    Headline: ICC calls for continued dialogue on biodiversity benefit sharing mechanism

    ICC has issued the following statement upon the conclusion of the United Nations’ Conference of the Parties to the Convention on Biological Diversity (CBD COP16) underscoring the commitment of business to support future efforts to secure a robust and workable multilateral benefit sharing mechanism.

    ICC appreciates the efforts of Parties and the Colombian Presidency at CBD COP16 to progress on the operationalisation of the multilateral mechanism on benefit sharing from the use of digital sequence information, including the COP16 Decision’s recognition that further work is needed to refine several of its elements .  

    Businesses are committed to supporting biodiversity goals and engaged constructively in the discussion – viewing the multilateral mechanism as an opportunity to increase benefits shared for biodiversity through a simpler system that provides more legal certainty for companies and supports research and innovation.

    As several countries have recognised, the decision provides a starting basis for moving forward but many important aspects require further evidence-based work to ensure that the mechanism has the necessary enabling conditions and incentives to engage broad business participation. A system that is broad in scope makes it easy to contribute, sets fees at realistic levels, provides legal certainty for research and innovation, and has the potential to incentivise more funding for biodiversity. Business will strengthen its engagement as an integral part of the solution and will need to play a role in further refining the mechanism to ensure its success.”

    Further work could continue along several tracks, through formal CBD workstreams, informal dialogues, or a pilot phase to test the modalities in the decision and obtain evidence for consideration at COP17.  ICC will be working with companies, countries and other stakeholders along all these tracks to optimise the potential of the mechanism to attract broad participation from businesses to further biodiversity goals.

    PRINCETON – First Lady Tammy Murphy on Tuesday hosted an intimate Día de Muertos commemoration at Drumthwacket, marking the first time this holiday has been celebrated at The People’s House. The First Lady was joined by Mariana Díaz Nagore, the Head Consul of the Consulate of Mexico in New Brunswick, and prominent leaders from New Jersey’s Mexican and Latino communities.

    “New Jersey is home to an incredibly strong and vibrant Mexican American community, which is why I wanted to open Drumthwacket – the People’s House – to both celebrate Día de Muertos and acknowledge the rich contributions of our state’s Mexican and Latino residents,” said First Lady Tammy Murphy. “Día de Muertos is a special time to come together with friends and family to reflect, connect with our ancestors, and remember loved ones who have passed. We were honored to mark this beautiful holiday and, when we looked at the altar, Phil and I truly felt the presence of our loved ones.”

    On Día de Muertos, families welcome back the souls of their deceased relatives for a brief reunion that includes food, drink and celebration. The living family members treat the deceased as honored guests in their celebrations and leave the deceased’s favorite foods and other offerings at gravesites or on altars built in their homes.

    As part of the event, Drumthwacket’s Music Room was transformed into an altar honoring the Governor and First Lady’s departed loved ones, including their late parents, siblings, additional family members and friends. 

    The altar was decorated by Lilia Rios and Francisco Del Toro, Co-Founders of La Providencia, and was adorned with photos, candles and bright marigolds called cempasuchil alongside food for the deceased.

    “The altar for the Dia de Muertos at Drumtwacket is a recognition of the Mexican community in New Jersey and a celebration of its rich culture and values. I am grateful to First Lady Tammy Murphy for opening the doors of Drumthwacket for the first time to Mexico’s Day of the Dead traditions and allowing us to share them with the community as a whole with this beautiful altar,” said Mariana Díaz Nagore, the Head Consul of the Consulate of Mexico in New Brunswick.

  • MIL-OSI Global: The racist ‘one-drop rule’ lives on in how Trump talks about Black politicians and whiteness in America

    Americans who heard former President Donald Trump claim that Vice President Kamala Harris previously identified as “not Black” in a July 2024 interview may wonder why he continuously emphasized former President Barack Obama’s blackness during his first presidential campaign.

    As a scholar focused on race and gender issues, I recognize that these seemingly inconsistent definitions of blackness are not inconsistent at all. They demonstrate a consistent position on whiteness.

    In both cases, Trump implies that the race of his opponent is all voters need to know to determine their characters. It is an ideology that normalizes the dominance and privilege of white Americans within a racial hierarchy.

    Making whiteness great again

    In the American imagination, white people are often perceived as being more authentically American than other racial groups.

    Additionally, Trump and some of his followers see many of America’s strides on civil rights as detrimental to white people. Trump has said that “anti-white feeling” is a significant problem in America. And Republican voters, who are overwhelmingly white, are more likely than the general population to view racism as a bigger problem for white people.

    Trump has said he believes America was at its best in the 1940s and 1950s. However, Trump’s long-standing inflammatory rhetoric around race — including his recent racist comments degrading Haitian refugees in Springfield, Ohio — do not simply glorify a time immediately before the civil rights era. They recall an older era.

    Calls to “Make America Great Again” hearken back to colonialism, when whiteness — particularly white, male power — was at its peak. The period from 1500 to the 1960s was a time when white men could exercise control over people of color by racially classifying their bodies. And they protected whiteness by passing laws that declared “one drop” of Black blood as enough to declare someone Black.

    Whiteness is property, as the legal scholar Cheryl Hines has argued. It’s an asset for those who possess it. It offers benefits like white privilege and the idea of being white as moral and superior.

    One-drop statutes, such as the Virginia Racial Integrity Act of 1924, attempted to scientifically define who was Black based on how much African ancestry a person had. Passed in dozens of states in the 20th century, these laws were about maintaining white purity.

    More specifically, one-drop statutes reflected a fear that people who were considered white in terms of their appearance but had Black ancestry could reproduce with other white people. This, in turn, would result in the supposed degeneration of the white race.

    These laws attempted to legally define Blackness.

    Power and dominance

    Harris and Obama, the children of immigrants, both have mixed-race backgrounds. Harris is the child of a Black Jamaican father and an Indian mother. Obama is the son of a Black Kenyan father and a white American mother.

    However, Trump insists that Harris was “Indian all the way,” while Obama was a “Black president.” For me, this perspective reveals another aspect of Trump’s racial thinking: He appears to believe in the impenetrability and power of whiteness.

    Trump sees Harris as capable of dancing back and forth between being Indian and being Black. Yet he has never implied that Obama can dance between being Black and being white.

    In a society that often ties physical characteristics to racial identity, many people might find it difficult to imagine Obama as identifying as white. That’s because our society associates his skin tone and hair texture with Blackness.

    However, I argue that the inability to view this hypothetical racial dance as possible for Harris and not for Obama is tied to white supremacist beliefs.

    These beliefs defend whiteness as being imbued with dominance over other racial groups. This power is reflected in the ability to define the race of others, regardless of how they may identify themselves. And it is reflected in the desire to also limit who can count as white.

    Trump does both of those things.

    A foil to white identity

    “She was always of Indian heritage, and she was only promoting Indian heritage. I didn’t know she was Black until a number of years ago, when she happened to turn Black, and now she wants to be known as Black,” Trump said in July at a gathering of Black journalists.

    He added: “So I don’t know, is she Indian or is she Black? I respect either one, but she obviously doesn’t, because she was Indian all the way, and then all of a sudden she made a turn and she went – she became a Black person.”

    By suggesting that Harris has strategically identified as Black for political gain, Trump implies that there’s a political advantage to being Black in America.

    This notion aligns with the racist belief, fueled by white racial resentment, that Black Americans are afforded privileges over whites and Asian Americans.

    The sociologist Arlie Hochschild has shown that many white Trump supporters believe circumstances in America have gotten worse for whites in recent decades. They believe many of the gains for people of color — affirmative action and other diversity policies — have been at the expense of the rights of white people.

    Simultaneously, Trump’s comments emphasize his own whiteness by using Harris’ and Obama’s race as a foil to his white identity. Research on the construction of race in America shows that whiteness is devoid of meaning without something to define itself against.

    For white people who feel many things have been taken away from them in an increasingly multiracial America, Trump is their warrior. He campaigns to protect the white population and culture of America.

    The Prime Minister is set to announce an additional £75 million to boost border security, bringing the investment in the Border Security Command over the next two years to £150 million.

    The Prime Minister is set to announce an additional £75 million to boost border security, bringing the investment in the Border Security Command over the next two years to £150 million. 

    Marking the first time the INTERPOL General Assembly has been hosted in the UK in over 50 years, Keir Starmer will today (4 November) open the Assembly in Glasgow by setting out his personal mission to smash the people smuggling gangs by resetting the UK’s whole approach to this challenge and intensifying international collaboration to meet the global scale of the threat.

    The General Assembly is INTERPOL’s supreme governing body and comprises senior ministerial and policing leads from the organisation’s 196 member states. 

    In his speech, the Prime Minister will set out his plans to draw on his experience of bringing together agencies to tackle international terrorist and drug smuggling gangs during his time as Director of Public Prosecutions to dismantle the people smuggling gangs who drive illegal migration, profit from human misery and represent a serious threat to global security. 

    He will also set out how the £150 million will provide additional specialist investigators and state of the art surveillance equipment to ensure those behind this criminal activity are stopped and brought to justice. 

    This major funding boost for the government’s new Border Security Command will initially be directed towards a range of enforcement and intelligence activity, including:

    • Investing heavily in NCA technology and capabilities, delivering advanced data exploitation and improvements to technologies to boost collaboration with European partners to investigate and break people smuggling networks.
    • 300 staff for the new Border Security Command, who will strengthen global partnerships, deliver new legislation and lead the system through investment and strategy.
    • 100 specialist investigators and intelligence officers for the NCA, dedicated to tackling criminals who facilitate people smuggling. 

    • Creating a new specialist OIC Intelligence Source Unit which will cohere intelligence flows from key police forces. 

    • Boosting the Crown Prosecution Service’s ability to deliver charging decisions more quickly on international organised crime cases. 

    The Border Security Command, led by Martin Hewitt CBE QPM, will be provided with enhanced powers – through a new Border Security, Asylum and Immigration Bill – to tackle organised immigration crime whilst providing for strong and effective border security. 

    New measures will make it easier to detect, disrupt and deter those seeking to engage in and benefit from organised immigration crime. The Command will also coordinate the work of intelligence agencies and law enforcement, who lead joint investigations with European counterparts to ensure we can bring those responsible to justice.

    Prime Minister Sir Keir Starmer is expected to say:

    “The world needs to wake up to the severity of this challenge.  I was elected to deliver security for the British people. And strong borders are a part of that. But security doesn’t stop at our borders.  

    “There’s nothing progressive about turning a blind eye as men, women and children die in the Channel.

    “This is a vile trade that must be stamped out – wherever it thrives. So we’re taking our approach to counter-terrorism – which we know works, and applying it to the gangs, with our new Border Security Command. 

    “We’re ending the fragmentation between policing, Border Force and our intelligence agencies.”

    Home Secretary Yvette Cooper said: 

    “Criminal smuggler gangs profit from undermining our border security and putting lives at risk and they have been getting away with it for far too long.

    “Our new Border Security Command, with the investment set out today, will mean a huge step change in the way we target these criminal gangs. People smugglers and traffickers operate in networks across borders, that’s why we have launched a major boost to our cooperation with international partners including other European countries, the G7 and Europol, and why we are so pleased to be hosting the INTERPOL conference on tackling international crime in Glasgow today.”

    The Prime Minister will also announce that the UK Government has increased its in-year support for INTERPOL’s global operations through a £6 million investment which harnesses the organisation’s unique capabilities to tackle serious organised crime affecting the UK. 

    Addressing the General Assembly, the Prime Minister will say that closer cooperation with international partners is key as he details how the gangs’ operations span from the money markets in Kabul through to the Kurdish region of Iraq and right across Europe and into the UK. 

    He will stress the government’s ongoing commitment to strengthening security agreements to facilitate greater sharing of intelligence and more joint operational work, in particular through Europol. 

    The Home Office will also invest £24m in the new financial year to tackle international serious organised crime affecting the UK including drugs and firearms, fraud, trafficking and exploitation. Funds will in part be used to bolster work done by special prosecutors and operational partners in the Western Balkans.

    There were more than 5,000 drug related deaths in 2023, with most of the illegal drugs causing these coming from overseas or facilitated by transnational gangs. ISOC funding will also be used to tackle drug smuggling upstream and at the UK border, building on recent successes, such as the effective collaboration with the US and Ecuador, which has resulted in the seizure of 19 tonnes of cocaine.

    National Crime Agency Director General Graeme Biggar said:

    “Serious and organised crime causes more harm, to more people, more often than any other national security threat. And almost all of serious and organised crime now has an international nexus. Distance, borders and languages are meaningless to criminals. This is why collaborations with INTERPOL have never been as important as they are today.

    “Tackling organised crime, and especially immigration crime, remains a top priority for the NCA. We are currently leading around 70 investigations into the gangs or individuals involved in the highest echelons of this type of criminality, and we are devoting more resources to it than ever before.

    “We have built up our intelligence sharing effort with law enforcement partners across Europe and beyond, including having more NCA officers based overseas, sharing intelligence and working side by side on joint investigations. This approach is bringing operational results with arrests and prosecutions, but we are also we are seeking to disrupt the people smugglers’ business model, through targeting their social media offering, their supply routes for equipment, and their financial flows.

    “We are determined to do all we can to disrupt and dismantle these networks, wherever they operate.”

    The announcement comes just a month after Britain joined up to a new G7 anti migrant smuggling action plan which included pledges to bolster border security, combat transnational organised crime, and protect vulnerable individuals from exploitation by smugglers. 

    The plan includes new, intelligence-led joint investigative actions to target criminal smuggling routes, working with social media platforms and internet providers to remove harmful content promoting illegal migration services or advertising fake job opportunities, and strengthening capabilities to monitor and anticipate irregular migration flows at both global and regional levels.

  • MIL-OSI Australia: Take off for extra tourism and trade capacity

    The Albanese Government is boosting aviation competition, trade and tourism opportunities for Australians, securing new or updated air services arrangements with seven international markets following months of negotiations.

    These arrangements will allow Australian airlines to expand their international networks and international airlines to increase operations into Australia, a boost for Australian travellers and diaspora communities.

    This includes unrestricted capacity with Canada and Malaysia – the first arrangements of this type since a deal struck with India in 2018.

    Along with Canada and Malaysia, arrangements have landed with Hong Kong, Chile, Mongolia, Latvia, and Rwanda.

    Australia now has more than 110 bilateral air services arrangements in place with other countries or economies, with today’s announcement following recent enhanced arrangements secured in the past 12 months with Türkiye, Vietnam and Sri Lanka. 

    Each arrangement is negotiated to serve Australia’s national interest, with the Australian Government signing with some of our larger tourism markets, including:

    • Immediate increase in available capacity for airlines to 50,000 weekly passenger seats with Malaysia, and unrestricted capacity for passenger services from 2026
    • Immediate increase in available capacity for airlines to 50 weekly passenger services with Canada, and unrestricted capacity for passenger services from 2026
    • Immediate increase in available capacity for airlines to 84 passenger services per week, and unlimited cargo services with Hong Kong 
    • A doubling of available capacity for airlines to and from Chile by 2025

    Inaugural arrangements were signed between the Australian Government and the governments of Latvia, Mongolia and Rwanda, each allowing 14 passenger services per week to and from Australia along with unrestricted dedicated cargo services. 

    These arrangements deliver on our commitment in the Aviation White Paper to expand capacity under our bilateral air services arrangements ahead of demand, ensuring airlines have adequate time to plan for additional future services and add new routes to their schedules. It also aligns with our commitments to prioritise negotiations within our region.

    These arrangements have already resulted in significant additional capacity being added into the Australian market, supporting growth in visitor numbers. For example, ABS data for the 12 months to August shows arrivals from Vietnam were 49 per cent higher than pre-pandemic, making it Australia’s fastest growing inbound visitor market.

    On October 31, 2024, the New Development Bank (NDB) successfully priced a 3-Year USD 1.25 billion Green Bond, paying an annual coupon of 4.677 per cent (equivalent to SOFR MS + 80 bps), under its Euro Medium Term Note Programme, which will be issued on 7 November 2024, subject to final legal documentation and customary closing conditions.

    An amount equal to the net proceeds from the Bond issuance will be allocated to finance and/or refinance, in whole or in part, past or future disbursement of loans made to eligible green projects in accordance with NDB’s Sustainable Financing Policy Framework dated 25 May 2020 in such sectors as clean transportation, climate change adaptation, energy efficiency, low-carbon and renewable energy, sustainable water management, etc. NDB’s Sustainable Financing Policy Framework governs issuances of green, social and sustainability debt instruments, including the use and management of bond proceeds, project selection and evaluation process, reporting and disclosure.

    The USD 1.25 billion Green Bond received strong demand from investors, with the final order book exceeding USD 2.2 billion. Geographically, the issuance attracted a diverse investor base, with 66% of investors from Asia and 34% from the EMEA region. The composition of the final order book was as follows: Central Banks, Official Institutions, and Sovereign Wealth Funds – 52%; Banks – 43%; Asset Managers, Fund Managers, and others – 5%.

    Bank of China, Emirates NBD Capital, First Abu Dhabi Bank, ICBC, and Standard Chartered Bank (B&D) acted as Joint Lead Managers of the transaction. CITIC Securities served as a Co-Manager of the transaction.

  • MIL-Evening Report: Will it be Kamala Harris or Donald Trump? Here’s what each needs to win the US election

    On election eve in the United States, the presidential race is deadlocked. The polls are exceptionally close across the country and in all the swing states – Pennsylvania, Michigan, Wisconsin in the industrial midwest; Nevada and Arizona in the west; and Georgia and North Carolina in the south.

    The final New York Times/Siena poll shows Democratic Vice President Kamala Harris leading by a very small margin or tied with Republican former President Donald Trump in all the swing states. The exception is Arizona, where Trump leads by a few percentage points.

    While there is no clear favourite to win, there are several critical factors that will driving voters’ decisions on Election Day. This is what to watch.

    Republicans turning against Trump

    Trump’s favourability is stuck around 43% in nationwide polling. In the past two presidential elections, he fell short of taking 50% of the national popular vote. As president, he never achieved over 50% favourability. And he has never topped 50% since leaving office.

    This means he has hit a ceiling in his support and is highly unlikely to win the national popular vote on Tuesday.

    This also reflects what happened to Trump in the Republican primaries to win the nomination. He dominated the field, defeating Florida Governor Ron DeSantis, former UN Ambassador Nikki Haley, and several others. But in most of those primaries, 15-20% of Republican voters did not vote for Trump.

    Where will these Republican voters ultimately land on Tuesday? Probably half want to vote Republican and will go with Trump. Others will not being able to bring themselves to vote for Harris and will simply not vote for president.

    Others will switch their support to Harris. Indeed, there has never been such a swelling of support from members of one party to support the other party’s presidential candidate.

    Harris needs those “Republicans for Harris” votes. In addition, she’ll need to replicate the coalition of young voters, voters of colour and women who backed current President Joe Biden against Trump in 2020 in those same swing states and nationally.

    Her favourability ratings are higher than Trump, at around 46%. The closer a presidential candidate is to 50% approval ratings, the better their chance of winning the election.

    It’s the economy, stupid

    At the same time, the country is in a bad mood. There is a classic polling question asked at elections: is the country on the right track, or moving in the wrong direction? Between 60–70% of Americans believe the country is on the wrong track.

    That is a signal this election is about change. Historically, that sentiment has not favoured the incumbent in the White House. As Biden’s vice president, Harris is directly facing this headwind.

    There are four key issues in this election. The most important is the hip pocket issue: household budgets, cost of living pressures and voters’ concerns about their future economic security.

    Since Biden and Harris took office nearly four years ago, the cost of groceries, household items, utilities and services such as insurance have risen between 10–40%. Petrol prices have gone up even more.

    Though interest rates have fallen, American households are hurting. When asked who is best to manage the economy, voters in swing states say Trump by a 15-point margin.

    The next-biggest issue is immigration. Since Trump first became a presidential candidate in 2015, he has relentlessly pushed the immigration button, declaring the border with Mexico is out of control, with crime and pillage rising in its wake.

    The first three years of Biden’s term were also marked by big surges of immigrants crossing the border, though rates have fallen dramatically in 2024.

    Voters view Trump as best placed to manage this issue, too, by nearly 15 points.

    So, Trump is seen as a more effective leader on the two most important policy issues in this election.

    A surge in support from women

    Abortion rights and reproductive health services are the third major issue. Many women across America are repelled by the Supreme Court’s decision to take away their long-held constitutional right to an abortion. Now, this policy is decided at the state level. And several conservative Republican states – including Ohio and Kansas – have voted to restore abortion rights.

    Harris is seen as the champion of these issues. Multiple polls show voters trust her more than Trump on reproductive rights, by wide margins.

    As a result, polling shows Harris is leading Trump with women voters in the swing states, by 15 points or more.

    Abortion rights are also on the ballot in two swing states, Nevada and Arizona, which should help Harris in both.

    The future of American democracy is the fourth major issue facing voters. According to a new poll, half the country sees Trump as a profound threat to America’s democracy who will wield authoritarian power to enforce his policies and programs.

    Harris has pledged to turn the page, heal divisions and get Republicans and Democrats working together again.

    In these closing days, Trump continues to make provocative statements with violent imagery. At a rally in Arizona last week, for instance, he again attacked Liz Cheney, the former Republican congresswoman who advocated for the prosecution of Trump over the January 6 insurrection:

    She’s a radical war hawk. Let’s put her with a rifle standing there with nine barrels shooting at her, OK? Let’s see how she feels about it. You know, when the guns are trained on her face.

    This may have provided Harris with a final cut-through moment on Trump’s fitness for office in the final days of the campaign. She said in response:

    Anyone who wants to be president of the United States who uses that kind of violent rhetoric is clearly disqualified and unqualified to be president. […] Trump is increasingly, however, someone who considers his political opponents the enemy, is permanently out for revenge and is increasingly unstable and unhinged.

    So, who is going to win?

    Trump’s team sees victory in all the polls. His chief pollster wrote late last week:

    President Trump’s position nationally and in every single battleground state is significantly better than it was four years ago.

    The polls may also be undercounting the full measure of Trump’s support, as was the case in 2016 and 2020. And the polls may not be reflecting the extent of antipathy towards Harris as a Black and south Asian woman.

    Jen O’Malley Dillon, Harris’ campaign director, and who headed the 2020 Biden campaign that defeated Trump, has told her troops, meanwhile, that undecided voters are “gettable”, adding:

    We have multiple pathways to victory […] Our folks are voting at levels we need them to vote in order for us to win.

    Harris has built a US$1 billion (A$1.5 billion) machine designed to reach voters in the swing states – through personal contact. This machine made three million phone calls and door knocks on homes in Michigan, Pennsylvania and Wisconsin alone on Saturday. If this machine delivers, it could be the boost Harris needs on election night.

    Harris’ campaign also signalled over the weekend that late-deciding voters, and especially women, are breaking their way by double digits. There is a sense among Democrats that Harris is now peaking as the campaign concludes.

    The final analysis

    If Harris wins, it will be because she has successfully sealed the deal with those voters and made the election a referendum on Trump – that on balance the country has had enough of him after eight years. It also means her ground game delivered the votes.

    If Trump wins, it will mean voters trusted him to manage inflation and the cost-of-living squeeze on households, as well as what they see as out-of-control immigration and crime. These messages would also have been further embellished by unease about Harris, a Black and south Asian woman, as president.

    WASHINGTON, D.C. – For the fourth year in a row, the White House is displaying a Día de los Muertos ofrenda to honor and celebrate the lives of loved ones who have passed. As part of this experience, First Lady Jill Biden welcomed members of the Latino community for a special White House tour and invited guests to add a photo of a loved one to the display. This year’s ofrenda was created in partnership with the Mexican Cultural Institute, located in Washington, D.C.  
     
    “The First Lady continues to open the ‘People’s House’ wider and wider to communities across the country. Through this Día de los Muertos ofrenda, we hope all who visit the White House in the coming days can take a moment to recognize those we’ve lost and celebrate the rich diversity of our country,” said Vanessa Valdivia, Press Secretary for the First Lady.
     
    This is the fourth Día de los Muertos ofrenda display during the Biden-Harris Administration, and the second to be made available to view on the public tour of the White House. In 2023, Dr. Biden displayed the ofrenda along the public tour route of the White House for the first time and invited members of the Latino community to add a photo of a loved one. In 2022, Dr. Biden partnered with the National Museum of Mexican Art (NMMA) in Chicago, Illinois to display an ofrenda that was located in the West Garden Room of the White House. In 2021, the President and First Lady debuted the first-ever ofrenda at the White House to mark Día de los Muertos.

    MUSKOGEE, OKLAHOMA – The United States Attorney’s Office for the Eastern District of Oklahoma announced that Timothy Randall England, age 36, of Tahlequah, Oklahoma, was sentenced to 300 months in prison for the 2023 murder of a Stilwell resident.

    The charge arose from investigations by the Cherokee County Sheriff’s Office, the Cherokee Nation Marshal Service, the Adair County Sheriff’s Office, the Oklahoma State Bureau of Investigation, and the Federal Bureau of Investigation.

    On April 30, 2024, England pleaded guilty to one count of Murder in Indian Country—Second Degree.   According to investigators, on February 7, 2023, England traveled to a Stilwell residence, waited outside for the resident to arrive, then fired upon the victim eight times with a 7.62×39 rifle before fleeing the scene.  Three of the shots struck the victim, who died at the scene.  England was later apprehended by the Cherokee Nation Marshal Service in Tahlequah and arrested without incident.  The crime occurred in Adair County, within the boundaries of the Cherokee Nation Reservation, in the Eastern District of Oklahoma.

    The Honorable Raúl M. Arias-Marxuach, Chief Judge in the U.S. District Court for the District of Puerto Rico, sitting by assignment, presided over the hearing in Muskogee.  England will remain in the custody of the U.S. Marshal pending transportation to a designated United States Bureau of Prisons facility to serve a non-paroleable sentence of incarceration.

    Assistant U.S. Attorney Kevin Gross represented the United States at sentencing.

    MUSKOGEE, OKLAHOMA – The United States Attorney’s Office for the Eastern District of Oklahoma announced that Mason Anthony Wilson, age 28, of Gore, Oklahoma, was sentenced to 120 months in prison for one count of Child Abuse in Indian Country and 120 months in prison for one count of Child Neglect in Indian Country.  The terms are set to be served concurrently.

    The charges arose from an investigation by the Muskogee Police Department and the Federal Bureau of Investigation.

    On June 5, 2024, a federal jury found Wilson guilty at trial on both counts.  According to investigators, in April 2022, Wilson caused injuries to a 2-month-old baby in his care, including multiple fractured bones, and failed to provide medical care for the child.  The crimes occurred in Sequoyah County, within the boundaries of the Cherokee Nation Reservation of Oklahoma, in the Eastern District of Oklahoma.

    The Honorable Kea W. Riggs, U.S. District Judge in the United States District Court for the District of New Mexico, sitting by assignment, presided over the hearing in Muskogee, Oklahoma.  Wilson will remain it the custody of the U.S. Marshal pending transportation to a designated United States Bureau of Prisons facility to serve a non-paroleable sentence of incarceration.

    MUSKOGEE, OKLAHOMA – The United States Attorney’s Office for the Eastern District of Oklahoma announced that Ronald Wayne Yarbrough Jr., age 54, of Lehigh, Oklahoma, was sentenced to 115 months in prison for voluntary manslaughter.

    The charge arose from an investigation by the Federal Bureau of Investigation.

    On August 31, 2023, Yarbrough pleaded guilty to an Information of one count of Voluntary Manslaughter in Indian Country.  According to investigators, on November 24, 2022, Yarbrough instigated a fight outside the family home.  During the fight, Yarbrough stabbed the victim in the neck.  The victim was later declared dead at an area hospital.  The crime occurred in Coal County, within the boundaries of the Choctaw Nation Reservation, in the Eastern District of Oklahoma.

    The Honorable Kea W. Riggs, U.S. District Judge in the United States District Court of New Mexico, sitting by assignment, presided over the hearing in Muskogee, Oklahoma.  Yarbrough will remain in the custody of the U.S. Marshal pending transportation to a designated United States Bureau of Prisons facility to serve a non-paroleable sentence of incarceration.

    WASHINGTON— Today, Representative Dale W. Strong (R-AL) introduced the Deport Illegal Voters Act to expedite the removal of aliens convicted of voting illegally.  

    Specifically, the legislation adds unlawful voting to the defined list of aggravated felonies under the Immigration and Nationality Act (INA) and provides for the expedited deportation of convicted individuals. 

    “Anyone who is not an American citizen and casts a ballot in this election should be first in line to be deported. We must secure our elections and ensure participation in our elections is reserved for American citizens and American citizens only,” said Congressman Dale W. Strong.  

    Under the Biden-Harris Administration, we have seen record numbers of border crossings and illegal immigration into the United States. Additionally, there have been numerous cases of voter registration forms issued to non-citizens and numerous cases of non-citizen voting across the country, including Alabama. In September, the Department of Justice charged a Guatemalan national residing in Alabama with fraudulently using a U.S. identity to vote in multiple elections including the 2016 and 2020 presidential elections. This week, charges were filed against a Chinese national who cast a vote in the 2024 Presidential election in Michigan.  

    Interference in our elections undermines the rights of American citizens and sets a dangerous precedent that could further erode the trust and credibility of our electoral system. The integrity of our election system must be safeguarded to ensure only eligible and lawful voters are permitted to participate.

    In an independent study commissioned by the United Nations Department of Peace Operations (DPO), new models for UN peacekeeping are outlined to address evolving global threats. Commissioned at the request of Germany and other co-chairs of the UN Peacekeeping Ministerial process, this study aims to shape discussions for the upcoming Berlin UN Peacekeeping Ministerial on May 13-14, 2025. The event will center on the theme: “The Future of Peacekeeping.”

    The study finds that UN peacekeeping remains an effective multilateral tool for preventing and limiting armed conflict, sustaining peace, as well as responding to a broader range of threats to international peace and security. It also reviews security threats and challenges that future peacekeeping missions must address. Among the most important are armed conflict, the weaponization of new and emerging technologies, transnational organized crime, the climate crisis, and public health emergencies, which are combining in complex ways that ignore international political borders.

    Looking to the future, fresh thinking is needed about what roles peacekeeping can and should play. The study’s vision for UN peacekeeping is a politically focused, people-centered, modular tool that can unite the Security Council around effective multilateral responses to a broad range of threats and challenges. To support this vision, the study offers 30 plausible models to inform future UN missions. The models describe a mix of longstanding peacekeeping tasks; how those traditional tasks might be performed in different ways in changed contexts and with new technologies; and propose novel activities for future UN peacekeeping.

    This study also highlights the need for investments in key capabilities to strengthen current and future peacekeeping missions, irrespective of the precise combination of models and mandates. There are also strong links between peacekeeping and the UN’s broader prevention and peacebuilding agendas, as well as the Agenda 2030 for Sustainable Development, which can be reinforced further.

    Governor Kathy Hochul today announced that more than $435 million is being awarded to 102 critical water infrastructure projects across New York State through the Water Infrastructure Improvement and Intermunicipal Grant programs. The grants awarded by the New York State Environmental Facilities Corporation (EFC) deliver on Governor Kathy Hochul’s 2024 State of the State to help small, rural and disadvantaged communities with their water infrastructure needs. With critical financial support for local governments across New York, Governor Hochul is laying the foundation for a healthier, more resilient future, ensuring every New Yorker has access to safe and clean water, while creating jobs and boosting the economy.

    “New York is committed to funding water infrastructure upgrades because every person has a right to clean water,”  Governor Hochul said.  “With this funding for communities across the State, we are providing critical resources to local economies, creating jobs and safeguarding the health and well-being of all New Yorkers.”

    These grants will support water infrastructure projects totaling more than $1 billion that safeguard drinking water from the risk of toxic chemicals, upgrade and replace water and wastewater infrastructure in a manner that will increase community resilience, regionalize water systems, support local economies, and are critical to protecting public health and the environment. The ratepayers are projected to save an estimated $1 billion in costs the communities would have incurred if they had financed the projects on their own.

Coleman said,  ”EFC’s grants are a hallmark of New York State’s robust, nation-leading investment in the environment, which will help municipalities affordably invest in water infrastructure improvement projects. These grants will help get shovels in the ground for 102 water quality projects across New York State. EFC is committed to awarding grant funding to the communities that need it most, as demonstrated by the dedicated work of our Community Assistance Teams and the award of enhanced grants totaling $126.7 million amount to small, rural and disadvantaged communities.”

    This round of WIIA/IMG boasts improvements announced as part of Governor Hochul’s 2024 State of the State to maximize benefits for rural and disadvantaged communities.

    Enhanced Awards for 32 Projects in Small, Rural Communities
    Even with extensive financial support from the State, some municipalities are left passing a large financial burden to their ratepayers. To alleviate this burden on small, rural and disadvantaged communities, Governor Hochul directed EFC to increase grants for small, rural communities from 25 percent to 50 percent of net eligible project costs. Examples of enhanced awards include:

    • Town of Peru (North Country) is awarded $11 million for upgrades to the Town of Peru Water Pollution Control Plant (WPCP), with a focus on effluent disinfection.
    • Saint Regis Mohawk Tribe is awarded $9.8 million for upgrades to the wastewater treatment plant.
    • Village of Richfield Springs (Mohawk Valley)  is awarded $9.1 million for improvements to the wastewater treatment plant and sewer rehabilitation.
    • Town of Ellicott (Western NY)  is awarded $3.2 million for the expansion of sewer service in the area around Fluvanna Avenue.

    EFC’s Community Assistance Teams Helped Municipalities Secure Grants
    Small, rural and disadvantaged communities are particularly impacted by deteriorating water infrastructure and emerging contaminants and often do not possess the resources and capacity necessary to advance a project for infrastructure improvement. Governor Hochul expanded EFC’s  Community Assistance Teams program that launched in 2023 to provide essential support for updating New York’s critical water infrastructure. Thirteen municipalities that worked with EFC through this critical initiative received grants, four of which are receiving enhanced awards:

    • Town of Mina (Western NY) is awarded $13 million for the construction of a new sanitary sewer collection system around Findley Lake and a new wastewater treatment plant to treat sewage from the new system.
    • Town of Potsdam (North Country) is awarded $1.4 million for the construction of a new sewer district.
    • Village of Parish (Central NY) is awarded $1 million for wastewater treatment plant improvements.
    • Town of Wilna (North Country) is awarded $154,527 for wastewater treatment facility upgrades.

    Awards Totaling $66 million To Protect Drinking Water From Emerging Contaminants
    Continuing New York’s national leadership on addressing the threat of PFAS, Governor Hochul increased awards for emerging contaminant projects from 60 percent to 70 percent of net eligible project costs. This change will help ensure cost is not a barrier for communities working to make life-saving investments that eliminate risks to their drinking water supplies. Examples of emerging contaminants projects include:

    • Village of Hempstead (Long Island)  is awarded $37 million for water treatment improvements to remove 1,4 Dioxane and PFAS.
    • Town of North Salem (Mid-Hudson)  is awarded $592,074 for the Pabst Water System PFOS Mitigation project.
    • Dutchess County Water & Wastewater Authority (Mid-Hudson)  is awarded $15 million for water system interconnection to remedy PFAS-Contaminated source water.
    • Suffolk County Water Authority (Long Island)  is awarded a total of $4.9 million for four projects using advanced oxidation to remove 1,4-dioxane from groundwater.

    EFC administers the WIIA and IMG programs in coordination with the Department of Health (DOH). The State has awarded more than $2.9 billion in water infrastructure grants through EFC since 2015.

    Department of Environmental Conservation Interim Commissioner Sean Mahar said, “Under Governor Hochul’s leadership, New York State continues to prioritize investments in clean water for communities statewide. Today’s award of $435 million will support more than 100 water projects across the State to protect public health and the environment. The investments, bolstered by EFC’s assistance to rural, smaller and disadvantaged communities, are advancing effective water infrastructure improvements that will benefit New Yorkers.”

    State Commissioner of Health Dr. James McDonald said, “Governor Hochul is ensuring that New Yorkers throughout the State have access to clean drinking water, the foundation to good health. The financial support in this latest announcement will help municipalities make critical upgrades to their water systems, something they might not be able to afford on their own, and thus help to achieve greater health equity in our great state. New York State will continue to work with communities to ensure their water is safe to drink today and into the future.”   

    Secretary of State Walter T. Mosley said, “Clean water infrastructure is vital to public health and New York State is making a historic economic commitment for communities to address drinking water infrastructure needs.     New York’s Commitment to Water Quality
    New York State continues to increase its nation-leading investments in water infrastructure, including more than $2.2 billion in financial assistance from EFC for local water infrastructure projects in State Fiscal Year 2024 alone. With $500 million allocated for clean water infrastructure in the FY25 Enacted Budget announced by Governor Hochul, New York will have invested a total of $5.5 billion in water infrastructure between 2017 and this year. Governor Hochul’s State of the State initiatives are ensuring ongoing coordination with local governments and helping communities to leverage these investments. The Governor increased WIIA grants for wastewater projects from 25 to 50 percent of net eligible project costs for smaller, disadvantaged communities. The Governor also expanded EFC’s Community Assistance Teams to help small, rural and disadvantaged communities leverage this funding and address their clean water infrastructure needs.   • MIL-OSI USA: Booker Calls on EPA to Ban Use of Paraquat to Protect Farmworkers and Rural Communities

    WASHINGTON, D.C. –  Today, U.S. Senator Cory Booker (D-NJ) and his Senate colleagues sent a letter to Environmental Protection Agency (EPA) Administrator Michael Regan urging the agency to ban the use of paraquat, a highly toxic pesticide linked to severe health risks, including Parkinson’s disease and various forms of cancer.
    “Paraquat is a highly toxic pesticide whose continued use cannot be justified given its harms to farmworkers and rural communities. We write to urge the Environmental Protection Agency (EPA) to ban the use of paraquat in the United States,” the Senators wrote. 
    “Paraquat has been linked to Parkinson’s disease, thyroid cancer, and other health harms such as kidney, liver, and respiratory damage, and reproductive harm, including neurodevelopmental impact on developing fetuses. In rural areas, exposure to paraquat and other pesticides during pregnancy can increase the risk of leukemia,” the Senators continued.  
    There has been a global movement away from paraquat, with over 70 countries—including China, Brazil, and members of the European Union—banning its use. Additionally, data from the EPA indicates that the majority of U.S. farmers do not rely on paraquat for their crops.
    Given the documented health hazards associated with paraquat, the case for its ban is clear. The EPA must prioritize the safety and well-being of farmworkers and rural communities, who should not be subjected to preventable health harms.
    “We urge you to protect the health of farmworkers and rural residents by banning paraquat,” the Senators concluded. 
    The letter is cosigned by U.S. Senators Richard Blumenthal (D-CT), Martin Heinrich (D-NM), Ed Markey (D-MA), Bernie Sanders (I-VT), Chris Van Hollen (D-MD), and Peter Welch (D-VT).

    Attorney General Wilson announces cooperation agreements and settlements with Heritage and Apotex totaling $49.1 Million

     

    First two settlements and cooperation agreements with corporate defendants as states prepare for trial in ongoing generic drug price-fixing litigation

    (COLUMBIA, S.C.) – Attorney General Alan Wilson today joined a coalition of 50 states and territories announcing two significant cooperation agreements and settlements with Heritage Pharmaceuticals and Apotex totaling $49.1 million to resolve allegations that both companies engaged in widespread, long-running conspiracies to artificially inflate and manipulate prices, reduce competition, and unreasonably restrain trade with regard to numerous generic prescription drugs. As part of their settlement agreements, both companies have agreed to cooperate in the ongoing multistate litigations led by Connecticut against 30 corporate defendants and 25 individual executives. Both companies have further agreed to a series of internal reforms to ensure fair competition and compliance with antitrust laws. A motion for preliminary approval of the $10 million settlement with Heritage was filed today in the United States District Court for the District of Connecticut in Hartford. A settlement with Apotex for $39.1 million is contingent upon obtaining signatures from all necessary states and territories and will be finalized and filed in the U.S. District Court in the near future.

    The settlements come as the states prepare for the first trial to be held in Hartford, Connecticut.

    “I am proud to join my fellow state attorneys general in resolving this matter related to generic drug price fixing,” Attorney General Wilson said. “This settlement resolves a portion of the litigation, and the litigation continues as we seek to hold other defendants accountable and protect consumers.”  

    Connecticut’s Assistant Attorney General Joseph Nielsen is the lead attorney for a coalition of nearly all states and territories filing three antitrust complaints, starting first in 2016. The first Complaint included Heritage and 17 other corporate Defendants, two individual Defendants, and 15 generic drugs. Two former executives from Heritage Pharmaceuticals, Jeffery Glazer and Jason Malek, have since entered into settlement agreements and are cooperating. The second Complaint was filed in 2019 against Teva Pharmaceuticals and 19 of the nation’s largest generic drug manufacturers. The Complaint names 16 individual senior executive Defendants. The third complaint, to be tried first, focuses on 80 topical generic drugs that account for billions of dollars of sales in the United States and names 26 corporate defendants and 10 individual defendants. Six additional pharmaceutical executives have entered into settlement agreements with the States and have been cooperating to support the States’ claims in all three cases.  

    The cases all stem from a series of investigations built on evidence from several cooperating witnesses at the core of the different conspiracies, a massive document database of over 20 million documents, and a phone records database containing millions of call detail records and contact information for over 600 sales and pricing individuals in the generics industry. Each complaint addresses a different set of drugs and defendants and lays out an interconnected web of industry executives where these competitors met with each other during industry dinners, “girls’ nights out”, lunches, cocktail parties, and golf outings and communicated via frequent telephone calls, emails and text messages that sowed the seeds for their illegal agreements. Throughout the complaints, defendants use terms like “fair share,” “playing nice in the sandbox,” and “responsible competitor” to describe how they unlawfully discouraged competition, raised prices, and enforced an ingrained culture of collusion. Among the records obtained by the States is a two-volume notebook containing the contemporaneous notes of one of the States’ cooperators that memorialized his discussions during phone calls with competitors and internal company meetings over a period of several years.

    WASHINGTON – U.S. Senators Martin Heinrich (D-N.M.) and Ben Ray Luján (D-N.M.), and U.S. Representative Teresa Leger Fernández (D-N.M.) sent a letter urging the Federal Emergency Management Agency (FEMA) Director of the Hermit’s Peak/Calf Canyon Claims Office and the FEMA Director of the New Mexico Joint Recovery Office to address concerns from New Mexicans about the process for receiving compensation from the Claims Office.  
    Created by the Hermit’s Peak/Calf Canyon Fire Assistance Act in 2022 – legislation championed and passed by N.M. Congressional Democrats – the Hermit’s Peak/Calf Canyon Claims Office is responsible for processing New Mexicans’ claims that arose from the wildfire. Since the devastating wildfire, the N.M. Delegation has secured a total of $3.95 billion in federal funding for the Hermit’s Peak/Calf Canyon Fire recovery. 
    “The Hermit’s Peak/Calf Canyon Fire destroyed hundreds of homes and businesses in New Mexico. The fire and subsequent flooding displaced thousands of our constituents for months, wiped away generations of history, and uprooted families from their communities. And yet, over two years later, many New Mexicans continue to wait for the relief and compensation they are owed by the federal government,” the lawmakers wrote to Jay Mitchell, FEMA Director of the New Mexico Joint Recovery Office, and Michael Plostock, FEMA Director of the Hermit’s Peak/Calf Canyon Claims Office.  
    “After a significant delay in getting the Claims Office fully staffed and operational, and after further delays in dispersing funds, improvements to the Claims Office’s processes and best practices are still sorely needed. While we are encouraged by recent changes within the Claims Office, we have continued to hear concerns from our constituents about their experience with the process for receiving compensation from the Claims Office,” the lawmakers continued.  
    “The Claims Office must process claims faster, communicate with claimants on a regular and consistent basis, and pay fair compensation. We also ask that processes and formulas reflect unique aspects of New Mexico such as adobe, historic structures, and subsistence living where large cache of food are kept in freezers,” the lawmakers further continued. 
    To address these concerns and ensure that victims of the fire have all the information and tools they need to get compensation from the Claims Office, the lawmakers requested that Directors Mitchell and Plostock answer the following questions: 
    1. How is the Claims Office working to more consistently communicate with claimants through proactive communication and responding to claimant inquiries in a timely manner? 
    2. How is the Claims Office working to speed up the review of total loss claims in a way that ensures these claimants receive full compensation for culturally and structurally unique buildings, such as adobe? 
    3. How many claimants have total home losses? Of those, how many have been compensated to date (broken down between partial and full compensation)? And of those who lost homes, how many of those are living in a new home or are in the building process? 
    4. What steps is the Claims Office taking to ensure that claimants who do not possess traditional mortgage documentation or property deeds receive compensation quickly? 
    5. What are the policies and processes in place to ensure that claimants can retain their assigned navigator if they so choose? 
    6. When using standard rate calculators and tools from the insurance industry, how is the Claims Office working to make changes and updates to maximize the amount of compensation claimants are awarded? 
    7. How is the Claims Office working to reduce the amount of tax documentation required from claimants, rather than add to it, particularly in total loss, complex, and small business claims?  
    8. How is the Claims Office ensuring equity in food loss payments? If changes to Claims Office compensation policy are needed, is the Claims Office committed to updating policy such that claimants are not paid less than they would have previously received, and is the Claims Office committed to updating previously closed claims with the adjusted increased compensation?  
    9. How is the Claims Office ensuring equity in hourly labor rate reimbursement for repairs? 
    10. How is the Claims Office working to help claimants understand the review decisions by Subject Matter Experts (SMEs)? Does the Claims Office include the SME reports with annotated decisions in Letter of Determination?  
    11. How is the Claims Office working to reduce the number of separate assessments claimants are required to have on the same property? 
    12. When will the erosion estimate process be finalized? 
    13. How is the Claims Office working to ensure that business loss claimants can receive updates and work on their claims from any office location?

    LAREDO, TX – Today, U.S. Congressman Henry Cuellar, Ph.D. (TX-28) announced the official opening of the new Laredo Customs Trade Partnership Against Terrorism (CTPAT) Field Office at the World Trade Bridge (WTB) port of entry, in Laredo, Texas. Rep. Cuellar secured funding for this office through his support of CBP’s port of entry operations including robust staffing for the Office of Field Operations in the Fiscal Year 2024 Homeland Security Appropriations bill. 

    CTPAT is CBP’s flagship program public aimed at strengthening international supply chain security while at the same time facilitating legitimate low-risk cargo. Activities for the Laredo CTPAT office will include the review of CTPAT program applications, assessment of eligibility requirements, certification and validation of new members, and the continued maintenance of accounts and revalidation of CTPAT members in accordance with the SAFE Port Act of 2006. The area of responsibility (AOR) for the Laredo CTPAT office during its formation will include but is not limited to, the Laredo, Texas commuting area, and the cross-border cities within the state of Tamaulipas, Mexico.

    WASHINGTON, D.C. – Today, the Office of the Director of National Intelligence (ODNI), the Federal Bureau of Investigation (FBI), and the Cybersecurity and Infrastructure Security Agency (CISA) released the following statement:

    “The IC assesses that Russian influence actors manufactured a recent video that falsely depicted individuals claiming to be from Haiti and voting illegally in multiple counties in Georgia. This judgment is based on information available to the IC and prior activities of other Russian influence actors, including videos and other disinformation activities. The Georgia Secretary of State has already refuted the video’s claims as false.

    Russian influence actors also manufactured a video falsely accusing an individual associated with the Democratic presidential ticket of taking a bribe from a U.S. entertainer.

    This Russian activity is part of Moscow’s broader effort to raise unfounded questions about the integrity of the US election and stoke divisions among Americans, as detailed in prior ODNI election updates. In the lead up to election day and in the weeks and months after, the IC expects Russia to create and release additional media content that seeks to undermine trust in the integrity of the election and divide Americans.”

    “Here we are at the end of 2024 and MC14 isn’t that far away. We’re committed to having concrete outcomes and so as part of achieving that, this session will be important,” said Richard Tarasofsky of Canada, which co-convenes TESSD together with Costa Rica, in opening the meeting. He added that a high-level TESSD plenary stocktaking session will be held on 4 December to seek members’ support for the proposed way forward towards achieving concrete outcomes at MC14 that reflect both the technical discussions in working groups as well as the written outcomes of those groups.
    “We are really making an effort to dig deeper into the development dimension, including in how we select topics such as climate adaptation,” said Mr. Tarasofsky.
    The four TESSD working groups advanced substantive work in their respective discussions at the meeting.
    In the Working Group on Trade-related Climate Measures (TrCMs), members deliberated on the use of TrCMs for achieving climate change adaptation and focused on developing country perspectives. They heard presentations from the International Institute for Sustainable Development, the WTO Secretariat, the World Bank, Barbados and Samoa.
    In the Working Group on Environmental Goods and Services, members exchanged views on trade-related aspects of water management and climate change adaptation, considering presentations on water management technologies and developing country experiences from the UN Environment Programme (UNEP) Copenhagen Climate Centre and the UN Climate Technology Centre & Network (CTCN). Members also considered presentations on identification and trade promotion of environmental goods and services from Australia, Finland and the WTO Secretariat.
    In the Working Group on Subsidies, members considered presentations on critical minerals, including how international cooperation can support developing countries in addressing challenges and seizing opportunities in the sector. The International Energy Agency, the African Development Bank, Australia and the Philippines provided presentations.
    In the Working Group on Circular Economy-Circularity, members heard from the Global Batteries Alliance on batteries passports and on circularity of batteries. They also heard from Rwanda on implementing circular economy principles in the transport sector. Members also were briefed on new analytical work from the International Chamber of Commerce, Organisation for Economic Co-operation and Development, and the Forum on Trade, Environment and SDGs (TESS).
    Across the four working groups, members also discussed possible ways forward for outcomes at MC14, including a compilation and mapping of policy measures shared by members, practical ways to enhance cooperation, and expanding and refining the TESSD indicative list of environmental goods and services. They also considered developing guidelines for subsidy design and recommendations to enhance transparency, trade-related guidelines for a circular economy and trade‑related good practices for circularity in priority sectors.

    At the close of the two-day meeting, Ana Lizano of Costa Rica, TESSD co-convenor, said: “We have heard support as well as constructive feedback from the participants to the suggestions on the way forward presented by the facilitators of the four groups. So the co-conveners, together with the facilitators, will put together the most balanced outlook possible for 2025 and towards the next Ministerial Conference.”
    “We will continue working on bringing to the table more voices from the developing and least-developed members to consolidate an agenda that is not only balanced but also representative of the needs, opportunities, and interests of all TESSD participants,” she said.
    Guided by their 2021 Ministerial Statement, TESSD seeks to complement the work of the WTO Committee on Trade and Environment and advance discussions at the intersection of trade and environmental sustainability towards identifying concrete actions that members could take individually or collectively. The initiative, which is open to all WTO members, is currently co-sponsored by 77 members representing all regions and all levels of development.

    The Chair noted that despite calls for members to notify their subsidies, compliance with the subsidy notification obligation under the WTO’s SCM Agreement remains concerningly low, affecting the Agreement’s proper functioning. 
    He highlighted that 84 members have not made their 2023 notifications, which were due by 30 June 2023, while 82 members have yet to make their 2021 notifications, which were due more than three years ago. He also noted that 71 members still have not submitted their 2019 notifications, now overdue by more than five years. Many of these members have either never notified or have done so only in the distant past, he said.
    The Chair emphasized that all members benefit from the collective effort of timely and complete notifications. “Ultimately, all members, in addition to being required to notify, have an interest in the notified information of other members,” he stated. He called on non-compliant members to fulfil their obligations, noting that transparency is fundamental to the SCM Agreement’s proper functioning.
    Highlighting efforts to improve compliance, the Chair drew attention to the WTO Secretariat’s technical assistance project on subsidy notifications. The first round of the project, completed in 2023, invited 43 members to take part, with 23 agreeing to participate. Of these, 11 members subsequently submitted their 2023 subsidy notifications in a timely fashion, accounting for 13% of all notifications received for that cycle. The Chair praised these tangible outcomes as evidence of the effectiveness of well-structured, customized assistance projects. He also informed members that a 2024-2025 round of the same technical assistance project will be launched towards the end of this year. He encouraged active engagement of the participating members.
    Several delegations took the floor to echo the Chair’s concerns, stressing the importance of timely and complete subsidy notifications for the SCM Agreement’s effective functioning. They also expressed appreciation for the Secretariat’s ongoing support and technical assistance efforts.
    Training session on subsidy notifications
    In response to a suggestion to organize a training session on the obligation to make subsidy notifications, the Chair acknowledged the potential benefits of such an initiative. He noted that holding a training session would be particularly useful given that a new notification cycle will begin in 2025. Recognizing the timeliness of such a session, he proposed that the Secretariat arrange this training early next year. The Secretariat will communicate the exact date and venue of the session in due course.
    Review of members’ subsidy notifications
    The Committee reviewed the 2023 new and full subsidy notifications submitted by Australia, Cabo Verde, Cambodia, the European Union (pertaining to Croatia, Luxembourg, and Slovenia), Democratic Republic of the Congo, Dominican Republic, El Salvador, Honduras, Iceland, Nepal, and Uruguay.
    The Committee also continued its review of 2023 subsidy notifications from Brazil, Canada, China, Eswatini, the European Union, Japan, Kenya, the Republic of Korea, Malaysia, Mauritius, Montenegro, Norway, Türkiye, the United Kingdom, the United States, and Vanuatu. It also continued its review of a 2019 notification from the Russian Federation.
    National legislation
    The Committee reviewed new notifications of countervailing duty legislation submitted by Brazil, Cabo Verde, Solomon Islands, and the United States. It also continued its review of the legislative notifications of Saint Kitts and Nevis, the European Union, and Ghana.
    Semi-annual reports of members on countervailing duty actions
    The Committee considered the semi-annual reports of countervailing duty actions submitted by Australia, Brazil, Canada, the European Union, India, Mexico, the United Kingdom, and the United States.
    In addition to the semi-annual reports, the SCM Agreement requires members to submit without delay notifications of all preliminary and final countervailing duty actions taken. Reports received from Australia, Brazil, Canada, the European Union, India, Mexico, Chinese Taipei, the United Kingdom, and the United States were reviewed by the Committee.
    Other matters
    The Chair recalled the 31 December 2015 deadline for the elimination of export subsidies by members that received “fast track” extensions under Article 27.4 of the SCM Agreement. He noted that only 15 of the 19 members that had received extensions have provided the final required notifications. He called on the remaining members to comply without delay.
    The Committee discussed a separate item China placed on the agenda regarding discriminatory subsidies policies and measures of the United States.
    The Committee discussed a separate item the Republic of Korea placed on the agenda regarding France’s electric vehicle subsidies programme.
    The Committee also discussed a separate item Australia, Canada, the European Union, Japan, the United Kingdom, and the United States placed on the agenda regarding subsidies and capacity.
    In addition, the Committee discussed a separate item the United States placed on the agenda regarding Kazakhstan’s proposed preferences for domestically produced agricultural machinery.
    The Committee discussed a separate item the United States placed on the agenda regarding the WTO Secretariat’s activities on subsidies. The United States highlighted certain Secretariat-initiated activities relating to subsidies, calling for greater transparency and consultation between the Secretariat and the membership.  Australia, the European Union, India, and the United Kingdom commented on the issues raised by the US, including by expressing support for the call for greater transparency.
    The Secretariat informed the Committee that it has been working on a transparency portal that will allow members to access information about Secretariat-initiated activities and explained that it expected this portal would be rolled-out towards the end of November.
    Under other business, the United States provided an update on proposed guidelines for submission of questions and answers under Articles 25.8 and 25.9 of the SCM Agreement, previously submitted by Australia, Canada, the European Union, Japan, the United Kingdom, and the United States, and discussed at the Committee’s regular meeting in April 2024.
    The Committee also adopted its 2024 annual report to the CTG.
    Next meeting
    The spring and autumn 2025 meetings of the SCM Committee are scheduled to take place in the weeks of 28 April and 27 October 2025, respectively.

    WASHINGTON, DC – Today, U.S. Senator Jacky Rosen (D-NV) voted against confirming South Dakota Governor Kristi Noem as the next Secretary of Homeland Security. Senator Rosen met with Governor Noem earlier this month and strongly opposed the Trump Administration’s plans to carry out mass deportations. She also emphasized the importance of protecting Deferred Action for Childhood Arrivals (DACA) and Temporary Protected Status (TPS) recipients.
    “Nevada is the proud home of countless law-abiding immigrants looking for a better future and making contributions to our state and our economy. We also have thousands of DACA and TPS recipients who deserve a permanent solution that provides them peace of mind and a pathway to citizenship,” said Senator Rosen. “The Trump Administration has already taken shameful actions to try to eliminate automatic citizenship of children born here to immigrant parents, target sensitive locations like schools and churches, and start to carry out mass deportations. I voted against Kristi Noem for Secretary of Homeland Security because I believe she will take actions that will hurt families in my state. I’ll keep fighting back against the Trump Administration’s actions that negatively impact Nevadans.”
    Senator Rosen has been outspoken in her opposition to mass deportation, and her strong support for DACA and TPS recipients and their families. Earlier this year, she applauded the extension of TPS status for immigrants from El Salvador and Venezuela, after calling on the Biden Administration to continue to protect displaced Salvadorans. She has also raised concerns over the significant application delays impacting DACA recipients, and gave a floor speech urging her Senate colleagues to take immediate action to permanently protect Dreamers, while simultaneously continuing to work to pass comprehensive immigration reform that provides a pathway to citizenship.

  • MIL-Evening Report: Politics with Michelle Grattan: Bruce Wolpe says personal relations between Trump and Albanese would be ‘rocky’

    Days from the US presidential election, the polls are showing the outcome of the race between Kamala Harris and Donald Trump remains a nail biter.

    With the United States our closest ally, the result could have potential implications for Australia in areas such as climate change policy, defence and the economy. If there is a Trump victory, Prime Minister Anthony Albanese will also have the challenge of building a relationship with an unpredictable character.

    To discuss the state of the contest and what comes next, we’re joined by Bruce Wolpe, senior fellow at the United States Studies Centre at the University of Sydney. Wolpe worked with the Democrats in Congress, and on the staff of Julia Gillard. Last year, he authored the book, Trump’s Australia.

    Wolpe regards the election as too close to call.

    They’re just deadlocked in two fundamental respects. National head-to-head across the country – the popular vote – they’re 49-48, 47-47, no one cracking 50, and there’s no clear favourite. And then that same pattern exists in all of the seven swing states that will decide the election per the Electoral College.

    In terms of key issues:

    Just as it is here in Australia, hip pocket is the strongest determinant of how you will vote, and so inflation and the state of the economy, in the lived experience, is the number one issue. Americans and Australians share the same experience over the past post-COVID years where there’s been an outbreak of inflation and high interest rates. And that means that the basket of goods that you buy day in, day out, week in, week out, from the supermarket to your petrol to your insurance prices are up between 10 and 40%.

    The second big issue is immigration. As I’m sure you know from looking at the news over the past three years, just following things, the southern border with Mexico has been effectively out of control. It’s back under control but in that time, perhaps millions of people have flowed into the United States.

    The third big issue is abortion rights, reproductive health rights and its future. The Supreme Court two years ago repealed Roe v Wade, which established a right found in the Constitution for women to take care of their reproductive health services. That’s the first time that a universal human constitutional right has been repealed since Dred Scott in the Civil War [denying slaves’ rights]. Three generations of women have grown up with the protections for them.

    This has become a very powerful issue. And 52% of all voters are women.

    On what either a Harris or a Trump administration might look like for Australia:

    I think with Harris, we would just see very strong continuity with Biden. I mean, on foreign policy issues, they really have worked together.

    The relationship with Australia is fine. Her relationship with the Prime Minister is absolutely fine. They know each other, can work together, a very comfortable working relationship.

    [As to] Trump and Australia: first, I really have to say in the first [Trump] term, I think Australia had the most untroubled relationship with Trump than any other country in the world, and that includes Israel, that includes Europe, that includes Canada.

    There is a structural trade surplus that the United States has with Australia. So Australia is not number one on the hit list of nations that are, quote, taking advantage of the United States in their trade agreements. […] It will start off in Trump’s head with all the countries that he wants to go after – I don’t think Australia is high on the list.

    However, on a personal level, Wolpe says there might be some issues between Trump and Albanese:

    I think personally it will be rocky at the start for several reasons. First, Trump will be briefed on everything that the Prime Minister has said on him and his presidency. And he attacked Trump for the January 6th insurrection. He’s for abortion rights and attacked the ruling of the Supreme Court. He’s for gun control, and Australia has a completely different posture on gun control, and Trump is strong on the Second Amendment. If Trump looks at the agenda of the Albanese government, it is a mirror image of Joe Biden’s domestic policy agenda adjusted for realities in both countries. But it’s the same deal.

    Every year, half of the world’s children are subjected to various forms of violence. On 7–8 November, the first global ministerial conference on this topic will be held in Colombia’s capital, Bogotá. The Swedish Government is co-hosting the conference, together with the Government of Colombia, the World Health Organization, UNICEF and the UN Special Representative of the Secretary-General on Violence Against Children.

    Eradicating violence against children is one of the interim Sustainable Development Goals of the 2030 Agenda. It is now six years to the target deadline. The aim of the Global Ministerial Conference on Ending Violence against Children is to highlight the issue on the global agenda and accelerate efforts to end violence against children. Ministers from all over the world will convene at the conference to discuss how countries can take joint action, share best practices and formulate new and ambitious goals to end violence against children.

    “All children have the right to a life free from all forms of violence. Unfortunately for many children and young people, the reality is different. I hope that this conference will be a catalyst for addressing violence against children and raising the issue higher up on the global political agenda. Furthermore, I look forward to sharing Swedish experiences as well as learning and get inspired by concrete success factors, from both the conference and planned study visits in Colombia. For example, how to protect children from online violence, strengthen child and youth care and combat the recruitment of children and young people into criminal gangs,” says Minister for Social Services Camilla Waltersson Grönvall.

    Sweden has long been a role model regarding children’s rights. As a country, Sweden has made considerable progress in areas such as child protection, education, and social care, and was the first country in the world to introduce a ban on corporal punishment of children in 1979. Sweden also has a strong civil society and research environments that help to promote the rights of the child, and has been prominent in implementing legislation which puts the best interest of the child at the centre. By sharing experiences with other countries and spreading knowledge about Sweden’s strong tradition of protecting children’s rights, Sweden can drive international change, so that every child, no matter where they live, can live in safety and with their rights respected and protected. 

    Conference discussion topics will include corporal punishment, online violence, health, education, parental support, recruitment to criminal gangs, and sexual violence.
