    WASHINGTON — Today, U.S. Senator Martin Heinrich (D-N.M.), a member of the Senate Select Committee on Intelligence, pressed the White House on the risks of allowing unvetted “Department of Government Efficiency” (DOGE) staff and representatives to access classified and sensitive government materials. In a letter to White House Chief of Staff Susie Wiles, Heinrich sounded the alarm on the risk DOGE poses to our national security and Americans’ privacy.

    In the letter, Heinrich, U.S. Senator Mark R. Warner (D-Va.), and several colleagues demanded that the administration provide details to Congress about how DOGE staff and representatives are being vetted, which systems, records and information are being shared, and what steps the Trump administration is taking to safeguard them from misuse or disclosure.

    “According to press reports, DOGE inspectors already have gained access to classified materials, including intelligence reports, at the United States Agency for International Development (USAID), sensitive government payment systems, including for Social Security and Medicare, at the Treasury Department, and federal personnel data from the Office of Personnel Management. Further, as of today the scope of DOGE’s access only seems to be expanding, as reports indicate DOGE has now entered the Department of Labor and other agencies,” Heinrich wrote. “No information has been provided to Congress or the public as to who has been formally hired under DOGE, under what authority or regulations DOGE is operating, or how DOGE is vetting and monitoring its staff and representatives before providing them seemingly unfettered access to classified materials and Americans’ personal information.”

    Heinrich added, “As you know, information is classified to protect the national security interests of the United States. Government employees and contractors only receive access to such information after they have undergone a rigorous background investigation and demonstrated a ‘need to know.’ Circumventing these requirements creates enormous counterintelligence and security risks. For example, improper access to facilities and systems containing security clearance files of Intelligence Community personnel puts at risk the safety of the men and women who serve this country. In addition, unauthorized access to classified information risks exposure of our operations and potentially compromises not only our own sources and methods, but also those of our allies and partners. If our sources, allies, and partners stop sharing intelligence because they cannot trust us to protect it, we will all be less safe.”

    Heinrich also raised alarms about the privacy implications of allowing an unknown number of DOGE staff to access unclassified systems containing information about individual American taxpayers and organizations.

    Heinrich continued, “Unclassified government systems also contain sensitive data, the unintended disclosure of which could result in significant harm to individuals or organizations, including financial loss, identity theft, and exposure of medical and other private personal information. The U.S. Treasury payment systems, in particular, are used to disburse trillions of dollars each year, and contain everyday Americans’ personal information, such as Social Security numbers, home addresses, and bank accounts. Allowing DOGE access to this information raises unprecedented risks to Americans’ private personal and financial information.”

    The letter also noted that there are strict cybersecurity controls in place for federal networks that DOGE does not seem to be following, including by reportedly connecting personal devices to sensitive government systems.

    “Such unregulated practices with our government’s most sensitive networks render Americans’ personal and financial information, and our classified national secrets, vulnerable to ransomware and cyber-attacks by criminals and foreign adversaries. The recent unprecedented Salt Typhoon and Change Healthcare attacks that affected tens of millions of Americans further underscore the importance of rigorously fortifying our government systems,” Heinrich stated.

    Alongside Heinrich and Warner, U.S. Senators Ron Wyden (D-Ore.), Angus King (I-Maine), Michael Bennet (D-Colo.), Kirsten Gillibrand (D-N.Y.), Jon Ossoff (D-Ga.), and Mark Kelly (D-Ariz.) joined the letter.

    WASHINGTON — U.S. Senator Martin Heinrich (D-N.M.) introduced the Apprenticeship Pathways Act, legislation to create pathways to high-demand careers for high school students by expanding access to apprenticeships and technical education. Heinrich introduced the bill with U.S. Senator Jerry Moran (R-Kan.).

    Apprenticeships and technical education offer a direct path to acquiring in-demand skills, and early exposure to industries can encourage more students to pursue careers in those professions. Expanding apprenticeship programs for high school students can help address workforce shortages and ensure a sustainable workforce pipeline. This legislation particularly focuses on apprenticeship programs for occupations with high need, including the building trades, healthcare, manufacturing, technology, telecommunications, and early childhood education.

    “If we want to set the next generation up for success, we need to go all in on expanding access to career-connected learning like apprenticeships as early as high school. By providing students with more preparation and job skills, we will ensure more New Mexicans have the opportunity to access careers in their own communities that they can build their families around, while strengthening New Mexico’s middle class and growing our state’s economy,” said Heinrich.

    “Apprenticeships bridge the gap between education and production, providing hands-on learning opportunities that benefit both students and employers in technical fields,” said Moran. “Aligning tech training with industry demands will help meet the workforce needs in Kansas and expand high-paying career opportunities in the IT industry.”

    The Apprenticeship Pathways Act would direct the U.S. Secretary of Labor to provide grants to industry intermediaries to develop and establish apprenticeship programs for high school students in the building trades, health care, early childhood education, technology, and manufacturing — based on local, regional, and national workforce trends. This model provides students on-the-job training and instruction, real-world experiences and responsibilities, and inspiring career pathways ahead of their entrance to the workforce.

    “Thanks to Senator Heinrich, and this legislation, New Mexico will soon provide pre-apprenticeship opportunities to young people around the state, especially in our underserved communities. Pre-apprenticeship is an essential on-ramp for high schoolers and recent graduates to access in demand, high wage careers. It’s a critical step in making our communities more prosperous,” said Mike May, Director of Workforce Learning for Future Focused Education.

    Heinrich’s Longtime Support for Workforce Training and Apprenticeships:

    This week, Heinrich announced $1,350,000 in federal funding that he secured through the Fiscal Year 2024 appropriations process for the United Association of Plumbers & Pipefitters Local 412 (U.A. Local 412). The funding will support specialized journeyman training focused on filling jobs created by the CHIPS Act and Inflation Reduction Act, including needs specific to semiconductor plants, hospitals, and heat pump installation, service, repair, and maintenance. Through his work on the Senate Appropriations Committee, Heinrich has further supported the U.A. Local 412’s workforce development efforts by securing $1.2 million in the Fiscal Year 2023 Appropriations Bill.

    In October 2024, Heinrich visited U.A. 412’s mobile training unit, which is creating more pathways to in-demand careers in the skilled trades and has already trained dozens of New Mexicans in Española, Taos, Las Vegas, Mora, Raton, and Santa Fe. Heinrich also participated in a training demonstration with U.A. Local 412 leadership and apprentices who are learning skills in the plumbing, pipefitting, and HVAC trades.

    The U.A. Local 412 Mobile Training Unit was initially paid for by an Economic Development Administration (EDA) Good Jobs Challenge Grant, as part of a $6.4 million award to the Northern N.M. Workforce Integration Network. The Good Jobs Challenge funds were authorized by the American Rescue Plan, the critical economic recovery legislation that Heinrich was proud to pass in 2021.

    Heinrich is continuing to press for passage of Fiscal Year 2025 Appropriations Bills. The Senate Appropriations Committee passed bills last year that included an additional $870,000 CDS award that he secured within the Senate Appropriations Committee-passed Labor, Health and Human Services, Education Appropriations Bill to sustain the U.A. Local 412’s mobile training unit’s operations past the original EDA funding, and to expand its reach to new communities including Grants, Gallup, Silver City, and Zuni Pueblo.

    Heinrich has long championed proven workforce training programs like U.A. Local 412’s apprenticeship and pre-apprenticeship programs that are growing the middle class, creating and connecting New Mexicans to high-quality careers they can access in their communities, and continuing New Mexico’s leading role in the clean energy transition that is being built by union workers in the skilled trades.

    Last year, Heinrich hosted a “Pro-Worker, Pro-Business Opportunities” roundtable to talk directly with New Mexicans about how federal legislation he helped pass into law, like the Inflation Reduction Act and Infrastructure Law, is creating careers in high-demand sectors and strengthening New Mexico’s health care, early childhood education, and skilled trades workforce. 

    In the last Congress, Heinrich introduced the bipartisan Apprenticeship Pathways Act, legislation to create pathways to careers for high school students by expanding access to apprenticeship programs for occupations with high need, including the building trades, healthcare, manufacturing, technology, telecommunications, and early childhood education. Last year, Heinrich also introduced the Pre-Apprenticeships To Hardhats (PATH) Act, legislation to strengthen the pipeline for careers in New Mexico, address rising workforce shortages, and grow the state’s economy through quality pre-apprenticeship programs.

    Last Congress, Courtenay Eichhorst, Business Manager of U.A. Local 412 and President of New Mexico Building Trades, testified about the importance of apprenticeships and pre-apprenticeships during a hearing that Heinrich convened as the Chairman of the Joint Economic Committee on “Job Training for the Clean Energy Transition.”

    Eichhorst said during that JEC hearing, “In addition to our ‘gold standard’ apprenticeship programs, the UA and other Building Trades’ unions are also increasingly investing in pre-apprenticeship programs that can be designed to help prepare high school students or individuals from underrepresented communities for a career in the trades. These programs help fill the role that used to be filled by the ‘shop classes’ that were found in high schools but have become increasingly rare. Pre-apprenticeship programs also focus on the ‘soft skills’ that are necessary for success in any industry, such as showing up on time and other work etiquette.”

    Also in the Fiscal Year 2024 Appropriations Bills, Heinrich secured $1,200,000 in Congressionally Directed Spending for the SMART Local Union No. 49 Joint Apprenticeship and Training Committee to enhance and expand specialized HVAC apprenticeship training.

    Last March, Heinrich introduced the Providing Resources and Opportunities for Health Education and Learning (PRO-HEAL) Act, legislation that will tackle the health care provider shortage in New Mexico and nationwide by expanding pathways to high-quality, in-demand health care careers that medical professionals can access in their communities. Specifically, the PRO-HEAL Act addresses medical provider shortages by incentivizing states and institutions of higher education to expand or create health care provider pipeline programs, particularly in underserved and rural communities. The legislation is inspired by the success of the Combined BA/MD Degree Program at the University of New Mexico, where over 65% of students who have graduated from their program practice medicine in New Mexico.   

    Heinrich previously introduced the Pathways to Health Careers Act, legislation that reauthorizes and modernizes the Health Profession Opportunity Grant (HPOG) program to help address health care shortages in New Mexico and across the country and create pathways to high-quality, in-demand health care careers. The HPOG program has a proven track record of successfully educating workers for jobs in the health care industry, while also providing career coaching, job placement, and a mix of other support services. The Pathways to Health Careers Act would restart and expand the HPOG Program, providing $425 million to make HPOG available nationwide from FY2024 through FY2028 and includes set asides for Tribes and U.S. Territories. 

    In 2021, Heinrich and Moran introduced the Championing Apprenticeships for New Careers and Employees in Technology (CHANCE in Tech) Act, bipartisan legislation to create earlier pathways to high-paying careers in the information technology (IT) industry. Heinrich previously introduced the bipartisan legislation in 2019 with former U.S. Senator Cory Gardner (R-Colo.).

    Washington, D.C. — Senators Patty Murray (D-WA), Vice Chair of the Senate Appropriations Committee; Tammy Baldwin (D-WI), Ranking Member of the Senate Appropriations Subcommittee on Labor, Health, and Human Services, and Education; and Bernie Sanders (I-VT), Member of the Senate Health, Education, Labor and Pensions (HELP) Committee alongside Representatives Bobby Scott (D-VA), Ranking Member of the House Committee on Education and Workforce, and Rosa DeLauro (D-Conn.), Ranking Member of the House Appropriations Committee and the Subcommittee on Labor, Health, and Human Services, and Education sent a letter warning against the Trump administration’s reported plans to unilaterally dismantle the Department of Education. The lawmakers asked the acting Secretary of Education for answers on recent actions taken by the Trump administration to put federal workers on administrative leave, coerce employees into leaving their jobs, provide access to students’ sensitive data, and illegally freeze vital funding.

    “Over the course of two weeks, the Trump Administration issued sweeping executive orders and sought to broadly and illegally freeze federal financial assistance,” wrote Sanders and the lawmakers. “Federal employees have been targeted, in some cases for simply following the law. Elon Musk is attempting to shut down the work of entire agencies while gaining access to some of the federal government’s most far reaching and sensitive data systems. Media reports indicate a similar effort may be underway at the Department of Education.”

    “We will not stand by and allow this to happen to the nation’s students, parents, borrowers, educators, and communities. Congress created the Department to ensure all students in America have equal access to a high-quality education and that their civil rights are protected no matter their zip code,” continued the lawmakers. “We urge you to provide information on the steps the Department is taking to ensure the continuity of programs that Americans depend on, the ability of the Department to effectively administer programs for their intended purposes without waste, fraud and abuse, and the safeguards in place to protect student data privacy.”

    The lawmakers note that Trump and Elon Musk have not shared any plans regarding intended changes to the Department of Education with the Congressional committees responsible for its oversight and funding. In their letter, they request information about access to the Department’s sensitive data and steps taken to safeguard it, communications and details regarding Department employees who have been placed on leave and confirmation that no awards have been blocked or terminated.

  • MIL-OSI United Nations: ‘Step Up the Pace’ and end female genital mutilation, UN says

    As the world marks the International Day of Zero Tolerance for Female Genital Mutilation on Thursday, the United Nations is warning that without urgent action, a staggering 27 million more girls could undergo the procedure by 2030.

    Female Genital Mutilation (FGM) refers to all procedures involving the partial or total removal of female external genitalia or other injuries to female genital organs for non-medical reasons, according to the World Health Organization (WHO).

    “More than 230 million girls and women alive today are survivors of this abhorrent practice,” said UN Secretary-General António Guterres in his message for the day, describing it as “one of the most brutal manifestations of gender inequality”.

    The UN sexual and reproductive health agency (UNFPA), the UN Children’s Fund (UNICEF) and World Health Organization reaffirmed that FGM has no health benefits, with lifelong consequences including severe infections, complications in childbirth, chronic pain and psychological trauma.

    “Eradicating this vicious human rights violation is urgent, and it is possible,” Mr. Guterres emphasised.

    Progress and challenges

    Since 2008, the UNFPA-UNICEF Joint Programme on the Elimination of FGM, in collaboration with WHO, has provided prevention and protection services to nearly seven million girls and women.

    The initiative has also mobilised 12,000 grassroots organizations and trained 112,000 community and frontline workers. Additionally, 48 million people have publicly declared their commitment to ending the practice.

    Despite these efforts, the road to elimination remains steep. Only seven of the 31 countries with available data are on track to meet the Sustainable Development Goals (SDGs) target of ending genital mutilation by 2030.

    Meanwhile, in The Gambia, attempts to repeal the ban on genital mutilation threaten to reverse years of progress, underscoring the fragility of existing gains.

    ‘Step Up the Pace’

    This year’s theme, Step Up the Pace, serves as a call to accelerate global efforts to eliminate genital mutilation and dismantle the harmful gender and social norms that perpetuate it.

    “We must strengthen global movements to break down harmful attitudes, beliefs and gender stereotypes,” said Mr. Guterres.

    A key part of this effort is The Pact for the Future, adopted by UN Member States last September. This global commitment aims to tackle gender discrimination and harmful social norms, ensuring that laws and policies align with efforts to end FGM worldwide.

    Cost of inaction

    Failure to end FGM has dire social, economic and health consequences. According to WHO, treating health complications from genital mutilation costs healthcare systems $1.4 billion annually.

    Meanwhile, the mental and emotional toll on survivors can last a lifetime, impacting their education, employment and overall well-being.

    With less than five years left to reach the 2030 target, the UN is calling for stronger alliances, increased investment and sustained advocacy.

    “Let’s join forces to make female genital mutilation history and ensure a brighter, healthier, and more just future for all women and girls everywhere,” Mr. Guterres concluded.

  • MIL-OSI United Nations: Experts of the Committee on the Elimination of Discrimination against Women Praise Belarus for Progress in Preventing Trafficking, Ask about Criminalisation of HIV Transmission and Reported Repression of Civil Society

    The Committee on the Elimination of Discrimination against Women today concluded its consideration of the ninth periodic report of Belarus, with Committee Experts praising the State’s progress in preventing trafficking, and raising questions about the criminalisation of HIV transmission and reports of repression of civil society.

    Elgun Safarov, Committee Expert and Rapporteur for Belarus, and other Experts commended Belarus’ awareness-raising projects on the prevention of trafficking and women’s empowerment.

    One Committee Expert noted that Belarus had a high number of criminal cases related to HIV.  Transmission of HIV was penalised with imprisonment of up to five years. Was the State party rethinking this law?

    Mr. Safrov said many very important non-governmental organizations had been closed recently.  What were the reasons for these closures?  There were reports of repression of women journalists and activists.

    Several other Experts expressed concern about reports that women who expressed dissent were punished and detained.  What plans were in place to protect women activists from gender-based violence and State repression?  Why were civil society organizations engaged in the protection of human rights dissolved by the State?

    Introducing the report, Larysa Belskaya, Permanent Representative of Belarus to the United Nations Office at Geneva and head of the delegation, said Belarus strived to fully ensure equal rights and opportunities for women in all spheres. In an extremely difficult geopolitical situation, Belarus progressively built a society where every person could have decent living conditions and benefit society.

    The delegation said Belarus had taken measures to eliminate trafficking in persons and to identify and rehabilitate victims.  In 2024, authorities identified 1,500 cases of suspected trafficking and identified several victims, including minors.  The State worked with civil society to build the capacity of law enforcement staff related to trafficking; 90 training sessions had been held in 2024.

    Concerning the transmission of HIV, the delegation said that in 2023, nine women had been penalised for transmitting HIV and 12 women were penalised in 2022.  The State party was continuing to reduce the stringency of HIV legislation.  A draft law had been developed to decriminalise unintentional transmission of HIV.  Penalties for the deliberate transmission of HIV would remain.

    The delegation said the Committee’s assessments related to repression were not appropriate.  The protests that took place in Belarus over the reporting period were in many cases not peaceful.  Certain extremist actions were taken by media workers.  The Government was working to increase understanding of the situation.

    Civil society in Belarus was active, the delegation added.  The State party had over 1,500 civil society organizations, including women’s organizations.  In 2020, there was an attempt to carry out a coup d’etat by several non-governmental organizations engaged in anti-Government activities.  A court decision held these organizations and their members responsible for violating the law.  This should not be considered repression of civil society.  In 2023, a new law on the activities of civil society was adopted that required organizations to re-register.  Many non-governmental organizations had not completed the new registration procedure and had been shut down.  Citizens were entitled to renew the activities of previous non-governmental organizations.

    In closing remarks, Ms. Belskaya said Belarus had achieved much in terms of gender equality and empowering women.  The discussion helped the State party to identify the remaining issues to be addressed. The Committee’s recommendations would be carefully considered by the National Council on Gender Equality and used to construct the next national action plan on gender equality

    In her closing remarks, Nahla Haidar, Committee Chair, commended the State party for its efforts and encouraged it to implement the Committee’s recommendations for the benefit of all women and girls in Belarus.

    The delegation of Belarus consisted of representatives from the Ministry of Labour and Social Protection; Ministry of Health; and the Permanent Mission of Belarus to the United Nations Office at Geneva.

    Presentation of Report

    LARYSA BELSKAYA, Permanent Representative of Belarus to the United Nations Office at Geneva and head of the delegation, said Belarus was committed to the principles of the Convention and strived to fully ensure equal rights and opportunities for women and men in all spheres.  Its Gender Gap Index score had almost halved from 0.152 in 2014 to 0.096 in 2024, placing the country 29th out of 166 countries.  In an extremely difficult geopolitical situation, Belarus preserved its State, peace and tranquillity, and progressively built a society of equal opportunities, where every person could have decent living conditions and benefit society.

    Over the years, the Government had made serious efforts to implement the Convention and had achieved concrete results for the advancement of women.  Gender policy was coordinated by the National Council on Gender Policy.  Every five years, national action plans on gender equality were adopted.  This year, the sixth national action plan (2021-2025), the goals and objectives of which were linked to the Sustainable Development Goals, was being implemented.  Work was also progressively being carried out to introduce mechanisms for gender analysis of legislation and gender budgeting in the development of draft State plans and programmes. 

    The National Statistical Committee had developed thematic information systems that made it possible to analyse the situation in the field of gender equality.  The “Gender Statistics Web Portal” contained 178 gender statistics.  In 2020, the Labour Code introduced a norm establishing paternity leave of up to 14 days within six months after the birth of the child.  The Government was also working to calculate the value of unpaid domestic services not included in gross domestic product.  The final data would be published in June 2025.

    Belarussian women were actively promoted to managerial positions.  In the National Assembly, the share of women in 2023 was 36 per cent. At the same time, in the House of Representatives, their share was 40.6 per cent.  Women accounted for 47 per cent of local self-government bodies. Among senior civil servants, the share of women in 2023 was 54.6 per cent; among judges, 64.4 per cent.

    Labour legislation provided for parents with family responsibilities an additional day off from work per month or reduced working days, flexible forms of employment, and remote employment.  The country guaranteed access for all citizens to health care, education, social services, culture and sports.  At the birth of a child, the State provided material support to all families and the payment of insurance premiums.  Benefits for pregnancy, childbirth and temporary disability had been increased, as had social support for parents raising a child with disabilities.  Since 2015, the State also provided a one-time non-cash provision equalling 10,000 United States dollars at the birth or adoption of third or subsequent children.

    The Belarussian Women’s Union, which united 162,000 women, worked to raise the status of women in society and their role in all spheres of life, and there were 15 more women’s organizations in Belarus.  In total, as of October 2024, there were 1,466 public associations; 18 new public associations were registered in 2024. 

    In Belarus, the literacy rate of the population aged 15 and over was almost 100 per cent. General secondary education was compulsory for all.  The percentage of women in higher education was about 53 per cent.  Almost 92 per cent of women aged 16-72 used the Internet.

    For several years, there had been a decrease in the female working age unemployment rate, from 3.1 per cent in 2019 to 2.7 per cent in 2023.  This figure was lower than the male unemployment rate, which was 4.1 per cent in 2023.  More than 42 per cent of employed women had completed higher education and 70 per cent of civil servants were women.  The share of women among researchers in Belarus was 39.2 per cent.  In 2024, for the first time, a female cosmonaut from Belarus, Marina Vasilevskaya, flew to the International Space Station.  Belarus was also actively developing women’s entrepreneurship; the representation of women in this area was 36.4 per cent.  In 2023, the first Forum of Women Entrepreneurs was held, with the active participation of the Belarussian Women’s Union.

    Every woman, regardless of income, had the opportunity to receive any type of medical care free of charge.  Unprecedented measures were being taken in the country to protect motherhood and childhood, to accompany women during pregnancy, and to carry out annual medical examinations.  Belarus was among the 25 countries with the highest rating in terms of access to sexual and reproductive health, information and education.  The proportion of women using various types of contraception increased from 39.9 per cent in 2010 to 53.2 per cent in 2021. The number of abortions per 1,000 women of childbearing age over the past 10 years had decreased by almost two times to 6.2 per cent in 2023.  Since 2011, no cases of illegal abortions had been registered in the country.

    Specific measures were being taken in Belarus to prevent domestic violence.  In 2022, protective measures for victims and preventive measures against violators were strengthened.  Every year, about 15,000 victims turned to regional social service centres for help.  A network of “crisis” rooms was being developed, with 134 rooms having been established as of 2024.  There were no restrictions on the time in which people could live in these rooms; in the first half of 2024, 81 women lived in them.  Public and international organizations were involved in aiding women victims of domestic violence.

    From today’s dialogue, Belarus expected practical and implementable recommendations that would allow it to implement high international standards in State policy to ensure equal rights and expand opportunities for women.

    Questions by a Committee Expert 

    ELGUN SAFAROV, Committee Expert and Rapporteur for Belarus, said that Belarus had developed family and women policy, implemented many awareness-raising projects on the prevention of trafficking and women’s empowerment, organised several international conferences on women in entrepreneurship and science, and adopted several legislative acts on women rights protection during the reporting period. He expressed appreciation for the State party’s activities for the harmonisation of legislation and measures for the adoption of international standards. 

    However, the Committee had witnessed multiple violations of women’s rights.  The State party did not have comprehensive anti-discrimination legislation that specifically prohibited discrimination against women, including direct and indirect discrimination, and also had no specific, stand-alone legislation on gender equality, or a law explicitly focused on ending all forms of gender-based violence, including domestic violence.  Sexual harassment in the workplace remained unaddressed in legislation, and laws prohibited women’s participation in certain jobs. 

    There were many problems related to access to justice for women.  There needed to be effective remedies for victims of discrimination.  There was no special body for deciding cases related to discrimination against women.  HIV transmission was criminalised.  Why had some women lawyers’ licenses been terminated?

    What measures were in place to incorporate a definition of equality between women and men in the Constitution and the Criminal Code?  What mechanisms were in place to protect against discrimination?  Had the Convention been translated into Belarussian? Were there any court cases that had referenced the Convention?  Why had closed court sessions been held to try women who had participated in peaceful demonstrations?  How were lawyers appointed?  Did the State party keep data on criminal cases related to gender?

    Responses by the Delegation

    The delegation said Belarus did not have a comprehensive definition of discrimination against women in its legislation, but principles of equality were included in the Constitution and various laws.  The Government had considered developing a single act on discrimination, but had found that existing legislation sufficiently banned discrimination. Legal amendments were introduced in 2022 to provide women and men with equal opportunities in employment, training and education.  The rights of victims of sexual discrimination needed to be restored under law. All complaints of discrimination, including from women and foreign citizens, needed to be reviewed by relevant State authorities within a tight deadline.  Discriminatory norms were not permitted in legislation.  Follow-up on implementation of gender legislation was carried out by a dedicated group of the National Council on Gender Policy.

    The Bar Association carried out activities to inform citizens about how they could access legal aid.  Women who lodged a complaint related to workplace discrimination or the deprivation of parental rights, as well as pregnant women, vulnerable families and victims of trafficking, received legal aid free of charge. Women in prisons could receive legal aid when they submitted complaints.  Women could choose their own lawyer, or were appointed one if they could not afford one.

    Belarus had two national languages: Belarussian and Russian.  Russian was more represented in State correspondence, but this did not hinder access to information on legislation for the population.  The Convention was part of the national legal system and had been referenced in court proceedings.  The Criminal Code recognised undermining of women’s bodily integrity as an offence.  There were around 50 cases related to bodily harm in the first half of 2024, and 44 cases of other sexual offences.

    Questions by Committee Experts 

    A Committee Expert commended the Government on efforts to align policies with the Sustainable Development Goals. However, the Committee was concerned by the absence of an independent national human rights institution, and by the exclusion of civil society organizations that worked to safeguard women’s rights.  Would the State party consider establishing a national human rights institution in line with the Paris Principles?  Which Government agency was responsible for protecting women’s rights.

    The Expert welcomed the policy to promote gender empowerment and gender sensitive budgeting.  How would the national action plan on gender equality be monitored?  How would the State party ensure the meaningful participation of civil society in this regard?

    The Committee was deeply concerned by the increasingly shrinking civic space.  Many women human rights defenders faced detention and restriction of activities. What plans were in place to protect women activists from gender-based violence and State repression?  Why were civil society organizations that were engaged in the protection of human rights dissolved by the State?

    Belarus had not adopted a national action plan on women, peace and security.  Would it consider developing such a plan to mainstream gender perspectives into peacebuilding efforts?

    One Committee Expert said the share of women in regional leadership positions was low and there were very few female ambassadors.  Women who peacefully expressed diverse political opinions were at a high risk of being treated as extremists.  Had the State party implemented temporary special measures to ensure gender equality in recent years?  Were there measures to increase the representation of women in leadership positions, as well as in employment and education?  What measures were in place to support vulnerable women and to mitigate the impact of the COVID-19 pandemic on gender equality?

    Responses by the Delegation

    The delegation said Belarus had State and public institutions protecting human rights, including the national councils on gender equality, children and disability, and the Environmental Committee, among others.  The State had conducted consultations with civil society, international organizations and State agencies in 2017 related to the establishment of a national human rights institution.  Belarus believed that creating a national human rights institution was not a priority as its existing bodies were working efficiently to protect human rights. This issue could be examined in more detail at a later stage.

    The National Council on Gender Equality coordinated and monitored the implementation of national action plans on gender equality.  From 2023 to 2024, a gender assessment methodology for legislation was adopted. Based on assessments, problems had been identified and measures were being planned to address them in the next national action plan.

    Belarus was not a party to any conflict currently, so it had not implemented special measures related to women, peace and security.  However, the Government had taken measures to protect Ukrainian refugees.  Over 200,000 people had arrived from Ukraine in the past three years, more than half of whom were women.  Belarus offered refugees temporary protection and the choice of becoming Belarussian citizens.

    Civil society in Belarus was active. The State party had over 1,500 civil society organizations, as well as professional unions and women’s organizations. The Belarussian Women’s Union actively engaged with State authorities.  There were also specialised civil society organizations supporting vulnerable women.  The process for registering a civil society organization was simple and transparent; the State did not interfere in the registration of such organizations and provided regular support to existing organizations.  Under the law on civil society organizations, such organizations could be closed based on court decisions finding that the organization had carried out unlawful propaganda or violated State legislation. 

    Citizens active in social activities had the right to be defended but were held liable when they violated the law. In 2020, there was an attempt to carry out a coup d’etat by several non-governmental organizations engaged in anti-Government activities.  A court decision had held these organizations and their members responsible for violating the law.  This should not be considered repression of civil society.  After these events, laws on civil society were amended to provide incentives for more constructive civic activities.  Non-governmental organizations in Belarus needed to work cooperatively with the State and could not be funded from abroad.

    Questions by Committee Experts

    A Committee Expert welcomed that the State party had not ruled out establishing a national human rights institution and called for serious consideration of its establishment.  The Expert called for the development of a dedicated policy on women, peace and security.  How many women’s organizations participated in the development and analysis of the national action plan on gender equality?

    Another Committee Expert welcomed advances in protection from domestic violence, including the law on crisis prevention.  However, gender stereotypes were spread in media communications and women were systematically silenced and controlled by the State – women who expressed dissent were attacked, punished and detained.  Vulnerable women were often blamed and stigmatised when they sought protection.  The State party implemented restraining orders for only 30 days and perpetrators were not expelled from homes. 

    Would the State party adopt a comprehensive strategy to address gender stereotyping, a comprehensive law against domestic violence, and penal protection against marital rape?  How would the State party protect victims in criminal proceedings?  What remedies had been provided to victims in recent years?  How many persons had been convicted for domestic violence crimes? What services were provided in crisis rooms and how were personnel in these rooms trained?  Why did the rooms also house men?  Over 30 non-governmental organizations managing hotlines and shelters had been closed; why was this?

    One Committee Expert commended the State party for addressing trafficking in persons by ratifying international conventions on trafficking and developing comprehensive laws related to trafficking.  Could the State party provide data on trafficking and prostitution?  What measures were in place to protect women with disabilities from trafficking and to identify victims of trafficking?  How many investigations into trafficking had been carried out and how many persons were convicted?  How was the State party strengthening protections for women and girls against trafficking, promoting their access to justice, and building the capacity of State officials on the gendered aspects of trafficking?

    Responses by the Delegation

    The delegation said analysis of the national action plan on gender equality was carried out twice a year. The Belarus Women’s Union was represented in the National Commission on Gender Equality and other bodies.  The State party also closely cooperated with the Red Cross and other international organizations, and supported organizations of persons with disabilities.  Seventy per cent of civil servants were women; 50 per cent were in middle management positions and were involved in preparing important political decisions.

    Eliminating gender stereotypes was one of the goals of the national action plan for gender equality.  The State party was working to enhance the role of fathers in carrying out domestic tasks and was working with civil society on a joint project encouraging responsible fatherhood.  There was a programme on State television that presented case studies of successful professional women.

    Persons who perpetrated domestic violence were required to leave the homes where victims lived, and authorities monitored compliance.  The law on preventing domestic violence had been amended to address violence against former partners and cohabitants.  The number of protective measures that had been implemented had increased significantly from around 18,000 in 2022 to 33,000 in 2024.  The Government supported victims to stay in their homes.  There were awareness raising campaigns in place to inform potential victims about reporting channels and preventing gender-based violence.  All types of bodily harm were criminalised.

    Every year, around 17,500 complaints of domestic violence were made.  If women victims required temporary housing, it was provided. Shelters could be accessed 24 hours a day by victims and their children without documentation.  There were hundreds of crisis rooms available, including 132 equipped for children.  Work was underway to ensure access to the rooms for persons with disabilities.

    Belarus had taken measures to eliminate trafficking in persons and to identify and rehabilitate victims.  In 2024, authorities identified 1,500 cases of suspected trafficking and identified several victims, including minors. The State worked with civil society to build the capacity of law enforcement staff related to trafficking; 90 training sessions had been held in 2024.  Specialists had been hired to support victims of various forms of trafficking.  The State was also working to align national trafficking legislation with international norms, and various awareness raising campaigns on trafficking were also in place. Involvement in prostitution was an administrative offence; however, victims of trafficking were not prosecuted, but were provided with support.

    Questions by Committee Experts

    A Committee Expert welcomed that legislation was being amended regarding domestic violence, which needed to be made an aggravated circumstance in homicide offences.  What measures were in place to ensure the safety of victims of domestic violence?

    Another Committee Expert commended progress being made related to trafficking and prostitution.

    ELGUN SAFAROV, Committee Expert and Rapporteur for Belarus, asked why there was a shortage of female Belarussian ambassadors.  None of the chambers of Parliament had female chairs; there were no parliamentary committees working to protect women’s rights; and only one out of 24 Ministers was a woman.  Why was this? How many Deputy Ministers were women? To what extent were women represented in the technological sector?

    Many very important non-governmental organizations had been closed recently.  What were the reasons for these closures?  There were reports of repression of women journalists and activists.

    One Committee Expert noted progress made in reducing statelessness through nationalisation efforts. However, 2,473 women remained stateless in the State party.  Were there programmes addressing statelessness?  When would the State party ratify the 1954 and 1967 United Nations conventions on statelessness?  The State party had not established a clear procedure for protecting migrant mothers and newborns.  Would it do so?

    Responses by the Delegation

    The delegation said the law on prevention of violence included a clause on educational programmes for perpetrators. The State party was interested in best practices in this field in other countries.

    Women made up around 70 per cent of Belarus’ Ministry of Foreign Affairs.  At a time, Belarus had four female ambassadors.  Appointment to ambassadorial roles was based on competitive selection and there was a shortage of women applicants.  Women were broadly represented as deputy chairs of parliamentary committees and made up around 50 per cent of the members of local councils. Belarus aimed to improve women’s representation in all fields.

    The Committee’s assessments related to repression were not appropriate.  The protests that took place in Belarus over the reporting period were in many cases not peaceful.  Certain extremist actions were taken by media workers.  The Government was working to increase understanding of the situation.

    In 2023, a new law on the activities of civil society was adopted that required organizations to re-register. Many non-governmental organizations had not completed the new registration procedure and had been shut down. Citizens were entitled to renew the activities of previous non-governmental organizations.

    Belarus strived to eradicate statelessness.  The number of stateless women in Belarus had significantly decreased by around 5,000 persons over the past 10 years, thanks to the work of authorities in collaboration with United Nations bodies.  The State supported stateless persons and their children to apply for Belarussian citizenship.  It was continuing work towards ratification of the United Nations conventions on statelessness.  The Government had not received reports of unlawful treatment of stateless persons. Stateless persons in Belarus were primarily citizens of the former Soviet Union.  Their numbers were low; the number of stateless children was less than 10.  To receive citizenship, people needed to demonstrate that they had sufficient income and had not committed offences.

    Questions by a Committee Expert 

    A Committee Expert said Belarus had near universal enrolment of girls and boys in primary education.  Educational instructions could reproduce harmful tropes of men as breadwinners and women as caregivers.  What measures were in place to enforce the role of men as caregivers? Only 23 per cent of persons in science, technology, engineering and maths education were women.  What measures were in place to promote their participation?  Only 17 per cent of university professors were female.  How would this be addressed?  Many students had been arrested and prosecuted for their engagement in protest movements.  Nine of the 11 students detained were women, including a woman professor.  What was the status of these women?

    Responses by the Delegation

    The delegation said traditional values in Belarus promoted families with children. Many educational programmes aimed to uphold traditional values and promote gender equality and the equal roles of men and women.  Around 52 per cent of higher education students were women.  Around 40 per cent of workers in the information technology sphere were women.  The Government was implementing incentives and other measures to attract girls to science, technology, engineering and maths careers.

    Students were detained on the grounds that they had broken a criminal law.  There was no persecution of students simply for exercising freedom of expression.

    Questions by a Committee Expert

    One Committee Expert said the employment rate of men was 72 per cent compared to 63 per cent for women. Although the list of closed professions for women had been reduced significantly, significant barriers for women accessing the labour market remained, and the list itself was a form of discrimination.  Women were underrepresented in higher-paid industries.  Workplace harassment remained common and legislation did not provide adequate remedies for victims and penalties for perpetrators.  Detained women were legally required to engage in labour; this was a form of modern slavery.  In July 2022, all independent trade unions were banned in Belarus. What protection mechanisms were available related to workplace sexual harassment?  Was there a national action plan for addressing the gender pay gap? When would the State party abolish forced labour for prisoners?

    In 2017, the State introduced pension reform, raising the retirement age.  Many citizens had lost their pensions due to the reforms.  Why did men and women have different pension ages?

    Responses by the Delegation

    The delegation said the rate of employment for women from 15 to 74 was 63 per cent, whereas the employment rate for women of working age was above 80 per cent. Belarus promoted equal pay for work of equal value.  Overall, women earned around 75 per cent of what men earned.  In the transport sector and the agricultural sector, wage gaps were much lower.  The State party was implementing measures to reduce the gender pay gap.  Women were now able to work in professions that were previously not accessible, such as truck drivers.  The State party was encouraging men to take parental leave. Women who experienced workplace harassment could report the incident to local authorities and receive remedies. 

    The Supreme Court had ruled that trade unions were to be closed when their activities were harmful to public interests or State values. The federation of trade unions covered almost all unions in the country.  It promoted general and collective agreements, which provided additional social and labour rights for workers.

    Women earned 92.5 per cent of the pension earned by men. Less than one per cent of the elderly were poor.  Women could continue working after they reached pension age; around 20 per cent of women did so.  The Presidential Decree on Employment did not punish individuals who were not working. Under the decree, women who were not working had the right to access State subsidies.

    The State party was exerting efforts to address the gender pay gap.  The national action plan on gender equality, which was based on the Committee’s previous recommendations, introduced measures to support female entrepreneurs and workers.

    Questions by a Committee Expert

    A Committee Expert said there had been significant advances in the field of public health in Belarus in recent years, but access to medicines was better in cities than in rural areas, and the quality of healthcare had declined nation-wide.  How was the State party supporting equal access to affordable healthcare for women from vulnerable groups?  What measures were in place to remove obstacles to accessing abortions?  Did both men and women need to undergo cancer screenings before they could obtain a driver’s licence?

    Women with disabilities faced barriers in accessing sexual and reproductive health services.  How was the State party meeting the needs of women with disabilities in this regard?  Some women with disabilities had been pressured to hand over their children to the State.  How would the State party address the discrimination faced by women with disabilities?  How did the delegation respond to reports of sterilisation of women with disabilities?

    Women with HIV reportedly faced systematic discrimination in health care.  The Penal Code sanctioned the transmission of HIV regardless of the circumstances. What measures were in place to support women with HIV?  What was the situation of sexual and reproductive health education?

    Responses by the Delegation

    The delegation said that in Belarus, medical assistance for persons with HIV was provided in line with health protocols from 2018 and 2022.  In 2018, Belarus had been certified as being free from mother-to-child transmission of HIV.  There were around 27,000 HIV positive people in the State.  The State party worked closely with non-governmental organizations to provide treatment for HIV positive people.  Around 95 per cent of HIV positive people were receiving retroviral treatment.  Women formerly had to present certificates from gynaecologists to receive a driver’s licence; as of last year, this was no longer necessary.  A draft law had been developed to decriminalise unintentional transmission of HIV.  Penalties for the deliberate transmission of HIV would remain.

    The protection of maternal and child health was a priority for the State.  Women who sought abortions could receive free counselling.  Over five years, these counselling sessions had prevented 23,000 abortions.  Pregnancies were interrupted only when the pregnant woman provided permission.

    All women, including women with disabilities, had access to medical assistance without discrimination.  Resources were set aside to allow for high quality medical care of the population.

    The World Health Organization had highly rated the medical care provided in Belarus.  The assessment that the quality of medical care had declined in recent years was not in line with reality.  Mobile health clinics provided in-home medical care in rural areas.  The State party was addressing shortages in healthcare staff.  It had difficulties in accessing certain types of medications due to sanctions from Western countries.

    Questions by Committee Experts

    A Committee Expert commended measures reforming regulations on universal social protection and access to support funds for entrepreneurs. Were there schemes guiding social protection for workers in the informal sector?  What steps had been taken to incorporate gender considerations into the tax regime?  What percentage of business grants were received by female entrepreneurs over the past five years?  How had technological training helped to bridge gender gaps in digital fields? How was the State party strengthening women’s role in sports and cultural activities and addressing stereotypes related to sports and culture?

    Another Committee Expert congratulated Belarus on co-sponsoring the United Nations Convention against Cybercrime and for implementing measures to protect elder women in digital spheres.  What social security and economic policies were in place for elderly women?  Belarus had a high number of criminal cases related to HIV.  Transmission of HIV was penalised with imprisonment of up to five years.  Was the State party rethinking this law?

    Women with disabilities’ right to work could only be realised after a medical examination.  How would the State party allow for the full realisation of these women’s right to work?

    Women in prisons were reportedly denied access to menstrual products.  How would the State party ensure that all detained women were treated in a dignified manner?  Belarus had in 2022 broadened its definition of pornography to include non-traditional relationships.  How would this affect the lesbian, bisexual, transgender and queer community?  Were the rights of indigenous women considered in plans to develop a second nuclear powerplant in the State? 

    Responses by the Delegation

    The delegation said there were around 400,000 people engaged in entrepreneurship in Belarus, 40 per cent of whom were women.  There was a framework for supporting women entrepreneurs, including in rural areas, and norms and laws aimed to support small businesses. Special taxation measures were provided to women entrepreneurs.  The share of women entrepreneurs had increased by around 10 per cent in recent years.  A State support programme for the unemployed had been established; almost half of all beneficiaries were women.

    In 2023, nine women had been penalised for transmitting HIV and 12 women were penalised in 2022.  The State party was continuing to reduce the stringency of HIV legislation.

    There was a Government mechanism which visited prisons regularly to examine living conditions.  The Attorney-General also monitored compliance with legislation on prisons.  Access to all forms of medical care was granted to detainees.  All detainees could file complaints to courts related to the lawfulness of their detention as well as other problems.  Prisoners who violated prison regimes were placed in solitary confinement.

    The State party had a plan for implementing the Convention on the Rights of Persons with Disabilities.  It supported employers who hired persons with disabilities and provided training to help persons with disabilities access work.  An act on quotas for persons with disabilities in the workplace had been implemented.

    Legislative changes addressed the circulation of products that harmed public morality.  They were not expected to have an impact on the lesbian, bisexual, transgender and intersex community.  People could choose the type of relationship they had.

    The impact on human health of the State’s nuclear power plants was negligible.  Belarus upheld the highest standards of safety.

    Women were being encouraged to participate in sports traditionally favoured by men.

    Questions by a Committee Expert

    ELGUN SAFAROV, Committee Expert and Rapporteur for Belarus, asked if the State party had statistics on the amount of property inherited by women.  How did courts protect women’s property rights in divorce proceedings? How were children’s rights protected in international adoption proceedings?  The dialogue and the Committee’s recommendations would help with protecting the rights of women in Belarus.

    Responses by the Delegation

    The delegation said Belarus’ legislation on divorce promoted the best interests of the child.  Mediation was increasingly used in custody cases.  The interests of the mother and father were duly protected.  Belarus worked with several States on regulating international adoptions.  The State party monitored families who had adopted Belarussian children to ensure that their rights were upheld.

    Concluding Remarks

    LARYSA BELSKAYA, Permanent Representative of Belarus to the United Nations Office at Geneva and head of the delegation, thanked the Committee for the dialogue. Belarus had achieved much in terms of gender equality and empowering women.  The discussion helped the State party to identify the remaining issues to be addressed.  The Belarussian population supported the State’s measures, but there was more to be done.  The Committee’s recommendations would be carefully considered by the National Council on Gender Equality and used to construct the next national action plan on gender equality

    NAHLA HAIDAR, Committee Chair, thanked the delegation for its engagement with the Committee.  The dialogue had provided insights into the achievements made in Belarus and the areas in which further progress was needed.  The Committee commended the State party for its efforts and encouraged it to implement the Committee’s recommendations for the benefit of all women and girls in Belarus.

    Health Minister Simeon Brown has today thanked outgoing Health New Zealand Chief Executive Fepulea’i Margie Apa for her service. 

    “Margie Apa was the first to hold the position of Chief Executive at Health New Zealand, taking on the challenge of transitioning New Zealand’s health system from regional district health boards into a single entity following the previous government’s reforms in the middle of a pandemic. 

    “Prior to this, Margie was Chief Executive of the Counties Manukau District Health Board, having built a career in public service. 

    “As Chief Executive at Health New Zealand, Margie remained committed to ensuring access to healthcare services while Health New Zealand grappled with significant operational and financial challenges stemming from the health system reforms.

    “I acknowledge Margie’s decision to step down as Chief Executive of Health New Zealand and thank her for her service,” Mr Brown says. 

    Dr Dale Bramley will become acting Chief Executive of Health New Zealand, while a formal recruitment process is underway to find Ms Apa’s replacement. 

    “I look forward to working with Dr Bramley to ensure Health New Zealand focusses on its core role of ensuring access to timely, quality healthcare for all New Zealanders.”

  • MIL-OSI Security: NURSE CHARGED WITH TAMPERING WITH VIALS OF FENTANYL

    DETROIT – An indictment was unsealed charging registered nurse Travis Eskridge, 53, of Grosse Pointe Park, Michigan, with three counts of tampering with a consumer product, specifically the Schedule II controlled substance fentanyl.  He also was charged with one count of theft of medical products by an employee and one count of obtaining a controlled substance by fraud.  The announcement was made by Acting United States Attorney Julie Beck.

    Beck was joined in the announcement by Special Agent in Charge Ronne Malham, FDA Office of Criminal Investigations Chicago Field Office.

    According to the indictment, while working as a registered nurse in the emergency room at Ascension St. John Hospital, Eskridge tampered with vials containing fentanyl, a powerful narcotic pain reliever, which he knew were intended to be administered to patients in the hospital’s emergency room.  The indictment charges that Eskridge removed fentanyl from the vials, replaced fentanyl with another liquid, and returned the tampered vials to the locked drug storage system. Eskridge did this with reckless disregard for the dangerous risk to patients that results from such tampering.  The indictment also charges that he stole fentanyl vials as part of a pattern of thefts over a nine-month period and obtained fentanyl by fraud for his personal use.  Nurse Eskridge was removed from his position at Ascension St. John Hospital in August of 2022 when the tampering and thefts were discovered.     

    Acting United States Attorney Beck stated, “Such crimes are a betrayal of the trust placed in licensed medical professionals. To protect the health and safety of our citizens, we take crimes like this seriously and pursue those in positions of trust who choose to harm others.”

    Travis Eskridge made his initial appearance on the Indictment today before a Magistrate Judge of the United States District Court for the Eastern District of Michigan.  He was released on a    bond with conditions that included not seeking employment as a nurse.

    The maximum penalties provided by statute for these offenses include up to 10 years of imprisonment for each of the three tampering counts, up to 5 years of imprisonment for the theft count, and up to 4 years of imprisonment for the acquiring by fraud count. Each count also carries a maximum fine of $250,000.  The actual sentence imposed upon any conviction would be decided after consideration of the United States Sentencing Guidelines.

    The case is investigated by special agents of the Food and Drug Administration.

    An indictment is only a charge and is not evidence of guilt. The defendant is entitled to a fair trial in which it will be the government’s burden to prove guilt beyond a reasonable doubt.

  • MIL-OSI New Zealand: Independent arbiter to determine torture redress

    The Government has appointed Hon Paul Davison KC as an independent arbiter to determine financial redress for survivors tortured at the Lake Alice Psychiatric Hospital Child and Adolescent Unit (the Lake Alice Unit).

    In December, Cabinet set aside up to $22.68 million for redress for torture which consists of three components; a one-off payment which recognises an individual’s experience of torture as a child, a new written apology which explicitly acknowledges torture, and facilitating access to support and rehabilitative services. 

    Eligible survivors can choose either an expedited payment of $150,000 or an individual payment process where each claim is independently assessed by an independent arbiter who will determine payment amounts.

    Hon Paul Davison KC is a retired judge of the High Court who also sat as a member of a Divisional Court of Appeal. He retired from the High Court in August 2023 and has since resumed practice at the Bar as a mediator and providing litigation and consultancy advice. In 1983, Hon Davison was the Counsel Assisting the Committee of Inquiry into Oakley Hospital that investigated the death of a patient following the administration of ECT. The Chair of the Committee of Inquiry was Sir Rodney Gallen who was later appointed to oversee the distribution of $6.5m to survivors of the Lake Alice in what is known as the first-round settlement. 

    “We wanted to ensure people have choice when going through this process. The individualised option allows survivors to opt for a payment that considers their personal experiences of torture at the Lake Alice Unit. Guided by terms of reference, Hon Davison KC will independently assess the claims of those who choose this pathway. I would like to thank him for his willingness to undertake this important role,” Lead Coordination Minister Erica Stanford says.

    So far 77 survivors of the Lake Alice Unit have been confirmed as eligible to make their claim for redress. Survivors will have until 30 April 2025 to choose the individual payment process and until 30 September 2025 for the expedited pathway.

    Payments for the expeditated process will begin in March, both processes will be complete by the end of 2025. All eligible survivors can access free independent legal advice to support them during this process.

    Reason for Recall

    Medline Industries, LP, is recalling Integrated Arterial Catheters due to a manufacturing issue that caused excess material to be present on the catheter hub. If a catheter with excess material at the hub is used, that material could detach, potentially entering the  body at the place it is inserted or entering the bloodstream. 

    The use of affected product may cause serious adverse health consequences, including blockage of blood vessels (embolism) and death.

    There have been no reported injuries. There have been no reports of death.

    Medline Industries, LP, Integrated Arterial Catheters are found in Arterial Line Insertion kits, bundles, trays or insertion trays. An arterial catheter is used to continuously monitor blood pressure and take blood samples from patients.

    This communication is part of the Communications Pilot to Enhance the Medical Device Recall Program. The FDA has become aware of a potentially high-risk device issue. The FDA will keep the public informed and update this web page as significant new information becomes available.

    Affected Product

    The FDA is aware that Bard Peripheral Vascular, a subsidiary of Becton, Dickinson and Company (BD), has issued a letter to affected customers providing updated instructions for use for Rotarex Atherectomy Systems (as shown in Figure 1) related to a potentially high-risk device issue:

    What to Do

    • On February 5, 2025, BD sent all affected customers a Medical Device Correction letter recommending the following actions:
      • Review the updated electronic Instructions for Use (eIFU) for Rotarex Atherectomy System, ZE10895 revision C1 09/24, in its entirety, which can be found on BD’s website.
      • Review the updated online, on-demand training on the safe and effective use of the Rotarex Atherectomy System, reflecting the recent eIFU updates by registering on the BD Learning Academy Learning Management System. 
      • Post BD’s “Urgent: Medical Device Correction” notice with the stored product as evidence of the updated eIFU.
    • BD has identified that certain patient anatomical characteristics, including vessel size, angulation, tortuosity, degree of calcification, and procedural factors such as contralateral access, sheath kinking, lack of continuous blood flow, and catheter advancement related factors, could contribute to helix fracture and/or breakage events. BD is continuing to investigate what contributing factors exist that may have resulted in reported failure and/or breakage events. Updates to the Warnings section of the eIFU for US distributed Rotarex Atherectomy Systems include:
      • Use a kink resistant, suitably reinforced sheath of the same size as the Rotarex™ Atherectomy Catheter, or 1 French size bigger. When choosing a contralateral approach this may also serve to facilitate a smooth transition across the aortic bifurcation.
        • Do not use the device across a vessel bifurcation or curve that results in a curvature of the catheter shaft of <4 cm in diameter (Figure 2). Consider the use of ipsilateral access if contralateral access is expected to result in a catheter bend less than 4 cm in diameter.
      • Maintain adequate blood flow through the catheter to reduce the risk of catheter overheating or blockage. Adequacy of blood flow can be assessed by observing continuous drainage into the collecting bag and listening for changes in the audible pitch of the motor.
      • Maintain constant catheter movement to reduce fatigue stress on the inner helix in one location. Perform a smooth back and forth motion within the target lesion. Use a 10 mm forward motion (equivalent to one catheter head) for softer materials and 1 mm for denser lesions.
        • Do not use the device in calcified vessel segments that exhibit radiopacities on both sides of the arterial wall and extend beyond 10 mm in length prior to contrast injection or digital subtraction angiography.
      • Monitor the catheter closely for resistance to movement. Audible control unit alarms (i.e., intermittent beeping) or changes in tactile feel of the catheter, pitch sound of the motor, or LED bar illumination on the control unit (where the green light is no longer illuminated, leaving only the yellow/orange light illuminated) indicate the need to reduce catheter advancement from increments of 10 mm to 1 mm, stop, or flush the catheter. 
    • Check this web page for updates. The FDA is currently reviewing information about this potentially high-risk device issue and will keep the public informed as significant new information becomes available.

    Reason for Early Alert

    The helix portion of the device rotates at a high rate of speed and may be at risk of fracture or breakage when exposed to certain stress, wear, high temperatures, friction, or localized pressure. Use of the device in certain anatomy and lesion types, as well as certain procedural factors, may cause the helix to fracture or break, requiring retrieval of a broken catheter and/or device fragment. A helix fracture or break could cause vessel injury and may lead to severe bleeding or death.

    BD has reported 30 serious injuries and 4 deaths associated with this issue. Additionally, BD has reported 115 cases requiring additional intervention following helix fracture and/or breakage.

    Device Use

    The Rotarex Atherectomy System is intended for use as an atherectomy device and to break up and remove thrombus from native peripheral arteries or peripheral arteries fitted with stents, stent grafts, or native or artificial bypasses.

  • MIL-Evening Report: A new school year can see friendships change – this is tough on kids, but parents can help

    The start of the school year means new classes, routines, after-school activities and sometimes even a new school.

    This can be a really exciting time for kids, but these changes can also disrupt existing friendships. Students might feel stressed about not having certain friends with them in class or confused about why old friends are behaving differently.

    How can you coach your child through changing friendship dynamics?

    How parents help

    Research shows supportive friendships play an important role in maintaining students’ wellbeing. Having good friends is linked to better mental health as well as better school attendance and academic achievement.

    Research also shows us parenting plays an important role in helping children make and keep friends.

    Our research has found parents can improve how well a child is accepted by peers by doing three things:

    • listening and asking questions to help their child think through a situation

    • helping their child plan how to address the issue

    • supporting their child to have contact with peers.

    Parents can play an important role in their child’s friendships.

    Listening to your child

    It’s helpful to check in with your child regularly so you can provide support if they need it.

    When children tell you about a conflict or problem, simply start by listening actively. This means reflecting back in your own words what your child said, including feelings. For example,

    So it sounds like you are feeling upset Shelley wants to hang out with kids in her new class?

    It’s also helpful to empathise with your child about how they feel:

    I think I would feel sad too if that happened to me.

    This helps your child feel like someone else understands them – and they are not dealing with this on their own.

    For older children and teenagers, you may want to check if the child wants your help to work out how to solve the problem. Sometimes listening is all that is needed.

    Working out what to do next

    If needed, parents can then coach children how to manage any concerns. They can start by helping a child understand why another child may have acted as they did.

    For example, if the parent says “Why do you think Shelley said this?”, perhaps the child might respond that “Shelley doesn’t like me anymore”. The parent could offer an alternative explanation – perhaps Shelley is worried about making friends in her new class.

    The parent could ask the child what they want – in the above example, the child may want to still be friends with Shelley. The parent can then prompt the child to think of a range of ways to improve the situation, weigh up what might work best and encourage the child to give this a go. Often children can think of solutions themselves, if asked

    What could you do to improve things? What else could you do?.

    In our example, this might include organising a play with Shelley on the weekend. Alternatively, the child might plan to check in again with Shelley after a few days.

    This type of coaching is helpful as it supports the child thinking through the problem and coming up with their own solution, which they are more likely to put in place than if simply told what to do.

    Parents can also support their child to strengthen friendships by helping them connect with friends outside school through activities, play dates and online contact.

    Play dates can help if friends are not seeing each other at school.

    Friendships may change over time

    We hear a lot about “BFFs”. However, it is not unusual for friendship groups to change over time, as children mature and develop particular interests.

    When children are placed in a new class or school with no close friends, children often cope through what researchers call “transitional friendships”.

    For example, it’s common for children to start high school with no firm friends, but still know some peers from primary school. These acquaintances can provide companionship until children form closer friendships.

    Parents can help their child in making close friends at high school by supporting them to catch up and connect with new friends out of school.

    Similarly, if a child is missing their old friends, a parent can coach their child in finding ways to stay in touch – like texting, a weekend sleepover or joining an out-of-school activity together.

    If friendship concerns or worries are having an ongoing, negative impact on your child’s mental health, parents should seek further support from a health professional.

    You can start with your GP, who may suggest a referral to a psychologist. You may also like to talk to your child’s teacher – they may be able to help your child get to know potential friends through class activities.

  • MIL-Evening Report: The transformation of Jordan Mailata: from rugby league in Sydney to a second NFL Super Bowl

    Jordan Mailata is an Australian-born NFL star who plays for the Philadelphia Eagles as an offensive left tackle. This position favours very tall, heavy and strong athletes who also possess good footwork, agility and tactical awareness.

    His main job is to protect his quarterback and provide gaps for his running backs to run through.

    Mailata is one of four Australians to play in a Super Bowl, with the others being punters (kickers) Ben Graham, Arryn Siposs and Mitch Wishnowsky.

    Unfortunately, no Australian has won the game that matters most every year but Mailata has a chance in his second Super Bowl, against the Kansas City Chiefs on Monday morning.

    So, how did Mailata reach the pinnacle of his “new” sport?

    A rugby league giant

    Mailata’s initial sporting success came in rugby league.

    He played in the Canterbury Bankstown Bulldogs under-18 team and was offered a contract by the South Sydney Rabbitohs under-20 team. Both of these clubs are part of the elite National Rugby League (NRL) competition.

    Mailata, who still hadn’t reached his 21st birthday when offered the Rabbitohs contract, stood out as a giant even in professional rugby league circles at 203cm and 147 kilograms.

    But after fainting during a rugby league training session, he was diagnosed with a heart condition that required surgery. He then became even bigger, reportedly tipping the scales at close to 170kg.

    Ultimately, this resulted in some of the South Sydney staff and sport agents suggesting American football might be a better option for someone of his stature and physical capacities.

    Tranasferring his talent

    This brings us to what is known as “talent transfer”.

    In high-performance sport, talent transfer refers to a high-level athlete from one sport transferring to another based on their existing skills and physical capacities.

    This can be done for a number of reasons, like injury, burnout, loss of interest, or, in the case of Mailata, finding another sport that would suit their physicality better.

    Examples of talent transfer include sprinting to bobsleigh (Jana Pittman), rowing to cycling (Bridie O’Donnell and Rebecca Romero) or Sonny Bill Williams, who was highly successful at rugby league, rugby union and heavyweight boxing.

    For talent transfer to be successful, there needs to be a lot of similarities between the two sports in areas such as skill requirements (kicking, passing, tackling), physical traits (height, mass) and physiological demands (aerobic vs anaerobic).

    These similarities can allow athletes to capitalise on their previous training to succeed in their new sport faster and to a higher level than their competitors.

    The similarities between American football and rugby (league and union) – such as catching and kicking an oval-shaped ball, evading or running through defenders and full-body tackling – would have benefited a mature athlete like Mailata to transfer from one code to another.

    A whole new ball game

    His transition from a monster-sized rugby league player in Australia to a more regular-sized offensive tackle in the NFL was initially facilitated through the NFL International Player Pathway (IPP) program.

    The IPP was established in 2017 to provide high performance adult athletes from all over the world (like Mailata) the opportunity to learn the complexities of American football and increase the number of international players in the NFL.

    The program has been highly successful, with 37 international players signing with NFL teams, of which 18 are currently on NFL rosters.

    When Mailata was drafted to the NFL in 2018, he had to work on many aspects of his body to meet the physical challenges of playing in the NFL against other exceptionally massive and strong athletes.

    He also had to learn a range of sport-specific technical and tactical skills.

    As a part of the IPP, he started working with coaches including Jeff Stoutland, the Philadelphia Eagles offensive line coach.

    Stoutland took Mailata into the classroom, teaching him the intricacies of offensive line play including protection and run schemes. These lessons extended into what footwork patterns he would need to master, where and how to position his body when initiating contact and how to use his hands to control the defensive line.

    Such skills are the bread and butter of the offensive line – these athletes provide the quarterback time to make key passing decisions and increase the chance of their running backs making big yards on their carries.

    Mailata has also mentioned how Strickland taught him the importance of critically watching NFL games, initially to learn the technicalities of the sport and now to further refine his performance against the best defensive lines.

    The next wave

    In addition to the IPP that looks at talent transfer from adult athletes, the NFL has developed the NFL Academy for school-aged children.

    The first academy was based at Loughborough University in the United Kingdom and the second was developed at A.B. Patterson College on the Gold Coast.

    These academies combine full-time education with intensive American football training in the hope of promoting pathway opportunities at US colleges.

    Hopefully, these academies will see more young Australians transferring their skills and following Mailata into the NFL.

    India is home to 6.65 lakh villages, with 2.68 lakh Gram Panchayats and Rural Local Bodies, which form the backbone of the nation’s rural landscape. These villages, scattered across the country, play a crucial role in shaping India’s rural economy and culture. The Union Budget 2025-26 recognizes the importance of these communities and places a strong emphasis on their upliftment. The budget focuses on key areas such as employment generation, women empowerment, education and infrastructure development in rural India.

    Total amount allocated for the demand in the Budget Estimate (BE) for 2025-26: ₹1,88,754.53 Cr.

    The Union Budget 2025-26 outlines several key initiatives aimed at driving rural development and enhancing prosperity through focused programs and investments:

     

    1. Water Supply – Jal Jeevan Mission:

    The Jal Jeevan Mission has been extended until 2028 with an increased focus on improving the quality of infrastructure and the operation and maintenance of rural piped water supply schemes through a citizen-centric approach, known as “Jan Bhagidhari”. The goal is to achieve 100% coverage with enhanced financial support and sustainability through state-specific MoUs.

    1. Broadband Connectivity – Bharatnet Project:

    Broadband connectivity will be expanded under the Bharatnet Project, aiming to provide all government secondary schools and primary health centers in rural areas with internet access, improving education and healthcare services.

    1. India Post as a Catalyst for Rural Economy:

     India Post will drive rural economic growth with its 1.5 lakh rural post offices, India Post Payment Bank, and 2.4 lakh Dak Sevaks. It will enhance services by offering micro-enterprise credit, digital services, and institutional account management. Furthermore, India Post will evolve into a key public logistics organization supporting entrepreneurs, MSMEs, and self-help groups.

    1. Rural Prosperity and Resilience Program:

    A comprehensive multi-sectoral ‘Rural Prosperity and Resilience’ programme will be launched in collaboration with states. This program aims to address under-employment in agriculture by promoting skill development, technology adoption, and investments to invigorate the rural economy. The mission will focus on empowering rural women, young farmers, marginalized communities, and landless families, ensuring that migration becomes a choice, not a necessity.

    Through these initiatives, the Union Budget 2025-26 envisions a holistic approach to rural development, aiming for long-term growth, resilience, and self-reliance across rural India.

    Positive Transformations in Rural India

    Positive outcomes have been observed across various sectors as India moves toward greater prosperity. These include an increase in rural wages, wider internet connectivity in rural areas, a decline in poverty, and a reduction in consumption inequality.

    • National Multidimensional Poverty Index (MPI) Report: The proportion of individuals living in multidimensional poverty declined from 24.85% to 14.96% between 2015-16 and 2019-21. 13.5 crore individuals escaped multidimensional poverty during this period.
    • Rural Internet Connectivity: As of March 2024, India had 954.40 million internet subscribers. Out of this, 398.35 million were rural internet subscribers.
    • Income Distribution (Gini Coefficient): For rural areas, it declined from 0.266 in FY22-23 to 0.237 in FY23-24.
    • Rural Wage Growth: As per data from the Labour Bureau, rural wages in FY25 (April-September 2024) showed a growth of above 4% each month year-on-year: Agriculture wages grew by 5.7% for men and 7% for women. Non-agricultural wages grew by 5.5% for men and 7.9% for women.

    Pathway to Prosperity: Key Rural Scheme Achievements

    • Pradhan Mantri Gram Sadak Yojana (PMGSY) – Roads: Launched in December 2000, this initiative aims to provide rural connectivity through a single all-weather road to unconnected habitations of a designated population size in the core network, enhancing the socio-economic conditions of rural communities.
    • Pradhan Mantri Awaas Yojana-Gramin (PMAY-G) – Housing: Launched on 20th November 2016, aiming to provide housing for the poorest segments of society.

    Mission Amrit Sarovar: Launched on 24th April 2022, with an objective to conserve water for the future. The Mission aimed at developing / rejuvenating 75 Amrit Sarovar (Pond) in each district of the Country. A total of 68,843 ponds have been constructed.

     

    National Rural Health Mission: Launched in 2005 with the objective of building public health systems to provide accessible, affordable and quality health care to the rural population.

    1. Jal Jeevan Mission: Launched in 2019, JJM is a nationwide programme designed to provide all households in rural India with safe and adequate drinking-water through individual household tap connections. As of 27 January 2025, a total of 12.2 crore households have been provided with tap water connections.
    1. Swachh Bharat Mission (Gramin): Launched on October 2, 2014, the initiative aimed at making India Open Defecation Free (ODF). Currently in Phase 2 the focus is on maintaining the ODF status, managing solid and liquid waste by 2024-25 and transitioning all villages from ODF to the ODF Plus model.

    Saansad Adarsh Gram Yojana (SAGY): Launched on 11th October 2014, SAGY aims to preserve the essence of rural India by providing access to basic amenities and opportunities for people to shape their own futures.

    1. Pradhan Mantri Janjati Adivasi Nyaya Maha Abhiyan (PM-JANMAN): Cabinet Approved PM-JANMAN on Nov. 2023 to improve socio-economic conditions of the Particularly Vulnerable Tribal Groups (PVTGs).

Deendayal Antyodaya Yojana – National Rural Livelihoods Mission (DAY-NRLM): Launched in 2011, the scheme aims to empower rural poor women by organizing them into Self Help Groups (SHGs) and supporting economic activities to improve their income and quality of life. Implemented in 5,369 blocks across 682 districts.
    2. Gram Nyayalayas Act, 2008: Provide access to justice at the grassroots level in rural areas. As of October 2024, 313 Gram Nyayalayas have disposed of over 2.99 lakh cases between December 2020 and October 2024.
    1. National Social Assistance Programme (NSAP): Launched on 15th August 1995, Provide financial assistance to vulnerable sections of society.

     

    1. Mahatma Gandhi National Rural Employment Guarantee Scheme (MGNREGS) Progress: Launched in 2005, the scheme aims to provide 100 days of guaranteed wage employment annually to rural households, enhancing livelihood security through unskilled manual work. The Budget allocation under Mahatma Gandhi NREGA has steadily risen. The budget allocation for the financial year 2006-07 was Rs 11,300 crore which increased to Rs 33,000 crore in 2013-14 and now stands at Rs 86,000 crore during FY 2024-25 at Budget estimate stage.

    In a bid to raise awareness about the health benefits of medicinal plants, a species-specific campaign titled “Shatavari –For Better Health” was launched today by Shri Prataprao Jadhav, Minister of State (Independent Charge), Ministry of Ayush. Vaidya Rajesh Kotecha, Secretary, Ministry of Ayush, Dr. Mahesh Kumar Dadhich, CEO, National Medicinal Plants Board (NMPB), and senior officials from the Ministry of Ayush were present on the occasion.

    In his address, Shri Prataprao Jadhav highlighted the significant progress made by the Ministry of Ayush over the last decade and lauded the efforts of NMPB for launching this new initiative to promote awareness about Shatavari. The Minister also mentioned previous successful campaigns led by NMPB, including those for Amla, Moringa, Giloe, and Ashwagandha. These initiatives have contributed to spreading knowledge of the health benefits of medicinal plants across the country.

    Shri Prataprao Jadhav also emphasised the relevance of Shatavari in achieving the Panch Pran Goal outlined by the Prime Minister Shri Narendra Modi during his Independence Day speech on August 15, 2022. The Prime Minister envisioned making India a developed nation by its 100th Independence Day in 2047. As part of this mission, the Shatavari plant has been identified as a key resource for enhancing women’s health in India. This aligns with the broader goal of holistic well-being of citizens.

    Vaidya Rajesh Kotecha, Secretary, Ministry of Ayush, elaborated on the activities and achievements of NMPB in promoting medicinal plants. He also shared insights into the Central Sector Scheme for the Conservation, Development, and Sustainable Management of Medicinal Plants, an initiative to ensure the long-term preservation and cultivation of important medicinal species, including Shatavari.

    Dr. Mahesh Kumar Dadhich, CEO, NMPB, highlighted the medicinal importance of Shatavari, especially for its benefits to women’s health, and discussed the agro-economic potential of this plant. He informed the attendees that financial assistance amounting to ₹18.9 Lakhs will be provided to eligible organizations to support the campaign, fostering greater awareness and wider adoption of Shatavari in the public health landscape.

    Shatavari, known for its numerous health benefits, particularly in supporting women’s health and enhancing immunity, will now receive focused attention through this campaign, ensuring it reaches wider audiences across the nation. The campaign marks another significant step in the Ministry of Ayush’s continued efforts to promote traditional medicine and medicinal plants for better health and well-being in India.

  • MIL-OSI USA: Hell’s Kitchen Aesthetician Arrested For Unlawfully Injecting Counterfeit Botox

    Joey Grant Luther Allegedly Purchased and Imported Counterfeit Botox From China and Administered Drugs to Clients at His Hell’s Kitchen Medical Spa Without a License

    Danielle R. Sassoon, the United States Attorney for the Southern District of New York, announced the unsealing of a Complaint charging JOEY GRANT LUTHER with wire fraud, smuggling, and other crimes related to misbranded and counterfeit drugs.  As alleged in the Complaint, from in or about April 2023 through at least in or about July 2024, LUTHER shipped counterfeit drugs, including counterfeit Botox, from countries in Asia, including China, and injected them, without the required license, into his clients at his medical spa, JGL Aesthetics.  None of the counterfeit Botox that LUTHER injected was approved for sale or dispensing in the U.S. by the FDA.  LUTHER was arrested this morning and will be presented later today before U.S. Magistrate Judge Sarah L. Cave.

    U.S. Attorney Danielle R. Sassoon said: “As alleged, Joey Grant Luther, who does not possess the licensing required by New York State to perform injections of Botox, knowingly purchased counterfeit Botox from China, injected it into his clients, and represented that the counterfeit Botox that he was peddling was genuine.  Luther continued to purchase and inject the counterfeit Botox even after he learned that clients had fallen ill or experienced strange symptoms after Luther injected them.  Luther’s disregard for the health of his clients put all of his victims in harm’s way and, in some cases, caused life-threating injuries.  Luther will now face criminal charges for this conduct.”

    As alleged in the Complaint:[1]

    From at least in or about January 2021 through at least in or about July 2024, LUTHER ran a medical spa called JGL Aesthetics in the Hell’s Kitchen neighborhood of Manhattan.  In or about September 2021, an individual (“Victim-1”) went to JGL Aesthetics to receive Botox treatments to treat excessive sweating as well as fine lines on her face.  Victim-1 learned that LUTHER performed Botox injections from a friend.  Between in or about September 2021 and in or about February 2024, LUTHER injected counterfeit drugs labeled as Botox® 150 Units manufactured by Allergan into Victim-1’s armpit, forehead, and face on approximately eight occasions.  Victim-1 never provided LUTHER with a prescription to receive Botox injections.

    On or about February 27, 2024, LUTHER injected Counterfeit Botox into Victim-1’s armpits and eyebrow area at JGL Aesthetics.  Approximately three days after Victim-1’s February 27, 2024, visit to JGL Aesthetics, Victim-1 began experiencing double vision, light headedness, difficulty swallowing and chewing, heart palpitations, and slurring of speech.  Victim-1 also could not lift her arms and experienced weakness from the waist up. Victim-1 went to three hospitals to seek medical assistance for these symptoms.  On or about March 20, 2024, Victim-1 was diagnosed with Botulism toxin.

    From between in or about April 2023 and in or about January 2024, U.S. Customs and Border Patrol (“CBP”) seized parcels intended for JGL Aesthetics, including one which lists a return address in Hong Kong.  These parcels contained significant quantities of counterfeit drugs, including Counterfeit Botox.  Below is a photo of the contents of the parcel—including the exterior of cartons of Counterfeit Botox.

     

    From at least in or about March 2024 through at least in or about April 2024, during which time LUTHER negotiated an additional purchase of Counterfeit Botox from one of his suppliers, multiple individuals who received injections of Counterfeit Botox from LUTHER messaged LUTHER about the negative side effects from the injections, including lazy eyes, double vision, and drooping eyelids.  In response to these complaints, LUTHER typically assured his clients that the side effects were temporary, represented that he was unaware that counterfeit Botox had been found circulating in the U.S., and assured clients that the Counterfeit Botox was from Allergan, the veritable maker.  As alleged, LUTHER was well aware that the Counterfeit Botox was, in fact, counterfeit.

    Neither CBP’s seizure of packages intended for LUTHER, the defendant, nor his clients informing LUTHER of injuries related to his injecting Counterfeit Botox stopped LUTHER from continuing to procure the Counterfeit Botox and injecting it into his clients. Between March 13, 2024—the date that Victim-1 contacted LUTHER about the injections of Counterfeit Botox—and October 2, 2024—after law enforcement officers and special agents executed a search warrant of JGL Aesthetics, JGL Aesthetics had at least approximately 700 appointments logged in its client and service management application that were coded with having provided Botox-related services.  Data contained in the client and services management application also revealed that JGL Aesthetics provided Botox-related services as early as January 2021.

    LUTHER, 54, of New York, New York, is charged with one count of wire fraud, which carries a maximum sentence of 20 years in prison; one count of dispensing of a misbranded drug while held for sale, which carries a maximum sentence of one year in prison; one count of holding counterfeit drugs for sale and for dispensing, which carries a maximum sentence of 10 years in prison; one count of receiving misbranded drugs in interstate commerce and delivery or proffered delivery thereof, which carries a maximum sentence of three years in prison; and one count of smuggling, which carries a maximum sentence of 20 years in prison.

    The minimum and maximum potential sentences are prescribed by Congress and are provided here for informational purposes only, as any sentencing of the defendant will be determined by a judge.

    Ms. Sassoon praised the outstanding investigative work of the Food and Drug Administration Office of Criminal Investigations, the Federal Bureau of Investigation, the CBP – New York Field Office, and the Special Agents and Task Force Officers assigned to the U.S. Attorney’s Office for the Southern District of New York.

    This case is being handled by the Office’s Narcotics Unit.  Assistant U.S. Attorney Brandon C. Thompson is in charge of the prosecution.

    The charges contained in the Complaint are merely accusations, and the defendant is presumed innocent unless and until proven guilty.

  • MIL-OSI USA: Michigan Man Charged with Drug Distribution and Loan Fraud

    BOSTON – A Michigan man has been charged and has agreed to plead guilty in connection with a conspiracy to import and sell illegal pharmaceuticals, including opioids, and to fund the operation of the scheme by fraudulently obtaining a Covid pandemic relief loan.

    Donald Nchamukong, 37, was charged by Information with conspiracy to smuggle goods into the United States, to commit loan fraud and to distribute controlled substances.  Nchamukong will make an initial appearance in federal court in Boston on a date to be scheduled by the Court.

    According to the charging documents, starting in 2019 and continuing to 2022, Nchamukong and a co-conspirator, Doyal Kalita, conspired to distribute drugs to persons in the United States over the internet and using call centers in India. Nchamukong allegedly used shell companies, including a purported dietary supplements company and an auto parts supplier, and associated bank and merchant accounts to process sales of illegal foreign drugs, including the Schedule IV opioid, tramadol. Nchamukong and Kalita also received shipments of tramadol from India and reshipped the drug to customers across the United States, including in Massachusetts. When the Covid-19 pandemic hit, Nchamukong and Kalita allegedly fraudulently obtained a $200,000 Economic Injury Disaster Loan to fund their illegal drug scheme.  

    Kalita was convicted in 2024 and sentenced to 10 years in prison for orchestrating the online drug distribution scheme and a technical support fraud scheme and related money laundering.

    The charge of conspiracy provides for a sentence of up to five years in prison, three years of supervised release and a fine of up to $250,000, or twice the monetary gain or loss, whichever is greater. Sentences are imposed by a federal district court judge based upon the U.S. Sentencing Guidelines and statutes which govern the determination of a sentence in a criminal case.

Foley; Jodi Cohen, Special Agent in Charge of the Federal Bureau of Investigation, Boston Division; Thomas Demeo, Acting Special Agent in Charge of the Internal Revenue Service Criminal Investigation, Boston Field Office; and Fernando P. McMillan, Special Agent in Charge of the New York Field Office of the U.S. Food and Drug Administration, Office of Criminal Investigations made the announcement today. Valuable assistance was provided by Homeland Security Investigations in New York, Small Business Administration and the United States Attorney’s Office for the Eastern District of New York. Assistant U.S. Attorney Kriss Basil, Deputy Chief of the Securities, Financial, and Cyber Fraud Unit, is prosecuting the case.

    On May 17, 2021, the Attorney General established the COVID-19 Fraud Enforcement Task Force to marshal the resources of the Department of Justice in partnership with agencies across government to enhance efforts to combat and prevent pandemic-related fraud. The Task Force bolsters efforts to investigate and prosecute the most culpable domestic and international criminal actors and assists agencies tasked with administering relief programs to prevent fraud by augmenting and incorporating existing coordination mechanisms, identifying resources and techniques to uncover fraudulent actors and their schemes, and sharing and harnessing information and insights gained from prior enforcement efforts.   • MIL-OSI Europe: Answer to a written question – Suspicious under-reporting of nosocomial infections in Romanian hospitals – E-002315/2024(ASW)

    The prevalence of healthcare-associated infections (HAI) reported by Romanian hospitals in the European Centre for Disease Prevention and Control’s (ECDC) point prevalence surveys (PPS)[1] is indeed low: 2.8% (second lowest) in 2011-2012[2], 3.6% (fourth lowest) in 2016-2017[3], and 3.1% (second lowest) in 2022-2023[4].

    Some degree of under-reporting may be possible, as shown by the data on patient case-mix (severity of the clinical condition of hospitalised patients) in the PPS sample from Romania and the results of the validation of this and previous PPS, but the extent of under-reporting cannot be quantified.

    The low reported prevalence of HAI can also be partly explained by the very low diagnostic testing in Romanian hospitals (third lowest in 2016-2017 and second lowest in 2022-2023), indicating that some HAI may remain undiagnosed because diagnostic tests are not performed.

    In accordance with Article 7(1) of Regulation (EU) 2022/2371[5], Member States must provide a report on their prevention, preparedness and response planning for serious cross-border health threats, which includes their national capacities related to HAI surveillance.

    ECDC periodically assesses the Member States’ prevention, preparedness and response planning at national level under Article 8 of Regulation (EU) 2022/2371.

    Such an assessment[6] is scheduled to take place in Romania in 2026. In any case, the Commission remains in contact with the relevant Romanian authorities.

    Based on the information provided by the Member States and the results of the assessments carried out by ECDC, the Commission shall produce a report on the state of play and progress and may support the action of the Member States through general recommendations on prevention, preparedness and response planning.

    WASHINGTON, D.C. – Last night, U.S. Senator Tim Kaine (D-VA) joined his Democratic colleagues in holding the Senate floor to protest Russell Vought’s nomination to lead the Office of Management and Budget (OMB), citing stories he has collected from federal workers about the chaos the Trump Administration has unleashed on the federal workforce. Vought is one of the key authors of Project 2025 and has long been an architect of President Trump’s plans to villainize the federal workforce.

    “My colleagues have spoken on the floor about a particular statement of Mr. Vought’s that I examined him about fairly aggressively during the Budget Committee Hearing. In the course of a speech, he said, ‘I want federal employees to be traumatized. I want to put them in trauma. I want them to come to work—to not want to come to work—because they know that they are increasingly viewed as the villain. Now, who talks like that? I mean, who talks like that? Is there a single manager or leader or organizational chief that we admire who believes that their mission, their happiness, their glee, their purpose is to make their workforce feel traumatized? No we would never celebrate a leader of that kind,” said Kaine.
    “What I want to do in my time on the floor tonight is talk a little bit about these federal employees and what having a traumatized workforce means… What I’ve heard from Virginians is just in the week since the funding pause order went into place—something that was masterminded by Russell Vought—federal employees. Yesterday, I decided after hearing stories from federal employees, to launch a website, a resource where federal employees could share with anonymity guaranteed… I thought what I would do tonight is, I’ve just taken 18 of these stories, from the federal employees that have just once in in the last 24 hours, of the hundreds that have been submitted, and I just want to read some to you, to tell you about who these people are who Mr. Vought wants to be traumatized. Who these people are that Mr. Vought wants to personally make feel as if they are the villains,” Kaine continued.
    Then, Kaine shared various stories he has collected from federal workers about how the Trump Administration’s actions have harmed them and threatened their ability to deliver essential services for the American people, including:
    A federal employee working for the U.S. Agency for International Development (USAID) who wrote, “After two extremely painful miscarriages, I am now 34 weeks pregnant with my first child. Since my husband works as a lawyer for the EPA, what should have been a joyful time in our lives now feels like a dystopian hellscape and we are very afraid for our future and financial security. We are just hoping to have health insurance at this point for when I give birth but even that feels uncertain. I swore an oath and believe in the work that USAID does. I believe that it makes American stronger, safer, and more prosperous, as Secretary Rubio is calling for, and I will supporting the Agency until they boot me from the system. God help us all.”
    A federal employee working for the U.S. Department of Health and Human Services who explained, “I am married and pregnant. I am the breadwinner. A woman. I am a homeowner. I pay taxes. I took an oath and I love my job. The daily fear tactics and targeting of federal employees has uprooted my life. I no longer feel safe going on any kind of family vacation, making any big purchases or doing anything because everyday I wonder will I have a job.”
    A federal employee working for the National Science Foundation (NSF) who said, “The opportunity to give back and support the next generation of U.S. based scientists was a dream fulfilled, and I am terrified that I will be fired as soon as Friday with no protections or severance. The fair compensation and flexible schedule let’s my spouse work as a teacher, and she is so great at her job. But that will not pay the mortgage.”
    A federal employee working for USAID who warned, “The attack on USAID lacks intelligence and foresight. China and Russia are filling the vacuum, outspending the US and deepening partnerships with our allies, who feel abandoned. This is creating permanent damage, and undoing decades of progress in a few days. This does the opposite of making America stronger, safer, and more prosperous.”
    A federal employee working for the U.S. Department of Agriculture who explained, “These last few weeks have been hell for us federal workers. I come to work with a pit in my stomach. I am a probationary employee, so will probably be the first to go during a RIF. They have left us in the dark while constantly terrorizing us with threatening, passive aggressive messages, and half legal deals to resign. I fear for my job, but I fear more for my country.”
    A federal employee working for the U.S. Department of Transportation who wrote, “I am frightened about my position. I’m a single income household and am convinced no one has my back. Congress has been pretty much silent, and the news has gained very little traction nationwide.”
    A federal employee working for the U.S. Department of Defense who said, “As soon as this administration took office it felt like federal workers were under siege. They began with their flurry of executive orders and memos, they put Elon Musk (whom no one elected, whom is not a federal employee but yet has huge contracts for other areas with the government) in charge of “handling” the potential mass layoffs of federal workers.”
    A federal employee working at the General Services Administration who explained, “…the disregard for union contracts is deeply concerning and undermines the commitments made to the workforce. Many of my talented and hardworking colleagues have been living in fear for weeks, facing uncertainty they do not deserve. This unlawful mistreatment not only undermines their dedication but also creates an environment of instability and anxiety that no employee should have to endure.”
    A federal employee working at the Department of Homeland Security (DHS) who wrote, “My husband and I are both federal employees and we are both on probation. We also have student loan debts and under the public service loan forgiveness program. If we lose our jobs because we are on probation, we will lose the ability to have our payments to [Public Service Loan Forgiveness] counted, we will not be able to pay for childcare and we will lose our apartment.”
    A federal employee working at DHS who warned, “truly believe a strong, healthy workforce of civilian servants is vital for a strong, healthy America. Our government has a duty to protect its citizens. This – to me – includes making sure peoples basic needs are met, be it healthcare, food, housing, education, etc. The private sector is not taking on this obligation.”
    A federal employee who said, “I’ve served under different administrations, Republican and Democrat, and been proud to do so… The last 2 weeks have been a nightmare.”
    A federal employee who wrote, “Since inauguration, times have been hell for us because every day is loaded with uncertainty regarding the future state of our contract, work, and our federal counterparts we work daily with. To this day, every work day is filled with dread and anxiety.”
    A federal contractor working for USAID who explained, “In the past week, I have experienced near everyone in my company get placed on furlough. Beyond the fact that we were all working to make international development more impactful, and the fact that the US Company we have invested so much time in may never come back from this, we are all without salary and uncertain for the future.”
    A federal employee working for a small independent agency who wrote, “I am a probationary employee, meaning my name is on a short list to fire. I was hired under Schedule A — persons with disabilities, so my name is on a list. I feel like I am being threatened by the very institutions that were created to safeguard the principles of truth, compassion, respect…”
    A federal employee who wrote, “Today, I woke up to an email saying we had a restraining order, tied to Trump’s EOs, that would limit how we’d disburse our grants. Since the EOs were vaguely defined to begin with, this could be a witch hunt for all kinds of programs and grants we give out.”
    A federal employee who said, “I’m a senior human resource professional in the Department of the Interior. I’m on daily calls with Departmental HR leaders who receive direction from OPM. Today leadership mentioned that their coordination was with DOGE “employees” rather than with actual OPM employees. These DOGE employees have full access to our USA Staffing hiring system, which includes personally identifiable information for ALL applicants to any position in DOI. It is unclear what kind of clearance these individuals have, if any, and what authority they have to even access this system.”

    Good morning.

    I wanted to say a few words about the deeply concerning situation in the Democratic Republic of the Congo.

    We are at a pivotal moment and it is time to rally together for peace.

    Tomorrow, leaders from the East African Community and the Southern African Development Community will take part in a Summit in Tanzania.

    The focus will be addressing the crisis in the face of the offensive by the M23, supported by the Rwandan Defence Forces.

    Next week, in Addis Ababa, I will take part in a Summit-level meeting of the African Union Peace and Security Council where this crisis will be also front and centre.

    In advance of these crucial gatherings, I want to make a special appeal for peace.

    Thousands of people have been killed – including women and children – and hundreds of thousands have been forced from their homes in the eastern DRC.

    We also see the continued threat by other armed groups, either Congolese or foreign.

    All of this is having an enormous human toll.

    We have countless reports of human rights abuses, including sexual and gender-based violence, forced recruitment, and the disruption of lifesaving aid.

    The humanitarian situation in and around Goma is perilous.

    Hundreds of thousands of people are on the move, with many of the previous sites hosting displaced people north of the city now looted, destroyed or abandoned.

    Healthcare facilities are overwhelmed.

    And other basic services – including schools, water, electricity, phone lines and the internet – are severely limited.

    Meanwhile, the conflict continues to rage in South Kivu and risks engulfing the entire region.

    I want to pay tribute to all those who have lost their lives, including MONUSCO blue helmets and regional forces.

    And I express my solidarity with the Congolese people who find themselves yet again the victims of a seemingly endless cycle of violence.

    As the Summit in Tanzania gets underway, and as I prepare to leave for Addis Ababa, my message is clear:

    Silence the guns.

    Stop the escalation.

    Respect the sovereignty and territorial integrity of the Democratic Republic of the Congo.

    Uphold international human rights law and international humanitarian law.

    There is no military solution.

    It is time for all the signatories of the Peace, Security and Cooperation Framework for the DRC and the region to honour their commitments.

    It is time for mediation. It is time to end this crisis. It is time for peace.

    The stakes are too high.

    We need the active and constructive role of all players — namely neighbouring countries, subregional organizations, the African Union and the United Nations.

    Let us all act together for peace.

    After pressure, Kennedy agreed to transfer stake in anti-vaccine lawsuits to his son, but would still have influence over those cases as HHS Secretary

    Washington, D.C. – U.S. Senators Elizabeth Warren (D-Mass.), a member of the Senate Finance Committee, and Tim Kaine (D-Va.), a member of the Senate Committee on Health, Education, Pensions, and Labor, wrote to Robert F. Kennedy, Jr., nominee for Secretary of Health and Human Services (HHS), about his continued conflicts of interest. The senators called out Mr. Kennedy’s plan to enter office with a serious ethics conflict by keeping a financial interest in anti-vaccine lawsuits within his family, asked him to recuse himself from former clients’ matters, commit to not lobbying HHS after his tenure as Secretary, and more. 

    Mr. Kennedy initially had an agreement with the law firm Wisner Baum that would allow him to earn 10% of any payments awarded to plaintiffs in cases he referred to the firm, including cases against the pharmaceutical company Merck’s Gardasil vaccine. As HHS Secretary, Mr. Kennedy would have the power to influence the outcome of those vaccine cases, including influencing Merck’s willingness to settle, or influencing the jury pool. Last week, Mr. Kennedy announced he would transfer his stake in those cases to his adult son, an attorney at Wisner Baum. 

    “This arrangement simply does not pass the smell test. Your son is not an independent third party, and ethics experts have critiqued your plan as exploiting a loophole in the law,” wrote the senators. The lawmakers called on Mr. Kennedy to divest from cases he’s referred to the firm by either forfeiting the fee or agreeing with Wisner Baum to accept an amount not dependent on the outcome of cases during his tenure. 

    Mr. Kennedy has also worked with an anti-vaccine advocacy group, Children’s Health Defense, which regularly sues the agencies he’d oversee as HHS Secretary, and a number of law firms with ongoing health-related matters. Mr. Kennedy has agreed to not work on his former clients’ matters for one year. However, the senators are concerned that the cooling-off period is too short to resolve the concern that he would not be impartial when handling matters involving former clients with whom he still has fresh relationships. To address such concerns, over a dozen Biden appointees voluntarily agreed to recuse themselves from former clients’ matters for four years. 

    Mr. Kennedy also said he would continue to hold investments in a fund invested in multiple companies regulated by HHS, and that he would seek a waiver to work on matters that impact those investments. 

    “You appear to be planning to make decisions that can impact your own investments in numerous health companies. We urge you to either divest these holdings before taking office or to recuse from all particular matters that could impact those holdings,” wrote the lawmakers

    During his hearing, Mr. Kennedy committed to not working for a drug company for at least four years after leaving government service. However, he did not commit to not seeking compensation from entities that sue drug companies or that he would regulate or interact with at HHS. Numerous Biden appointees agreed to a cooling-off period of at least four years before working in the industries they regulated. 

    “You should commit to not lobbying HHS for at least four years after leaving office, either as a formal registered lobbyist or informal shadow lobbyist — given that former high-level officials can leverage their influence not only by directly lobbying but through facilitating others to do so,” concluded the lawmakers

    The senators asked Mr. Kennedy to make these commitments to increase American’s trust in his ability to serve the public interest during his time at HHS.

  • MIL-OSI Canada: Province opens first eating disorders recovery centre

    Alberta’s government is making record investments in mental health and addiction services to support Albertans of all ages in their pursuit of wellness and recovery. Through the Alberta Recovery Model and Recovery Alberta, the province has increased opportunities for recovery of eating disorders. Every aspect of a person’s life can be affected by eating disorders, including both mental and physical health, especially for teenagers who are still in development.

    The EHN Sandstone Recovery Centre is the result of a collaborative partnership between Alberta’s government, Recovery Alberta, Silver Linings Foundation and Edgewood Health Network (EHN Canada).

    With an investment of almost $10 million over three years (2023-26) in partnership with Recovery Alberta to establish the EHN Sandstone Recovery Centre in Calgary, Alberta’s government remains committed to supporting this important recovery program for young Albertans. The Silver Linings Foundation raised $4 million in capital funding for this facility.

    “This is another important step in creating strong, recovery-oriented systems of care in communities across Alberta. Eating disorders can often be misunderstood and can go unrecognized or underdiagnosed. With the opening of this centre, young Albertans can now get the care they deserve and have better access to intensive treatment to better support them in their recovery.”

    Operated by EHN Canada, the 12-bed EHN Sandstone Recovery Centre in Calgary increases access to specialized eating disorders treatment in the province providing up to 52 youth and young adults with treatment free of charge every year.

    The EHN Sandstone Recovery Centre helps close a gap in the continuum of care for youth and young adults diagnosed with complex eating disorders. Albertans aged 12 to 24 now have access to intensive treatment in a community setting, reducing the need for long hospital stays and increasing positive health outcomes.

    The centre offers an individualized approach to care, with around-the-clock support from a multidisciplinary team of physicians, nurse practitioners, registered dietitians, nurses, counselors and support staff. Services include academic support, weekly individual and family therapy, daily group therapy, nutritional rehabilitation, structured meal support therapy, self-care and wellness activities, nutritional education, and distress tolerance skills. While treatment length varies, it generally lasts anywhere from three weeks to four months.

  • MIL-OSI Global: Fines for term-time holidays are at record levels – this will further erode trust between parents and schools

    Recently released government statistics show a record number of fines were given to parents for their children’s absence from school in 2023-24 in England. Of the 487,344 fines issued, 91% were for unauthorised family holidays.

    If these fines, known as fixed penalty notices, go unpaid or in some cases have been previously issued, parents are taken to court. In 2023-24, 28,296 parents were prosecuted over their children’s school attendance.

    Whether the fines have any effect on ensuring attendance is debatable. The figures show that thousands of parents are willing to book a term-time holiday anyway. But fines are certainly affecting the crucial relationship between schools and families.

    When I carried out my doctoral research between 2014 and 2016 on the relationships between schools and parents, these bonds were already quite fragile. People in my study argued that endless “dictats” from school built a “brick wall” rather than a partnership.

    Now, it’s likely that an increasingly strict application of attendance rules is further breaking down trust.

    Fines were first introduced by a Labour government in 2004 as a last resort to tackle truancy. In 2014, then education secretary Michael Gove widened the application of the fines. Local authorities were encouraged to use penalty notices for parents who took their children on holiday during school term time.

    Since Gove, education secretaries – including current education minister Bridget Phillipson – have insisted that every day matters in school, and that there are very few reasons to miss school. Holidays are seen as unacceptable.

    Since the pandemic, even more focus has been placed on attendance as persistent absence rates have increased.

    Government statistics show a correlation between attendance and exam results. However, whether lower attendance causes lower results is difficult to prove, especially when factors such as poverty are taken into account.

    What’s more, when holiday absence has been analysed separately, this has not been found to have the same negative affect on achievement at school as other reasons for absence.

    The record number of fines issued last year came before new guidance was set in August 2024. Now, fixed penalty notices have risen from £60 to £80 for a first offence (if paid within 21 days) and to £160 for a second offence (if paid within 28 days). If parents receive two fixed penalty notices within three years, the next offence will result in prosecution. However, councils may choose prosecution earlier if they wish.

    Whereas previously there was more discretion and variance between authorities and schools, all headteachers must now consider the above approach if a child misses more than five days of school. It can only be assumed that the number of fines and prosecutions will increase.

    As a side-effect, we are seeing schools encouraged to clamp down on child illness for fear that parents are lying and are in fact on holiday. While government guidance says that in most cases a parent’s word should be enough evidence that their child is sick, it also states that evidence of illness should be requested in cases where there is “genuine and reasonable doubt about the authenticity of the illness”.

    This suggests that schools should be questioning their trust in their pupils’ parents. This is a fundamental break down of the school-parent relationship, not to mention a strain on NHS time.

    Why parents book term-time holidays

    Term-time holidays are often seen as a way for parents to book a cheaper break, as holidays are generally more expensive during school holidays. But, even leaving aside that many families may only be able to afford a holiday at all if it is taken in term time due to the cost of living crisis, the situation is more complicated.

    There are many reasons for taking holidays within school term time. Families might be visiting relatives overseas for a wedding, funeral or because of a family member’s terminal illness. Often, a school might grant one day of absence, but no more.

    Parents may be unable to take leave from work during school holidays as a result of the industry they work in. They may have family members who work away for long periods, and want to spend time together with the children when they return. They may have a child with particular needs who is unable to cope with busy holiday times, or children in different schools with different holiday periods.

    Relationship breakdown

    When a headteacher refuses to authorise such a holiday this leads to resentment from parents. Resentment like this may cause some to withdraw children from school and choose to home educate.

    There is some effort now for schools to offer support first before legal intervention for families who might have attendance issues for other reasons, such as emotionally based school avoidance. But there is little to no desire to work with families around their complex needs for holidays.

    Partnership with parents is often touted by schools as central to pupils’ wellbeing, progress and attainment. But the power in this partnership is often skewed towards the professionals.

    Parents and schools should work together for the good of children. This does not simply mean parents obeying schools; that is not a recipe for partnership. Instead, it means understanding the different contexts that families and teachers live and work in. If parent engagement is essential to wellbeing and school progress, it is not worth continuing down the road of alienation and punishment.

  • MIL-OSI USA: Governor Lamont Announces 2025 Legislative Proposal: Reduce Prescription Drug Costs

    (HARTFORD, CT) – Governor Ned Lamont today announced that the package of legislative proposals he is presenting to the Connecticut General Assembly for consideration this session includes comprehensive reforms to improve healthcare affordability and mitigate out-of-pocket costs for patients, particularly those related to prescription drugs.

    “Families across America are simply paying too much for essential prescription drugs, and these rising costs make accessing health coverage a barrier for far too many people,” Governor Lamont said. “I am urging the state legislature to make lowering prescription drug costs a priority this session. The proposals I’ve presented to them contain wide-ranging steps to lower prescription drug costs and put limits on future price increases.”

    Recently, through an initiative launched between the Lamont administration and Comptroller Sean Scanlon, Connecticut joined the ArrayRx prescription drug discount card program, which enables all residents in Connecticut to receive a discount card at no cost that gives them discounts at the pharmacy on certain medications. Working in collaboration with Comptroller Scanlon, Governor Lamont is proposing to expand the use of this card in Connecticut, enabling consumers to receive credit for “cash” prescription drug purchases toward their annual deductible if they paid a lower price than they would have under their insurance coverage.

    “Skyrocketing drug prices are forcing too many people into impossible choices, like skipping doses or cutting pills in half,” Comptroller Scanlon said. “That’s just wrong, and it must end. If drug makers and pharmacy benefit managers won’t lower prices for the people of our state, we will. I am proud to be working with Governor Lamont on innovative solutions that will rein in costs and improve healthcare affordability in Connecticut.”

    “It’s nearly impossible for someone to follow their healthcare provider’s treatment plan if they can’t afford the out-of-pocket cost for the prescriptions they need,” Dr. Deidre Gifford, commissioner of the Connecticut Office of Health Strategy and Governor Lamont’s senior advisor for health and human services, said. “This proposal focuses on making prescription drugs more affordable for Connecticut residents.  It’s good healthcare and it’s good public policy.

    Governor Lamont’s proposal, House Bill 6870 (An Act Addressing Patients’ Prescription Drug Costs), contains the following actions:

    • Permits patients to claim low-cost drug purchases toward deductibles: Establishes a patient’s right to receive credit for out-of-pocket and out-of-network prescription drug expenses toward their annual deductible if they paid a lower price than they would have at an in-network pharmacy with insurance.
    • Limits annual generic drug price increases to inflation: Limits price increases for generic and off-patent drugs to the annual rate of inflation and authorizing the Connecticut Department of Revenue Services to levy a civil penalty on manufacturers that raise prices above that threshold. By focusing on generic drugs and those that drugs that are coming off patent, Connecticut can respect and encourage innovation yet help clamp down on unfair price spikes for many commonly used drugs.
    • Establishes a pathway for safe Canadian prescription drug importation: Requires the Connecticut Department of Consumer Protection to assess feasibility of establishing a Canadian prescription drug importation program within Connecticut after reviewing quality, safety, and operational needs.

  • MIL-OSI USA: ‘Egg-sasperated’ Reed Seeks Answers from USDA Nominee on Plan to Lower Egg Prices

    WASHINGTON, DC — Why did the Senator cross the road?  To help drive down ‘eggflation.’

    U.S. Senator Jack Reed (D-RI) is urging President Donald Trump – who pledged to “immediately bring prices down, starting on day one” — to finally take action to help reduce egg prices and crack down on anti-competitive price gouging.

    Today, Reed sent a letter to the president and CEO of the America First Policy Institute, Brooke Rollins, who President Trump nominated to lead the U.S. Department of Agriculture (USDA), asking for her plan to help lower egg prices. 

    Reed says Trump is causing consumers to shell out more for eggs: In the weeks since Trump took office for his second term, wholesale prices for a dozen Grade A large white eggs in cartons already increased about 15 percent and the Trump Administration has taken zero substantive steps to address the situation.  In fact, Trump’s initial moves in office, such as blocking the U.S. Centers for Disease Control and Prevention (CDC) and other federal health agencies from publishing scientific reports on the bird flu or issuing health advisories, or his decision to withdraw from the World Health Organization (WHO), which coordinates global efforts to combat disease outbreaks, may be contributing to the problem and increasing the likelihood of future avian flu cases. 

    This week, Rhode Island consumers are being charged anywhere from $4.55 a dozen to $6.99 a dozen for large eggs at local chain retailers and some restaurants have instituted a 50-cent surcharge per egg on all menu items. 

    “In order to combat these price spikes, we must have a strong response from the USDA to get avian influenza under control.  In addition, the USDA, in conjunction with other federal agencies, including the Federal Trade Commission and the Department of Justice, must carefully police the market and crack down on any price gouging by large egg producers, who in the past have demonstrated a propensity to hike prices on consumers to levels that far exceed any increase in the cost of production,” Reed wrote the USDA nominee.

    Reed noted that during her hearing, Ms. Rollins “did not provide a comprehensive plan, and instead stated “there is a lot that I have to learn” about avian influenza and animal disease.”

    His letter concluded: “As Agriculture Secretary, you would be tasked with spearheading and implementing the Trump Administration’s plan to combat this costly disease in our nation’s animals.  I understand that it may be difficult to outline a comprehensive plan during the time allotted in a confirmation hearing.  To that end, I would like to provide you the opportunity to outline your plan in writing to address avian influenza and bring egg prices down for Americans across the country.

    “To allow me to fully evaluate your nomination, I ask that you respond promptly before your final confirmation vote.” 

    Reed says he hopes to be able to share the plan with other U.S. Senators on both sides of the aisle to help inform their votes.

    As the full Senate prepares to consider your nomination for Secretary of Agriculture, I write to inquire about your plan to address the ongoing H5N1 avian influenza (“bird flu”) outbreak, which is contributing to high egg prices for consumers across the country.  I am well aware that avian influenza has been a problem for multiple administrations – including the Obama Administration, the first Trump Administration, and the Biden Administration.  Regardless, I am interested to hear how you, if confirmed, plan to end the current outbreak and lower prices.

    In your written testimony for your January 23rd nomination hearing, you shared that one of your “key priorities for Day One,” if confirmed as Secretary would be to “immediately and comprehensively get a handle on the state of animal-disease outbreaks, including H5N1.”  However, when asked for your plan to address this issue by Ranking Member Amy Klobuchar, you did not provide a comprehensive plan, and instead stated “there is a lot that I have to learn” about avian influenza and animal disease.

    As Agriculture Secretary, you would be tasked with spearheading and implementing the Trump Administration’s plan to combat this costly disease in our nation’s animals.  I understand that it may be difficult to outline a comprehensive plan during the time allotted in a confirmation hearing.  To that end, I would like to provide you the opportunity to outline your plan in writing to address avian influenza and bring egg prices down for Americans across the country.

  • MIL-OSI Global: Anti-LGBTQ+ policies harm the health of not only LGBTQ+ people, but all Americans

    In 2024, state legislatures introduced an all-time record of 533 bills targeting LGBTQ+ populations. These policies create a patchwork of legal landscapes that vary widely between and within states, affecting aspects of everyday life ranging from how kids learn and play to where adults live and work.

    All of these policies have implications for the health of not only LGBTQ+ people but also the general public.

    I am a health policy researcher who studies how state and federal legislation affect public health. Research has shown that the social determinants of health – the opportunities and resources that affect how people live, learn, play, work and age – play a significant role in LGBTQ+ well-being. Newly published work from my colleagues and I show how anti-LGBTQ+ public policies can have lasting effects on everyone’s health.

    Existing policies and LGBTQ+ health

    Same-sex marriage provides a clear example of the direct and indirect ways public policies affect LGBTQ+ health.

    Most people in the U.S. have health insurance through their employer, which usually offers coverage for employees and their family, including a spouse and children. A landmark 2015 study found that health coverage significantly increased for adults in same-sex marriages after its legalization in New York state. After same-sex marriage was legalized nationwide, a follow-up study also showed an increase in health insurance coverage among gay and lesbian couples.

    Even among single LGBTQ+ people who did not get married, same-sex marriage may have also improved their health by improving social attitudes toward LGBTQ+ people overall. Researchers found that gay and bisexual men, regardless of whether they were single or married, spent less on medical visits, mental health visits and overall health care spending after Massachusetts legalized same-sex marriage in 2004.

    Access to gender-affirming care provides another example of how public policies affect the health of LGBTQ+ people.

    A 2020 national study of nearly 30,000 transgender and nonbinary people found that suicide attempts and mental health hospitalizations declined in states that passed policies requiring private insurers to equally cover services they already provide for cisgender people for transgender people. No other studies directly analyze how policies regulating access to care affect the health of trans and nonbinary people.

    However, a large body of clinical research supports the health benefits of gender-affirming care. A randomized clinical trial and prospective study found that starting gender-affirming hormone therapy reduced depression and suicidality in transgender and nonbinary people. Several recent systematic reviews analyzing 124 peer-reviewed studies conducted over the past 50 years also found that gender-affirming surgery and hormone therapy improved quality of life and mental health.

    Policies outside health affect LGBTQ+ well-being

    Policies outside of health care – such as nondiscrimination, education and workplace protections – also affect LGBTQ+ well-being.

    For example, transgender and nonbinary people living in states with policies that specifically include gender identity in hate crime and discrimination protections reported better mental health than those in states without protections. Similarly, LGBTQ+ students in schools with designated safe spaces reported lower rates of suicidal thoughts.

    However, the surge in anti-LGBTQ+ policies in the U.S., initially focusing on youth, has significantly increased polarization between and within states. For example, while 17 states have implemented guidances to make schools safer and more inclusive for transgender youth, 25 states have banned transgender youth from using bathrooms and playing on sports teams that align with their gender. Meanwhile, South Dakota and Missouri have enacted laws to preempt progressive schools and districts from adding LGBTQ+ student protections and supportive resources.

    The Trump administration is also actively targeting resources that support LGBTQ+ students by reducing funding to schools that offer these programs.

    In 2020, the Supreme Court ruled 6-3 in Bostock v. Clayton County that federal sex-based nondiscrimination protections in the workplace included discrimination based on gender identity and sexual orientation. Researchers found that LGBTQ+ older adults with co-workers supportive of their gender and sexuality experienced less workplace conflict and cognitive health problems compared with those who did not.

    The Trump administration is working to restrict the scope of federal antidiscrimination protections to exclude LGBTQ+ people.

    Harms of emerging anti-LGBTQ policies

    Emerging anti-LGBTQ+ policies could also have consequences for large swaths of the population beyond LGBTQ+ people.

    In 2025, the Supreme Court will hear Braidwood v. Becerra, a case arguing that requiring employers to cover PrEP – a once-a-day pill that is highly effective at preventing HIV infection – as part of the insurance plan they offer employees violates their religious freedom. Texas District Judge Reed O’Connor agreed that mandating PrEP coverage requires the plaintiffs to “facilitate and encourage homosexual behavior.”

    O’Connor ruled in 2023 to overturn the Affordable Care Act’s requirement that insurers fully cover preventive care. He argues this can be done on the grounds that the U.S. Preventive Services Task Force – a group of physicians and researchers that evaluates the quality and efficacy of preventive services – is unconstitutional. This legal challenge puts free coverage of mammograms, vaccinations and other preventive services into limbo for millions of Americans.

    The Trump administration has taken down CDC pages providing information about HIV.

    The Trump administration has scrubbed federal web pages of resources, programs and documents that reference gender and LGBTQ+ people. This order includes removing datasets that have been continuously updated since the 1980s to track public health issues such as homelessness, bullying in schools, and smoking and drinking, likely because they include LGBTQ+ demographic information.

    The administration has also ordered federal health agencies to retract scientific research that may be inclusive of LGBTQ+ people by searching for specific keywords, such as “gender.” The National Science Foundation is also screening active scientific research projects that use words like “women,” “trauma” and “disability.” Removing this data not only hamstrings public health research and programming for LGBTQ+ populations, but also restricts it for all Americans.

    These decisions are in stark contrast to countries such as England, Wales, New Zealand and Australia, which have collected or are planning to collect LGBTQ+ demographic data as part of their national census. Including LGBTQ+ people in demographic data reflects best practices that were outlined in the Federal Evidence Agenda on LGBTQI+ Equity issued under the Biden administration. These guidelines have since been removed.

    Far-reaching consequences

    The rapid escalation of anti-LGBTQ+ policies in recent years is already taking its toll on youth, with negative news coverage of LGBTQ+ issues causing spikes in suicidal thoughts.

    These policies also have far-reaching consequences for the broader public. Rigorous and long-standing research demonstrates that LGBTQ+-inclusive policies support safer communities and stronger economies for everyone, while exclusionary laws worsen and limit access to essential services.

    Ongoing legal battles and policy shifts will shape the future of LGBTQ+ rights, with rippling effects on public health, workplace protections and health care access for all Americans.
