    “One year ago today, Hamas carried out a devastating surprise attack on Israel that took more than 1,200 innocent lives from many nations and subjected hundreds more to a year of captivity as hostages. Today, Annie and I pause to grieve all those whose lives were lost on October 7, in the year of fighting that has followed, and in the regional conflicts started by Iran and its proxies: Hezbollah, the Houthis, and the Shia militias. Hamas has been willing to draw Israel into a war on its terms, which has tragically resulted in tens of thousands of Palestinian civilian deaths. Israel has a right to exist in peace and to defend itself from attack, and the Palestinian people deserve a path to self-governance and to peace, as well. I still have hope that all sides can reach an agreement bringing an end to the fighting and securing the release of all the hostages still held within Gaza. Hamas struck a year ago today to prevent both Israel and the Palestinians from achieving regional peace and a resolution of their decades-old conflict, and we cannot let them win.”

    Senator Working to Establish UND as Leader in New Initiative, Coordinate with FAA on Site Visit to Ensure Timely Program Implementation
    GRAND FORKS, N.D. – Senator John Hoeven issued the following statement after the University of North Dakota (UND) submitted its application to the Federal Aviation Administration’s (FAA) Enhanced Air Traffic-Collegiate Training Initiative (AT-CTI) program. Hoeven has been working to secure the aviation school’s role in the new program, part of his broader efforts to address the air traffic controller (ATC) shortage. Specifically, this effort will allow UND’s ATC program graduates to move directly into the workforce rather than attending the FAA’s ATC Academy in Oklahoma:
    This builds upon UND’s current role as an AT-CTI program, which allows graduates to skip the first five weeks of initial qualification training at the FAA Academy.
    Under the enhanced program, UND will offer the same curriculum provided by the FAA Academy, making graduates immediately eligible for hire and to begin localized training at an air traffic facility.
    Graduates will still be required to pass the Air Traffic Skills Assessment (ATSA) exam and meet medical and security requirements.
    UND is aiming to start the Enhanced AT-CTI program in the spring 2025 semester, being one of the first schools in the nation to offer this opportunity to students.

    To advance UND’s application, Hoeven made the case to Transportation Secretary Pete Buttigieg and FAA Administrator Michael Whitaker for UND to lead the way in this initiative.
    The senator stressed the university’s position as a world leader in aviation research, education and training.
    This comes in addition to measures Hoeven worked to include in the FAA Reauthorization Bill passed by Congress earlier this year to improve ATC hiring and retention.

    With the application submitted, the FAA will begin the review process, which includes a site visit in Grand Forks in the coming months.
    The site visit will involve an inspection of UND’s classes, curriculum, equipment and other aspects essential to the Enhanced AT-CTI program.
    Hoeven’s office continues working with the FAA to coordinate these next steps in the application process.

    “Air traffic controllers are an essential part of our nation’s ability to provide safe, timely air service, and the ongoing labor shortages in this area constrain the operations of airports across the country. The good news is that we have a world-class aviation school at UND, which is primed and ready to tackle this demand for a qualified ATC workforce. As an existing AT-CTI school, UND is well-positioned to move into this new enhanced training initiative, which is a great opportunity for its students to get into the workforce more quickly, bypassing the need to go the ATC Academy in Oklahoma,” said Senator Hoeven. “That’s why we’ve been working to secure UND’s leadership in this program, having raised this priority with both the Transportation Secretary and the FAA Administrator. With the school’s application now submitted to the FAA, we continue our efforts to move this process forward, and ensure the site visit and all required steps are successfully completed in time to begin this program at UND in 2025.”

    Addressing the ATC Shortage
    The FAA reauthorization bill includes legislation Hoeven cosponsored that requires the FAA to use a more accurate staffing model developed by the National Air Traffic Controllers Association and the FAA’s Air Traffic Organization. The bill also sets an updated minimum hiring target for new air traffic controllers.

  • MIL-OSI USA: Durbin Files Amicus Brief In Support Of Illinois Interchange Fee Prohibition Act

    The amicus brief filed in the District Court for the Northern District of Illinois lays out the structure of the Durbin Amendment, which aligns with the recently enacted Illinois Interchange Fee Prohibition

    CHICAGO – U.S. Senate Majority Whip Dick Durbin (D-IL), Chair of the Senate Judiciary Committee and author of the Durbin Amendment, filed an amicus brief in the District Court for the Northern District of Illinois in support of the recently enacted Illinois Interchange Fee Prohibition Act (IFPA).  IFPA, which was signed into law on June 7th, bars the charging of interchange fees on the tax and tip portions of credit and debit card transactions.  Last month, the Illinois Bankers Association, along with the American Bankers Association, America’s Credit Unions, and the Illinois Credit Union League, filed a lawsuit, Illinois Bankers Association v. Raoul, claiming IFPA is preempted by federal law, including the 2010 Durbin Amendment.  The bankers’ motion for a preliminary injunction currently is pending before the court. 

    The amicus brief states, “Senator Durbin is uniquely positioned to offer an important perspective on the operation of the Durbin Amendment and how Illinois’ law aligns with it.  This perspective will help the Court decide the pending motion and resolve the case.”

    The amicus brief describes how IFPA is consistent with the Durbin Amendment’s intent.  The Durbin Amendment created a ceiling—not a uniform standard—for debit interchange fees that card networks like Visa and Mastercard were facilitating on behalf of financial institutions that issued their network-branded cards.  By imposing such constraints, the Durbin Amendment sought to reduce the billions of dollars per year in excessive debit interchange fees that were being charged to merchants and which were borne ultimately by consumers in the form of higher retail prices.

    The amicus brief continues, “The purpose of the Durbin Amendment was to rein in centrally-fixed debit interchange fees that had been insulated from competitive market forces and resulted in excessively high fees that burdened merchants and consumers.  The Durbin Amendment and its implementing Regulation II did so by establishing a fee maximum for any debit interchange fees that networks like Visa and Mastercard fixed on covered issuers’ behalf.  The IFPA aligns with the Durbin Amendment’s text, structure, and purpose.  Like the Durbin Amendment, the IFPA only applies to fees that are price-fixed by networks on behalf of issuers.  The IFPA defines the fees it regulates as fees ‘established, charged, or received by a payment card network for the purpose of compensating an issuer for its involvement in an electronic payment transaction’—a definition that closely aligns with the Durbin Amendment’s definition.”

    The amicus brief concludes, “In short, the IFPA is both consistent with the Durbin Amendment and consistent with sound policy that will help protect merchants and consumers from excessive and anti-competitive fees.

    In Congress, Durbin has made it a priority to protect consumers.  Durbin’s Credit Card Competition Act is bipartisan legislation that would enhance competition and choice in the credit card network market, which is currently dominated by the Visa-Mastercard duopoly.  It is estimated that businesses paid more than $100 billion in swipe fees on Visa- and Mastercard-branded cards in 2023 alone.

    Building off of debit card competition reforms enacted by Congress in 2010, the Credit Card Competition Act would direct the Federal Reserve to ensure that the largest credit card-issuing banks offer a choice of at least two networks, one of which must be a network other than Visa and Mastercard, over which an electronic credit transaction may be processed.

    Visa and Mastercard wield enormous market power in credit cards; according to the Federal Reserve, they account for nearly 576 million cards, or about 83 percent of general-purpose credit cards.  Visa’s and Mastercard’s market power and network structure have enabled them to impose fees on U.S. merchants that are among the world’s highest, charging more than $100 billion in U.S. merchant credit card fees in 2023. These fees include interchange fees which Visa and Mastercard require merchants to pay to issuing banks, as well as network fees that Visa and Mastercard require merchants to pay directly to them.  Consumers ultimately pay for all of these fees in the price of the goods and services they buy.

    Funding will improve the Confederated Tribes of the Umatilla Indian Reservation’s irrigation systems on the Walla Walla River

    Washington D.C. – U.S. Senators Ron Wyden and Jeff Merkley today announced a federal investment of $350,000 for the Confederated Tribes of the Umatilla Indian Reservation to make improvements that will reduce water losses in the Little Walla Walla Canal System. 

    “As we face an ever-deepening climate crisis, it’s vital to find efficient ways to conserve resources like water to help communities throughout Oregon thrive,” Wyden said. “I’m gratified that this investment from the Inflation Reduction Act will help the Confederated Tribes of the Umatilla continue their long tradition of environmentally sound, sustainable farming.”  

    “Indigenous peoples in the Pacific Northwest have been caretakers of our waterways since time immemorial,” said Merkley. “As climate chaos fuels longer and more intense droughts in Oregon and across the American West, we must find ways to improve water efficiency while protecting our waterways and the ecosystems they support. It is great news to see these funds supporting the Confederated Tribes of the Umatilla as they work with partners to improve the efficiency of the Little Walla Walla Canal System.” 

    This funding, from the Bureau of Reclamation’s Native American Affairs Technical Assistance Program, was provided through the Inflation Reduction Act to support Tribal efforts to develop, manage and protect water and related resources, and mitigate drought impacts and the loss of Tribal trust resources.  

    “Thanks to legislation recently passed in Oregon and Washington as part of the Walla Walla Water 2050 Plan, this water will be protected through Oregon, across the state line to the mouth of the Walla Walla River in Washington, and throughout the ceded lands of the Confederated Tribes of the Umatilla Indian Reservation, improving stream flows all the way to the Columbia River,” said  CTUIR Chairman Gary I. Burke. 

    “The Confederated Tribes of the Umatilla Indian Reservation are pleased to work collaboratively on this project with their partners at the Walla Walla River Irrigation District. By investing in aging infrastructure, this project will improve operations for the district, save water, and restore flows in the Walla Walla River for salmon and steelhead,” said Anton Chiono, CTUIR Department of Natural Resources Habitat Conservation Project Leader.

We cannot forget this day, nor can we forget the Americans and other hostages still held by Hamas – and we must do everything that we can to bring them home. I grieve with the families of the victims, the families of the hostages, and all of those who continue to be affected by the war.

    “In this same year, antisemitism has surged, in both word and deed, at home and abroad. As we mark this anniversary, Americans from across the political spectrum should stand united against hate, including antisemitism.

    Transfer of $350 million in federal funding secured by lawmakers to FHWA moves MassDOT further toward replacing the Sagamore Bridge
    Boston, MA – Continuing the momentum on replacing the Cape Cod Bridges, the Healey-Driscoll Administration signed a new Memorandum of Agreement (MOA) with the U.S. Department of the Army and the Federal Highway Administration (FHWA) to move forward on rebuilding the Sagamore Bridge. Senator Warren has led efforts to secure these funds for the Bourne and Sagamore Bridges, pressing the federal government to take action to replace these crucial pieces of infrastructure. 
    Under the agreement, the USACE will transfer $350 million in federal funding secured through the 2024 appropriations bills to the Federal Highway Administration. The FHWA Eastern Federal Lands Division will use the funds to construct a portion of the new Sagamore Bridge as part of MassDOT’s overall replacement project.
    The Sagamore Bridge is vital infrastructure supporting the economy of Cape Cod and surrounding communities and ensuring safe and reliable travel for residents, workers, and millions of annual visitors. The new MOA will help to further the current plan to begin construction on the Cape. The Sagamore Project is Phase 1 of the Cape Cod Bridges Program, rebuilding both the Sagamore and the Bourne Bridges while also making investments in other transportation infrastructure along the Cape Cod Canal and expanding travel options.  
    “We’re one step closer to replacing the Cape Cod Bridges—a decades-overdue project that will lift up the entire region,” said Senator Warren. “An investment this big is made possible only by teamwork, and it’s thanks to our strong federal, state, and local partnership that we were able to secure over $2 billion for the bridges. I’ll keep working closely with Senator Markey, Representative Keating, Governor Healey, and the delegation to get this crucial project to the next stage.”
    “We continue to make important progress in our efforts to rebuild both Cape Cod Bridges. After securing $1.72 billion in federal funding, we’re now moving forward with an agreement with the U.S. Department of the Army and the Federal Highway Administration that will allocate a crucial piece of that funding and allow us to begin construction on the Sagamore Bridge,” said Governor Maura Healey. “We’re grateful to our MassDOT team, as well as our Congressional delegation and federal partnerships for their continued partnership and commitment to delivering this project for the people of Massachusetts.” 
    The project will help to spur economic growth and development, improving safety and quality of life for both the region and state. This project is critical to the Cape Cod economy, and the bridge will be a connector to other assets on a local, state, and national level. 
    Senator Warren, Senator Markey, Congressman Keating, and the Massachusetts delegation secured a total of $1.72 billion in federal funding for the bridge replacement project. In July, MassDOT won $1 billion from the Bipartisan Infrastructure Law’s (BIL) Bridge Investment Program, and in December 2023, MassDOT won $372 million from the BIL’s Federal Multimodal Project Discretionary Grant Program. Senator Warren, along with the Massachusetts Delegation, secured $350 million for the bridges in the Fiscal Year 2024 Energy and Water Development Appropriations Act, which was signed by President Biden. Governor Healey has also pledged $700 million in state support. 
    “This project has always been about partnership, and we thank the Healey Administration, the Congressional delegation and the Biden-Harris Administration for their unwavering support and funding. We look forward to working with partners and stakeholders in the region to begin the next steps to making this project a reality,” said Massachusetts Transportation Secretary & CEO Monica Tibbits-Nutt. 
    Senator Warren has long advocated for federal investments in the Cape Cod Bridges project and other critical infrastructure projects across the Commonwealth: 
    In July 2024, Senator Warren, along with Senator Ed Markey, Rep. Bill Keating, and Governor Maura Healey, announced the U.S. Department of Transportation (DOT) had awarded the Massachusetts Department of Transportation (MassDOT) and Army Corps of Engineers a billion-dollar grant to replace the Cape Cod Bridges under the Bipartisan Infrastructure Law’s Bridge Investment Program.
    In March 2024, the entire Massachusetts congressional delegation sent a letter to U.S. Secretary of Transportation Pete Buttigieg, reaffirming their support for Massachusetts’ billion-dollar Bridge Investment Program (BIP) grant application to replace the Cape Cod Bridges, in light of the $350 million in funding from the FY 2024 funding package signed by President Biden and the U.S. Department of Transportation’s $372 million Mega grant.
    In March 2024, Senators Markey and Warren and Congressman Keatingsecured $350 million for the Cape Cod Bridges in the Fiscal Year 2024 Energy and Water Development Appropriations Act.
    In December 2023, following the advocacy of the delegation, the Department of Transportation awarded Massachusetts a $372 million grant through the Bipartisan Infrastructure Law’s National Infrastructure Project Assistance (MEGA) program toward the replacement of the Sagamore bridge. 
    In May 2023, Senators Warren and Markey and Representatives Keating and Seth Moulton (D-Mass.) sent a letter to Secretary of Defense Lloyd J. Austin III, urging him to exercise his authority to support installation resilience in order to provide funding for the replacement of the Bourne and Sagamore Bridges.
    In March 2023, Senators Warren and Markey announced and applauded the inclusion of $350 million, toward a commitment of $600 million, in President Biden’s budget for the Bourne and Sagamore bridges.

  • MIL-OSI USA: Warren, Dean Press CocaCola, PepsiCo, and General Mills on “Shrinkflation” Price Gouging and Tax Dodging

    Washington, D.C.  – U.S. Senator Elizabeth Warren (D-Mass.) and Representative Madeleine Dean (D-Pa.) wrote to the CEOs of Coca-Cola, PepsiCo, and General Mills, pressing their executives on the companies’ pattern of profiteering off consumers, both through “shrinkflation” and dodging taxes on the profits they made from that price gouging.
    All three of these companies have shrunk the size of their packaging to squeeze profits out of their customers, and then paid a very slim federal income tax on their billions of dollars in profits. In other words, the companies are sticking the American people with the bill twice over, with American families (1) paying higher prices for smaller packages of food, and (2) paying their taxes while big corporations like PepsiCo avoid chipping in their fair share to run our country.
    It is clear that these big companies are engaging in shrinkflation. In fact, reporting indicates that one of the key reasons that General Mills’ profits continue to grow is because they’ve shrunk some of their packaging. For example, the “Family Size” box of Cocoa Puffs went from 19.3 ounces to 18.1 ounces while charging the same price, at least initially. Similarly, PepsiCo replaced its 32 oz Gatorade bottle with a 28 oz bottle for the same price. And Coca-Cola has openly told its shareholders that it had “earn[ed] the right” to hike prices for consumers because of their company’s market power.
    “Shrinking the size of a product in order to gouge consumers on the price per ounce is not innovation, it is exploitation,” wrote the lawmakers. “Unfortunately, this price gouging is a widespread problem, with corporate profits driving over half of inflation.”
    While these companies continue to profit off consumers, the company is also turning around and paying less of those profits in taxes than the families it price gouges. 
    According to a recent report by the Institute for Taxation and Economic Policy, from 2018 to 2022, Coca-Cola made $13.4 billion but paid an average effective tax rate of just 13.5 percent, General Mills made $12 billion but paid an average effective tax rate of just 14.8 percent, and PepsiCo made $22.4 billion but paid an average effective tax rate of just 15 percent. These tax rates are even lower than the corporate tax rate that was reduced from 35 to 21 percent by President Trump and Congressional Republicans in 2017.
    “We strongly oppose these corporate tax giveaways, and have fought to pass tax increases on big corporations, including the 15 percent minimum tax on billion-dollar corporations,” wrote the lawmakers. “No corporation should pay a lower tax rate than working Americans – especially when that same corporation turns around and gouges consumers on the other end through shrinkflation.”
    As a champion for American consumers and a secure and healthy economy, Senator Warren has engaged in oversight of corporations for unfairly increasing prices for consumers. She has also been calling for more competition and stronger enforcement of antitrust laws to bring down prices for families: 

    On February 15, 2024, Senators Warren, Baldwin, Casey, and U.S. Representative Jan Schakowsky (D-Ill.) reintroduced the Price Gouging Prevention Act of 2024, which would protect consumers and prohibit corporate price gouging by authorizing the FTC and state attorneys general to enforce a federal ban against grossly excessive price increases. 

    In December 2023, Senator Warren urged the FTC to block the Kroger-Albertsons merger, which would give the five largest food retail companies control of 55 percent of all grocery sales, allowing them to further control and ultimately raise consumer prices, while also reducing job competition, decreasing wages, and decreasing the bargaining power of organized labor. 

    In November 2023, Senator Warren called out TransDigm for its refusal to provide cost and pricing information needed to prevent price gouging of taxpayers and the Department of Defense. 

    In November 2023, Senator Warren expressed disappointment at the FTC’s decision to allow pharmaceutical giant Amgen to move forward with its acquisition of Horizon Therapeutics (Horizon) given the potential impacts on the price of medicine.  

    In the past few years, Senator Warren has urged the Biden administration to closely scrutinize other potentially anticompetitive mergers that could lead to higher prices for consumers and accelerate industry consolidation. She has led letters about the proposed mergers of Frontier and Spirit airlines, JetBlue and Spirit Airlines, Sanderson-Wayne, WarnerMedia-Discovery, and Amazon-MGM.

    In March 2022, Senator Warren introduced the Prohibiting Anticompetitive Mergers Act to help stomp out rampant industry consolidation that allows companies to raise consumer prices and mistreat workers. The bill would ban the biggest, most anticompetitive mergers and give the Department of Justice and Federal Trade Commission the teeth to reject deals in the first instance without court orders and to break up harmful mergers. 

    In February 2022, at a hearing, Senator Warren called out corporations for abusing their market power to raise consumer prices and boost profits. 

    That same month, Senator Warren requested the Department of Justice to take aggressive action against corporations violating antitrust laws to hike prices for consumers. 

    In January 2022, Senator Warren questioned Federal Reserve nominee Lael Brainard about market concentration and price gouging driving inflation.

    At a January 2022 hearing, Senator Warren pressed Fed Chair Jerome Powell on the role of corporate concentration in driving up prices for consumers during his renomination hearing to be Chair of the Board of Governors of the Federal Reserve System.

    In a New York Times op-ed published in April 2020, Senator Warren urged Congress to focus on cracking down on price gouging in its ongoing effort to address the impact of the coronavirus pandemic. 

    In March 2020, Senator Warren joined her colleagues in urging the FTC to use its full authority to prevent abusive price gouging on consumer health products during the COVID-19 pandemic.

    WASHINGTON – Today, U.S. Senators John Hickenlooper and Michael Bennet welcomed over $1.6 million in federal funding from the Department of Veterans Affairs (VA) for eight Colorado organizations that offer adaptive sports, recreational activities, and equine therapy for veterans and service members living with disabilities. The funding comes from the VA’s’ Adaptive Sports Grant Program, which supports more opportunities for disabled veterans to play recreational sports and activities customized to better fit their needs. 
    “Adaptive sports give our wounded veterans a community and outlet for mental health,” said Hickenlooper. “This funding makes it easier for our disabled vets to hit the slopes and enjoy all the outdoor activities that make Colorado special.”
    “Our veterans have sacrificed so much to keep our country safe, and we owe them our support after they have served. Colorado veterans deserve to live a full and independent life, and this funding will help wounded heroes access athletics and other recreational activities,” said Bennet.
    “These grants give Veterans life-changing opportunities to participate in adaptive sports in the communities where they live all across the country,” said VA Secretary Denis McDonough. “We know adaptive sports and recreational activities can be transformational for Veterans living with disabilities, improving their overall physical and mental health, and also giving them important community with fellow heroes who served.”
    VA has awarded over $119 million in grants through the Adaptive Sports Grant Program during the last nine years. This program is one of VA’s many initiatives dedicated to improving the lives of those who have served.

    Young men and women who started their day at a music festival ended it with fresh scars of war.

    Denver — Colorado U.S. Senators Michael Bennet and John Hickenlooper, and U.S. Representatives Joe Neguse, Jason Crow, Brittany Pettersen, and Diana DeGette, wrote to the Bureau of Reclamation (BOR) in support of the Colorado River Water Conservation District’s (CRWCD) application for federal funding to purchase two of the oldest water rights on the Colorado River mainstem in Colorado, known as the Shoshone Permanency Project. The lawmakers offered their support as part of an ongoing BOR funding opportunity to provide environmental benefits in response to drought, which remains open for additional projects in Colorado and the rest of the Upper Colorado River Basin.
    “The Colorado River District’s mission is to promote the protection, conservation, use, and development of the water resources of the Colorado River water basin for the welfare of the state of Colorado,” wrote the lawmakers. “Preserving the Colorado River’s historical flow regime as intended by the Shoshone Permanency Project will benefit the Colorado River ecosystem every year, and especially in dry years.”
    The 1902 Senior and the 1929 Junior Shoshone Water Rights currently held by Xcel Energy are used to generate power at the Shoshone Power Plant and then return it to the river. Communities across Western Colorado have already committed over $55 million, and are applying to BOR for funding from the Upper Colorado River Basin Environmental Drought Mitigation program to help complete the purchase and create stability for communities, water and recreational users, and the environment. The Upper Colorado River Basin Environmental Drought Mitigation program funding opportunity is open for application through November 22, 2024, and the lawmakers welcome other applicants to contact their offices on the opportunity to provide support. 
    “This strong show of funding reflects the local recognition of the Shoshone Water Rights’ importance to the health of western Colorado’s environment and local economies,”continue the lawmakers. “We recognize the Shoshone Permanency Project’s complex nature and ongoing technical review, but believe the opportunity to protect historical Colorado River flows deserves your attention.”
    As part of the Shoshone Permanency Project, CRWCD will seek a change in these rights to include an alternate beneficial use and preserve the historical flow regime. The state process for changing these decreed water rights is distinct from any federal funding review or outcome, and will proceed separately. As acknowledged in the letter, data collection and analysis related to the Shoshone water rights’ historic use is ongoing and important to the state of Colorado’s formal review. 
    As the Chair of the Senate Agriculture Committee’s Subcommittee on Conservation, Climate, Forestry and Natural Resources, Bennet has consistently worked with his colleagues to help communities in Colorado and across the American West as they face the effects of climate change. In June 2022, as Subcommittee Chair, Bennet held the Senate’s very first hearing on Western drought. In June 2024, Bennet and Subcommittee Ranking Member U.S. Senator Roger Marshall (R-Kan.) held a field hearing in Burlington, Colorado, to hear from Western producers and agricultural leaders facing historic drought. 
    Bennet and Hickenlooper fought to include $8 billion for Western water infrastructure, $10 billion for forests, $19 billion for agricultural conservation, and $4 billion for drought in the Inflation Reduction Act (IRA) and Bipartisan Infrastructure Law. In September 2022, Bennet, Neguse, and Crow urged BOR to prioritize funding for long-term, permanent solutions to the Colorado River drought crisis as it worked to allocate the $4 billion for Western drought from the IRA. After calling on the Biden administration to make further investments to address long-term drought caused by climate change in April 2024, Bennet welcomed $400 million from the U.S. Department of Agriculture for investments at the irrigation district scale to address drought in August. As you know, the Inflation Reduction Act provided a historic $4 billion to address issues caused by drought, including activities to support environmental benefits, and ecosystem and habitat restoration. If selected, the River District will leverage Bucket 2E funding alongside significant state and local investment to purchase two of the oldest water rights on the Colorado River mainstem in the State of Colorado – the Shoshone Water Rights – to preserve their historical flow regime in perpetuity. 
    The River District was established in 1937 as a local governing entity to represent water users across 15 counties in Western Colorado – including the headwaters of the Yampa, White, Gunnison, and Colorado Rivers. The Colorado River District’s mission is to promote the protection, conservation, use, and development of the water resources of the Colorado River water basin for the welfare of the State of Colorado.
    Now, the River District is pursuing the Shoshone Permanency Project, which aims to preserve the historical Colorado River flow regime created by the 1902 Senior Shoshone Water Right and the 1929 Junior Shoshone Water Right (the “Shoshone Water Rights”). The River District has signed an agreement to purchase the Shoshone Water Rights from Xcel Energy, which currently holds the rights for its Shoshone hydropower plant. Today, the Shoshone Water Rights are decreed as non-consumptive water rights: the water is used to generate hydropower at the Shoshone Power Plant and is returned to the stream. The Shoshone Water Rights’ senior status “pulls” water to Glenwood Canyon, which ensures that water continues to flow and benefits the downstream environment. Preserving the Colorado River’s historical flow regime as intended by the Shoshone Permanency Project will benefit the Colorado River ecosystem every year, and especially in dry years.
    Data collection and analysis of Shoshone Water Rights’ historic use is not yet completed, and ongoing–a key step for understanding the historic flow regime on the Colorado River. The Shoshone Permanency Project seeks to change the water rights to include an alternate beneficial use for instream flow purposes, a legally recognized beneficial use in Colorado, to preserve the historical Shoshone flow regime. The proposed decree associated with these flows is still under technical review by the State of Colorado. The River District is actively discussing the proposal with other water users across the state. The Colorado Water Conservation Board and the State of Colorado Water Court will conduct a formal review in the coming months. Ongoing modeling will also help quantify the environmental benefits of the Shoshone Water Rights flows. One potential benefit is to the critical habitat of four fish in the Colorado River listed under the Endangered Species Act (ESA), known as the 15-Mile Reach, located near Palisade, Colorado.
    The State of Colorado and our water users are making their own significant investments to ensure that the historical Shoshone flows can continue in perpetuity. The Colorado River District has allocated $20 million, the State of Colorado has appropriated another $20 million for the acquisition, provided the State’s instream flow requirements are met, and a coalition of Western Slope water users and local governments have formally committed over $15 million. This strong show of funding reflects the local recognition of the Shoshone Water Rights’ importance to the health of western Colorado’s environment and local economies.
    We recognize the Shoshone Permanency Project’s complex nature and ongoing technical review, but believe the opportunity to protect historical Colorado River flows deserves your attention.     Background
    Ricketts has been a staunch supporter of Israel’s sovereignty, their right to defend themselves against Iran and its terrorist proxies, and Israel’s efforts to bring home the remaining hostages. 
    In the weeks following the October 7th attack, Rickettsintroduced legislation to enact a permanent ban on U.S. funding for United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA). Since October 7th, numerous reports have revealed UNRWA staff was directly involved in Hamas’ attack on Israel. The Stop Support for Hamas Act would:
    Cut off contributions for the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA), which has been described as “effectively a branch of Hamas;”
    Freeze Economic Support Funds (ESF) to Gaza and the West Bank until Israel has verifiably dismantled the terrorist infrastructure of Hamas and other terrorist groups in Gaza;
    Strengthen certification requirements under the Palestinian Anti-Terrorism Act of 2006 to ensure that no ministry, agency or instrumentality of the Palestinian Authority (PA) employs members, agents or affiliates of Hamas;
    Ensure any U.S. assistance to nongovernmental organizations (NGOs) operating in Gaza and the West Bank does not benefit Hamas or any other terrorist organization; and
    Strengthen Taylor Force Act provisions to prevent any U.S. funding that directly or indirectly benefits the PA until it ends its “pay for slay” program.

    Today marks one year since the horrific Hamas terrorist attack on Israel, which killed 1,200 innocent men, women, and children, and took some 250 hostages, including Americans, many of whom are still being held captive today. Yahya Sinwar and his Hamas accomplices are responsible for mass murder, the taking of hostages, and sexual violence. They are war criminals. Nobody should forgive or forget those atrocities, which began this war.
    Over the past year, I have met with many survivors of that attack and their relatives. It is difficult to comprehend the heartbreak they have experienced. Today, we should all remember those human stories and reflect on that human cost.
    We also cannot mark this date without considering what has happened in the year since the Hamas massacre.
    Israel clearly had a right to respond to the Hamas attack. But Prime Minister Benjamin Netanyahu’s extremist government has not simply waged war against Hamas. It has waged total war against the Palestinian people. More than 41,000 Palestinians have been killed and more than 96,000 wounded, sixty percent of whom are women, children, or elderly people. The Netanyahu government has destroyed much of the housing stock of Gaza, the civilian infrastructure, and the health care system. Every one of the 12 universities in Gaza have been bombed, and there are virtually no educational opportunities available for the many children there. Desperate families, with few belongings, have been displaced time and time again.
    Israel has blocked humanitarian aid, cutting off food, water, medical supplies. Severe restrictions remain in place. Humanitarian aid organizations describe the situation as a catastrophe, with many thousands of children facing malnutrition and starvation. These actions by the Netanyahu government have clearly violated U.S. and international law and made Israel less secure.
    Further, Netanyahu has consistently sabotaged efforts to obtain a ceasefire deal and secure the release of the hostages. Every time an agreement has appeared close, he has introduced new demands, sinking the deal and leaving the hostages and Palestinian civilians to continue their suffering.
    Since October 7th, this ongoing conflict and the horrific humanitarian crisis have been a daily torment. Today, as we remember those lost and continue to grapple with the horror of that day, we must re-dedicate ourselves to returning the hostages to their families, bringing about an immediate ceasefire, returning displaced people to their homes, and providing the massive humanitarian aid that the people of Gaza need.

They have faced vicious attacks since their founding in 1948, but in the past year the attacks have reached a level never seen in the last half century of Israel. Terror attacks on the streets, rockets and missiles from all four directions and innocent hostages in Gaza have tested Israel’s strength. But, Israel still stands. These despicable acts of violence, which resulted in the largest loss of Jewish life in a single day since the Holocaust, sadly continue with the brutal murder of six hostages just a few weeks ago and Iran’s recent missile attack. This resolution sends a strong message against all antisemitic acts and violence committed in support of such terrorist ideology.     “One year ago, at the end of Sukkot and the beginning of Simchat Torah, Hamas inflicted horrific violence in a sickening attack on Israel, brutally murdering nearly 1,200 Israelis and taking 251 hostages. Today and every day, we mourn the lives lost on October 7 and the suffering of civilians in Israel, Gaza, the West Bank, and Lebanon in the year since. It’s long past time for Israel and Hamas to reach a deal to release the hostages and establish a ceasefire in Gaza. It is in the best interest of U.S. and Israeli national security, as well as for the safety of U.S. servicemembers in the Middle East, that we urgently de-escalate tensions across the region and find a path back to peace—so the Israeli, Palestinian, and Lebanese people can live side by side as neighbors and with the safety and dignity they deserve.”
    Kaine has long supported Israel’s right to defend itself from Hamas, Iran, Hezbollah, and other actors who seek to harm Israel, while also protecting civilians in Gaza and the West Bank. He has repeatedly called for a deal to release hostages, establish a ceasefire, and increase humanitarian aid into Gaza.
