    In addition to delivering letters and parcels, Department of Posts is now ensuring that various government welfare schemes and their benefits reach to all citizens. Department of Posts has access to last mile of the country and is equally involved in the joys and sorrows of the people. Postmaster General, North Gujarat Region, Shri Krishna Kumar Yadav, expressed these views during his visit to the Mahesana Head Post Office on 20th sepetember 2024. Under the campaign ‘Ek Ped Maa ke Naam’, tree plantation was conducted at the Mahesana Head Post Office to spread the message of environmental protection. Superintendent of Post Offices, Mahesana Division Shri H.C. Parmar welcomed the Postmaster General and provided detailed information about the progress of postal services in Mahesana.”

    Postmaster General Shri Krishna Kumar Yadav delivered a cheque for ₹10 lakh as a claim payment to the family of Shri Babubhai Rabari from Mahesana, who had taken the Tata Group’s accident insurance policy for just ₹399 through India Post Payments Bank, after his untimely death.

    Postmaster General Shri Krishna Kumar Yadav added that the Department of Posts is also playing a vital role in the PM Vishwakarma Scheme. Under this scheme, toolkits are being provided to artisans/beneficiaries through the Department of Posts. Department of Posts led by distributing the first toolkit in the country to Shri Rameshbhai Babubhai Senma, a resident of Jagannathpura village in the Mahesana Postal Division, North Gujarat Region.

    Shri Krishna Kumar Yadav told that the PM Vishwakarma Scheme has been launched by the Ministry of Micro, Small, and Medium Enterprises (M/o MSME) for the upliftment of traditional artisans and craftsmen engaged in various trades like blacksmithing, goldsmithing, pottery, carpentry, and sculpting, among others. The aim is to preserve cultural heritage and integrate these artisans into the formal economy and global value chains. The scheme is being implemented through the National Small Industries Corporation (NSIC). Toolkits for 18 identified trades under this scheme will be distributed to artisans/beneficiaries through post offices. The Department of Posts is the logistics partner for the Ministry of MSME in this scheme and will ensure the smooth transportation and delivery of toolkits to beneficiaries across the country.

    Postmaster General Shri Krishna Kumar Yadav conducted a detailed review of the progress of postal services in the Mahesana Division. Currently, there are a total of 6.77 lakhs savings accounts, 79,000 IPPB accounts, 66,000 Sukanya Samriddhi accounts, and 4,000 Mahila Samman Savings Certificates opened in Mahesana Division. Additionally, 61 villages have been covered as ‘Sampoorna Sukanya Samriddhi Grams,’ 100 villages covered as Sampoorna Bima Grams,’ and 5 villages designated as Five-Star Villages. Through the Passport Seva Kendra at the Mahesana Head Post Office, more than 7,015 people have obtained passports in this financial year. 14,000 people have enrolled or updated their Aadhaar through the post office, while 70,000 people have benefited from CELC through India Post Payments Bank. More than 69,000 individuals received payments totaling ₹22.4 crore through the Aadhaar Enabled Payment System at door step.

    During his visit to the Mahesana Head Post Office, Shri Krishna Kumar Yadav emphasized the importance of good behavior towards customers. Postmaster General emphasized the importance of conducting extensive campaigns and Dak Chaupals in the remaining days of the financial year to achieve the allocated targets for various services. He also highlighted the need to connect the citizens with these services, ensure prompt resolution of public grievances, and responsiveness towards customers.

    During this visit, Superintendent of Post Offices Shri H.C. Parmar, Assistant Superintendent Shri R.M. Rabari, Shri N.K. Parmar, Shri Vishal Brahmbhatt, IPPB Branch manager Shri J. Rohit and Postmaster, Mahesana HO Shri D G Patel were present.

  • MIL-OSI USA: Booker, Grijalva Introduce Bill to Permanently Protect American Bison, Grizzly Bears, and Gray Wolves

    WASHINGTON, D.C. –  Today, U.S. Senator Cory Booker (D-NJ) and U.S. Representative Raúl M. Grijalva (D-AZ-07) introduced the Tribal Heritage and American Bison, Grizzly Bear, and Wolf Restoration and Coexistence Act, legislation to establish permanent federal protections for these three species and expand recovery efforts and coexistence measures. Additionally, the bill would enhance existing tribal management authorities over these species by creating oversight committees that work in unison with Indian Tribes to identify tribal lands suitable for possible reintroduction efforts. 

    “American bison, grizzly bears, and gray wolves are iconic American species and are timeless symbols of our nation’s heritage, yet these animals were driven to the brink of extinction,” said Senator Booker. “Building on the success of past conservation legislation like the American Bald and Golden Eagle Protection Act and the Marine Mammal Protection Act, I am proud to introduce legislation that directs the Secretary of the Interior to works closely with Indigenous communities to ensure permanent protection for these animals.”

    “Bison, grizzly bears, and wolves hold significant spiritual, cultural, and ecological value to many tribal communities and our nation,” said House Natural Resources Committee Ranking Member Raúl M. Grijalva. “I’m proud to introduce this legislation with Senator Booker to enshrine protections for these species and ensure that conservation and management are conducted in close consultation with Tribal Nations. For centuries, the United States’ policies have systematically failed to honor our treaties, harming Tribal Nations and resulting in significant cultural losses and ecological damage. Congress has a trust responsibility to move forward from past injustices and craft policies for the future that are based on respect and recognition of Tribal Nations’ leadership in recovering these iconic species and their habitats.”

    American bison, grizzly bears, and gray wolves hold important cultural significance to the Indigenous peoples of North America. Despite their important ecological roles and cultural symbolism, during the 19th and 20th century each of these species were hunted to the point of eradication from most of their historic range throughout the continental United States. The elimination of these animals from their traditional ranges has dramatically compromised the integrity of their former ecosystems. Continuing to reestablish their presence – and prohibiting future eradication efforts – will restore the health of these ecosystems. 

    As seen with the 1995 reintroduction of gray wolves in Yellowstone National Park, reestablishing keystone species in their former ranges can have significant benefits to the ecosystem. The 1995 introduction rebalanced elk and deer populations, allowing vegetation to flourish in response to reduced herbivore grazing pressure. This landmark conservation effort helped re-stabilize the Yellowstone ecosystem, while creating an immense boom in ecotourism revenue that now generates an annual average of over $80 million for local economies in the Greater Yellowstone region. Grizzly bears play a similar role by regulating prey populations and preventing overgrazing, while bison grazing and foraging aid in plant growth and increase biodiversity by aerating soil and dispersing native seeds. These are just a few examples that demonstrate the positive impacts that bison, grizzly bears, and wolves have on North American ecosystems.

    Specifically, the Tribal Heritage and American Bison, Grizzly Bear, and Wolf Restoration and Coexistence Act would:

    1.       Prohibit the take, possession, purchase, sale, or transport of American bison, grizzly bears, and wolves, exclusive of captive-bred bison intended for human consumption, with targeted exceptions authorizing the Secretary of the Interior to issue permits for scientific or conservation purposes and for protection of agricultural interests and public safety. 

    2.       Exempt religious, cultural or treaty-reserved purposes of Federally recognized Indian Tribes.

    3.       Provide for civil and criminal penalties for violations.

    4.       Require consultation with federally recognized Indian Tribes before a take permit is issued under this Act or before any activity is carried out on the Tribal land of a federally recognized Indian Tribe that may negatively impact habitat or increase mortality of bison, grizzly bears or wolves.

    5.       Authorize federally recognized Indian Tribes, in consultation with the Secretary, to manage bison, grizzly bears and wolves reintroduced on Tribal land.

    “In the gulf coast of Texas remains a species of wolf called “The Ghost” wolf for its elusive nature and ability to ‘come back from the dead’. After generations of persecution, encroachment, and habitat loss, the Red Wolf was thought to be extinct, but that wasn’t the case. This story is much like the story of my people, the Karankawa. By hiding in plain sight, mixing and adapting to our ever-changing environment, both of us are still here. If only there had been a system in place like this legislation proposes today; that defends and protects, under the wings of their original stewards, our relatives who defend biodiversity, health, culture, and the climate,” said Chiara Beaumont, Karankawa.

    “Indigenous peoples, like our relatives the Buffalo, Grizzly and Wolves have distinct cosmology with our natural world.  We have inhabited our natural world prior to colonization, dating back to our creation stories. “Comes Holy” a white buffalo was born June 4, 2024 and fulfills a prophecy that teaches our human relatives that spiritual unity is of essence to our survival.  Indigenous people speak on behalf of those who cannot – the Buffalo, Grizzlies and Wolves,” said Vivian Delgado, Yaqui.

    “We must protect and speak for our sacred relatives because they can’t speak for themselves.  For they maintain an ecological balance that is imperative for our survival, knowledge and growth.  Just like we seek guidance from our elders, we are also guided by our relatives of the Wolf Nation. By protecting and restoring our bond with our relatives we receive their teachings and many blessings.  Through this we can begin to heal our relationship with ourselves, others and Mother Earth,” said Osvaldo Cabral, Huichol.

    “This legislation reverses the current doom narrative, instead asks, “What do we stand to gain and how fast.” This fresh novel inquiry is the best approach to wildlife coexistence, reversing climate warming, stemming biodiversity loss and move humans to right relationship with the natural world. This legislative framework utilizes, to the fullest, traditional ecological knowledge together with western science in tribal Co-stewardship decision-making collaboratives for conservation, restoration and protection of our 4-leg relatives, their habitat and their natural active role in maintaining overall ecological health,” said Dallas Gudgell, Yankton Dakota.

    “Our relatives within the Greater Yellowstone Ecosystem and the nation, from all walks of life, whether they are keystone species, like buffalo or an apex predator, deserve to be protected from corporate interests and settler-colonial practices that put private interests above the American public and the original occupants of the land,”said Devin Oldman, Arapaho.

    “All these species are important and it is that, also, we need their “spirit” in our world to live as the Creator wants us to,” said Allen Pinkham, Nez Perce.

    “In 2021 President Joe Biden issued an executive order that elevated Indigenous Traditional Ecological Knowledge and ancestral wisdom into federal policy decisions. “Indigenous Knowledge cannot be separated from the people inextricably connected to that knowledge,” the order states. “It applies to phenomena across biological, physical, social, cultural, and spiritual systems.” Indigenous Peoples worldwide “manage over 24% of land, which contains about 40% of all ecologically intact landscapes and protected areas left on the planet, and a staggering 80% of the world’s biodiversity.” Now is the time for Native people to share stories about the wolves, bison and Grizzley bears that would receive lasting protections under this senate bill, which began in 2019 with House Bill 2532, originally co-sponsored by Representative Deb Haaland, who is now by the first Native director of the Department of the Interior,” said Tony Evans, Mohawk. 

    “The relationship between Indigenous peoples and animals like wolves, grizzly bears, and buffalo is deeply rooted in spiritual, cultural, and ecological significance. These animals are not just seen as wildlife but as relatives and integral parts of the natural world, embodying lessons, symbols, and connections that are vital to the balance of life. The protection of wolves, grizzly bears, and buffalo is not only about preserving species but also about maintaining the natural order and the sacred bonds that sustain life. In this way, the relationship with these animals is a profound reminder of the responsibilities humans have to the Earth and all living beings. The respect and reverence for these animals are central to Indigenous teachings, which stress that all life is interconnected, and the well-being of one species affects the well-being of all.”said Red Fawn Janis, Iglala Lakota.

    “The wolf, who is named Ma’iingan by the Anishinaabe people of the Great Lakes, carries core cultural teachings that are necessary for us to understand how to live in accordance with our instructions as responsible and moral beings. The unanimous rejection of a recreational wolf hunt by every Federally recognized tribe in Michigan  underscores how integral the living presence of Ma’iingan is to our continued existence as Anishinaabek. From the beginning, our fates have run parallel, and it is deeply necessary that we continue to reside on these lands together with Ma’iingan. Kchi miigwech, much gratitude, to Senator Booker for his leadership and rational insistence that our relationship with the natural world is foundationally important,” said Dr. Nichole Keway Biber, Little Traverse Bay Bands of Odawa Indians.

  • MIL-OSI USA: Unregistered Municipal Advisory Activity in Public-Private Partnerships

    Good afternoon everyone. I want to thank The Bond Buyer for organizing this Infrastructure Conference and for inviting me today to talk about some important regulatory safeguards that were put in place a decade ago to help state and local governments make effective infrastructure investments.

    But before I begin, I must remind you that my remarks are in my official capacity as Director of the Securities and Exchange Commission’s Office of Municipal Securities, but do not necessarily reflect the views of the Commission, the Commissioners, or other members of the staff.

    These types of events give me a unique opportunity to speak directly to the municipal securities market about an issue that has framed my tenure with the Commission, first as a staff attorney serving as a principal drafter of the municipal advisor rules and now as the Director of the Office charged with overseeing municipal advisor regulation, namely unregistered entities engaging in municipal advisory activity.[1]

    Filling a Gap in the Regulatory Landscape

    To begin, I thought I would spend a few moments laying out the municipal advisor regulatory framework.

    Until the passage of the Dodd-Frank Wall Street Reform and Consumer Protection Act (“Dodd-Frank Act” or “Dodd-Frank”), advisors[2] to municipal entities[3] and obligated persons[4] were largely unregulated and were generally not required to register with the Commission or any other federal, state, or self-regulatory entity with respect to their municipal advisory activity.[5]

    Leaving the activities of these advisors generally unchecked, however, led to several cases of market abuses and economic damage to municipal entities and obligated persons.[6] For instance:

    • Congress found that a number of municipalities suffered losses from complex derivatives products that were marketed by unregulated financial intermediaries;[7]
    • The Commission brought action against a financial institution alleging payments by the financial institution to local firms whose principals or employees were friends of public officials in connection with a bond underwriting and interest rate swap agreement;[8] and
    • The Commission settled several actions against major financial institutions for their role in a series of complex, wide-ranging bid rigging schemes involving derivatives utilized by municipalities and underlying obligors as reinvestment products.[9]

    Dodd-Frank was enacted to generally strengthen oversight of the municipal securities market and to broaden current municipal securities market protections to cover, among other things, previously unregulated market activity.[10] Section 975 amended Section 15B of the Securities Exchange Act of 1934 (“Exchange Act”) creating a new class of regulated person required to register with the Commission: municipal advisors.[11] 

    Who Are Municipal Advisors?

    So, who are municipal advisors? Broadly speaking, municipal advisors assist municipal entities and obligated persons on the terms of bond offerings, investment of bond proceeds, and the structuring and pricing of related products.

    A “municipal advisor” is any person (who is not a municipal entity or an employee of a municipal entity) that:

    provides advice to or on behalf of a municipal entity or obligated person with respect to municipal financial products or the issuance of municipal securities, including advice with respect to the structure, timing, terms, and other similar matters concerning such financial products or issues; or undertakes a solicitation of a municipal entity or obligated person.[12]

    Key here is advice. As you may suspect, “advice” is not subject to a bright-line definition.[13] Instead, the determination of whether a person provides advice to, or on behalf of, a municipal entity or an obligated person regarding municipal advisory activity will depend on all the relevant facts and circumstances.[14] For purposes of the municipal advisor definition, advice includes, without limitation, recommendations that are particularized to the specific needs, objectives, or circumstances of a municipal entity or obligated person with respect to municipal financial products or the issuance of municipal securities, based on all the facts and circumstances.[15] Advice excludes, among other things, the provision of general information that does not involve a recommendation regarding municipal financial products or the issuance of municipal securities.[16]

    The focus of the advice standard is whether or not, under all of the relevant facts and circumstances, the information presented to a municipal entity or obligated person is sufficiently limited so that it does not involve a recommendation that constitutes advice.[17]

    The Exchange Act provides that municipal advisors and any person associated with such municipal advisor has a fiduciary duty to their municipal entity clients, prohibiting municipal advisors from engaging in any act, practice, or course of business that is not consistent with their fiduciary duty.[18] Although the Exchange Act does not provide that municipal advisors are deemed to have a fiduciary duty insofar as their advice is to non-municipal entity obligated person clients, some state fiduciary or agency laws may, depending on the facts and circumstances, apply to municipal advisor engagements with such obligated persons.[19] Municipal advisors do have other obligations to obligated person clients, such as a duty of fair dealing and a duty of care under current Municipal Securities Rulemaking Board (“MSRB”) rules.[20]

    Now that I have laid out the regulatory framework, I want to summarize the key takeaways:

    First, the Commission applies the term “municipal advisory activities”[21] to a range of activities, including, but not limited to developing financing plans, assisting in evaluating different financing options and structures, and evaluating and negotiating terms.[22]

    Second, advice is not subject to a bright-line definition. Advice includes a recommendation regarding municipal financial products or the issuance of municipal securities. The determination of whether a recommendation has been made is an objective inquiry and a key factor that the Commission will consider is whether the recommendation reasonably would be viewed as a suggestion to take action or refrain from taking action.[23]

    Third, any person engaging in municipal advisory activity will be considered a municipal advisor and have a fiduciary duty to their municipal entity client, unless an exclusion or exemption applies.

    Finally, under federal securities law, a person must register with the Commission and the MSRB prior to engaging in municipal advisory activities. Any person that engages in municipal advisory activity prior to registering with the Commission and the MSRB as a municipal advisor violates Section 15B(a)(1)(B) of the Exchange Act.[24]

    Observations on Public-Private Partnerships

    The roughly $4 trillion[25] municipal securities market provides critical support to our nation’s infrastructure. The funds raised by our states and local governments in the municipal securities market have helped remove lead from water pipes; built roads and bridges; modernized hospitals; built clean-energy infrastructure, and so much more to ensure that we have the infrastructure needed to access critical services. But for decades now, observers have noted that tight fiscal conditions and rising costs associated with maintaining and building infrastructure have prevented our states and local governments from investing in infrastructure at the levels needed.[26]

    Recently enacted legislation has made funding and incentives available for a broad range of infrastructure development[27] and may also serve as a potential catalyst for the private sector to help in closing infrastructure gaps, including through public-private partnerships (“P3”).[28]

    As everyone in the room is aware, leveraging private capital to finance public infrastructure is not a new tool. Much of our nation’s early infrastructure was built through partnerships between the public and private sectors.[29] More recently, P3s have been used as a delivery option for complex highway projects throughout the nation[30] and have been presented as a tool to finance projects in other sectors, such as energy infrastructure, affordable housing, school facilities, and telecom.[31]

    Despite their widespread use, there is no universally accepted definition of a P3.[32] P3s are broadly described as any contractual agreement between a public entity and a private entity for the purpose of financing, constructing, operating, managing, and/or maintaining a public asset and related services.[33]

    Let’s break that down a bit: P3s are long-term contractual arrangements between a public entity and private entity, where the private entity makes a financing commitment expecting to be repaid with future tax revenue or user fees or similar arrangement. The private entity signing and managing the P3 contract is typically a special purpose vehicle (SPV) created for the purpose of the P3 project and having equity investors.[34]

    Pretty straightforward: instead of using public resources that may be limited by budget or debt restrictions, private financing steps in as an alternative to building much needed infrastructure, potentially using the same taxes and fees that the municipal entity or obligated person would have used to finance the project if it had decided to finance on its own.

    Well, there is more to the story. Definitionally, P3s exist on a spectrum as an alternative form of procurement[35] but also on a spectrum as an alternative form of financing. Financing packages come in all types of configurations: equity, debt, or a combination sourced from both public and private sources, including private activity bonds (“PABs”), federal credit assistance, state, or local funding, which may include the issuance of municipal securities.[36]

    Compared to more traditional financings of infrastructure – that is, using federal, state, or local funding, which more likely than not includes the issuance of municipal securities – P3s and other non-traditional methodologies that have been developed to deliver and finance infrastructure needs are a bit more complex.

    This complexity has brought with it a range of concerns regarding the use of P3s. Public officials and state and local inspector generals and auditors have studied individual transactions and have issued findings identifying key areas of concern. These concerns include transferring too little or too much risk between the public and private sectors; not using the most efficient and lowest cost financing available to the municipal entity or obligated person; and having very costly long-term impacts to fix short-term budgetary issues.

    Public entities have also been exposed to all sorts of contingent liabilities, including compensation clauses, non-compete clauses, and availability payment escalation clauses, leading to potential increased financial and political burdens on the public entity. Uncontrollable external events, oftentimes impacting anticipated revenues, have seen public entities having to make the choice to either terminate, suspend, or take full control over a project, even though the risk of such events was supposed to be borne by other parties.[38]

    Pathways to Public-Private Partnerships

    In light of these potential hurdles, how does a municipal entity or obligated person go about deciding to finance an infrastructure project using a non-traditional form of procurement?

    One way would be for municipal entities and obligated persons to rely on individuals and firms – advisors, consultants, banks, engineers, accounting firms, developers, real estate managers, investment specialists, diversified financial services groups – collectively, what I will be referring to as “P3 Consultants” that have positioned themselves as financial, legal, and technical experts on P3s. Individual or groups of P3 Consultants are purportedly capable of providing tailored advice to municipal entities and obligated persons on the entire P3 lifecycle. However, various reports[39] have identified that P3 Consultants have engaged in concerning behavior, including:

    • Failure by P3 Consultants to disclose conflicts of interest between the P3 Consultant and subcontractors hired to provide a VfM analysis, leading to the skewing of project costs in favor of a P3 procurement.
    • P3 Consultants with no experience in municipal financing, failing to include a public sector comparator as part of the VfM analysis and resultingly being unable to demonstrate that the procurement would be maximizing VfM.
    • P3 Consultants advising municipal entities or obligated persons that P3s that only used private debt and equity funding sources would be considered an “off-balance sheet” financing, despite the fact that projects procured with a mix of public and private funding sources would, under accounting standards be required to be includable on the municipal entities balance sheet.[40]

    Soliciting a P3 Consultant

    In staff’s review of P3s in the municipal securities market, one of the first questions that we asked ourselves is how does the process get started – how does a municipal entity or obligated person connect with a P3 Consultant and does that raise any regulatory issues?

    Municipal entities and obligated persons often solicit a P3 Consultant through a competitive request for proposal/qualification (“RFP/Q”) process, where the municipal entity or obligated person has defined the infrastructure project scope; completed a preliminary VfM, or other process, which compares[41] the costs and benefits of a P3 or other non-traditional procurement method against a traditional procurement method; defined requirements related to construction, operation, and management of the project; and assessed potential financing arrangements. But P3 Consultants may also approach the municipal entity (or obligated person) through an Unsolicited Proposal (“USP”) process.[42]

    So, how does the RFP/Q process tie back to our municipal advisor regulatory framework?

    Well, responses to requests for RFP/Qs alone do not constitute municipal advisory activity.[43] Persons providing a response in writing or orally to a RFP/Q from a municipal entity or obligated person for services in connection with a municipal financial product or the issuance of municipal securities is exempt from the definition of municipal advisor provided that such person does not receive separate direct or indirect compensation for advice provided as part of such response.[44] However, Unsolicited Proposals that broadly seek input on any infrastructure project may not be a process that is consistent with the RFP exemption to the municipal advisor definition.[45]

    We have previously spoken about the parameters and level of formality of the RFP/Q process that would be needed to qualify for the RFP exemption.[46] Staff is of the view that the USP process would need to meet the same standards to qualify any responses for the exemption. Municipal entities, obligated persons, or registered municipal advisors acting on their behalf, should apply a similar degree of formality by identifying a particular objective for the USP process. Otherwise, any person responding to a USP would need to consider if the substance of their proposal requires registration as a municipal advisor.

    We have seen instances where P3 Consultants are originating an infrastructure project by identifying public asset gaps, proposing project design recommendations, providing project affordability analyses, and/or discussing the viability of a public infrastructure project in general terms. Without including material specifically tailored to the needs, objectives, or circumstances of the municipal entity or obligated person, this may not rise to the level of municipal advisory activity. However, some Unsolicited Proposals have included subjective qualitative and quantitative criteria specially tailored to the municipal entity or obligated person that includes descriptions of proposed business arrangements (i.e., ground lease, management agreements); market studies that support revenue assumptions and financial, economic and social benefits; advice with respect to sizing and structuring of the financing package, which may include consideration or use of municipal securities or municipal financial products; and models allocating risk transfer between the public and private entity. P3 Consultants should be aware that, depending on the facts and circumstances, such submissions could constitute municipal advisory activity.

    Regardless of whether a P3 Consultant has been retained through an RFP/Q process or through a USP process, our overarching observation has been that municipal entities and obligated persons seem to rely heavily on the content of the proposals – and the implied expertise – of the P3 Consultant.

    The Role of the P3 Consultant

    What services do P3 Consultants provide? Well, services run the whole gamut.

    We have observed instances where the P3 Consultant analyzes and makes recommendations on the most cost effective and appropriate financing package for the delivery of the project, including:

    • Considering various financing alternatives to raise the necessary capital, which may include, without limitation: federal, state, or local funding, including the use of municipal financial products or the issuance of municipal securities; equity and lender commitments; and/or special facility financing; and
    • Assisting with the sizing and structuring of the financing package, which may include consideration or use of municipal securities or municipal financial products and participating in the preparation of disclosure documents.

    P3 Consultants should be aware that considering various financing alternatives and assisting with the sizing and structuring could constitute municipal advisory activity.

    We have seen P3 Consultants be asked to independently, or in collaboration with the staff of the municipal entity or obligated person and other advisors, draft RFP/Qs for the solicitation of financial and/or technical private sector project delivery partners (“Private Sector Partners”). Assisting a municipal entity or obligated person with drafting – or simply drafting – an RFP/Q is municipal advisory activity requiring registration with the Commission, absent an available exclusion or exemption, because the P3 Consultant (or any other entity) could be providing advice with respect to the parameters of such RFP/Q which includes the issuance of municipal securities or the use of municipal financial products.[47]

    Takeaways

    The SEC’s mission is to protect investors, maintain fair, orderly, and efficient markets, and facilitate capital formation. The Office of Municipal Securities remains dedicated to providing information to the municipal securities market to help persons and entities active in the market comply with the important safeguards that were put in place after the last financial crisis by Congress. The Exchange Act makes it unlawful for any municipal advisor to provide advice to or on behalf of, or to undertake a solicitation of, a municipal entity or obligated person without registering with the Commission.[48]

    As you continue your partnerships to help meet the nation’s infrastructure needs, I would like you to remember that addressing the risks that unregistered municipal advisory activity pose to municipal entities and obligated persons is a challenge that requires a whole municipal securities market approach.

    P3 Consultants and Private Sector Partners who advise municipal entities or obligated persons on the issuance of municipal securities, the use of municipal financial products, and/or the use of debt financing alternatives that are tailored to the specific needs, objectives, or circumstances of the municipal entity during any stage of the P3 lifecycle should remember that they may be engaging in municipal advisory activity requiring registration as a municipal advisor with the Commission and the MSRB. The relevant timeline for advice to obligated persons is slightly different but still includes advice prior to the issuance of municipal securities until they are no longer outstanding.[49]

    For other market participants, engaging persons acting as unregistered municipal advisors may have far-reaching consequences for themselves and others,[50] including eroding public trust, significant financial losses and inefficiencies, and undermining the legitimacy of the P3 process.

    More information about the Commission’s regulation of municipal advisors is available at the Office of Municipal Securities website.[51] The MSRB also provides educational material on various topics related to municipal advisors at its Education Center website that may be helpful to municipal entities, obligated persons, P3 Consultants, and Private Sector Partners and any other market participant seeking additional information.[52]

    That was President Bartlet’s suggestion to Donna.
    For the entire episode, Donna had been trying to find a way to recognize her high school English teacher, Mrs. Morello—who went above and beyond for her school in Wisconsin.
    In the end, President Bartlet calls Donna into the Oval Office. Charlie has Mrs. Morello on the phone. And Donna doesn’t know what to say.
    “Tell her where you are.”
    And Donna says: “Mrs. Morello, I’m in the Oval Office with the President of the United States, and it’s because of you.”
    Now, I teach writing at a community college not too far from here—so I might be a little biased in bringing up this moment. And I want to thank Aaron and everyone who contributed to that episode for that beautiful tribute to educators everywhere.
    We just came from the Oval.
    Because even though Joe is away hosting the leaders of Australia, India, and Japan in Delaware, he wanted to make sure President Bartlet and his staff had a chance to see the Oval Office again.
    I often talk to my students about the power of good storytelling—because it can inspire and shape our world.
    When The West Wing lights up our screens, every swell of the opening theme, every fast talking, fast walking journey through seemingly endless halls—every performance—changes how we see the public servants behind these white walls, striving for a better tomorrow.

    WASHINGTON, D.C. – U.S. Senator Lisa Murkowski (R-AK), Vice Chairman of the U.S. Senate Committee on Indian Affairs, attended and spoke at a ceremony in Kake, Alaska, where the U.S. Navy formally apologized for bombarding the Alaska Native village of Kake, Alaska in 1869.
    Senator Murkowski has advocated for this formal apology for many years. She has heard directly from the leadership of the respective villages and clans about the pain and suffering that was inflicted on the Tlingit people by this bombardment and how, generations later, it continues to affect the community. This formal apology is long overdue but marks the start of healing for the community. 
    “It was incredible to be present at this ceremony to witness the United States military’s historic apology for the devastating 1869 bombardment of Kake. I have heard for many years how the people of Kake have not been able to heal from the trauma of the Navy’s attack. Families have shared the stories of the destruction, which led to deaths among children and elders. These families have had to live with that sadness and unresolved trauma for too long,” said Senator Murkowski. “One of the cultural values the people of Kake carry is spiritual and cultural balance. When trying to find that balance, apologies need to be made, to say ‘I am sorry, we failed you.’ While far overdue, it is appropriate now that our military offered this apology to the people of Kake for their loss. I commend the clan leaders in Kake for their humble acceptance of the Navy’s apology, and hope that this acknowledgment will promote healing from the intergenerational trauma caused by the United States government’s mistakes. It was my great honor to have worked alongside the community of Kake to advocate for this historic event.”

    “I was gifted the name Aan shaawátk’I. which means Lady of the Land. It is a tribute and an honor that I carry deeply with me. It is a responsibility that I have to not only the Deisheetaan, but to all of Alaska’s peoples.”
    “The blanket I wear at this moment that Dr. Worl has honored me with wearing for this time is a peace blanket.”
    “I became involved in these discussions – I heard about this story – years ago. Years ago, I’d learned there had been an effort for an apology, which had to work its way up not only through the military leadership, but then needed to be signed off by the Secretary of the Navy and by the President. And that it made its way so far up in the Clinton Administration, but was ultimately rejected. That was before I had heard of these stories, but this effort is one that should not die, that could not die, that must be remedied.”
    “I want to acknowledge Dr. Worl for not only convening so many, but [also for her] very, very direct reach out to our military leadership. It was in 2019 that she reintroduced the story to General Tom Bussiere who was head of the Alaska Command at the time. And General Bussiere said this wrong must be righted. I will work with you. But as happens, Generals come and they go. And General Bussiere worked hard but it was not accomplished.”
    “I was asked in my role as a member of the Senate Indian Affairs Committee for help from the U.S. Navy on an issue thousands of miles from here, in Nevada, where they were looking to convey property to allow for an extension of a military facility. They said what they were going to do was ensure that the Native people who had been harmed by the military’s actions would receive recognition and would receive a level, a show of apology. And I said ‘I will work with you on that issue in Nevada, but you must understand that the people of Kake have a raw and an open scar that has been left for generations. That the people of Angoon have a raw and open scar that has been left for generations. And the people of Wrangell. So, help us to ensure that these wrongs are corrected.”
    “It was humbling to be in Juneau for Celebration this year. To be part of the lengthy discussions with our military liaisons, some of whom are in this room this afternoon. And our Native leaders and elders from Kake, from Angoon, and from Wrangell, and to finally be to that point where the answer is ‘yes, an apology is necessary. Let’s talk about when.’ And now that ‘when’ is here for the people of Kake. And, so, to be able to announce at Celebration was a truly humbling moment.”

  • MIL-OSI USA: Crapo, Risch, Ricketts Introduce Bill to Protect Ag Supply Chains from China

    Washington, D.C.–U.S. Senators Mike Crapo (R-Idaho), Jim Risch (R-Idaho) and Pete Ricketts (R-Nebraska) introduced the Securing American Agriculture Act, which would protect domestic agriculture supply chains and reduce America’s reliance on foreign adversaries.
    “Close and continued oversight evaluating America’s relationship with the CCP is vital to our national security and protecting our nation’s food supply chain,” said Crapo.  “It is in our best interest to take every step toward mitigating potential threats from the CCP.” 
    “Congress can’t allow Communist China to seize control of America’s food supply chain,” said Risch.  “Idaho’s farmers and ranchers fuel our economy and feed the world. The Securing American Agriculture Act will help defend against threats to Idaho agriculture from China’s influence.”
    “The CCP is the single greatest threat to America’s national security and financial independence,” said Ricketts.  “A CCP-led world would mean coercion instead of choice, tyranny instead of liberty, and dictatorship instead of democracy. The only way to combat this threat is with a strong, strategic, all-of-government approach.  This bill moves us closer to that.”
    In recent years, China gained significant market share in the production of essential agricultural inputs like vitamins, veterinary pharmaceuticals and crop protection tools.  Losing access to these key inputs could drastically reduce agricultural productivity, increase food prices, and undermine domestic food security.
    The Securing American Agriculture Act would:

    Require the U.S. Department of Agriculture, in conjunction with the U.S. Trade Representative and the Department of Commerce, to conduct an annual threat assessment of critical food and agricultural supply chains.

    Require the Secretary of Agriculture to provide recommendations to mitigate potential threats from China and for legislative and regulatory actions to reduce barriers to domestic critical input production.

    Governor Roy Cooper has requested a Major Disaster Declaration from the federal government for North Carolina for 39 counties and the Eastern Band of Cherokee Indians for federal Public Assistance and Individual Assistance in the aftermath of Tropical Storm Helene. Public Assistance reimburses government entities and some non-profit organizations for emergency protective measures and debris removal, while Individual Assistance can provide direct financial support to impacted residents.

    The declaration will start the process for providing critical financial assistance to people and communities hit hard by the storm. On Wednesday, President Biden approved Governor Cooper’s request for a Federal Emergency Declaration which provided federal financial reimbursement for response actions by government entities and some non-profits.   

    “Helene brought pain and destruction to our state and we’re working to get help to people quickly,” Governor Cooper said. “As waters recede and winds die down, families and communities will need assistance to clean up and recover and this request can help speed up the process.”

    After making landfall Thursday night in Florida, Helene traveled north bringing record rainfall to the mountain and foothill regions of North Carolina. Landslides and major flooding are still occurring in many western counties and more than 900,000 households statewide are without power. Two people in North Carolina have lost their lives to the storm so far and first responders continue with emergency response and rescue efforts. Central and eastern parts of the state have also seen impacts also with multiple tornados reported and many counties still under flood warnings as rivers continue to rise.

    Travel remains extremely dangerous in the foothills and mountains where officials are urging people to shelter in place and avoid driving except in emergency situations. The North Carolina Department of Transportation (NCDOT) has warned people to consider all roads in western North Carolina closed unless you are seeking higher ground. Motorists should not attempt to drive through standing water or around barricades. 

    All available state resources have been mobilized since Governor Cooper declared a State of Emergency on Wednesday. The State Emergency Response Team continues to support impacted communities with equipment, personnel and resources, including the North Carolina Swift Water Rescue Teams and Urban Search and Rescue Teams, and more than 378 North Carolina National Guard soldiers. Utility crews from other states and Canada have also been recruited to assist with post-storm debris removal and restoration of power in areas experiencing outages.

    Espoo, Finland – Nokia today announced that it has been awarded a three-year deal by Vodafone Idea Limited (VIL) to deploy 4G and 5G equipment. The agreement includes the modernization and expansion of VIL’s 4G network of which Nokia is already a major supplier. The deployment will deliver premium connectivity to 200 million VIL customers. Nokia will increase its market share and replace the incumbent vendor in Chennai and Andhra Pradesh, making it the largest supplier covering circles that generate more that 50% of VIL’s revenue. Deployment will begin immediately.

    The deal will see Nokia deploy equipment from its comprehensive, industry-leading 5G AirScale portfolio, powered by its energy-efficient ReefShark System-on-Chip technology. This includes base stations, baseband units, and its latest generation of Habrok Massive MIMO radios. These are designed for easy deployment and will deliver premium 5G capacity and coverage. Nokia will also modernize VIL’s existing 4G network with multiband radios and baseband equipment, which can also support 5G.

    VIL will also benefit from Nokia’s industry-leading network optimization and automation platform, MantaRay SON. This uses self-configuring modules to boost network performance and efficiency and can be tailored and deployed to optimize specific software applications to address unique operational challenges.     Senior officials from the Justice Department and Department of the Interior yesterday convened a roundtable discussion with Tribal leaders, advocates, members of the media, and federal officials to discuss how media coverage can be channeled to help address the crisis of missing or murdered Indigenous peoples (MMIP) and human trafficking (HT).

    The virtual roundtable was organized as part of the federal  response to the recommendations of the Not Invisible Act Commission (NIAC) — a federal advisory committee established in November 2023 under the Not Invisible Act of 2019 to recommend strategies for combating violent crime on Indian lands and against American Indian and Alaska Native people. During seven field hearings across the country as well as a virtual national hearing that informed the Commission’s recommendations, people affected by the crisis of MMIP and HT shared their concerns about lack of media coverage and whether that may contribute to cases being ignored or going unsolved. The Commission in turn recommended the Justice Department and Department of the Interior hold a roundtable discussion as a step toward developing a set of best practices.

    “Public communication, news stories, and social media can be crucial in finding and investigating cases of missing or murdered Indigenous persons,” said Attorney General Garland. “That is why, on the Not Invisible Act Commission’s recommendation, we convened this roundtable to develop best practices and guidelines to aid law enforcement, families, advocates, and journalists when a member of a Native community is reported missing. It is our hope that this convening will strengthen those partnerships, which are essential to advancing our shared goal of ending this crisis.”

    “Since day one, the Biden-Harris administration has been committed to fulfilling our promises to Indian Country,” said Secretary Haaland, who authored the Not Invisible Act while in Congress. “This roundtable is part of that promise as we act on one of the Not Invisible Act Commission’s recommendations because a crisis that exists in silence will never be solved. Today is one step of many to ensure our missing relatives’ stories are told.”

    Attorney General Garland also announced that this month, the Justice Department will award more than $210 million to American Indian and Alaska Native communities through three separate programs to support a wide range of public safety challenges. These funds will go directly to efforts to support Tribal safety. They include programs dedicated to reducing domestic violence and sexual violence, supporting victims of crime, and providing resources to law enforcement, Tribal youth programs, and treatment programs.

    Principal Deputy Associate Attorney General Benjamin C. Mizer delivered opening remarks at the roundtable, saying “it is critical now, more than ever,” to work together to draw attention to the MMIP and HT crises. “The potential for immediate, real-time alerts makes media, particularly social media, a powerful tool to get the word out fast when emergencies happen. And the widespread use of media facilitates information sharing and collaboration that can help resolve missing persons cases.”

    Department of the Interior Assistant Secretary for Indian Affairs Bryan Newland opened the roundtable and said, “The overarching principle that guides our work is to make life better for people in Tribal communities and making sure that Indian people have the opportunity to live safe, healthy, and fulfilling lives in their tribal communities. Public safety is a big part of this, and addressing the Missing and Murdered Indigenous Peoples crisis and human trafficking are at the forefront of our public safety work.”

    In August, Attorney General Garland and Secretary Haaland visited New Mexico to discuss efforts to confront the MMIP crisis and human trafficking with federal and Tribal leaders.     Additional Background on the Departments of Justice and Interior’s commitment to addressing MMIP and HT

    Law Enforcement Collaboration: At the 2022 White House Tribal Nations Summit, the Bureau of Indian Affairs (BIA) and FBI announced an agreement to provide for the effective and efficient administration of criminal investigations in Indian Country. The agreement specified that BIA’s Office of Justice Services (BIA-OJS) and the FBI would cooperate on investigations and share information and investigative reports as well as establish written guidelines outlining jurisdiction and investigative roles and responsibilities. The agreement also requires that all BIA, FBI and Tribal law enforcement officers receive training regarding trauma-informed, culturally responsive investigative approaches.

    Missing and Murdered Unit (MMU): As one of her first acts as Secretary, Secretary Haaland created a new MMU within BIA-OJS to pursue justice for missing or murdered American Indians and Alaska Natives. The MMU, headquartered in Albuquerque, provides leadership and direction for cross-Departmental and interagency work involving missing and murdered American Indians and Alaska Natives. The MMU has enabled the Interior Department to expand its collaborative efforts with other agencies, such as working to enhance the Justice Department’s National Missing and Unidentified Persons System (NamUs) and working through strategic partnerships with the FBI’s Behavioral Analysis Units (BAUs), the FBI Forensic Laboratory, the USMS’ Missing Child Unit (MCU) and the National Center for Missing and Exploited Children (NCMEC).

    MMIP Regional Outreach Program: Since the start of this Administration, the Justice Department has made strides in implementing systems aimed at preventing new instances of MMIP, locating individuals who are reported missing, and, where a crime has occurred, investigating and prosecuting those responsible. In Summer 2023, the Department launched an MMIP Regional Outreach Program. This program places attorneys and coordinators at U.S. Attorneys’ Offices across the United States to help prevent and respond to cases of missing or murdered Indigenous people.

    Not Invisible Act Commission: The Departments worked collaboratively to stand up the Not Invisible Act Commission, which was created by legislation the Secretary led in Congress, to develop recommendations on how the federal government can combat crimes against American Indian and Alaska Native people. The Commission included federal, state, and Tribal law enforcement, Tribal leaders, federal partners, service providers, family members of missing and murdered individuals, and survivors. In 2023, the Commission held seven field hearings across the country as well as a virtual national hearing to hear directly from individuals affected by the MMIP crisis. In March, the Departments released their response to the Commission’s recommendations, which they are in the process of implementing in collaboration with Congress.

    Operation Not Forgotten: The FBI established this operation to focus resources on seeking justice for Tribal community members who have been victims of unresolved crimes. Operation Not Forgotten first surged resources to Tribal communities in 2023 with the mission of examining cases that have gone unresolved. The goal was to move those cases closer to resolution, provide services for victims, and to bring offenders to justice, who had so far escaped it. Due to the success of the 2023 operation, the FBI is currently partnering with the BIA-MMU to surge resources in 2024. BIA-MMU is providing significant intelligence and investigative support for the duration of the operation. Over 45 special agents and five intelligence personnel have deployed in support of the 2024 operation.

    White House Council on Native American Affairs: At the 2021 White House Tribal Nations Summit, President Biden signed Executive Order 14053 on Improving Public Safety and Criminal Justice for Native Americans and Addressing the Crisis of Missing or Murdered Indigenous People directing the Departments of Justice, the Interior, and Health and Human Services to work with Tribal Nations and partners to build safe and healthy Tribal communities and to support comprehensive law enforcement, prevention, intervention and support services. President Biden signed the Violence Against Women Act Reauthorization Act of 2022 into law, which built on advancements from previous reauthorizations and included new provisions to address the crisis of MMIP across the country and re-enforced Tribal sovereignty by providing means for Tribes to address the epidemic of violence within their lands and communities. The White House Council on Native American Affairs is continuing to implement this work through its Public Safety and Justice committee, which is co-chaired by the Departments of Justice and the Interior, as part of an all of government approach to address public safety and the MMIP crisis.

    International Collaboration: The United States is also working with its international counterparts from Canada and Mexico to address public safety issues on a larger scale. In September 2023, Canada chaired the Fifth Convening of the Trilateral Working Group on Violence against Indigenous Women and Girls in collaboration with Indigenous leaders and government officials from Canada, the United States and Mexico and global subject-matter experts. Discussions at this year’s convening focused on human trafficking and access to justice. Officials from the three countries agreed to continue to protect and uphold the rights of Indigenous women, learn from and implement Indigenous-led approaches, provide accessible and culturally safe services, and support the preservation of Indigenous cultures and languages.      Secretary, Department of Agriculture and Farmers’ Welfare (DA&FW) Dr. Devesh Chaturvedi held a meeting with Vice-President, South Asian Region, World Bank Shri Martin Raiser yesterday at Krishi Bhawan, New Delhi. The agenda of the meeting was to discuss the priorities of the Ministry of Agriculture and Farmers’ Welfare and deepening collaboration on ongoing issues, including soil health, climate resilient agriculture and access to carbon markets and digital agriculture.

    Secretary informed the World Bank delegation about the priorities of the government in agriculture sector. He informed that the government is making efforts to achieve self-sufficiency in pulses and oilseeds, promoting of sustainable agriculture, implementing policies to overcome the challenge of small holding size, and implementing policies to improve delivery of services to the farmers and bring behavioral change at scale. 

    During the meeting, the discussion was focused on ways to ensure the benefits of the carbon credit to the small and marginal farmers; challenges of decreasing farm size; access of capital to the Farmers Producers organization; leveraging digital, and soil health infrastructure for behavioral change at scale for sustainable use of input; designing policies to incentivize farmers to adopt sustainable agriculture practices and climate smart and resilient agriculture.

    The Ministry of Civil Aviation (MoCA) has joined the Special Campaign 4.0 (2nd October – 31st October 2024) with the goal of fast-tracking the disposal of pending matters and institutionalizing Swachhata (cleanliness) across its offices. This initiative aligns with the Government of India’s ongoing efforts to enhance governance and administrative efficiency.

    Union Civil Aviation Minister, Shri Ram Mohan Naidu, chaired a review meeting on 27th September, 2024 thereby setting clear objectives for the campaign. The Ministry is committed to improving cleanliness and enhancing administrative efficiency as part of this initiative.

    In the Preparatory Phase of the campaign, the Ministry has identified pending tasks under several categories, including 16,580 physical files and 2,093 electronic files for review. 283 public grievances, 100 public grievance appeals have been targeted for disposal during the campaign. Furthermore, 678 Sites have been targeted for cleanliness activities during the campaign

    The review meeting was attended by Senior Officers from the Ministry and other Heads of Organisations. The Ministry is focused on key activities that will support the successful implementation of the campaign, building on the achievements of previous initiatives.

    The Ministry of Civil Aviation remains dedicated to furthering transparency, boosting administrative efficiency, and promoting Swachhata through the effective execution of Special Campaign 4.0.

    Department of Agricultural Research and Education-Indian Council of Agricultural Research organized initiatives taken by local bodies to integrate citizens with Swachhata for Swachhata Hi Seva and Special Campaign 4.0. This initiative was taken by various ICAR institutes.

        In some ICAR institutes in North-Eastern region. Villages near the institutes were sensitized to keep their surroundings clean and segregate the waste for appropriate disposal. In this initiative, dustbins were installed in various chosen locations in local market where the waste generation is in maximum amount. Locals and shopkeepers were educated about the dry and wet waste management & recycling practices by the officials of this institute. The swachhta banners were displayed at prominent places of the village, and the importance of swachhta and sanitation to the farmers and villagers was explained. The event aimed to raise awareness about the importance of mental and physical cleanliness among local villagers. Experts from ICAR institutes engaged with village workers, emphasized the significance of cleanliness in daily life for better health and well-being. Sessions included discussions on practical steps to maintain hygiene in households, personal cleanliness, and the community environment. They also addressed mental health, promoting the idea that a clean, stress-free mind is as important as physical cleanliness for overall wellness. The campaign’s key messages encouraged community members to adopt healthy, sustainable habits to ensure a cleaner, healthier environment. This initiative, part of the broader Swachh Bharat Mission, seeks to foster long-term behavioral changes in rural communities through education and interaction.

    Robust Growth in the Production of Key Minerals and non-ferrous Metals

    Production of some key minerals in the country has continued to witness strong growth during FY 2024-25 (April-August), after reaching record production levels in FY 2023-24. Iron ore account for about 70% of the total MCDR mineral production by value. Production of iron ore was 274 million metric tonne (MMT) in FY 2023-24. As per provisional data, production of iron ore has increased from 108 MMT in FY 2023-24 (April-August) to 116 MMT in FY 2024-25 (April-August), showing a healthy 7.4% growth. Production of manganese ore has jumped by 15.4% to 1.5 MMT in FY 2024-25 (April-August) from 1.3 MMT during the corresponding period of previous year.  

    In the non-ferrous metal sector, primary aluminium production in FY 2024-25 (April-August) posted a growth of 1.3% over the corresponding period last year, increasing to 17.49 lakh ton (LT) in FY 2024-25 (April-August) from 17.26 LT in FY 2023-24 (April-August). During the same comparative period, refined copper production has grown by 5.8% from 1.91 LT to 2.02 LT.

    India is the 2ndlargest aluminium producer, among top-10 producer in refined copper and 4thlargest iron ore producer in the world. Continued growth in production of iron ore in the current financial year reflects the robust demand conditions in the user industry viz. steel. Coupled with growth in aluminium and copper, these growth trends point towards continued strong economic activity in user sectors such as energy, infrastructure, construction, automotive and machinery.

    NLC India Limited, a Navratna Public Sector Enterprise under the Ministry of Coal, Government of India, is proudly stepping into 10th year of renewable energy generation today. This day marks a significant milestone, as it was on September 28, 2015, that the company embarked on its renewable energy journey by Commissioning a 10 MW solar photovoltaic power plant in Neyveli.

    Under the visionary leadership of Prime Minister Shri Narendra Modi, NLC India Limited (NLCIL) is steadily transforming India’s energy landscape. Following the Prime Minister’s clarion call in 2015 for a robust shift towards renewable energy as India transitioned from “Megawatts to Gigawatts”, NLC India Limited became the first CPSE in the country to generate 1 GW of renewable energy, demonstrating its unwavering commitment to sustainable power generation.

    NLCIL, primarily a Lignite based power generating company, has ventured into renewable energy with 1380 MW of solar power plants and 51 MW of wind power plants. NLCIL has generated 1234 Crore Units of Green Energy effectively preventing the emission of 1 Crore Tonnes of Carbon Dioxide, thus providing affordable and sustainable power and enhancing the quality of life for millions.

    NLCIL’s corporate plan envisages 10,000 MW Renewable Energy capacity by 2030. To achieve this, NLC India has formed new subsidiaries -. NLC India Renewables Ltd (NIRL) to focus on asset monetization and NLC India Green Energy Ltd (NIGEL) to spearhead clean energy initiatives. Furthermore, NLCIL’s membership in the International Solar Alliance (ISA) underscores its commitment to environmental sustainability within the coal sector.

    Under the guidance of Union Minister of Coal and Mines Shri G Kishan Reddy, NLCIL remains at the forefront of renewable energy innovation and has been actively pursuing projects in Solar and Wind power, Energy Storage Systems (ESS), Green Hydrogen, Pumped Storage Hydro projects, Lignite-to-Methanol conversion, mine overburden-to-sand initiatives, and critical mineral exploration.

    With a current renewable energy capacity of 1.4 GW, NLCIL is set to quadruple this figure, targeting an ambitious 10 GW by 2030. Significant projects are underway in Neyveli, Barsingsar (Rajasthan), Gujarat, and Assam. Notably, on August 28, 2024, NLCIL signed a 25-year power purchase agreement with Telangana state DISCOMs for 200 MW of solar energy at a competitive price under the Central Public Sector Undertaking (CPSU) scheme.

    NLC India Limited is committed to continuing this journey and playing its vital role in achieving the Prime Minister’s goal of net zero by 2070, contributing to a sustainable and aspirational India.

    Sri Bhupathiraju Srinivasa Varma Minister of State for Steel and Heavy Industries inaugurated the comprehensive event MMMM 2024 comprising of international conference on “Process & Product Innovations in Metal Production” and Open Seminar on Green Steel Production organised by Hyve India Ltd, IIM Delhi Chapter, Metalogic PMS, and World Metal Forum at Yashobhoomi from 27th September 2024 to 29th September 2024.

    Speaking on the occasion Hon’ble Minister of State lauded the technological Innovations and material efficiency in the steel sector that has driven the global steel production close to 2 billion tonnes from a few kgs in earlier eras and the global capacity has reached close to 2.5 billion tonnes.

    Sri Bhupatiraju Srinivasa Varma added that India’s and global demand for steel will continue to grow in times to come. Indian Steel has a bright future ahead and is currently the Second largest producer with a capacity of 178 million tonnes and production of 144 million tonnes in Fy’24.

     Minister observed that the Steel Sector is at the watershed moment in its life cycle and the future direction will be built be built on digitisation in its processes and around sustainable steel production to minimise the emission levels to reduce its environmental carbon footprints.

    Sri Bhupatiraju Srinivasa Varma reminded the industry representative present that Hon’ble PM Sri Narendra Modi had promised at COP26 on November 2, 2021 that, India will reduce the carbon intensity of its economy by more than 45 percent By 2030 and will achieve the target of Net Zero by the year 2070.

    Global steel sector on an average account for ~8 percent of total emissions with emission intensity of 1.89 tons of CO2 per tonne of crude steel produced. However, in India the sector contributes around 12% of total emissions released with emissions intensity of 2.5 tons of CO2 on production per ton of crude steel averred the Hon’ble Minister

    Considering the urgency of the issue, the Ministry of Steel has recently released a report titled “Greening the Steel Sector in India: Roadmap and Action Plan” prepared based on the recommendation of the 14 Task Forces constituted by the Ministry of steel for defining pathway towards decarbonization of steel sector. The report comprises in-depth recommendations on technologies including Energy Efficiency, Renewable Energy, Green Hydrogen, Material Efficiency, Process Transition from coal based DRI to Natural Gas based DRI, Carbon Capture, Utilisation and Storage (CCUS) and the use of Biochar in steel.

    Sri N N Sinha former Secretary Ministry of Steel mentioned that there is recent report from BCG that has highlighted the companies pursuing decarbonisation pathway are able to improve their bottom line. He added that the aforesaid report also highlighted that companies may be able to improve 10% to 40% in their emission intensity by focussing on internal improvements. The Indian Steel companies now should come forward as the Government has already laid out clear pathway.

    Sri Subhankar Sen Business head BPCL said that MAK Lubricants from Bharat Petroleum are complimenting steel industry’s impressive growth, projected to reach 300 million tonnes by 2030 and the increasing focus on sustainable practices and green steel production.

     Minister of state also released the Conference Volume and Souvenir of the International Conference on PROCESS and PRODUCT INNOVATIONS IN METAL PRODUCTION organised by The Indian Institute of Metals-Delhi Chapter at the event.

     Minister of state exhorted industry that the way forward towards transition to low carbon metal production is innovation of processes, robust collaboration between metal producers both primary and the secondary, academicians, R&D organisations, capital equipment producers and the metal using sector.

    The Indian Navy Quiz – THINQ24, progressed with the first Elimination Round on 10 Sep 24. A total of 12,655 school teams registered for the National level quiz competition were put through three elimination rounds which culminated on 25 Sep 24.

    The shortlisted schools will now participate in the Zonals on 14-15 Oct 24, which will be conducted in online mode.

    THINQ 24 which commenced it’s journey with registration process on15 Jul 24 has reached the half way mark with the completion of Elimination rounds. This year, the theme of THINQ 2024 is ‘Viksit Bharat’ aligned with the vision to transform India into a developed nation by 2047. This quiz competition goes beyond the concept of testing just the general awareness of students. It is a forum to ignite young minds, spread awareness among students on their role in nation building and reach greater heights

    The semifinals and final of THINQ 24 would be held at the premier Naval Training establishment, the Indian Naval Academy at Ezhimala, Kerala under the aegis of Southern Naval Command on 07 & 08 Nov 24.

    by Cosimo GrazianiKazan (Agenzia Fides) – The next BRICS Summit will take place from 22 to 24 October in the Russian city of Kazan.The geopolitical and economic alliance known as BRICS takes its name from the initials of its original founding countries: Brazil, Russia, India and China joined in 2006, while South Africa joined in 2010.Now the BRICS network is gradually expanding. Similar to last year’s summit in South Africa, this time too there are a number of countries that want to join the group.In Johannesburg, Ethiopia, the United Arab Emirates, Iran, Egypt and Saudi Arabia were admitted as new members.This year Turkey, Azerbaijan and Malaysia, which have submitted formal applications for membership in recent weeks, could join. But the list of countries seeking to join or being courted by the current members is long: Thailand is very interested in joining, China is pushing for Kazakhstan to join, and Algeria is expected to join, which was due to join last year but was blocked by an Indian veto.All the new countries applying to join have great geopolitical weight: Turkey and Azerbaijan are involved in the political changes in Europe and Asia, while Malaysia is a member of ASEAN, an organization that has been able in recent years to carve out an exceptional economic role for itself in a context such as the Indo-Pacific region, where the giants India and China are located.Analysts say Turkey’s application for membership is linked to its chances of gaining the desired accession to the European Union, a process in which negotiations have been stalled for about six years now. This reading is confirmed by comments made by Turkish Foreign Minister Hakan Fidan in a broadcast to Turkey’s Anadolu Agency on Thursday, September 19. “If our economic integration into the European Union had been crowned with membership that went beyond the customs union, we might not be embarking on this kind of search on many issues,” Fidan said.For Azerbaijan, the accession would be the final recognition of its new status as a medium-sized power at the international level, as it would take place in the same year that Baku is organizing the Cop29 on the environment and thus can also influence the global agenda to combat climate change, despite being an oil-producing country.Finally, Malaysia hopes to join the bloc to be able to act more freely in its trade relations: as explained on the website of The Diplomat magazine, Malaysia would use its membership to maintain political relations that are not too unbalanced with its trading partners, to ensure a fair distance with everyone, and to present itself as a “bridge” between this organization and ASEAN.New members mean new international weight for the organization. But such an accelerated expansion of membership also raises doubts about the real benefits that members hope to gain. Up front, there is the problem of the procedures for admitting a new candidate. As seen in the case of Algeria last year, the weight of individual states in the final decisions is still enormous, and there are no defined criteria for admission.Suffice it to say that Malaysia’s application letter was sent to Russia and not to a special body, a sign that the decision will be strongly influenced by the interests and assessments of the country organizing the summit this year.This hypothesis is confirmed by China’s announcement last July that it would admit Kazakhstan to the organization: Beijing obviously did so because it has a strong interest in integrating Kazakhstan into the organization over the other members. This year, the acceptance of the candidacy of Turkey and Azerbaijan comes at a very convenient time for Russia, as it is involved in various issues in Europe and the Caucasus, and the acceptance of Malaysia is to be seen in a dialectical relationship with the Western world in terms of enlargement.An enlargement that depends too much on the specific interests of the country organizing the summit risks making membership unbalanced in certain geographical contexts, quite unlike the “diffuse” and “balanced” enlargement that was clearly one of the selection criteria last year. This year, Eurasia is at the heart of the process, while the Indo-Pacific plays a secondary role and Africa, the Middle East and South America are left out. This would mean a reorientation towards these contexts next year, with the uncertainty that the respective relations between individual candidates and member states could slow down or block the process.Such a dynamic affects the enlargement process, but also calls into question the very nature of the organization: what does BRICS want to be? An alternative to Western organizations or just an economic platform? One answer to this question seems to be the solution found with Algeria after last year’s rejection: the country first joined the “New Development Bank” the BRICS banking institution, which also includes a South American country that has so far refused to join the bloc, such as Uruguay. Applying this solution of partial or reduced membership to other countries in the future would weaken the idea of BRICS as an alternative to the West and its international importance.     To mark the 90th year of its establishment, Reserve Bank of India hosted RBI@90 Inter Institutional Cricket Tournament at Jaipur, Rajasthan from September 21-28, 2024. Teams with Indian players having experience of playing at International and National level participated in the tournament. The tournament was played in the twenty over format.

    The event commenced with Opening Ceremony and Exhibition Match on September 21, 2024. Finals of the tournament was played on September 28, 2024 between SPJ Cargo and Bank of Baroda at Sawai Mansingh Stadium, Jaipur

    Finals started with introduction of both the teams and unveiling of trophy of the tournament. Bank of Baroda won the toss and scored 157 runs. SPJ Cargo chased the target to win the tournament.

    The matches of the tournament were streamed live on the Reserve Bank of India’s YouTube channel.

    Search and rescue operations remain underway in communities across Western North Carolina and supplies are being brought into the region by air following devastating impacts from Tropical Storm Helene.

    “This is a historic and catastrophic storm for Western North Carolina and I’m grateful to first responders working right now to save lives and evacuate residents,” Governor Cooper said. “Efforts are also underway to get power and communications restored, and we’re bringing in needed supplies by air.”

    More than 200 people have been rescued from flood waters in North Carolina following Helene’s torrential rains. North Carolina’s search and rescue teams are being bolstered by teams from 19 states and three federal teams.

    Many areas in the mountains received more than 10 inches and as much as 29 inches of rain causing catastrophic flooding. High winds gusting up to hurricane strength also brought down trees, power lines and cell towers across the region.

    More than 700,000 people remained without power as of this morning and utility crews are responding from across the country for immediate restoration and repair efforts. Sixteen shelters housed approximately 1,100 residents last night.

    Cellular telephone service remains spotty west of I-77 due to significant infrastructure damage. Telecommunications partners have activated Disaster Roaming, which allows any phone on any cellular network to access any available network to connect to. Telephone service providers are working to restore communications across the area.

    “The State Emergency Response Team is working around the clock responding to severe impacts from Helene’s devastation. We are grateful for our local, state and federal partners and their teamwork to help North Carolinians hit hard by this storm,” said NC Emergency Management Director Will Ray. “Please remain aware of hazards and follow directions from local officials to protect life and safety.”

    Across North Carolina, 29 counties and 52 towns and cities have issued States of Emergency, in addition to the statewide State of Emergency declared by Governor Cooper. Governor Cooper yesterday requested a Major Disaster Declaration from the federal government for North Carolina for 39 counties and the Eastern Band of Cherokee Indians for federal Public Assistance and Individual Assistance in the aftermath of Tropical Storm Helene.

    As of Saturday morning, about 418 state-maintained roads remained closed, mostly due to flooding. Across the area, 11 landslides have been reported. This includes major closures on Interstates 26 and 40 around Asheville, plus dozens of locations along several U.S. and N.C. highway routes.

    State transportation officials continue to urge residents to avoid traveling in western North Carolina, and to consider all roads in that region closed due to damage from the storm. People should go to DriveNC.gov for the latest conditions on roads impacted by Hurricane Helene. Never drive through standing water or go around barricades and road closure signs.

    North Carolina residents should call 911 only for emergencies and dial 211 for other types of information. Up-to-date information on local conditions, shelters, traffic, power outages and resources is available at ReadyNC.gov and from county government social media.

    At a function held at ED(Works) main conference hall today at RINL, Sri U Sridhar, CGM(Works) I/c presented the ‘Swachhta Puraskar 2024’ to various departments of Visakhapatnam Steel Plant for carrying out ‘Swachh Bharat’ activities at RINL in a sustainable and commendable way during the period 16th Sept’ 2023 to 15th Sept’ 2024.

    HODs along with their Department SwachhataCoordinator/representatives of Blast Furnace,  Coke ovens & Coal chemicals Plant, Light & Medium Merchant Mill,  Raw Material Handling Plant, Steel Melting Shop-2,  Sinter Plant, Wire Rod Mill-2,   Electro Technical Laboratory,  Engg.     Union Minister of Commerce & Industry, Shri Piyush Goyal during his valedictory speech at the 2nd edition of Uttar Pradesh International Trade Show (UPITS) said that Prime Minister Shri Narendra Modi’s efforts in developing Uttar Pradesh will help the state reach US$ 1 trillion economy in the first phase. 

    Shri Goyal noted that the double engine Government of Uttar Pradesh led by Shri Yogi Adityanath under the guidance of the Prime Minister will help India become a US$ 5 trillion economy in the first phase, and will serve as a cornerstone for India to become a US$35 trillion economy and a ‘Viksit Bharat’ by 2047. Shri Goyal noted that the industrial and other proactive policies implemented by Shri Yogi Adityanath with the visionary goals of the Prime Minister has led the state to become a holistic model of development in the country.

    Highlighting the journey of Make in India program, Shri Goyal said that PM Modi’s vision to initiate this journey on September 25, 2014 to make India a domination nation at the global stage in manufacturing will produce employment and entrepreneur opportunities for the youth.

    Shri Goyal announced that a decision has been taken to celebrate the Anniversary of Make in India with the opening of the UP International Trade Show every year. The Government of India and the UP Government together have constantly prioritised making laws simpler and promote ease of doing business, he said.  He added that the Centre and the UP government in a joint effort are building an industrial smart city in Greater Noida and a total of 20 industrial smart cities are being developed across the country.

    Applauding the success of the trade show in its 2nd edition, Shri Goyal highlighted that over 2,500 exhibitors participated and over a lakh people have already attended in the four-day event from September 25-29, 2024. Shri Goyal further praised Shri Adityanath and the UP government for their efforts in skill development of the youth enabling provision of skilled and talented labour for the companies investing in the state. He said that because of this proactive initiative, migration from the state has significantly reduced with industries receiving a ready talent pool for efficient operations enabling them to expand their business and also making the state investor-friendly. UP government has been successful in not only a holistic development of the state but has also made progress in social infrastructure and human development, he said. 

    Shri Goyal explaining 4Ds – Decisive leadership, Demand, Demographic Dividend and a vibrant Democracy, said that huge investments have poured into Uttar Pradesh because of its implementation by the Centre and the state government.

    Highlighting the successes of first 100 days of PM Modi’s third term, Shri Goyal said that the decisions taken to benefit farmers, to increase minimum wages, build 3 crore homes under the PMAY scheme, provision for health expenditure up to Rs 5 lakh for citizens above 70 years, to built 12 more industrial smart cities and to provide employment to 4 crore youth by spending Rs 2 lakh crore over a period of five years will strengthen the society and benefit every part of the country.

    Speaking about the improvement from 142nd to 63rd in Ease of Doing Business rankings, Shri Goyal said that the continuous efforts led by the Government has led to rise of India’s rankings in Global Innovation Index to 39th spot out of 133 countries.  He continued that the ranking is reflective of the rise in patent filing in the country as well. The Intellectual Property Rights regime has vastly improved over the last decade. From 6,000 patents being filed in 2014 to 1 lakh patents filed last year, shows country’s growth in technology, he said.

    Emphasising the importance of maintaining quality in products, the Union Minister said that India is being recognised as a quality provider of goods and services. We have to ensure that the products we manufacture, the services we provide should be of high quality and buyers should receive this quality with Made in India products, he said.

    The Union Minister said that PM gave the vision of Zero Defect, Zero Effect and to make products of high sustainable quality is the need of this country and the world. He expressed hope that the youth, innovators, and startups with high quality, zero-defect production and sustainable manufacturing practices will propel India to world recognition. Manufacturing and selling of Made in India products within the country and abroad will reduce imports, boost MSMEs, help One District One Product scheme to grow and lead India to be technologically developed nation.

    A seminar, organised by the Telecom Disputes Settlement & Appellate Tribunal (TDSAT) on the theme “Mechanism for Resolution of Disputes in Telecom, Broadcasting & Cyber Sectors” in Goa today has called for vigorous outreach activities by all stakeholders to create awareness among the public about the availability of Adjudicating Officers (AO) for cybercrimes in every state, as the public is largely unaware of the provision to approach the AOs for compensation. Although the victims of cyber crimes file complaints with the cyber police, there is a lack of awareness about the existence of AOs in every state who can exercise jurisdiction over claims for damages up to Rs 5 cr, subject experts, who attended the seminar, said.

         

    The seminar, organised at Hotel Double Tree by Hilton in Arpora, North Goa, today, 28th September, 2024, was inaugurated by Justice Devendra Kumar Upadhyaya, Chief Justice, High Court of Bombay. In his inaugural address, Justice Upadhyaya highlighted the importance of tribunals and their origin in Indian legal system. He emphasized that the existence of subject experts along with judicial members in a tribunal strengthens the dispute resolution process in the given specialized sector.

    Justice Navin Chawla, Judge, High Court of Delhi, who was a special guest at the seminar, shared his experience as a practicing lawyer with the TDSAT before his elevation as judge. He highlighted the evolution of TDSAT in the course of the time.

    Justice D.N. Patel, Chairperson, TDSAT, in his Introductory address, talked about the jurisdiction of the TDSAT covering sectors like Telecom, Broadcasting, Cyber, Airport Tariff, Aadhaar, Personal Data Protection etc. and elaborated the kind of disputes that are raised before the TDSAT.

    Justice M.S. Karnik, Judge, High Court of Bombay at Goa, was the Guest of Honour. The seminar was also attended by Justice Kamal R. Khata, Judge, High Court of Bombay, and Justice Valmiki Menzes, Judge, High Court of Bombay at Goa.

    The Business Session was addressed by subject experts and lawyers comprising of Ms. Yashaswini B., IAS, Director, Department of Information Technology, Government of Goa, Adv Kunal Tandon, Adv Payal Kakra, Adv Vibhav Srivastava, Adv Tejveer Singh Bhatia, Adv Himanshu Dhawan, and Adv Jose Elmano Periera, President of Goa High Court Bar Association. Shri Meet Malhotra, Senior Advocate, moderated the session. The experts spoke various topics such as ‘IP TV – A Merger of Telecom and Broadcasting?’, ‘TDSAT’s Role in Ensuring Fair Practices and Quality Service in Broadcasting’, ‘Role of Regulations in Orderly Growth of Broadcasting and Cable Industry’, ‘Dispute Resolution under Cyber Law’, etc.

    Adv Kunal Tandon said that more awareness needs to be created among the public about the availability of the forum of Adjudicating Officers across all states for civil remedies to the victims of cyber offences. Adv Meet Malhotra, the moderator, suggested convening a conference of all AOs under the IT Act by the TDSAT to sensitize them and others regarding the availability of remedies to the victims of cyber offences.

    Justice D.N. Patel, Chairperson, TDSAT, suggested that a mechanism needs to be drawn where registration of any FIR by cyber police station against any cyber offence must be reported to the IT Secretary of the State who also happens to be the Adjudicating Officer under IT Act for consideration of civil remedy to the cyber offence complainant.

    Telecom Lawyers’ Association President Adv Manjul Bajpai, members of the local judiciary, office bearers of the TDSAT, lawyers and representatives of the State government, were also present at the seminar.

    As part of the ongoing Swachhata Hi Seva (SHS) 2024 campaign, Union Minister for Jal Shakti, Shri C.R. Paatil visited the Rajnandgaon district of Chhattisgarh today. His visit was aimed at observing the significant progress and implementation of various sanitation and water conservation initiatives under the Swachh Bharat Mission Grameen (SBM-G), reinforcing the importance of sustaining cleanliness efforts in rural India.

    The ongoing Swachhata Hi Seva (SHS) 2024 campaign, with its theme of ‘Swabhaav Swachhata, Sanskaar Swachhata’, is being held from 17th September to 1st October. The campaign will be culminating with Gandhi Jayanti on 2nd October, which is also the 10th anniversary of the Swachh Bharat Mission. The SHS campaign focuses on behavioral change and community participation to maintain cleanliness and sanitation across India.

    In his opening address, the Shri Paatil highlighted, “Under the inspiring leadership of Prime Minister, Shri Narendra Modi, we are entering a new chapter in the Swachhata journey. As we approach 2nd October, a day marking 10 years of the Swachh Bharat Mission, we should all do our bit by participating in Shramdaan in our villages and towns. Our collective efforts over the past decade have transformed the sanitation landscape of India. Chhattisgarh, like the rest of the country, has played a pivotal role in this transformation, and today I urge everyone to continue their dedication as we move forward with renewed commitment and energy.”

    Key SHS 2024 Activities in Chhattisgarh:

    • 5,631 Cleanliness Target Units (CTUs) planned, with 2,071 transformed CTUs involving 1.3 lakh volunteers.
    • 29,951 Swachhata Mein Bhagidari events, with over 10.48 lakh participants, fostering community ownership of local sanitation systems.
    • Over 32,000 sanitation workers benefited from health camps, and 26,000 sanitation workers were provided with PPE kits through 2,332 SafaiMitra Suraksha Shivirs.

    Chhattisgarh’s Sanitation Progress:

    • 67% villages declared ODF Plus Model.
    • 73% villages have arrangements for Solid Waste Management.
    • 94% villages have Liquid Waste Management systems in place.
    • Chhattisgarh has achieved ODF Plus Model status for 13,033 villages, with a goal to declare all villages ODF Plus by December 2024.

    During the visit, Shri Paatil witnessed firsthand the innovative waste-to-art installations created by the local community, the transformative impact of Cleanliness Target Units (CTUs), and the successful ‘Ek Ped Maa ke Naam’ tree plantation initiative. The ‘Mission Jal Raksha’ programme, aimed at water conservation, was highlighted with the Minister inspecting the percolation tank site in Barga village, showcasing local efforts to preserve and replenish water resources.

    A notable highlight was the declaration of Rajnandgaon and Dongargaon blocks as ODF Plus Model blocks, underscoring the district’s commitment to Sampoorna Swachhata and waste management.

    The Union Minister also inaugurated the Faecal Sludge Treatment Plant (FSTP) in Baghara, which was a significant step towards sustainable waste management. He also visited the Plastic Waste Management Unit (PWMU) in Amlidih village, where he interacted with Swachhata Didis, sanitation workers leading local cleanliness efforts.

    This visit by Union Minister demonstrates the government’s ongoing resolve to make the vision of a Sampoorna Swachh Bharat a permanent reality. The Swachhata Hi Seva 2024 campaign continues to unite communities in their mission towards a cleaner and more sustainable India.
