  • MIL-OSI Security: Three Individuals Sentenced for Harboring Aliens Arriving in Puerto Rico from the Dominican Republic

    SAN JUAN, Puerto Rico – The last of three defendants was sentenced today to prison for harboring aliens that arrived in Puerto Rico from the Dominican Republic.

    Together, defendants Katia Janette Nieves, Junior Melo, and Iris J. Nieves-Ríos coordinated the pickup in August 2023 of at least 50 individuals arriving unlawfully via boat on the west side of Puerto Rico from the Dominican Republic. Despite knowing that these individuals were aliens not lawfully in the United States, the defendants transported them to a residence in San Juan, Puerto Rico, harbored them, and demanded money from family members in order to release the individuals.

    Junior Melo was sentenced on December 16, 2024, to 72 months in prison and five years of supervised release. Katia Janette Nieves was sentenced on January 15, 2025, to 72 months in prison and five years of supervised release. Iris J. Nieves-Ríos was sentenced today to 24 months in prison and five years of supervised release.

    U.S. Attorney W. Stephen Muldrow of the District of Puerto Rico; and Joseph González, Special Agent in Charge of the FBI San Juan Field Office made the announcement.

    The FBI and the Puerto Rico Police Bureau investigated the case.

    Assistant U.S. Attorney Daynelle Álvarez-Lora and Assistant U.S. Attorney Linet Suárez prosecuted the case.

  • MIL-OSI Security: U.S. Attorney’s Office Secures 51-Month Sentence in Vehicular Homicide Case

    ALBUQUERQUE – A Sanostee man was sentenced to 51 months in federal prison and ordered to pay nearly $8,000 in restitution after pleading guilty to two counts of involuntary manslaughter for a fatal drunk-driving crash that occurred on the Navajo Nation.

    According to court documents, at approximately 6:30 a.m. on August 12, 2023, Leonardo Robbie Duncan, 33, an enrolled member of the Navajo Nation, was driving while intoxicated on Navajo Route 36 near Upper Fruitland, New Mexico, when he crossed into oncoming traffic and collided head-on with a vehicle occupied by Jane and John Doe.

    Duncan fled the scene on foot without checking on or assisting the victims. An off-duty Southern Ute Tribal police officer attempted to stop Duncan from leaving but was unsuccessful. John Doe died at the scene; Jane Doe passed away en route to the hospital. Both victims were enrolled members of the Navajo Nation.

    Duncan turned himself in to Navajo Nation Police six hours after the crash. At the time of surrender, his blood-alcohol content was 0.08. At the time of the incident, Duncan was on state probation for Battery on a Household Member and had recently violated this probation with an open-container offense. He also had a prior State conviction for Driving While Intoxicated from 2018.

    Upon his release from prison, Duncan will be subject to three years of supervised release.

    U.S. Attorney Alexander M.M. Uballez and Raul Bujanda, Special Agent in Charge of the Federal Bureau of Investigation’s Albuquerque Field Office, made the announcement today.

    The Farmington Resident Agency of the Federal Bureau of Investigation’s Albuquerque Field Office investigated this case with assistance from the Navajo Police Department and Navajo Department of Criminal Investigations.

  • MIL-OSI Security: Guatemalan National Charged with Transportation, Distribution, and Possession of Child Pornography

    OKLAHOMA CITY – A federal complaint has been unsealed charging GUSTAVO GORDILLO, 41, of Guatemala, with transportation, distribution, and possession of child pornography, announced U.S. Attorney Robert J. Troester.

    According to an affidavit filed in support of a criminal complaint, in July 2020, investigators with the Oklahoma City Police Department (OCPD) received a cyber tip after files containing child sexual abuse material (CSAM) were uploaded to a Google Photos account. The affidavit alleges that the suspect who uploaded the photos, later determined to be Gordillo, lived in Oklahoma City. OCPD detectives investigated the tip, as well as additional tips from Facebook, and learned that Gordillo had communicated with a child living out of state. The affidavit further alleges Gordillo provided CSAM to and received CSAM from the child. In December 2024, additional investigation led law enforcement to a residence in the Oklahoma City metro that was connected with Gordillo. Gordillo was charged by Complaint on January 27, 2025, and was arrested by Homeland Security Investigations (HSI) and OCPD on January 29, 2025.

    Public records show Gordillo had entered into the United States on a temporary visa that had expired.

    If found guilty as charged in the Complaint, Gordillo faces up to sixty years in federal prison. The public is reminded these charges are merely allegations, and that Gordillo is presumed innocent unless and until proven guilty beyond a reasonable doubt.

    This case is the result of an investigation by HSI and OCPD. Assistant U.S. Attorney Tiffany Edgmon is prosecuting the case.

  • MIL-OSI Security: Honduran Man Pleads Guilty to Immigration Crime

    BECKLEY, W.Va. – Nolvin Alfredo-Diaz, also known as “Alfredo Diaz” and “Nolvin Alfredo Diaz,” 42, a Honduran national, pleaded guilty today to reentry of a removed alien.

    According to court documents and statements made in court, on August 21, 2024, U.S. Immigration and Customs Enforcement (ICE) agents arrested Alfredo-Diaz in Lewisburg. Alfredo-Diaz admitted that he was a citizen of Honduras in the United States illegally and that he had previously been deported from the United States. Alfredo-Diaz had no identification documents permitting him legal status in the United States.

    Fingerprints matched Alfredo-Diaz to two prior removals from the United States to Honduras. On December 27, 2006, Alfredo-Diaz was removed from the United States to Honduras following his felony conviction for controlled substance-possession Schedule I, to wit, heroin, in Denver County, Colorado, District Court on September 25, 2006. On September 6, 2007, Alfredo-Diaz was found in Denver, Colorado, and convicted of controlled substance-possession Schedule II, to wit, cocaine, in Denver County, Colorado, District Court on December 20, 2007. On July 21, 2010, Alfredo-Diaz was found in Canon City, Colorado, and was removed from the United States to Honduras on August 5, 2010.

    Alfredo-Diaz never obtained the express consent of the Secretary of U.S. Homeland Security to reapply for admission to the United States for either of the prior removals, nor did he seek to reenter the United States through other legal means.

    Alfredo-Diaz is scheduled to be sentenced on May 29, 2025, and faces a maximum penalty of 10 years in prison and up to three years of supervised release. Alfredo-Diaz will be subject to deportation proceedings at the conclusion of any sentence.

    “This federal criminal case underscores our office’s commitment to pursuing illegal reentry cases, especially in circumstances where the offender has a criminal history,” said United States Attorney Will Thompson. “Here, Mr. Diaz has two felony convictions for drug offenses and has been removed from the United States on multiple occasions. This will be Mr. Diaz’s third felony conviction. Our office will diligently and aggressively pursue these types of immigration cases.”

    Thompson made the announcement and commended the investigative work of U.S. Immigration and Customs Enforcement (ICE).

    United States Magistrate Judge Omar J. Aboulhosn presided over the hearing. Assistant United States Attorney Erik S. Goes is prosecuting the case.

  • MIL-OSI Security: Guatemalan National Pleads Guilty to Illegally Entering the US After a Prior Removal

    PORTLAND, Maine: A Guatemalan national pleaded guilty today in U.S. District Court in Portland to entering the United States after a prior removal.

    According to court records, in November 2024, an Immigration and Customs Enforcement (ICE) agent conducted a records check on Jorge Martinez-Urizar, 50. The check showed that he had been removed from the country on three prior occasions, most recently in July 2005, and that he had not filed any applications or petitions granting him permission to reenter or remain in the United States lawfully. Martinez was removed in 2005 after serving a 70-month sentence in Oregon for a 1999 conviction for assault in the second degree and unlawful use of a weapon.

    Martinez-Urizar faces a maximum prison term of 20 years and a fine up to $250,000.

  • MIL-OSI Security: 3 men believed to be part of South American Theft Group indicted for federal crimes related to burglary of NFL player’s Cincinnati home

    CINCINNATI – A federal grand jury in Cincinnati has charged defendants believed to be operating as part of a South American Theft Group with transporting stolen goods interstate and falsifying records in a federal investigation. The three men allegedly committed the Dec. 9, 2024, burglary at the home of a local NFL player.

    A federal complaint was filed on Feb. 3 and the indictment was returned today, charging Jordan Francisco Quiroga Sanchez, 22, Bastian Alejandro Orellana Morales, 23, and Sergio Andres Ortega Cabello, 38, all of Chile.

    “Our investigation remains ongoing as these individuals seem to be the alleged tip of the iceberg of South American Theft Groups committing crimes throughout our district and elsewhere,” said U.S. Attorney Kenneth L. Parker. “We owe it to the victims, whether they are or are not professional athletes, to follow the evidence into these alleged criminal networks and hold the law-breakers accountable. I cannot thank our law enforcement partners enough for their commitment to working together to track down these perpetrators. Today is a day that law enforcement scored and spiked the ball.”

    “South American Theft Groups have been a major concern in the Cincinnati area,” said FBI Cincinnati Special Agent in Charge Elena Iatarola. “We appreciate the partnerships of all the agencies involved in the Southwest Ohio South American Theft Group Task Force for their hard work on this investigation.”

    “The Ohio Organized Crime Investigations Commission was created for – and excels at – these types of complex, multi-jurisdictional cases,” Ohio Attorney General Dave Yost said. “I’m proud of the work done so far, and look forward to more results as our task force continues its work.” 

    According to charging documents, law enforcement responded to the NFL player’s home around 8:14pm on Dec. 9, 2024, in reference to a reported burglary. An associate of the homeowner had been dropped off at the residence shortly after 8pm and discovered rooms were unusually messy and a primary bedroom window on the back side of the home had been broken.

    It is believed the burglary likely occurred between 6pm and 8pm. The homeowner was away from his residence playing in an NFL game in Dallas. During a security detail shift change at the home at approximately 6pm, security personnel walked the perimeter of the house and no windows appeared to be broken at that time.

    Continued investigation at the Cincinnati home led investigators to discover a trail camera image of a man carrying luggage and walking through the wooded area behind the home.

    Law enforcement tracked the subjects in various states following the burglary, and subsequently located the vehicle at the La Quinta hotel on University Boulevard in Fairborn. The Ohio State Highway Patrol later stopped the vehicle for a traffic violation.

    Phone analysis shows Cabello allegedly deleted photographs of the stolen goods and the back of the victim’s home during the traffic stop with the Ohio State Highway Patrol, thus falsifying records in a federal investigation. Additional cell phone analysis revealed other photos of the defendants in southeast Florida days after the burglary with luxury luggage and wearing the stolen jewelry.

    Also in the car with the defendants were punch tools to break glass, as well as an old Louisiana State University shirt and a Cincinnati Bengals hat believed to be taken from the victim’s home.

    The men were taken into local custody at the time of the traffic stop.

    Interstate transportation of stolen property is a federal crime punishable by up to 10 years in prison. Falsification of records in a federal investigation carries a potential penalty of up to 20 years in prison. The three men were previously charged locally and those state charges remain pending.

    Lee Womble is Vice President and Global Accounts Director for SLB with global responsibility for drilling contractor accounts over all SLB divisions and basins.

    He joined Cameron Iron Works in 1988 as a Product Design Engineer after receiving his Bachelor of Science degree in Mechanical Engineering from the University of Texas at Austin. Lee received his registered Professional Engineer license from the State of Texas in 1993 and obtained his first patent in 1994. He has since managed engineering, repair operations, manufacturing, field service and sales.

    Mr. Womble has since held numerous positions throughout his 36-year career such as Design Engineer, Repair and Sales Mgr., Regional Manager, Director and now Vice President since 2007. He has lived in locations such as the US, Saudi Arabia, Egypt, Indonesia, and Malaysia. Lee has served on committees for API, AADE, IADC and The Joint Industry Task Force. He is currently focused on help SLB lead in technology, performance, and customer centricity.

    Gene Stahl was appointed as President, North American Drilling in 2023 and previously held the position of Chief Marketing Officer since 2019. Since joining Precision Drilling in 1993, Mr. Stahl has progressed his way through the organization holding several positions with increasing responsibility, including Contracts, Investor Relations, Engineering, Manufacturing, Rig Construction, Procurement, Field Training and Development, and Health, Safety and Environment (HSE). Mr. Stahl holds a Bachelor of Arts degree in Economics from the University of Calgary and is a graduate of the Harvard Business School, Advanced Management Program.

    Jon Richards currently serves as Vice President Operations for Noble Corporation. He previously served as Senior Vice President of Worldwide Operations for Diamond Offshore. Mr. Richards joined Diamond Offshore in 1997 and has over 27 years of experience in the offshore drilling industry.

    Jon started his career as an Operations Development Trainee with Diamond and has since held various leadership roles and responsibilities managing operations in the United States, United Kingdom, West Africa, and Brazil. Jon holds a degree in Business Management from Texas Tech University and participates in various roles as a member of the IADC. In his free time, Jon enjoys spending time outdoors with his family and volunteering with youth sports.

    Jim Nowotny is the Vice President International and Offshore Business Development at Helmerich & Payne.  He has extensive domestic and international leadership experience in multiple areas of the offshore and land drilling industry, including marketing and business development, commercial and technical contracts, operations, manufacturing, and engineering.  He has worked in the energy industry since 1995.

    Prior to joining Helmerich & Payne, he worked for an international oil field equipment manufacturer.  There he was responsible for four manufacturing business units within Canada and the USA.  He oversaw all aspects of business operations, including the manufacturing, engineering, and business development groups. Jim also worked for over 16 years in various roles for Atwood Oceanics, an international offshore drilling contractor.  He worked in increasing roles of responsibility in the areas of engineering, operations, marketing, and business development.

    Jim has a Bachelor of Science degree in mechanical engineering from Texas A&M University and has completed several executive education courses at Columbia Business School, Harvard Law School and Kellogg School of Management at Northwestern University.

  • MIL-OSI United Nations: Human Rights Council to Hold Special Session onthe Democratic Republic of the Congo on 7February

    The United Nations Human Rights Council will hold a special session on the human rights situation in the east of the Democratic Republic of the Congo on Friday, 7 February 2025.

    The session will start at 10 a.m. in room XX of the Palais des Nations in Geneva. The meeting will be webcast live in the six official languages of the United Nations.

    The special session is being convened per an official request submitted on Monday evening, 3 February, by the Democratic Republic of the Congo, which has been supported by 27 States thus far.

    For a special session to be convened, the support of one-third of the 47 members of the Council – 16 or more – is required. This request is thus far supported by the following States members of the Council (27): Algeria, Belgium, Bulgaria, Burundi, Chile, Colombia, Costa Rica, Cyprus, Czechia, the Democratic Republic of the Congo, the Dominican Republic, France, Germany, Ghana, Iceland, Japan, Kyrgyzstan, Malawi, Marshall Islands, Morocco, the Netherlands, North Macedonia, the Republic of Korea, Romania, South Africa, Spain and Switzerland.

    The request is also supported by the following 21 observer States: Australia, Austria, Croatia, Denmark, Estonia, Finland, Greece, Hungary, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Poland, Portugal, Slovakia, Slovenia, Sweden and the United Kingdom.

    The list of signatories remains open up to the holding of the special session. Therefore, the above list of States is to be considered provisional.

    In connection with this special session, the Council will convene an organizational meeting on Thursday, 6 February at 10 a.m. when specific details on the special session and its scenario will be announced. This organizational meeting will also be webcast live.

    This will be the thirty-seventh special session of the Human Rights Council. On 28 November 2008, the Council held a special session on the situation of human rights in the east of the Democratic Republic of the Congo.   • MIL-OSI Europe: Answer to a written question – Humanitarian and infrastructural crisis in Cuba – E-002542/2024(ASW)

    In 2024, the Commission allocated a total of EUR 4.4 million in humanitarian assistance to Cuba. The Commission has closely followed the impacts of recent hurricanes and earthquakes, compounding an already dire situation in the country. A humanitarian expert was deployed to assess the needs after the disasters stroke.

    The Commission supported the emergency response with further EUR 3.9 million. In addition, it deployed a humanitarian airbridge to transport more than 100 tons of humanitarian supplies from the United Nations, EU, and Spanish stocks in five flights, providing relief to populations affected by hurricane Oscar.

    Furthermore, it allocated EUR 500 000 in humanitarian aid to respond to urgent health needs due to medicine shortages across the country. The EU stands ready to provide additional humanitarian aid based on assessments of new needs.

    In a longer-term perspective, the EU will continue to provide support under the Multiannual Indicative Programme 2021-2027[1] and through the Global Gateway[2] to strengthen development and resilience. This includes programmes in crucial sectors such as water and sanitation, and energy.

    The EU has a longstanding cooperation in both sectors and through the Global Gateway there is potential for European investments on renewable energy infrastructure.

    The European Parliament,

     having regard to the draft Commission implementing decision authorising the placing on the market of products containing, consisting of or produced from genetically modified maize DP910521 pursuant to Regulation (EC) No 1829/2003 of the European Parliament and of the Council (D102174/03),

     having regard to Regulation (EC) No 1829/2003 of the European Parliament and of the Council of 22 September 2003 on genetically modified food and feed[1], and in particular Article 7(3) and Article 19(3) thereof,

     having regard to the vote of the Standing Committee on Plants, Animals, Food and Feed referred to in Article 35 of Regulation (EC) No 1829/2003, on 22 November 2024, at which no opinion was delivered, and the vote of the Appeal Committee on 17 December 2024, at which again no opinion was delivered,

     having regard to Article 11 of Regulation (EU) No 182/2011 of the European Parliament and of the Council of 16 February 2011 laying down the rules and general principles concerning mechanisms for control by Member States of the Commission’s exercise of implementing powers[2],

     having regard to the opinion adopted by the European Food Safety Authority (EFSA) on 19 June 2024, and published on 1 August 2024[3],

     having regard to its previous resolutions objecting to the authorisation of genetically modified organisms (‘GMOs’)[4],

     having regard to Rule 115(2) and (3) of its Rules of Procedure,

     having regard to the motion for a resolution of the Committee on the Environment, Public Health and Food Safety,

    A. whereas on 27 June 2022, Corteva Agriscience Belgium B.V., based in Belgium, on behalf of Corteva Agriscience LLC, based in the United States, submitted an application to the national competent authority of the Netherlands for the placing on the market of foods, food ingredients and feed containing, consisting of or produced from genetically modified maize DP910521 (the ‘GM maize’);

    B. whereas the GM maize produces the Cry1B.34 toxin and is resistant to the herbicide glufosinate;

    C. whereas glufosinate is classified as toxic to reproduction 1B and therefore meets the ‘cut-off criteria’ set out in Regulation (EC) No 1107/2009 of the European Parliament and of the Council[5]; whereas the approval of glufosinate for use in the Union expired on 31 July 2018;

    D. whereas Cry1B.34 is a synthetic fusion protein combining Cry1B, Cry1Ca1 and Cry9Db1, engineered for insect resistance against lepidopteran pests, without demonstrated specificity to target species;

    E. whereas the genetic modification includes a two-step process using CRISPR/Cas9 to insert a ‘landing pad’, followed by microprojectile bombardment for gene expression cassette insertion;

    Lack of assessment of the complementary herbicide

    F. whereas Commission Implementing Regulation (EU) No 503/2013[6] requires an assessment of whether the expected agricultural practices influence the outcome of the studied endpoints; whereas, according to that Implementing Regulation, this is especially relevant for herbicide-tolerant plants;

    G. whereas the vast majority of GM crops have been genetically modified so that they are tolerant to one or more ‘complementary’ herbicides which can be used throughout the cultivation of the GM crop, without the crop dying, as would be the case for a non-herbicide tolerant crop; whereas a number of studies show that herbicide-tolerant GM crops result in a higher use of complementary herbicides, in large part because of the emergence of herbicide-tolerant weeds[7];

    H. whereas herbicide-tolerant GM crops lock farmers into a weed management system that is largely or wholly dependent on herbicides, and does so by charging a premium for GM seeds that can be justified only if farmers purchasing such seeds also spray the complementary herbicides; whereas heightened reliance on complementary herbicides on farms planting the GM crops accelerates the emergence and spread of weeds resistant to those herbicides, thereby triggering the need for even more herbicide use, a vicious circle known as ‘the herbicide treadmill’;

    I. whereas the adverse impacts stemming from excessive reliance on herbicides will worsen as regards soil health, water quality, and above and below ground biodiversity, and lead to increased human and animal exposure, potentially also via increased herbicide residues on food and feed;

    J. whereas assessment of herbicide residues and metabolites found on GM plants is considered outside the remit of the EFSA Panel on Genetically Modified Organisms (‘EFSA GMO Panel’) and is therefore not undertaken as part of the authorisation process for GMOs;

    Outstanding questions concerning Bt toxins

    K. whereas a number of studies show that side effects have been observed that may affect the immune system following exposure to Bt toxins and that some Bt toxins may have adjuvant properties[8], meaning that they can increase the allergenicity of other proteins with which they come into contact;

    L. whereas a scientific study found that the toxicity of Bt toxins may also be increased through interaction with residues from spraying with herbicides, and that further studies are needed on the combinatorial effects of ‘stacked’ events (GM crops which have been modified to be herbicide-tolerant and to produce insecticides in the form of Bt toxins)[9]; whereas assessment of the potential interaction of herbicide residues and their metabolites with Bt toxins is, however, considered to be outside the remit of the EFSA GMO Panel and is, therefore, not undertaken as part of the risk assessment;

    Bt crops: effects on non-target organisms

    M. whereas, unlike the use of insecticides, where exposure is at the time of spraying and for a limited period afterwards, the use of Bt GM crops leads to continuous exposure of the target and non-target organisms to Bt toxins;

    N. whereas the assumption that Bt toxins exhibit a single target-specific mode of action can no longer be considered correct and effects on non-target organisms cannot be excluded; whereas an increasing number of non-target organisms are reported to be affected in many ways;

    Member State and stakeholder comments

    O. whereas Member States submitted many critical comments to EFSA during the three-month consultation period[10], including that the list of relevant studies, identified in the literature review of the applicant, did not include studies on the fate of Bt proteins in the environment or on potential effects of Btcrop residues on non-target organisms even though such studies exist;

    P. whereas field trials conducted for compositional and phenotypic analysis of the GM maize failed to consider diverse environmental conditions and genetic backgrounds relevant to its cultivation, particularly in countries like Brazil;

    Q. whereas the toxicity assessment of Cry1B.34 does not account for combinatorial effects with plant constituents or residues from herbicide applications;

    R. whereas glufosinate, the complementary herbicide, is associated with significant risks to biodiversity, soil and water quality, and long-term ecosystem health;

    S. whereas the risk of gene flow to wild relatives such as teosinte, reported in Spain and France, raises concerns about transgene persistence and environmental impacts;

    T. whereas the monitoring requirements under Implementing Regulation (EU) No 503/2013 are inadequately addressed, with no independent verification of data provided;

    Ensuring a global level playing field and upholding the Union’s international obligations

    U. whereas the conclusions of the Strategic Dialogue on the Future of EU Agriculture[11] call on the Commission to reassess its approach on market access for agri-food imports and exports, given the challenge of diverging standards of the Union and its trading partners; whereas fairer trade relations, on a global level, coherent with goals for a healthy environment, were one of the main demands of farmers during the demonstrations of 2023 and 2024;

    V. whereas a 2017 report by the United Nations’ (UN) Special Rapporteur on the right to food found that, particularly in developing countries, hazardous pesticides have catastrophic impacts on health[12]; whereas the UN Sustainable Development Goal (‘UN SDG’) Target 3.9 aims by 2030 to substantially reduce the number of deaths and illnesses from hazardous chemicals and air, water and soil pollution and contamination[13];

    W. whereas the Kunming-Montreal Global Biodiversity Framework, agreed at the COP15 of the UN Convention on Biological Diversity (‘UN CBD’) in December 2022, includes a global target to reduce the risk of pesticides by at least 50 % by 2030[14];

    X. whereas Regulation (EC) No 1829/2003 states that GM food or feed must not have adverse effects on human health, animal health or the environment, and requires the Commission to take into account any relevant provisions of Union law and other legitimate factors relevant to the matter under consideration when drafting its decision; whereas such legitimate factors should include the Union’s obligations under the UN SDGs and the UN CBD;

    Reducing dependency on imported feed

    Y. whereas one of the lessons from the COVID-19 crisis and the still ongoing war in Ukraine is the need for the Union to end the dependencies on some critical materials; whereas in the mission letter to Commissioner Christophe Hansen, Commission President Ursula von der Leyen asks him to look at ways to reduce imports of critical commodities[15];

    Undemocratic decision-making

    Z. whereas, in its eighth term, Parliament adopted a total of 36 resolutions objecting to the placing on the market of GMOs for food and feed (33 resolutions) and to the cultivation of GMOs in the Union (three resolutions); whereas, in its ninth term, Parliament adopted 38 resolutions objecting to placing GMOs on the market and has adopted another 8 resolutions objecting to placing GMOs on the market already in the current 10th term ;

    AA. whereas despite its own acknowledgement of the democratic shortcomings, the lack of support from Member States and the objections of Parliament, the Commission continues to authorise GMOs;

    AB. whereas no change of law is required for the Commission to be able not to authorise GMOs when there is no qualified majority of Member States in favour in the Appeal Committee[16];

    AC. whereas the vote on 22 November 2024 of the Standing Committee on Plants, Animals, Food and Feed referred to in Article 35 of Regulation (EC) No 1829/2003 delivered no opinion, meaning that the authorisation was not supported by a qualified majority of Member States; whereas the vote on 17 December 2024 of the Appeal Committee again delivered no opinion;

    1. Considers that the draft Commission implementing decision exceeds the implementing powers provided for in Regulation (EC) No 1829/2003;

    2. Considers that the draft Commission implementing decision is not consistent with Union law, in that it is not compatible with the aim of Regulation (EC) No 1829/2003, which is, in accordance with the general principles laid down in Regulation (EC) No 178/2002 of the European Parliament and of the Council[17], to provide the basis for ensuring a high level of protection of human life and health, animal health and welfare, and environmental and consumer interests, in relation to GM food and feed, while ensuring the effective functioning of the internal market;

    3. Calls on the Commission to withdraw its draft implementing decision and to submit a new draft to the committee;

    4. Calls on the Commission to ensure convergence of standards between the Union and its partners in free trade agreement negotiations, in order to meet Union safety standards;

    5. Calls on the Commission not to authorise the GM maize due to the increased risks to biodiversity, food safety and workers’ health in line with the One Health approach;

    6. Expects the Commission, as matter of urgency, to deliver on its commitment[18] to come forward with a proposal to ensure that hazardous chemicals banned in the Union are not produced for export;

    7. Welcomes the fact that the Commission finally recognised, in a letter of 11 September 2020 to Members, the need to take sustainability into account when it comes to authorisation decisions on GMOs[19]; expresses its deep disappointment, however, that, since then the Commission has continued to authorise GMOs for import into the Union, despite ongoing objections by Parliament and a majority of Member States voting against;

    8. Urges the Commission, again, to take into account the Union’s obligations under international agreements, such as the Paris Climate Agreement, the UN CBD and the UN SDGs; reiterates its call for draft implementing acts to be accompanied by an explanatory memorandum explaining how they uphold the principle of ‘do no harm’[20];

    9. Instructs its President to forward this resolution to the Council and the Commission, and to the governments and parliaments of the Member States.

  • MIL-OSI Europe: EIB Board approves €2.4 billion of financing for business innovation, energy grids, flood resilience and transport

    The European Investment Bank (EIB) today approved €2.4 billion of new financing for business investment, clean energy, transport, telecommunications and flood protection in Europe.

    The EIB Board of Directors also discussed the strategic orientation of EIB Global. Reflecting the changing geopolitical context and even better aligning with EU external policy priorities, the Bank’s investments outside of the EU will continue contribute to a stronger Europe in a more stable, more prosperous and sustainable world.

    The Board examined ways to further increase support for electricity networks in Europe. In 2024, the Bank mobilised over €100 billion of additional investment for energy and financed a record high of €8.5 billion for electricity grids, which mobilised 40% of total EU investment in electricity grids.

    “We are ahead of the investment targets of the RePowerEU programme to bring cheaper and clean energy to European households and businesses. Last year the EIB marked a record in investment in energy grids and inter connectors, to bolster Europe’s competitiveness and security”, said EIB Group President Nadia Calviño.

    Energy networks, flood defences

    The first EIB Board of Directors of the year approved financing totalling €791 million to expand hydrogen production for transport, strengthen electricity distribution, and improve flood protection in Poland.

    This includes funding to boost research into and development of hydrogen and to increase the number of hydrogen refueling stations for cars and trucks.

    In support of Ukraine, the Board paved the way for financing of €100 million to repair damaged municipal heating infrastructure in the country.

    Outside the EU, the EIB agreed to provide financing to upgrade and extend electricity distribution in Panama. The goal is to increase renewable/energy use, bolster grids and expand power distribution to unserved communities in the country.

    Green innovation

    The Board also approved financing totalling €879 million for innovation and investment by businesses to improve energy efficiency and environmental sustainability.

    This includes backing automotive-component research and development at 15 manufacturing sites across Europe and low-carbon glass production in France and Spain.

    The EIB endorsed a new securitisation scheme to support Dutch business investment in climate action and environmental sustainability.

    Better connections

    The Board agreed €768 million in financing for transport and telecom networks in the EU and beyond.

    In Colombia, the Board approved EUR 418 million for construction of and the acquisition of trains for Metro Line 1 in the capital Bogota – a service expected to carry more than 1 million passengers a day when operational.

    The Board also gave the green light for financing of €350 million to expand mobile-phone networks across Italy.

  • MIL-OSI United Nations: ‘No Appetite for Another Extension’ of South Sudan Peace Agreement, Mission Head Tells Security Council, Urging Leaders Focus on Benchmarks without Delay

    The Revitalized Peace Agreement in South Sudan is facing challenges due to low political will, trust deficit among the parties to the accord and lack of predictable funding, the Security Council heard today from senior officials assisting peacebuilding in that country.

    Charles Tai Gituai, Interim Chairperson of the Reconstituted Joint Monitoring and Evaluation Commission — the official oversight body responsible for monitoring and evaluating the status of implementation of the 2018 Revitalized Peace Agreement — said that the parties in September 2024 agreed to extend the transitional period from 22 February 2025 to 22 February 2027, with elections rescheduled to December 2026.  While the National Election Commission has completed its plans and has opened offices in the 10 states, financial constraints remain a hindrance in election preparations.

    Further, election laws stipulate that parties with armed forces cannot be registered until they relinquish their forces — this includes the Sudan People’s Liberation Movement/Army in Opposition and others within the South Sudan Opposition Alliance, he said.  This underscores the need to hasten the unification of forces so that these parties can participate in the elections.  Also expressing concern about persistent levels of intercommunal violence in some parts of the country, he noted that the Sudan conflict exacerbates the humanitarian situation and has caused a huge influx of returnees and refugees in South Sudan.  Further, oil production — the country’s main source of foreign earnings — was disrupted in the second quarter of 2024 because of that conflict.

    Welcoming the work of the National Constitutional Amendment Committee and the Judicial Reform Committee, he said “the success of these institutions demonstrates that with funding availability, the Peace Agreement institutions and mechanisms can fully discharge their mandates”.  The permanent ceasefire continues to hold, though recent skirmishes in Western Equatoria State are concerning.  Commending the mediation talks ongoing in Nairobi, he said:  “The people of South Sudan are looking forward to a positive outcome for these talks and hoping that it will bring practical and enhanced transformative approaches in addressing the root causes of conflict.”  The Council must consider a visit to South Sudan to mobilize resources and political support to help South Sudan achieve its first democratic elections in December 2026, he added.

    Also addressing the Council was Nicholas Haysom, Special Representative of the Secretary-General and Head of the United Nations Mission in South Sudan (UNMISS), who noted that this month marks the beginning of the fourth extension of the Revitalized Peace Agreement.  “There is no appetite for another extension,” he stressed.  Rather, “there is strong desire for the leaders to focus on the benchmarks set out in the Peace Agreement without further delay”.  Urging parties to engage constructively, he acknowledged progress in some areas and welcomed the declarations of Governors to expand the civic and political space in their states.  Also noting expanded access to justice, including through mobile courts, he pointed to the adoption of a national community violence reduction strategy.  The National Elections Commission has launched its website and is rolling out a voter education strategy.

    However, none of these achievements “are sufficient to significantly move the needle” on the critical conditions required for holding elections and adopting a new constitution, he added.  Stressing the importance of “low-hanging fruit” measures such as voter registration, he reiterated that “the clock is already ticking on the extended transitional period”.  Noting that constitution and census timelines do not fit into the framework for a December 2026 election, he added:  “we have not yet seen the previously promised harmonized work plan with an operational timetable for elections.”  The lack of Government funding is slowing down these processes, he said, underscoring that “neither UNMISS nor the international community or the electoral management bodies can provide the full measure of support if these critical decisions are not taken.”

    “My country is struggling to transition from instability to stability through implementation of the R-ARCSS [Revitalised Agreement on the Resolution of the Conflict in South Sudan],” observed Edmund Yakani, Executive Director of the Community Empowerment for Progress Organization. Noting that the Tumani Initiative under Kenya’s co-mediation provides an opportunity for transitioning the country from violence to peace, he added:  “We are impressed by the process of embracing inclusive Government”.  The only option for a peaceful transition is through elections, he said, pointing to the citizens’ disappointment over the last elections postponement.  Noting that deadly intercommunal violence poses a challenge for the country’s transition, he said that elections will be credible if the Government creates conditions for holding them.

    For her part, the representative of South Sudan acknowledged the concerns about delays in the transition process and assured the Council that “every effort is being made to accelerate key milestones, particularly the preparations for free, fair and credible elections”.  Her Government is committed to providing the necessary funding and institutional support to advance the electoral process and has taken significant steps to draft a permanent constitution “that will reflect the aspirations of the South Sudanese people”, she pledged.  The deployment of the Necessary Unified Forces remains a priority, and South Sudan is working to overcome logistical and financial challenges to complete Phase II of training and deployment, she added.

    Urging all parties, including opposition groups, to negotiate in good faith within the framework of the Revitalized Agreement rather than seeking a parallel process that could complicate the peace road map, she expressed concern about the deteriorating situation in Sudan.  Recalling her country’s appeals to Sudan to cease harbouring rebels who actively destabilize its security efforts, she said this plea has gone unanswered.  “The people of South Sudan have been deeply affected by videos depicting heartless killings” of their nationals, she said, adding that these are believed to be incited by General Yassir Al-Atta, Assistant to the Commander in Chief, who claimed that 65 per cent of the Rapid Support Forces are South Sudanese.  Despite the anger provoked by this, her Government continues to call for restraint from its people, she said.

    As Council members weighed in, they stressed the need to advance progress towards elections.  The representative of Sierra Leone, also speaking for Algeria, Guyana and Somalia, highlighted the need for a credible and inclusive electoral process.  For that, security sector reform and disarmament, demobilization and reintegration of armed groups remains crucial.  He also called for urgent action to finalize transitional security arrangements and establish a middle command structure for the Necessary Unified Forces.  While the electoral road map’s implementation is critical for elections, consideration should be given to the participation of internally displaced people and returnees, he pointed out.

    Pakistan’s delegate, noting that elections have been rescheduled to take place in 2026, encouraged South Sudan to use the two-year extension to move towards a credible path to elections.  “This extension must not become a missed opportunity”, Greece’s delegate said, while Slovenia’s delegate urged the Government to secure the necessary funding for timely implementation of the Revitalized Peace Agreement.  “Promises must be turned into reality,” said Denmark’s representative, also calling for a clear elections plan and resources for election-related bodies.

    The representative of the United States said the transitional Government failed to conclude the transitional period and use public revenue transparently for public needs.  Despite significant international support, South Sudan’s President and other political leaders “have not demonstrated political will to seriously move towards elections”, he observed, adding:  “In fact, they have made efforts worse.”  While the 2005 Comprehensive Peace Agreement was a “pivotal moment in South Sudan’s history that brought hope to a people long ravaged by war and oppression”, two decades later, that country’s leaders failed to meet their people’s expectations.  He called on the transitional Government to start using public revenues for appropriate public purposes rather than to benefit the “small corrupt elite”.

    Panama’s delegate was one among several Council members who expressed concern over persisting sexual and gender-based violence, noting that women and girls, as young as 11, have fallen victims to this crime.  Hence, the Mission’ work is crucial, he stressed, highlighting the need for the equitable participation of women, young people and communities in peacebuilding.  The representatives of the Republic of Korea and France also expressed support for UNMISS, highlighting its many crucial roles, which range from enabling humanitarian assistance to assisting with election preparations.

    China’s delegate, Council President for February, speaking in his national capacity, said that, prior to the meeting, his country, using virtual technologies, conducted an underground inspection of the Mission’s work.  A new “batch” of Chinese peacekeepers have recently completed their rotation and handover, he reported.  He welcomed South Sudan’s steps towards elections and called on the international community to respect its sovereignty and ownership.  Further, “sanctions, such as arms embargo, are constraining security capacity building in South Sudan and should be adjusted or lifted”, he stressed.

    Along similar lines, the Russian Federation’s delegate said that sanctions make it difficult to strengthen South Sudan’s security and called for a review of the parameters of the arms embargo.  Voting issues are South Sudan’s internal affairs, he observed, adding that the country’s leadership has managed to establish relative stability and attain progress in State-building and resolving security issues.

    WASHINGTON, D.C. — Today, House Democratic Caucus Chair Pete Aguilar and Vice Chair Ted Lieu held a press conference on House Republicans’ failure to lower the high cost of living while prioritizing stealing taxpayer dollars from vital programs to pay for tax giveaways to billionaires.

    CHAIRMAN AGUILAR: Good morning. House Democrats had a productive Caucus this morning. Leader Jeffries laid out our path forward as we push back against the chaos and the corruption that we’ve seen from Donald Trump’s White House. 

    One thing is clear: with Trump and Republicans in control, America will be less safe and more expensive. We are less safe because an unelected billionaire with controversial ties to China has access to personal information for every American, including potentially tax and Social Security information. We’re less safe because President Trump released violent criminals into our communities, some with records of domestic violence, rape and attacking police officers. We are less safe because hundreds of FBI agents are on the verge of being fired for not being sufficiently loyal to Donald Trump. Women who serve in the military are less safe today because of an executive order Donald Trump signed preventing them from traveling across state lines to seek abortion care. 

    America is more expensive because egg prices are at an all time high, and Republicans in Congress have not taken a single step to reduce the cost of living. The reckless Republican tariffs will increase costs for households by $1,200 each year. Everything from groceries to alcohol to lumber used to build homes will be more expensive. The Republican rip off will increase health care costs by stealing from Medicaid to pay for tax cuts for billionaires and corporations. 

    The American people voted for solutions to their economic challenges and instead got a corrupt White House in an America that is less safe and more expensive. Vice Chair Ted Lieu. 

    VICE CHAIR LIEU: Thank you, Chairman Aguilar. Leader Jeffries has laid out a 10-point plan to fight back against the lawless actions of the Trump Administration. That plan has three themes. There’s going to be a legislative strategy, a mobilization strategy and a litigation strategy. To that end, over 25 lawsuits have already been filed. We expect that a number of these actions by the Trump Administration will be reversed because all the courts have to do is follow the law. And in fact, if you look at what happened, a number of Trump’s actions have been stopped or the Administration has simply folded. 

    The Administration wants you to think that they are invincible, that they are just rolling right along and doing all these things. That is simply not true. A number of times they have been stopped, and they have had to back down. So, for example, on the birthright citizenship order, a Reagan-appointed federal judge declared it unconstitutional, put an injunction on it. And then with the OMB freeze memo, there was pushback from Democrats, from the American people, and they had to rescind that memo, and a judge also declared that memo to be illegal. And then most recently, you saw Trump’s signature issue, the tariffs. He backed out because of the reaction from the stock market and the reaction from the American people. Basically, Canada and Mexico are doing what they said they were already going to do. So essentially, Donald Trump simply folded on that issue. So, I want people to understand their power to shape public sentiment. 

    And not only are the Trump Administration’s actions ludicrous, they are harming people. So, I’ll end on this example: In California, Donald Trump ordered the Army Corps of Engineers to release a whole bunch of water from these dams when no one needed it. So, over 2 billion gallons of water has now been wasted in California. This water from Northern California isn’t even going down to Southern California. It’s largely going to evaporate when farmers don’t need it, and so Republican Congressman David Valadao is going to have to answer to his farmers when in the summer months, they need water and they don’t have enough. 

    Those are the harmful actions of this Administration, and I want people to understand that pushing back against this Administration gets them to fold.

    United States Attorney Clint Johnson today announced the results of the February Federal Grand Jury 2024-A Indictments.

    The following individuals have been charged with violations of United States law in indictments returned by the Grand Jury. The return of an indictment is a method of informing a defendant of alleged violations of federal law, which must be proven in a court of law beyond a reasonable doubt to overcome a defendant’s presumption of innocence.

    Derrick Adams. Felon in Possession of a Firearm; Possession of Marijuana with Intent to Distribute; Maintaining a Drug-Involved Premises. Adams, 45, of Tulsa, is charged with possessing a firearm, knowing he was previously convicted of a felony.  He is further charged with knowingly possessing marijuana with intent to distribute and maintaining a residence for the purpose of drug distribution. The Drug Enforcement Administration and the Oklahoma Bureau of Narcotics are the investigative agencies. Assistant U.S. Attorney Attila Bogdan is prosecuting the case. 25-CR-036

    Odon Ambros-Cagan. Unlawful Reentry of a Removed Alien. Ambros-Cagan, 24, a Mexican national, is charged with unlawfully reentering the United States after having been previously removed in Mar. 2020.     Brandon Allen Boone. First Degree Burglary in Indian Country; Assault of an Intimate/Dating Partner by Strangling and Attempting to Strangle in Indian Country; Attempted Witness Tampering by Corrupt Persuasion. Boone, 25, of Bristow and a member of the Muscogee (Creek) Nation, is charged with breaking into an occupied home and strangling an intimate dating partner. Further, Boone attempted to prevent the victim from speaking with law enforcement officials. The Bureau of Indian Affairs and the Bristow Police Department are the investigative agencies.     Dylan Lee Boyd. Aggravated Sexual Abuse by Force and Threat in Indian Country; Sexual Abuse of a Minor in Indian Country; Abusive Sexual Contact with a Minor in Indian Country; Commission of Felony Sex Offense Involving a Minor by a Registered Sex Offender (superseding). Boyd, 27, of Quapaw and a member of the Miami Tribe of Oklahoma, is charged with knowingly engaging in a sexual act by force and threat with a minor victim under 16 years old in Nov. 2020.  He allegedly knowingly engaged in sexual abuse and abusive sexual contact with the minor victim. Boyd is further charged with committing a felony offense with a minor while being required to register as a sex offender. The Quapaw Nation Marshals Service is the investigative agency.     Luis Fernando Contreras-Luviano. Unlawful Reentry of a Removed Alien.   • MIL-OSI Security: Leader of Drug Trafficking Organization Sentenced to 21 Years in Federal Prison

    SAN ANTONIO – A Honduran national was sentenced in a federal court in San Antonio today to 262 months in prison for his role as a leader of a drug trafficking organization.

    According to court documents, Marco Antonio Morales-Perez, 51, along with Pablo Torres-Zaragoza aka Jose Juan Zaragoza-Cardenas, 42, of Mexico, continued to lead an organization that trafficked methamphetamine and heroin to San Antonio and other areas of south Texas while they were both incarcerated at the Great Plains Correctional Institution in Hinton, Oklahoma on prior federal charges. Morales-Perez and Torres-Zaragoza used contraband cell phones that had been smuggled into the facility by drone to facilitate, broker and coordinate narcotics deliveries, relying on various contacts, acquaintances and intermediaries to ultimately accomplish the deliveries. Ultimately, more than 160 kgs of methamphetamine and 12 kgs of heroin was seized as part of the Drug Enforcement Administration’s investigative efforts.

    “The significant sentences of these two leaders of this sophisticated drug trafficking organization sends a strong message that we are equipped to investigate and infiltrate complex organizations to hold accountable those at the highest levels who are having dangerous drugs delivered to our community,” said U.S. Attorney Jaime Esparza for the Western District of Texas. “I’d also like to thank the many local law enforcement agencies along with state and federal partners who have provided the essential investigative support to help prosecute these drug traffickers.”

    Torres-Zaragoza was sentenced Dec. 4, 2024 to 262 months in federal prison. Five additional co-defendants indicted alongside Morales-Perez have also been sentenced. Jesus Alfredo Palacios was sentenced to 150 months in prison; Juan Del Hoyo was sentenced to 120 months imprisonment; Manuel Montoya received a 34-month prison sentence; Jose Adam Alejandre-Navarro was sentenced to 108 months; and Israel Villegas Alcantar received a federal prison sentence of 47 months.

    The DEA investigated the case with valuable assistance from San Antonio High Intensity Drug Trafficking Areas (HIDTA), the San Antonio Police Department, Bexar County Sheriff’s Office, Great Plains Correctional Facility, Hollywood Park Police Department, Castle Hills Police Department, Live Oak Police Department, Leon Valley Police Department, Texas Department of Public Safety, U.S. Marshals Service, and the Houston Police Department.

    Assistant U.S. Attorney Eric Fuchs prosecuted the case.

    This case resulted from the work of an Organized Crime Drug Enforcement Task Forces (OCDETF) investigation. OCDETF identifies, disrupts, and dismantles the highest-level drug traffickers, money launderers, gangs, and transnational criminal organizations that threaten the United States by using a prosecutor-led, intelligence-driven, multi-agency approach that leverages the strengths of federal, state, and local law enforcement agencies against criminal networks.

    Warren Questions Greer on Trade Agenda, Tariff Exemptions for Trump’s Allies and Special Interests

    “Tariffs are an important strategic economic tool, but Donald Trump’s desire to start and stop random trade wars will not protect jobs, keep Americans safe, or bring down costs for families.”

    Washington, D.C. – U.S. Senator Elizabeth Warren (D-Mass.), Ranking Member of the Senate Committee on Banking, Housing, and Urban Affairs (BHUA) and member of the Senate Finance Committee, wrote to Jamieson Greer, nominee to be U.S. Trade Representative (USTR), ahead of his February 6, 2025 confirmation hearing, probing his views on trade. Senator Warren asked Mr. Greer to address her concerns with the administration’s tariff strategy, corporate influence over trade agreements, corporations offshoring of jobs, and other trade-related concerns. 

    The USTR is responsible for developing and promoting the U.S. trade agenda and leading trade negotiations on behalf of the U.S., playing a critical role in the economy. This week, the Trump administration announced new tariffs on Canada, Mexico, and China. During the last Trump administration, corporations and their lobbyists abused tariff exclusion loopholes to receive secretive exemptions from President Trump and his trade team. The Commerce Department’s Inspector General found that the process for receiving an exemption was “neither transparent nor objective.”

    “(T)he President does not appear to have a strategic plan in place to ensure that his proposed tariffs are implemented in a way that secures wins for hardworking Americans and precludes carveouts for special interests,” wrote Senator Warren. “Instead, he has threatened, and withdrawn tariff threats in a chaotic and haphazard manner that has only resulted in uncertainty for American consumers, workers, and manufacturers, as well as our allies.”

    Large multinational companies have also gained outsized influence in trade negotiations and trade disputes. For decades, membership of the trade advisory committee has leaned heavily in favor of billionaire corporations and their industry associations, and Investor-State Dispute Settlement (ISDS) provisions have allowed corporations to sue governments—including the United States—for pursuing public policies they may disagree with. Senator Warren encouraged Mr. Greer to pursue the removal of ISDS provisions from trade agreements with U.S. allies. 

    Senator Warren also wrote that she believes large corporations have too many incentives to move jobs and manufacturing abroad. “In order to reverse the negative effects offshoring has had on the American economy, the Administration must invest in domestic industry and eliminate incentives for corporations to hide their profits abroad,” the senator wrote

    Senator Warren also expressed support for the Trade Adjustment Assistance (TAA) program to help American workers whose jobs are displaced by trade. “Renewing TAA is a no-brainer, and I hope you will support it to make sure that workers at home get a fair deal,” said Senator Warren.

    In order to better understand Mr. Greer’s approach to trade, Senator Warren asked him to prepare to answer questions on his vision for the Trump administration’s trade agenda on February 6, 2025, the date of his confirmation hearing.

  • MIL-OSI Security: USS St. Louis (LCS-19) Supports Operation Southern Guard at Naval Station Guantanamo Bay

    The Freedom-variant littoral combat ship USS St. Louis (LCS 19) is moored at U.S. Naval Station Guantanamo Bay (NSGB) and the crew is supporting the expansion of the base’s Migrant Operations Center as part of Operation Southern Guard.

    At the direction of the President of the United States to the Department of Homeland Security (DHS) and the Department of Defense (DOD), U.S. military service members are supporting removal operations led by DHS at NGSB. U.S. Southern Command has set up a Joint Task Force Migrant Operations (JTF-MIGOPS) at the Naval Station to execute the directive.

    The USS St. Louis is currently deployed to the Caribbean conducting counter-illicit drug trafficking operations in support of Joint Interagency Task Force South (JIATF-South), and participating in operations with partner nations in support of U.S. Naval Forces Southern Command/U.S. 4th Fleet. USS St. Louis arrived at NSGB on January 30, and the crew has been steadily assisting ever since.

    At the direction of the President of the United States, and in coordination with the Department of Homeland Security and the Department of Defense, U.S. Army South has assumed responsibility as the lead Joint Task Force for ongoing illegal alien holding operations at Naval Station Guantanamo Bay, Cuba.

    Under the command of Maj. Gen. Phil Ryan, USARSOUTH will oversee the establishment and management of facilities supporting DHS-led operations.

    More than 300 U.S. military personnel are currently deployed to support the mission, including elements from USARSOUTH, U.S. Southern Command, and U.S. Marine Corps units. These forces will provide operational support, security, and logistical assistance as part of the broader interagency effort.

    As the land component of USSOUTHCOM, USARSOUTH remains committed to executing its mission in support of national security objectives while working alongside DHS and other federal agencies.

    In 1972, the US meteorologist Edward Lorenz asked a now-famous question:

    Does the flap of a butterfly’s wings in Brazil set off a tornado in Texas?

    Over the next 50 years, the so-called “butterfly effect” captivated the public imagination. It has appeared in movies, books, motivational and inspirational speeches, and even casual conversation.

    The image of the tiny flapping butterfly has come to stand for the outsized impact of small actions, or even the inherent unpredictability of life itself. But what was Lorenz – who is now remembered as the founder of the branch of mathematics called chaos theory – really getting at?

    A simulation goes wrong

    Our story begins in the 1960s, when Lorenz was trying to use early computers to predict the weather. He had built a basic weather simulation that used a simplified model, designed to calculate future weather patterns.

    One day, while re-running a simulation, Lorenz decided to save time by restarting the calculations from partway through. He manually inputted the numbers from halfway through a previous printout.

    But instead of inputting, let’s say, 0.506127, he entered 0.506 as the starting point of the calculations. He thought the small difference would be insignificant.

    He was wrong. As he later told the story:

    I started the computer again and went out for a cup of coffee. When I returned about an hour later, after the computer had generated about two months of data, I found that the new solution did not agree with the original one. […] I realized that if the real atmosphere behaved in the same manner as the model, long-range weather prediction would be impossible, since most real weather elements were certainly not measured accurately to three decimal places.

    There was no randomness in Lorenz’s equations. The different outcome was caused by the tiny change in the input numbers.

    Lorenz realised his weather model – and by extension, the real atmosphere – was extremely sensitive to initial conditions. Even the smallest difference at the start – even something as small as the flap of a butterfly’s wings – could amplify over time and make accurate long-term predictions impossible.

    Lorenz initially used “the flap of a seagull’s wings” to describe his findings, but switched to “butterfly” after noticing a remarkable feature of the solutions to his equations.

    In his weather model, when he plotted the solutions, they formed a swirling, three-dimensional shape that never repeated itself. This shape — called the Lorenz attractor — looked strikingly like a butterfly with two looping wings.

    Welcome to chaos

    Lorenz’s efforts to understand weather led him to develop chaos theory, which deals with systems that follow fixed rules but behave in ways that seem unpredictable.

    These systems are deterministic, which means the outcome is entirely governed by initial conditions. If you know the starting point and the rules of the system, you should be able to predict the future outcome.

    There is no randomness involved. For example, a pendulum swinging back and forth is deterministic — it operates based on the laws of physics.

    Systems governed by the laws of nature, where human actions don’t play a central role, are often deterministic. In contrast, systems involving humans, such as financial markets, are not typically considered deterministic due to the unpredictable nature of human behaviour.

    A chaotic system is a system that is deterministic but nevertheless behaves unpredictably. The unpredictability happens because chaotic systems are extremely sensitive to initial conditions. Even the tiniest differences at the start can grow over time and lead to wildly different outcomes.

    Chaos is not the same as randomness. In a random system, outcomes have no definitive underlying order. In a chaotic system, however, there is order, but it’s so complex it appears disordered.

    A misunderstood meme

    Like many scientific ideas in popular culture, the butterfly effect has often been misunderstood and oversimplified.

    One common misconception is that the butterfly effect implies every small action leads to massive consequences. In reality, not all systems are chaotic, and for systems that aren’t, small changes usually result in small effects.

    Another is that the butterfly effect carries a sense of inevitability, as though every butterfly in the Amazon is triggering tornadoes in Texas with each flap of its wings.

    This is not at all correct. It’s simply a metaphor pointing out that small changes in chaotic systems can amplify over time, making long-term outcomes impossible to predict with precision.

    Taming butterflies

    Systems that are very sensitive to initial conditions are very hard to predict. Weather systems are still tricky, for example.

    Forecasts have improved a lot since Lorenz’s early efforts, but they are still only reliable for a week or so. After that, small errors or imprecisions in the starting data grow larger and larger, eventually making the forecast inaccurate.

    To deal with the butterfly effect, meteorologists use a method called ensemble forecasting. They run many simulations, each starting with slightly different initial conditions.

    By comparing the results, they can estimate the range of possible outcomes and their likelihoods. For example, if most simulations predict rain but a few predict sunshine, forecasters can report a high probability of rain.

    However, even this approach works only up to a point. As time goes on, the predictions from the models diverge rapidly. Eventually, the differences between the simulations become so large that even their average no longer provides useful information about what will happen on a given day at a given location.

    A butterfly effect for the butterfly effect?

    The journey of the butterfly effect from a rigorous scientific concept to a widely popular metaphor highlights how ideas can evolve as they move beyond their academic roots.

    While this has helped bring attention to a complex scientific concept, it has also led to oversimplifications and misconceptions about what it really means.

    Attaching a metaphor to a scientific phenomenon and releasing it into popular culture can lead to its gradual distortion.

    Any tiny inaccuracies or imprecision in the initial description can be amplified over time, until the final outcome is a long way from reality. Sound familiar?

  • MIL-OSI Security: Illegal Alien Sentenced to Prison for Unlawful Reentry

    BOSTON – An El Salvadoran man living in Chelsea, Mass. was sentenced yesterday in federal court in Boston for unlawful reentry.

    Benancio Martinez-Diaz, 38, was sentenced by U.S. District Court Judge Leo T. Sorokin to four months in prison, to be followed by three years of supervised release. Martinez-Diaz will be subject to deportation upon completion of his sentence. In October 2024, Martinez-Diaz pleaded guilty to one count of unlawful reentry. In July 2024, Martinez-Diaz was indicted by a federal grand jury in this case.

    Between 2006 and 2014, Martinez-Diaz was deported/removed from the United States on five separate occasions. He was most recently removed on or about May 30, 2014. On or about Oct. 8, 2023, Martinez-Diaz was arrested on state charges and Immigration and Customs Enforcement was notified and a detainer was lodged.  

    United States Attorney Leah B. Foley; Michael J. Krol, Special Agent in Charge of Homeland Security Investigations in New England; and Chelsea Police Chief Keith Houghton made the announcement. Assistant U.S. Attorney Suzanne Sullivan Jacobus of the Major Crimes Unit prosecuted the case.

  • MIL-OSI Security: FBI Philadelphia Continues Search for Wanted Fugitive Justin Smith

    The FBI’s Violent Crimes Task Force continues to assist the Philadelphia Police Department with the search for Justin Smith, a convicted felon, wanted for his alleged involvement in the murder of his pregnant 21-year-old girlfriend.  

    She disappeared on March 30, 2021, and her body was found on April 5, 2021. He is alleged to have shot her in the head multiple times, causing her death and the death of her unborn child.   

    On April 9, 2021, Smith was charged with murder and related offenses in the 1st Judicial District in Philadelphia County, Pennsylvania, and a state warrant was issued for his arrest.   

    On August 10, 2023, a federal arrest warrant was issued for Smith in the United States District Court, Eastern District of Pennsylvania, Philadelphia, Pennsylvania, after he was charged with unlawful flight to avoid prosecution. 

    Justin Smith is known to have connections to Greensboro, North Carolina, and New Castle, Delaware. After fleeing Philadelphia in 2021, he was seen in the Little Haiti neighborhood of Miami, Florida, and in Atlanta, Georgia. 

    The FBI is offering a reward of up to $25,000 for information leading to Smith’s location and arrest. 

    Anyone with information on Smith’s whereabouts is asked to contact the FBI at 215-418-4000 or tips.fbi.gov. Tipsters can remain anonymous.

    DALLAS — U.S. Immigration and Customs Enforcement apprehended an illegally present Guatemalan national wanted for murder in his home country when officers arrested Dennis Alexander Valenzuela, 37, Jan. 31 at his home in Fort Worth, Texas.

    “Our officers pursue criminal aliens who attempt to hide in the shadows of our communities daily,” said acting ICE Enforcement and Removal Operations Dallas Field Office Director Joshua Johnson. “The apprehension and pending removal of this individual underscores our dedication to upholding the laws of our country and safeguarding our communities.”

    Valenzuela entered the United States at or near Hidalgo, Texas on June 16, 2021, without an immigration inspection, admission, or parole by an immigration officer. U.S. Border Patrol agents encountered Valenzuela on that same date, and served him a Notice to Appear, pursuant to the Immigration and Nationality Act.

    Valenzuela will be housed at the Prairieland Detention Center in Alvarado, Texas pending removal proceedings.

    WASHINGTON, D.C. – Today, U.S. Senator Maria Cantwell (D-WA), the ranking member of the Senate Committee on Commerce, Science, and Transportation, delivered a speech on the Senate floor calling for the United States to establish new trade agreements with Southeast Asia, the Middle East, and Latin America – and to repudiate the trade philosophy of President Donald Trump, whose proposed tariffs on goods from Canada, Mexico, and China would spark a trade war, drive up costs for American consumers, harm domestic businesses across hundreds of industries, and compromise the United States’ global leadership in the free trade ecosystem.

It’s better to create economic stability than fueling poverty and migration […] Last week, I spoke about additional investments the United States needs to make in Panama, Latin America, and others, to link and modernize bilateral agreements that help us counter China,” Sen.     In her speech, Sen. Cantwell railed against President Donald Trump’s tariff’s proposal, likening his isolationist trade policies to an attempt to make time stand still – a futile goal at any point, but especially during the modern information age, when countries are more interconnected than ever and the United States is locked in an innovation race in artificial intelligence and quantum technology. She also called on the United States to invest in its workforce, research & development, science, and capital investment to modernize its manufacturing and stay competitive.

    “To outcompete our adversaries, we need coalitions, not go-it-alone strategies. Why do we fear this if we think our principles are correct? But somehow the current administration thinks that we’ve been hurt more than we’ve been helped in this global equation, and they want us to believe that somehow there is a win-win situation on tariffs that they can deliver on,” Sen. Cantwell said.

    “Tariffs are a distortion of markets. Tariffs mean we disagree. It very rarely means the disagreement will be resolved quickly. It usually means people will retaliate, and the escalation of that retaliation will hurt consumers so much so that eventually someone will blink,” she continued. “The payers in this dispute, though, are never the government leaders. No, it’s the workers who lose their job. It’s the family that pays higher cost. It’s the community that loses their economic activity and tax revenue.”

    In Washington state: Two out of every five jobs are tied to trade and related industries. In 2023, the state imported $19.9 billion of goods from Canada – primarily oil, gas, lumber, and electrical power — making our northern neighbors Washington state’s largest trade partner. Also in 2023, the state imported $1.7 billion in goods from Mexico, including motor vehicles, vehicle parts, and household appliances.     Sen. Cantwell has remained a steadfast supporter of free trade to grow the economy in the State of Washington and nationwide. Sen. Cantwell was the leading voice in negotiations to end India’s 20% retaliatory tariff on American apples, which devastated Washington state’s apple exports.  India had once been the second-largest export market for American apples, but after then-President Trump imposed tariffs on steel and aluminum in his first term, India imposed retaliatory tariffs in response and U.S. apple exports plummeted.  The impact on Washington apple growers was severe:  apple exports from the state dropped from $120 million in 2017 to less than $1 million by 2023.  In September 2023, India ended its retaliatory tariffs on apples and pulse crops following several years of Sen. Cantwell’s advocacy, which was welcome news to the state’s more than 1,400 apple growers and the 68,000-plus workers they support.

    In May 2023, Sen. Cantwell sent a letter urging the Biden Administration to help U.S. potato growers finally get approval to sell fresh potatoes in Japan. In June 2023, Sen. Cantwell hosted U.S. Sen. Debbie Stabenow (D-MI), then-chair of the Committee on Agriculture, Nutrition, and Forestry, in Washington state for a forum with 30 local agricultural leaders in Wenatchee to discuss the Farm Bill.

    In 2022, Sen. Cantwell spearheaded passage of the Ocean Shipping Reform Act, a law to crack down on skyrocketing international ocean shipping costs and ease supply chain backlogs that raise prices for consumers and make it harder for U.S. farmers and exporters to get their goods to the global market.

    In August 2020, during the height of the COVID-19 pandemic, Sen. Cantwell sent a letter to then-Secretary of Agriculture Sonny Perdue requesting aid funds be distributed to wheat growers. In December 2018, Sen. Cantwell celebrated the passage of the Farm Bill, which included $500 million of assistance for farmers, including those who grow wheat.

    In 2019, Sen. Cantwell helped secure a provision in the $16 billion USDA relief package, ensuring sweet cherry growers could access emergency funding to offset the impacts of tariffs and other market disruptions.

  • MIL-OSI Security: Morgantown Sex Offender Sentenced to 10 Years After Traveling to Mexico to Purchase Child

    CLARKSBURG, WEST VIRGINIA – Scott David Bixler, 43, of Morgantown, West Virginia, was sentenced to the statutory maximum sentence of 120 months imprisonment for failing to update his sex offender registration.  Bixler will serve a lifetime of supervision following his prison sentence.

    Bixler is a convicted sex offender and is required to register under the Sex Offender Registration Act (SORNA) for life.  As part of his registration obligations, he is required to report any international travel. In July of 2023, Bixler fled to Mexico shortly before he was scheduled to appear in state court for sentencing related to criminal convictions for failure to register as a sex offender under West Virginia law.

    When Bixler and his spouse were arrested in Mexico, they possessed two pellet guns, methamphetamine, a cell phone jammer, and a large amount of cash.  The investigation also revealed that the Bixlers were attempting to purchase a young girl while in Mexico.  Fortunately, Mexican authorities thwarted the plan and arrested the couple.

    “The sentence handed down by the Court ensures that the Defendant will be confined in prison for the maximum time allowed by law,” said Acting United States Attorney Randolph J. Bernard.  “I shudder to think what might have happened but for the dedication of AUSA Perri, the federal and state law enforcement agencies, as well as the Mexican authorities.  Our community and children are safer because of their efforts and the sentence imposed.”

    Assistant U.S. Attorney David Perri prosecuted the case on behalf of the government.  The FBI, the U.S. Marshals Services, and the West Virginia State Police investigated this case.

    This case was brought as part of Project Safe Childhood, a nationwide initiative to combat the growing epidemic of child sexual exploitation and abuse launched in May 2006 by the Department of Justice. Led by U.S. Attorneys’ Offices and CEOS, Project Safe Childhood marshals federal, state, and local resources to better locate, apprehend, and prosecute individuals who exploit children via the Internet, as well as to identify and rescue victims.     The Justice Department and DHS will also continue to collaborate and work closely with our counterparts within the Government of Puerto Rico, to include the Puerto Rico Department of Justice, the Puerto Rico Department of Public Safety, the Puerto Rico Police Bureau, and other governmental agencies, as well as municipal police departments to protect our communities from harm.

    The U.S. Attorney’s Office’s implementation of the Executive Order will focus on the apprehension and prosecution of criminal aliens, as well as supporting the prosecution and/or expedited removal from the United States of aliens without legal status. The apprehension and prosecution or removal of aliens includes special interest aliens deemed by the DHS to be from a country that poses a national security or counterintelligence threat.

    “Those aliens who are involved in criminal activity, who are fugitives from justice, who have prior criminal convictions and/or come from nations that pose a threat to our national security, remain a priority for the Department of Justice,” said United States Attorney Muldrow. “We are also fully committed to supporting the efforts of the Department of Homeland Security, and all its components, to make Puerto Rico and the United States safer.”

    “Homeland Security Investigations (HSI) is dedicated to identifying and prosecuting individuals who are illegally present in the United States, ensuring they are swiftly removed to their home countries,” said Rebecca González-Ramos, Special Agent in Charge of HSI San Juan. “The executive order aims to protect the United States from individuals who pose a threat to public safety by committing crimes.”

    “The Drug Enforcement Administration remains resolute in its mission to protect the communities of Puerto Rico and the U.S. Virgin Islands from the devastating impact of drug trafficking and transnational criminal organizations. These criminal networks not only threaten public safety through the distribution of dangerous narcotics but also exploit immigration vulnerabilities to further their illicit enterprises. Through intelligence-driven investigations, collaborative enforcement operations, and strategic partnerships with our federal, state, and local counterparts, the DEA will aggressively target those who pose a threat to our national security and the well-being of our citizens. Our enforcement efforts will focus on identifying, disrupting, and prosecuting individuals and organizations engaged in drug trafficking, money laundering, and violent crime. Additionally, we remain committed to supporting the efforts of the Department of Homeland Security and the Department of Justice in the apprehension and prosecution of criminal aliens involved in drug-related offenses. The DEA Caribbean Division will continue to conduct high-impact operations aimed at preventing narcotics and criminal elements from infiltrating our shores. These enforcement efforts are crucial in ensuring the safety and security of the people of Puerto Rico and the continental United States.     The United States Marshals Service, whose mission includes apprehending federal and state fugitives, will lead an initiative – Operation Homeland – to focus resources and coordinate enforcement operations with DOJ and DHS components on the apprehension of alien fugitives charged with federal and local crimes.

    “Historically, the United States Marshals have played a crucial role in serving our nation by apprehending and removing dangerous fugitives from our communities. In this instance, we have teamed up with our federal law enforcement partners to focus on apprehending non-U.S. citizens who have active criminal warrants. We are confident that these collaborative efforts will lead to safer communities. We encourage all citizens to continue cooperating with our investigations to help locate these fugitives and bring them to justice,” said Wilmer Ocasio-Ibarra, U.S. Marshal District of Puerto Rico.

    As recently announced by Immigration and Customs Enforcement (ICE), on January 30, 2025, the below-listed individuals entered into Puerto Rican waters without inspection and were detained by the CBP. Earlier that day, Coast Guard had previously boarded the sailing vessel Mistress, but the vessel was allowed to continue its voyage to St. Martin.  Instead of going to St. Martin, the S/V Mistress entered U.S. waters without inspection and anchored off La Parguera, where they were arrested and processed for expedited removal by DHS officials, including the United States Border Patrol and Immigration and Customs Enforcement (ICE). Specifically, the following eight individuals were encountered on a private boat off the southwest coast of Puerto Rico:

    “Every day CBP Officers are responsible with determining the admissibility of aliens arriving at our ports of entry.  Foreign travelers requesting entry undergo an inspection and determination of admissibility to the United States, and if they are not admissible, they are returned to their point of embarkation,” indicated Roberto Vaquero, Director of the San Juan Office of Field Operations. “Our officers will be vigilant in determining admissibility and will also inspect authorized presence from passengers in domestic flights as they try to reach the Continental US.”

    “The Ramey Sector of the US Border Patrol remains steadfast in protecting our Caribbean borders and deter irregular migration attempts.  U.S. immigration law makes it a crime to enter or attempt to enter without requesting admission at a port of entry designated for that purpose by immigration officials,” stated Reggie Johnson, Acting Chief Patrol Agent. “Migrants should know that they will face full legal consequences of unlawful entry.”

    “Air and Marine Operations agents and assets will support the whole of government effort to enforce immigration laws and protect our borders from emerging threats,” said Christopher Hunter, Director of the Caribbean Air and Marine Branch. “AMO safeguards our Nation by anticipating and confronting security threats through our aviation and maritime law enforcement expertise, innovative capabilities, and partnerships at the border and beyond.”
