Ended automatic citizenship for children of illegal aliens.
    • Paused the operation of the U.S. Refugee Admissions Program (USRAP).
    • Ended catch-and-release policies.
    • Revoked Biden’s disastrous executive actions that essentially opened our southern border.
    • Detained the most dangerous illegal criminal aliens in Guantanamo Bay and El Salvador’s prisons.  
    • Removed the monetary incentive for illegal aliens to come to the United States in the first place by ensuring they do not receive taxpayer-funded resources.

  • MIL-OSI USA News: Fact Sheet: President Donald J. Trump Rescinds Useless Water Pressure Standards

    RESCINDING BURDENSOME WATER RULES: Today, President Donald J. Trump signed a memorandum to eliminate restrictive water pressure and efficiency rules that make household appliances less effective and more expensive. The memorandum directs the Secretary of Energy to:

    • Review and rescind—or revert to the minimum standards required by statute—rules that limit water use in showerheads, faucets, dishwashers, toilets, urinals, and washing machines.  
    • Publish in the Federal Register a notice clarifying the scope of federal preemption of state rules for water use in showerheads, faucets, toilets, and urinals.
    • Pause enforcement any of rules mentioned in the memorandum until they are rescinded or revised.
    • Work with the Director of the Office of Legislative Affairs to recommend to Congress any water pressure or related energy efficiency laws, including the Energy Policy Act of 1992, that should be repealed or amended.

    RESTORING CONSUMER CHOICE AND AFFORDABILITY: President Trump believes that the Federal Government should not impose or enforce regulations that make taxpayers’ lives worse.

    • Water conservation requirements for faucets, showers, bathtubs, and toilets make bathroom appliances more expensive and less functional.
    • Efficiency standards render other American appliances, like clothes washers and dishwashers, less useful, more breakable, and more expensive to repair.
      • Ultra-efficient washing machines cost at least $100 more according to the Department of Energy.
      • Updated dishwasher regulations caused those appliances to take two hours or more to complete a normal load of dishes—about twice the time of pre-standards models.

    FREEING HOUSEHOLDS FROM BAD REGULATIONS: President Trump if fulfilling his promise to free Americans from costly and ineffective appliance rules.

    • On his first day in office, President Trump signed an Executive Order to “safeguard the American people’s freedom to choose from a variety of goods and appliances, including but not limited to lightbulbs, dishwashers, washing machines, gas stoves, water heaters, toilets, and shower heads…”
    • President Trump also signed a Day One Presidential Memorandum directing agencies to “eliminate counterproductive requirements that raise the costs of home appliances.”
    • Under President Trump’s leadership, the Department of Energy has already withdrawn or postponed numerous energy efficiency rules on key home appliances.

    Today, President Donald J. Trump and Secretary of Transportation Sean Duffy unveiled a plan to completely overhaul the nation’s air traffic control system — taking action where the Biden Administration refused, despite repeat warnings.

    The announcement — which builds on the Trump Administration’s unprecedented actions to secure America’s skies and improve air travel — was praised by the nation’s major airlines:

    • United Airlines CEO Scott Kirby: “This really is an historic day — a day I have been looking forward to my entire career when I felt like we have turned the corner and are on the path to give the United States the best-in-class air traffic control system that the citizens of the United States deserve.”
    • American Airlines CEO Robert Isom: “I’ve been in the airline business a long time, and that entire time, I’ve known that the U.S. air traffic control system was operating on antiquated technology. This plan from President Trump and Secretary Duffy is absolutely the best opportunity that we’ve had in decades to do something about our outdated air traffic control infrastructure and build a best-in-class system that our country deserves.”
    • Delta Air Lines CEO Ed Bastian: “I want to especially thank Secretary Duffy and the Administration for gathering us all here today and taking such a strong approach to overhauling our air traffic control system in the U.S. This has been a long time coming.”
    • Southwest Airlines CEO Bob Jordan: “I cannot say enough thanks to Secretary Duffy, to the administration, to President Trump for the stellar leadership to bring everyone together on this problem. This challenge is decades old, but I am absolutely confident that we can get this done and that we are finally going to address the real problem.”
    • JetBlue CEO Joanna Geraghty: “We very much appreciate the leadership that you are bringing to this ATC modernization effort … This has quite literally been our number one priority for decades. I am proud to stand here today with what appears to be a solution and path to move forward.”

    Key aspects of the Trump Administration’s plan include:

    • Replacing outdated infrastructure with state-of-the-art fiber, wireless, and satellite technologies at over 4,600 air traffic control sites — including 25,000 new radios, 600+ new radars, and 475 new voice switches.
    • Building six new air traffic control coordination centers for the first time in six decades.
    • Replacing towers and TRACONs and implementing modern hardware and software at all air traffic facilities to create a common platform throughout the network.

    President Donald J. Trump is determined to make the American pharmaceutical and biotechnology industries great again — both as a matter of national security and to unleash unprecedented prosperity for American workers.

    Gilead Sciences became the latest industry leader to announce a massive new investment in its U.S. operations with an $11 billion boost to its planned U.S.-based spending.

    The company joins a host of others in expanding their domestic footprint to align with President Trump’s vision:

    • New Jersey-based Johnson & Johnson announced a $55 billion investment in manufacturing, research and development, and technology.
    • Roche, a Swiss drug and diagnostics company, announced a $50 billion investment in its U.S.-based manufacturing and research and development.
    • New Jersey-based Bristol Myers Squibb announced a $40 billion investment in research, development, technology, and manufacturing.
    • Indiana-based Eli Lilly and Company announced a $27 billion investment to more than double its domestic manufacturing capacity.
    • Novartis, a Swiss drugmaker, announced a $23 billion investment to build or expand ten manufacturing facilities across the U.S.
    • Illinois-based AbbVie announced a $10 billion investment over the next ten years to support volume growth and add four new manufacturing plants to its network.
    • New Jersey-based Merck & Co. announced it will invest a total of $9 billion over the next several years after opening a new $1 billion North Carolina manufacturing facility — including a new state-of-the-art biologics manufacturing plant in Delaware.
      • Merck Animal Health announced an $895 million investment to expand their manufacturing operation in Kansas.
    • New York-based Regeneron Pharmaceuticals announced a $3 billion agreement with FUJIFILM Diosynth Biotechnologies to produce drugs at its North Carolina facility.
    • California-based Amgen announced a $900 million investment in its Ohio-based manufacturing operation.
    • Illinois-based Abbott Laboratories announced a $500 million investment in its Illinois and Texas facilities.

    ESTABLISHING A NEW PARADIGM FOR OUR SPECIAL RELATIONSHIP: Today, on the 80th anniversary of Victory Day for World War II, President Donald J. Trump and Prime Minister Keir Starmer announced a historic trade deal, providing American companies unprecedented access to the UK markets while bolstering U.S. national security. This is a great deal for America.

    • President Trump: “The deal includes billions of dollars of increased market access for American exports, especially in agriculture, dramatically increasing access for American beef, ethanol, and virtually all of the products produced by our great farmers.”
      • “The UK will reduce or eliminate numerous non-tariff barriers that unfairly discriminated against American products.”
      • “This is now turning out to be, really, a great deal for both countries.”
    • Prime Minister Starmer: “This is going to boost trade between and across our countries. It’s going to not only protect jobs, but create jobs, opening market access.”
    • This trade deal will significantly expand U.S. market access in the UK, creating a $5 billion opportunity for new exports for U.S. farmers, ranchers, and producers.
      • This includes more than $700 million in ethanol exports and $250 million in other agricultural products, like beef.
      • It commits the countries to work together to enhance industrial and agricultural market access.
      • It closes loopholes and increases U.S. firms’ competitiveness in the UK’s procurement market.
      • It ensures streamlined customs procedures for U.S. exports.
      • It establishes high standard commitments in the areas of intellectual property, labor, and environment.
      • It maximizes the competitiveness and secures the supply chain of U.S. aerospace manufacturers through preferential access to high-quality UK aerospace components.
      • It creates a secure supply chain for pharmaceutical products.
    • The reciprocal tariff rate of 10%, as originally announced on Liberation Day, is in effect.
    • The United States will agree to an alternative arrangement for the Section 232 tariffs on UK autos.
      • Under the deal, the first 100,000 vehicles imported into the U.S. by UK car manufacturers each year are subject to the reciprocal rate of 10% and any additional vehicles each year are subject to 25% rates.
    • The United States also recognizes the economic security measures taken by the UK to combat global steel excess capacity and will negotiate an alternative arrangement to the Section 232 tariffs on steel and aluminum.
      • This deal creates a new trading union for steel and aluminum.
    • This U.S.-UK trade deal will usher in a golden age of new opportunity for U.S. exporters and level the playing fields for American producers.
    • Today’s action also sets the tone for other trading partners to promote reciprocal trade with the United States.

    A FRAMEWORK TO BOLSTER ECONOMIC SECURITY: President Trump continues to advance the interests of the American people, enhancing market access for American exporters and lowering tariff and non-tariff barriers to protect our economic and national security.

    • On April 18, President Trump had a call with Prime Minister Starmer to discuss our bilateral trade relationship.
    • U.S. total goods trade with the UK was an estimated $148 billion in 2024.
    • The UK average applied agricultural tariff is 9.2% while the U.S. average applied agricultural tariff (prior to April 2) was 5%.
    • The UK maintains certain tariff and non-tariff barriers that restrict market access and create an unfair playing field for American workers and businesses.
      • For example, the UK imposes tariffs that can exceed 125% on meat, poultry, and dairy products on top of maintaining non-science-based standards that adversely affect U.S. exports.
    • On April 2, 2025, Liberation Day, President Trump imposed a 10% tariff on all countries to address unfair trade practices that have contributed to America’s trade deficit and imbalances in order to better protect American workers and our national security. 

    A MILESTONE IN ADVANCING AN AMERICA FIRST TRADE POLICY: Since Day One, President Trump challenged the assumption that American workers and businesses must tolerate unfair trade practices that have disadvantaged our workers and businesses for decades and contributed to our historic trade deficit.

    • Reversing these conditions and addressing the lack of reciprocity in America’s trade relationships will bring about a new Golden Age and Make America Great Again.
    • President Trump continues to advance the interests of the American people, enhancing market access for American exporters and lowering tariff and non-tariff barriers.
    • The Economic Prosperity Deal with the United Kingdom is a critical step forward in a special relationship to promote reciprocal trade with a key ally and partner.

    During National Mental Health Awareness Month, we recognize the millions of Americans affected by mental health challenges, and my Administration remains committed to prioritizing their well-being. 

    Mental illnesses can affect anyone, regardless of their background or circumstances.  No person should have to face these challenges alone.  Recognizing the signs, fostering open dialogue, and showing compassion are essential steps in addressing mental health challenges and supporting those who face them.

    My Administration is confronting the mental health challenges facing our Nation as part of the efforts to improve the overall health and well-being of all Americans.  The Make America Healthy Again Commission is addressing the root cause of our country’s escalating health crisis and is committed to providing transparency and open-source data, conducting gold-standard research, along with improving access to nutritious food, and expanding treatment options to protect the health of every American.

    We also remain committed to making sure every man and woman who served in uniform has access to the mental health care and suicide prevention resources they need.  No one who has defended our country should struggle to get support when they need it most.   

    If you are struggling with your mental health, it is important to reach out to others and seek professionals for support.  Together, we will build a stronger, healthier future for all.

    Small businesses power our economy from the ground up, driving innovation and building products that keep America strong, competitive, and secure.  During National Small Business Week, we celebrate the unyielding spirit, creativity, and perseverance of our hardworking entrepreneurs who dare to dream big.

    Small businesses are vital to our economy.  America has 33 million small businesses that employ 61.7 million Americans — nearly half of the private-sector workforce — and create almost two out of every three new jobs in the country. 

    In recent years, small business owners have faced unprecedented challenges — record high inflation, reckless Federal spending, and burdensome regulations — yet have remained committed to delivering for America’s communities. 

    Small businesses across the country have also carried the burden of a broken global trade system for far too long.  Originally designed after World War II to support recovery in war-torn nations, it is now exploited by foreign competitors.  They flood our markets with cheap goods while shutting out quality American products. 

    Too many in our Government were afraid to tackle this problem.  Now, at last, my Administration is fixing it.  On Liberation Day, we implemented targeted tariffs to protect American businesses from unfair trade practices and to strengthen local supply chains.  We are putting American people first and delivering long-overdue relief for our workers and entrepreneurs. 

    My Administration is unleashing a new era of opportunity for small businesses built on common sense and pro-growth policies that put our workers and our job creators first.  We are cutting red tape, keeping taxes low, promoting fair and reciprocal trade practices, and fighting for hardworking Americans.

    A Proclamation 

    Every year, hurricanes destroy lives, striking some of our Nation’s most beautiful regions and leaving devastation in their wake.  National Hurricane Preparedness Week is a time to raise awareness about the dangers of these storms and encourage citizens in coastal areas and inland communities to be vigilant in emergency planning and preparation.

    Hurricanes, storm surges, and flooding can wash away homes and properties, but the greatest threat is the loss of life, making readiness paramount.  Those living in at-risk areas should have a family evacuation plan and a supply of non-perishable food, water, medicine, batteries, and other essential items.

    This August marks the 20th anniversary of Hurricane Katrina, which caused widespread destruction and loss of life, leaving an indelible impact on the Louisiana Delta and Mississippi Coast.  Tragically, in the decades since, other catastrophic hurricanes — most recently Helene and Milton — have devastated communities and shattered lives throughout our Nation. 

    In the aftermath of each storm, the intrepid American spirit emerged.  It was evident in the professionalism and compassion of volunteers and organizations offering aid, comfort, and temporary shelter — and in the extraordinary resilience and strength of those left to rebuild their lives.  I witnessed this firsthand in North Carolina after Hurricane Helene, where I met with survivors and local leaders working tirelessly to restore their communities.

    I remain steadfastly committed to supporting hurricane recovery efforts and ensuring that Federal resources and tax dollars are allocated to American citizens in need.  I signed an Executive Order giving State and local authorities a more significant role in resilience, preparedness, and rapid-response efforts.  Local officials have the insight to make risk-informed decisions, deploy resources, manage operations, and eliminate ineffective bureaucracy so we can better serve affected communities.

    As hurricane season approaches, I urge every household to recognize the dangers of severe weather, assess their risk, and develop a comprehensive plan to ensure disaster preparedness.

    Section 1Purpose.  During my first term, my Administration took unprecedented action to improve the well-being of the American people by restoring capacity for domestic production of critical pharmaceutical products.  Notably, in Executive Order 13944 of August 6, 2020 (Combating Public Health Emergencies and Strengthening National Security By Ensuring Essential Medicines, Medical Countermeasures, and Critical Inputs Are Made In The United States), I directed each executive department and agency involved in the procurement of Essential Medicines, Medical Countermeasures, and Critical Inputs to take a variety of actions to increase their domestic procurement of Essential Medicines, Medical Countermeasures, and Critical Inputs, as defined in section 7 of that order, and to identify vulnerabilities in our Nation’s supply chains for these products.  Unfortunately, the prior administration did too little to advance these goals.  Critical barriers and information gaps persist in establishing a domestic, resilient, and affordable pharmaceutical supply chain for American patients.

    One key area of concern is the length of time it takes to build pharmaceutical manufacturing facilities in the United States today.  New construction must navigate myriad Federal, State, and local requirements ranging from building standards and zoning restrictions to environmental protocols that together diminish the certainty needed to generate investment for large manufacturing projects.  For pharmaceutical manufacturing, these barriers are heightened by unannounced inspections of domestic manufacturers by the Food and Drug Administration (FDA), which are more frequent than such inspections at international facilities.  Industry estimates suggest that building new manufacturing capacity for pharmaceuticals and critical inputs may take as long as 5 to 10 years, which is unacceptable from a national security standpoint.  Even expanding existing capacity or modifying existing production lines to produce new or different products requires extensive permitting and regulatory approval, making it more difficult to repurpose existing underutilized pharmaceutical manufacturing capacity available domestically.

    It is in the best interest of the Nation to eliminate regulatory barriers to the domestic production of the medicines Americans need.  My Administration will work to make the United States the most competitive nation in the world for the manufacture of safe and effective pharmaceutical products.

    Sec. 2.  Policy.  It is the policy of the United States that the regulation of manufacturing pharmaceutical products and inputs be streamlined to facilitate the restoration of a robust domestic pharmaceutical manufacturing base.

    Sec. 3.  Streamlining Review of Domestic Pharmaceutical Manufacturing by the Food and Drug Administration.  Within 180 days of the date of this order, the Secretary of Health and Human Services, through the Commissioner of Food and Drugs (FDA Commissioner), shall review existing regulations and guidance that pertain to the development of domestic pharmaceutical manufacturing and shall take steps to eliminate any duplicative or unnecessary requirements in such regulations and guidance; maximize the timeliness and predictability of agency review; and streamline and accelerate the development of domestic pharmaceutical manufacturing.  The FDA Commissioner’s review shall encompass all regulations and guidance that apply to the inspection and approval of new and expanded manufacturing capacity, emerging technologies that enable the manufacturing of pharmaceutical products, active pharmaceutical ingredients, key starting materials, and associated raw materials in the United States.  The FDA Commissioner shall:

    (a)  evaluate the current risk-based approach to prior approval of licensure inspections, including when such inspections are necessary, and seek to improve upon this approach to ensure all required inspections are prompt, efficient, and limited to what is necessary to ensure compliance with the Federal Food, Drug, and Cosmetic Act and other Federal law;

    (b)  identify and undertake measures necessary to expand, as practicable, existing programs that provide early technical advice before a facility is operational;

    (c)  identify and undertake measures necessary to improve enforcement of data reporting under section 510(j)(3) of the Federal Food, Drug, and Cosmetic Act (21 U.S.C. 360(j)(3)), including consideration of publicly displaying the list of facilities, including foreign facilities, that are not in compliance;

    (d)  provide clearer guidance regarding the requirements or recommendations for site changes, including moving production from a foreign to domestic facility, and validation of new or updated components necessary in manufacturing; and

    (e)  review and, as appropriate, seek to update any other relevant compliance policies, guidance documents, and regulations.

    Sec. 4.  Enhancing Inspection of Foreign Manufacturing Facilities.  Within 90 days of the date of this order, the FDA Commissioner shall develop and advance improvements to the risk-based inspection regime that ensures routine reviews of overseas manufacturing facilities involved in the supply of United States medicines, which shall be funded by increased fees on foreign manufacturing facilities to the extent consistent with applicable law.  Additionally, the FDA Commissioner shall publicly disclose the annual number of inspections that the FDA conducts on such foreign facilities, with specific detail by country and by manufacturer. 

    Sec. 5.  Streamlining Review of Domestic Pharmaceutical Manufacturing by the Environmental Protection Agency.  Within 180 days of the date of this order, the Administrator of the Environmental Protection Agency (EPA) shall take action to update regulations and guidance that apply to the inspection and approval of new and expanded manufacturing capacity of pharmaceutical products, active pharmaceutical ingredients, key starting materials, and associated raw materials in the United States to eliminate any duplicative or unnecessary requirements and maximize the timeliness and predictability of agency review.

    Sec. 6.  Centralized Coordination of Environmental Permits to Expand Domestic Pharmaceutical Manufacturing Capacity.  For purposes of 42 U.S.C. 4336a, the EPA shall be the lead agency for the permitting of pharmaceutical manufacturing facilities that require preparation of an Environmental Impact Statement pursuant to the National Environmental Policy Act of 1969, 42 U.S.C. 4321 et seq., unless that role is assumed by another agency.  The lead agency shall designate a single point of contact within the agency to coordinate with permit applicants.  The Office of Management and Budget shall coordinate with the lead agency and with other relevant agencies and the Federal Permitting Improvement Steering Committee, as needed, to expedite the review and approval of relevant permits.

    Sec. 7.  Streamlining Review of Domestic Pharmaceutical Manufacturing by the United States Army Corps of Engineers.  Within 180 days of the date of this order, the Secretary of the Army, acting through the Assistant Secretary of the Army for Civil Works, shall review the nationwide permits issued under section 404 of the Clean Water Act of 1972 (33 U.S.C. 1344) and section 10 of the Rivers and Harbors Appropriation Act of 1899 (33 U.S.C. 403) to determine whether an activity-specific nationwide permit is needed to facilitate the efficient permitting of pharmaceutical manufacturing facilities.

    Sec. 8General Provisions.  (a)  Nothing in this order shall be construed to impair or otherwise affect:

    (i)   the authority granted by law to an executive department or agency, or the head thereof; or

    (ii)  the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.

    (b)  This order shall be implemented consistent with applicable law and subject to the availability of appropriations.

    (c)  This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

    (d)  The Department of Health and Human Services shall provide funding for publication of this order in the Federal Register.

    By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered:

    Section 1.  Purpose.  Dangerous gain-of-function research on biological agents and pathogens has the potential to significantly endanger the lives of American citizens.  If left unrestricted, its effects can include widespread mortality, an impaired public health system, disrupted American livelihoods, and diminished economic and national security.
    The Biden Administration allowed dangerous gain-of-function research within the United States with insufficient levels of oversight.  It also actively approved, through the National Institutes of Health, Federal life-science research funding in China and other countries where there is limited United States oversight or reasonable expectation of biosafety enforcement. 
    This recklessness, if unaddressed, may lead to the proliferation of research on pathogens (and potential pathogens) in settings without adequate safeguards, even after COVID-19 revealed the risk of such practices.

    Sec2.  Policy.  It is the policy of the United States to ensure that United States federally funded research benefits American citizens without jeopardizing our Nation’s security, strength, or prosperity.  My Administration will balance the prevention of catastrophic consequences with maintaining readiness against biological threats and driving global leadership in biotechnology, biological countermeasures, biosecurity, and health research.

    Sec3Stop Dangerous Gain-of-Function Research. (a)  The Director of the Office of Science and Technology Policy (OSTP), in coordination with the Director of the Office of Management and Budget and the Assistant to the President for National Security Affairs (APNSA), and in consultation with the Secretary of Health and Human Services and the heads of other relevant executive departments and agencies (agencies) identified by the Director of OSTP, shall establish guidance for the heads of relevant agencies, to the extent consistent with the terms and conditions of the funding, to immediately:
    (i)   end Federal funding of dangerous gain-of-function research conducted by foreign entities in countries of concern (e.g., China) pursuant to 42 U.S.C. 6627(c), or in other countries where there is not adequate oversight to ensure that the countries are compliant with United States oversight standards and policies; and
    (ii) end Federal funding of other life-science research that is occurring in countries of concern or foreign countries where there is not adequate oversight to ensure that the countries are compliant with United States oversight standards and policies and that could reasonably pose a threat to public health, public safety, and economic or national security, as determined by the heads of relevant agencies.
    (b)  The Director of OSTP, in coordination with the Director of the Office of Management and Budget and the APNSA, and in consultation with the Secretary of Health and Human Services and the heads of other relevant agencies, shall establish guidance for the Secretary of Health and Human Services and the heads of other relevant agencies with respect to suspension of federally funded dangerous gain-of-function research, pursuant to the terms and conditions of the relevant research funding, at least until the completion of the policy called for in section 4(a) of this order.  Heads of agencies shall report any exception to a suspension to the Director of OSTP for review in consultation with the APNSA and the heads of relevant agencies.

    Sec4.  Secure Future Research Through Commonsense Frameworks.  (a)  Within 120 days of the date of this order, the Director of OSTP, pursuant to 42 U.S.C. 6627 and in coordination with the APNSA and the heads of relevant agencies, shall revise or replace the 2024 “United States Government Policy for Oversight of Dual Use Research of Concern and Pathogens with Enhanced Pandemic Potential” to:
    (i) strengthen top-down independent oversight; increase accountability through enforcement, audits, and improved public transparency; and clearly define the scope of covered research while ensuring the United States remains the global leader in biotechnology, biological countermeasures, and health research;
    (ii) incorporate enforcement mechanisms, including those described in section 7 of this order, into Federal funding agreements to ensure compliance with all Federal policies governing dangerous gain-of-function research; and
    (iii) provide for review and revision at least every 4 years, or as appropriate.

    (b)  Within 90 days of the date of this order, the Director of OSTP, in coordination with the APNSA and the heads of relevant agencies, shall revise or replace the 2024 “Framework for Nucleic Acid Synthesis Screening” (Framework) to ensure it takes a commonsense approach and effectively encourages providers of synthetic nucleic acid sequences to implement comprehensive, scalable, and verifiable synthetic nucleic acid procurement screening mechanisms to minimize the risk of misuse.  The heads of all agencies that fund life-science research shall ensure that synthetic nucleic acid procurement is conducted through providers or manufacturers that adhere to the updated Framework.  To ensure compliance, the updated Framework shall incorporate the enforcement mechanisms described in section 7 of this order.  The Framework shall be reviewed and revised at least every 4 years, or as appropriate

    Sec5.  Manage Risks Associated with Non-federally Funded Research.  Within 180 days of the date of this order, the Director of OSTP, in coordination with the Director of the Office of Management and Budget, the APNSA, the Assistant to the President for Domestic Policy, and the heads of other relevant agencies, shall develop and implement a strategy to govern, limit, and track dangerous gain-of-function research across the United States that occurs without Federal funding and other life-science research that could cause significant societal consequences.  This strategy shall include actions to achieve comprehensive, scalable, and verifiable nucleic acid synthesis screening in non-federally funded settings.  Any gaps in authorities necessary to achieve the goals of this strategy shall be addressed in a legislative proposal to be sent to the President, through the Director of OSTP and the APNSA, within 180 days of the date of this order.

    Sec6.  Increase Accountability and Public Transparency of Dangerous Gain-of-Function Research.  The Director of OSTP, in coordination with the APNSA and the heads of relevant agencies, shall ensure that the revised policy called for in section 4(a) of this order includes a mechanism whereby research institutions that receive Federal funding must report dangerous gain-of-function research, and to the maximum extent permitted by law, include research that is supported by non-Federal funding mechanisms.  The reporting mechanism shall provide a publicly available source of information about research programs and awards identified pursuant to this section, including, where permitted by law, those that have been stopped or suspended pursuant to sections 3(a) and 3(b) of this order, and all future programs and awards that are covered by the updated policy developed in section 4(a) of this order.  This reporting shall be conducted in a way that does not compromise national security or legitimate intellectual property interests of subject institutions.

    Sec7.  Future Enforcement Terms.  The Secretary of Health and Human Services and the heads of other relevant agencies shall, consistent with existing laws and regulations, include in every life-science research contract or grant award:
    (a) a term requiring the contractual counterparty or grant recipient to agree that its compliance in all respects with the terms of this order and any applicable regulations promulgated by the contracting or grant-offering agency is material to the Government’s payment decisions for purposes of 31 U.S.C. 3729(b)(4);
    (b)  a term requiring such counterparty or recipient to certify that it does not operate, participate in, or fund any dangerous gain-of-function research or other life-science research in foreign countries that could cause significant societal consequences or generate unnecessary national security risks, and that does not comply with this order and the policies ordered herein;
    (c)  a term stating that a violation of the terms of this order or any applicable regulations promulgated by the contracting or grant-offering agency by any grant recipient may be considered a violation of such term by the recipient’s employer or institution; and  
    (d)  a term stating that any grant recipient, employer, or institution found to be in violation of the terms of this order or any applicable regulations promulgated by the contracting or grant-making agency may be subject to immediate revocation of ongoing Federal funding, and up to a 5-year period of ineligibility for Federal life-sciences grant funds offered by the Department of Health and Human Services and other relevant agencies.

    Sec8.  Definitions.  For the purposes of this order,
    “dangerous gain-of-function research” means scientific research on an infectious agent or toxin with the potential to cause disease by enhancing its pathogenicity or increasing its transmissibility.  Covered research activities are those that could result in significant societal consequences and that seek or achieve one or more of the following outcomes:
    (a)  enhancing the harmful consequences of the agent or toxin;
    (b)  disrupting beneficial immunological response or the effectiveness of an immunization against the agent or toxin;
    (c)  conferring to the agent or toxin resistance to clinically or agriculturally useful prophylactic or therapeutic interventions against that agent or toxin or facilitating their ability to evade detection methodologies;
    (d)  increasing the stability, transmissibility, or the ability to disseminate the agent or toxin;
    (e)  altering the host range or tropism of the agent or toxin;
    (f)  enhancing the susceptibility of a human host population to the agent or toxin; or
    (g)  generating or reconstituting an eradicated or extinct agent or toxin.

    Sec9.  General Provisions.  (a)  Nothing in this order shall be construed to impair or otherwise affect:
    (i) the authority granted by law to an executive department or agency, or the head thereof; or

    PROTECTING AMERICANS FROM DANGEROUS GAIN OF FUNCTION RESEARCH: Today, President Donald J. Trump signed an Executive Order to improve the safety and security of biological research in the United States and around the world. This Executive Order:

    • Ends any present and all future Federal funding of dangerous gain-of-function research in countries of concern like China and Iran and in foreign nations deemed to have insufficient research oversight.
    • Empowers American research agencies to identify and end Federal funding of other biological research that could pose a threat to American public health, public safety, or national security.
    • Prohibits Federal funding from contributing to foreign research likely to cause another pandemic. These measures will drastically reduce the potential for lab-related incidents involving gain-of-function research, like that conducted on bat coronaviruses in China by the EcoHealth Alliance and Wuhan Institute of Virology.
    • Protects Americans from lab accidents and other biosecurity incidents, such as those that likely caused COVID-19 and the 1977 Russian flu.

    ESTABLISHING SAFE AND SECURE OVERSIGHT OF DANGEROUS GAIN OF FUNCTION RESEARCH IN THE UNITED STATES: This Executive Order will increase the safety and security of biological research for Americans without impeding U.S. innovation.

    • For decades, policies overseeing gain-of-function research on pathogens, toxins, and potential pathogens have lacked adequate enforcement, transparency, and top-down oversight. Researchers have not acknowledged the legitimate potential for societal harms that this kind of research poses.
    • The Biden Administration allowed dangerous gain-of-function research with insufficient levels of oversight and actively approved Federal life-science research funding in China and other countries.
    • The 2024 United States Government Policy for Oversight of Dual Use Research of Concern and Pathogens with Enhanced Pandemic Potential (“DURC/PEPP”) and the 2024 Framework for Nucleic Acid Synthesis Screening are the latest examples of inadequate policies that rely on self-reporting and fail to protect Americans from dangerous research practices.
    • This Order pauses research using infectious pathogens and toxins in the United States that may pose a danger to American citizens until a safer, more enforceable, and transparent policy governing such research can be developed and implemented. It directs the Director of the Office of Science and Technology Policy (OSTP) and the National Security Advisor (NSA) to work with funding agencies to develop such a policy within 120 days.
    • Unlike previous policies, this Order contains enforcement and reporting mechanisms that will strengthen oversight and discourage subjective interpretation of policies that researchers have used in the past to evade biosafety and biosecurity oversight.

    SAFEGUARDING THE FUTURE AND PROMOTING AMERICAN BIOTECHNOLOGY DOMINANCE: President Trump is driving us into the Golden Age of American Innovation that will lead us to a safer, healthier, and more prosperous America.

    • This Order protects Americans from dangerous gain-of-function research that manipulates viruses and other biological agents and toxins, but it does not impede productive biological research that will ensure the United States maintains readiness against biological threats and continues to drive global leadership in biotechnology, biosecurity, and health research.
    • President Trump has long theorized that COVID-19 originated from a lab leak at the Wuhan Institute of Virology and has consistently pushed for transparency in investigating its origins.

    President Donald J. Trump’s relentless pursuit of an American manufacturing renaissance is “boosting demand for some U.S.-made goods, with smaller players reaping the early benefits,” writes The Wall Street Journal, as companies onshore production and buy their products in America.

    Here are a few examples from the story:

    • “‘We are swamped. We are running 24 hours a day, seven days a week in both Chicago and Cleveland,’ said Jack Schron, president of Jergens Inc., which makes manufacturing tools, including industrial screwdrivers, clamps and hoists. Schron said his factories in Ohio and Illinois are ‘going like gangbusters,’ partly owing to new orders from customers looking to avoid paying import tariffs.”
    • “Donny Chaplin, president of Grand River Rubber & Plastics in Ashtabula, Ohio, said he has seen a rush of new inquiries and orders. Two previous customers that had switched to Chinese suppliers a few years ago came back in recent days wanting to buy rubber gaskets from Grand River again, for the plastic pails they manufacture. Three manufacturers of oil filters also got in touch, wanting to shift business from China, with two already placing orders. All together, the new business will be worth about $5 million a year if it is completed, or roughly 10% of Grand River’s revenue. That might require the company to hire new employees and expand production lines.”
    • “The tariffs are a lifeline for the U.S. companies that sprang up during the Covid-19 pandemic to produce face masks, rubber gloves and other personal protective equipment, after shipments from Asia declined. The companies struggled in the pandemic’s aftermath, when hospitals and clinics abandoned U.S. manufacturers and returned to lower-cost suppliers in China, U.S. executives said. But new U.S. tariffs on rubber gloves from China have doubled the price from a few months ago, and ‘the folks that are relying on China are scrambling for other sources,’ said Alan Rust, chief growth officer for SafeSource Direct … ‘We were getting stiffed for a very long time, but just recently we’ve been getting a lot more inquiries.’”
    • “Employees for Massachusetts-based AccuRounds are working overtime to accommodate rising orders for the company’s shafts, valves and other steel components. The company recently added two customers that had shifted business from AccuRounds to suppliers in Singapore and China in recent years. First-quarter sales were 20% higher from a year earlier, said Chief Executive Michael Tamasi.”
    • “Michigan-based Whirlpool, which assembles 80% of its U.S. appliances at domestic factories, says its Asian competitors have had an unfair advantage, as they manufacture their appliances overseas but haven’t been paying import tariffs on them since 2023, when one imposed during Trump’s first term expired. Those rivals’ access to cheaper components and steel in Asia helps give them a $150 retail price advantage on washers, Whirlpool says. Chief Executive Marc Bitzer said the latest tariffs on imported assembled appliances should help close the price gap. ‘The tariffs will finally help create a level playing field for Whirlpool,’ he said in April during a call with analysts.”

    Meanwhile, The Washington Post reports:

    • “At the local Excel Dryer plant, William Gagnon, the chief operating officer, is unfazed. In fact, President Donald Trump’s import taxes so far have been nothing but good news for one of the world’s largest makers of restroom hand dryers.     At the height of World War II, American and Australian forces fought for 4 grueling days against enemy naval and air forces at the Coral Sea.  Through their heroic bravery, their unwavering resolve, and the grace of Almighty God, our Allied forces halted at great cost a major enemy advancement for the first time in the Pacific Theatre, and sank an enemy aircraft carrier for the first time—marking a significant turning point in the war and paving the way for the enemy’s eventual defeat. 

    As we commemorate this historic battle, we also remember the 656 Allied service members who gave their lives for our liberty.  The courage of those fallen heroes not only changed the course of the war but also forged a glorious bond between the United States and Australia that endures to this day—a friendship that remains foundational to Indo-Pacific security and prosperity.

    Today, we honor the fearless determination of those who fought at the Coral Sea, and we solemnly remember those who laid down their lives to secure the future of freedom.  Their sacrifice will forever be etched in our hearts, and our nations remain eternally grateful.

  • MIL-OSI USA News: Establishment of the Religious Liberty Commission

    By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered:
    Section 1Purpose and Policy.  It shall be the policy of the executive branch to vigorously enforce the historic and robust protections for religious liberty enshrined in Federal law.  The Founders envisioned a Nation in which religious voices and views are integral to a vibrant public square and human flourishing and in which religious people and institutions are free to practice their faith without fear of discrimination or hostility from the Government.  Indeed, the roots of religious liberty stretch back to the early settlers who fled religious persecution in Europe, seeking a new world where they could choose, follow, and practice their faith without interference from the Government.  The principle of religious liberty was enshrined in American law with the First Amendment to the Constitution in 1791.  Since that time, the Constitution has protected the fundamental right to religious liberty as Americans’ first freedom.
    During my first term, I issued Executive Order 13798 of May 4, 2017 (Promoting Free Speech and Religious Liberty).  Pursuant to that order, the Attorney General issued a memorandum for all executive departments and agencies (agencies) titled “Federal Law Protections for Religious Liberty” on October 6, 2017.  The Supreme Court has also continued to vindicate the Founders’ commitment to religious liberty, including by giving effect to the principle that religious voices should be welcomed on an equal basis in the public square.
    In recent years, some Federal, State, and local policies have threatened America’s unique and beautiful tradition of religious liberty.  These policies attempt to infringe upon longstanding conscience protections, prevent parents from sending their children to religious schools, threaten loss of funding or denial of non-profit tax status for faith-based entities, and single out religious groups and institutions for exclusion from governmental programs.  Some opponents of religious liberty would remove religion entirely from public life.  Others characterize religious liberty as inconsistent with civil rights, despite religions’ vital roles in the abolition of slavery; the passage of Federal civil rights laws; and the provision of indispensable social, educational, and health services.
    President Ronald Reagan reminded us that “freedom is never more than one generation away from extinction.”  Americans need to be reacquainted with our Nation’s superb experiment in religious freedom in order to preserve it against emerging threats.  Therefore, the Federal Government will promote citizens’ pride in our foundational history, identify emerging threats to religious liberty, uphold Federal laws that protect all citizens’ full participation in a pluralistic democracy, and protect the free exercise of religion.

    Sec. 2Establishment of the Religious Liberty Commission.  (a)  There is hereby established the Religious Liberty Commission (Commission).
    (b)  The Commission shall function as follows:
    (i)     The Commission shall be composed of up to 14 members appointed by the President.  Members of the Commission shall include individuals chosen to serve as educated representatives of various sectors of society, including the private sector, employers, educational institutions, religious communities, and States, to offer diverse perspectives on how the Federal Government can defend religious liberty for all Americans.  The President shall designate a Chairman and Vice Chairman from among the members.  The Commission shall also include the following ex officio members or such senior officials as those members may designate:
                     (A)  the Attorney General;
                     (B)  the Secretary of Housing and Urban Development; and
                     (C)  the Assistant to the President for Domestic Policy.
    (ii)    Members appointed to the Commission shall serve one term ending on July 4, 2026, which marks the 250th anniversary of American Independence.  If the term of the Commission is extended by the President beyond July 4, 2026, members shall be eligible for reappointment for a 2-year term.  Members may continue to serve after the expiration of their terms until the appointment of a successor.
    (iii) The Commission shall produce a comprehensive report on the foundations of religious liberty in America, the impact of religious liberty on American society, current threats to domestic religious liberty, strategies to preserve and enhance religious liberty protections for future generations, and programs to increase awareness of and celebrate America’s peaceful religious pluralism. Specific topics to be considered by the Commission under these categories shall include the following areas: the First Amendment rights of pastors, religious leaders, houses of worship, faith-based institutions, and religious speakers; attacks across America on houses of worship of many religions; debanking of religious entities; the First Amendment rights of teachers, students, military chaplains, service members, employers, and employees; conscience protections in the health care field and concerning vaccine mandates; parents’ authority to direct the care, upbringing, and education of their children, including the right to choose a religious education; permitting time for voluntary prayer and religious instruction at public schools; Government displays with religious imagery; and the right of all Americans to freely exercise their faith without fear or Government censorship or retaliation.
     (iv)    The Commission shall advise the White House Faith Office and the Domestic Policy Council on religious liberty policies of the United States.  Specific activities of the Commission shall include, to the extent permitted by law, recommending steps to secure domestic religious liberty by executive or legislative actions as well as identifying opportunities for the White House Faith Office to partner with the Ambassador at Large for International Religious Freedom to further the cause of religious liberty around the world.
    (v)     Members of the Commission shall serve without any compensation for their work on the Commission.  Members of the Commission, while engaged in the work of the Commission, may be allowed travel expenses, including per diem in lieu of subsistence, to the extent permitted by law for persons serving intermittently in Government service (5 U.S.C. 5701-5707), consistent with the availability of funds.
    (vi)    To advise members of the Commission:
                 (A)  An Advisory Board of Religious Leaders shall be designated by the President and shall consist of not more than 15 members.  The Advisory Board of Religious Leaders shall be a subcomponent of the Commission and report to the Chairman of the Commission; 
                  (B)  An Advisory Board of Lay Leaders from religious congregations shall be designated by the President and shall consist of not more than 15 members.  The Advisory Board of Lay Leaders shall be a subcomponent of the Commission and report to the Chairman of the Commission; and
                  (C)  An Advisory Board of Legal Experts shall be designated by the President and shall consist of the Attorney General, or the Attorney General’s designee, and not more than 10 attorneys.  The Advisory Board of Legal Experts shall be a subcomponent of the Commission and report to the Chairman of the Commission.
    (vii)   The Commission shall terminate on July 4, 2026, which marks the 250th anniversary of American Independence, unless extended by the President.
    (viii)  The Department of Justice shall provide such funding and administrative and technical support as the Commission may require, to the extent permitted by law and as authorized by existing appropriations.
    (ix)    Insofar as the Federal Advisory Committee Act (chapter 10 of title 5, United States Code) may apply to the Commission or any of its Advisory Boards, any functions of the President under that Act, except for those in sections 1005 and 1013 of that Act, shall be performed by the Attorney General, in accordance with the guidelines and procedures established by the Administrator of General Services.

    Sec. 3.  Severability.  If any provision of this order, or the application of any provision to any agency, person, or circumstance, is held to be invalid, the remainder of this order and the application of its provisions to any other agencies, persons, or circumstances shall not be affected thereby.

    Sec. 4.  General Provisions.  (a)  Nothing in this order shall be construed to impair or otherwise affect:
    (i)   the authority granted by law to an executive department or agency, or the head thereof; or
    (ii)  the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.
    (b)  This order shall be implemented consistent with applicable law and subject to the availability of appropriations.
    (c)  This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

Trump delivered a powerful recap of his first 100 days in office — showcasing his transformative achievements and confronting the mainstream media’s distortions head-on. From securing the border to slashing billions in waste, President Trump laid out why the nation is rallying behind the America First agenda.

    Last night, President Donald J. Trump renewed his call for Congress to pass the “one big, beautiful bill” and once again deliver the largest tax cuts in history to the American people.

    In addition to finally exempting tips, overtime, and seniors’ Social Security from taxes, here’s what else that means:

    • Real wages will go up by as much as $3,300/year.
    • Take-home pay for median-income households will increase by as much as $5,000/year.
    • Short-run real GDP will be boosted by 3.3-3.8% and long-run real GDP by 2.6-3.2%.
    • 4.1 million jobs will be saved.

  • MIL-Evening Report: Confirmed: Australian weapons sold to Israel, reveals Declassified Australia

    The Australian counter-drone weapons system seen at a weapons demonstration in Israel recently is actually just one of a few that were sold by the Canberra-based company Electro Optic Systems (EOS) and sent through its wholly-owned US subsidiary to Israel, Declassified Australia can reveal.

    It was the ABC who broke the news of the EOS weapons system being provided for the demonstration trial. In response, Prime Minister Anthony Albanese continued to insist, as he has since the war in Gaza began, that Australia does not sell weapons to Israel.

    However the weapon displayed wasn’t just provided on loan for the demonstration – the weapon has been “sold” to the Israelis. Declassified Australia can reveal that EOS, by its own admission, sold more than one of its R400 weapons systems to the Israelis prior to the demonstration.

    An EOS company presentation, titled “2024 Full Year Results”, describes a “potential new customer” for the R400 weapon in the “Middle East” (page 36). The presentation, prepared for EOS shareholders and lodged with the Australian Stock Exchange, is dated 25 February 2025.

    EOS describes this potential new customer for its R400 as a “Preliminary” stage opportunity, valued at less-than-A$100 million, and states that more than one weapon was sold:

    “Sample products sold, demo held, discussions underway.” [Emphasis added]

    The company also points out a sense of urgency with the potential sale:

    “Potential to accelerate due to operational requirements.”

    In another section of the report (page 16), EOS reports a single entry in the “Preliminary” stage of a potential sale of R400 weapons, with the “Bid being prepared or submitted”.

    EOS states (page 36) the “estimated opportunity size” of the sale is up to “$100 million”. At a unit price per system of A$1.55 million that potential contract is enough to purchase 60 of the R400 counter-drone system.

    Under the heading “Notable Demonstrations” (page 15), EOS refers to “Counter Drone evaluation testing with New Customer”, held in January 2025, with an accompanying photograph of its R400 counter-drone cannon with five senior Israeli defence leaders posing beside it at the testing site.

    EOS itself has revealed that the new customer is clearly Israel.

    EOS states it had “supported a local prime [a major local weapons company] to demonstrate counter-drone capabilities in a high profile local demonstration”. EOS states that its R400 weapon system had “performed extremely well, earning high praise from the organisers.”

    The location of the demonstration of the Australian weapon is verified as being in Israel’s southern Negev Desert by a 5 February press release about the weapon testing, released by Israel’s Ministry of Defence.  [Note: Since publication of this article, the Press Release has been taken down from the Israeli Defense Ministry website, but is still available here, for now.]

    An Israel Defense Force photograph included with the press release, is the same photo of the R400 weapon and Israeli officials, as published in the EOS document. Israel’s Ministry of Defence also posted this video of the final demonstration event, with a firing of the EOS R400 weapons system appearing at 01:06.

    In the photograph standing behind the Australian company’s weapon are four senior Israeli defence officials, together with an Israeli defence industry CEO.

    Countering drone attacks
    EOS’ powerful R400 remote weapons system has a 2km range and is renowned for its lethality and precision in targeting. Using a sophisticated gimbal, its accuracy is maintained even when the system is mounted and used atop a moving vehicle. The weapon can be seen in use on a moving vehicle here in this video clip.

    The EOS R400 is not solely a counter-drone weapons system. It can be configured to fire weapons ranging from machine guns, to 30mm cannons, automatic grenade launchers, anti-tank guided missiles and 70mm rockets, meaning it can be used against multiple types of targets in addition to drones — including people, buildings, armoured vehicles, and tanks.

    The R400 Slinger variation is marketed by EOS as a system designed solely to counter modern drone threats with a single, lethal shot.

    The Australian company’s customer in Israel is noted in the EOS company document as being an Israeli “local prime” arms manufacturer. Both Israel Aerospace Industries (IAI) and Elbit Systems participated in the demonstration trials, each demonstrating a Counter Unmanned Aerial System (C-UAS) that incorporated a 30mm cannon.

    EOS sees a big future for the R400 and its suite of remote weapons systems. The EOS 2024 Financial Report was lodged with ASX on 25 February 2025. In the “Market Overview”section, it discusses weapons contracts signed in 2024, and notes (page 8) that:

    “[EOS] Defence Systems is in active discussions and contract negotiations for the provision of RWS [Remote Weapons Systems] and related components with other potential customers.”

    “Assuming the evaluation of these systems progresses positively, EOS would hope to move to sell larger, commercial quantities to these customers.”

    Australia obliged to act on defence transfers
    In October 2024, the UN’s Independent International Commission of Inquiry on the Occupied Palestinian Territory reported on the implementation of the International Court of Justice’s (ICJ) findings that Israel may be committing “genocide”.

    As reported by Kellie Tranter in Declassified Australia in November, the Australian government’s international legal responsibilities extend to investigating and regulating individuals and corporate entities who act in and from Australia to support the legally proscribed conduct of the Israeli State.

    The Commission stated:

    “Thus, the Commission recommends that any State engaged in such transfer or trade to Israel shall cease its transfer or trade until the State is satisfied that the goods and technology subject to the transfer or trade are not contributing to maintaining the unlawful occupation or to the commission of war crimes or genocide and thereafter throughout any period when the State is not so satisfied.” [Emphasis added]

    The UN Commission makes clear what trade it refers to:

    On the issue of arms and military transfer and trade relating to Israel’s military capability, States have a duty to conduct a due diligence review of all transfer and trade agreements with Israel, including but not limited to equipment, weapons, munitions, parts, components, dual use items and technology, to determine whether the goods or technology subject to the transfer or trade contribute to maintaining the unlawful occupation or are used to commit violations of international law.” [Emphasis added]

    If the government becomes aware of an impending military transfer of weapons or technology defined above, to Israel – as the stated intentions of EOS reported here make clear – it is obliged to investigate and if necessary intervene to halt the transfer:

    This includes both preexisting agreements and future transfers to Israel. States are obliged to demonstrate that any transfer or trade relating to military capability is not being used by Israel to maintain the unlawful occupation or commit violations of international law.” [Emphasis added]

    Words are not enough
    The Australian government and the Defence Department have continued their obfuscation of Australia’s weapons trade with Israel, as Declassified Australia has been reporting repeatedly.

    ABC television has reported how the government continues to insist no weapons or ammunition had been supplied “directly to Israel” since its latest genocidal war on Gaza began. The addition of the word “directly” is a notable change to the government’s wording, since this EOS news emerged.

    In response to the ABC report, Prime Minister Albanese said: “We do not sell arms to Israel . . .  We looked into this matter and the company has confirmed with the Department of Defence that the particular system was not exported from Australia. Australia does not export arms to Israel.”

    Declassified Australia has previously reported on the Albanese Government’s repeated and misleading use of the phrase “to Israel”. Arms companies are known for exporting their weaponry, or parts and components thereof, via third party countries in an attempt to cover their tracks.

    A defence industry source told the ABC the Australian-made components of the EOS R400 remote weapons system were assembled at the company’s wholly-owned US subsidiary in Alabama USA, before being shipped to Israel without an Australian export approval.

    Military exports, including ammunition, munitions, parts and components, do not need to travel ‘directly’ to Israel to be prohibited under the Arms Trade Treaty.

    Governments are required to find out where their weapons will, or may, end up and then make responsible decisions that comply with the treaty. A government must consider and assess the potential ‘end users’ of its military exports.

    A UN expert panel has issued repeated demands that States and companies cease all arms transfers to Israel or risk complicity in international crimes, possibly including genocide. It stated:

    “An end to transfers must include indirect transfers through intermediary countries that could ultimately be used by Israeli forces, particularly in the ongoing attacks on Gaza.…” [Emphasis added.]

    Greens’ defence spokesperson, Senator David Shoebridge, has said, “What we might be seeing here is the impact of what’s called AUKUS Pillar 2, the removal of any controls for the passage of weapons between Australia and the United States, and then Australia permitting the United States to send Australian weapons anywhere”.

    Not the first time
    EOS has a history of supplying its remote weapons systems to military regimes accused of extensive war crimes.

    During the catastrophic Yemen war which started in 2014, despite significant evidence of war crimes, EOS sold its weapons systems to both Saudi Arabia and the United Arab Emirates. EOS enjoyed the full support of the Turnbull coalition government and its defence industry minister Christopher Pyne.

    In early 2019, ABC TV reported, Saudi Arabia awarded Australian weapons manufacturer EOS a contract to supply it with 500 of its R400 Remote Weapons Systems.

    The company has also benefited from the government-industry ‘revolving door’. Former chief of army, Peter Leahy, was on the EOS board from 2009 until late 2022, encompassing the period of the Yemen war. He served as the company’s chair from mid-2021 until his departure.

    The two longest-serving current members of the EOS board are former chief of air force, Geoff Brown (joined 2016) and former Labor senator for the ACT, Kate Lundy (joined 2018).

    The release of a Human Rights Watch (HRW) report in 2023 raised serious concerns about EOS and its Saudi Arabian arms deals.

    HRW’s report revealed that hundreds, possibly thousands, of unarmed migrants and asylum-seekers had been killed at the Yemen-Saudi border in the 15 months between March 2022 and June 2023, allegedly by Saudi officers.

    Human Rights Watch says it identified on Google Earth what looks like “a Mine-Resistant Ambush Protected (MRAP) vehicle” near a Saudi border guard posts north of the Yemeni refugee trail in January 1, 2023.

    The vehicle has what appears to be “a heavy machine gun mounted in a turret on its roof”. This description closely matches the military equipment that Australia sold to Saudi Arabia a few years earlier.

    Declassified Australia put a number of questions to EOS, the Department of Defence, and the offices of the Prime Minister, the Defence Minister, and the Foreign Minister. None responded to our questions on this matter.

    INCENTIVIZING DOMESTIC AUTO PRODUCTION: Today, President Donald J. Trump signed a proclamation to protect national security by incentivizing domestic automobile production and reducing American reliance on imports of foreign automobiles and their parts.

    • The proclamation modifies the tariff action on automobiles and automobile parts by encouraging manufacturers to assemble their automobiles in the U.S., thereby reducing American reliance on foreign imports of automobiles and automobile parts.
    • It offers an offset to a portion of tariffs for automobile parts used in U.S.-assembled vehicles equal to 3.75% of the Manufacturer’s Suggested Retail Price (MSRP) of a manufacturer’s U.S. production for the next year (April 3, 2025 to April 30, 2026), and 2.5% of U.S. production the year after (May 1, 2026 to April 30, 2027).
      • These percentages reflect the duty that would be owed when a 25% duty is applied to 15% of the value of a U.S.-assembled automobile in the first year, and to 10% of the value of a U.S.-assembled automobile in the second year.
      • All other automobile imports will still be subject to the 25% tariff.
      • For instance, if a manufacturer builds a car in the U.S. that has 85% U.S. or USMCA content, the manufacturer effectively will not owe tariffs on that vehicle’s production for the first year.
      • If a manufacturer builds a car in the U.S. that is 50% U.S. or USMCA content and 50% imported from elsewhere, then instead of paying the tariff on the full 50% of the imported car parts, the manufacturer effectively only pays on 35% for the first year.
    • The proclamation sets strict penalties for importers who claim tariff reduction in excess of approved amounts.
    • This modified action will more effectively address the threat to national security by reducing reliance on foreign manufacturing, strengthening U.S. vehicle assembly operations, boosting domestic R&D, and creating American jobs, all of which are essential to a strong defense industrial base.

    MAINTAINING A RESILIENT DOMESTIC INDUSTRIAL BASE: President Trump is taking further action to ensure the U.S. can sustain its domestic industrial base and meet national-security needs. 

    • The COVID-19 pandemic exposed critical vulnerabilities and choke points in global supply chains, undermining our ability to maintain a resilient domestic industrial base.
    • Legislation, pre-existing trade agreements like the USMCA, revisions to the U.S.-Korea Free Trade Agreement, and subsequent negotiations have not sufficiently mitigated the threat to national security posed by imports of automobiles and certain automobile parts.
    • Foreign automobile industries, bolstered by unfair subsidies and aggressive industrial policies, have expanded, while U.S. production has stagnated.
    • In 1985, American-owned facilities in the United States manufactured 11.0 million automobiles, representing 97% of overall domestic (American- and foreign-owned) production of automobiles.
    • In 2024, Americans bought approximately 16 million cars, SUVs, and light trucks, and 50% of these vehicles were imports (8 million).
      • Of the other 8 million vehicles assembled in America and not imported, the average domestic content is conservatively estimated at only 50% and is likely closer to 40%.
      • Therefore, of the 16 million cars bought by Americans, only 25% of the vehicle content can be categorized as Made in America.
    • The United States trade deficit in automobile parts reached $93.5 billion in 2024.
    • Currently, the U.S. automobile and automobile parts industry (American-owned and foreign-owned firms) employs approximately one million U.S. workers.
    • Employment in automotive parts manufacturing totaled approximately 553,300 jobs in 2024, a decline of 286,000 jobs or 34% since 2000.
    • In 2023, Research and Development (R&D) by American-owned automobile manufacturers amounted to only 16% of global R&D spending. R&D by American-owned firms lagged behind the EU, which controlled 53% of global R&D.

    A PROCLAMATION

    Four hundred and eighteen years ago, more than 100 men completed a grueling 144-day voyage from the countryside of England to the mouth of the Chesapeake Bay in search of opportunity in the New World.
    Commissioned by King James I and the Virginia Company of London, these intrepid settlers charted three small ships — the Susan Constant, the Godspeed, and the Discovery — to set sail on a perilous journey across the Atlantic to expand the reach of the English Crown into unknown lands, create a better future for their families, and further the “Glory of His Divine Majesty.”
    Known as the “First Landing,” the seeds of America’s destiny were sown when this courageous band of Christians erected a towering wooden cross at the crest of Cape Henry, Virginia.  Under the First Charter of Virginia, which commissioned the voyage, they consecrated the New World, gave thanks to God for their safe passage, and dedicated the land to His glory.  The raising of the Cape Henry Cross was a visible symbol of the covenant the settlers made on their first day in the New World — for themselves and their posterity — to obey God, seek His blessing, and place their trust in Him.
    Within weeks, the men traveled inland to establish Jamestown — the first permanent English settlement in the New World.  “We hope to plant a nation where none before hath stood,” one early settler sang in a ballad.  In the months and years that followed, the settlers at Jamestown would face grave dangers and extraordinary challenges, including a severe drought, starvation, and disease.  By the first year’s end, only 38 of the original 104 men had survived.  Yet, by the grace of God, Jamestown endured and the American spirit of courage, strength, and determination was born.
    Today, a majestic granite cross stands on those same hallowed shores as a testament to the steadfast Christian belief of the Jamestown settlers that God’s grace abides, His mercy is abundant, and His glory is everlasting.  Our Nation honors the heroic souls whose faithful devotion and uncommon courage more than 400 years ago foreshadowed the birth of the greatest Republic in the history of the world — and it is in their memory that we pledge to forge a future that always celebrates our history, honors our heritage, and glorifies our God Almighty. 
    More than four centuries after the First Landing, we prayerfully renew our covenant to always be one Nation under God and to always seek His blessing and protection.
    NOW, THEREFORE, I, DONALD J.     A PROCLAMATION

    1.  On February 17, 2019, the Secretary of Commerce (Secretary) transmitted to me a report on his investigation into the effects of imports of passenger vehicles (sedans, sport utility vehicles, crossover utility vehicles, minivans, and cargo vans) and light trucks (collectively, automobiles) and certain automobile parts (engines and engine parts, transmissions and powertrain parts, and electrical components) (collectively, automobile parts) on the national security of the United States under section 232 of the Trade Expansion Act of 1962, as amended (19 U.S.C. 1862) (section 232).  Based on the facts considered in that investigation, the Secretary found and advised me of his opinion that automobiles and certain automobile parts are being imported into the United States in such quantities and under such circumstances as to threaten to impair the national security of the United States.
    2.  In Proclamation 9888 of May 17, 2019 (Adjusting Imports of Automobiles and Automobile Parts Into the United States), I concurred with the Secretary’s finding in the February 17, 2019, report that automobiles and certain automobile parts are being imported into the United States in such quantities and under such circumstances as to threaten to impair the national security of the United States.  I directed the United States Trade Representative (Trade Representative), in consultation with other executive branch officials, to pursue negotiation of agreements to address the threatened impairment of the national security of the United States with respect to imported automobiles and certain automobile parts from certain countries.  The Trade Representative’s negotiations did not lead to any agreements of the type contemplated by section 232.  I also directed the Secretary to monitor imports of automobiles and certain automobile parts and inform me of any circumstances that, in the Secretary’s opinion, might indicate the need for further action under section 232 with respect to such imports.
    3.  In Proclamation 10908 of March 26, 2025 (Adjusting Imports of Automobiles and Automobile Parts Into the United States), I found, based on information newly provided by the Secretary, that imports of automobiles and certain automobile parts continued to threaten to impair the national security of the United States and deemed it necessary and appropriate to impose a tariff system to adjust imports of automobiles and certain automobile parts so that such imports will not threaten to impair national security.  The tariffs on automobiles have been in effect since 12:01 a.m. eastern daylight time on April 3, 2025; the tariffs on automobile parts are set to go into effect on or after 12:01 a.m. eastern daylight time on May 3, 2025. 
    4.  In Proclamation 10908, I also deemed it necessary and appropriate to establish processes to identify and impose tariffs on additional automobile parts to ensure that the tariffs on automobiles and certain automobile parts are not circumvented and that the purpose of this action to eliminate the threat to the national security of the United States by imports of automobiles and certain automobile parts is not undermined.  I directed the Secretary to set up such a process within 90 days of the date of Proclamation 10908.
    5.  In Proclamation 10908, I also directed the Secretary to continue to monitor imports of automobiles and automobile parts, to review the status of such imports with respect to national security, and to inform me of any circumstances that, in the Secretary’s opinion, might indicate the need for further action by the President under section 232.  The Secretary has advised me that additional action is warranted in the interest of meeting the national security objectives outlined in Proclamation 10908.
    6.  In my judgment, it is necessary and appropriate to modify the system of monetary fees and related measures imposed to adjust imports of automobiles and certain automobile parts pursuant to Proclamation 10908 to more effectively eliminate the threat imports of automobiles and certain automobile parts pose on the national security of the United States.
    7.  I determine that the modified system, by linking the ultimate monetary fee imposed on imports of automobile parts to the imports’ use in assembly of automobiles within the United States, in the way and on the timeline described below, will adjust imports of automobiles and automobile parts and more effectively eliminate such imports’ threat to impair national security.  I find that the modified system will more effectively eliminate the national security threat because it will more quickly reduce reliance on foreign manufacturing and importation of automobiles and automobile parts; strengthen United States vehicle assembly operations by encouraging companies to expand domestic production capacity, which is critical to a strong domestic defense industrial base; shift manufacturing activity into the United States; increase domestic automotive research and development so that American-owned producers can produce cutting-edge technologies that are essential to the United States defense industrial base and our military superiority; create jobs in the automotive industry that increase the number of employees in the domestic automotive industry; and ensure that other benefits of production are concentrated in the United States. 
    8.  Section 232 authorizes the President to adjust the imports of an article and its derivatives that are being imported into the United States in such quantities or under such circumstances as to threaten to impair the national security of the United States so that such imports will not threaten to impair national security.
    9.  Section 604 of the Trade Act of 1974, as amended (19 U.S.C. 2483), authorizes the President to embody in the Harmonized Tariff Schedule of the United States (HTSUS) the substance of statutes affecting import treatment, and actions thereunder, including the removal, modification, continuance, or imposition of any rate of duty or other import restriction.
    NOW, THEREFORE, I, DONALD J. TRUMP, President of the United States of America, by the authority vested in me by the Constitution and the laws of the United States of America, including section 301 of title 3, United States Code; section 604 of the Trade Act of 1974, as amended; and section 232 of the Trade Expansion Act of 1962, as amended, do hereby proclaim as follows:
    (1)  To more effectively eliminate the threat to impair national security posed by imports of automobiles and automobile parts, I find that it is necessary to modify the system imposed in Proclamation 10908 by reducing duties assessed on automobile parts accounting for 15 percent of the value of an automobile assembled in the United States for 1 year and equivalent to 10 percent of that value for an additional year as follows:
    (a)  For automobiles assembled in the United States, automobile manufacturers shall be eligible to receive an import adjustment offset amount applicable to section 232 duties on automobile parts based on the following schedule:
    (i)   The automobile manufacturer may apply for an import adjustment offset amount equal to 3.75 percent of the aggregate Manufacturer’s Suggested Retail Price (MSRP) value of all automobiles assembled in the United States from April 3, 2025, through April 30, 2026.
    (ii)  The automobile manufacturer may apply for an import adjustment offset amount equal to 2.5 percent of the aggregate MSRP value of all automobiles assembled in the United States from May 1, 2026, through April 30, 2027.
    (b)  The percentage rate provided in subsection (i) reflects the total duty that would be owed when a 25 percent duty is applied to parts accounting for 15 percent of an automobile’s MSRP value.  The percentage rate provided in subsection (ii) reflects the total duty that would be owed when a 25 percent duty is applied to parts accounting for 10 percent of an automobile’s MSRP value. 
    (c)  Only automobiles that undergo final assembly in the United States are eligible to be included in this calculation.  The manufacturer’s import adjustment offset amount may only be used by importers of record authorized by that manufacturer, and the amount may only be used to offset tariff liability related to that manufacturer’s automobile parts tariff liability under Proclamation 10908.  Should a manufacturer’s import adjustment offset amount exceed the total amount attributable to that manufacturer’s automobile parts tariff liability under Proclamation 10908, the relief is capped at the total amount of that manufacturer’s automobile parts tariff liability under Proclamation 10908, and the manufacturer may not use the additional amount above that cap to offset any other tariff liability.  A manufacturer with an approved import adjustment offset amount may determine the importers of record eligible to decrement against that manufacturer’s import adjustment offset amount, and that list of importers of record may include suppliers in that manufacturer’s supply chain for automobiles assembled in the United States if the manufacturer so chooses.
    (2)  (a)  Within 30 days of the date of this order, the Secretary shall establish a process by which manufacturers seeking an import adjustment offset amount shall submit to the Secretary:
    (i)    documentation certifying the number of automobiles the manufacturer projects it will assemble in the United States, as well as a list of all plant locations where the projected automobiles will undergo final production;
    (ii)   documentation certifying the manufacturer’s projected cost of tariffs due to imported automobile parts subject to Proclamation 10908, broken down by tariff costs the manufacturer will incur directly and tariff costs the manufacturer will incur from its suppliers;
    (iii)  documentation detailing the total import adjustment offset amount requested within the schedule determined by the Secretary in accordance with this proclamation;
    (iv)   documentation identifying the importer(s) of record, including importer of record numbers, eligible to use that manufacturer’s import adjustment offset amount, as well as the amount of the manufacturer’s offset amount allotted to each importer of record; and
    (v)    a certification, signed by a senior officer of the manufacturer, attesting under penalty of perjury that the information submitted under subsections (i) through (iv) is true, complete, and accurate to the best of the manufacturer’s knowledge, and that the manufacturer has conducted reasonable due diligence to verify the accuracy of the assertions and facts contained in its submissions.
    (b)  Upon verification of the completeness and accuracy of a manufacturer’s submission and the manufacturer’s eligibility, the Secretary shall approve the application and notify U.S. Customs and Border Protection (CBP) with the information necessary for CBP to administer and implement the manufacturer’s import adjustment offset amount, including importer of record number(s) for the importer(s) eligible to use each offset amount and the approved import adjustment offset amount.  CBP shall confer the approved offset amount to the approved importer(s) of record using processes and mechanisms consistent with CBP’s operational framework and tariff administration procedures, including offset against current tariff obligations due at the time of entry, or other lawful methods.
    (3)  The Secretary, in consultation with the Secretary of the Treasury and the Commissioner of CBP, shall issue such regulations, guidance, and procedures as necessary to carry out the provisions of this proclamation and Proclamation 10908, and may establish standards for determining United States content and for validating manufacturer certifications.
    (4)  The Secretary, in consultation with the United States International Trade Commission and CBP, shall determine whether modifications to the HTSUS are necessary to effectuate this proclamation and may make such modifications through notice in the Federal Registerif needed.
    (5)  CBP shall begin providing approved importers with an import adjustment offset amount as soon as practicable and may request information from importers of record as necessary to implement a particular manufacturer’s import adjustment offset amount. 
    (6)  Should an importer claim and receive any import adjustment offset amount from CBP in excess of the amount approved by the Secretary, CBP may assess monetary penalties in the maximum amount permitted by law.
    (7)  The Secretary shall continue to monitor imports of automobiles and automobile parts.  The Secretary also shall, from time to time, in consultation with any senior executive branch officials the Secretary deems appropriate, review the status of such imports with respect to national security.  The Secretary shall inform the President of any circumstances that, in the Secretary’s opinion, might indicate the need for further action by the President under section 232.  The Secretary shall also inform the President of any circumstance that, in the Secretary’s opinion, might indicate that the duty rate provided for in Proclamation 10908, or any proclamation issued pursuant thereto, is no longer necessary.
    (8)  Any provision of previous proclamations and Executive Orders that is inconsistent with the actions taken in this proclamation is superseded to the extent of such inconsistency.  This proclamation shall apply in accordance with the Executive Order of April 29, 2025 (Addressing Certain Tariffs on Imported Articles).

    By the authority vested in me as President by the Constitution and the laws of the United States of America, including the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.), the National Emergencies Act (50 U.S.C. 1601 et seq.), section 604 of the Trade Act of 1974, as amended (19 U.S.C. 2483), section 232 of the Trade Expansion Act of 1962, as amended (19 U.S.C. 1862), and section 301 of title 3, United States Code, it is hereby ordered:

    Section 1.  Purpose.  The United States has imposed tariffs under various statutory authorities and through a number of Executive Orders and proclamations to protect national security and address unusual and extraordinary threats to the national security, foreign policy, and economy of the United States.  Although each of these actions, as listed in section 2 of this order, serves separate and distinct policy purposes, I have now determined that, to the extent these tariffs apply to the same article, these tariffs should not all have a cumulative effect (or “stack” on top of one another) because the rate of duty resulting from such stacking exceeds what is necessary to achieve the intended policy goals.  To avoid the cumulative effect of overlapping tariffs on certain articles, this order sets out the procedure for determining which of multiple tariffs shall apply to an article when that article is subject to more than one of the actions listed in section 2 of this order.

    Sec. 2Applicability.  This order shall apply only to the administration of tariffs imposed through the following actions and subsequent amendments to those tariffs:
    (a)  Proclamation 10908 of March 26, 2025 (Adjusting Imports of Automobiles and Automobile Parts Into the United States);
    (b)  Executive Order 14193 of February 1, 2025 (Imposing Duties To Address the Flow of Illicit Drugs Across Our Northern Border), as amended by Executive Order 14197 of February 3, 2025 (Progress on the Situation at Our Northern Border), Executive Order 14226 of March 2, 2025 (Amendment to Duties To Address the Flow of Illicit Drugs Across Our Northern Border), and Executive Order 14231 of March 6, 2025 (Amendment to Duties to Address the Flow of Illicit Drugs Across Our Northern Border);
    (c)  Executive Order 14194 of February 1, 2025 (Imposing Duties To Address the Situation at Our Southern Border), as amended by Executive Order 14198 of February 3, 2025 (Progress on the Situation at Our Southern Border), Executive Order 14227 of March 2, 2025 (Amendment to Duties To Address the Situation at Our Southern Border), and Executive Order 14232 of March 6, 2025 (Amendment to Duties to Address the Flow of Illicit Drugs Across Our Southern Border);
    (d)  Proclamation 9704 of March 8, 2018 (Adjusting Imports of Aluminum Into the United States), as amended by Proclamation 9980 of January 24, 2020 (Adjusting Imports of Derivative Aluminum Articles and Derivative Steel Articles Into the United States), and Proclamation 10895 of February 10, 2025 Adjusting Imports of Aluminum Into the United States); and
    (e)  Proclamation 9705 of March 8, 2018 (Adjusting Imports of Steel Into the United States), as amended by Proclamation 9980 of January 24, 2020 (Adjusting Imports of Derivative Aluminum Articles and Derivative Steel Articles Into the United States), and Proclamation 10896 of February 10, 2025 (Adjusting Imports of Steel Into the United States).

    Sec. 3.  Non-Stacking of Tariff Measures.  (a)  Notwithstanding any provision of any action listed in section 2 of this order, tariffs for articles subject to tariffs under the actions listed in section 2 of this order shall apply as follows: 
              (i)    An article subject to tariffs pursuant to the action listed in section (2)(a) of this order shall not be subject to additional tariffs on that article pursuant to the actions listed in sections 2(b) through 2(e) of this order.
             (ii)   An article subject to tariffs pursuant to the actions listed in section 2(b) or 2(c) of this order shall not be subject to additional tariffs on that article pursuant to the actions listed in section 2(d) or 2(e) of this order. 
             (iii)  An article subject to tariffs pursuant to the actions listed in section 2(d) of this order shall be subject to additional tariffs on that article pursuant to the actions listed in section 2(e) of this order, provided the article otherwise satisfies all conditions necessary for application of those additional tariffs; likewise, an article subject to tariffs pursuant to the actions listed in section 2(e) of this order shall be subject to additional tariffs on that article pursuant to the actions listed in section 2(d) of this order, provided the article otherwise satisfies all conditions necessary for application of those additional tariffs.
         (b)  Subsection (a) of this section shall not be construed to diminish the validity of any action listed in section 2 of this order.  Each action listed in section 2 of this order remains independently valid and enforceable, except that the duty rates provided by these actions shall not be cumulative when the conditions outlined in subsection (a) of this section are met.
         (c)  If an imported article is subject to both a tariff imposed pursuant to subsection (a) of this section and one or more tariffs imposed pursuant to an action or actions not listed in section 2 of this order, then the tariff imposed on the article pursuant to subsection (a) of this section shall be cumulative with the tariff or tariffs imposed pursuant to the action or actions not listed in section 2 of this order.

    Sec. 4.  Non-applicability to Other Tariff Measures.  (a)  Nothing in this order shall be interpreted to alter or limit the application of any duties, taxes, fees, or exactions other than those imposed pursuant to the actions listed in section 2 of this order.
    (b)  Accordingly, an article that is subject to duties pursuant to an action listed in section 2 of this order may still be subject to other applicable duties, taxes, fees, exactions, and charges, such as, but not limited to, those set forth in column 1 of the Harmonized Tariff Schedule of the United States (HTSUS); duties imposed pursuant to section 301 of the Trade Act of 1974, as amended; duties imposed pursuant to Executive Order 14195 of February 1, 2025 (Imposing Duties To Address the Synthetic Opioid Supply Chain in the People’s Republic of China), as amended; and antidumping and countervailing duties.

    Sec. 5.  Implementation.  (a)  The Secretary of Homeland Security, acting through the Commissioner of U.S. Customs and Border Protection and in consultation with the Secretary of the Treasury, shall take all necessary steps to update guidance, systems, and enforcement mechanisms, including to revise, suspend, or rescind any regulations that may be inconsistent with this order, to reflect the policy set forth in this order.
    (b)  The Secretary of Commerce and the Secretary of Homeland Security, in coordination with the Secretary of the Treasury and the United States Trade Representative, shall provide additional guidance as necessary to ensure consistent interpretation and application of the policy set forth in this order.
    (c)  The Secretary of Homeland Security is authorized to determine whether changes to the HTSUS are necessary and to coordinate with the Chair of the United States International Trade Commission to implement all necessary changes to execute this order.
    (d)  Any changes to the HTSUS necessary to comply with this order shall be made not later than 12:01 a.m. eastern daylight time on May 16, 2025.  This order shall apply retroactively to all entries of merchandise subject to any applicable tariffs outlined in section 2 of this order and made on or after March 4, 2025.  Any refunds will be processed pursuant to applicable laws and U.S. Customs and Border Protection’s standard procedures for such refunds.

    Sec. 6General Provisions.  (a)  Nothing in this order shall be construed to impair or otherwise affect:
              (i)   the authority granted by law to an executive department or agency, or the head thereof; or
              (ii)  the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.
    (b)  This order shall be implemented consistent with applicable law and subject to the availability of appropriations.
    (c)  This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

    Since President Donald J. Trump took office 100 days ago, it has been a nonstop deluge of hoaxes and lies from Democrats and their allies in the Fake News suffering from terminal cases of Trump Derangement Syndrome.

    In no particular order, here are some of the most egregious hoaxes peddled by the usual suspects so far in President Trump’s second term:

    • HOAX: Fake News CNN attempted to “fact check” President Trump’s claim that the Biden Administration spent millions on “making mice transgender.”
    • FACT: After their so-called “fact check” was thoroughly debunked, they were forced to update it in disgrace and admit the claim was, in fact, true.
    • HOAX: The Fake News claimed the Department of Defense removed Gen. Colin Powell’s name from a list of notable Americans buried at Arlington Cemetery.
    • FACT: No service members’ names were removed from that section — and Gen. Powell’s name remains among those listed.
    • HOAX: Rep. Eric Swalwell (D-CA) claimed “no president” presided over more plane crashes during their first month in office as President Trump.
    • FACT: “There were 55 aviation accidents in the U.S. between Biden’s inauguration on Jan. 21, 2021, and Feb. 17, 2021, compared to 35 during the same period for Trump,” Fox News reported.
    • HOAX: Gov. JB Pritzker (D-IL) and Chicago Public Schools officials claimed, without bothering to verify, that ICE agents had conducted a “raid” at an elementary school — a false claim echoed by media outlets, including the Chicago Tribune.
    • FACT: It was actually the U.S. Secret Service investigating a threat unrelated to immigration.
    • HOAX: Far-left influencers and other leftist hacks falsely claimed the Department of Government Efficiency (DOGE) and Elon Musk were out to “cut Social Security.”
    • FACT: They were referencing an interview in which Musk was clearly referring to the tremendous amount of waste, fraud, and abuse within entitlement programs.
    • HOAX: The media smeared DOGE as “young, inexperienced engineers” engineering a “government takeover.”
    • FACT: In reality, DOGE is led by seasoned industry professionals, including successful CEOs who paused their lives to aid in the effort of streamlining government and holding the bureaucracy accountable.
    • HOAX: NBC’s Peter Alexander peddled the lie that “constituents in some traditionally red districts” were unhappy with President Trump’s effort to cut waste, fraud, and abuse in government.
    • FACT: The same “protests” cited by the Fake News were funded and organized by far-left special interest groups.
    • HOAX: NPR claimed NASA astronauts Suni Williams and Butch Wilmore — who were stuck on the International Space Station for more than nine months following problems with their spacecraft — were “not stranded.”
    • FACT: NPR itself had described the astronauts as stranded in prior reporting, and only seemed to take issue with the description once President Trump and Elon Musk made it a priority to bring them home.
    • HOAX: A foreign Fake News outlet reported that President Trump “shut down” the British prime minister during a news conference.
    • FACT: In reality, President Trump was simply moving on from a reporter who was trying to goad the two leaders into division.
    • HOAX: NPR falsely claimed the White House was actively searching for a new secretary of defense.
    • FACT: This lie was immediately shut down by multiple Trump Administration officials, including President Trump himself.
    • HOAX: The Fake News attempted to paint illegal immigrant gang member Kilmar Abrego Garcia as an innocent “Maryland father” who was unjustly deported by the Trump Administration — and actively censored the truth about him.
    • FACT: Abrego Garcia is a citizen of El Salvador and was deported to his home country amid overwhelming evidence of his gang affiliation.
    • HOAX: Deranged “filmmaker” Michael Moore questioned whether deported illegal immigrants would go on to cure cancer or stop “that asteroid (sic) that’s gonna hit us.”
    • FACT: Moore’s statement was a strong early contender for the dumbest, most ridiculous statement of the year considering those deported illegal immigrants were violent criminals.
    • HOAX: The Fake News portrayed Mahmoud Khalil, a pro-Hamas radical who led violent protests at Columbia, as an innocent graduate student with an absolute right to remain in the U.S.
    • FACT: An immigration judge ruled Khalil — who is not a U.S. citizen — can be deported.
    • HOAX: The Financial Times reported that Senior White House Counselor Peter Navarro wanted to remove Canada from the “Five Eyes” intelligence sharing network.
    • FACT: Mr. Navarro immediately shut down this fake story.
    • HOAX: A foreign Fake News reporter claimed President Trump referred to European nations as “parasites.”
    • FACT: President Trump immediately pushed back on this ridiculous claim — as did the Italian prime minister.
    • HOAX: Fake News CNN’s Brianna Keilar implied the Trump Administration was somehow wrong for stopping illegal immigrants from stealing taxpayer dollars in the form of welfare benefits.
    • FACT: Deputy Chief of Staff Stephen Miller summarily embarrassed her with the facts: “The federal government will find EVERY illegal alien who is stealing American taxpayer dollars — and that’s what Americans expect to happen. I don’t even fathom the premise of your question.”
    • HOAX: A favorite refrain of the Fake News is that Secretary of Health and Human Services Robert F. Kennedy, Jr., is “anti-vaccine.
    • FACT: Kennedy debunked the lie in his confirmation hearings: “This has been repeatedly debunked … Bringing this up right now is dishonest.”
    • HOAX: WIRED falsely claimed the Social Security Administration is “shifting its public communication exclusively to X” under President Trump.
    • FACT: Not happening.
    • HOAX: Reuters falsely reported that the Trump Administration “stalled a United Nations program in Mexico aimed at stopping imported fentanyl chemicals from reaching the country’s drug cartels.”
    • FACT: The Department of State is actually trying to expand the initiative.
    • FACT: The Fake News frequently pushed the lie that as part of the Trump administration, Secretary Kennedy would implement a national abortion ban and “restrict or even ban medication abortion without a single act of Congress.”
    • FACT: Secretary Kennedy consistently pledged to implement President Trump’s policies — which include leaving abortion to the states, ending barbaric late-term abortions, protecting conscientious objections, and ending federal funding for abortions.
    • HOAX: Fake News savant Tara Palmeri falsely reported that President Trump’s proposal for Gaza was conceived by Jared Kushner.
    • FACT: This lie was immediately and summarily debunked by the Trump Administration: “The worst reporter in America makes up fake news for clout because she has no real sources. Sit down, dummy.”
    • HOAX: Sen. Chris Murphy, Rep. Jasmine Crockett, and media outlets claimed President Trump’s directive to pause radical, wasteful government spending meant an end to Medicaid, food assistance, and other individual assistance programs.
    • FACT: Individual assistance programs — Social Security, Medicare, Medicaid, SNAP, etc. — were explicitly excluded, as was made clear by Press Secretary Karoline Leavitt and the Office of Management and Budget. Only unnecessary spending — DEI, Green New Scam, NGOs that undermine the national interest — were included in the directive.
    • HOAX: A “physicians advocacy group” was widely cited as opposing President Trump’s nomination of Robert F. Kennedy, Jr., to lead the Department of Health and Human Services.
    • FACT: The “advocacy group” was really an astroturfed partisan organization funded by prominent left-wing donors — and accepted fake signatures.
    • HOAX: Sen. Tim Kaine (D-VA) and other Democrats pushed the lie that DOGE posted “classified information” on their website.
    • FACT: That alleged “classified information” was really just an employment headcount — which has been publicly available for years.
    • HOAX: Rep. Debbie Wasserman Schultz (D-FL) claimed Secretary of Homeland Security Kristi Noem called all Venezuelan immigrants “dirtbags.”
    • FACT: Secretary Noem actually called illegal immigrant members of the vicious Tren de Aragua gang “dirtbags,” which is true.
    • HOAX: The New York Times wrote that Secretary Robert F. Kennedy, Jr., wanted to “ban fluoride in drinking water” and “reverse … one of the most important public health practices in the country’s history.”
    • FACT: New York Times made no mention of their own reporting that fluoride may be “linked to lower IQ scores in children.”
    • HOAX: Sen. Chuck Schumer (D-NY) repeatedly lied about President Trump “going after” Social Security.
    • FACT: President Trump has repeatedly pledged to protect Social Security and make it more robust for American citizens.
    • HOAX: Sen. Mark Kelley (D-AZ) attempted to scare veterans by shamelessly claiming their care was in jeopardy due to “layoffs” at VA hospitals.
    • FACT: The lie was debunked by Secretary of Veterans Affairs Doug Collins: “What changes are you talking about? We’ve not had those layoffs… I put $360 million back into community care… It’s concerning to me that a veteran would actually tell stories to veterans that are not true.”
    • HOAX: Rep. Jasmine Crockett (D-TX) exploited the Ronald Reagan Washington National Airport plane crash tragedy by claiming President Trump “froze the hiring” of air traffic controllers.
    • FACT: Air traffic controllers were exempt from the federal hiring freeze.
    • HOAX: Rep. Jasmine Crockett (D-TX) implied that “cutting” members of an aviation advisory committee was somehow a cause of the Ronald Reagan Washington National Airport plane crash tragedy.
    • FACT: The advisory group hadn’t met since 2023 and was comprised of business and union leaders who gave “advice” to the TSA and had nothing to do with actual air travel.
    • HOAX: A far-left writer claimed Elon Musk and DOGE staffers “illegally installed a commercial server to control federal HR databases that contain sensitive personal information, including SSNs, home addresses, and medical histories.”
    • FACT: A top official confirmed “there’s nothing illegal and no server, just more made up tall tales from uninformed career bureaucrats.”
    • HOAX: The Washington Post alleged the Trump Administration was setting “quotas” for immigration authorities — and gave the administration just four minutes to comment before publishing.
    • FACT: As usual, this was a fake story.
    • HOAX: Online liberal activists claimed President Trump “took down” President Obama’s portrait in the White House.
    • FACT: Obama’s portrait was not taken down — it was simply moved only feet away from its previous location.
    • HOAX: Sen. Mazie Hirono (D-HI) claimed Attorney General Pam Bondi created a “weaponizing task force.”
    • FACT: It was a task force to END weaponization at the Department of Justice.
    • HOAX: CBS News reported that Secretary of Defense Pete Hegseth ordered a “makeup studio” be installed inside the Pentagon.
    • FACT: It was a “totally fake story,” and the alleged studio was really an existing green room with no frills.
    • HOAX: Politico reported the Trump Administration was debating lifting sanctions on Russian energy assets, including the Nord Stream pipeline.
    • FACT: This was debunked by both Secretary of State Marco Rubio and Special Envoy Steve Witkoff.
    • HOAX: An illegal immigrant in U.S. custody “simply disappeared,” The New York Times reported.
    • FACT: The illegal immigrant was a confirmed member of the vicious Tren de Aragua gang. An immigration judge ordered his removal, and he was deported along with other threats to national security.
    • HOAX: The Wall Street Journal alleged that Special Envoy Steve Witkoff was receiving sensitive information on a personal phone while in Moscow and that Russian Intelligence must’ve had access to the information.
    • FACT: This was a total fabrication. Special Envoy Witkoff did not even have a personal phone with him in Russia. He had only a government phone; a secure line of communication.
    • HOAX: The Wall Street Journal claimed the Trump Administration “sought to portray” deported criminal illegal immigrant gang member Kilmar Abrego Garcia as “violent.”
    • FACT: Abrego Garcia’s own wife filed an order of protection against him and testified that he brutally beat her.
    • HOAX: An AP reporter claimed that FAA staff who worked on “radar, landing and navigational aid maintenance, among others” were “harassed on Facebook” by DOGE.
    • FACT: That was a total lie. DOGE doesn’t have a Facebook page and no professionals who perform critical safety functions were fired.
    • HOAX: The Daily Beast claimed Vice President JD Vance “broke one of the most notorious Vatican rules during his Easter weekend visit” by being photographed in the Sistine Chapel.
    • FACT: Buried all the way down in the 14th paragraph, The Daily Beast admitted the vice president was given special permission by the Vatican to have photographs taken inside the Sistine Chapel.
    • HOAX: Left-wing social media accounts promoted fake, AI-generated audio of Vice President Vance “disparaging Elon Musk in private.”
    • FACT: The audio was debunked as fake.
    • HOAX: The New York Times reported that funding for the Women’s Health Initiative was being slashed by the Department of Health and Human Services.
    • FACT: Secretary Robert F. Kennedy, Jr., himself declared this Fake News and recognized the project is “mission critical.”
    • HOAX: Fox News’s Jennifer Griffin gave legitimacy to a hoax from delusional Reps. Debbie Wasserman Schultz (D-FL) and Rosa DeLauro (D-CT) that Secretary of Defense Pete Hegseth requested nearly $140,000 in “upgrades” to his government residence.
    • FACT: This lie was debunked by Secretary Hegseth — and it was so outrageous, even the AP was forced to admit it was completely fake.
    • HOAX: Rep. Don Beyer (D-VA) and many others claimed the Supreme Court ordered the return of illegal immigrant gang member Kilmar Abrego Garcia to the United States.
    • FACT: Even CNN admitted that’s not what happened: “They did not order the administration to return him to the United States … they could’ve said ‘we order him returned,’ but they didn’t do that.”
    • HOAX: Joe Biden accused the Trump Administration of “taking aim at Social Security.”
    • FACT: As usual, he was lying — President Trump has repeatedly pledged to protect Social Security.
    • HOAX: Rep. Ro Khanna (D-CA) claimed the arrest of a Milwaukee judge who helped an illegal immigrant evade arrest was “unprecedented.”
    • FACT: It wasn’t; it has happened before.
    • HOAX: Sen. Tammy Baldwin (D-WI) called the arrest of a Milwaukee judge who helped an illegal immigrant evade arrest a “gravely serious and drastic move.”
    • FACT: The judge violated the law by obstructing an ICE arrest of an illegal immigrant.
    • HOAX: Sen. Amy Klobuchar (D-MN) claimed the arrest of the Milwaukee judge who obstructed an apprehension of a criminal illegal immigrant “threatens the rule of law.”
    • FACT: It literally does the opposite because no one is above the law.
    • HOAX: Politico claimed the Trump Administration “wipe[d] out firefighter health and safety programs.”
    • FACT: The programs remain a top priority for the administration — and will remain intact.
    • HOAX: Sen. Elizabeth Warren claimed that President Trump’s policies make it so “no one wants to make investments in the United States.”
    • FACT: President Trump has secured more than $5 trillion in investments since taking office, which is expected to create more than 451,000 new jobs — and the list is only expected to grow.
    • HOAX: NBC’s Kristen Welker peddled a Fake News hoax that the Trump Administration was deporting children.
    • FACT: Secretary of State Marco Rubio shut down her desperate attempt at a hoax by highlighting how the mother, who was in the country illegally, made that choice all on her own.
    • HOAX: The New York Times implied President Trump was alone in wearing a blue suit to the funeral of Pope Francis.
    • FACT: Photos show dozens of world leaders and other attendees — many situated near President Trump — also wearing blue clothing.
    • HOAX: Teachers’ union boss Randi Weingarten accused President Trump of taking teachers’ salaries and giving them to “billionaires” by cutting the Department of Education.
    • FACT: President Trump has repeatedly called teachers “the most important people in this country” who should be paid more, not less. The federal government does not pay the salaries of teachers; state and local governments do.
    • HOAX: The Fake News and their predictable allies ran with a story that claimed an American citizen was detained by authorities after he informed them he was, in fact, a citizen.
    • FACT: That’s not what happened. The individual “approached Border Patrol in Tucson and stated he had entered the U.S. illegally through Nogales. He said he wanted to turn himself in and completed a sworn statement identifying as a Mexican citizen who had entered unlawfully … A few days later, his family presented documents showing U.S. citizenship. The charges were dismissed, and he was released to his family.”
    • HOAX: PBS News claimed “DOGE operatives attempted to gain access to secure spaces,” implying they attempted to access classified information without approval.
    • FACT: This wasn’t even remotely true.
    • HOAX: The AP falsely claimed Director of National Intelligence Tulsi Gabbard said President Trump is “very good friends” with Russian President Vladimir Putin.
    • FACT: The AP was humiliatingly forced to retract its story, admitting they were wrong. Stephanie Ruhle also had to issue a correction. DNI Gabbard was referencing President Trump’s relationship with Indian PM Narendra Modi.
    • HOAX: Student visa holders should have unfettered access to do whatever they want in the United States.
    • FACT: Wrong. As Secretary of State Marco Rubio said, “When you apply to enter the United States and you get a visa, you are a guest… If you tell us when you apply for a visa ‘I’m coming to the U.S. to participate in pro-Hamas events,’ that runs counter to the foreign policy interest of the United States… If you had told us you were going to do that, we never would have given you the visa.”

  • MIL-Evening Report: 50 years after the ‘fall’ of Saigon – from triumph to Trump

    30 April 1975. Saigon Fell, Vietnam Rose. The story of Vietnam after the US fled the country is not a fairy tale, it is not a one-dimensional parable of resurrection, of liberation from oppression, of joy for all — but there is a great deal to celebrate.

    After over a century of brutal colonial oppression by the French, the Japanese, and the Americans and their various minions, the people of Vietnam won victory in one of the great liberation struggles of history.

    It became a source of inspiration and of hope for millions of people oppressed by imperial powers in Central & South America, Asia, Africa, the Middle East and Eastern Europe.

    Civil war – a war among several
    The civil war in Vietnam, coterminous with the war against the Western powers, pitted communists and anti-communists in a long and pitiless struggle.

    Within that were various strands — North versus South, southern communists and nationalists against pro-Western forces, and so on. As various political economists have pointed out, all wars are in some way class wars too — pitting the elites against ordinary people.

    As has happened repeatedly throughout history, once one or more great power becomes involved in a civil war it is subsumed within that colonial war. The South’s President Ngô Đình Diệm, for example, was assassinated on orders of the Americans.

    By 1969, US aid accounted for 80 percent of South Vietnam’s government budget; they effectively owned the South and literally called the shots.

    US punishes its victims
    This month, 50 years after the Vietnamese achieved independence from their colonial overlords, US President Donald Trump declared April 2 “Liberation Day” and imposed some of the heaviest tariffs on Vietnam because they didn’t buy enough US goods!

    As economist Joseph Stiglitz pointed out, they don’t yet have enough aggregate demand for the kind of goods the US produces. That might have something to do with the decades it has taken to rebuild their lives and economy from the Armageddon inflicted on them by the US, Australia, New Zealand and other unindicted war criminals.

    Straight after they fled, the US declared themselves the victims of the Vietnamese and imposed punitive sanctions on liberated Vietnam for decades — punishing their victims.

    Under Gerald Ford (1974–1977), Jimmy Carter (1977–1981), Ronald Reagan (1981–1989), George H.W. Bush (1989–1993) right up to Bill Clinton (1993–2001), the US enforced the Trading with the Enemy Act (TWEA) of 1917.

    The US froze the assets of Vietnam at the very time it was trying to recover from the wholesale devastation of the country.

    Tens of millions of much-needed dollars were captured in US banks, enforced by the International Emergency Economic Powers Act (IEEPA). The US also took advantage of its muscle to veto IMF and World Bank loans to Vietnam.

    Countries like Australia and New Zealand, to their eternal shame, took part in both the war, the war crimes, and imposing sanctions and other punitive measures subsequently.

    The ‘Boat People’ refugee crisis
    While millions celebrated the victory in 1975, millions of others were fearful. The period of national unification and economic recovery was painful, typically repressive — when one militarised regime replaces another.

    This triggered flight: firstly among urban elites — military officers, government workers, and professionals who were most closely-linked to the US-run regime.

    You can blame the Commies for the ensuing refugee crisis but by strangling the Vietnamese economy, refusing to return Vietnamese assets held in the US, imposing an effective blockade on the economy via sanctions, the US deepened the crisis, which saw over two million flee the country between 1975 and the 1980s.

    More than 250,000 desperate people died at sea.

    Đổi Mới: the move to a socialist-market economy
    In 1986, to energise the economy, the government moved away from a command economy and launched the đổi mới reforms which created a hybrid socialist-market economy.

    They had taken a leaf out of the Chinese playbook, which under the leadership of Deng Xiaoping (1978 –1989), had moved towards a market economy through its “Reform and Opening Up” policies.  Vietnam saw the “economic miracle” of its near neighbour and its leaders sought something similar.

    Vietnam’s economy boomed and GDP grew from $18.1 billion in 1984 to $469 billion by 2024, with a per capita GDP at purchasing power parity (PPP) of $15,470 (up from about $300 per capita in the 1970s).

    After a sluggish start, literacy rates soared to 96.1 percent by 2023, and life expectancy reached 73.7 years, only a few short of the USA.  GDP growth is around 7 percent, according to the OECD.

    An unequal society
    Persistent inequality suggests the socialist vision has partially faded. A rural-urban divide and a rich-poor divide underlines ongoing injustices around quality of life and access to services but Vietnam’s Gini coefficient — a measure of income inequality — puts it only slightly more “unequal” as a society than New Zealand or Germany.

    Corruption is also an issue in the country.

    Press controls and political repression
    As in China, political power resides with the Party. Freedom of expression — highlighted by press repression — is severely limited in Vietnam and nothing to celebrate.

    Reporters Without Borders (RSF) rates Vietnam as 174th out of 180 countries for press freedom and regularly excoriates its strongmen as press “predators”.  In its country profile, RSF says of Vietnam: “Independent reporters and bloggers are often jailed, making Vietnam the world’s third largest jailer of journalists”.

    Vietnam is forging its own destiny
    What is well worth celebrating, however, is that Vietnam successfully got the imperial powers off its back and out of its country. It is well-placed to play an increasingly prosperous and positive role in the emerging multipolar world.

    It is part of the World Trade Organisation (WTO), and the ASEAN network, and borders China, giving Vietnam the opportunity to weather any storms coming from the continent of America.

    Vietnam today is united and free and millions of ordinary people have achieved security, health, education and prosperity vastly better than their parents and grandparents’ generations were able to.

    In the end the honour and glory go to the Vietnamese people.

    “This immortal statement was made in the Declaration of Independence of the United States of America in 1776. In a broader sense, this means: All the peoples on the earth are equal from birth, all the peoples have a right to live, to be happy and free.

    “… A people who have courageously opposed French domination for more than eight years, a people who have fought side by side with the Allies against the Fascists during these last years, such a people must be free and independent.

    “For these reasons, we, members of the Provisional Government of the Democratic Republic of Vietnam, solemnly declare to the world that Vietnam has the right to be a free and independent country — and in fact is so already. The entire Vietnamese people are determined to mobilise all their physical and mental strength, to sacrifice their lives and property in order to safeguard their independence and liberty.”

    Jobs Statistics:

    • President Trump has created 345,000 jobs since taking office in January.
      • 188,000 (54%) of these were in non-government and government-adjacent sectors. This is a dramatic improvement from the last two years of the Biden Administration, when three-fourths of all new jobs were in government or government-adjacent sectors.
        • 2,000 of which were mining and logging jobs.
        • 27,000 of which were construction jobs.
        • 9,000 manufacturing jobs were created (compared to the 6,000 manufacturing jobs lost per month from Jan 2023 to Dec 2024).
      • At the same time that there were large private sector job gains, 15,000 federal government jobs were cut.
    • The labor force participation rate for those without a high school diploma is up by 0.7% since President Trump took office.
    • The veteran unemployment rate is down from 4.2% in January to 3.8% in March.
    • 228,000 jobs were created in March alone, well above expectations.
      • This was the fourth best month in the last two years for private payroll growth.
    • Remote work among federal employees has fallen over 16 percentage points from March last year to March this year, showcasing the success of President Trump’s initiative to bring federal workers back to the office.
      • Federal telework numbers are now in-line with the private sector.

    Inflation Statistics:

    • Prescription drug prices are down over 2% since President Trump took office. 
    • Last month’s drop in the price of prescription drugs was the largest ever recorded.
    • Gasoline prices, as measured by the Consumer Price Index (CPI), are down 7% since President Trump took office.
    • Energy prices are down 2% since President Trump took office.
    • Wholesale egg prices down are about 50% since President Trump took office. Most consumers have seen relief in prices on the shelf, but all consumers should see it within the next month or two.
    • February inflation (the month prior to the most recent data) showed the smallest annual increase in core inflation in over four years (since March 2021).
    • Both of the last two CPI inflation prints came in below expectations.
    • Last month’s (March) decline was only the second monthly decline in inflation (CPI) in the last two-and-a-half years.
    • These price declines are in contrast to the persistently high inflation under President Biden, which reached the highest annual rate in the past 40 years. After suffering for years under Biden Administration inflation, consumers are now getting welcome relief. On Biden’s watch, grocery prices rose 23%, and energy prices rose 34%.
    • As a result of biting inflation, real wages in President Biden’s term were down about 2.4%.
    • Moreover, in the most recent inflation print from March, airfare, used motor vehicles, and motor insurance all saw price decreases.
    • Prices for wholesale goods fell nearly 1% last month and prices for wholesale services fell 0.2% last month, which will eventually lead to lower consumer prices.
    • Last month, retail egg price inflation continued to slow.

    Misc. Economic Statistics:

    • Real average hourly earnings for middle- and low-income workers are up 0.4% and up 1% for workers in the manufacturing sector since President Trump took office.
    • The automotive sector is growing: under President Trump, we already had the biggest one-month increase in auto sales in March in more than a year.
    • Mortgage rates have declined roughly four-tenths of a percentage point since President Trump took office.
      • Assuming the most recent median home price in the U.S., a new homebuyer making a 20% down payment on a 30-year mortgage would save roughly $32,400 over the course of the loan, or about $1,080 per year.
    • Industrial production was at the seventh-highest monthly level ever recorded in March. The only higher monthly levels occurred during the first Trump Administration in 2018 and in February of this year.
    • Since the beginning of the Trump Administration, at least $5 trillion in new investment in the U.S. has been pledged from both foreign governments and private companies.

    Economic Policy Wins:

    • Upon taking office, President Trump immediately blocked all unfinalized Biden-era rules, saving Americans over $180 billion — $2,100 per family of four over the next decade — and launched a bold, multi-agency effort to roll back existing federal regulations that drive up the cost of living. This effort is projected to yield significant cost savings in the coming months, including the EPA’s rollback of tailpipe emission rules for light-duty and medium-duty vehicles ($667 billion in total savings) and the Department of Transportation’s latest Corporate Average Fuel Economy (CAFE) standards ($88 billion in savings). These two efforts alone yield $755 billion in total savings or over $8,800 per family of four over the next decade. The combined savings from all of these actions equal just over $935 billion or nearly $11,000 per family of four over the coming decade.
    • The Trump Administration has implemented an aggressive 10-to-1 deregulatory initiative, which requires that whenever an agency proposes a new rule or guidance document, it must eliminate 10 existing rules or guidance documents. This effort builds on the successful deregulatory initiative introduced in President Trump’s first term, which required the repeal of at least two existing regulations for each new rule, and in practice eliminated 5.5 rules for each new significant rule.
    • To date, President Trump has issued over 20 significant deregulatory presidential actions (i.e., executive orders, presidential memoranda, and presidential proclamations).

  • MIL-OSI USA News: Enforcing Commonsense Rules of the Road for America’s Truck Drivers

    class=”has-text-align-left”>By the authority vested in me as President by the Constitution and the laws of the United States of America, it is hereby ordered:

    Section 1.  Purpose.  America’s truck drivers are essential to the strength of our economy, the security of our Nation, and the livelihoods of the American people.  Every day, truckers perform the demanding and dangerous work of transporting the Nation’s goods to businesses, customers, and communities safely, reliably, and efficiently.

    Proficiency in English, which I designated as our official national language in Executive Order 14224 of March 1, 2025 (Designating English as the Official Language of the United States), should be a non-negotiable safety requirement for professional drivers.  They should be able to read and understand traffic signs, communicate with traffic safety, border patrol, agricultural checkpoints, and cargo weight-limit station officers.  Drivers need to provide feedback to their employers and customers and receive related directions in English.  This is common sense.

    That is why Federal law requires that, to operate a commercial vehicle, a driver must “read and speak the English language sufficiently to converse with the general public, to understand highway traffic signs and signals in the English language, to respond to official inquiries, and to make entries on reports and records.”  Yet this requirement has not been enforced in years, and America’s roadways have become less safe.

    My Administration will enforce the law to protect the safety of American truckers, drivers, passengers, and others, including by upholding the safety enforcement regulations that ensure that anyone behind the wheel of a commercial vehicle is properly qualified and proficient in our national language, English.

    Sec. 2.  Policy.  It is the policy of my Administration to support America’s truckers and safeguard our roadways by enforcing the commonsense English-language requirement for commercial motor vehicle drivers and removing needless regulatory burdens that undermine the working conditions of America’s truck drivers.  This order will help ensure a safe, secure, and efficient motor carrier industry.

    Sec. 3.  Upholding English Proficiency Requirements for Commercial Motor Vehicle Operators.  (a)  The Secretary of Transportation, acting through the Administrator of the Federal Motor Carrier Safety Administration (FMCSA), shall, within 60 days of the date of this order, rescind the guidance document titled, “English Language Proficiency Testing and Enforcement Policy MC-ECE-2016-006,” issued on June 15, 2016, and issue new guidance to FMCSA and enforcement personnel outlining revised inspection procedures necessary to ensure compliance with the requirements of 49 C.F.R. 391.11(b)(2).

         (b)  In carrying out subsection (a) of this section, the Secretary of Transportation, through the Administrator of the FMCSA, shall take all necessary and appropriate actions, consistent with applicable law, to ensure that the out-of-service criteria are revised such that a violation of the English language proficiency requirement results in the driver being placed out-of-service, including by working with the relevant entities responsible for establishing the out-of-service criteria.

    Sec. 4.  Strengthening Commercial Driver’s License Security for Safer Commercial Motor Vehicle Operations.  The Secretary of Transportation, through the Administrator of the FMCSA, shall:

    (a)  review non-domiciled commercial driver’s licenses (CDLs) issued by relevant State agencies to identify any unusual patterns or numbers or other irregularities with respect to non-domiciled CDL issuance; and

    (b)  evaluate and take appropriate actions to improve the effectiveness of current protocols for verifying the authenticity and validity of both domestic and international commercial driving credentials.

    Sec. 5.  Supporting America’s Truck Drivers.  Within 60 days of the date of this order, the Secretary of Transportation shall identify and begin carrying out additional administrative, regulatory, or enforcement actions to improve the working conditions of America’s truck drivers.

    Sec. 6.  General Provisions.  (a)  Nothing in this order shall be construed to impair or otherwise affect:

    (i)   the authority granted by law to an executive department or agency, or the head thereof; or

    (ii)  the functions of the Director of the Office of Management and Budget relating to budgetary, administrative, or legislative proposals.  

    (b)  This order shall be implemented consistent with applicable law and subject to the availability of appropriations.

    (c)  This order is not intended to, and does not, create any right or benefit, substantive or procedural, enforceable at law or in equity by any party against the United States, its departments, agencies, or entities, its officers, employees, or agents, or any other person.

    (d)  The Department of Transportation shall provide funding for this order’s publication in the Federal Register.
