  • MIL-OSI New Zealand: Government Cuts – PSA strongly opposes decisions released by Health NZ – further dismantling of our public health system by Government

    The PSA strongly opposes final decisions released by Health New Zealand for the following teams: Procurement, Supply Chain and Health Technology Management (PSC&HTM), Planning, Funding and Outcomes, and Audit, Assurance & Risk.

    “These decisions include the possible loss of specialists procurement, auditing and health innovation and improvement,” Public Service Association Te Pūkenga Here Tikanga Mahi national secretary, Fleur Fitzsimons, said.

    “The possible loss of these roles has been forced on Health NZ by the Government imposing cuts to our health system that will affect patients. We call on Government to stop these endless cuts to our health system.

    “This is why we are still fighting this in the Employment Relations Authority, which is why this will not be implemented until the Authority has heard and determined the matter or the PSA and Health New Zealand have settled it by agreement.”

    The union filed these legal proceedings in the Employment Relations Authority in February because several proposed restructures breached the Code of Good Faith for the public health sector, the Employment Relations Act 2000, collective agreements and Te Mauri o Rongo – NZ Health Charter.

    “We’ll be making it clear to all our members that legal action is still going ahead and we strongly oppose these Health NZ changes.”

    Last month, the PSA agreed a settlement with Health NZ stopping the restructuring of the National Public Health Service and two directorates in the Planning Funding and Outcomes business unit: Data and Analytics, Community Mental Health Funding and Investment, and Data and Digital Services.

    Litigation remains in place for Planning Funding and Outcomes (Former Service Improvement and Innovation functions): Te Whatu Ora Improve; Evidence, Research and Clinical Trial; Operations; Population Health Gain; Consumer Whanau Voice; Former Office of the Chief Executive (OCE): Strategic Planning and Procurement Supply Chain and Health Technology Management.

    Earlier today, the PSA also announced further litigation against Health NZ to stop another round of cuts to their Audit, Assurance and Risk, People and Culture, Finance Stage 1, and Communications and Engagement teams.

    • there were 58,539 live births registered, up from 56,277
    • there were 37,647 deaths registered, little changed from 37,623
    • the total fertility rate was 1.58 births per woman, up from 1.54
    • the infant mortality rate was 6.0 deaths per 1,000 live births, up from 3.8 per 1,000 (the increase is a result of a high number of late registrations during this period, see Births and deaths: Year ended December 2024 (including abridged period life table)).

  • MIL-OSI New Zealand: First Responders – Winslow hay bale fire update #1

    Fire and Emergency New Zealand was alerted to a large fire involving hay bales in Winslow, Ashburton around 11.30pm last night.
    Incident Controller Carrie Swanson says that at its peak, the fire was fought by 11 fire crews and additional support staff.
    “Thanks to the hard mahi of our crews, no other structures were damaged besides the two hay sheds,” she says.
    “The fire was contained to this property, and no others are currently threatened.
    “The fire began to decrease in size around midday today, but it is large and deep-seated, and will take some time to cool and extinguish completely.”
    Crews will continue to work on the fire overnight and into the next few days, Carrie Swanson says.
    “Don’t be alarmed if you see smoke in the area, as this is to be expected,” she says.
    “If you’re in the vicinity and are concerned, stay inside and keep doors and windows closed.”

  • MIL-OSI New Zealand: Government Cuts – Children pay price of Oranga Tamariki contracting fiasco – Auditor-General issues damning indictment of Govt cuts

    The Auditor-General’s report into Oranga Tamariki’s provider contracts lays bare the reckless way the Government ordered cuts without regard to how children would be harmed.
    In 2023 the Government ordered a 6.5% cut of Oranga Tamariki’s overall funding, triggering a chaotic review of contracts with hundreds of community service providers – some even told their contracts would end with only days’ notice last year.
    “The report confirms what we have said all along – the Government has totally botched its rushed spending cuts with little regard to the consequences – children are the casualties of these decisions,” said Fleur Fitzsimons, National Secretary for the Public Service Association Te Pūkenga Here Tikanga Mahi.
    The report says ‘its decisions were not adequately informed by evidence of how they would affect children and their families. The effects of decisions on children and their families are still not known. Given that this is the core role of Oranga Tamariki, it is unacceptable’.
    “It’s staggering that the Government can order an organisation that supports some of New Zealand’s most vulnerable tamariki and rangatahi, and their whānau to make such bad decisions.
    “Without doubt children will have been impacted as providers had to stop services or move children to other service providers at short notice – it’s just not good enough when the welfare of children should be at the heart of these decisions.
    “This all speaks to the cruel nature of the Government’s decisions which put saving money to fund tax cuts ahead of supporting vulnerable children.
    “The Government promised no impacts on frontline services – this report again exposes this lie as we have seen throughout the public service. There is nothing more frontline than protecting children.
    “The PSA is still awaiting a response from the Auditor-General about whether he will investigate cuts at Health New Zealand which also impact frontline health services – this report means he should.
    “The chickens are coming home to roost as we warned they would. Without doubt in the months and years ahead we will see more damage that the Government is inflicting on frontline services from these short-sighted cuts. More New Zealanders will pay the price – it’s unacceptable.”

    The 50th anniversary of the end of the War on Vietnam will be commemorated in Wellington on Friday, 16 May 2025.
    30 April 1975 saw the “fall of Saigon” that brought an end to this horrendous war.
    Former members and supporters of the Wellington Committee on Vietnam (CoV) and associated groups such as Release All Vietnamese Prisoners of Conscience (RAVPOC), the Organisation to Halt Military Service (OMHS) and Medical Aid for Vietnam have been invited to the gathering. Younger and current anti-war activists have also been invited.
    The gathering has been called by former chairs of the Wellington Committee of Vietnam in the early 1970s, Michael Law and Robert Reid, and will include an “Extraordinary Special Meeting of the CoV” to mark the occasion.
    The events will be held at the National Library in Molesworth Street, Wellington.
    From 2.00 pm until 4.30 pm Friday 16 May the Alexander Turnbull Library will have some of its archived material on anti-war protests on display (especially from the Rona Bailey Collection).
    At 5.00 pm the reunion meeting will take place in the Malaga Pasifika Room of the National Library.
    The events will remember the brave struggle of the Vietnamese people for independence, the horrific action and atrocities of the US and allied forces in Vietnam and the protest activity that took place against the war on Vietnam in New Zealand in the 1960s and 1970s.

  • MIL-OSI New Zealand: Government Cuts – Govt squeeze on funding will see another 68 roles go at DOC

    The Government’s squeeze on funding public services will see a hollowing out of the Department of Conservation’s Regional Operations teams around the country.
    In a change proposal released today, DOC is proposing to use natural attrition to cut 68 team leader level roles over the next few years, about five per cent of the 1350-strong Regional Operations workforce.
    Of the 68 roles, 29 are already vacant and 39 staff in other roles will not be replaced when they leave.
    DOC worked with the PSA to manage the proposed change to ensure every current staff member could continue to have a job.
    Public Service Association Te Pūkenga Here Tikanga Mahi National Secretary Fleur Fitzsimons said the proposal will see a hollowing out of DOC’s regional conservation capability over time.
    “The proposals would see DOC lose valuable skills and knowledge across the country.
    “The changes are being forced on DOC to do more within the Government’s overly tight funding for conservation. We should be investing more, not less, in conservation in regional New Zealand. The Government has chosen to fund tax breaks for landlords over properly funding vital conservation work.
    “The Government talks a big game about growing the economy yet wants to shackle DOC, which plays such an important role in boosting tourism, our second biggest export earner.
    “The PSA is concerned that the reduction in the number of roles over time may see the remaining staff carrying a higher workload,” Fitzsimons said.
    The proposal said the approach would save $5 million from DOC’s regional operations budget of $170 million.

    Te Rauparaha Arena was jam-packed for the second Porirua Careers Expo on Tuesday.
    More than 3300 rangatahi from across the city, and wider afield, came through the Arena during the day, taking up the opportunity to connect with industry professionals and education providers and potentially kickstart their career journey.
    There were 90 exhibitors spread out through the main stadium, representing construction and trades, education, tech and professional, Government and health. These included BRANZ, Porirua and Whitby New World supermarkets, Wellington Free Ambulance, Whittaker’s, Le Fale Jobs and Skills Hub, MSD, TechStep, BCITO, TradeMe, NZ Police and Mexted Turf.
    Aotea College Year 13 student Emma Dullabh said it was a fantastic day out.
    “It was so cool to see how passionate the stall holders were about their work, and how happy they were to answer questions. It made the day really enjoyable and I was really inspired. Everyone looked like they were having a great time,” she said.
    Porirua Mayor Anita Baker said the serious side of the expo – opening doors and inspiring young people – was offset by a fun atmosphere with MC Nate Lopa and the Cook Island drummers, along with attendees having the opportunity to win one of either $500 Prezzy cards courtesy of Tranquil IT.
    “This is the second year Porirua has hosted a Careers Expo and all the feedback has been wonderful, as our rangatahi get a look into what opportunities await them once they leave school,” Mayor Baker said.
    “My congratulations to organisers, exhibitors and schools for the work that went in to make this event happen.”
    Some of the feedback collated from stallholders included:
    “There was an exceptional amount of people, the children were engaged and really well prepared.”
    “I had between 45 and 50 engagements and was able to connect with some secondary schools I haven’t been able to connect with in the past.”
    “While we weren’t actively recruiting on the day, our aim was just to be out in the community making ourselves known. We wanted to teach students more about us and engage with them – this was a huge success.”

    On 14 May 2025, the annual general meeting in Equinor ASA approved the annual report and accounts for Equinor ASA and the Equinor group for 2024, as proposed by the board of directors.

    Further, the annual general meeting approved a cash dividend of US dollar (USD) 0.37 per share to be distributed for the fourth quarter of 2024.

    The fourth quarter 2024 dividend accrues to the shareholders as registered in Equinor’s shareholder register with the Norwegian Central Securities Depository (VPS) as of expiry of 16 May 2025.

    Subject to ordinary settlement in VPS, this implies that the right to dividend accrues to shareholders as of 14 May 2025. The shares will be traded ex-dividend on the Oslo Stock Exchange (Oslo Børs) from and including 15 May 2025. For US ADR (American Depository Receipts) holders, dividend accrues to the ADR-holders as of 14 May 2025, and the ex-dividend date will be from and including 16 May 2025.

    Shareholders whose shares trade on the Oslo Stock Exchange will receive their dividend in Norwegian kroner (NOK). The NOK-dividend will be communicated on 22 May 2025. The expected payment date for the dividend is 28 May 2025.

    The general meeting authorised the board of directors to resolve dividend payments based on the company’s approved annual accounts for 2024. The authorisation is valid until the next annual general meeting, but no later than 30 June 2026.

    The general meeting supported the company’s energy transition plan available at www.equinor.com/investors/2025-annual-general-meeting.

    The plan describes the strategy for the company’s energy transition, including its actions and climate ambitions, its support for the Paris Agreement and how it plans to deliver energy with lower emissions over time while protecting long-term shareholder value and competitiveness.

    In accordance with the proposal from the nomination committee, the general meeting adopted the remuneration to the corporate assembly and to the nomination committee, effective as from 15 May 2024.

    The general meeting authorised the board of directors on behalf of the company to acquire Equinor shares in the market to continue the company’s share-based incentive plans for employees. The authorisation is valid until 30 June 2026. See attached minutes for details.

    As part of the company’s share buyback programme, the general meeting approved a reduction in capital through the cancellation of own shares and the redemption of shares belonging to the Norwegian State. See attached minutes for details.

    To enable Equinor’s board of directors to utilise the share buyback mechanism permitted by the Norwegian Public Limited Liability Companies Act with respect to the distribution of capital to the company’s shareholders, the general meeting authorised the board of directors on behalf of the company to acquire Equinor shares in the market. It is a precondition that the repurchased shares are subsequently cancelled through a resolution by a new general meeting to reduce the company’s share capital. The authorisation is valid until the next annual general meeting, but no later than 30 June 2026.

    Car insurance premiums have surged in the past 2 years but switching providers could save you hundreds of dollars, says Consumer NZ.

    Vanessa Pratley, investigative writer at Consumer NZ, says its annual car insurance survey found premiums have increased by as much as 46% since 2023.  

    Pratley points to inflation and extreme weather events as factors driving up the cost of insurance across the board, but another contributing factor is your age and life stage.

    “Every insurer will base its premiums on risk. How much you pay will depend on things like whether you live in a flood-prone area, the car you drive, and even your age and gender.  

    “And because not all insurers are equal – which is to say they use their own risk assessments – you might be more or less of a risk to one provider or another.

    “You can switch insurance providers any time (though there might be cancellation fees), and that could potentially reward you with hundreds of dollars in annual savings.”

    Toot if your premium’s up!

    Consumer’s survey found young males will pay more in car insurance premiums than older people or young females. And older females could pay more than older males – depending on the insurer.  

    “When we compared the costs for four different age brackets across nine insurance providers, we found annual savings ranged quite significantly – between $481 and $1,296.

    “Since 2023, the lowest median increase was just 0.6% for a family of four living in Auckland, and the highest median increase was 46% for young males living in Christchurch.

    “If the cost to insure your car is stressing you out right now, don’t cancel your cover or drop down to third-party – shop around and see what savings you could make first.”

    Switch to a lane you can afford

    Other than switching providers, Pratley explains some policies may look similar but cover very different things.

    “‘Standard’ cover with one insurer will be an optional extra with another insurer.

    “You might find your insurance policy includes towing expenses or key replacements as part of its standard offering. But if you very rarely park in the city and never lose your keys, you might be paying more than you need.

    “Take the time to compare what’s on offer and consider whether switching plans or providers would get you back to a policy you can afford.”

    Get a steer on satisfaction

    As well as crunching the numbers on the cost of car insurance premiums, Consumer surveys car insurance customers about how satisfied they are with their current provider.  

    “No one takes out insurance cover for fun. It’s an important financial safety net, for example, if you accidentally swing your car into a parked Tesla. If the right protection isn’t in place for you, you could find yourself in a real pickle.

    “The experience you get from your insurance provider, especially how they treat you, should be an important consideration, too. We’re pleased to announce that FMG and MAS received Consumer’s People’s Choice award for car insurance this year.”

    Food prices increase 3.7 percent annually – 15 May 2025 – Food prices increased 3.7 percent in the 12 months to April 2025, following a 3.5 percent increase in the 12 months to March 2025, according to figures released by Stats NZ today.

    Higher prices for the grocery food group and the non-alcoholic beverages group contributed most to the annual increase in food prices, up 5.2 percent and 6.8 percent, respectively.

    “Price increases were widespread, with all five food groups recording an increase,” prices and deflators spokesperson Nicola Growden said.

    The fruit and vegetables group increased in price for the first time since January 2024, with prices up 0.2 percent in the 12 months to April 2025.

    Worker cooperatives produce products or services. But they are run very differently. Workers can become members of the cooperative they work for by buying a share of the business. This gives them a vote in how the business is run and a share of net income, after costs have come out.

    Co-ops do not have external shareholders – the profits stay with workers. Rather than bosses deciding and workers carrying out the tasks, worker cooperatives are based on democratic principles. Big decisions are discussed and then voted on, and each member gets one vote. They offer a direct way for workers to control their production and shape the economy.

    In Australia, these models peaked in the 1980s. Most are gone, though a few older cooperatives are still running, such as Tasmanian recycling cooperative Resource Work Collective, founded in 1993.

    In recent years, there’s been renewed interest in the model. The Earthworker cooperative network focused on Victoria’s Latrobe Valley. The goal: find new types of employment and products in a coal area undergoing transition.

    How well does the model work?

    Mondragon is the most well-known example. Founded in 1956 in the Basque region of northern Spain, Mondragon grew and became self-sustaining. It has developed supporting institutions such as research and development companies and even a university. It also established a credit union, which attracted capital and provided loans to cooperatives.

    While Mondragon is a successful example, these organisations face a number of barriers to their survival.

    Critics have argued worker cooperatives tend to fail as workers do not understand the market for their products, but Mondragon undercuts this criticism.

    Worker cooperatives can have difficulties raising capital. Some banks can be reluctant to invest as they may lack familiarity or sympathy with the model.

    Instead, workers may put some or all of their savings into the organisation to get it started. Taking these kinds of risks means some workers may be focused on getting immediate rewards, rather than investing surplus funds or building up cash reserves.

    Workers can sometimes choose to transform a successful cooperative into a capitalist enterprise to achieve greater capital gains.

    Surprisingly, trade unions are generally hostile and suspicious of worker cooperatives. Union organisers may fear worker-owners could see little need for trade unions in representing their interests, or that cooperatives could undercut union wages and conditions to remain competitive.

    To date, worker cooperatives have had a limited impact in Australia, despite the relatively strong historical position of workers.

    Compared to member cooperatives and other types, worker’s cooperatives tend to be short lived in Australia. That’s because most were formed by workers after an industrial dispute or to maintain employment during economic downturns.

    In 1987, for instance, workers retrenched by a major communications company decided to form a co-op which became the Electronic Service Centre in Fairfield, New South Wales. A later example is Abrasiflex, a NSW company bought by workers facing retrenchment in 1993. Both cooperatives failed by the early 2000s.

    Their popularity peaked in the 1980s, when the model was promoted by state Labor governments. Policymakers saw them as a short term means to resolve unemployment, rather than a long term means to secure economic democracy.

    The model lost traction in the early 1990s due to an economic downturn, capital shortfalls and changing political circumstances.

    New energy

    The idea for Earthworker came from discussions between unionists and environmentalists over job creation and the environment. Earthworker founders were influenced by the Green Bans.

    Conflict can occur between environmentalists who want to shut down certain industries, and unionists who want to protect jobs […] we should work together for a “just transition” and create jobs that aren’t just better for the earth, but for workers too.

    In this respect, Earthworker has much in common with the Cleveland Model in the United States, which links green business, local economic development and fair labour practices.

    Earthworker only formally became a cooperative in 2011, though discussions date back to the late 1990s. In 2016, the network bought a hot water tank manufacturer in Morwell and began making their own tanks and solar hot water systems as the Earthworker Energy Manufacturing Co-operative. The cooperative is aimed at helping the Latrobe Valley’s transition away from coal power jobs.

    Earthworker promotes the payment of trade union wage rates and conditions. The goal is to build a network of cooperatives supporting each other to build economies of scale.

    Their other cooperatives include Earthworker Construction (residential construction, landscaping and maintenance) and Earthworker Smart Energy (improving thermal efficiency and comfort in homes). These cooperatives are generally small, with 10 members or fewer.

    Another cooperative, Redgum Cleaning, closed down in 2023. It was not viable due to staff shortages, increased costs and work cancellations during the pandemic. Paying union rates in a competitive industry also assisted its demise.

    By contrast, the Earthworker Energy Manufacturing Co-operative has found a way to survive in a competitive market.

    Niche or mainstream?

    Australian worker cooperatives ensure manufacturing and services remain locally owned and controlled. Could they expand? It’s possible.

    Capital remains a major issue for Australian worker cooperatives such as Earthworker. Without capital, it’s hard to scale. Government efforts to expand domestic manufacturing often overlook this model.

    The Earthworker network points to one future for Australian worker cooperatives. Despite the failures of the past, Earthworker’s focus on building a network of sustainable businesses rather than a single cooperative is a promising path.

    A welcoming ceremony for a pair of Chinese giant pandas took place in Vienna’s Schoenbrunn Zoo on Wednesday, marking the official start of a decade-long stay in the Austrian capital of the panda pair for scientific research purposes and as friendship envoys.

    The two giant pandas — male He Feng and female Lan Yun — arrived in Austria on April 23.

    Addressing the ceremony, Austrian President Alexander Van der Bellen said giant pandas are a symbol of the friendship between his country and China. The cooperation on giant panda protection like this creates trust and brings nations closer together.

    Van der Bellen said that he is very happy to officially welcome the giant pandas to the new home and that the Chinese giant panda is deeply loved by the Austrian people.

    Chinese Ambassador to Austria Qi Mei attended the ceremony.

    As part of the ceremony, the Schoenbrunn Zoo staged a traditional Chinese lion dance performance to celebrate the panda pair’s arrival, to the cheers of the audience. Among the crowds were dozens of local school children holding signs reading “Warmly Welcome” to demonstrate their love for the Chinese giant panda.

    The panda pair’s arrival marks the latest 10-year round of the scientific collaboration between China and Austria on giant panda conservation, which started in 2003.     The 2025 Country Issues Map is out now. The report surveyed energy leaders across the wider energy sector to get a snapshot of what keeps them awake at night, and busy during the day.
    BusinessNZ Energy Council (BEC) Executive Director Tina Schirr says the map paints a clear picture of the sector’s issues that still need to be addressed.
    “Affordability being the dominant concern on the 2025 map is no surprise given the strain placed on the electricity sector during last year’s dry winter, and the compounding issue of reduced gas availability.”
    Carbon pricing ranks high on the uncertainty list, reflecting instability in the Emissions Trading Scheme, an oversupply of New Zealand Units, and investor hesitancy.
    Schirr says gas users will continue to face difficulties accessing viable alternatives.
    “However, there is growing acknowledgement that grid-scale storage and demand response measures can help reduce supply risks, especially during dry years.
    “How New Zealand manages the energy trilemma – balancing security, sustainability, and equity – has become an increasing area of concern in these reports. Uncertainty over gas reliability is now a key threat to security of supply and affecting affordability across the wider industry.”
    Schirr says that over the years, a major blind spot for New Zealand remains unchanged – community engagement.
    “Engagement and energy literacy continue to rank low for both uncertainty and impact, despite their importance in building lasting public support for energy transitions.
    “On the bright side, infrastructure concerns that dominated previous years have eased somewhat, but transmission grids and long-term planning remain high-priority actions. New Zealand also retains its position as a global energy innovator.

    Bayldon says it’s incumbent on the Government to increase its climate finance commitment in Budget ’25.

    “We know that climate change is the great existential crisis of our time, and it is without doubt a humanitarian crisis in which children bear the brunt of suffering.  Every cyclone, every flood, and every village lost to rising sea levels means more children going without food, a home, and an education.

    “Our commitment to climate finance will help Pacific children and communities to become more resilient in the face of a changing climate,” he says.

    The PSA is taking Health NZ Te Whatu Ora to the Employment Relations Authority to stop another round of job cuts to key teams that support frontline health services.
    The litigation covers the proposed restructures of Audit, Assurance and Risk, People and Culture, Finance, and Communications and Engagement.
    “These are damaging cuts of key teams which support the frontline – if they go ahead this will further undermine our health system and so patient care,” said Fleur Fitzsimons, National Secretary for the Public Service Association for Te Pūkenga Here Tikanga Mahi.
    “This is all because the Government has made a choice to cut taxes and underfund the health system – New Zealanders deserve better.”
    Significant jobs are at stake. For example Health NZ is is proposing to cut 338 People and Culture roles – a net reduction of 21% of the team – at a time when it is struggling to recruit people to staff hospitals and elsewhere.
    Health NZ also plans to cut one in four roles at its Audit Assurance and Risk team which ensures some $12 billion of annual funding of the primary health care sector is paid out correctly and not subject to fraud.
    “Our view is the restructures have been handled badly by the Government. It has ignored obligations under collective agreements to properly consult with the union and members. It’s required to work with those impacted on the design of new structures and not impose them in the way it has.
    “In particular, roles can’t simply be disestablished without considering alternatives like re-deploying impacted staff, re-training for other positions or reducing roles through attrition.”
    The PSA has so far succeeded in reducing cuts to other teams including Data and Digital and Pacific Healthafter filing litigation with the Authority.
    The Authority has also ordered mediation in relation to the PSA’s litigation over the proposed restructuring of two other teams – Procurement and Supply Chain and Planning, Funding and Outcomes – Service Improvement and Innovations.
    “The PSA remains strongly opposed to all job cuts at Health NZ which are being rushed through regardless of their impacts on frontline health services. It’s all about saving money in the short term, not supporting our health system.”
    The Public Service Association Te Pūkenga Here Tikanga Mahi is Aotearoa New Zealand’s largest trade union, representing and supporting more than 95,000 workers across central government, state-owned enterprises, local councils, health boards and community groups.

    Most Asian markets were trading in the red. Tokyo, Shanghai, Hong Kong, Bangkok and Seoul were among the major losers, while Jakarta was in the green.

    Meanwhile, the US market closed mixed on Wednesday. The Dow Jones fell 0.21 per cent, while the technology-heavy Nasdaq gained 0.72 per cent.

    On the institutional front, foreign institutional investors (FIIs) were net buyers of equities worth ₹931 crore on May 14, while domestic institutional investors (DIIs) purchased equities worth ₹316 crore.

    In an extraordinary concession, the Fair Work Commission has acknowledged labour hire firms may face millions of dollars in retrospective liabilities under Labor’s “same job same pay” laws – even leading to workers losing their jobs.

    In its decision of 7 May 2025 (published Monday 12 May) relating to Glencore’s Bulga coal mine in New South Wales, the FWC considered arguments from labour hire firms Skilled and WorkPac that they would be impacted by increases in the retrospective value of annual leave and sick/personal leave entitlements of their employees, should the same job same pay order be made.

    Despite ultimately making the order, the FWC found:

    “… the fact that making a regulated labour hire arrangement order would increase the liabilities of each of Skilled and WorkPac for accrued annual leave and personal leave (which must be paid out in some circumstances), weighs in favour of a conclusion that it would not be fair and reasonable to make the orders sought.”

    Further, in the case of WorkPac:

    “… I accept that many arrangements could become wholly unviable for WorkPac’s business and it would need to consider its options to respond to those challenges, which may include terminating those arrangements which are commercially unsustainable. WorkPac’s employees may be immediately and adversely affected if those arrangements are terminated…”

    And, in the case of Skilled:

    “Skilled has no right to recover this increase in liability from Bulga or anyone else. Because Skilled only earns a small profit margin on the labour hire employees it supplies to the mine, the increased leave liability arising from the making of a regulated labour hire arrangement order would exceed the profit margin earned by (Skilled) under its supply contract with Bulga over the life of that contract.”

    AREEA Chief Executive Steve Knott AM said the decision confirmed long-held concerns that “same job same pay” could mean “hundreds of millions of dollars in retrospective leave liabilities”.

    “In late 2023, AREEA raised concerns with the Albanese Government that its proposed same job same pay laws could unleash retrospective leave liability costs on the mining industry, potentially ranging in the hundreds of millions,” he said.

    “The government paid lip service in response – implementing a partial fix that would apply only in very limited circumstances. This issue needs to be urgently revisited.

    “The FWC has finally been forced to acknowledge the unfair, unreasonable and unsustainable impacts of same job same pay orders on labour hire firms in the mining industry, going so far as to admit contracts may be terminated and employees may lose their jobs.

    “Evidence was accepted that labour hire firms have limited ability to recover unplanned increases in both prospective costs and retrospective leave liabilities, and their ability to commercially service contracts may be put at real risk.

    “Yet, remarkably, such impacts apparently do not weigh heavily enough in the favour of a same job same pay order being “not fair and reasonable” when balanced against labour hire employees and direct hired employees having a pay differential.

    “Retrospective cost increases driven by government policy is a killer for investor certainty and business confidence. How could any firm confidently invest and do business in Australia when such concerns can be cavalierly brushed aside?

    “The Albanese Government said the laws would not impact on firms retrospectively. It should act to ensure this commitment is upheld and protect the sanctity of commercial arrangements lawfully and compliantly entered into under the laws of the land at the time.

    “At stake are thousands of jobs, billions of dollars in investment capital and many billions more in government revenues to fund national programs and infrastructure.”

    Another challenging outcome of the Bulga mine same job same pay decision is that relatively inexperienced labour hire employees will soon be paid at the same rates as their vastly more experienced direct-hired counterparts.

    This outcome was accepted, but also didn’t weigh heavily enough against the making of the order.

    “As a result, labour hire trade assistants with as little as 12 months’ experience will receive pay rises of up to $40,000 per annum, bringing them into parity with experienced heavy machinery operators who have been employed at the mine for more than 10 years,” Mr Knott said.

    “Given the Albanese Government said the laws would not result in unfair pay parity between inexperienced and highly experienced employees, these types of outcomes may play out adversely in the marketplace.”
