  • MIL-OSI Global: Flock is a refreshing play about the complex reality of growing up in care

    There are over 100,000 children and young people living in care in the UK, either with foster carers, in residential children’s homes or in other settings. Flock, currently playing at the Soho Theatre in London before embarking on a UK tour, follows the lives of two young people who have spent time in care, Robbie (Jamie Ankrah) and his older sister Cel (Gabriella Leonardi).

    The play was written by Lin Coughlan and directed by Jim Pope after three years of development with Raising the Roof, a project working with young people aged 16-25 who have lived in care, to develop fictional narratives informed by their own lives.

    The voices of young people who have lived in care give this play its beating heart. And they’re also vitally important for authentic representation of first-hand care-stories that are notably missing in mainstream media.

    Historically, characters who have grown up in the care system tend to be represented as villains or criminals in popular culture. Think Paul Spector in The Fall, or Loki from the Marvel universe. Exceptions can be found in many heroes in the Marvel comics created by Stan Lee, like Spider-Man or Daredevil.

    Researchers who have first-hand experience of the care system have commented on the prevalence of stigmatising narratives around “damage” and negative stereotypes associated with experience of care, alongside idealised “happy-ever-after” foundling stories.

    Important work is being done to archive the work of creators with experience of the care system and to capture a variety of care stories. However, nuanced work taking into account the complexity of going through the care system is rare and public attitudes reflect harmful misconceptions about young people living in care.

    In England, it’s estimated that at least one in three children who enter care are separated from their siblings. In Flock, Robbie is desperately waiting for his 18th birthday, when he hopes he will be able to live reunited with his sister Cel.

    While Robbie and Cel are not living together, they find ways to connect – taking trips to McDonalds or going bowling. Maintaining connections with siblings, while sometimes complex, can make a big difference to supporting the sense of belonging, mental health and wellbeing experienced by young people in care.

    Cel is one of the only people who shares Robbie’s memories of his nan and their valued moments with her before coming into care. There is evidence that sibling separation has a long-lasting impact for adults with experience of care, associated with complicated feelings of loss. However, when planning for young people’s living arrangements, sibling reunification or connection is not always prioritised.

    Young carers and their siblings

    Sibling reunification is not always easy. While Cel loves Robbie, she often feels more like his parent, and the responsibility of supporting him to manage his emotions while she is still a child weighs heavily on her. Cel might be described as a young carer, taking on daily tasks and personal care for her sibling when adults were not able to do so.

    While young carers who have spent time caring for a sibling do often express feeling more resourceful, greater responsibility and prioritising their sibling’s needs can impact their own wellbeing. Cel dreams of going to university and the freedom of leaving her responsibility as an older sister, even as she loves Robbie and wants the best for him.

    Cel is not the only person that Robbie can rely on. He also has a strong connection with his best friend Miko (Deshaye Gayle) and somewhat reluctantly meets with his personal advisor, Mrs Bosely (Jennifer Daley). As Robbie’s relationship with Cel comes under threat, these connections become especially important.

    Coming into care can cause disruption to more than sibling relationships. Children often lose touch with family, friends and communities and often move school and neighbourhood. Most young people living in care, like Robbie, have had difficult and possibly traumatic early experiences before, during and after moving into care.

    After difficult early experiences, some young people may experience changes to their brain and behaviour that allows them to survive loss, neglect or abuse. These adaptations may look like an increased alertness to danger or an unwillingness to trust others.

    While these changes may help children stay safe when living in unsafe circumstances, they might also make it harder to maintain close relationships. This negative impact of these understandable adaptations on relationships is called “social thinning”. At moments, Robbie’s mistrust is clear – when he fears that Miko is only his friend out of pity or when he finds it hard to accept any support Bosely offers him. However, we also see that the consistent, warm and understanding support of Miko and Bosely helps Robbie to stay connected in his lowest moments.

    This play represents both the very difficult experiences of young people living in care, alongside real moments of joy, strength, hope and connection. Flock provides a refreshing and much-needed story of the complex reality of the lives of young people living in care in the UK, putting real voices at its centre.

    ​​Statistics Jersey have today published the September 2024 Retail Prices Index report. 

    The All Items Retail Prices Index (RPI) is the main measure of inflation in Jersey. It measures the change from quarter to quarter in the price of the goods and services purchased by an average household in Jersey. 

    ​The September report shows:

    • ​the All Items Retail Prices Index (RPI) for Jersey increased by 3.0% to stand at 233.7 (June 2000 = 100)
    • the increase in the RPI was less than that to June 2024 (5.0%); hence the annual rate of inflation decreased by 2.0 percentage points (pp) since last quarter
    • a few groups contributed to the decrease in the annual rate of inflation, most notably the housing group
    • prices in most groups increased and these increases were similar to or less than those over the 12 months to June 2024, which resulted in an overall downward contribution to the annual rate of inflation
    • leisure services which includes entertainment, sport and leisure fees and foreign and UK holidays, was the price group that made the largest contribution to the annual rate of inflation, contributing +0.8 pp to the rate
      • the overall price change in the leisure services price group was lower compared with the 12 months to June 2024, hence its contribution to the change in rate of the RPI was -0.3 pp
    • the increase in the RPI was 7.1 pp smaller than a year ago (10.1% in September 2023)
    • RPI(Y), which measures underlying inflation, increased by 3.3%, which was 0.6 pp smaller than the June 2024 rate (down from 3.9%)
    • RPI(X) increased by 3.5%
    • RPI Pensioners increased by 3.6%
    • RPI Low Income increased by 3.4%
    • annual changes in RPI(X), RPI(Y), RPI Pensioners, and RPI Low Income were 0.6 to 0.8 pp smaller than those in June 2024
    • the rate of inflation in Jersey as measured by the RPI, was 0.4 pp higher than the UK CPIH, which is the broadly comparable headline rate of inflation for the UK

Yet, there is in fact a ‘finger’ to be placed between husband and wife, the ‘finger of God’: the Holy Spirit!”, said Pope Francis this morning, despite the heavy autumn rain, when he returned to St. Peter’s Square for the traditional Wednesday general Audience.The Pope thus continued the cycle of catechisms on the Holy Spirit and today he discussed the action of the third person of the Trinity in the sacrament of marriage.Pope Francis quotes the Fathers of the Church in this regard, in particular Saint Augustine, whose reflections start from the revelation that “God is love”, as we read in the New Testament. Love, said the Pope, presupposes “someone who loves; someone who is loved – and love itself that unites the two. In the Trinity, the Father is, the one who loves, the source and the beginning of everything; the Son is the one who is loved, and the Holy Spirit is the love that unites them”. “The God of Christians is therefore a ‘unique’ but not a solitary God; he is a unity of communion and love.”“What does the Holy Spirit have to do with marriage?” asks Pope Francis. “Very much, perhaps the essential thing, and I will now try to explain why! Christian marriage is the sacrament of the mutual gift of man and woman. This is how it was intended by the Creator. The human couple is therefore the first and most fundamental realization of the communion of love that is the Trinity”.     Key factors contributing to the third quarter of 2024 results included:

    • Total loans increased $661 million, or 12%, over the last 12 months, while growing $207 million, or 3%, on the linked quarter. Broad based loan growth during the quarter included increases in all markets and across all loan categories, with Construction Land & Development (CL&D) growth of $88 million posting the largest gain. The yield earned on loans increased to 6.17% for the third quarter of 2024, benefiting primarily from significant average loan balance growth.
    • Deposit balances expanded $323 million, or 5%, over the last 12 months, with the deposit mix continuing to shift from non-interest bearing and low interest-bearing deposits into higher cost deposits. Non-interest-bearing demand accounts declined $207 million, or 12%, while interest-bearing deposits grew $530 million, or 11%, led by time deposit growth. On the linked quarter, total deposits expanded $157 million, or 2%. Non-interest-bearing demand accounts increased $26 million, or 2%, while total interest-bearing deposit accounts increased $131 million, or 3%.
    • Net interest income increased $3.7 million, or 6%, for the third quarter of 2024 compared to the third quarter a year ago, with net interest margin compressing one basis point to 3.33%. On the linked quarter, net interest income increased $3.0 million, or 5%, while net interest margin expanded 7 basis points to 3.33%.
    • Provision for credit loss expense(1) of $4.3 million was recorded for the third quarter of 2024, primarily attributed to strong loan growth and deterioration within the Federal Reserve Bank’s unemployment rate forecast used in the CECL allowance model. Traditional credit quality statistics remained strong for the quarter.
    • Non-interest income increased $1.9 million, or 8%, over the third quarter of 2023. WM&T income expanded $901,000, or 9%, to $10.9 million, with strong estate fees and improved market conditions more than offsetting a decline in net new business expansion. Treasury management fees grew $304,000, or 12%, over the last 12 months to a record $2.9 million. Card income increased $213,000, or 4% over the third quarter of 2023 consistent with increased transaction volume. Other non-interest income increased $315,000 over the third quarter of 2023, mainly due to increased swap fees collected.
    • Total non-interest expenses increased $1.8 million, or 4%, during the third quarter of 2024 compared to the third quarter of 2023, and decreased $657,000, or 1%, on the linked quarter. Overall, non-interest expenses continued to track closely to management expectations.
    • Tangible common equity per share(3) was $24.58 on September 30, 2024, compared to $23.22 on June 30, 2024, and $20.17 on September 30, 2023.

    Results of Operations – Third Quarter 2024, Compared with Third Quarter 2023

    Net interest income, the Company’s largest source of revenue, increased by $3.7 million, or 6%, to $65.0 million. Strong organic loan growth and correlating interest income expansion contributed to net interest income growth.

    • Total interest income increased by $16.8 million, or 19%, to $105.7 million.
      • Interest income and fees on loans increased $17.5 million, or 22%, over the prior year quarter. Consistent with the $688 million, or 13%, increase in average loans and interest rate expansion, the average quarterly yield earned on loans increased 51 basis points over the past 12 months to 6.17%.
      • Interest income on securities decreased $1.1 million, or 13%, compared to the third quarter of 2023. While average securities balances have declined $235 million, or 14%, over the past 12 months, the rate earned on securities improved three basis points to 2.07%. Over the past 12 months, cash flows from investment portfolio maturities and pay downs have been utilized to fund loan growth and in lieu of redeployment into the portfolio.
      • Interest income on overnight funds increased $306,000, or 19%, consistent with the $24 million quarter over prior year quarter average balance increase.
         
    • Total interest expense increased $13.1 million, or 48%, to $40.7 million, as the cost of interest-bearing liabilities increased 68 basis points to 2.84%. For the sixth consecutive linked quarter end, the pace of expansion of total interest-bearing liability costs has slowed.
      • Interest expense on deposits increased $12.6 million over the past 12 months, as the overall cost of interest- bearing deposits increased to 2.68% in the third quarter of 2024 from 1.88% in the third quarter of 2023. Interest expense expansion was spread over most deposit categories, with time deposits and money market interest expense expanding the most at $5.5 million and $4.1 million, respectively.
      • Interest expense on Federal Home Loan Bank (FHLB) advances increased $292,000, or 6%, with the cost of funds declining 37 basis points to 4.49%. Consistent with third quarter investment securities maturities, the Bank relied less on overnight advances during the third quarter of 2024.

    For the third quarter of 2024, consistent with strong loan growth, a deterioration in unemployment rate projections and a slight increase in net charge-offs, offset by a reduction in specific reserves and other factors within the CECL allowance model, the Company recorded provision expense (1) of $4.3 million for loans. In addition, no provision expense for off balance sheet exposures was recorded. For the third quarter of 2023, the Company recorded $2.3 million in provision expense for loans and $475,000 of provision expense for off balance sheet exposures associated with expansion of C&LD and Commercial & Industrial (C&I) lines of credit.

    Non-interest income increased $1.9 million, or 8%, to $24.8 million compared to the third quarter of 2023.

    • WM&T income ended the third quarter of 2024 at $10.9 million, increasing $901,000, or 9%, over the third quarter of 2023. Despite positive equity market performance and strong estate fee revenue, WM&T income was muted by negative net new business.
    • Compared to the third quarter of 2023, treasury management fees increased $304,000, or 12%, to a record $2.9 million. The consistent treasury management growth has been driven by strong transaction volume, organic growth, modified fee schedules, strong foreign exchange income and new product sales.
    • Card income increased $213,000, or 4%, over the third quarter of 2023. Credit card interchange income and annual merchant incentives drove credit card income to a record $1.7 million. In addition, debit card income also posted growth over the prior period.
    • Other non-interest income, which includes swap fees, letter of credit fees and OREO activity, increased by $315,000. While swap fee income was strong in the third quarter of 2024, the Company’s Insurance Captive, which was not renewed in 2024, contributed approximately $302,000 to other non-interest income in the third quarter of 2023.

    Non-interest expenses, which tracked closely with management expectations, increased $1.8 million, or 4%, compared to the third quarter of 2023, to $48.5 million.

    • Compensation and benefits expense increased $2.3 million, or 9%, compared to the third quarter of 2023, consistent with annual merit-based increases and increased bonus levels, partially offset by lower health insurance claims.
    • Technology and communication expenses, which include computer software amortization, equipment depreciation and expenditures related to investments in technology needed to maintain and improve the quality of customer delivery channels, information security and internal resources, increased $264,000, or 6%, consistent with software upgrades and increased compliance-related expense.
    • Card processing expense increased $208,000, or 13%. Debit card interchange expense increased $103,000 while credit card expense increased $105,000, consistent with transaction growth and fraud mitigation efforts.
    • Amortization of investments in tax credit partnerships declined $323,000 compared to the third quarter of 2023. Effective January 1, 2024, the Bank adopted ASU 2023-02 and began booking tax credit amortization expense for all income tax credit projects as a component of tax expense via the proportional amortization method.
    • Other non-interest expenses declined $831,000, or 31%, compared to the third quarter of 2023, primarily due to modifications made to the corporate credit card reward program and significant declines in check and card losses, as well as the Company’s strategic decision to exit its Insurance Captive, which contributed $275,000 in expense to the third quarter of 2023.

    Financial Condition – September 30, 2024, Compared with September 30, 2023

    Total assets increased $534 million, or 7%, year over year to $8.44 billion.

    Total loans increased $661 million, or 12%, to $6.28 billion, with growth spread across all categories and markets. Total line of credit usage ended at 43.2% as of September 30, 2024, compared to 38.8% as of September 30, 2023, boosted by increased CL&D and C&I line usage. C&I line of credit usage expanded to 31.8% as of period end.

    Total investment securities decreased $229 million, or 16%, year over year. The overall portfolio yield was 2.07% for the third quarter of 2024, compared to 2.04% for the third quarter of 2023. Over the past 12 months, cash flows from the investment portfolio have been utilized to fund loan growth and provide liquidity in lieu of redeployment.

    Total deposits increased $323 million, or 5%, over the past 12 months, with the deposit mix continuing to shift from non-interest bearing and low interest-bearing deposits into higher cost deposits. Non-interest-bearing demand accounts declined $207 million, or 12%, while interest-bearing deposits grew $530 million, or 11%, led by $313 million of time deposit growth and $174 million of growth in money market balances.

    Non-performing loans totaled $17 million, or 0.27% of total loans outstanding on September 30, 2024, compared to $17 million, or 0.31% of total loans outstanding on September 30, 2023. The ratio of allowance for credit losses to loans ended at 1.36% on September 30, 2024, compared to 1.39% on September 30, 2023.

    As of September 30, 2024, the Company continued to be “well-capitalized,” the highest regulatory capital rating for financial institutions, with all capital ratios experiencing meaningful growth. Total equity to assets(3) was 11.07% and the tangible common equity ratio(3) was 8.79% on September 30, 2024, compared to 10.21% and 7.69% on September 30, 2023, respectively.

    In August 2024, the board of directors increased the quarterly cash dividend to $0.31 per common share. The dividend was paid October 1, 2024, to shareholders of record as of September 16, 2024.

    No shares have been purchased since 2020, and approximately 741,000 shares remain eligible for repurchase under the current buy-back plan, which expires in May 2025.

    Results of Operations – Third Quarter 2024, Compared with Second Quarter 2024

    Net interest margin improved seven basis points on the linked quarter to 3.33%, boosted by strong loan growth, higher interest earning asset yields and a slow-down in cost of funds expansion.

    Net interest income increased $3.0 million, or 5%, over the prior quarter to $65.0 million.

    • Total interest income increased $5.4 million, or 5%.
      • Interest income, including fees, on loans increased $5.7 million, or 6%. Average loans increased $201 million, or 3%, and the corresponding yield earned increased 11 basis points to 6.17%.
    • Total interest expense increased $2.5 million, or 6%.
      • Interest expense on deposits increased $2.4 million, or 8%, led by a $76 million increase in average interest-bearing deposits concentrated within the time and money market categories.

    The Company recorded $4.3 million in provision for credit losses on loans(1) and no credit loss expense for off-balance sheet exposures during the third quarter of 2024. During the second quarter of 2024, the Company recorded $1.3 million in provision for credit losses, which included a $1.1 million provision for credit losses on loans and $225,000 of credit loss expense for off-balance sheet exposures.

    Non-interest income increased $1.1 million, or 5%, on the linked quarter, with increases in nearly every category.

    Non-interest expenses decreased $657,000 to $48.5 million, as increases in compensation expense were more than offset by decreases in employee benefits, marketing and business development and technology and communication expenses.

    Financial Condition – September 30, 2024, Compared with June 30, 2024

    Total assets increased $122 million, or 1%, on the linked quarter to $8.44 billion.

    Total loans expanded $207 million, or 3%, on the linked quarter, led by increases in nearly every loan category. Total line of credit usage was 43.2% as of September 30, 2024, compared to 41.1% as of June 30, 2024. C&I line of credit usage totaled 31.8% as of September 30, 2024, compared to 30.8% as of June 30, 2024.

    Total deposits increased $157 million, or 2%, on the linked quarter. Non-interest-bearing demand accounts increased $26 million, or 2%, while total interest-bearing deposit accounts increased $131 million, or 3%. Time deposits increased by $119 million and money market balances increased by $82 million on the linked quarter.

    The Gauteng City-Region, which has long been South Africa’s economic engine, is in decline. The region contributes about 35% of the country’s total economic output, and is home to more than 15 million people, about 25% of the country’s population of 62 million people.

    Many in the province have come from far and wide hoping to “make it” in the land of opportunity. Yet both the media and the public raise critical questions about its future amid decaying infrastructure, poor delivery of basic government services, and a steady uptick in violent crime.

    New research from the Gauteng City-Region Observatory (GCRO) reveals that development outcomes in the province are declining. The GCRO is an independent institute that produces research and analysis to inform decision making and policy in the Gauteng City-Region. It is a partnership between the Gauteng provincial government, the University of the Witwatersrand, the University of Johannesburg, and organised local government (Salga-Gauteng).

    The GCRO constructs a multidimensional index of wellbeing that combines 33 variables into one measure, known as the Quality of Life Index, from survey data that has been collected every two to three years since 2009.

    This includes measures of health, safety, life satisfaction, socio-economic status, public services, satisfaction with government, and social and political participation. The latest index (2023/24) shows that quality of life in Gauteng has fallen to its lowest level ever since the survey began in 2009. This suggests that the wellbeing of many households has been compromised by the complex and interconnected global challenges, known as the polycrisis, that have emerged since the COVID-19 pandemic.

    Many of these challenges are linked to the local governance crisis, characterised by unstable political party coalitions. The interaction of complex crises amplifies harmful effects, profoundly affecting quality of life.

    A governance crisis emerged in South Africa in the wake of state capture, marked by a stark decline in the provision of quality public services. So, the government has struggled to shield citizens from the worst impacts of the polycrisis. Households face an acute convergence of global and local crises, reflected in health, economic instability, societal unrest, climate challenges, and rising safety concerns.

    The research

    The 7th Quality of Life Survey involved 13,795 adult residents of Gauteng. Respondents were randomly sampled in every ward of the province. Data was collected by a team of fieldworkers from 28 August 2023 to 16 April 2024. The data is made freely available, and is used by government, academics and civil society. The findings inform policy and strategic planning by government entities across the Gauteng City-Region.

    The latest survey results paint a complex picture about the quality of life in Gauteng. Some of the most significant findings which relate to the challenges that household face, and the ways people respond to challenges, are highlighted below. The list of crises includes concerns about public service delivery, satisfaction with government, safety, poverty, and overall quality of life.

    Unreliable service delivery

    Basic services in Gauteng are characterised by interruptions to supply, inadequate coverage and quality problems. While most residents have access to water, electricity, sanitation and refuse removal, satisfaction with these levels has declined substantially since the previous survey in 2020/21.

    The latest survey shows that only 61% of respondents were satisfied with their sanitation, only 60% perceived their water as always clean, and only 64% were satisfied with their refuse removal. These are all lower than in the past when satisfaction ranged between 70% and 75%. The impact, for example, is that those who do not have weekly refuse removal are more likely to dump their rubbish in public spaces or burn it – causing various environmental challenges.

    Gauteng households use various resources at their disposal to deal with the impacts of unreliable services. For instance, one in seven households (15%) are now generating some or all their own electricity, compared to 4% in 2017/18. This is partly related to the unreliability of electricity provision, and growing efforts to gain independence from the “grid”. But the unreliability and cost of electricity have varied impacts, depending on household income.

    Declining satisfaction with government

    Only a fifth (21%) of respondents were satisfied with the performance of the national government. A similar proportion (22%) of respondents were satisfied with the performance of provincial and local governments. Satisfaction for all these spheres has declined by between 15 and 20 percentage points since 2017/18.

    The effect of dissatisfaction with government is increasing disengagement. Just over half of respondents (54%) felt that politics was a waste of time, and 57% said that South Africa was a failed state. When the survey was conducted, before the 2024 provincial elections, 21% of respondents said they were not planning to vote. Thus, government dissatisfaction and disengagement helps to understand the low voter turnout during the elections.

    Poverty

    While poverty rates measured in 2023/24 have improved from their peak during the pandemic, the recovery is partial. Sixteen percent of respondents lived below the food poverty line of R760 per month (about US$43). This remains higher than pre-pandemic levels (it was 12% in 2017/18). It shows that a large portion of Gauteng’s households have struggled to meet their basic needs for a long time.

    South Africa’s welfare systems remain a lifeline for many households. The proportion of respondents that benefited from any kind of social grant (including child support and old age pensions has increased steadily from 30% in 2011 to just over 50% in 2023/24.

    Low-income households are also less likely to recover from shocks because they lack financial safety nets, and cannot afford to replace public services with costly private alternatives.

    Safety concerns

    Another kind of problem experienced by respondents is insecurity as a result of crime and violence. A fifth of respondents (21%) said that they had been the victim of crime in the last year. This was a two percentage point increase from 2020/21, when lockdowns reduced crime levels. The proportion of respondents who said that the crime situation had worsened was also higher (increasing from 43% in 2020/21 to 48% in 2023/24).

    Much larger proportions of respondents felt unsafe in their homes, and when walking in their neighbourhood in the daytime or at night. For example, in 2023/24, 81% of respondents felt unsafe walking in their area at night, compared to 75% in 2020/21. The effect is that 62% of respondents in 2023/24 were dissatisfied with the security services provided by the government, compared to 54% in 2020/21.

    Overall quality of life is lower

    Overall, in the latest index quality of life reached its lowest point yet since the index was first calculated. The 2023/24 value was calculated at 59.5 out of 100, compared to 61.4 in 2020/21 and a high of 63.9 in 2017/18.

    Most of the dimensions declined, suggesting that the wellbeing of many households has been adversely affected by the interplay between the governance crisis and the polycrisis. Households’ ability to navigate these challenges is strongly shaped by inequality, which remains very high.

    The 2023/24 quality of life report shows that the Gauteng City-Region grapples with a series of wicked problems. Public and private sector leaders, along with civil society, need to assess the current situation and collaborate on innovative solutions to enhance the quality of life of all residents in the City-Region.

    Headline: ICC reaches arbitration milestone with case 29,000

    The milestone case involves Brazilian parties from the power and energy sector, governed by Brazilian law, with a tribunal to be seated in Rio de Janeiro. The parties had initially agreed to ad hoc arbitration under the UNCITRAL Rules, with ICC as the appointing authority. They then modified that agreement in favour of arbitration under the ICC Rules of Arbitration. 

    Alexander G. Fessas, Secretary General of the ICC Court and Director of ICC Dispute Resolution Services, said: 

    “When the Secretariat’s São Paolo’s office opened seven years ago, we pledged to provide long-term support to the ever-developing disputes landscape in Brazil and Latin America. We now celebrate the success of that pledge with the registration of our 29,000th case, and the trust parties place in ICC Arbitration.” 

    In 2023, ICC Arbitration involved 80 Brazilian parties (including 12 state-owned entities) in newly registered cases, and the ICC Court confirmed or appointed 60 arbitrators coming from Brazil. Brazil ranks sixth globally in terms of the nationality of parties and arbitrators.  

    Parties from Latin America and the Caribbean account for approximately 15% of all parties in arbitrations registered with ICC. Brazil has traditionally been the leading jurisdiction in Latin America and is the fifth most used seat of arbitration worldwide. In terms of applicable laws in newly registered cases in Latin America, Brazil came second (29 cases), just behind Mexico (35 cases).  

    Same-nationality party disputes represented 29% of the ICC Court’s new caseload in 2023, with 21 cases involving only parties coming from Brazil. This makes Brazil the second top jurisdiction resorting to ICC Arbitration for domestic disputes in 2023. 

    The energy sector traditionally generates the second largest number of ICC cases, slightly behind the construction and engineering sector, accounting for over 20.6% of all new cases registered in 2023. 

    Ana Serra e Moura, Deputy Secretary General of ICC International Court of Arbitration, said: 

    “The registration of the 29,000th case involving Brazilian parties highlights ICC’s consistent growth in Brazil and beyond, in one of the most important industry sectors. It is now time to pause and celebrate the trust of our users and the relentless work of our teams on ensuring that ICC Dispute Resolution Services meet the needs of global business.” 

    Efforts to expand ICC Dispute Resolution Services in Latin America began with the establishment of a dedicated case management team in São Paulo in 2017, following the inauguration of ICC Brazil in 2014. Since then, the ICC Secretariat’s case management team in Brazil has administered over 650 cases, in recent years surpassing 100 cases annually, further solidifying Brazil’s importance in ICC operations.  

    As ICC continues to strengthen its presence in Latin America, key regional developments will be discussed at the upcoming 22nd ICC Miami Conference on International Arbitration from 1 to 3 December 2024, including significant updates from Brazil, Argentina, Mexico, and Ecuador.

  • MIL-OSI Global: Americans use the Book of Revelation to talk about immigration – and always have

    During a campaign speech in Latrobe, Pennsylvania, on Oct. 19, 2024, Donald Trump promised to save the country from immigrants: “I will rescue every town across America that has been invaded and conquered, and we will put these vicious and bloodthirsty criminals in a jail or kick them out of our country.”

    Depicting immigrants as a threat has been a pillar of Trump’s message since 2015. And the types of terms he uses aren’t just disparaging. It might not seem like it, but Trump is continuing a long tradition in American politics: using language shaped by the Bible.

    When the former president says those at the border are “poisoning the blood of our country,” “animals” and “rapists,” his vocabulary mirrors verses from the New Testament. The Book of Revelation, the last book of the Bible, says those kept out of the city of God are “filthy”; they are “dogs and sorcerers and sexually immoral and murderers and idolaters and everyone who loves and practices falsehood.”

    In fact, Americans have been using the Bible for centuries to talk about immigrants, especially those they want to keep out. As a scholar of the Bible and politics, I’ve studied how language from Revelation shaped American ideas about who belongs in the United States – the focus of my book, “Immigration and Apocalypse.”

    The shining city

    The Book of Revelation describes a vision of the end of the world, when the wicked are punished and the good rewarded. It tells the story of God’s enemies, who worship the evil Beast of the Sea, bear his mark on their body and threaten God’s people. Because of their wickedness, they suffer diseases, catastrophes and war until they are finally destroyed in the lake of fire.

    God’s followers, however, enter through the gates of the walls surrounding the New Jerusalem, a holy city that comes down from heaven. God’s chosen people enter through the gates and live in the shining city for eternity.

    Throughout American history, many of its Christian citizens have imagined themselves as God’s saints in the New Jerusalem. Puritan colonists believed they were establishing God’s kingdom, both metaphorically and literally. Ronald Reagan likened the nation to the New Jerusalem by describing America as a “shining city … built on rocks stronger than oceans, wind-swept, God-blessed, and teeming with people of all kinds living in harmony and peace,” but with city walls and doors.

    Reagan was specifically quoting Puritan John Winthrop, one of the founders of Massachusetts Bay Colony, whose use of the “city on a hill” phrase quotes Jesus’ Sermon on the Mount. But Reagan’s detailed description closely matches that of the New Jerusalem in Revelation 21. Like God’s heavenly city, Reagan’s picture of America also has strong foundations, walls and gates, and people from every nation bringing in tribute.

    Barring the gates

    If people imagine the U.S. as God’s city, then it’s easy also to imagine enemies who want to invade that city. And this is how unwanted immigrants have been depicted through American history: as enemies of God.

    In the 19th century, when virtually all politicians were Protestant, anti-Catholic politicians accused Irish immigrants of bearing the “mark of the Beast” and being loyal to the “Antichrist”: the pope. They claimed that Irish immigrants could form an unholy army against the nation.

    At the turn of the century, “yellow peril” novels against Chinese immigration imagined a heathen horde taking over the U.S. At the end of one such book, China itself is depicted as a satanic “Black Dragon,” forcing its way through “the Golden Gate” of America.

    And all immigrant groups who were unwanted at one time or another have been accused of being “filthy” and diseased, like the enemies of God in Revelation. Italians, Jews, Irish, Chinese and Mexicans were all, at some point, targeted as unhealthy and carrying illness.

    In political cartoons from the turn of the 20th century, Eastern European and Jewish immigrants were depicted as rats, while Chinese immigrants were portrayed as a horde of grasshoppers – echoing imagery from Revelation, where locusts with human faces swarm the Earth. During COVID-19, an event itself considered apocalyptic, xenophobic fear has focused on Asian Americans and migrants at the U.S.-Mexico border.

    This constellation of labels from Revelation – plague-bearing, bestial, invading, sexually corrupt, murderous – has been reused and recycled throughout American history.

    ‘Heaven has a wall’

    Trump himself has described immigrants as diseased, “not human,” sexual assaulters, violent and those “who don’t like our religion.”

    Others have more explicitly used images from Revelation to talk about immigration. Pastor Robert Jeffress, who preached at Trump’s 2017 inauguration church service, told viewers on Fox News’ “Fox & Friends,” “God is not against walls, walls are not ‘un-Christian,’ the Bible says even heaven is going to have a wall around it.” The Conservative Political Action Conference held a panel in 2017 titled “If Heaven Has a Gate, A Wall, and Extreme Vetting, Why Can’t America?” There are even bumper stickers that say, “Heaven Has A Wall and Strict Immigration Policy / Hell Has Open Borders.”

    Revelation 21 indeed describes the heavenly New Jerusalem with a massive shining wall, “clear as crystal,” with pearls for gates. Trump, similarly, talks about his “big, beautiful door,” set in a “beautiful,” massive wall that also has to be “see-through.”

    The city of God metaphor has long been a tool for American leaders – both to idealize the nation and to warn against immigration. But the concept of a walled-in city seems increasingly outdated in a digitally connected, global world.

    As migration continues to rise around the world due to climate change and conflict, I’d argue that these metaphors and the attitudes they drive are not just obsolete, but exacerbating crisis.

  • MIL-OSI United Nations: Experts of the Human Rights Committee Commend Greece on Measures Taken for Unaccompanied Minors, Raise Questions on Domestic Violence and Allegations of Border Pushbacks

    The Human Rights Committee today concluded its consideration of the third periodic report of Greece on how it implements the provisions of the International Covenant on Civil and Political Rights.  Committee Experts commended Greece for the measures taken for unaccompanied minors, while raising questions on domestic violence, and allegations of pushbacks at the border. 

    One Committee Expert said the Committee welcomed measures taken by the State party, including the establishment of the Special Secretariat for the Protection of Unaccompanied Minors, the Emergency Response Mechanism, and law 4960/2022 on the establishment of a National Guardianship System for unaccompanied minors.  The Committee also appreciated the national protection strategy (2021–2025) and the mechanism for unaccompanied children living in precarious conditions. 

    Another Expert asked how the State party addressed the root causes of gender-based violence? Was there a comprehensive strategy to prevent, raise awareness on, and respond to gender-based violence?  Was there mandatory and continuous capacity building for judges, prosecutors, and other law enforcement officials about gender-based violence? 

    A Committee Expert said numerous reports documented instances of pushbacks by the Hellenic police and Hellenic coast guards, including patterns of excessive use of force, cruel, inhuman and degrading treatment, incommunicado detention, and unlawful destruction of personal belongings.  How would Greece ensure thorough, systematic, effective, and independent investigations into allegations of pushbacks and hold those responsible accountable?  Reports before the Committee indicated that from January 2020 to June 2024, there were 1,452 incidents at the borders affecting approximately 46,649 people. What measures were being taken to ensure that border control operations prioritised the protection of life and that rescue efforts were conducted in compliance with human rights?

    The delegation said violence against women had increased significantly during the pandemic. In April 2020, there was a significant increase of more than 200 per cent regarding phone calls to the hotline for reporting violence.  Psychosocial support was provided upon request, including both online and in-person. An awareness raising campaign was launched in 2024 and was displayed in the Athens urban rail network.  A panic button application was launched, enabling women in immediate danger to call for help in a safe manner by pressing a button on their phone which was linked to the police. 

    The delegation said pushbacks were not the policy of the Greek Government in any way, shape, or form; the Government policy was clear.  Actions taken by Hellenic authorities at the sea borders were carried out in full compliance with international obligations.  Allegations on so-called pushbacks were not compatible with the well-established operations of the Hellenic authorities.  However, any allegations of pushbacks or mistreatment of third country nationals were thoroughly investigated.  From 2015 to the present, the Hellenic coast guards had rescued more than 254,000 people.  Several mechanisms allowed complaints against pushbacks to be submitted to the Hellenic authorities, and the coast guards had a robust disciplinary mechanism.

    Introducing the report, Katerina Patsogianni, Secretary General for Equality and Human Rights, Ministry of Social Cohesion and Family of Greece and head of the delegation, said in recent years, Greece had confronted the combined effects of the economic crisis, the migration crisis, and the COVID-19 pandemic.  The country was now on a path to long-term progress and sustainability, benefiting its human rights framework.  Greece had developed one of Europe’s most efficient asylum services and continued to improve its capacities and infrastructure.  The fight against human trafficking was a top priority for authorities, who worked closely with non-governmental organizations in a strategic alliance. 

    In concluding remarks, Ioannis Ghikas, Permanent Representative of Greece to the United Nations Office at Geneva, thanked the Committee for the frank and honest exchange.  Greece had worked hard to improve the situation, particularly on migration; the number of deaths in the Aegean Sea had fallen by 40 per cent. Greece had a vibrant society with few resources but was working to do better. 

    Tania María Abdo Rocholl, Committee Chairperson, thanked the delegation for the dialogue, which had covered a wide range of subjects under the Covenant.   The Committee aimed to ensure the highest level of implementation of the Covenant in Greece.

    Presentation of Report

    IOANNIS GHIKAS, Permanent Representative of Greece to the United Nations Office at Geneva, said since the last review, Greece had made significant progress in key areas, including the protection of vulnerable groups, ensuring gender equality, and promoting human rights safeguards.  Despite unprecedented challenges, Greece had remained committed to protecting and promoting human rights and looked forward to the Committee’s recommendations. 

    KATERINA PATSOGIANNI, Secretary General for Equality and Human Rights, Ministry of Social Cohesion and Family of Greece and head of the delegation, said in recent years, Greece had confronted the combined effects of the economic crisis, the migration crisis, and the COVID-19 pandemic.  The country was now on a path to long-term progress and sustainability, benefiting its human rights framework.  Faced with the COVID-19 pandemic, Greece implemented restrictive measures to curb the spread of the disease, which were proportionate, non-discriminatory, and scientifically evaluated.  At the same time, the authorities enacted policies to protect public health and mitigate the social and economic effects of the pandemic. The National Vaccination Programme ran smoothly and efficiently, targeting specific and vulnerable groups. Following recommendations to improve policy coordination, Greece launched national human rights action plans with input from independent bodies and civil society. 

    Significant progress had been made on gender equality, including ratifying the Council of Europe Convention on Violence against Women and the International Labour Organization Convention on Sexual Harassment in the Workplace.  The Labour Inspection Body was now an independent authority, and the Greek Ombudsperson’s role in equal treatment had been strengthened. In 2019, Greece introduced a comprehensive legal framework to promote gender equality.  The new national action plan 2026-2030 would guide future policies with civil society input. 

    This year marked a significant milestone for the rights of lesbian, gay, bisexual, transgender and intersex persons, with the enactment of marriage equality for all, without gender discrimination.  On the rights of the child, key policy actions were focused on strengthening foster care and adoption, preventing child abuse, and setting rules for child protection units and childcare centres. 

    Greece was actively implementing the Roma National Strategy 2021–2030, guided by the principle “for the Roma, with the Roma.”  Key committees, including the Roma Forum, were fully operational. All available European Union funding was being used to enhance Roma’s employment, education, healthcare, and housing participation.  Harsher penalties now applied to crimes with racist characteristics. The National Council against Racism and Intolerance, an inter-ministerial body with the participation of independent bodies, adopted the first national action plan in December 2020. 

    For persons with disabilities, Greece established a National Accessibility Authority and was developing a national strategy for 2024-2030.  Key policies included deinstitutionalisation and a personal assistant programme for independent living.  A 2023 law improved access to justice for persons with disabilities and removed derogatory language from the legislation.  Additionally, the Ministry of Health had enacted legislation for psychiatric reform, shifting from institutional to community-based care.

    Greece had developed one of Europe’s most efficient asylum services and continued to improve its capacities and infrastructure.  Since 2021, the National Emergency Response Mechanism had supported thousands of unaccompanied minors in precarious conditions.  This year, Greece launched the new national guardianship system to serve vulnerable asylum applicants better at the first reception stage. In 2023, the General Secretariat of Vulnerable People and Institutional Protection was established in the Ministry of Migration and Asylum to address challenges faced by vulnerable refugees and migrants. 

    Greek law enforcement authorities fulfilled their border protection responsibilities in compliance with domestic, European and international law.  Allegations regarding violations of the principle of non-refoulement at land or sea borders did not correspond to the operational activities of law enforcement agencies.  Greece applied a firm policy for the effective monitoring of fundamental rights and the assessment of complaints of ill treatment at the border, comprised of internal disciplinary procedures; prosecutorial supervision under criminal law; and independent monitoring by the Greek Ombudsman and the National Transparency Authority.  In addition, a Special Committee for Compliance with Fundamental Rights and the position of the Fundamental Rights Officer were established in the Ministry of Migration and Asylum in 2022. 

    The fight against human trafficking was a top priority for authorities, who worked closely with non-governmental organizations in a strategic alliance.  In 2019, the National Referral Mechanism for trafficking victims was launched, which trained staff on standard operating procedures for victim protection, including in reception and identification centres.  A key development in the field of justice was the recent reform of the judicial map for civil and criminal courts, which aimed to reorganise courts geographically, streamline procedures, and speed up case resolution.  Greece had also undertaken several key initiatives to further develop a resilient and pluralistic media ecosystem, focusing on protecting, ensuring safety, and empowering journalists.  Ms. Patsogianni expressed gratitude for being able to engage in a constructive and frank dialogue with the Committee.

    Questions by Committee Experts

    A Committee Expert said the Committee noted that awareness raising on the Covenant was part of training activities for judges, lawyers and law enforcement officials. What were the channels used by the State party, the number of beneficiaries of these training courses, and the number of cases in which the provisions of the Covenant were invoked by the national courts?  What measures were taken by Greece to ensure the full implementation of the Committee’s views, including by providing victims with an effective remedy for the violation of their rights in several cases in the courts? 

    According to the information received, the measures taken by the State party during the COVID-19 pandemic had particularly wider implications for the human rights of asylum seekers, refugees and migrants, who were subject to mandatory quarantine, late vaccinations, lack of access to vaccination for certain groups, and policing people’s movements.  To what extent and how long were asylum procedures suspended due to restrictions imposed as a result of the COVID-19 pandemic?  Could figures be provided on the number criminal investigations opened, and prosecutions and convictions of the perpetrators of domestic violence and femicide committed during the prolonged COVID-19 quarantine?  What measures had been taken by the State party to ensure effective reparation for the damage suffered by the victims?

    The Committee welcomed the decision taken by the Court of Appeal of Athens in a landmark judgment handed down on 7 October 2020 against the neo-Nazi party “Golden Dawn”, which was described as a criminal organization.  The report also provided figures on the number of alleged racist incidents.  However, information received indicated that there was not enough prosecution to punish the perpetrators of the wrongdoings.  What measures were being taken to encourage victims of discrimination to report the situation to authorities?  How was it ensured that victims of hate crimes had access to support services? 

    Another Expert said the Committee appreciated the adoption of several laws, including amendments to the whistleblower protection law, increasing the fines for foreign bribery offenses, as well as the creation of new anti-corruption institutions, including the National Transparency Authority in 2019.  However, the Committee was concerned about the limited practical impact of these reforms.  Could statistics on corruption efforts be provided, including the number of investigations, prosecutions and convictions in corruption cases?  How did the State party ensure thorough and impartial investigations into all allegations of corruption, regardless of the officials or institutions involved?  Could more information on technical initiatives be provided?  How were whistleblower protection mechanisms being implemented? 

    The Committee remained concerned about the use of excessive force during pushbacks of migrants and asylum seekers, including instances of pointing guns, hitting with batons, slapping, and pushing asylum seekers.  Could the State party comment on these reports?  Could the State party also comment on allegations that no investigations had been conducted into police violence against Roma communities nearly five years after the incidents?

    The Committee commended Greece for adopting the 10-year national action plan for mental health in 2023, and for adopting law 5129/2024 for the completion of the psychiatric reform.  What steps were being taken to reduce overcrowding and improve the overall quality and supervision of psychiatric care?  How was the State party working to improve the capacity of the Committee for the Protection of the Rights of People with Psychosocial Disability and the Health Quality Assurance Body?

    While the Committee commended Greece for making the reduction of involuntary hospitalisations a priority, how did the State party ensure that patients being evaluated for involuntary commitment were provided with appropriate legal safeguards.  How was the State party working to reduce the total number of involuntary commitments to psychiatric care?  The Committee was concerned by the use of physical and chemical restraints in psychiatric care; what was being done to ensure that the use of restraints was properly regulated and minimised. 

    One Committee Expert said the Committee welcomed measures taken by the State party, including the establishment of the Special Secretariat for the Protection of Unaccompanied Minors, the Emergency Response Mechanism, and law 4960/2022 on the establishment of a National Guardianship System for unaccompanied minors.  The Committee also appreciated the national protection strategy (2021–2025) and the mechanism for unaccompanied children living in precarious conditions.  It was hoped these measures were robust and effective. 

    However, the Committee had been informed that unaccompanied minors were still sometimes detained in police stations and subjected to heavy restrictions of movement. How did the State party ensure that short-term detention and restrictions did not amount to a disproportionate limitation of the rights to liberty, security, and freedom of movement of unaccompanied minors?  The Committee was aware of the National Guardianship System for unaccompanied minors and of the Hippocrates project on medical and psychosocial services.  How would the State party ensure that the system and project had sufficient resources to be effective, that available guardians were appointed, and that services would be provided in practice? How did Greece ensure that the age determination procedure was multidisciplinary, scientifically based, harmonised across the country, and used only in cases of serious doubts about the claimed age?

    The Committee understood that law 4800/2021 allowed perpetrators of domestic violence or sexual offences to retain child custody and unrestricted contact with their children until they were convicted by a first instance court.  What measures had Greece taken to protect the safety of women and children who were forced into contact with alleged abusers under shared custody arrangements?  It was understood that in cases of imminent danger to a child’s mental or physical health, a prosecutor could take immediate protection measures for up to 90 days and renewable.  How often was this measure taken?  How well-known was this option to prosecutors and lawyers, as well as to women and children involved?  Why did Greece decide not to include femicide as a crime within the law?  What other measures had it taken to protect women against femicide?  What measures had been taken to increase the availability of shelters across the country?

    Could the State party inform the Committee on how it addressed the root causes of gender-based violence?  Was there a comprehensive strategy to prevent, raise awareness on, and respond to gender-based violence?  Was there mandatory and continuous capacity building for judges, prosecutors, and other law enforcement officials about gender-based violence?  The Committee had received information that Greek coast guards were involved in incidents where women, including pregnant women, were beaten and sexually assaulted.  What concrete measures had the State party taken to protect women from assaults and to prosecute and punish perpetrators?

    Another Expert welcomed information from the State party regarding measures taken to improve conditions in reception and detention centres.  However, reports indicated that migrants and asylum seekers continued to be held in poor and prison-like conditions of detention, and that their living conditions may be considered as amounting to inhuman and degrading treatment. What measures did Greece plan to take to address inadequate conditions of detention in reception and detention centres?  Did the State party have any policies in place to ensure adequate resources were available for migrants and asylum seekers at times of increased arrivals? What steps would Greece take to prevent the detention of third country nationals and asylum seekers and ensure that measures of detention were only used as a last resort? 

    Would Greece consider abolishing the administrative detention of asylum seekers on the grounds of illegal entry, particularly those belonging to vulnerable groups?  Would Greece consider putting in place a proper procedure for individualised risk assessment before imposing a detention order for an asylum seeker or a third party national?  What steps would be taken to ensure that all persons deprived of their liberty enjoyed fundamental legal safeguards against ill treatment from the outset of their detention, including the rights to be assisted by a lawyer without delay?  How was it ensured that all foreign nationals deprived of their liberty were granted access to a lawyer and doctor? 

    Another Expert asked what steps were being taken to develop a comprehensive statistical system on trafficking and improve early identification and referral systems? Could disaggregated data be provided on the number of trafficking cases investigated, convictions secured, and sentences imposed?  What steps was the State party taking to adopt a new national action plan and ensure sufficient resources for its implementation?  The situation on support and redress for victims was concerning, as there was a lack of adequately funded and inclusive shelters for trafficking victims and no victims had successfully obtained compensation.  What measures were being taken to increase the capacity of shelters and ensure that they were accessible to all victims?  How did Greece ensure the quality of services provided in shelters, and what long-term reintegration programmes were available?  What steps were being taken to facilitate access to compensation for victims, ensuring they received legal assistance? 

    It was reported that in 2023, of the 10,973 asylum appeals submitted to the Appeals Committees, only 5,915 cases, around 53 per cent, received legal aid.

    What steps were being taken to streamline the legal aid application process and court fee waivers for vulnerable populations?  What measures were being considered to increase the capacity and resources of the legal aid system to ensure timely and effective representation?  How was the State party addressing delays in providing legal aid, especially during critical stages such as police investigations and initial detention?  How did Greece plan to resolve ongoing delays in compensating legal aid lawyers? 

    Responses by the Delegation

    The delegation said that once ratified, international conventions formed part of domestic law. The national school of the judiciary provided training to judges and prosecutors.  Initial training was mandatory since 2022 and covered topics including human rights, gender law, and the treatment of victims.  Thirteen seminars were held online and in-person for judges in 2023, while 15 seminars were planned for 2024.  Greece did not have specific legislation to receive Views from the Committee. 

    During the COVID-19 pandemic, Greek authorities resorted to a wide array of restrictive measures to protect public health.  All these measures were necessary and applied in a non-discriminatory manner.  The Greek Ministry of Justice recently amended the Criminal Code concerning the fight against corruption with a new law in 2024.  Greece had an increased number of ongoing corruption investigations and cases and looked forward to final judgments in the immediate future. 

    In 2021, Greece significantly amended the provisions relating to family law.  The law had since triggered widespread concerns regarding its impact on custody in situations of domestic violence.  The Greek legal system offered certain possibilities to suspend or regulate the parental rights of parents who had been abusive to their spouses or children. 

    The National Council against Racism, through strengthened collaboration, would focus on enhancing victims’ access to services, improving the skills of public officials to draft the second national action plan against racism and intolerance, and raising public awareness through a national campaign which reached over 100,000 people. 

    Violence against women had increased significantly during the pandemic.  In April 2020, there was a significant increase of more than 200 per cent regarding phone calls to the hotline for reporting violence. Psychosocial support was provided upon request, including both online and in-person.  A social media campaign had succeeded in raising awareness on the gender-based violence issue.  Since 2010, a comprehensive strategy had been implemented to combat gender-based violence, comprised of prevention measures.  An awareness raising campaign was launched in 2024 and was displayed in the Athens urban rail network.  A panic button application was launched, enabling women in immediate danger to call for help in a safe manner by pressing a button on their phone which was linked to the police. 

    The National Centre for Social Solidarity operated two support centres in Athens for families that faced psychosocial crises, with an emphasis on victims of violence and trafficking.  Short-term accommodation was provided. 

    One thousand and one hundred persons with disabilities had received personal assistance to enhance their independent living.  A protection officer was stationed at each institution to report any cases of abuse. The Transparent Authority was the intendent mechanism responsible for conducting inspections in institutions where there were allegations or suspicions of abuse. 

    From 2019 to 2023, incidents of domestic violence had increased from 5,221 victims to 11,589. There had been 10 homicides of female victims by male perpetrators last year and six so far this year.  Five offices for the protection of minors had been established and a special hotline was operational, enabling citizens to call and make complaints. 

    Foreigners in prison who did not have sufficient knowledge of the Greek language had the right to appear before courts with an interpreter.  Alternative detention measures were applied under certain conditions. Detainees were immediately informed of their rights upon arrival at the prisons.  Information, lawyer representation, and linguistic assistance were provided to any foreign prisoners.  There were plans to recruit interpreters for implementing linguistic projects.

    Sixty-eight offices had been established in the country to combat violence which arose due to racist motives.  A special hotline was put into operation for reporting hate motivated crimes.  The cybercrime division had developed a series of actions aimed at informing the public on hate speech.  Police personnel were trained in the use of weapons and carried appropriate weapons when performing their duties.  The promotion of ethical standards and the code of conduct of police officers was received through training. 

    For people who tried to illegally cross the maritime borders of Greece, Hellenic officers undertook all legal and necessary measures.  There were clear legal rules that governed the use of force during law enforcement and border control activities.  When Hellenic officers used firearms, it was mandatory to inform the local prosecutor.  Detailed instructions had been disseminated to coast guard officers, and it was ensured that vulnerable groups were immediately provided with appropriate medical care.  It was important to recognise the humanitarian efforts of the coast guard officers; hundreds of thousands of migrants had been rescued by the Hellenic coast guard officers throughout the migrant crisis. 

    Since 2002, the Hellenic police had been dealing with the issue of human trafficking.  There were 12 human trafficking teams and officers had received specialised training in identifying victims and providing support. The fight against trafficking remained a top priority for the Greek authorities.  The establishment of the Office of a National Rapporteur on Trafficking was followed by the National Referral Mechanism.  The Office of the National Rapporteur was responsible for a national strategy to combat trafficking, and was mandated to cooperate closely with all national authorities.  The National Referral Mechanism was in its fifth year of operation; it specialised in victim protection and facilitated training sessions. 

    The national crisis management plan for refugees had been activated during the COVID-19 pandemic and consisted of allocating specific areas for medical care and a temporary restriction on movement for foreign nationals.  This did not constitute a detour from the rights in the Covenant.  Regardless of their legal status, migrants and asylum seekers were offered vaccinations free of charge.  Free transport was provided to asylum seekers to reach the local markets and health centres. Restriction on freedom of movement procedures for third country nationals was temporary and was done to verify a person’s identity.  This did not apply to people who urgently required medical support. 

    The work of the Special Secretariat for Unaccompanied Minors had been remarkable.  The National Guardianship System aimed to ensure that every unaccompanied minor had a guardian.  It was a new system that was implemented in January 2024.  There was a system for submitting complaints and a national registry for unaccompanied minors.  There were 137 guardians active in Greece, with more than 500 minors under the programme.  Greece was following an established procedure regarding age assessment. 

    Current penitentiary legislation provided for the protection of prisoners, including the right to appeal their sentence in an appeals court.  A total of 226 appeals had been launched, of which 15 had been awarded a compensation amount, a favourable sentence, or transfer to another penitentiary.  A working group had been set up to develop a short, easy to use guide for prisoners, informing them of their rights.   

    A training programme had been implemented for mental health service professionals, related to the de-escalation of violence and issues of chemical restraints, to ensure the protection of the rights of those with mental disabilities.   

    Questions by Committee Experts

    A Committee Expert said femicide was more than murder; it had specific gender motives and was driven by wider issues.  Could the delegation respond to this?  How were women made aware of the panic/warning application on the phone? What happened if men checked the phones? Did the police have sufficient capacity to respond?  Was it also available in rural areas? 

    Another Expert asked if all detention centres had good conditions?  Previously, the alterative to detention was determined by the asylum office, but now it was done by police officers.  Were individual assessments made before detention? 

    An Expert asked what concrete successes had been achieved in corruption cases, and what had been the challenges?  Could information about timely investigations into excessive use of force be provided? 

    One Expert said domestic violence was a real issue facing Greece.  Could information be provided on the sentences handed down and financial types of reparations to victims during the COVID-19 pandemic? 

    A Committee Expert asked for clarification on services available for trafficking victims. 

    Responses by the Delegation

    The delegation said more medical staff were joining the reception centres every day. Referrals were also made to local public hospitals for serious cases.  Two reception centres had been established on the mainland, which accepted many applicants from the islands and helped to decongest the islands’ reception centres.  There were centres for women victims of violence and accommodation to child victims was also guaranteed.  Access to compensation was provided by Hellenic authorities.  There had been a strong campaign for raising awareness of domestic violence, including a campaign on the nightly news.  The legal framework would not be changed. 

    The delegation said that at the borders, persons were obliged to remain within the premises to be registered for a minimum of five days, up to a maximum of 25.  Usually, registration was completed before the five days and then the restriction on movement was lifted.  Work was done to promote alternative measures to imprisonment, including electronic monitoring and community services. 

    The root causes of violence against women were identified as persistent gender stereotypes. The national action ban to combat violence against women addressed many areas to combat this scourge.  The panic button had specific features to ensure it remained undetectable by the abuser.  Only the victim was aware of its presence on the phone. 

    In Greece, persons with low income could apply for free legal aid.  Victims of trafficking and domestic violence could receive free legal aid regardless of their income.  The new legislation of the Penal Code made sanctions for violence against women more severe, with a victim-centred approach.

    Questions by Committee Experts

    A Committee Expert said the Committee was concerned about the system for the appointment of the most senior judges and prosecutors, including the President and Vice-President of the Council of State, the Supreme Court, and the Court of Audit. 

    Did the State party have any plans to revise the current system for appointing the highest positions of the judiciary and ensure the involvement of the judiciary in the process?  Were there any other measures in place to ensure that the highest positions of the judiciary were not subject to a strong influence from the executive and to safeguard the independence of the judiciary? 

    Greece had yet to establish a statelessness determination procedure; could the State party clarify its plans to finalise and implement a Presidential Decree establishing a statelessness determination procedure?  Would the State party consider ratifying the 1961 Convention on the Reduction of Statelessness?

    The Committee was concerned about reports that unregistered Roma people faced lengthy and costly judicial procedures to acquire Greek citizenship, and that children born to stateless parents faced substantial barriers to obtaining Greek nationality.  Did Greece have any plans to amend the list of documents required to apply for Greek nationality on the basis of birth and non-acquisition of a foreign nationality at birth, especially for children born to stateless parents?  What concrete steps were in place to eliminate the barriers that stateless Roma faced to acquiring Greek nationality and to address the risk of statelessness within this community? 

    Concerns persisted about the application of the “safe third country” concept, particularly with the designation of Türkiye as a safe third country for asylum seekers from Syria, Afghanistan, Pakistan, Bangladesh, and Somalia.  Despite the lack of readmissions to Türkiye since March 2020, Greece continued to reject numerous applications as inadmissible under this concept, leaving many individuals in prolonged legal limbo without access to international protection.  What measures had been taken to reconsider the extensive use of the safe third country concept given the non-implementation of returns to Türkiye?  How was the State party addressing the protracted legal limbo experienced by asylum seekers, and what protections and support were available for their rights?  What had been done to 

    ensure the implementation of law 4939/2022, which mandated an in-merit examination when a third country did not permit entry?  What support mechanisms were in place for those whose applications had been deemed inadmissible? 

    Another Expert said the State party had asserted that pushbacks had never been practiced as a de facto border policy of the State party and that the Hellenic police and Hellenic coast guard consistently followed the established legal and procedural frameworks.  Yet numerous reports documented instances of pushbacks, including patterns of excessive use of force, cruel, inhuman and degrading treatment, incommunicado detention, and unlawful destruction of personal belongings.  Reports before the Committee indicated that from January 2020 to June 2024, there were 1,452 incidents at the borders affecting approximately 46,649 people.  Could the State party comment on such allegations and provide information on measures in place to prevent such practices and to safeguard the principle of non-refoulement? 

    Could information be provided on the outcome of investigations undertaken by the National Transparency Authority and other monitoring mechanisms on pushback allegations, and whether there was any follow-up or redress measures taken on allegations of pushbacks?  How would Greece ensure thorough, systematic, effective, and independent investigations into allegations of pushbacks and hold those responsible accountable?  What was the outcome of the 200 documented complaints of pushback cases?  What measures were being taken to ensure that border control operations prioritised the protection of life and that rescue efforts were conducted in compliance with human rights?

    Another Expert said according to the information received, conscientious objectors who performed civilian service would receive either food and accommodation without any salary, or €223.53, which was well below the legal minimum wage.  In addition, the law provided for the possibility for persons over the age of 33 to perform only part of their service and to buy back the rest, at a significantly higher rate than that for military service.  Could the State party comment on this information?  What measures did the State party intend to take to avoid imposing repeated sanctions on conscientious objectors?  What measures did the State party intend to take to ensure non-punitive alternative civilian service?

    It was evident that Roma were considered as a vulnerable social group, and could exercise all civil and political rights.  What measures were being taken to prevent, combat and eliminate all forms of discrimination against Roma children in the education system?  What measures were being taken to limit the use of forced evictions by adopting viable alternatives to eviction, including alternative housing for evicted families?

    The Committee was concerned that stricter registration and financial regulations could compromise civil society’s capacity to monitor human rights, particularly those of asylum seekers, refugees and displaced people.  How did the State party ensure that registration and financial requirements were necessary and proportionate?  How was it guaranteed that these requirements did not indirectly discriminate? 

    The Committee continued to receive information that human rights defenders, especially those working with migrants, asylum seekers and refugees, and on pushbacks, were regularly subjected to smear campaigns, harassment, threats and criminal prosecution. In one case, a human rights defender faced restrictions, including a travel ban.  How were these measures considered proportionate?  How were human rights defenders protected in order to ensure that they could carry out their work safely?

    The Committee had received reports linking blanket bans on assemblies to political events. Could the State party confirm that authorities limited their discretion to prohibit assemblies to those strictly necessary and not merely due to their political content?  Now that the COVID-19 emergency measures had ended, what steps had the State party taken to prevent the imposition of blanket bans on all demonstrations?

    One Expert said credible reports indicated that police officers had used excessive force against, and caused serious injuries to, protestors and journalists participating in demonstrations.  What measures were being taken to ensure that police officers used the minimum force necessary in response to high-tension demonstrations?  Could updates be provided about the installation and use of surveillance systems in public demonstrations, including any efforts to establish clear criteria for identifying the persons and places subjected to surveillance, to limit the time period of data retention, and to make information about the systems publicly accessible? 

    What specific reform measures had been adopted to strengthen internal oversight and accountability within the Hellenic Police, especially regarding protest management? How was it ensured that all police officers consistently complied with the requirement to wear visible identification during public assemblies?

    Greece’s Ethics Committee had the authority to exclude media from state advertising and funds for up to two years, raising concerns that government control could have a chilling effect on press freedom.  How was it ensured that the Ethics Committee operated independently from government influence and respected journalistic integrity?  Would the State party revise the legal framework to protect journalists against the use of retaliatory lawsuits?  How were journalists informed about their rights and responsibilities during public demonstrations? 

    Responses by the Delegation 

    The delegation said the Supreme Judicial Council decided on the placements, postings and promotion of judicial officers. The principle of non-refoulment was a cornerstone of the framework for the protection of refugees. Strict adherence to this principle applied, and the Hellenic police had circulated clear guidelines for Hellenic police staff regarding the protection of those arriving in the country, particularly women and children.  It was clarified that no third country national who applied for international protection should be returned until their application had been reviewed. 

    The Hellenic police conducted border surveillance duties with full respect of the human rights of third country nationals.  Particular emphasis was given in the provisions of the European Convention of Human Rights.  Land border activities conducted by the Hellenic police aimed at detecting all illegal crossings.  Greece’s legislative framework did not have a specific framework for protecting human rights defenders.  However, an article within the Penal Code set out a special aggravating condition for crimes or misdemeanours committed out of hatred. 

    Actions taken by Hellenic authorities at the sea borders were carried out in full compliance with international obligations. Allegations of so-called pushbacks were not compatible with the well-established operations of the Hellenic authorities.  However, any allegations of pushbacks or mistreatment of third country nationals were thoroughly investigated.  Hellenic coast guards demonstrated a high level of professionalism and were trained to respect the rights of all who were crossing the borders.  From 2015 to the present, the Hellenic coast guards had rescued more than 254,000 people. 

    Several mechanisms allowed complaints against pushbacks to be submitted to the Hellenic authorities, and the coast guards had a robust disciplinary mechanism. Upon receiving a complaint on human rights violations, an administration investigation was launched, and depending on findings, disciplinary sanctions were carried out.  An independent investigation had been launched by the Greek Ombudsman, the results of which were pending.  The law aimed to ensure people in distress at sea and migrants received the highest level of assistance. 

    Greece enacted a law in 2020, followed by a presidential decree, pertaining to public assembly.  This law clearly defined the power of police authorities while ensuring protection, fully protecting the right to freedom of assembly. The Greek police had imposed assembly bans during COVID-19 based on exceptional public health concerns. Greece’s primary aim was to promote the right to assembly, not to restrict it.  In 2023, only three rallies had been banned.  The Hellenic police prioritised de-escalation and the use of “soft measures”, with force being used as a last resort.  Around 34 cases of excessive use of force had been recorded against journalists in 2021, and were sent to the Ombudsman for review. 

    The use of the surveillance system in the context of public open-air assemblies was limited to the assemblies only, without focusing on particular people and without recording sound.  Police officers were obliged to wear a badge of identity on their uniforms during the assemblies. 

    The Greek asylum service had significantly expanded its operational capacity, now operating in 26 different locations across the country, including islands such as Lesbos; these islands were the frontlines of migratory flows.  The number of employees had tripled after 2019 to manage the high volume of cases. By implementing reforms, the Greek asylum service managed to reduce the large number of pending asylum cases to around 18,000 in 2024, down from over 200,000.  Asylum seekers whose appeal had been rejected had the right to file for the annulment of the decision within 30 days.  During 2023, refugee and protection status had been granted to 873 applicants.  This number was around 400 so far in 2024. 

    Greece had designated Türkiye as a safe third country concerning asylum seekers from certain countries.  Based on this information, it could safely be assumed that Türkiye respected the principle of non-refoulment.  Since March 2020, Türkiye had not been responding to requests from nationals from countries such as Bangladesh, Pakistan, Syria and other countries and was therefore not implementing its obligations. 

    Free legal aid was provided to asylum applicants.  Appeals committees were instructed to rule that the applicants were stateless if asylum applicants could not prove which country they came from.  Acquisition of Greek citizenship did not discriminate, and children born to Greek Roma parents were awarded Greek citizenship from birth.  The Greek Citizenship Code aimed to prevent statelessness.  Stateless children enjoyed a right to Greek citizenship if they resided permanently in Greece and had between six to nine years of Greek schooling, even if they had not been born in Greece.   

    Several laws referred to the requirements of registration for non-governmental organizations.  The new registration process aimed to set the same rules for all non-governmental organizations and was free of charge.  This year, 10 registrations had been accepted and only one was rejected. 

    In July 2022, the revision of the school curriculum for primary and secondary education was completed, seeking to foster a more equitable educational environment.  In this framework, the teaching of religious education in Greece was viewed as an essential component.  Like other subjects, religious education was intended to foster critical thinking and respect for diverse beliefs and values.  This course would be provided with alternative educational opportunities for students who did not participate in religious education due to their beliefs or backgrounds.

    Military service was a universal obligation in Greece.  Those who identified as conscientious objectors could fulfil this duty through another service, other than within the armed forces.  In the case of the person banned from leaving the country, this ban had been lifted. 

    The Greek authorities had gone the extra mile regarding the adoption of a law in 2022 to strengthen the transparency of print and electronic media. The conditions which had been set out for print and electronic media enhanced the protection of journalists. Regarding the two-year penalty of exclusion from media, this only occurred following a careful examination. This two-year penalty had been approved by the federal journalistic organizations of Greece. 

    More than 200 print media and 400 electronic media had been approved in Greece.  In July 2022, a taskforce was created to focus on issues including gender-based challenges in the media area.  Most recently, a training was conducted in collaboration with the United Nations Educational, Scientific and Cultural Organization for law enforcement operators and media professionals to foster better cooperation between the two groups. From this taskforce, a law was developed to protect journalists covering sports events from violence. 

    A new programme was being designed to help Roma people with no documents acquire them.  There was no specific legislation on minority associations or organizations.  Over 200 associations had been formed by members of the Muslim minority. 

    Questions by Committee Experts

    A Committee Expert asked how often demonstrations were completely prohibited?  How were associations informed about procedural rights? 

    Another Expert asked for more information regarding the income of conscientious objectors? 

    An Expert said there were overwhelming reports that had documented instances of forced returns.  How was it possible to follow the principle of non-refoulment in these instances?   

    Another Expert thanked the delegation for their thorough answers.  Could further clarification be provided about the State party’s plan to develop a statelessness determination procedure? 

    Responses by the Delegation 

    The delegation said each case of public assembly was evaluated directly, taking into account proportionality and necessity.  The police aimed to facilitate the legal rights to assembly without incident.  The new Penitentiary Code introduced a remedy, enabling those serving in pretrial detention to lodge complaints about the conditions of their living conditions and medical care. 

    Pushbacks were not the policy of the Greek Government in any way, shape, or form; the Government policy was clear.  Greece had significantly approved the asylum system for migration and was now the fourth most productive in the European Union. The State had made all the progress it could considering the difficult region.  Legislation protected everyone, including human rights defenders. Alleged “smear campaigns” needed to be examined by the courts; they could not always be presumed. 

    Closing Remarks

    IOANNIS GHIKAS, Permanent Representative of Greece to the United Nations Office at Geneva, thanked the Committee for the frank and honest exchange.  Although progress had been made, there was still work which needed to be done. Greece had worked hard to improve the situation, particularly on migration; the number of deaths in the Aegean Sea had fallen by 40 per cent.  Greece had a vibrant society with few resources but was working to do better. 

    TANIA MARÍA ABDO ROCHOLL, Committee Chairperson, thanked the delegation for the dialogue, which had covered a wide range of subjects under the Covenant.   The Committee aimed to ensure the highest level of implementation of the Covenant in Greece.

    Universities are future makers.

    They help build the future that we’re all going to live in.

    Build the workforce we’re going to need.

    But not just that.

    The research that our universities do grapple with the problems of today.

    And the upshot of that is a different world tomorrow.

    Look around and you can see the fingerprints of universities everywhere.

    From environmental and industrial innovations to the medicine we take or the technology we hold in our hands.

    It’s just another way of saying how important our universities are and the work they do.

    Then there’s the change that’s coming at us. That we have to adapt to. Respond to. That we have to be ready for.

    This conference is talking about that.

    And AI is a classic example of it.

    The Accord itself is all about getting us ready for that future. That change that is coming at us.

    A future where more people have a university degree than today.

    Where more people have a university qualification than ever before.

    Where by 2050, 80 per cent of the entire workforce would have a TAFE qualification or a university degree.

    That’s a big change.

    In the 1980s and 1990s, under Bob Hawke and Paul Keating, the number of Australians finishing high school jumped from around 40 per cent to almost 80 per cent.

    In the next 25 years it won’t just be 80 per cent of the workforce who have finished high school, 80 per cent will have gone to TAFE or university as well.

    That’s a big economic and social shift.

    Some of it will happen organically. Think about it.

    The fastest growing jobs in the future will be in areas like health care, teaching, ICT and engineering.

    And it’s often those professions that require university qualifications.

    But that alone is not enough to hit that 80 per cent target.

    We have also got to change.

    What the Accord says is we’ve got to break down that invisible barrier that stops a lot of people from getting a chance to go to university.

    Unless more people from poor backgrounds, more people from the outer suburbs, more people in the regions get a crack at university, then we won’t hit that target.

    That’s obvious just by looking at the raw statistics.

    About one in two young people in their 20s and 30s have a university degree, but not everywhere.  

    Not in the outer suburbs and not in the regions.

    At its core, the Universities Accord is about changing that.

    The first Accord bill is in the Parliament right now.

    It wipes about $3 billion of HECS debt, it creates paid prac, and it massively expands those FEE-FREE courses that act as a bridge between school and uni.

    That’s passed the House and it’s in the Senate.

    It’s just the start.

    The Accord is massive. Implementing it will take more than one budget or one government, but have bitten off a big chunk in this year’s budget.

    29 of the Accord’s 47 recommendations in full or in part.

    That includes a new funding system, needs-based funding and a new Australian Tertiary Education Commission to steer reform over multiple governments.

    And I hope to provide you with more detail on all of that before the end of the year.

    There is also another Accord Bill in the Parliament.

    That’s the one that sets up a National Student Ombudsman.

    An independent body to investigate and resolve disputes and give students a stronger voice when the worst happens.

    It is a necessary response to the terrible and appalling evidence of sexual violence and harassment on campus.

    But it’s not just about that. Its scope will be broad.

    That includes complaints about antisemitism and Islamophobia or any type of racism or discrimination.

    That builds on the work that TEQSA is doing with universities right now.

    The Accord also had a fair bit to say about governance more broadly.

    That’s why Education Ministers have agreed to set up the Expert Council on University Governance.

    It is based on a proposal from the University Chancellors Council.

    It is not intended to be a representative body or a stakeholder forum.

    Its job will really be to provide Ministers with expert and technical governance advice about how to improve university performance.

    There are three areas this Council will focus on:

    1.    Ensuring that universities are good employers providing a supportive workplace—and, importantly, a workplace where staff can have confidence that they will not be underpaid for the important work they do.
    2.    Making sure governing bodies have the right expertise, including in the business of running universities; and, of critical importance,
    3.    Making sure our universities are safe for our students and staff.

    My department is also engaging with the TEQSA to issue new guidance and requirements on workplace obligations for higher education providers.

    The department has also engaged an independent expert to support the National Tertiary Education Union (NTEU), Universities Australia (UA) and the Australian Higher Education Industrial Association (AHEIA) to assist in identification and resolution of priority issues to ensure universities are exemplary employers.

    And we will require universities to provide additional data to the Australian Government on casual staff numbers to increase transparency and understanding of workforce patterns and issues.

    All of these reforms are important to me.

    They are about making our universities as good as they possibly can be.

    Making them better.

    Making them fairer.

    And if we do that our country will be better and fairer too.

    Because the doors of opportunity, that the Prime Minister talks about and you hold in your hands, are opened just a bit wider.

    That’s what’s at stake.

    That’s how important the work you do is.

    General electorates down by one, number of Māori electorates stays at seven23 October 2024 – Aotearoa New Zealand has 120 parliamentary seats. These are made up of general electorate, Māori electorate, and list seats.

    The number of general electorates in Aotearoa New Zealand will decrease from 65 to 64 at the next general election. There is no change to the number of Māori electorates, which remains at seven, Stats NZ said today.

    The number of electorates in the North Island will decrease by one from 49 to 48.

    “This means there will be one more list seat in a 120-member Parliament,” acting deputy government statistician Kathy Connolly said.

    Data from the 2023 Census and Māori Electoral Option was used to determine these results.

  • MIL-Evening Report: Scurvy is largely a historical disease but there are signs it’s making a comeback

    Scurvy is is often considered a historical ailment, conjuring images of sailors on long sea voyages suffering from a lack of fresh fruit and vegetables.

    Yet doctors in developed countries have recently reported treating cases of scurvy, including Australian doctors who reported their findings today in the journal BMJ Case Reports.

    What is scurvy?

    Scurvy is a disease caused by a severe deficiency of vitamin C (ascorbic acid), which is essential for the production of collagen. This protein helps maintain the health of skin, blood vessels, bones and connective tissue.

    Without enough vitamin C, the body cannot properly repair tissues, heal wounds, or fight infections. This can lead to a range of symptoms including:

    • fatigue and weakness
    • swollen, bleeding gums or loose teeth
    • joint and muscle pain and tenderness
    • bruising easily
    • dry, rough or discoloured skin (reddish or purple spots due to bleeding under the skin)
    • cuts and sores take longer to heal
    • anaemia (a shortage of red blood cells, leading to further fatigue and weakness)
    • increased susceptibility to infections.

    It historically affected sailors

    Scurvy was common from the 15th to 18th centuries, when naval sailors and other explorers lived on rations or went without fresh food for long periods. You might have heard some of these milestones in the history of the disease:

    • in 1497-1499, Vasco da Gama’s crew suffered severely from scurvy during their expedition to India, with a large portion of the crew dying from it

    • from the 16th to 18th centuries, scurvy was rampant among European navies and explorers, affecting notable figures such as Ferdinand Magellan and Sir Francis Drake. It was considered one of the greatest threats to sailors’ health during long voyages

    • in 1747, British naval surgeon James Lind is thought to have conducted one of the first clinical trials, demonstrating that citrus fruit could prevent and cure scurvy. However, it took several decades for his findings to be widely implemented

    • in 1795, the British Royal Navy officially adopted the practice of providing lemon or lime juice to sailors, dramatically reducing the number of scurvy cases.

    Evidence of scurvy re-emerging

    In the new case report, doctors in Western Australia reported treating a middle-aged man with the condition. In a separate case report, doctors in Canada reported treating a 65-year old woman.

    There’s an abundance of vitamin C in our food supply, but some people still aren’t getting enough.

    Both patients presented with leg weakness and compromised skin, yet the doctors didn’t initially consider scurvy. This was based on the premise that there is abundant vitamin C in our modern food supply, so deficiency should not occur.

    On both occasions, treatment with high doses of vitamin C (1,000mg per day for at least seven days) resulted in improvements in symptoms and eventually a full recovery.

    The authors of both case reports are concerned that if scurvy is left untreated, it could lead to inflamed blood vessels (vasculitis) and potentially cause fatal bleeding.

    Last year, a major New South Wales hospital undertook a chart review, where patient records are reviewed to answer research questions.

    This found vitamin C deficiency was common. More than 50% of patients who had their vitamin C levels tested had either a modest deficiency (29.9%) or significant deficiency (24.5%). Deficiencies were more common among patients from rural and lower socioeconomic areas.

    Now clinicians are urged to consider vitamin C deficiency and scurvy as a potential diagnosis and involve the support of a dietitian.

    Why might scurvy be re-emerging?

    Sourcing and consuming nutritious foods with sufficient vitamin C is unfortunately still an issue for some people. Factors that increase the risk of vitamin C deficiency include:

    • poor diet. People with restricted diets – due to poverty, food insecurity or dietary choices – may not get enough vitamin C. This includes those who rely heavily on processed, nutrient-poor foods rather than fresh produce

    • food deserts. In areas where access to fresh, affordable fruits and vegetables is limited (often referred to as food deserts), people may unintentionally suffer from a vitamin C deficiency. In some parts of developing countries such as India, lack of access to fresh food is recognised as a risk for scurvy

    • the cost-of-living crisis. With greater numbers of people unable to pay for fresh produce, people who limit their intake of fruits and vegetables may develop nutrient deficiencies, including scurvy

    • weight loss procedures and medications. Restricted dietary intake due to weight loss surgery or weight loss medications may lead to nutrient deficiencies, such as in this case report of scurvy from Denmark

    • mental illness and eating disorders. Conditions such as depression and anorexia nervosa can lead to severely restricted diets, increasing the risk of scurvy, such as in this case report from 2020 in Canada

    • isolation. Older adults, especially those who live alone or in nursing homes, may have difficulty preparing balanced meals with sufficient vitamin C

    • certain medical conditions. People with digestive disorders, malabsorption issues, or those on restrictive medical diets (due to severe allergies or intolerances) can develop scurvy if they are unable to absorb or consume enough vitamin C.

    How much vitamin C do we need?

    Australia’s dietary guidelines recommend adults consume 45mg of vitamin C (higher if pregnant or breastfeeding) each day. This is roughly the amount found in half an orange or half a cup of strawberries.

    When more vitamin C is consumed than required, excess amounts leave the body through urine.

    Signs of scurvy can appear as early as a month after a daily intake of less than 10 mg of vitamin C.

    Eating vitamin C-rich foods – such as oranges, strawberries, kiwifruit, plums, pineapple, mango, capsicum, broccoli and Brussels sprouts – can resolve symptoms within a few weeks.

    Vitamin C is also readily available as a supplement if there are reasons why intake through food may be compromised. Typically, the supplements contain 1,000mg per tablet, and the recommended upper limit for daily Vitamin C intake is 2,000mg.

    Census results reflect Aotearoa New Zealand’s diversity – media release – 3 October 2024 – Aotearoa New Zealand continues to become more culturally diverse, according to 2023 Census data released by Stats NZ today.

    The 2023 Census showed that people living in Aotearoa New Zealand identified with a wide range of ethnicities – and spoke over 150 languages. Additionally, while most of the population were born here, New Zealand was also home to people born in a diverse range of countries.

    “Just under 30 percent of New Zealanders were born overseas, and the census recorded well over 200 different birthplaces,” deputy government statistician and deputy chief executive insights and statistics Rachael Milicich said.

    “Pretty much every part of the world is represented here, from people born in Iceland in the north, to Argentina in the south.”

    Of the census usually resident population count, 3.5 million people were born in New Zealand and 1.4 million were born overseas.

    Home ownership increases and housing quality improves – media release – 3 October 2024 – 2023 Census data shows home ownership has increased and housing quality has improved, according to statistics released by Stats NZ today.

    Around two-thirds of households in Aotearoa New Zealand (1,175,217 or 66.0 percent) now own their home or hold it in a family trust, compared with 64.5 percent in 2018.

    “This increase in home ownership, although small, is a reversal of the falling rates we have seen since home ownership peaked in the early 1990s,” Stats NZ principal analyst Rosemary Goodyear said.

    2023 Census shows 1 in 20 adults belong to Aotearoa New Zealand’s LGBTIQ+ population – media release – 3 October 2024 – Confidentialised data from the 2023 Census found that 172,383 people (4.9 percent of adults) belonged to the LGBTIQ+ (or Rainbow) population, according to data released by Stats NZ today.

    LGBTIQ+ includes people who are lesbian, gay, bisexual, transgender, non-binary, intersex, or have other minority genders or sexual identities.

    Gender, sex, and LGBTIQ+ concepts in the 2023 Census has further information. LGBTIQ+ status is derived for all usual residents aged 15 years and older who responded to the census.

    The 2023 Census was the first census to collect data from New Zealanders about their gender, sexual identity, and whether they have a variation of sex characteristics.

    “Census data is for everyone in Aotearoa New Zealand, so it is important that Rainbow communities can see themselves in the data for the first time. We thank those who have advocated for and contributed to the delivery of this data over the years,” deputy government statistician and deputy chief executive insights and statistics Rachael Milicich said.

  • MIL-OSI United Nations: 4 ways countries are strengthening women’s participation in security efforts

    The full, equal and meaningful participation of women in all peacekeeping areas has been found to make our operations more effective and lets us better reflect and engage with the communities we serve. However, according to the latest data available, women still make up approximately 10% of peacekeeping’s police and military personnel.

    As UN military and police personnel are contributed by Member States, drawing from their own security institutions, troop and police contributors are critical to closing this gender gap. To help empower women peacekeepers and increase their numbers, UN Member States have committed to promote equal opportunity for all in their own security and defence institutions by identifying and removing barriers to women serving. This is making their own security sectors stronger while also leading to the deployment of more diverse military and police contingents to peacekeeping missions.

    On 17 October, the UN released its first-ever report on this issue, “Towards Equal Opportunity for Women in the Defence Sector.” It highlights that, despite the efforts of Member States to achieve gender equality, challenges and barriers still exist, making this a key issue for all. The report also showcases some innovative solutions that countries are using to boost women’s participation. Here are four standout best practices from the report:

    1. India: expanding opportunities for women in the armed forces

    India, a top contributor to UN peace operations, has made significant strides toward integrating women into its military forces. In 2020, the Indian Army began offering women permanent positions, giving them equal opportunities for career advancement. By 2022, the National Defence Academy admitted its first female cadets, symbolizing progress in building gender-equal pathways in military leadership.

    2. Canada: reforming military culture to promote inclusivity

    Canada is spearheading military reforms to eliminate gender bias and address sexual misconduct. In 2021, they established a Chief of Professional Conduct and Culture (CPCC to foster a safe and respectful environment for all service members. This cultural shift enhances the operational effectiveness of Canadian forces and, in turn, strengthens Canada’s peacekeeping deployments by ensuring inclusive participation.

    Colonel Marie-Ève Bégin, the Director General of the CPCC, highlighted that “the creation of [this new structure] shows our commitment to improving our organization’s culture.”

    3. Uruguay: empowering women in the armed forces through family support

    Uruguay has introduced initiatives to support women in its military, with a focus on deployment, helping them balance military service with caregiver responsibilities. With support from the Elsie Initiative Fund, the Ministry of Defence provides scholarships to cover childcare and elder care costs for deployed women and single parent families, regardless of gender, ensuring that caregiver obligations do not hinder participation in military operations and peacekeeping deployments.

    4. Ghana: training women for leadership in peacekeeping

    Ghana, another of UN Peacekeeping’s top troop-contributing countries, is addressing the challenge of advancing women’s careers in the national army by focusing on skills development, including in operational and tactical fields that are traditionally male-dominated, as well as on leadership opportunities.

    “We should continue to challenge gender stereotypes, call out discrimination, draw attention to biases and seek out inclusion,” says Commodore Faustina Anokye, the highest-ranking female officer in the history of the Ghanaian navy who also served as Deputy Force Commander of the UN peacekeeping mission in the Western Sahara (MINURSO).

    A global commitment to inclusive security

    Removing barriers to women who want to serve in the defence sector is a key way Member States are meeting their commitment to promote gender equality in peacekeeping missions. “If these institutions are not inclusive and representative,” said Alexandre Zouev, Assistant Secretary-General for Rule of Law and Security Institutions, “our gender parity efforts in peacekeeping will inevitably fall short.”

    Departments across the UN, through their Security Sector Reform (SSR) initiatives, are supporting Member States’ efforts to promote women’s participation in their defence sectors. The UN has also launched the Braking Barriers, Building Peace advocacy campaign, which is promoting equal opportunities in defence and security sectors around the world.  Through this work, the UN and its Member State partners are making peacekeeping more representative and responsive to diverse security needs, which is especially critical in today’s complex conflict environments.

    By committing to gender equality, the UN and its Member States are building more inclusive societies and enhancing sustainable peace and security for all.

  • MIL-OSI China: Beijing’s GDP grows 5.1%

    The gross domestic product (GDP) of Beijing increased 5.1 percent year on year in the first three quarters of 2024, the city’s statistics authorities said Monday.

    The Chinese capital’s GDP reached 3.3 trillion yuan (about 465 billion U.S. dollars) from January to September, according to the municipal bureau of statistics.

    Key industries in Beijing showed robust growth in the first nine months of the year. The manufacturing of computers, communication and other electronic equipment saw an increase of 19.5 percent year on year, while the automotive manufacturing industry surged by 18.4 percent compared with the same period last year.

    In the tertiary sector, the information transmission, software and information technology services industry saw rapid growth, achieving added value of 710.5 billion yuan, up 11.9 percent year on year. The added value of the financial industry increased by 6.6 percent to 672 billion yuan.

    In terms of employment, the urban surveyed unemployment rate in Beijing for the first three quarters stood at 4.1 percent on average, 0.4 percentage points lower than the same period last year.

  • MIL-OSI United Nations: Experts of the Committee on the Elimination of Discrimination against Women Praise Japan for Criminalising Non-Consensual Sexual Intercourse, Ask about Women’s Representation in Public and Private Bodies and the Single Surname System for Married Couples

    The Committee on the Elimination of Discrimination against Women today considered the ninth periodic report of Japan, with Committee Experts praising the State’s revision of legislation on rape to criminalise non-consensual sexual intercourse, and raising questions about women’s representation in public and private bodies and the single surname system for married couples.

    Bandana Rana, Committee Expert and Rapporteur for Japan, commended the State party for redefining rape as “non-consensual sexual intercourse” and for raising the age of consent to 16.

    Ms. Rana noted, however, that Japan had been ranked one hundred and twenty-fifth globally in terms of gender equality, due to, among other factors, the low level of women’s representation in government and deeply rooted gender stereotypes that hampered women’s standing.  The State party needed to address these issues, she said.

    Several Committee Experts raised concerns regarding women’s representation in public and private bodies.  One Expert noted that the number of women representatives in government had decreased recently, and that only around 0.8 per cent of company chief executive officers and 7.1 per cent of senior diplomats were women.  How would the State party improve female representation?

    A Committee Expert noted that 94.7 per cent of women adopted their husband’s surname under the current single surname system.  This had negative impacts on their identity and employment.  What were the prospects of reforming the law to allow for a dual surname system?

    Introducing the report, Keiko Okada, Director-General, Gender Equality Bureau, Cabinet Office of Japan and head of the delegation, said revisions to the Penal Code in 2023 clarified that non-consensual sexual acts constituted crimes regardless of marital status and raised the age of sexual consent from 13 to 16.  Multiple other laws addressing sexual violence, including against children, had also been enacted.

    Ms. Okada said the Government aimed to increase the percentage of women among candidates for the House of Representatives and the House of Councillors to 35 per cent by 2025.  The Act on Promotion of Women’s Participation and Advancement in the Workplace made it obligatory for national and local governments to set targets for women’s representation and make information about women’s participation publicly available. 

    The delegation added that companies with 301 employees or more were obliged to develop action plans on promoting women’s participation and publish statistics on women’s representation in workforces, and there were plans to extend this obligation to companies with 101 employees or more. There had been a gradual increase in women’s representation in managerial positions in private companies in recent years.

    Ms. Okada also said public opinion in Japan varied greatly regarding separate surnames for married couples.  The Government would proceed with deliberations on the introduction of such a system while closely monitoring public opinion. It was raising awareness that former surnames could be recorded alongside formal surnames on many official documents.

    In closing remarks, Ms. Okada said the delegation had engaged sincerely in the dialogue.  It hoped that the responses it had provided would be useful for the Committee.

    Ana Peláez Narváez, Committee Chair, in her concluding remarks, said that the dialogue had provided further insight into the situation of women in Japan. The Committee encouraged the State party to undertake further efforts to implement the Convention more comprehensively for the benefit of all women and girls in the State.

    The delegation of Japan consisted of representatives from the Cabinet Office; Cabinet Secretariat; National Police Agency; Children and Families Agency; Ministry of Justice; Ministry of Foreign Affairs; Ministry of Education, Culture, Sports, Science and Technology; Ministry of Health, Labour, and Welfare; and the Permanent Mission of Japan to the United Nations Office at Geneva.

    Presentation of Report

    KEIKO OKADA, Director-General, Gender Equality Bureau, Cabinet Office of Japan and head of the delegation, said that for nearly 40 years since ratifying the Convention in 1985, Japan had committed itself to implementing gender equality measures with the aim of eliminating discrimination against women both in its legislation and in practice.

    Following Committee recommendations, a bill to revise the Civil Code to make the minimum legal age of marriage the same for men and women was enacted in 2018 and took effect in 2022.  Another revision to the Civil Code enacted in 2022 abolished the waiting period for women to remarry after divorce.  This took effect in 2024.

    Public opinion in Japan varied greatly regarding separate surnames for married couples. The Fifth Basic Plan for Gender Equality stated that the Government would proceed with deliberations on the introduction of such a system while closely monitoring public opinion and developments in the National Diet’s discussion on the matter.  The Government was committed to expanding the use of former surnames; it was raising awareness that former surnames could be recorded alongside formal surnames on many official documents.

    The Hate Speech Elimination Act, the Act on the Promotion of the Elimination of Buraku Discrimination, and the Act on Promoting Measures for the Ainu People all incorporated the principle that discrimination was unacceptable, while the Basic Plan on Human Rights Education and Human Rights Awareness-Raising promoted human rights education and awareness-raising, identifying issues concerning women, the Buraku community, the Ainu people, and foreign nationals.  The content of the Plan was now being reviewed to address emerging issues.

    Revisions to the Penal Code in 2023 introduced crimes of “penetrative sexual assault” and “indecent assault”; clarified that non-consensual sexual acts constituted crimes regardless of marital status; raised the age of sexual consent from 13 to 16; criminalised requesting or engaging in a meeting with a child aged 15 or under for the purpose of an indecent act; and extended the statute of limitations for prosecuting sexual crimes.  Multiple other laws had also been enacted, including acts establishing the crime of non-consensual recording of a sexual image, preventing harm as a result of performing in sexually explicit videos, and stipulating measures to prevent sexual violence against children in schools and childcare providers. As of 2023, courts were able to issue orders banning spouses, including same-sex spouses, from approaching victims not only in cases of physical violence, but also in cases of non-physical acts causing psychological harm.  A 2022 law also stipulated comprehensive provision of a wide range of assistance for women victims of violence.

    Following 2019 legislation, a lump-sum payment of 3.2 million yen was provided to people with disabilities who underwent forced surgeries or other sterilization procedures. As of 2024, 1,129 claimants, including 817 women, had been approved for receipt of such payments.  In July 2024, the Supreme Court ruled that the provisions of the now-defunct Eugenic Protection Act relating to sterilization surgeries were unconstitutional.  The Prime Minister subsequently apologised on behalf of the Government for its role in enforcing the Act.  In September 2024, a “Basic Agreement” was signed with stakeholders aiming for a comprehensive solution to the issues of the now-defunct Eugenic Protection Act. The Diet also passed and enacted a bill on payment of compensation to persons who underwent eugenic surgery in October 2024.

    Following another Committee recommendation, Japan enacted and enforced domestic legislation to give effect to the United Nations Convention against Transnational Organized Crime and its supplementary protocol on trafficking in persons in 2017.

    In June 2021, measures to combat sexual harassment and harassment related to pregnancy and childbirth were made mandatory.  The Government aimed to increase the percentage of women among candidates for the House of Representatives and the House of Councillors to 35 per cent by 2025. The Act on Promotion of Women’s Participation and Advancement in the Workplace made it obligatory for national and local governments to set targets for women’s representation, formulate action plans comprising measures to achieve their targets, and make information about women’s participation publicly available.

    The Government aimed to ensure that by 2031, 40 per cent of single-parent households received child support, and that 70 per cent of single-parent households that had a child support agreement received it.  Revisions to the Civil Code in May 2024 introduced a statutory child support system that enabled a parent who lived with a child to claim child support from the parent who lived separately.  The revisions updated provisions relating to child support, parental responsibility and custody, making it possible for both parents to be designated as having parental responsibility following divorce.  Sole parental responsibility was always mandated in potential cases of child abuse, domestic violence, or other potential harm.

    Following the Committee’s recommendations, the Government had revised legislation to make it obligatory for employers with 301 or more regularly employed workers to make information about the gender wage gap publicly available.  The Government also offered a consultation service to help companies analyse the factors and reduce gender wage gaps and was promoting the use of digital tools to help companies calculate those gaps.  Local and national governments were also required to make information on gender wage gaps for all their agencies publicly available.

    The Act on Childcare and Family Care Leave was revised in June 2021, creating a parental leave system that allowed fathers to take leave twice, up to a maximum total of four weeks, within the first eight weeks after the birth of their child. Employers with more than 300 employees were required to make uptake rates of parental leave publicly available. Employers were also required to provide flexible ways of working for workers with preschool age children. Legislation was revised to allow employees who took childcare leave for 14 days or more to receive 80 per cent of their pre-leave pay for 28 days.

    ATSUYUKI OIKE, Permanent Representative of Japan to the United Nations Office at Geneva, said Japan had successfully formulated three national action plans on women, peace and security and was eagerly ensuring cross-cutting intergovernmental coordination.  Bodies promoting women, peace and security were established within the Ministry of Foreign Affairs and the Ministry of Defence.  Japan was currently implementing 57 projects across the globe, contributing to promoting the women, peace and security agenda in Asia, Africa and Latin America.  In 2025, Japan would assume the role of Co-Chair of the Women, Peace and Security Focal Points Network; it would make every effort to advance the agenda internationally.

    Questions by Committee Experts 

    BANDANA RANA, Committee Expert and Rapporteur for Japan, commended Japan for its efforts since its last report.  Ms. Rana said that Hiroko Akizuki, the Committee’s Vice-Chair, made valuable contributions to the Committee.  Japan was also congratulated for being nominated as the Co-Chair of the Women, Peace and Security Focal Points Network for 2025.

    Challenges remained for fully achieving gender equality.  Japan had been ranked one hundred and twenty fifth globally in terms of gender equality, due to, among other factors, the low level of women’s representation in government and deeply rooted gender stereotypes that hampered women’s standing.  The State party needed to address these issues.

    Ms. Rana commended the State party for redefining rape as “non-consensual sexual intercourse” and for raising the age of consent to 16.  There was a lack of enforcement of gender equality legislation, leading gender gaps and discriminatory practices to persist.  What legal complaint mechanisms were in place for women who faced discrimination and how was the State party raising awareness of these mechanisms?

    Ms. Rana commended the State party on adopting several laws that addressed discrimination.  There was no definition of intersectional discrimination in legislation.  Would the State party adopt such a definition?  What was the status of efforts to ratify the Convention’s Optional Protocol?

    Japan’s Basic Plan for Gender Equality lacked concrete commitments to address structural barriers for women. How would the State party address the shortcomings in the Plan?

    International treaties had the same effect as domestic legislation in Japan, but courts reportedly rarely applied the Convention.  There were commendable training programmes for judges on the Convention.  How would the State party further promote implementation and awareness of the Convention?

    A Committee Expert commended Japan on its stand on lethal autonomous weapons systems, which was in line with the Committee’s general recommendation 30.

    Responses by the Delegation

    The delegation said that under the Constitution and domestic laws, gender-based discrimination was prohibited. The Fifth Basic Plan on Gender Equality called on the Government to raise awareness about remedy mechanisms available to the public.  The plan would run until the end of 2025.  Consideration of the next plan would begin at a later stage.

    Japan was taking into consideration various issues, including organisational frameworks, in its deliberations on ratifying the Optional Protocol, and would seriously consider ratifying it soon.

    All international human rights treaties ratified by Japan had the same effect as domestic law, and were referred to when necessary in courts.  The Convention attached rights and obligations to the State party, not individuals.  The Legal Training and Research Institute trained judges each year on human rights issues.  Prosecutors also received training on international conventions. 

    Non-governmental organizations had contributed to the State party’s policies on gender; women, peace and security; and to drafting the State party’s report.

    Questions by Committee Experts 

    A Committee Expert said Japan had created shelters and strong policies to address human trafficking.  There were problems in the State party’s measures to address trafficking, which had not changed in the last five years and did not cover the whole country.  What was the role of women in the peacebuilding process in Japan?  Had the Diet implemented gender budgeting?  Would the State party develop an independent national human rights institute for the benefit of women?  Japan needed to provide increased support for non-governmental organizations.

    Another Committee Expert acknowledged legislative measures to promote women’s participation in public life.  The Basic Plan for Gender Equality set targets to increase women’s representation in political bodies, disaster management bodies, and leadership positions to 30 per cent.  Other countries of similar economic capacity were seeking to achieve parity, so it was disappointing that these modest targets had not been reached.  What progress had been made in achieving the targets in the Plan?  Would the State party adopt temporary special measures to reduce the fee of three million yen required for running for political office?  Were there temporary special measures targeting Buraku women and women with disabilities?  The Expert congratulated Nihon Hidankyo on receiving the 2024 Nobel Peace Prize and asked how the Government was supporting women hibakusha and women and girls affected by the Fukushima Daiichi nuclear disaster.

    Responses by the Delegation

    The delegation said Japan had 10 women ambassadors and six general counsels who were women.  Forty per cent of Foreign Ministry employees were women, and this percentage was expected to increase.

    The Government had announced preventative measures to address sexual abuse by United States forces in Okinawa.  A new forum had been established between the military and residents of Okinawa.  Japan had primary jurisdiction over offences committed by military personnel.

    National and regional legal affairs bureaus had staff members that received complaints of human rights violations from women. There had been a significant increase in the budget promoting gender equality in recent years.  The Government’s 2024 budget included investments of 10.6 trillion yen in gender policies.

    The Government was working to promote the participation of women with disabilities in decision-making processes.  The Government had a policy committee for persons with disabilities; 40 per cent of its members were women with disabilities. The central government mandated local governments to formulate plans supporting persons with disabilities.

    The Convention did not apply to the period of the Second World War.  However, Japan had legally concluded all claims and property issues related to comfort women.  It had also established a fund that provided atonement for former comfort women, who were also sent letters of apology by the Prime Minister.  Meetings had been conducted with former comfort women.  The Government had also significantly invested in a healing foundation for comfort women and provided direct support to 65 surviving comfort women.

    Some women who had evacuated Fukushima after the nuclear incident had returned.  Experts monitored the health impact of radioactive material and were providing accurate information on risks to residents.

    Questions by Committee Experts

    A Committee Expert said the State party was promoting awareness of unconscious gender bias, but patriarchal attitudes continued to be present in various aspects of life.  How did the Government measure the effectiveness of awareness activities? Would the State party consider policies to counter gender stereotyping at all levels, which appeared to be normalised in society?  How would the State party prohibit discriminatory remarks by politicians?

    How could rape be prosecuted without accusation from victims? There were reports that perpetrators of offences by United States military personnel in Okinawa against women were not brought to justice.  How was the State party addressing this?  Could the State party provide data on arrests, prosecutions and convictions?

    Resource allocations to enforce prevention of spousal violence were reportedly insufficient.  Would the State party consider revising legislation to address coercion and psychological violence?  How was it building the capacity of the judiciary related to their understanding of gender-based violence?  How were shelters for victims of domestic violence being funded?  Was there a level of awareness amongst women regarding new legislation on non-consensual sex and their right to refuse sex?

    BANDANA RANA, Committee Expert and Rapporteur for Japan, commended the 2014 national action plan to combat trafficking in persons and the establishment of the council to combat trafficking in persons.  What measures were in place to improve identification mechanisms for victims of trafficking?  Current legal provisions did not fully encompass non-coercive forms of trafficking. How would this be addressed? Labour trafficking remained significantly underreported.  How would the State party secure convictions in trafficking cases and enhance cross-border cooperation to ensure the safe return of trafficking victims? Victimisation of girls persisted in the online sphere through child prostitution and pornography.  How was this being addressed?  Did programmes to prevent trafficking reach rural areas? What measures were in place to prevent the trafficking of young women and girls forced into prostitution by economic hardship?

    The Committee acknowledged efforts made by Japan to address the comfort women issue.  These steps needed to be sustained and enhanced to ensure the rights of victims to truth, justice and reparation.

    ANA PELÁEZ NARVÁEZ, Committee Chair, asked how legislation addressed sexual acts against persons who could not give consent, such as children and persons with disabilities.

    Responses by the Delegation

    The delegation said that the Cabinet Office had conducted surveys in 2021 and 2022 that revealed unconscious bias related to gender.  It had since implemented various measures to promote awareness of unconscious bias in government and society.  The Act on Promotion of Gender Equality in the Political Field required political bodies to implement training to prevent sexual harassment against persons holding public office.  Individual cases of harassment were handled according to the law.

    In 2023, the Penal Code was revised to specify that non-consensual sexual relations were prohibited in all situations. Information had been posted on Government websites, and leaflets and posters had been created, informing women and girls about the new legislation.  Lectures on the new law had also been provided for staff at one-stop support centres.  Persons who had sex with persons who could not give consent due to a disability or other factors were punished under the law.

    A victim-centred approach was taken to addressing the issue of sexual abuse by military personnel against women in Okinawa. Suspects were held by the military until the Japanese Government indicted them.  The Government was committed to holding all perpetrators accountable.  There were three arrests of United States forces for non-consensual sex with women and one arrest for indecent assault.

    The Act against Sexual Violence was amended in 2023 to address threats of violence and extend restraining orders for perpetrators of domestic violence.  The Legal Training and Research Institute had conducted training on domestic violence for family court clecks and investigators.  Courts could order prohibition of repeated phone calls to victims. Forty-seven publicly run shelters were provided for victims of sexual and gender-based violence, and the Government also supported privately run shelters.  Livelihood support was provided for victims, as was education support for their children.  In 2023, 1,100 protection orders were issued by courts.

    In 2022, the Government introduced an action plan on trafficking in persons, which promoted the identification and support of victims. After 2022, Japan had been attending the meetings of the Bali Process and contributing funds to the International Organization for Migration to promote awareness of trafficking and voluntary returns of victims.  Japan had supported the return of over 600 victims.  The Japan Coast Guard conducted inspections of vessels and took protective measures if there were suspicions of trafficking.  The Immigration Services Agency investigated whether asylum seekers were victims of trafficking.  Residence visas could be issued to persons found to be victims.  The Agency provided consultations and information on trafficking in persons in multiple languages, and victim protection services through regional contact points.  The police had also been trained in identifying victims of trafficking.

    Legislation had been enacted to address online child pornography and child prostitution.  Persons who distributed child pornography were prosecuted under this legislation.

    Japan aimed to lead global efforts to prevent gender-based violence.  It was providing financial contributions to organizations supporting women affected by conflict and was conducting awareness raising campaigns to prevent such incidents.

    Questions by Committee Experts

    A Committee Expert commended efforts to remove barriers to female political representation in Japan.  It was concerning that the number of women representatives in government had decreased recently.  Only around 0.8 per cent of company chief executive officers were women, there were only two female justices in the Supreme Court, and only 7.1 per cent of senior diplomats were women.  How would the State party improve female representation in these areas? Would it implement penalties or incentives to improve female representation?

    Another Committee Expert said that mixed nationality couples and single foreign parents had issues with passing nationality onto their children.  Did children of mixed couples obtain Japanese nationality upon birth, regardless of the marital status of their parents? Could more detail be provided about changes in the nationality law in 2024?  Children of foreign nationals born in Japan were not granted Japanese nationality and foreign residents were not allowed the right to vote.  Could they be appointed to government positions?  Was there a complaints mechanism for denied nationality applications?

    Responses by the Delegation

    The delegation said the Basic Act for Gender Equality called on the Government to pursue affirmative actions to promote gender equality.  It set numerical targets for women’s representation and measures were developed to achieve those targets.  Numerical targets had been set for the representation of women in private sector companies.  More than half of new employees of the Foreign Ministry were women.  Currently, the Supreme Court had three women judges, meaning 20 per cent of its judges were women.  The Government was exerting efforts to increase the representation of women in the judiciary.  Companies with more than 301 employees were obliged to develop action plans on promoting women’s participation and publish statistics on women’s representation in their workforces, and there were plans to extend this obligation to companies with more than 101 employees.  There had been a gradual increase in women’s representation in managerial positions in private companies in recent years.

    The 2024 revision to the law on nationality was enacted to ensure that nationality was not granted when false claims were made by applicants.  There was no specific complaint mechanism related to obtaining nationality. Nationality could be obtained through naturalisation and other means.

    Questions by Committee Experts

    BANDANA RANA, Committee Expert and Rapporteur for Japan, said that Japan was one of the world’s largest donors to international efforts promoting gender equality.  How would the State party promote women’s participation in peace negotiations?

    Another Committee Expert said horizontal segregation persisted in Japan.  The share of female students in physical science education was 15 per cent, and around 10 per cent in engineering education. Women professors made up around 17 per cent of professors in universities.  Would the State party introduce temporary special measures to address these issues?  Why were many female lecturers hired in temporary positions?  How was the State party encouraging women to become doctors?

    How did the State party ensure standardisation and the accuracy of information in history textbooks?  How many male teachers were there in primary schools?  What measures were in place to improve the working environment for women teachers?  Did teacher training address verbal and psychological violence?  Would the State party adopt Convention standards related to sexual education?  What measures were in place to address bullying against lesbian, gay, bisexual, transgender and intersex children and children from non-conventional families?

    A Committee Expert said the Penal Code had recently been revised to address online insults; how many cases of online insults had since been prosecuted?  Marginalised women experienced disproportionate levels of workplace harassment.  The gender wage gap was wide, at 23 per cent, and there was a large proportion of unemployed work-age women.  What measures were in place to address these issues?  Most women worked in irregular employment positions; would the State party consider requiring companies to report on the percentage of women in such positions?  What protections were available for workplace harassment of whistle-blowers?  The Convention needed to be upheld in Supreme Court deliberations regarding selective surnames for women.

    Responses by the Delegation

    The delegation said that in 2023, Japan positioned gender mainstreaming as an important part of official development assistance.  It was promoting women’s empowerment through foreign policies. Wide-ranging discussions were held on the empowerment of women at the G-7 as a part of gender mainstreaming efforts. Women were encouraged to participate in humanitarian aid activities.

    Under the fifth Basic Plan for Gender Equality, there was a target for increasing women and girls’ participation in science, technology, engineering and maths education.  Women’s participation in this education had gone up this year.  The Government was also promoting diversity among university students and supporting women studying science, technology, engineering and maths subjects through scholarships.  It also awarded universities that took positive measures to enrol women students and was distributing increased funding for universities that employed high percentages of women professors and women in leadership positions.  The Government was supporting women to return to work in research after childbirth.  It found that there had been discrimination against women in three medical schools’ entrance examinations.  Measures had been taken to ban such discrimination and prevent its recurrence.

    The Government had national curriculum standards that textbook publishers needed to adhere to.  School textbooks promoted harmony between students and provided education on gender equality.  In the authorisation process, academic and other experts assessed draft textbooks created by private sector companies to ensure that they explicitly promoted gender equality.

    Overtime payment was not provided to teachers, but teachers’ salaries were adjusted based on the amount of work they conducted.  The Government was trying to reduce working hours for teachers by hiring additional teachers and implementing other measures. Teacher training covered respect for human rights and support for students of diverse backgrounds.

    Bullying, including of lesbian, gay, bisexual, transgender and intersex children, was not tolerated in schools.  Psychological health surveys and individual support teams were employed to respond quickly to school bullying, and guidelines were being revised to strengthen responses to bullying.  A policy to address deep-fake pornography was included in the Basic Plan for Gender Equality.

    Employers were not allowed to select employees based on weight, height or physical strength, or based on their ethnic background or belief. Each public and private entity had a quota for employment of persons with disabilities.  This had led to increased employment of such persons.  A workplace diversity promotion project was launched in 2019.  Companies that actively employed women were certified and provided with tax incentives. The Government, over the next three years, would introduce measures to support women’s employment in the digital field.  There were 73 prosecutions involving insults in 2023.

    Questions by Committee Experts

    A Committee Expert said the Equal Employment Act did not recognise discrimination based on pregnancy, rural background or age. Would the State party amend this legislation?  More than 50 per cent of female workers were in temporary positions.  This needed to be addressed.  The 2025 World Expo was an opportunity to showcase that the future of work was female.

    Another Committee Expert asked about the slow pace of dismantling single-sex schools, which validated differences between the sexes.  What timeline did the Government have to achieve this?  What reparation had been provided to women who had been denied admission to medical schools due to discrimination?  How would the State party address negative comments by authorities related to reproductive education?

    A Committee Expert said a 2023 Government pilot had made emergency contraception pills available in pharmacies.  Would this pilot project be made permanent, and would contraception be provided to persons under 18?  Women in Japan had to get consent from spouses to seek abortions.  There were even cases where single women had had to seek permission from partners to obtain abortions.  Would the Government remove this requirement?  Only around three per cent of clinics offered abortion pills that were as expensive as other abortion procedures and needed to be taken in front of medical staff.  What measures were in place to increase access to abortion pills and to allow women to take these pills at home?

    The Committee commended the Government for apologising for the sterilisation of persons with disabilities conducted under the former eugenic protection law and for committing to provide compensation to victims. What reproductive rights did women with disabilities currently have?  What progress had been made in reducing per- and polyfluoroalkyl substances in water supplies, which were harmful for pregnant women?

    Another Committee Expert commended the revised Pension Act and support provided for start-ups created by women.  Around 15 per cent of women in Japan lived below the poverty line. Women in part-time work lacked adequate safety nets to keep them from poverty.  What measures were in place to further extend women’s access to employment opportunities and low-interest credit?  How would the State party address the gender digital skills gap? Were there financial literacy programmes for women in rural areas?  What percentage of the social security budget was devoted to older women, women with disabilities, foreign students and rural women workers?  Had the State party considered reforms that would establish guaranteed pensions for all individuals and family benefits for women with children classified as “illegitimate”?  How was the State party promoting women’s participation in sports and cultural programmes?

    Responses by the Delegation

    The delegation said the Government would continue to consider expanding the scope of legislation on indirect discrimination in recruitment, considering societal attitudes.  Japan’s efforts to promote women’s empowerment would be showcased at World Expo 2025. 

    Japan had no plans to dismantle single-sex schools.  Schools and boards of education made decisions related to single-sex education in individual schools.  Sexual and reproductive education called on students to respect the opposite gender and to make informed decisions regarding sexual activities.

    A trial was being conducted on the sale of emergency contraception pills at pharmacies and a research project on the provision of the abortion pill at medical clinics had been concluded this year.  The Government would analyse their results.  Male spouses needed to permit pregnant women to seek abortions, except in cases of domestic abuse or for unmarried mothers. The Government would deepen social discussions on this issue.

    The Government had developed a plan for promoting female digital talent; it was expanding opportunities for female high school and university students to receive education on programming.  The Government provided loans to female entrepreneurs who had difficulties obtaining funds and was collecting statistics on the number of start-ups created by women.  Seminars had been conducted to promote capacity building for women entrepreneurs.

    In 2022, the Government published cross-sectoral guidelines on business and human rights.  It would continue to study the possibility of future laws on human rights due diligence.

    The average monthly pension as of 2022 was 58,000 yen for men and 54,000 yen for women.  There was no gender gap in the system itself; the difference was due to gaps in work style between men and women.  Japan had a universal pension system.  The Government would expand the scope of employees qualified to receive pensions and would provide additional support to elderly women recipients of pensions.

    Questions by Committee Experts

    A Committee Expert asked about the timeline for the trial of emergency contraception, and asked whether the Government would change legislation to remove the requirement for people who wished to change genders to be sterilised.  It was extraordinary that women in Japan needed to get permission from spouses to obtain abortions, except in cases of divorce, domestic violence or death of spouses. Would the State party revise this?

    Another Committee Expert asked about the number of female beneficiaries of financial loans.  How would the State party provide pension coverage for all vulnerable groups, including women not in employment, education or training?

    Responses by the Delegation

    The delegation said it was currently difficult to indicate a timeline for the trial of emergency contraception, but the Government would continue to consider this.

    The poverty rate was higher for females than for males. To address this, a supplementary pension benefit was provided for low-income households.

    The Government provided various sporting opportunities for women and was promoting women’s participation in governance of sporting organizations.  A plan had been adopted that promoted women’s participation in cultural activities.

    Questions by Committee Experts

    BANDANA RANA, Committee Expert and Rapporteur for Japan, commended plans to support land ownership for rural women.  Rural women lacked access to adequate social benefits such as maternity and sickness leave. How would the State party address this? 

    Ms. Rana welcomed inspections that had led to the detection of abuse of migrant technical intern trainees.  However, migrant women workers continued to face discrimination, threats of repatriation abroad, and poor working conditions.  How was the State party addressing these issues?  What measures were in place to address barriers to accessing health care for women with disabilities?

    Women’s representation in climate change decision making was low.  How would the Government address this, and ensure that extraterritorial investments protected women’s rights?  How would the State party take responsibility for monitoring nuclear standards with regards to the dumping of nuclear treatment water into the ocean?

    Another Committee Expert said that 94.7 per cent of women adopted their husband’s surname under the current single surname system.  This had negative impacts on their identity and employment. What were the prospects of reforming the law to allow for a dual surname system?

    What measures were in place to address the impact of discriminatory practices against children born out of wedlock?  There were barriers to women accessing assets in divorce settlements.  How was the Government working to train the judiciary on these issues so that justice could be imparted with a gender perspective?  How would it protect victims of family violence after the introduction of joint custody decisions?  Were there plans to increase court resources for this purpose?  Would the State party allow for adoption by same-sex couples?  The Committee suggested that the State party consider establishing equality between men and women regarding the appointment of female emperors.

    Responses by the Delegation

    The delegation said foreigners could be appointed to certain public servant positions, but not all positions.  In 2022, several thousands of inspections were carried out under the technical intern trainee law, which had identified human rights violations.  Employers that violated migrant workers’ rights were sanctioned.

    The Ministry of Environment was actively employing women. Discharged water from the Fukushima Daiichi nuclear plant was not contaminated with nuclear material.  The International Atomic Energy Agency had determined that the radiation impact of this water was negligible and that the disposal of this water into the ocean was safe.

    Opinions were mixed regarding selective separate surnames. The Government was offering information to deepen debate on the topic in the public and in the Diet.

    The best interests of the child needed to be considered regarding visitation rights for parents.  The revision of legislation on visitation did not harm the rights of children. In 2024, the Civil Code was revised to promote the separation of property after divorces.  The period in which claims could be made to family courts were extended from two to five years.  The revised law promoted the fair division of property.

    It was not appropriate for the Committee to raise the issue of revising the system of succession to the Imperial Throne of Japan.

    Questions by Committee Experts

    ANA PELÁEZ NARVÁEZ, Committee Chair, said that the Committee had capacity to raise relevant questions regarding equality between men and women, including regarding succession to the throne.  This was a topic that was directly relevant to the Convention.

    A Committee Expert welcomed that the Government had removed a policy offering grants to women to move away from Tokyo to get married. What was the level of engagement of women in policy making such as this?

    Another Committee Expert asked about efforts to ensure that family law included a gender perspective.

    Responses by the Delegation

    The delegation said the Japanese Government had set targets regarding the percentage of per- and polyfluoroalkyl substances in drinking water.  There had been no reports of health issues related to levels of these substances, but monitoring of water resources would continue to ensure the safety of the public.

    The Government would continue to support the capacity building efforts of family courts.  It was providing information about women’s ability to use maiden names to apply for certain State services.

    Concluding Remarks

    KEIKO OKADA, Director-General, Gender Equality Bureau, Cabinet Office of Japan and head of the delegation, said the delegation had engaged sincerely in the dialogue.  It hoped that the responses it had provided would be useful for the Committee.

    ANA PELÁEZ NARVÁEZ, Committee Chair, said that the dialogue had provided further insight into the situation of women in Japan.  The Committee encouraged the State party to undertake further efforts to implement the Convention more comprehensively for the benefit of all women and girls in the State.

  • MIL-Evening Report: 4,300 tonnes of space junk and rising: another satellite breakup adds to orbital debris woes

    Intelsat

    A large communications satellite has broken up in orbit, affecting users in Europe, Central Africa, the Middle East, Asia and Australia, and adding to the growing swarm of space junk clouding our planet’s neighbourhood.

    The Intelsat 33e satellite provided broadband communication from a point some 35,000km above the Indian Ocean, in a geostationary orbit around the equator.

    Initial reports on October 20 said Intelsat 33e had experienced a sudden power loss. Hours later, US Space Forces-Space confirmed the satellite appears to have broken up into at least 20 pieces.

    So what happened? And is this a sign of things to come as more and more satellites head into orbit?

    A space whodunnit

    There are no confirmed reports about what caused the breakup of Intelsat 33e. However, it is not the first event of its kind.

    In the past we’ve seen deliberate satellite destructions, accidental collisions, and loss of satellites due to increased solar activity.

    What we do know is that Intelsat 33e has a history of issues while in orbit. Designed and manufactured by Boeing, the satellite was launched in August 2016.

    In 2017, the satellite reached its desired orbit three months later than anticipated, due to a reported issue with its primary thruster, which controls its altitude and acceleration.

    More propulsion troubles emerged when the satellite performed something called a station keeping activity, which keeps it at the right altitude. It was burning more fuel than expected, which meant its mission would end around 3.5 years early, in 2027. Intelsat lodged a US$78 million insurance claim as a result of these problems.

    However, at the time of its breakup, the satellite was reportedly not insured.

    Intelsat is investigating what went wrong, but we may never know exactly what caused the satellite to fragment. We do know another Intelsat satellite of the same model, a Boeing-built EpicNG 702 MP, failed in 2019.

    More importantly, we can learn from the aftermath of the breakup: space junk.

    30 blue whales of space junk

    The amount of debris in orbit around Earth is increasing rapidly. The European Space Agency (ESA) estimates there are more than 40,000 pieces larger than 10cm in orbit, and more than 130,000,000 smaller than 1cm.

    The total mass of human-made space objects in Earth orbit is some 13,000 tonnes. That’s about the same mass as 90 adult male blue whales. About one third of this mass is debris (4,300 tonnes), mostly in the form of leftover rocket bodies.

    Tracking and identifying space debris is a challenging task. At higher altitudes, such as Intelsat 33e’s orbit around 35,000km up, we can only see objects above a certain size.

    One of the most concerning things about the loss of Intelsat 33e is that the breakup likely produced debris that is too small for us to see from ground level with current facilities.

    The past few months have seen a string of uncontrolled breakups of decommissioned and abandoned objects in orbit.

    In June, the RESURS-P1 satellite fractured in low Earth orbit (an altitude of around 470km), creating more than 100 trackable pieces of debris. This event also likely created many more pieces of debris too small to be tracked.

    In July, another decommissioned satellite – the Defense Meteorological Satellite Program (DMSP) 5D-2 F8 spacecraft – broke up. In August, the upper stage of a Long March 6A (CZ-6A) rocket fragmented, creating at least 283 pieces of trackable debris, and potentially hundreds of thousands of untrackable fragments.

    It is not yet known whether this most recent event will affect other objects in orbit. This is where continuous monitoring of the sky becomes vital, to understand these complex space debris environments.

    Who is responsible?

    When space debris is created, who is responsible for cleaning it up or monitoring it?

    In principle, the country that launched the object into space has the burden of responsibility where fault can be proved. This was explored in the 1972 Convention of International Liability for Damage Caused by Space Objects.

    In practice, there is often little accountability. The first fine over space debris was issued in 2023 by the US Federal Communications Commission.

    It’s not clear whether a similar fine will be issued in the case of Intelsat 33e.

    Looking ahead

    As the human use of space accelerates, Earth orbit is growing increasingly crowded. To manage the hazards of orbital debris, we will need continuous monitoring and improved tracking technology alongside deliberate efforts to minimise the amount of debris.

    Most satellites are much closer to Earth than Intelsat 33e. Often these low Earth orbit satellites can be safely brought down from orbit (or “de-orbited”) at the end of their missions without creating space debris, especially with a bit of forward planning.

    In September, ESA’s Cluster 2 “Salsa” satellite was de-orbited with a targeted re-entry into Earth’s atmosphere, burning up safely.

    Of course, the bigger the space object, the more debris it can produce. NASA’s Orbital Debris Program Office calculated the International Space Station would produce more than 220 million debris fragments if it broke up in orbit, for example.

    Accordingly, planning for de-orbiting of the station (ISS) at the end of its operational life in 2030 is now well underway, with the contract awarded to SpaceX.

  • MIL-OSI Russia: NSU Enters Top 10 of Digital Economy Universities Rankings

    ANO “Digital Economy” with the support of the Association of Computer and Information Technology Enterprises (APKIT) and the Ministry of Digital Development of the Russian Federation prepared a rating of universities in the digital economy. In total, more than 300 universities were assessed in the rating and 63 areas of training and specialties related to IT were considered. The final results were presented for two groups: universities in Moscow and St. Petersburg and separately for universities located in the regions. NSU entered the top 10 of the second group.

    The universities were assessed based on official statistics on IT personnel training and a survey of 90 respondents conducted by the Digital Economy ANO. Representatives of leading technology companies participated in the survey. The first group of the final ranking of digital economy universities included 24 universities from Moscow and St. Petersburg. Bauman Moscow State Technical University took first place. The leaders also included HSE, MIPT, Lomonosov Moscow State University, ITMO University, MEPhI, St. Petersburg State University, MIREA and other universities. The second group, which included universities located in the regions, included 30 leaders, including UrFU, NSTU, NSU, TPU, KFU and other universities.

    — NSU’s entry into the top 10 of the ranking is a significant result, since this ranking evaluates absolute, not relative indicators. The ranking mainly includes federal universities, which are several times larger than NSU in terms of the number of students. At our university, the IT direction is one of the key ones: for example, if you look at the distribution of budget places based on the results of the 2024 admission campaign, more than 20% are in IT. NSU has a specialized Faculty of Information Technology, while IT is represented in almost all faculties and in all institutes. The Mechanics and Mathematics Faculty has a system programming direction, the Physics Faculty has physical informatics, and the Humanities Institute has fundamental and applied linguistics, — commented NSU Rector, Academician of the Russian Academy of Sciences Mikhail Fedoruk.

    NSU is implementing a number of projects in cooperation with IT companies. For example, the university has joint educational and scientific laboratories with SHIFT and Sber, master’s programs, etc. NSU is also one of the leading scientific and educational centers in the field of artificial intelligence. For more than a year, the AI Center has been operating at the university, with Sber and Rostelecom as key industrial partners.

    ANCHORAGE, ALASKA—U.S. Senator Dan Sullivan (R-Alaska), addressing the Alaska Federation of Natives (AFN) annual convention today, spoke about the progress that has been made to advance the interests of Alaska Native people at the federal level in the past year, and highlighted work he is doing with Alaska Native communities to address challenges facing rural Alaska, like the devastating crash of salmon runs in parts of the state, limited access to affordable housing, the youth mental health crisis, and the disturbingly high rates of drug overdose deaths driven by fentanyl.

    Senator Sullivan discussed his work with the Alaska Eskimo Whaling Commission (AEWC) to secure the renewal of Alaska whaling captains’ quota at the recent International Whaling Commission (IWC) meeting in Peru; a new Alaska Salmon Research Task Force report created by his 2022 legislation; his team’s relentless efforts that led to a comprehensive ban on Russian seafood imports; and his efforts to address the Department of the Interior’s dismal implementation of his 2019 legislation to deliver Alaska Native Vietnam-era veterans the land allotments they are due.
    Finally, Sen. Sullivan also emphasized the legacy of patriotism of Alaska Native people and the critical ongoing military build-up taking place across Alaska.
    Below is a full transcript of Sen. Sullivan’s remarks.
    It’s an honor for me to be here today. AFN is certainly one of the highlights of the year for me, and for my wife, Julie, who is here in the audience today. I always look to her for my strength. She’s having a great time with her cousins and buying Christmas gifts for our family and friends.
    By the way, we are always amazed by the incredible crafts and artwork on display throughout the convention hall. To all of our skilled artisans, I want you to know I’ve just introduced two new pieces of legislation that I worked with many of you on to protect your rights as Alaska Native artists—and the next generation—to continue the centuries-old practice of using natural materials, like walrus ivory and bird feathers, in your artwork.
    That should be a no-brainer and we’re going to try and get a law passed to make sure that happens.
    I want to thank AFN leadership: Ana, Joe, and a big congratulations to Ben Mallott. We are excited about Ben’s strong leadership and his great experience with AFN. Ben, we are 100% behind you and think you’re going to do a great job here.
    And, of course, I know Julie Kitka has gotten a lot of accolades, and she deserves every single one of them. On the Senate floor back in D.C., I regularly give a speech about a special Alaskan, who we call the “Alaskan of the Week.” I try to get this every week. By the way—[there are] a lot of folks from our Alaska Native community who have been our “Alaskan of the Week.”
    So recently I gave a speech about Julie as our “Alaskan of the Week,” about her great service, and in that speech, I usually love to brag about that person, that Alaskan. But Julie Kitka, always humble, stressed that the great successes of AFN throughout her tenure were accomplished because of partnerships with all of you. She actually said when we were writing the speech, “Nothing I did was ever done alone.”
    Partnership is such a great leadership model. So, Julie Kitka, one more time—thank you for your great leadership. You’ve done such a great job.
    Alaska Travels
    As I always do, my Julie and I spent this past summer traveling to many rural Alaska communities including Saint Paul, Kotzebue, we were up on the Yukon, we were in the Ahtna region, to Nuiqsut and Utqia?vik. As always, we learned so much in our roundtable discussions, especially from our elders.
    We saw beautiful dancing. I tried to dance a little bit myself. That’s always embarrassing. We ate delicious food, met new friends and reconnected with old ones. So, again, to everybody that we were with—and it was with a lot of folks that summer—thank you for the warm, wonderful hospitality that we experienced literally everywhere we went. It is such a blessing of our Native communities.
    And as part of these travels, we were honored to attend Nalukataq in Utqia?vik.
    It’s magic when the whole community comes out to celebrate a cultural practice—subsistence whaling in this case—that Inupiat whalers have sustainably conducted for thousands of years.
    International Whaling Commission Meeting
    And this year, like six years ago, these same whaling captains were able to successfully renew—through very hard work—their quota at the International Whaling Commission (IWC) meeting in Peru.
    That is a big deal and deserves a round of applause. A really big deal. This has been a top priority of mine as your senator. As we know, success is never guaranteed at these International Whaling Commission meetings. The IWC has not always been a friend of our Alaska whaling captains. So before the big IWC meeting that was in Brazil in 2018 and in Peru this year, we all came together and put together a strategy with our whaling captains.
    We met with the U.S. State Department and NOAA to ensure the United States, as a country, had a coordinated strategy to make sure our Alaska Native whaling captains were able to get their IWC quota. That was part of the strategy. Both in 2018 and this past year in 2024, I hosted a reception in the U.S. Capitol. Here’s some photos from that.
    The goal of this reception was to invite the ambassadors, particularly from the countries that have not been friends of Alaska Native whaling, because we need their votes at this international convention. So if you see here at this convention, at one point, both in 2018 and in 2024, I looked across the reception area and literally every whaling captain had a Latin American ambassador with their arm around him.
    This is great lobbying on behalf of the IWC. And it worked! It worked because in Peru, just last month, our Alaska Whaling Eskimo Commission leaders were able to secure the first automatic quota renewal in IWC history. That is a giant triumph for Alaska Natives.
    In that regard, I want to do a big shout-out to AEWC Chair John Hopson Jr., the dynamic father-son duo of Crawford Patkotak, vice chair of the AEWC, and Josiah Patkotak, his son, the mayor of the North Slope Borough, and so many others. They all made it happen again. The children of the North Slope will look back at what the Alaska Eskimo Whaling Commission has achieved in the last 6 years and they will be grateful for decades to come.
    Salmon
    These whaling quotas are the kind of successes we can achieve when we unite behind a common mission.
    It’s more challenging, but this is also the approach I’m taking—working with so many of you—to address our salmon crisis.
    As you all know, we’ve had another banner year in terms of the strength certain salmon runs, like the Bristol Bay sockeye salmon run. But in the Yukon and Kuskokwim and other Interior rivers throughout our state, the runs have once again crashed. Representative Peltola talked very passionately about this yesterday, and our congressional delegation has always worked together to focus on these very important issues.
    I mentioned this to all of you before, but I’ll do it again. Over three decades ago, I was introduced to what salmon means to Native culture and people through my amazing wife Julie and her family’s fish camp near Hess Creek on the Yukon River. As a family, we have so many amazing memories and experiences at Julie’s family’s fish camp, particularly with our three daughters.
    And I know so many people have the same memories, learning how to head and gut and strip and smoke salmon on the banks of the Yukon, learning about their culture, about sharing, about family, about working together, about their heritage. When the Kings are running on the Yukon, it’s the most spiritual place in the world. When the fish aren’t running, and when the smoke houses are empty, it feels like something is very wrong with the universe.
    We experienced that feeling at Julie’s family’s fish camp this summer. We’re all worried—desperately worried—that a whole generation of children will miss out on this vital experience. It is soul wrenching.
    So here’s what I’m working on with all of you and, of course, with our congressional delegation.
    Alaskans can agree—we need to identify and address research prioritization gaps with comprehensive data and the best scientific minds, including Indigenous communities, to figure out the causes of these devastating salmon declines.
    That’s what my bill—the Alaska Salmon Research Task Force Act—does. This bill was passed into law. And here’s what it does. It brings the best minds in the world—state, federal, university, Indigenous, tribal—to figure out what is happening. It includes a specific working group focused on the Yukon and Kuskokwim.
    By the way, it probably doesn’t surprise you, but this bill was my wife Julie’s idea. And the Task Force report was just recently completed. This was required by the law. It’s at my booth and if you want a copy, we would love for you guys to take a look at my booth here at AFN. I want to thank so many in our Alaska Native community who took part in this Task Force and the research and the hard work of this report.
    This is what the Task Force recommends as we move forward. They call it “Gravel to Gravel,” “G to G,” which is a strategic approach that coordinates research where individual projects, regardless of whether they are led by state and federal, university, tribal or NGOs, will share information with other projects on what is happening to our salmon.
    With this critically important report now completed, my team and I will be working with all of you to build a comprehensive, well-funded salmon research program at the federal level on the goal that we all share: Achieving greater abundance and stability in our salmon stocks all across Alaska.
    Now, this won’t happen overnight, but you have my commitment that we will continue to work our hearts out on getting our salmon back in our rivers for our children, and our children’s children.
    We have to get to the bottom of this and address it. I certainly am committed to working with all of you on this.
    Another thing I know we can unite on in terms of a goal with regard to fisheries—which we’re able to achieve recently—is making sure that Russia can no longer flood America’s domestic markets with their cheap, unsustainable fish.
    After a long battle with the Biden administration, I was able to finally get them to ban Russian fish from coming into our country. When the Russians tried to circumvent this ban by sending their fish through Communist China, we shut down that loophole too. This will help all of our coastal communities, many of which are Native communities, and our Alaska fishermen.
    The Russian oligarchs say they’re in a war with Alaska’s fishermen. Well, we’re finally fighting back.
    This includes banning unsafe and often illegal Russian and Chinese trawlers who are likely contributing to depleting our own salmon runs here at home. I’m now pressing leaders from around the world—from Japan, to Canada, to Europe—to ban these fish.
    The world should want Freedom Fish from Alaska, not Communist Fish from China or Russia!
    Report on Children
    Now I want to turn to an incredibly important theme this year: Our Children, Our Future Ancestors. I really want to thank the commissioners, like Gloria O’Neil and Don Gray, and all of those who worked on “The Way Forward: Report of the Alyce Spotted Bear & Walter Soboleff Commission on Native Children.”
    To Gloria’s point during that last session, we certainly want to follow up with the work Gloria and others did in that important report. We don’t want to let that report go onto a shelf and collect dust. That report was spearheaded by legislation that Senator Murkowski wrote, that I co-sponsored. And, as Gloria and Don said, we know that the statistics are not great. As a matter of fact, they’re horrible.
    Too many Alaska Native children are experiencing poverty and abuse. Too many are in the juvenile justice system. Too many are experiencing mental health challenges.
    There have been many reports throughout the decades on the well-being of Alaska Native people. Gloria mentioned that in her comments just a few minutes ago. 30 years ago, if you look at this report my mother-in-law, Mary Jane Fate, worked on—the 1994 report that was also mandated by federal legislation. When she testified before Congress, she stated:
    “Today we find ourselves in a crisis situation. The outrageous school dropouts, high unemployment, hopelessness, and other tragic and sad endings such as the highest rates of suicides and accidents amongst our youth.”
    That was 30 years ago. The situation then was dire and still is if you look at the report that Gloria and Don just authored. But here’s the thing. We cannot lose hope. This is our youth, and we must recognize that there has been progress in the last 30 years since that last report, particularly significant improvement in education, in life expectancy, and in rates of poverty.
    So we must do more working together, and again, I want to thank Gloria and Don for their leadership.
    Mental Health
    One of the key issues in their report is resiliency. We need that, among all Alaskan kids, among all American kids. In that regard, mental health is key.
    As outlined in “The Way Forward” report, 31 percent of Alaska Natives told researchers: “My mental health is poor most of the time or always.” 21 percent of youth in the report said they had been bullied on social media or through texts.
    I know social media can be a great positive for many, particularly for those who live in Rural Alaska. But as we’re building out our historic broadband infrastructure in Rural Alaska, we need to understand that there is a very strong correlation between declining mental health and increasing social media use for all young Alaskans and for all young Americans.
    I have been very focused on this issue and can report important progress back in D.C. A few months ago, the Kids Online Safety and Privacy Act—of which I am an original cosponsor—passed the Senate with over 91 votes. “KOSA,” as we call it, gives parents significantly more control over what their kids are allowed to see online and limits harmful and addictive content that kids are bombarded with online.
    This is a good start, but we must do more to protect our children. We can have the strongest economy in the world, the best quality of life in the world, but none of that means anything if so many of our kids are depressed or considering ending their lives because of what they’re consuming online. We have to get started on this important issue.
    One Pill Can Kill
    Another issue that I’m very focused on that relates to our youth—this is a huge one—is the deadly fentanyl crisis that’s hit our state very hard, especially among our youth.
    The new numbers for 2023 just recently came out. Take a look at these slides. These numbers are shocking! The number one cause of overdose deaths in Alaska—particularly among our young people—are fentanyl overdoses, up roughly 45% from just last year. By the way, in other areas across the country these numbers are dropping dramatically. But in our state, they are continuing to surge. To surge!
    Alaska Natives account for 33% of drug overdose deaths from fentanyl last year. Our kids need to be educated about this lethal drug. That’s why my team and I, working with schools and organizations across the state, have launched the “One Pill Can Kill” campaign.
    What is it? It’s educating our youth that even a tiny, tiny bit—look at how small that is on a pencil tip—a tiny bit of fentanyl can be lethal. They need to know the drugs they buy on the streets or from friends, including marijuana, can be laced with fentanyl and can kill you. They need to know that one pill can kill.
    I would very much like to partner with AFN and other Native organizations across Alaska on this campaign. You can find information about it on my website and at my booth downstairs. But here’s the bottom line: If we can save even one young Alaskan’s life with this campaign, then it will be worth it.
    Housing
    Now, as you all know, raising healthy families with healthy children requires safe, affordable housing. Let’s face it, in pretty much every part of Alaska, especially Rural Alaska, we don’t have that.
    Last August, I hosted the Secretary of Housing and Urban Development in Alaska. A number of you were there at our roundtable that was focused on the outrageously high cost of housing in rural Alaska.
    The Secretary of HUD, she runs a big bureaucracy back in D.C. Unfortunately, we are still waiting for HUD’s recommendations on how to reduce the federal red tape that is a part of the problem of the high cost of housing in Rural Alaska. But here’s the deal. We shouldn’t have to wait. We can do so much of this ourselves.
    I’ve seen incredible innovation in housing during all of my travels throughout Rural Alaska. Last summer, Julie and I saw how Native leaders in Huslia and Hughes were building affordable, beautiful housing—just like in this photo—at much more competitive costs.
    These great leaders in our state weren’t waiting for the D.C. bureaucrats to give them permission to build. I’ll never forget in 2018, when I was in Holy Cross, talking about housing with World War II veteran Luke Demientieff and his son Leonard, a Vietnam veteran. Both are master carpenters. Leonard shared with me some wise words from an elder who had been looking out at the vast expanse of an Alaskan forest. This elder said, “There’s a house in the woods. You just have to go get it. You have to build it.”
    In other words, this community wasn’t waiting for the federal government to act. They got a sawmill and they started building. That is the kind of can-do spirit we need as Alaskans to address this housing shortage.
    Alaska Native Vietnam Veterans Allotments
    I think a number of you know that in my AFN remarks, I like to always talk about—and I certainly don’t have to remind all of you—about Alaska Native Veterans incredible patriotic history of military service to our country. Already this morning, I’ve seen several Alaska Native veterans. If you’re a veteran or a family member of a veteran, could you please stand or raise your hand to be recognized by this audience?
    You all know this, but it bears repeating: Generation after generation, Alaska Native people have served our country in the military at higher rates than any other ethnic group in America. That is what I call special patriotism, particularly when they were still facing shameful discrimination back home.
    Alaska Vietnam veterans really got hit hard. They were serving their country when, let’s face it, a lot of Americans were avoiding service. They came home, and because they were Vietnam Vets, many were treated disgracefully.
    This happened to my good friend Bill Thomas who said one day he was fishing in Haines, the next day he was in bootcamp at Fort Lewis, and then sent to the jungles of Vietnam.
    Nearly two years later, after his combat tour, Bill was flown to California, dazed, the smell of jungle still on his skin, fear still in his gut. On the way to being discharged, he had to drive past a group of protestors, yelling despicable things at him.
    On top of that, Bill, like so many other Alaska Native Vietnam veterans missed the deadline to apply for their Native allotment—the one that they were legally entitled to but missed because they were serving their country in a war overseas. His story was not unique.
    So working with many of you here—I see Benno Cleveland and others—I was able to pass my Vietnam Veterans Allotment Act in 2019 that righted this injustice. That is now the law. It gave our Alaska Native Vietnam veterans the ability to apply for a Native allotment.
    Unfortunately, the implementation of this bill has been dismal, despite Secretary Haaland’s commitment to me on making this a priority of hers.
    In the past four years, the Department of Interior has only certified 38 Alaska Native Vietnam-era [Veteran] allotments out of the over 2,000 Alaska Native Vietnam veterans who were eligible for this. That’s a disgrace and time is running out.
    That’s why I’ve introduced a new bill to extend the Alaska Native Vietnam Veterans Allotment Program for five more years, and importantly, to expand the lands available, particularly in Southeast, where we have such a high number of Vietnam veterans and where it’s been very challenging for our Vietnam veterans to get land close to their home.
    Here’s the challenge on my bill, and I’m going to need AFN’s help on this one: Every radical Lower 48 environmental group is going to come out and try to kill my bill. They don’t want Alaska Natives to have their own land and they certainly don’t want to honor our Vietnam veterans’ heroic service. We all need to fight back against them. Our cause is just. Our cause is so very just on this bill.
    I’m hoping that AFN and others—I’ve asked the Alaska Native Brotherhood, the Alaska Native Sisterhood—we can all work together and support my bill and continue to bring justice to our Alaska Native Vietnam veterans.
    Vietnam Veterans Resolution
    Finally, as it relates to our Vietnam veterans, like Bill Thomas and Benno and so many others, I was recently able to pass a Senate resolution—which, by the way, passed in the Senate unanimously—commending our Vietnam veterans for their courage and sacrifice. The resolution urges the President, on behalf of the Congress, to formally acknowledge the widespread mistreatment of our Vietnam veterans when they came back home.
    It offers a long overdue apology, and it calls for increased education in our schools, for our children, to learn about and understand and respect the courage and sacrifice of these heroes during the Vietnam War.
    Kake and Angoon
    There is another apology that I want to mention. This one also relates to our military. I think many know that I deeply respect our military. Last February, I retired from the Marines Corps after 30 years of service.
    But that doesn’t mean our military is perfect. No organization is perfect.
    I believe that in instances where our country has fallen short of our ideals and has harmed our own citizens, then an apology can be the right thing to do and it’s an important gesture for reconciliation.
    The egregious and unwarranted U.S. military assaults on the Alaska Native people of Kake and Angoon in the late 1800s is such a case.
    When Dr. Rosita Worl brought these historic wrongs to my attention, and mentioned the Tlingit people’s decades-long pursuit of recognition and an apology, I told my team in the Senate that we would work tirelessly with Alaska Native leaders to press this issue at the highest levels of the United States Navy and the Pentagon until these communities received an appropriate apology. That’s what we were able to do.
    Last month, some of you may have seen it, hopefully some of you were there, the U.S. Navy held a ceremony to present the apology in Kake—an official ceremony. There will be another ceremony in Angoon in a few days. Julie and I will be looking forward to attending.
    I am hopeful that these recognition ceremonies will help provide healing and importantly, show our youth that our country is so strong that it can admit its mistakes to become even stronger.
    Arctic and National Security
    Finally, let me turn to an issue that I have heard about from so many of you in your communities and where I want to compliment our brave Alaska-based military.
    We all know it’s becoming an increasingly dangerous world. We are in a new era of authoritarian aggression with dictators in Beijing, Moscow, Iran and North Korea on the march and working together. As Alaskans, we are on the front lines of this new Cold War. We’ve seen this with dramatically increased joint Chinese and Russian patrols in the air and on the seas, near our shores and our skies. You’ve seen these photos—Chinese bombers, Russian subs, Russian fighters near our aircraft. Very aggressive. Our military here has done a great job of protecting our country, just like Alaska Natives have done over the decades.
    Throughout history, our Alaska Native people have courageously served and defended our country. Think about it: the Alaska Territorial Guard, the Eskimo Scouts, the Tlingit code talkers. And of course, as I mentioned earlier, the super high number of Alaska Natives who serve their country in uniform. I’m absolutely confident that with this strong legacy of patriotism and service and a continued build-up of our own military here in Alaska, which I am very focused on, we as a country and as a state will once again prevail over these authoritarian dictatorships.
    Internships
    So let me end with one final plea. It’s related back to the theme of our youth and the theme of this conference. It’s just a pitch from my office. We have a very robust internship program. Representative Peltola yesterday mentioned one young Alaska Native leader, Sam Hiratsuka, who started in my office as an intern. He rose in my office, then went to Mary’s office, and just two days ago, was the youth speaker at the AFN Elders and Youth Conference. Sam is doing a great job and is showing the next generation of leaders how to lead.
    So here’s my pitch: We need more interns, Alaska Native interns. I have information at my booth, and I urge all of you to spread the word.
    We need our Alaska Native people working on Native issues in all branches of our federal government. It’s a great experience for them. They are the future, and we want to encourage that kind of service. With that, to the leadership of AFN, to Julie, and others, thank you again. My Julie and I are very honored to be here.

  • MIL-Evening Report: Labor retains office at ACT election; US presidential election remains on a knife’s edge

    The Labor Party has won a seventh consecutive ACT election.

    The ACT uses the Hare Clark proportional representation method with five five-member electorates, for a total of 25 seats. A quota is one-sixth of the vote or 16.7%.

    For Saturday’s election, the ABC is calling
    ten Labor seats, eight Liberals, two Greens, one Independent for Canberra (IfC) and one other independent, with three still undecided.

    Labor has won a seventh consecutive term, having governed in the ACT since 2001, often in coalition with the Greens. At the 2022 federal election, the ACT gave Labor a 67–33 two-party win, easily the most pro-Labor jurisdiction. This strong left lean makes it difficult for the Liberals to win ACT elections.

    Vote shares were 34.5% Labor (down 3.3% since the 2020 election), 33.0% Liberals (down 0.9%), 12.5% Greens (down 1.0%), 8.5% Independents for Canberra (new) and 11.5% for all Others (down 3.3%). Postal votes have not yet been counted, and these should help the Liberals.

    Nearly all pre-poll votes and some election day votes were cast electronically. Provisional preference distributions for these votes were published on election night, with paper ballots to be added to these electronic votes in the coming days.

    Analysis of each of the five electorates follows. The final seat result will probably be ten Labor (steady since 2020), ten Liberals (up one), three Greens (down three), one IfC (new) and one other independent (up one). If this occurs, Labor and the Greens will retain their combined majority with 13 of the 25 seats.

    In Brindabella, the Liberals won 2.57 quotas, Labor 2.05, the Greens 0.55 and IfC 0.45. Analyst Kevin Bonham says the Liberals are likely to win the last seat after postals are counted.

    In Ginninderra, Labor has 2.26 quotas, the Liberals 1.52, the Greens 0.89 and IfC 0.45. Bonham says the Greens and Liberals easily win the final two seats on the provisional distribution.

    In Kurrajong, Labor has 2.20 quotas, the Liberals 1.41, the Greens 1.07 and IfC 0.83. IfC easily wins the last seat on the provisional distribution.

    In Murrumbidgee, the Liberals have 2.06 quotas, Labor 2.02, independent Fiona Carrick 0.78 and the Greens 0.57. Carrick easily wins the last seat.

    In Yerrabi, the Liberals have 2.19 quotas, Labor 1.86, the Greens 0.71 and IfC 0.58. The Greens easily defeat IfC on the provisional distribution.

    Harris dips in polls, but US presidential contest remains tight

    The United States presidential election will be held on November 5. In analyst Nate Silver’s aggregate of national polls, Democrat Kamala Harris leads Republican Donald Trump by 49.1–46.8, a gain for Trump since last Monday, when Harris led by 49.3–46.5. Harris’ national lead peaked on October 2, when she led by 49.4–45.9.

    Joe Biden’s final position before his withdrawal as Democratic candidate on July 21 was a national poll deficit against Trump of 45.2–41.2.

    The US president isn’t elected by the national popular vote, but by the Electoral College, in which each state receives electoral votes equal to its federal House seats (population based) and senators (always two). Almost all states award their electoral votes as winner-takes-all, and it takes 270 electoral votes to win (out of 538 total).

    Relative to the national popular vote, the Electoral College is biased to Trump, with Harris needing at least a two-point popular vote win to be the narrow Electoral College favourite in Silver’s model.

    In Silver’s state poll aggregates, Harris leads by just 0.4 points in Pennsylvania (19 electoral votes) and Wisconsin (ten). She leads by about one point in Michigan (15 electoral votes) and Nevada (six). Trump leads by 0.8 points in North Carolina (16 electoral votes), 1.4 points in Georgia (16) and 1.8 points in Arizona (11).

    If Harris holds her current leads in Pennsylvania, Wisconsin, Michigan and Nevada, she likely wins the Electoral College by at least 276–262. But Harris’ margins in these states are now very narrow.

    While Silver’s model is still effectively a 50–50 toss-up, Trump is now the slight favourite with a 51% chance to win the Electoral College, up from 48% last Monday. Harris’ Electoral College win probability had peaked at 58% on September 27. There’s a 26% chance that Harris wins the popular vote but loses the Electoral College.

    While Trump was the favourite in Silver’s model between late August and mid-September, this is his first lead in FiveThirtyEight since early August.

    Silver said on Friday that current economic conditions imply Harris should win the national popular vote by about one point, so the contest is trending towards this outcome. But Trump would be likely to win the Electoral College with just a one-point Harris advantage in the popular vote.

    Liberals lose Pittwater to teal at NSW state byelections

    Byelections occurred Saturday in the New South Wales state Liberal-held seats of Epping, Hornsby and Pittwater. Labor did not contest any of these byelections. In Pittwater, The Poll Bludger’s projections give teal independent Jacqui Scruby a 54.1–45.9 lead over the Liberals, a 4.8% swing to Scruby since the 2023 state election.

    Current primary votes are 53.7% Scruby (up 17.3%), 42.4% Liberals (down 2.6%) and 3.9% for a Libertarian. The Greens had won 6.8% in 2023, but did not contest, presumably to stop left-wing votes exhausting under NSW’s optional preferential system.

    The other two byelections were easy Liberal holds, with the Liberals beating the Greens by 61.6–38.4 in Hornsby (58.0–42.0 against Labor in 2023). The Liberals won Epping by 65.8–34.2 against the Greens (54.8–45.2 against Labor in 2023).

    Federal Morgan poll and NT redistribution

    A national Morgan poll, conducted October 7–13 from a sample of 1,697, had a 50–50 tie, unchanged from the September 30 to October 6 Morgan poll.

    Primary votes were 37.5% Coalition (steady), 30% Labor (down 1.5), 14% Greens (up 1.5), 6% One Nation (up 0.5), 9% independents (steady) and 3.5% others (down 0.5).

    The headline figure uses respondent preferences. By 2022 election preference flows, Labor led by 51–49, a one-point gain for the Coalition.

    The Northern Territory has two federal electorates: Lingiari and Solomon. It had been seven years since the last NT redistribution, so a new redistribution was required, and this was released Friday.

    ABC election analyst Antony Green said Labor’s margin in Lingiari was increased from 0.9% to 1.7%, but decreased in Solomon from 9.4% to 8.4%. This is a draft redistribution, but there are not expected to be any changes before finalisation.

  • MIL-OSI Global: Jessica Campbell’s NHL coaching gig marks a pivotal turning point for professional hockey

    Jessica Campbell has made history as the first full-time female coach in the National Hockey League, marking a significant milestone in professional hockey.

    Campbell was hired by the Seattle Kraken in July, and during the team’s home opener against the St. Louis Blues on Oct. 8, the crowd erupted into cheers when she was introduced as part of the team’s coaching staff.

    While the Kraken went on to lose to the Blues 3-2, the game was a pivotal turning point for gender equality and coaching in the NHL. Campbell’s appointment as a full-time assistant coach shows there’s a path forward for women who aim to coach at the men’s professional level.

    Campbell’s story serves as a reminder of the challenges women coaches face. However, it also demonstrates how achieving a coaching role in a professional league, though difficult, is not impossible.

    ‘I didn’t know it was possible’

    Campbell brings a wealth of knowledge to her new role with the Kraken, from her playing experiences in the NCAA, the Canadian Women’s Hockey League and on Canada’s women’s national team.

    Her coaching career began as an assistant with the U18 Canadian women’s national team, and from there she coached in Sweden with the Malmö Redhawks. She then served as an assistant coach for the men’s national team in Germany and the Nürnberg Ice Tigers. Campbell later became the first female coach in the American Hockey League when she was hired by the Coachella Valley Firebirds as an assistant coach.

    Even with her breadth of experience, Campbell never envisioned herself as an NHL coach. Instead, she was focused on supporting players through her business, JC Power Skating School.

    “I didn’t imagine this path for me. I didn’t see it,” Campbell said in a 2023 interview. “Quite frankly there was no visibility and there weren’t other females doing this work, and so I didn’t know it was possible.”

    It was not until more and more NHL players sought out her skating and skill development program that she began to consider coaching in the NHL as a potential career path.

    Women coaches in the major leagues

    The NHL has been slow on the uptake when it comes to full-time women coaches. The other three major leagues — the National Football League, Major League Baseball and the National Basketball Association — have had women in coaching roles for years.

    At the start of the 2024 season, there were 15 full-time women coaches in the NFL. In 2023, the MLB had 43 women coaching. Within the NBA, there are currently five female assistant coaches.

    Yet, these numbers still reflect an alarming gender disparity. Like Campbell, many women may struggle to envision themselves in coaching positions. This moment encourages us to consider both the importance of women in coaching, and why there continues to be an under-representation of women coaching men’s sports.

    Research on women in coaching has continuously highlighted barriers in high performance sport. Women coaches often face stereotypes, discrimination and gendered organizational cultures that hinder their advancement in the field.

    To combat these barriers, the NHL has implemented various supports to ensure Campbell will not remain in a league of her own.

    The NHL Coaches Association launched a Female Coaches Development Program in 2021 to support the development of women coaching hockey. By providing leadership strategies, skill development, networking and career opportunities, the program aims to normalize women coaching men and expand the pool of available candidates.

    Paving the way

    While Campbell is the first full-time assistant coach in the NHL, others have had opportunities to guest coach at NHL camps or to be on the bench for pre-season games.

    For instance, Kim Weiss, the first woman to coach NCAA Division III men’s hockey, served as a guest coach for the Colorado Avalanche.

    Similarly, Kori Cheverie, the first woman to coach a Canadian university men’s hockey team, was a guest coach with the Pittsburgh Penguins and became the first female coach on the bench during an NHL pre-season game.

    Along with Campbell, the visibility that each of these women provides can spark meaningful change in the NHL. While Campbell’s coaching debut with the Kraken is breaking down barriers, sustained effort and dedication is required to create a more inclusive sport culture.

    Continued emphasis on initiatives like the NHL’s Female Coaches Development program are necessary for both current and aspiring women coaches so girls and women can envision themselves in leadership roles in the future.

    As a scholar who has studied the under-representation of women coaches, my hope is that Campbell will not remain an anomaly in the NHL, and eventually we see more women in both assistant and head coaching roles.

    Campbell’s new position with the Kraken could spur this change, with her and others enriching the NHL through the abilities, contributions and diverse perspectives that women bring to coaching.

    Scotland’s first Trade Envoy to Japan has been appointed to secure international investment.  

    Stephen Baker will identify new opportunities in Japan’s thriving energy transition, pharmaceuticals, med-tech and food sectors.

    Making this announcement ahead of a trade mission to Singapore and Malaysia, Business Minister Richard Lochhead said:

    “Increasing trade and attracting inward investment are vital components of a thriving, growing economy and the Scottish Government’s clear message is that Scotland is open for business.

    “Scottish businesses already have a strong track record when it comes to exports to the Asian market and attracting inward investment, given Scotland’s position as the UK’s most attractive place for inward investment outside London.

    “This appointment will help Scotland to increase business opportunities with similar Japanese companies and organisations, like Sumitomo’s £350 million investment in a manufacturing plant in Nigg.”

    The Scottish Government’s Trade and Investment Envoy for Japan Stephen Baker said:

    “Japan and the UK share a strong and vibrant partnership, with Scotland taking a leading role in the energy transition. Given Japan’s substantial economy, there are significant opportunities for trade and investment. Now is the perfect time to include Japan in your business strategy and I look forward to maximising the benefits of this global partnership for Scotland.”

    The unpaid Japan Envoy role will last for an initial two-year term.

    Mr Baker spent 21 years with Sony, before joining Scottish Development International in 2006, initially covering both trade and investment as Japan Country Head, and later as Regional Director for Information and communications technology, Creative Industry, Financial Services, and Global Business Services. Stephen also served as the Asia Pacific Regional Director for Inward Investment into Scotland.

  • MIL-Evening Report: Australia’s fertility rate has reached a record low. What might that mean for the economy?

    Australia’s fertility rate has fallen to a new record low of 1.5 babies per woman. That’s well below the “replacement rate” of 2.1 needed to sustain a country’s population.

    On face value, it might not seem like a big deal. But we can’t afford to ignore this issue. The health of an economy is deeply intertwined with the size and structure of its population.

    Australians simply aren’t having as many babies as they used to, raising some serious questions about how we can maintain our country’s workforce, sustain economic growth and fund important services.

    So what’s going on with fertility rates here and around the world, and what might it mean for the future of our economy? What can we do about it?

    Are lower birth rates always a problem?

    Falling fertility rates can actually have some short-term benefits. Having fewer dependent young people in an economy can increase workforce participation, as well as boost savings and wealth.

    Smaller populations can also benefit from increased investment per person in education and health.

    But the picture gets more complex in the long term, and less rosy. An ageing population can strain pensions, health care and social services. This can hinder economic growth, unless it’s offset by increased productivity.

    Other scholars have warned that a falling population could stifle innovation, with fewer young people meaning fewer breakthrough ideas.

    A global phenomenon

    The trend towards women having fewer children is not unique to Australia. The global fertility rate has dropped over the past couple of decades, from 2.7 babies per woman in 2000 to 2.4 in 2023.

    However, the distribution is not evenly spread. In 2021, 29% of the world’s babies were born in sub-Saharan Africa. This is projected to rise to 54% by 2100.

    There’s also a regional-urban divide. Childbearing is often delayed in urban areas and late fertility is more common in cities.

    In Australia, we see higher fertility rates in inner and outer regional areas than in metro areas. This could be because of more affordable housing and a better work-life balance.

    But it raises questions about whether people are moving out of cities to start families, or if something intrinsic about living in the regions promotes higher birth rates.

    Fewer workers, more pressure on services

    Changes to the makeup of a population can be just as important as changes to its size. With fewer babies being born and increased life expectancy, the proportion of older Australians who have left the workforce will keep rising.

    One way of tracking this is with a metric called the old-age dependency ratio – the number of people aged 65 and over per 100 working-age individuals.

    In Australia, this ratio is currently about 27%. But according to the latest Intergenerational Report, it’s expected to rise to 38% by 2063.

    An ageing population means greater demand for medical services and aged care. As the working-age population shrinks, the tax base that funds these services will also decline.

    Unless this is offset by technological advances or policy innovations, it can mean higher taxes, longer working lives, or the government providing fewer public services in general.

    What about housing?

    It’s tempting to think a falling birth rate might be good news for Australia’s stubborn housing crisis.

    The issues are linked – rising real estate prices have made it difficult for many young people to afford homes, with a significant number of people in their 20s still living with their parents.

    This can mean delaying starting a family and reducing the number of children they have.

    At the same time, if fertility rates stay low, demand for large family homes may decrease, impacting one of Australia’s most significant economic sectors and sources of household wealth.

    Can governments turn the tide?

    Governments worldwide, including Australia, have long experimented with policies that encourage families to have more children. Examples include paid parental leave, childcare subsidies and financial incentives, such as Australia’s “baby bonus”.

    Many of these efforts have had only limited success. One reason is the rising average age at which women have their first child. In many developed countries, including Australia, the average age for first-time mothers has surpassed 30.

    As women delay childbirth, they become less likely to have multiple children, further contributing to declining birth rates. Encouraging women to start a family earlier could be one policy lever, but it must be balanced with women’s growing workforce participation and career goals.

    Research has previously highlighted the factors influencing fertility decisions, including levels of paternal involvement and workplace flexibility. Countries that offer part-time work or maternity leave without career penalties have seen a stabilisation or slight increases in fertility rates.

    The way forward

    Historically, one of the ways Australia has countered its low birth rate is through immigration. Bringing in a lot of people – especially skilled people of working age – can help offset the effects of a low fertility rate.

    However, relying on immigration alone is not a long-term solution. The global fertility slump means that the pool of young, educated workers from other countries is shrinking, too. This makes it harder for Australia to attract the talent it needs to sustain economic growth.

    Australia’s record-low fertility rate presents both challenges and opportunities. On one hand, the shrinking number of young people will place a strain on public services, innovation and the labour market.

    On the other hand, advances in technology, particularly in artificial intelligence and robotics, may help ease the challenges of an ageing population.

    That’s the optimistic scenario. AI and other tech-driven productivity gains could reduce the need for large workforces. And robotics could assist in aged care, lessening the impact of this demographic shift.
