    Major Hurricane Milton is expected to make landfall in Florida, bringing with it devastating storm surge, winds, and inland flooding. The Seminole Tribe of Florida should have access to the federal resources required for emergency response and recovery preparations on tribal lands.
    U.S. Senators Marco Rubio (R-FL) and Rick Scott (R-FL) sent a letter to President Joe Biden urging his immediate approval of the Seminole Tribe of Florida’s request for a pre-landfall emergency declaration.

  • MIL-OSI USA: Gillibrand Holds Roundtable With Veterans To Discuss Bipartisan Legislation That Would Address Epidemic Of Traumatic Brain Injuries In Service Members and Veterans

    Following a disturbing report showing that service members are sustaining crippling traumatic brain injuries as a result of firing their own weapons, U.S. Senator Kirsten Gillibrand held a roundtable with veterans at VFW Post No. 9587 in Staten Island to discuss the her Blast Overpressure Safety Act, legislation to address traumatic brain injuries among service members and veterans. Service members who regularly fire heavy weapons are at increased risk of brain injury as a result of repeated exposure to explosions or blasts from their own weapons and explosives – otherwise known as blast overpressure. These brain injuries can cause depression, anxiety, cognitive problems, hallucinations, panic attacks, violent outbursts, suicidal tendencies, psychiatric disorders, dementia, and a variety of other serious health problems. At least a dozen Navy SEALs who have died by suicide over the past decade were later found to have suffered blast injuries, and many more service members have complained of health issues after blast exposure. Despite this, the Pentagon has struggled to properly investigate the impact of blast overpressure, effectively track the prevalence of blast overpressure-related injuries, or offer appropriate care to service members and veterans. Gillibrand is calling for more research and better treatment for those affected.
    Gillibrand was joined by New York State Senator Jessica Scarcella-Spanton and local veterans.
    “After repeatedly being exposed to blasts from their own weapons during both training and combat, our service members are sustaining severe and crippling brain trauma,” said Senator Gillibrand. “This bill will require the DoD to investigate the prevalence and causes of these brain injuries; to track each service member’s exposure to blasts; and to help service members access care. This is a critical bill and I look forward to getting it passed in the NDAA.” 
    “I want to thank Senator Gillibrand for joining us here on Staten Island for this veteran’s roundtable,” said State Senator Jessica Scarcella-Spanton. “It’s always an honor to meet with our veterans and discuss these important issues affecting them and their families.     Specifically, the Blast Overpressure Safety Act would: 
    Mandate regular neurocognitive assessments over a service member’s career, including a baseline neurocognitive assessment before training. 
    Create blast overpressure exposure and TBI logs for all service members.
    Increase transparency regarding blast overpressure safety in the weapons acquisition process. DoD must consider the minimization of blast overpressure during the acquisition process, require contracting entities to provide blast overpressure safety data, and publish blast overpressure safety data for weapons systems and its plans to better protect service members from in-use weapons systems. 
    Improve data on concussive and subconcussive brain injuries service members sustain. This includes information on discharges related to and medical providers trained in these injuries, as well as efforts with allies and partners to better address these injuries. 
    Enhance efforts to mitigate exposure and help service members access care. This includes retaliation protections for those who seek care; modifying existing weapons system to reduce blast exposure; updating and making publicly available blast overpressure thresholds and creating a waiver system for exceeding these thresholds; training high-risk service members to help them recognize exposure symptoms and creating strategies to mitigate their risk; and expanding the types of technologies in the Warfighter Brain Health Initiative pilot blast monitoring program. 
    Support service member treatment by establishing a Special Operations Comprehensive Brain Health and Trauma program, making the National Intrepid Center of Excellence (NICoE) a program of record and requiring DoD to provide childcare services to those seeking treatment there, and mandating training for medical and training personnel on blast overpressure and exposure and TBI.

    The Biden-Harris Administration continues to mobilize a whole-of-government effort to prepare for the impacts of Hurricane Milton, including pre-positioning resources and personnel and expediting debris removal efforts in Florida. These actions supplement the ongoing response and recovery efforts to the impacts of Hurricane Helene across the Southeast and Appalachia.
    Today, President Biden was briefed by members of his Administration who are driving preparations for Hurricane Milton and recovery efforts for Hurricane Helene. The President directed his team to do everything possible to save lives and help communities before, during, and after these extreme weather events.
    The President urges everyone to be aware of the evacuation orders that are in effect in multiple Florida counties. Shelters are open, and evacuation assistance is available. If you are told to evacuate, do so immediately for your safety and that of your loved ones.     Yesterday, President Biden had calls with Florida Governor Ron DeSantis and Tampa Mayor Jane Castor to get firsthand reports on recovery efforts for Hurricane Helene and to discuss preparations for Hurricane Milton. The President also spoke with National Weather Service Director Ken Graham, who briefed the President in detail on the forecast and expected impacts of Hurricane Milton for the State of Florida. 
    At the direction of President Biden, FEMA Administrator Deanne Criswell was on the ground in Tampa, Florida, yesterday, where she met with local leaders to coordinate preparations ahead of Milton’s landfall.
    Yesterday, President Biden quickly approved the Governor of Florida’s request for a pre-landfall emergency declaration. Under an emergency declaration, FEMA provides direct Federal support to states for life-saving activities and other emergency protective measures, such as evacuation, sheltering, and search and rescue. Earlier today, the President also approved an emergency declaration request from the Chairman of the Seminole Tribe of Florida.
    The Administration has been in touch with officials from the State of Florida, as well as more than 60 local officials in cities and counties along the likely path of impact, to ensure needs are met in advance of the storm. The Administration has also been in touch with officials from the Seminole and Miccosukee Tribes. The Administration has also reached out to state officials in South Carolina and Georgia and will continue outreach efforts based on Hurricane Milton’s latest trajectory.
    FEMA has sufficient funding to both support the response to Hurricane Milton and continue to support the ongoing response to and recovery from Hurricane Helene– including funding to support first responders and provide immediate assistance to disaster survivors.
    Additional updates include:
    Pre-Staging Personnel and Resources
    FEMA is pre-staging a full slate of response capabilities in Florida and the region, including seven FEMA Incident Management Assistance Teams, eight FEMA Urban Search & Rescue and swift water rescue teams, three U.S. Coast Guard Swift Water Rescue teams, four Health Care System Assessment Teams, five Disaster Medical Assistance Teams and an Incident Management Team from the U.S. Department of Health and Human Services.
    Additional pre-staged capabilities include U.S Army Corps of Engineers temporary power teams, debris experts and a roofing team, U.S. Environmental Protection Agency debris removal and wastewater experts, and 300 ambulances. In addition, the U.S. Department of Defense is posturing and staging forces to support FEMA and state partners including helicopters for search-and-rescue operations and to enable movement of personnel, equipment and commodities; and High Water Vehicles.  
    FEMA has five incident staging bases with commodities including food and water. Right now, FEMA currently has 20 million meals and 40 million liters of water in the pipeline to deploy as needed to address ongoing Helene and Milton response efforts and can expand as needed.
    Protecting Public Health and Health Care Systems
    Today, U.S. Department of Health and Human Services (HHS) Secretary Xavier Becerra declared a Public Health Emergency for Florida to address the health impacts of Hurricane Milton, the second public health emergency declaration for the state to aid in a hurricane response within the past two weeks.
    The Department’s Administration for Strategic Preparedness and Response (ASPR) pre-positioned approximately 100 responders in Atlanta along with medical equipment and supplies to support the delivery of health care services in Florida following the landfall of Hurricane Milton. The deployed personnel include ASPR Health Care Situational Assessment Teams who stand ready to work with state officials to assess the storm’s impacts on hospitals, nursing homes, dialysis centers, and other health care facilities and a Disaster Medical Assistance Team (DMAT) from ASPR’s National Disaster Medical System (NDMS) for rapid response following health care assessments. A second DMAT is being pre-positioned in Atlanta to support additional response to either Hurricane Helene or Hurricane Milton, as needed.
    In addition to the assessment teams and disaster medical system personnel, ASPR deployed personnel from an Incident Management Team and Regional Emergency Coordinators who integrate with FEMA, state health authorities, and emergency response officials to anticipate and assist Florida in meeting public health and medical needs in the wake of the storm. Logisticians and security personnel are also pre-positioned to provide support. ASPR is prepared to facilitate Public Health Emergencies for Hurricane Milton upon request. ASPR has also supported the HHS emPOWER program, which is available to identify the number of Medicare beneficiaries in affected zips codes who rely on electricity-dependent durable medical equipment and certain healthcare services, such as dialysis, oxygen tank, or home health, to help anticipate, plan for, and respond to the needs of at-risk citizens in potentially impacted areas.
    Preparing for Impacts to Infrastructure
    The Department of Transportation is deploying a Federal Aviation Administration (FAA) Air Traffic Field Incident Response (FIR) team to Florida and pre-staging operations in Jacksonville to prepare support for any impacted towers and airports. The team will work with the state and local authorities and the Department of Defense within the established Emergency Operations Center. The Department of Transportation is also deploying the FAA Communication Support Team (CST), which plays a critical role in supporting communication restoration at impacted airports. Specifically, the CST will set up Starlink and Mobile Phone Bonding kits, which increase signal stability and data throughout the region. The FAA is placing aircraft on standby to transport personnel from various agencies, mobilize resources, and support damage assessments to infrastructure.
    In addition, similar to the approach on Hurricane Helene, the FAA will continue to closely coordinate with the Department of Defense, the Armed Services, including Active Duty and National Guard units, and State Emergency Operations Centers to support their use of drones to support response and recovery.  Drones can play a critical role in supporting search and rescue operations and damage assessments by providing real time video, imagery, and sensor capabilities in hard-to-reach places.       The Department of Transportation’s Federal Highway Administration is coordinating with the Florida Department of Transportation and monitoring the situation to be prepared to support.
    The Environmental Protection Agency is working closely with Federal, state, local, and Tribal partners to support water systems, prepare for debris management, and ensure facilities, including Superfund sites, maintain critical public health and environmental protections while they recover from Hurricane Helene and prepare for Hurricane Milton. The agency has personnel on the ground in regional and national operations centers who are continuing to respond to Hurricane Helene and are preparing to offer support, guidance, and assistance to the State of Florida and everyone in the new storm’s path.
    Additional Pre-Landfall Preparations
    The Department of the Interior’s U.S. Geological Survey (USGS) is deploying wave sensors at eight locations in Florida between Naples and Crystal River to measure the coastal waves caused by the storm. USGS Field crews are also installing one rapid-deployment gauge on the Sunshine Skyway bridge in St. Petersburg, Florida. This specialized piece of equipment is a fully-functional streamgage designed to be deployed quickly and temporarily to measure and transmit real-time water level data in emergency situations. This data can be used by decision makers and emergency managers to monitor water levels as they work to save lives and property.
    The Department of Energy’s Energy Response Organization remains activated to respond to storm impacts. Via the Electricity Sub-Sector Coordinating Council and Oil and Natural Gas Sub-Sector Coordinating Council, the Department of Energy has been coordinating continuously with energy sector partners on both the ongoing Hurricane Helene response and potential impacts from Hurricane Milton.
    The U.S. Department of Housing and Urban Development (HUD) has notified local public housing authorities and owners of its assisted multifamily and heath care properties within the State of Florida to immediately implement all appropriate safety protocols for residents and workers. HUD is committed to ensuring that residents of its assisted homes and properties receive critical information that can save lives during extreme weather events. HUD is also conducting outreach and communications on the programmatic flexibilities and waivers that can be utilized to assist communities and survivors.
    The Export-Import Bank of the United States (EXIM) announced it is extending measures to assist customers, U.S. exporters, and financial institutions impacted by Hurricane Helene and forecasted to be impacted by Hurricane Milton. EXIM is offering assistance to allow businesses and financial institutions that participate in EXIM’s programs to return to their business concerns when appropriate and without penalty due to missed deadlines or other timeliness issues.

    WASHINGTON – Yesterday, U.S. Senator Roger Wicker, R-Miss., the highest-ranking Republican on the Senate Armed Services Committee, joined “The Hugh Hewitt Show” program and discussed several national defense topics, including the October 7th Anniversary, China’s shocking growth in naval shipbuilding, and the Biden-Harris administration’s weak record on China.

    The interview follows Senator Wicker’s October 7th Anniversary statement which was released on Monday.

    On a Harris presidency & China policy: “If it’s any indication of how her party has done with their leader in the U.S. Senate, yes, it’s very much a concern [how Harris would do with China]. Every time we’ve wanted to spend a few extra dollars – a few percentage points of our huge economy – to defend ourselves, the Democrats say: “well, we won’t do that unless we can increase domestic spending, too.” So, it’s been like pulling teeth getting a few extra ships built.”

    On shipbuilding: “China has 200 times the Navy shipbuilding capacity we do. When you talk about [how] we need to increase the number of fighter jets, or submarines, or ships, some people say: “well, we don’t even have the industrial capacity. We don’t have enough manufacturing plants.” And of course, the answer to that is: let’s get some. We’re going to have to increase our national defense to keep us out of a war. The idea is to keep the peace by being so strong that nobody will take a chance on us.

    On a future DOD budget: “What we need to do – and what I’ve advocated – and what military experts past and present are saying is that we need to go back to Ronald Reagan’s ‘peace through strength.’ And that does involve about five percent of our economy used to get us ready to defend ourselves in a war…if we spend five percent of our gross domestic product on defending America, we can save hundreds of billions and trillions of dollars by staying out of a war…the last time our Senate Republicans met with President Trump, he was very clear that he shared our determination to increase our Navy and get it back up to the point where we’re able to protect America and deter somebody from attacking us. So that was very much an encouraging statement from President Trump.”

    On Israel: “Remember this: the attack one year ago today was an attack on a civilian concert with Americans present and killed at the concert. 1,200 innocent civilians were killed in the most brutal way…there’s no way that after all the Israelis have encountered over 70 years and all the things the Jewish people have encountered over the centuries, there’s no way that Israel is going to give up its right to that tiny little piece of real estate in the Middle East. As a matter of fact, I think that Netanyahu is doing the world a favor by saying, ‘I’m going to totally eliminate these Iranian-backed terrorists – Hamas, the Houthis that are firing weapons on American ships, and Hezbollah, the largest terrorist group in Lebanon’…and I’ll tell you this: Lebanon will be far, far better off when and if Hezbollah is completely removed from their country.”

Ted Cruz (R-Texas) sent a letter to the Hormel Institute regarding its partnership with the Wuhan Institute of Virology (WIV) and financial resources secured for the Hormel Institute by Governor Tim Walz. The WIV has been credibly implicated as the point of origin of COVID-19 and conducts its activities under the auspices of the Chinese Communist Party.
    In the letter, Sen. Cruz wrote, “For over a decade, Governor Tim Walz has acted as one of the Institute’s most ardent supporters, securing millions of taxpayer dollars to fund its operations, including over $2 million in federal funding for technology acquisitions and a $5 million earmark to expand your Institute’s reach. The Governor’s support for the Hormel Institute has remained steadfast, continuing even after the FBI concluded on February 28, 2023 that COVID-19 pandemic likely originated from the WIV.
    “Governor Walz’s personal connections to China—his honeymoon there, over 30 trips, and public comments downplaying the strategic threat posed by the CCP13—only raise further questions about his motivations for promoting your institution. 
    “Your institute’s ongoing partnership with the Wuhan Institute of Virology, and by extension the People’s Liberation Army, reflects a troubling disregard for national security concerns…The American people deserve assurance that their resources and institutions are not inadvertently supporting the goals of our chief geopolitical adversary.”

    Dear Director Clarke:
    I write to you today with growing concern regarding the Hormel Institute’s longstanding partnership with China’s Wuhan Institute of Virology (WIV). 
    The WIV, as you are certainly aware, has been credibly implicated as the likely point of origin of the COVID-19 pandemic. Even more troubling are its direct ties to China’s People’s Liberation Army (PLA) and its involvement in classified military research including laboratory animal experiments under the auspices of the Chinese Communist Party (CCP) at least as recently as 2017. Despite these alarming connections which raise obvious national security concerns, the institute you lead has not only maintained its collaboration with WIV but it has done so with the backing of Minnesota’s top elected official. 
    For over a decade, Governor Tim Walz has acted as one of the Institute’s most ardent supporters, securing millions of taxpayer dollars to fund its operations, including over $2 million in federal funding for technology acquisitions and a $5 million earmark to expand your Institute’s reach. The Governor’s support for the Hormel Institute has remained steadfast, continuing even after the FBI concluded on February 28, 2023 that COVID-19 pandemic likely originated from the WIV.
    In recent years, researchers at the Hormel Institute have collaborated with the Wuhan Institute of Virology on a variety of projects, including a 2020 COVID-19 study and, as more recently as of 2024, on structural biology research.
    The COVID-19 study, titled “A dynamic regulatory interface on SARS-CoV-2 RNA polymerase,” was authored by four WIV researchers, three Hormel Institute researchers, and a Yale School of Medicine professor. Similarly, in January 2024, Hormel Institute researchers published a study on genes with the WIV’s Lina He, Wei Zhou, and Yangbo Hu. In 2023, WIV’s Yangbo Hu also worked with the Hormel Institute’s Dmytro Kompaniiets, Dong Wang, and Bin Liu on research titled “Structure and molecular mechanism of bacterial transcription activation,” among other collaborations. 
    Furthermore, the resignation of your predecessor, Dr. Zigang Dong, who served as Executive Director for nearly 18 years and resigned following an FBI investigation into his “possible failure to disclose foreign backing when applying for grants,” should have prompted a thorough reassessment of your institute’s engagements with foreign entities. Yet, despite this disconcerting event, Governor Walz continues to promote and direct public resources to your institute. Even after the U.S. government ceased funding to organizations working with the WIV, Governor Walz toured your facility and publicly praised its work.
    Governor Walz’s personal connections to China—his honeymoon there, over 30 trips, and public comments downplaying the strategic threat posed by the CCP—only raise further questions about his motivations for promoting your institution. 
    Additionally, in 2020, the Hormel Institute’s disclosure in a 2020 EMBO Journal Study that it received “help from the Core Facility and Technical Support” of the WIV for “radioactive and fluorescent tests” adds to the concern. Further raising suspicions is that Bin Liu, a professor at the Hormel Institute who worked on that 2020 EMBO Journal study, attended Wuhan University. Federal records indicate that the researchers for this particular study included those affiliated with the WIV, in addition to the University of Chinese Academy of Sciences and China’s Zhengzhou University. 
    In light of these recently-disclosed facts, it is critical to understand the full extent of your institute’s involvement in a partnership that risks benefitting our nation’s chief geopolitical adversary. Accordingly, for the purposes of oversight, I request that you respond to the following questions and requests by October 31, 2024: 
    1. How much public and private funding has the Hormel Institute received specifically for projects involving collaboration with the Wuhan Institute of Virology (WIV)? Please provide an itemized accounting of all such funding. 
    2. When did the Hormel Institute first initiate collaboration with the WIV, and what were the specific reasons for choosing to partner with a facility known to have ties to China’s People’s Liberation Army? 
    3. What actions has the Hormel Institute taken to ensure that its collaborative work with the WIV does not benefit China’s military or pose a risk to U.S. national security? 
    a. If no such actions were taken, what was the rationale behind this decision? 
    4. Given the WIV’s ties to China’s military, why has the Hormel Institute not publicly disclosed the full extent of its collaborations with the WIV? 
    a. If this information has been withheld, please explain why. 
    5. Please provide all internal documentation or communications related to the Hormel Institute’s partnerships with Chinese research facilities, including but not limited to the WIV. 
    6. What was the Institute’s reasoning behind continuing its collaboration with the WIV, even after serious concerns about the origins of COVID-19 and the lab’s military affiliations became widely known? 
    7. How can the American public trust that the Hormel Institute’s partnerships with the WIV are not inadvertently advancing China’s geopolitical goals, particularly in biotechnology and biomedical research? 
    8. Given the U.S. government’s cessation of funding to other nonprofits with ties to the WIV, what justifications does the Hormel Institute offer for continuing its relationship with the WIV? 
    9. Why did the Hormel Institute continue collaborating with the WIV after your predecessor, Dr. Zigang Dong, resigned amid an FBI investigation into his failure to disclose foreign funding when applying for grants? 
    10. The Hormel Institute’s work with the WIV includes research on gene structures and SARS-CoV-2 RNA polymerase. What measures have been taken to ensure that no sensitive intellectual property or technology has been transferred to China’s military-backed labs during these studies? If no measures were taken, why not? 
    11. Please provide any documentation or communications between the Hormel Institute and the Office of the Minnesota Governor regarding the Institute’s partnerships with Chinese research facilities, particularly the WIV. 
    Your institute’s ongoing partnership with the Wuhan Institute of Virology, and by extension the People’s Liberation Army, reflects a troubling disregard for national security concerns. The devastating impact of COVID-19 has highlighted the seriousness of these issues, as the pandemic has severely affected lives and economies worldwide.     DAYTON, OH – Today, U.S. Senator Sherrod Brown (D-OH) hosted the Propel Ohio 2024 Student Leadership Summit in Dayton. The one-day nonpartisan summit connects Ohio students at community colleges and technical schools, colleges, and universities and promotes student leadership. More than 250 students and 42 administrators from more than 51 Ohio community colleges, colleges, and universities are expected to attend this year’s summit.

    “I started the Propel Leadership Summit nearly a decade ago to bring together student leaders from around Ohio and help them make connections with each other and with leaders in public service, business, and nonprofits in our State,” said Brown.     WASHINGTON, D.C. – Today, U.S. Senator Sherrod Brown (D-OH) called on the Biden Administration to grant Ohio’s request to make Economic Injury Disaster Loans (EIDL) available to Youngstown businesses impacted by the downtown Realty Tower explosion on May 28, 2024.

    In a letter to U.S. Small Business Administration (SBA) Administrator Isabella Casillas Guzman and Associate Administrator Francisco Sánchez Jr., Brown detailed the impact of the explosion on local businesses and urged SBA to provide assistance. The letter follows an official request from the state that was submitted on Monday.

    “While downtown businesses have re-opened, many were significantly impacted and have requested help. Following the May explosion, I heard directly from businesses, workers, and residents who were negatively affected by the explosion. Business owners shared the economic challenges this emergency brought, and I urge you to answer their call for support,” Brown wrote.

    In July, Brown called on the Secretary of the Treasury and the IRS Commissioner to declare that relief payments Youngstown residents received from the Red Cross, the United Way, and Enbridge Gas in connection to the explosion be deemed tax exempt. Brown is pushing the IRS to declare the tragic explosion “of a catastrophic nature,” and qualify the payments as nontaxable. Earlier that week, Brown hosted a roundtable with government officials, businesses, workers and residents of downtown Youngstown who have been negatively affected by the May 28 Realty Tower Explosion. Brown and residents discussed the ongoing recovery efforts.

    I write to urge you to act swiftly on the request by Ohio Governor Mike DeWine for the Small Business Administration (SBA) to make Economic Injury Disaster Loans (EIDL) available to Youngstown businesses impacted by the downtown explosion on May 28, 2024. 

    The explosion resulted in one fatality, nine serious injuries, and massive property damage. In addition, the event displaced hundreds of residents from their homes, forced several businesses to close temporarily, and required the demolition of a historic building.

    While downtown businesses have re-opened, many were significantly impacted and have requested help. Following the May explosion, I heard directly from businesses, workers, and residents who were negatively affected by the explosion. Business owners shared the economic challenges this emergency brought, and I urge you to answer their call for support. In his request for SBA EIDL assistance, Governor DeWine has found that the sustained losses to businesses meet the threshold for SBA disaster assistance and that businesses are in need of financial assistance not otherwise available on reasonable terms.

    WASHINGTON, D.C. – Co-founders of the U.S. Senate Lead Task Force Cory Booker (D-NJ) and Tammy Duckworth (D-IL) and co-chairs of the U.S. House Get the Lead Out Caucus Lisa Blunt Rochester (D-DE-AL), Rashida Tlaib (D-MI-12) and Debbie Dingell (D-MI-06), along with U.S. Representative Barbara Lee (D-CA-12), today lauded the Environmental Protection Agency’s (EPA) decision to finalize the Biden Administration’s proposed Lead and Copper Rule Improvements (LCRI), which would lower the lead action level to better protect human health and require water systems to replace old and deteriorating lead pipes within a decade. In addition to the LCRI, the EPA also announced $2.6 billion in newly available drinking water infrastructure funding through the Bipartisan Infrastructure Law (BIL) to support lead-related activities, including lead pipe replacement projects.     The finalized rule also improves communication within communities so that families are better informed about the risk of lead in drinking water, the location of lead pipes and plans for replacing them. Exposure to lead is harmful to health, especially for young children. In children, low levels of exposure have been linked to damage to the nervous system, learning disabilities, shorter stature, impaired hearing and impaired formation and function of blood cells. 

    Last month, Booker called on the White House Office of Management and Budget (OMB) to expedite its review of LCRI.

  • MIL-OSI USA: Brown, Columbus Leaders Take on Predatory Investors That Drive Up Local Housing Prices

    COLUMBUS, OH – Today, U.S. Senator Sherrod Brown (D-OH) was joined by local leaders and community members in Columbus to call for passage of his Stop Predatory Investing Act, which would take away tax breaks for big investors that buy up large numbers of homes, driving up local housing prices. Brown, who serves as Chair of the Senate Banking, Housing, and Urban Affairs Committee, also toured a home being constructed for purchase by a Columbus homebuyer, not an investor. The Stop Predatory Investing Act would prohibit an investor who acquires 50 or more single-family rental homes from deducting interest or depreciation on those properties. Right now, two big Wall Street-backed investors own nearly 12,000 Ohio single-family homes in just three markets – including nearly 3,800 homes in Columbus. And the true extent of the problem is likely much larger, because other large investors, like private equity firms, that own homes throughout Ohio aren’t required to report how many homes they own.

    “In too many communities in Ohio, big investors funded by Wall Street are buying up homes and driving up prices. So many families who have worked for years saving to buy a house end up getting out-bid over and over by outside investors, and they can’t afford to compete,” said Brown. “We introduced the Stop Predatory Investing Act to fight back by striking right at the core of what makes this a profitable business venture for deep-pocketed investors: by taking away tax breaks they don’t need, we cut deep into their profit.”

    Brown was joined by Carlie Boos, Executive Director of the Affordable Housing Alliance of Central Ohio, Janene Parham, a realtor with Red 1 Realty and Co-Founder of Renew Homes Ohio, and Curtiss L. Williams, Sr., President and CEO of the Central Ohio Community Improvement Corporation.

    “It’s not a fair fight when these LLCs are offering to close on a home two hours after it shows up on a listing service, when they’re willing to pay cash, when they’re willing to buy as-is, no inspection, sight-unseen. Our homebuyers cannot go toe-to-toe with high-tech algorithms backed by an unlimited supply of cash. Thankfully, this is a problem that can be fixed. Most immediately, we can take away the incentives and tax breaks that make it more alluring to invest in a home than live in one. I want to thank Senator Brown, Curtiss Williams, and Janene Parham for their continued leadership in this effort,” said Carlie Boos.

    “As a realtor with over 25+ years and advocate for affordable housing. I have seen a lot of shifts of the market. This may be one of hardest, especially for buyers purchasing within the 180k –325k price range,” said Janene Parham. “Predatory Investment Corporation is having a negative effect on our housing market for buyers and renters in most vulnerable communities. Regulation has to happen now in order to stabilize and make home ownership affordable.”

    Private equity and other Wall Street-backed outside investors are a growing problem in Ohio housing markets, driving up local housing prices and pushing homeownership further out of reach for too many working families. In the second quarter of 2024, investors bought more than 14% of homes in Columbus according to Redfin. Large, out-of-state investors use technology and all-cash offers to outcompete individual buyers. And because investors often target the same types of affordable starter homes as first-time homebuyers, they deny families the opportunity to build wealth through homeownership.

    Brown has long fought to protect Ohio’s homeowners and renters from bad actors in the housing market and has fought to improve access to affordable homeownership. In July, Brown introduced the Housing Acquisitions Review and Transparency (HART) Act to increase competition in the housing market by requiring corporations and private equity firms that buy up large numbers of houses and apartments to report those transactions to antitrust enforcers. Brown has held hearings with Cleveland’s Director of Building and Housing Sally Martin and the Port of Greater Cincinnati Development Authority President and CEO Laura Brunner about the harm that investors have caused Ohio communities, renters, and aspiring homeowners. Brown also held a listening session where tenants from across the country described the harm they’d experienced renting from institutional investor landlords.

    Boston (October 8, 2024) – Senator Edward J. Markey (D-Mass.), a member of the Senate Environment and Public Works Committee, today joined Senator Elizabeth Warren (D-Mass.), Representative Bill Keating (MA-09), New Bedford Mayor Jon Mitchell, and local administrators and elected officials at a ribbon-cutting to celebrate the successful completion of the North Terminal expansion project, a maritime facility that will strengthen the Port’s competitiveness in fishing, offshore wind, and other industries. The expansion, which has created 630 linear feet of new bulkhead and 5.05 additional acres of terminal area, will support growing infrastructure needs of port users and ensure long-term economic growth for New Bedford and the South Coast region. With upgraded bulkheads, new berthing facilities, enhanced dredging, and expanded laydown space, North Terminal is designed to streamline logistics for businesses and facilitate future Port expansions. 

    The expansion of North Terminal is the latest piece of the modernization of the Port of New Bedford. Over the past ten years, the Port has seen the largest set of infrastructure upgrades in generations, which will top $1 billion upon completion.  

    “The Port of New Bedford is a triple threat: the number one fishing port by value in the nation, an innovator on offshore wind development, and a regional leader in maritime technology industries,” said Senator Markey. “This expanded infrastructure will be a game changer for New Bedford and beyond.     Senator Markey has secured funding for various projects for the Port of New Bedford. In 2018, Senator Markey led a letter of support for the Port of New Bedford and helped secured $15 million from the “Better Utilizing Investments to Leverage Development” (BUILD) grant to improve the infrastructure and environment.   

    In 2023, Senator Markey, Senator Warren, and Congressman Keating helped secure $24.4 million in Maritime Administration Port Infrastructure Development Program funding for the Leonard’s Wharf Extension project. Senators Markey and Warren also secured $4 million in FY24 Congressionally Directed Spending for New Bedford and Fairhaven Harbor for the US Army Corps of Engineers to dredge and repair damaged areas of the steel sector gates.

    New York, N.Y. – U.S. Senate Majority Leader Charles E. Schumer released the following statement on the removal of the Rochester Embayment from the U.S. Environmental Protection Agency’s list of the Great Lakes’ most environmentally degraded areas:
    “I was thrilled to lead the charge and secure $9.5 million in federal Great Lakes Restoration Initiative funding to finally rebuild the Braddock Bay barrier beach that Hurricane Agnes washed away in 1972 in the Town of Greece,” said Senator Charles Schumer. “In the four years since its reconstruction, Braddock Bay has been transformed from a pollution hotspot into a thriving area with healthy restored habitats for wildlife and improvements that returned tourism, boating, and recreation to the waterfront. The Braddock Bay restoration was the last of 14 major pollution- and ecologically-impaired hotspots along Rochester’s Lake Ontario and Genesee River embayment coastline – from Webster to Parma – that have now been cleaned up and restored thanks to federal GLRI funding. The water is cleaner, birds and fish are more abundant, beach closures are down, and the Rochester coastline can now be removed from the EPA’s list of ‘Areas of Concern.’ I fought to secure a historic $1 billion for the Great Lakes Restoration Initiative in the Bipartisan Infrastructure Law with moments like this in mind. Investing in the Great Lakes means investing in the future of New York, and I will always fight for funding so our community can enjoy the full natural beauty and economic energy of the wonderful communities along the Great Lakes.”
    Schumer has helped deliver nearly $14 million in federal funding through the federal Great Lakes Restoration Initiative (GLRI) to fund eight habitat restoration projects, including $9.5 million for the Braddock Bay restoration project. Thanks to those projects, 275 acres of habitat and 30,000 linear feet of wetland channeling have been restored to improve connectivity and biodiversity in the bay.
    Schumer has been a relentless champion for the Great Lakes, including securing a historic $1 billion – the largest ever single investment – in the Great Lakes Restoration Initiative (GLRI) as a part of the bipartisan Infrastructure Investment & Jobs Law. Since its inception in 2010, Schumer noted, the GLRI has had a significant impact on Upstate New York. Schumer has long been a champion for the Great Lakes, fighting off budget cuts to the GLRI in 2019 and working to secure a multimillion-dollar increase in authorization levels for the program in 2018.

    Washington, D.C. – Senator Roger Marshall, M.D. led a letter to the Cybersecurity and Infrastructure Security Agency (CISA) expressing concerns over the agency’s monitoring of online political speech leading up to the 2024 election cycle. In the letter, Senator Marshall and his colleagues warn that the agency’s actions risk First Amendment violations by censoring speech on popular social media and search engine platforms. The senators pointed to a similar effort by CISA during the 2020 election cycle that led to widespread censorship of American citizens. 
    “The First Amendment prohibits the government from ‘abridging freedom of speech’ and the Supreme Court has recognized that for ‘core political speech’ ‘the importance of First Amendment protections is at its zenith.’ In today’s world, ‘core political speech’ is often found on social media platforms. Instead of respecting these long-standing norms, CISA has in the past worked with partners to violate them, thus undermining trust in the agency for many Americans,” the senators wrote. “To quote the Supreme Court, ‘if there is a fixed star in our constitutional constellation, it is that no official, high or petty, can prescribe what shall be orthodox in politics, nationalism, religion, or other matters of opinion.’ This is why we are writing to discourage CISA from prescribing what is favored and disfavored speech going forward. Millions of Americans expect nothing less from their government,” the senators continued.
    Senator Marshall and his colleagues urged CISA to prioritize its core mission of protecting America’s critical cybersecurity infrastructure. The senators closed their letter by demanding CISA confirm it will not censor Americans’ online speech or collaborate with groups aiming to control online information or opinions.

    SHREVEPORT – This morning, U.S. Senator Bill Cassidy, M.D. (R-LA) hosted his second Rural Community Funding Summit of 2024, together with Minden Mayor Nick Cox, the Louisiana Municipal Association, the Police Jury Association of Louisiana, and LITACorp. Cassidy encouraged local officials in attendance to take advantage of his Infrastructure Investment and Jobs Act (IIJA), and the opportunities it provides.
    “When I was negotiating the bipartisan infrastructure bill, I was thinking of mayors, police jurors and city council members gaining access to dollars to build roads, fix water and sewage issues and extend high-speed broadband throughout Northwest Louisiana,” said Dr. Cassidy. “This summit completes the connection between appropriating our federal tax dollars back to our state and these community leaders learning how to use this money.”
    Webster Parish alone will benefit from over $17 million in the IIJA as of last summer, including over $9.2 million to build a new overpass over Louisiana Highway 531, along with other improvements near the overpass. Improvements will also be made to the stretch of Louisiana Highway 159 between Country Club Drive and Benson Road, and to the Minden and Springhill Airports.
    Representatives from numerous federal and state agencies, including the U.S. Department of Agriculture Rural Development and the Delta Regional Authority, were present. Cassidy was thanked for his efforts by Mayor Cox.

  • MIL-OSI USA: During Children’s Health Month, New Hampshire Congressional Delegation Applauds More Than $19 Million Headed to New Hampshire to Protect Children from Lead Poisoning

Specifically, the New Hampshire Housing Finance Authority is receiving $7.75 million, the City of Nashua is receiving $7.7 million and Sullivan County is receiving $4 million through the grant program.
    “Lead-based paint poses a serious health threat to children, and in states like New Hampshire where many of our neighborhoods have older housing stock, we must make every effort to protect families,” said Senator Shaheen. “This federal funding will help protect Granite State children from lead poisoning and exposure to other dangerous contaminants in their homes.”

    WASHINGTON – Yesterday, U.S. Senator Tommy Tuberville (R-AL) joined “Kudlow” on Fox Business Network with guest host David Asman to discuss the Biden-Harris administration’s slow FEMA response to victims of Hurricane Helene, amid reports of money being allocated to house illegal immigrants and Vice President Harris touting the administration’s move to send another $157 million to Lebanon.

    ON MAYORKAS CLAIMING FEMA IS OUT OF MONEY

    ASMAN: “Senator, thanks so much for being here. Appreciate it. You know, there’s a big question about whether the administration is contradicting itself now based on what they’ve said before about 1.) whether FEMA has enough money to deal with all these crises, these emergencies, and 2.) whether or not they waylaid a lot of that money for spending on migrants.”

    “So, it was pretty frank. He said, ‘We don’t have the funds to make it through the season.’ Now the question is, why? Senator, on the one hand, they’re saying this. On the other hand, they say exactly the opposite. I leave it to you now to try to figure out what’s going on here.”

    TUBERVILLE: “Well, our country is in a mess and we are in a mess. And this administration, David, has no clue what they’re doing. I’ve been in the Senate now for going on four years, and it’s been like this the entire time. Now, when it comes to spending money, they know how to do that, but they don’t know how to prepare for anything. Let’s go back to North Carolina. First of all, it’s not about money at North Carolina in the first few days. It’s about security. People on the ground like the military, helping find people that are stranded, opening up roads, doing the things to get communication into the area in North Carolina. They heard zero from FEMA for five or six days. It was a disaster. And it’s continued to be a disaster—more people still missing, but David, this administration—Mayorkas being the leader of this pack when it comes to some kind of security, whether it’s the border, or whether it’s FEMA—he’s never prepared. He always blames somebody else. Another blaming President Trump for all this is going on. These people know how to spend money, but that’s the only thing they know how to do. They can’t do anything other than just spend the taxpayers’ money, and they usually waste it when it comes to that.”

    ASMAN: “Well, and then they misappropriated. I mean, on the one hand, yes, you know, last week, [Karine] Jean-Pierre was saying that they haven’t used any money from FEMA for the migrants. But in 2022, she said very clearly funding is also available through FEMA’s emergency food and shelter program. That’s money that was going to the migrants. That’s money that the folks in Appalachia need right now.”

    TUBERVILLE: “Yeah. And we’ve all known that. They’ve been spending billions of dollars on the illegals coming across the border. Once they get here, they take care of them much more than they take care of our veterans or the homeless people living in this country. David, I was coming from Bogotá, Colombia, a few weeks ago, and half the plane was filled with Venezuelans and people from South America that our government and taxpayer money—they were flying people on those planes to Houston. It was a commercial airliner, and then they were going places from there. It is a disaster. It’s getting worse every day. But this group could care less. All they want [are] votes, David. They don’t want to take care of any American citizen. They want votes to get reelected to carry this power on for another four years and Heaven help us if that happens.”

    ASMAN: “And by the way, those folks that were on the plane with you haven’t been vetted. I mean, it’s quite clear that some of them—they just had to arrest, ICE just had to arrest some horrible people. They were child molesters from a bunch of different countries that were flown in and clearly, they hadn’t been vetted because if they had, they would have found out they had a horrible record from where they came from.”

    TUBERVILLE: “Exactly. And it’s gonna get worse before it gets better. Our prayers are out to the people of North Carolina, Georgia, South Carolina. But, David, let me tell you. I’ve lived in the South for all my life. I’ve been through hurricanes. I went through a terrible one in [Hurricane] Andrew back in ‘91 in Miami when I was coaching down there. There’s one coming named ‘Milton’ coming at Tampa. Right now, it’s a Category Five. It’s supposed to go down a little bit, but that usually never happens. The people of Tampa need to prepare to get out. Thank God, we have Governor DeSantis [who is] preparing for this because I promise you one thing, FEMA is nowhere to be found.”

    ON VP HARRIS BRAGGING ABOUT SENDING MONEY TO LEBANON

    ASMAN: “Well, meanwhile, while Mayorkas says we are running out of money for FEMA, Vice President Kamala Harris was bragging over the weekend about sending money to Lebanon of all places. She put out an X post saying, ‘I am concerned about the security and well-being of civilians suffering in Lebanon and will continue working to help meet the needs of all the civilians there.’ All the civilians there, what about the civilians here?”

    TUBERVILLE: “Well, this is for a longer conversation, David, but that’s a war there. Our friend and ally, Israel is fighting for their livelihood over there. And we’re funding both sides. We’re giving some money, some weapons to Israel, but now we’re sending money to Lebanon who they’re fighting. We continue to do this. We’re sending money to Hamas. We’re building ports for Hamas. We’re letting Iran run rampant in terms of making money to fund all this stuff. […] It is out of control. All they’re trying to do is sell the people in Michigan and some of these areas that have people from Islamic countries that, ‘Hey, we’re taking care of your people over there. Vote for us in four or five weeks. And we promise you, we’ll help you again.’ We care nothing about the American people, and it’s out of control and [I] hope the American people see what’s going on.”

    ON DEI STANDARDS IN FEMA

    ASMAN: “Senator, one more on FEMA for you. The chief of FEMA—a woman named ‘Deanne Criswell’—claims it’s disinformation to essentially tell the truth of what the administration including Mayorkas, including Jean-Pierre, have been saying about money being used from FEMA for migrants, etcetera. Now she’s the one who last year signed a pledge to, and I’m quoting here, ‘instill equity in disaster relief.’ Do you know what equity in disaster relief is?”

    TUBERVILLE: “Well, we probably could ask the ex-Secret Service Director who is the same way when she was all DEI—diversity, equity, and inclusion—in terms of the Secret Service. They almost got President Trump killed. Now the same thing here, people are dying because FEMA is worried more about diversity, equity, inclusion, and climate change than they are helping the people of North Carolina, South Carolina, and Georgia. Again, these people have no clue about organization and taking care of the people that they are being paid to take care for. So, they need to get off their tails and go to work. But, again, we’ve got another terrible tragedy getting ready to happen here in 36 hours. I hope they get their stuff together. If they need the money, we will pass it for them. But unfortunately, they’ve wasted $20 billion on these illegals coming in for four years, and that has created more disaster than anything else.”

    Rule places one-size-fits-all requirements on cities and states

    WASHINGTON – U.S. Senator Tommy Tuberville (R-AL) joined U.S. Senator Kevin Cramer (R-ND) in a bicameral amicus brief requesting the Appeals Court uphold the U.S. District Court decision that ruled the Biden-Harris administration’s final rule as illegal. The dysfunctional rule would impose one-size-fits-all requirements on how state departments of transportations (DOT) and cities report and measure greenhouse gas (GHG) emissions on the highway system. This rule requires cities and state DOTs to set declining targets for GHG emissions, which is a huge burden for rural states, like Alabama. However, the Federal Highway Administration (FHWA) appealed the decision, and it remains under further consideration.

    “Congress considered, and ultimately rejected, providing [FHWA] with the authority to issue a GHG performance measure regulation, but [FHWA] contorted ancillary existing authorities to impose one anyway,” the members argued. “In doing so, [FHWA] impermissibly usurped the Legislative Branch’s authority and promulgated the GHG performance measure without statutory authority delegated by Congress.

    “Put simply, when [FHWA] established a GHG performance measure regulation, it exceeded the powers Congress authorized. And it did so both at the expense of separation of powers and in violation of the Administrative Procedures Act,” continued the members. 

    The brief argues Congress debated and rejected granting FHWA the authority to issue GHG performance measure rules and the FHWA then intentionally misconstrued Congressional intent to justify its improper exercise of authority. It also argues the rulemaking is not consistent with recent Supreme Court decisions paring back Executive Branch overreach, and FHWA is bypassing principles of federalism to further its own policy agenda.

    BACKGROUND:

    In November 2023, the FHWA adopted a final rule that would impose burdensome GHG emissions performance measures on state departments of transportation and metropolitan planning organizations. This unnecessary rule will require state DOTs and metropolitan planning organizations to set declining targets for greenhouse gas emissions on the National Highway System. Many states, particularly rural states like Alabama, have criticized the proposal as an undue burden and impractical in areas where traffic congestion and emissions are already scarce. Furthermore, Congress has not provided the Department of Transportation (DOT) with any statutory authority to implement this proposal as the authority was intentionally struck from the Infrastructure Investment and Jobs Act (IIJA) before enactment by the Senate Environment and Public Works (EPW) Committee.

    In 2018, the Trump administration repealed an Obama administration 2017 FHWA rule after reconsidering the legal authority under which it was publicized. Unsurprisingly, the new FHWA rule resembles the 2017 Obama administration rule. A majority of state DOTs and attorneys general, including Alabama’s Attorney General, have raised concerns about the feasibility of the rule, which is another example of the Biden administration’s overreach that imposes unlawful burdens on the American people.

    Earlier this year, Senator Tuberville joined his colleagues in introducing a bicameral, bipartisan Congressional Review Act (CRA) Joint Resolution to nullify the rule. Following this effort, the Senate passed the CRA by a vote of 53-47 in April.

    WASHINGTON – The nonpartisan Congressional Budget Office (CBO) today estimated the Fiscal Year (FY) 2024 deficit was $1.8 trillion, double what the agency projected when the Biden-Harris administration took office. Senate Budget Committee Ranking Member Chuck Grassley (R-Iowa) issued the following statement on the need to reverse course.
    “President Biden and Vice President Harris have ignored resounding messages from Iowans and Americans nationwide, as well as alarms from global credit ratings companies. By consistently choosing a spendthrift agenda over fiscal sanity, this administration has hamstrung our economy for generations to come,” Grassley said. “Our nation needs a change of pace from the one this administration has set. Vice President Harris’ recent proposals, however, signal an unwillingness to meaningfully address Americans’ concerns and a readiness to double down on policies that have caused major consequences, like prices rising over 20 percent in less than four years.”
    Per CBO’s report, in FY 2024:
    The deficit totaled $1.8 trillion, up $139 billion from FY 2023 and double what CBO estimated when the Biden-Harris administration took office.
    Spending increased $617 billion (10 percent) from FY 2023, driven in part by costly executive actions and soaring interest payments.
    Net interest payments on the national debt totaled $950 billion, up $240 billion (34 percent) from FY 2023.  
    Background on the Biden-Harris Administration’s Irresponsible Economic Record:
    Moody’s Investors Service downgraded the U.S. credit outlook last year, citing the deficit as a key factor in its decision. Independent experts, such as the Federal Reserve Chairman and CBO Director, have warned that our nation is on an “unsustainable fiscal path.” Even so, the Biden-Harris administration plowed full steam ahead with trillion-dollar student loan bailout schemes and a $21 billion Medicare cost-shifting plan – an attempt to cover up negative effects the so-called Inflation “Reduction” Act is having on seniors, including hiking premiums and reducing plan options.
    Further, high borrowing costs and mounting federal debt have increased spending on net interest payments, which now exceed discretionary outlays for national defense. In early 2021, when interest rates sat at a record low, White House Office of Management and Budget (OMB) Director Shalanda Young claimed it would be a “historic missed opportunity” to forego borrowing trillions of dollars. Grassley last week called out OMB for neglecting to provide CBO with enough information to fully analyze the fiscal impacts of the Biden-Harris administration’s 2025 budget, despite committing to doing so.

    ALBUQUERQUE, N.M. — U.S. Senator Martin Heinrich (D-N.M.) and U.S. Representative Paul Tonko (D-N.Y.) introduced the Broadening Utilization of Proven and Effective Treatment for Recovery Act, or BUPE for Recovery Act, legislation to increase access to buprenorphine — a lifesaving drug used to treat opioid use disorder — by removing barriers providers and patients face when trying to access the medication.
    “New Mexicans know too well the heartache of losing a loved one to opioids. Enough is enough. We need an all-hands-on-deck approach to tackle this epidemic with the urgency it demands, which includes eliminating barriers that providers and patients face in accessing lifesaving medication,” said Heinrich. “My legislation aims to change reporting requirements for buprenorphine, ensuring that patients receive timely and effective treatment for opioid use disorder. This will help save lives and help New Mexicans get the care they need.”
    “For years, I’ve worked to address this disease of addiction and secure access to lifesaving treatments for the millions of Americans working to find and follow the path to recovery,” said Tonko. “A lynchpin of my efforts to address the opioid crisis is my MAT Act that eliminates outdated, bureaucratic barriers preventing practitioners from prescribing the proven treatment, buprenorphine, to their patients. Our newest bill, the BUPE for Recovery Act further strengthens our push to expand accessibility to this lifesaving drug.     The BUPE for Recovery Act temporarily exempts buprenorphine from the U.S. Drug Enforcement Administration’s (DEA) Suspicious Orders Report System (SORS) requirements during the opioid public health emergency. SORS reporting requirements have led to an uncertainty among pharmacies and distributors to stock and dispense buprenorphine, which can prevent individuals suffering from opioid use disorder from receiving timely and effective treatment. 
    This legislation will mitigate the treatment gap created by stringent SORS reporting requirements, reducing overdose deaths, saving lives, and improving public health outcomes.

    “Buprenorphine is a life saving medication proven to reduce the risk of overdose deaths in individuals with opioid use disorder. The American Medical Association urges that suspicious order reporting requirements not be triggered based upon orders for buprenorphine and their fulfillment, as buprenorphine has been approved by the FDA for opioid use disorder. If buprenorphine products remain in the Drug Enforcement Administration’s suspicious order reporting requirements, patients will continue to suffer.     Heinrich has continuously worked to make opioid use disorder treatments more readily available. 
    In the Fiscal Year 2025 (FY25) Commerce, Justice, Science, and Related Agencies (CJS)Appropriations Bill, Heinrich successfully included language directing the DEA to take further action to remove barriers to access for opioid use disorder medications such as buprenorphine. The inclusion of this language will assist local medical and mental health providers and make medications, including buprenorphine, more accessible to New Mexicans.

    “The charges brought against Nasir Ahmad Tawhedi in Oklahoma for plotting an Election Day terrorist attack on U.S. soil is a stark reminder that our nation continues to face threats from those who hate our freedom and want to do us harm. I’m grateful to the FBI, especially the Oklahoma FBI Field Office, and our local law enforcement agencies for their vigilance and dedication to protect our communities. Their swift action prevented what could have been a devastating attack.
    “Tawhedi is Afghan refugee with ties to ISIS. With the escalating conflict in Israel and across the Middle East, we must remain vigilant against terrorism here at home. Oklahomans know well that many of the Afghan refugees in our communities fought side by side with American troops against the terrorism that attacked our nation on 9/11 and destroyed the nation of Afghanistan.

    BLUEFIELD, W.Va. – Today, U.S. Senator Shelley Moore Capito (R-W.Va.), a leader on the Senate Appropriations and Environment and Public Works (EPW) Committees, made several stops in Bluefield, W.Va. to highlight funding projects she has supported, receive updates from community and local leaders, and present the Amelia Earhart Award to a local resident.
    To begin the day, Senator Capito met with community leaders to receive a briefing on the city’s funding awards and the regional impact of the recent storm. Following the briefing, Senator Capito toured the U.S. Route 52 modernization project – which she supported and made funding available through the Infrastructure Investment and Jobs Act.
    “As I was worked to craft the Infrastructure Investment and Jobs Act, I saw a generational opportunity to improve West Virginia’s surface transportation infrastructure. U.S. Route 52 is a crucial thoroughfare for Bluefield and these improvements will increase road safety and continue expanding economic opportunities in and around the city. I was proud to advocate for this project and I’m thrilled to see work underway,” Senator Capito said.
    “The funding Senator Capito helped secure for infrastructure projects in Bluefield represents generational change for not only our city, but all of Southern West Virginia.     The tour concluded at Bluefield State University (BSU) where Senator Capito met with leaders to discuss ongoing expansion projects at the university. In September, Senator Capito secured a Congressionally Directed Spending (CDS) award for BSU to expand its healthcare education facilities and curriculum. The funding, which is part of a broader investment in health care infrastructure and education across West Virginia, will bolster the university’s efforts to train the next generation of health care professionals in the region.
    “This new center at Bluefield State University will provide students with the tools and training they need to succeed in the medical field, while also helping to alleviate the healthcare workforce shortages we are seeing across the state and the country,” Senator Capito said. “Investing in medical education is one of the most important steps we can take to ensure that West Virginians have access to high-quality healthcare.”

    Heinrich secured $750,000 to redesign and improve technology at the Center helping first responders keep New Mexicans safe

    ALBUQUERQUE, N.M. — U.S. Senator Martin Heinrich (D-N.M.), a member of the Senate Appropriations Committee, toured the Bernalillo County Emergency Operations Center to see how the $750,000 he secured in Congressionally Directed Spending will make needed improvements and technology upgrades at the Center.

    “I’m proud to have secured funding to enhance the Bernalillo County Emergency Operations Center. These improvements will directly support our dedicated firefighters, law enforcement officers, and emergency medical responders who work tirelessly to safeguard the health and safety of all New Mexicans,” said Heinrich. “I will always fight to deliver the resources and tools our first responders need to do their vital, lifesaving work and keep New Mexicans safe.”

    During his visit, Heinrich was also briefed by Bernalillo County Fire Department Chief Greg Perez, Bernalillo County Emergency Management Director Thomas Walmsley, Bernalillo County Undersheriff Johan Jareno, and Bernalillo County Undersheriff Aaron Williamson on how the millions of dollars in federal investments Heinrich has secured have benefitted local fire and police departments, better equipping first responders with new tools needed to keep New Mexicans safe. 

    Background:

    In the Fiscal Year 2024 Appropriations Bill, Heinrich secured $750,000 for Bernalillo County to redesign the Bernalillo County Emergency Operations Center and upgrade the Center’s information technology systems and displays.  

    In addition to this investment, Heinrich cosponsored and secured passage of the Fire Grants and Safety Act, which has provided over $15.3 million to local fire departments in New Mexico. Specifically in Bernalillo County, this law has delivered: 

    • $2.4 million for Bernalillo County and its Fire and Rescue Department to recruit and retain firefighters. 
    • $1.6 million for Albuquerque and its Fire Department to recruit and retain firefighters, in addition to new resources needed to better respond to emergencies.  

    The Fire Grants and Safety Act, which was recently signed into law by President Joe Biden, reauthorizes two federal grant programs at the Federal Emergency Management Agency (FEMA). For a full list of investments from this program that have delivered funds across New Mexico, click here.

  • MIL-OSI USA: Crapo, Risch Join Effort to Protect Idaho Transportation Department from Federal Overreach

    Washington, D.C.–U.S. Senators Mike Crapo (R-Idaho) and Jim Risch (R-Idaho) joined a bicameral group of colleagues in filing an amicus brief requesting an Appeals Court uphold a District Court decision vacating a rule that would require local entities to regulate greenhouse gas (GHGs) emissions from cars and trucks.  

    In November 2023, the Federal Highway Administration (FHWA) adopted a final rule requiring state departments of transportation and metropolitan planning organizations to measure GHG emissions on the highway system and set declining targets.  The rule would hamstring the Idaho Transportation Department with costly and burdensome requirements that would divert limited funds for needed infrastructure improvements across the state to costly and expensive compliance measures by the federal government.

    Crapo and Risch joined a bipartisan Congressional Review Act joint resolution of disapproval to overturn the rule.  The resolution passed the Senate by a vote of 53 to 47 in April, reiterating Congress’s opposition to FHWA’s overreach

    Shortly after the rule was finalized, 21 state attorneys general filed litigation challenging the regulation.  The U.S. District Court found the Biden Administration rule to be illegal, but FHWA appealed the decision to the Sixth Circuit Court of Appeals and it remains under further consideration.

    The brief, led by Senators Kevin Cramer (R-North Dakota) and Shelley Moore Capito (R-West Virginia), argues Congress debated and rejected granting FHWA the authority to issue GHG performance measure rules and the FHWA then intentionally misconstrued Congressional intent to justify its improper exercise of authority.  It also argues the rulemaking is not consistent with recent Supreme Court decisions paring back Executive Branch overreach, and FHWA is bypassing principles of federalism to further its own policy agenda.

    “Congress considered, and ultimately rejected, providing [FHWA] with the authority to issue a GHG performance measure regulation, but [FHWA] contorted ancillary existing authorities to impose one anyway,” the members argued.  “In doing so, [FHWA] impermissibly usurped the Legislative Branch’s authority and promulgated the GHG performance measure without statutory authority delegated by Congress.”

    “Put simply, when [FHWA] established a GHG performance measure regulation, it exceeded the powers Congress authorized.  And it did so both at the expense of separation of powers and in violation of the Administrative Procedure Act,” continued the members.

    Washington, D.C. — Senator Ted Budd (R-NC) has joined a letter to Department of Health and Human Services (HHS) Secretary Xavier Becerra and Federal Emergency Management Agency (FEMA) Administrator Deanne Criswell urging that the Greensboro Influx Care Facility (ICF) be operationalized to assist in Western North Carolina’s recovery efforts from Hurricane Helene.
    The letter was led by Senator Thom Tillis and Rep. Richard Hudson and co-signed by Reps. Virginia Foxx, Chuck Edwards, David Rouzer, Dan Bishop, Greg Murphy, and Patrick McHenry.
    The letter reads, in part:
    “As you may know, Health and Human Services (HHS) currently operates GCC as an Influx Care Facility (ICF) meant to house and support unaccompanied alien children (UAC) in the case of an emergency. However, in June 2024, HHS’s Office of Refugee Resettlement (ORR) at the Administration for Children & Families (ACF) announced that GCC has “ramped down its operations to facility upkeep.”
    “Based on our understanding of this facility, we think that it could be incredibly useful in supporting the people of western North Carolina as the region recovers from Hurricane Helene. For example, GCC could be used to temporarily house those displaced by the storm or to serve as a staging area for aid workers stationed in the state.”
    “Our delegation is grateful for the work that has been done by your agencies so far to assist the people of North Carolina. However, much more can and should be done to expediently aid those whose lives have been upended by this storm. We believe operationalizing GCC for the purposes of aid and recovery is an effective way to do so.”

    Major Hurricane Milton is forecasted to potentially hinder or obstruct the Port of Tampa Bay, which receives more than 40 percent of Florida’s petroleum products. It’s crucial for the federal government to expedite all requested measures to protect Florida’s economy and to ensure a swift recovery. 
    U.S. Senators Marco Rubio (R-FL) and Rick Scott (R-FL) sent a letter to President Joe Biden urging the direction of federal agencies to expedite plans to respond to this potential obstruction. 
    “​With Hurricane Milton bearing down on Florida’s Gulf Coast, we request you direct federal agencies to expedite plans to respond to potential impediments or destruction of the Port of Tampa Bay and its associated federal channel. Long-term disruptions to the port would not only hinder disaster response and recovery, but have lasting consequences for Florida’s economy.”

    Dear Mr. President:
    ​With Hurricane Milton bearing down on Florida’s Gulf Coast, we request you direct federal agencies to expedite plans to respond to potential impediments or destruction of the Port of Tampa Bay and its associated federal channel.  Long-term disruptions to the port would not only hinder disaster response and recovery, but have lasting consequences for Florida’s economy. 
    ​As you may know, more than 40 percent of the volume of petroleum products consumed in Florida, including gasoline, diesel, and jet fuel, arrive through the Port of Tampa Bay, serving communities along the Gulf Coast and the I-4 Corridor. The port is also a major thoroughfare for aggregates and other construction materials that would be necessary for recovery and rebuilding efforts post-Hurricanes Helene and Milton. Due to the port’s location in Tampa Bay, the total length of the federal channels is approximately 70 miles, including portions that extend from the bay to beyond the barrier islands at the mouth of Tampa Bay.  This reality makes the channel susceptible to sand shoaling in normal conditions, but in severe hurricane conditions the port and channel could be otherwise obstructed by sediment and other storm debris.  The port’s location could also result in some of the most severe storm surge from Hurricane Milton impacting onshore facilities, including petroleum infrastructure.  Any extended disruptions to navigability of the federal or the operability of onshore petroleum infrastructure would have dire long-term consequences for the recovery of communities impacted by Helene and Milton as well as the Florida economy as a whole. Disruptions to the port would drive price increases and shortages of petroleum-based fuel products that could economically harm millions of Floridians.  
    ​To stave off long-term economic consequences that could be caused by impediments to navigation or the destruction of petroleum infrastructure at the Port of Tampa Bay, we urge you to expedite the finalization of plans to:
    Ensure U.S. Coast Guard and U.S. Army Corps of Engineers assets are in place to assess the federal channel for sediment shoaling and debris immediately following the storm;
    If needed, prepare to mobilize the Army Corps of Engineers for emergency dredging and construction operations to remove sediment from the federal channel and assist port tenants in rehabilitating onshore petroleum infrastructure as quickly as possible using natural disaster response emergency authorities; and
    Utilize waivers, as appropriate, to facilitate interstate deliveries of petroleum fuel products via truck, rail, and maritime modes of transportation.
    In the event that a worst case scenario occurs due to Hurricane Milton, preparation to accomplish these actions prior to landfall will aid in recovery.
