    Gotion Incorporated, a company with deep ties to the Chinese Communist Party, has developed a large industrial site near a U.S. military installation in Mecosta County, Michigan. The failure of the Committee on Foreign Investment in the United States (CFIUS) to investigate and block this development poses a serious threat to U.S. national security.
    U.S. Senator Marco Rubio (R-FL), U.S. Representative John Moolenaar (R-MI), and colleagues sent a letter to U.S. Department of Treasury Secretary Janet Yellen questioning CFIUS’s decision-making and urging an update of the committee’s rules.
    “We write to express our deep concern regarding the U.S. Department of the Treasury’s apparent failure to block Gotion Incorporated (Gotion)—an entity with deep ties to the Chinese Communist Party (CCP)—from developing a large industrial site near a major U.S. military installation.
    “Given CFIUS’ failure to launch a review of Gotion’s site development when the project was first publicly announced two years ago, it is now imperative that CFIUS update its proposed rulemaking to clarify the Committee’s ability to conduct retroactive reviews of covered greenfield investments that it previously failed to address.”
    Joining Rubio and Moolenaar were Senators Tom Cotton (R-AR), Mike Braun (R-IN) and Joni Ernst (R-IA), as well as Representatives Lisa McClain (R-MI), Bill Huizenga (R-MI), Jack Bergman (R-MI), John James (R-MI), and Tim Walberg (R-MI).
    Flashback… In September 2023, Rubio and Moolenaar sent a letter to Secretary Yellen urging CFIUS to review Gotion’s ownership.
    The full text of the letter is below. 
    Dear Secretary Yellen:
    We write to express our deep concern regarding the U.S. Department of the Treasury’s apparent failure to block Gotion Incorporated (Gotion)—an entity with deep ties to the Chinese Communist Party (CCP)—from developing a large industrial site near a major U.S. military installation. The scope of United States warfighting capabilities is extremely sensitive knowledge. We must only share this information selectively, exclusively, and knowingly with close allies and partners. Federal agencies have a duty to prevent America’s adversaries from obtaining information concerning our national defense personnel and assets. As we are sure you will agree, the Committee on Foreign Investment in the United States (CFIUS) plays a vital role in blocking foreign efforts to collect intelligence on our military via domestic investment.
    Unfortunately, CFIUS seems to have neglected a substantial foreign project constituting a major national security threat stemming from a major facility being constructed by Gotion. Gotion is the U.S. subsidiary of Gotion High-Tech, an electric vehicle (EV) battery company which is based in the People’s Republic of China (PRC) and has documented ties to the CCP. The House Select Committee on the CCP has routinely documented Gotion High-Tech’s notorious, widespread human rights abuses and use of forced labor in mainland China, in addition to its connection with Chinese paramilitary groups. Nonetheless, Gotion is currently constructing a $2.4 billion EV battery plant in Mecosta County, Michigan.
    In June 2023, Gotion announced that its plans for plant construction were outside of CFIUS’ jurisdiction, and could therefore continue the project. But as you know, as of February 13, 2020, CFIUS’ jurisdiction applies to greenfield investments when a foreign entity purchases real estate near certain sensitive military bases. Federal regulations define the extended range of a military installation as land within a 100-mile radius of the military installation (31 C.F.R. § 802.211). Covered installations include certain Army combat training centers within the continental United States (31 C.F.R. § 802.227(h)).
    According to CFIUS’ own Part 802 geographic reference tool, Gotion’s site in Michigan is located just under 60 miles south of the Camp Grayling Joint Maneuver Training Center—well within the regulation’s definition of extended range. Camp Grayling is the largest National Guard training facility in the United States, and is host to both the Northern Strike joint exercises and the National Guard Exportable Combat Training Center Exercises. Yet, despite Camp Grayling’s significance, and the overwhelming evidence that this facility meets CFIUS’ conditions for a sensitive military installation, CFIUS did not include the camp under its definition of covered real estate until its July 2024 proposed rule, “Definition of Military Installation and the List of Military Installations in Regulations Pertaining to Certain Transactions by Foreign Persons Involving Real Estate in the United States.”
    Given CFIUS’ failure to launch a review of Gotion’s site development when the project was first publicly announced two years ago, it is now imperative that CFIUS update its proposed rulemaking to clarify the Committee’s ability to conduct retroactive reviews of covered greenfield investments that it previously failed to address. This step is well within CFIUS’ authority under 50 U.S.C. 4565 §(b)(1)(D)(i). This common-sense measure would not only allow CFIUS to put a stop to Gotion’s continued nefarious activity, but also the activities of many other adversarial entities that have slipped under CFIUS’ radar and acquired land near sensitive military sites. CFIUS’ failure to retroactively review these transactions would constitute a major security blunder and permit the CCP to engage in intelligence gathering that compromises our military capabilities and readiness.
    Given the severity of what seems to be a grave lapse in CFIUS’ judgement, we request answers to the following questions:
    Why did CFIUS fail to designate Camp Grayling as an army combat training center under covered real estate until its July 2024 proposed rule?
    If Camp Grayling’s exclusion from covered real estate was a failure in oversight, what steps is CFIUS taking to rectify the situation?
    What action is CFIUS taking to stop Gotion from continuing its plant construction given its proximity to a major military installation?
    Will CFIUS commit to clarify its authority to conduct retroactive reviews of covered greenfield investments that have slipped under CFIUS’ radar?

  • MIL-OSI USA: SBA Stands Ready to Assist Alaska Businesses and Residents Affected by the Flooding

    SACRAMENTO, Calif. – Low-interest federal disaster loans are now available to Alaska businesses and residents as a result of President Biden’s major disaster declaration, U.S. Small Business Administration’s Administrator Isabella Casillas Guzman announced.

    The declaration covers the City and Borough of Juneau as a result of flooding that occurred Aug. 5–6.

    “SBA’s mission-driven team stands ready to help Alaska’s small businesses and residents impacted by flooding,” said Administrator Guzman. “We’re committed to providing federal disaster loans swiftly and efficiently, with a customer-centric approach to help businesses and communities recover and rebuild.”

    Businesses of all sizes and private nonprofit organizations may borrow up to $2 million to repair or replace damaged or destroyed real estate, machinery and equipment, inventory and other business assets. 

    For small businesses, small agricultural cooperatives, small businesses engaged in aquaculture and most private nonprofit organizations of any size, SBA offers Economic Injury Disaster Loans to help meet working capital needs caused by the disaster. Economic injury assistance is available to businesses regardless of any property damage.

    “SBA’s disaster loan program offers an important advantage–the chance to incorporate measures that can reduce the risk of future damage,” said Francisco Sánchez, Jr., associate administrator for the Office of Disaster Recovery and Resilience at the Small Business Administration. “Work with contractors and mitigation professionals to strengthen your property and take advantage of the opportunity to request additional SBA disaster loan funds for these proactive improvements.”

    Disaster loans up to $500,000 are available to homeowners to repair or replace damaged or destroyed real estate. Homeowners and renters are eligible for up to $100,000 to repair or replace damaged or destroyed personal property, including personal vehicles.

    Interest rates can be as low as 4 percent for businesses, 3.25 percent for private nonprofit organizations and 2.813 percent for homeowners and renters with terms up to 30 years. Loan amounts and terms are set by SBA and are based on each applicant’s financial condition.

    Interest does not begin to accrue until 12 months from the date of the first disaster loan disbursement. SBA disaster loan repayment begins 12 months from the date of the first disbursement.

    On October 15, 2024, it was announced that funds for the Disaster Loan Program have been fully expended. While no new loans can be issued until Congress appropriates additional funding, we remain committed to supporting disaster survivors. Applications will continue to be accepted and processed to ensure individuals and businesses are prepared to receive assistance once funding becomes available.

    Applicants are encouraged to submit their loan applications promptly for review in anticipation of future funding.

    As soon as Federal-State Disaster Recovery Centers open throughout the affected area, SBA will provide one-on-one assistance to disaster loan applicants.     An impressive crowd gathered as more than 12 fire trucks and partner emergency services paraded down the main street of town to mark Alexandra Fire Brigade’s 150th anniversary.

    On Saturday 12 October, the brigade celebrated the incredible milestone with the local community throughout the day and a dinner with more than 100 guests which included long-service medals.

    Alexandra Captain Chris Lynch said leading the brigade during this historic event was an honour and a privilege.

    “I don’t lead alone, I have an amazing team that joins me and without them, I am only one person,” Chris said.

    “A lot of work went into the event and it was a great day. This isn’t just about Alexandra’s 150th, this is the community being able to have a minute to look and see the people that support them in their time of need.”

    The brigade was formed in February 1874, with Captain Radford Huddle as officer in charge and around 20 members on board.

    A few months after the brigade was formed, the main street suffered significant fires with several buildings lost. The town had been hit with fires in the past, but reports indicate the formation of the fire brigade paid dividends, as the fire was contained. However, with every fire comes problems and Captain Huddle and three members resigned immediately after the incident.

    Training back in the day saw the firefighters don their new red uniforms before marching to the local racecourse, and while one member climbed a tree, others then had to source a continuous supply of water using buckets to get it to the top of the tree.

    Over the years the brigade became involved in the demonstrations, which was later known as the State Championships – where they went on to being quite successful, winning many trophies.

    The construction of a fire bell on a small tower in the main street was a major move forward to alert brigade members to fire calls. This historic bell still exists in front of the joint emergency services facility in Shamrock Street, Alexandra.

    The brigade acquired its first motor vehicle during the late 1930s, a Dodge, 4 cylinder, open cap, fitted with a bell. It was a hose carriage and firefighters transport vehicle only, which proved better than having to run a reel. This truck was replaced by an Austin Series 1 fitted with a Thompson front mounted pump around 1950.

    Alexandra Captain Chris Lynch said the brigade has been involved in numerous major fires over the decades.

    “The 2019/20 Black Summer fires stand out, our brigade spent time at the fires at Swift Creek,” Chris said.

    “Not long after I was voted in as Captain a few years ago, we responded to a fire at Maintongoon which ended up being one of the biggest fires for the season.”

    Chris joined CFA around 12 years ago and said it’s a great way to meet people, have community spirit and assist people in need.

    “Many people have come and gone over the years but it’s important to talk to the people who have been there before, learn from them and respect everybody’s opinion,” Chris said.

    “One of the most amazing things about Alexandra Fire Brigade is the members. We are such a diverse brigade, and we have the ability to do anything we put our minds to.

    “We also couldn’t do what we do without our Fire Equipment Maintenance (FEM) team and the auxiliary members who raise much needed funds for our brigade.”

    More than 30 service awards were presented during the brigade dinner including five members who received the prestigious 55 years of service.

    Dignitaries at the event included Cindy McLeish MP, Mayor Damien Gallagher, CFA Board Member Ross Coyle, Acting Assistant Chief Fire Officer Stephen Keating and Commander Paul Brislin.

    SACRAMENTO, Calif. – Francisco Sánchez Jr., associate administrator for the Office of Disaster Recovery and Resilience at the Small Business Administration, today announced the opening of its virtual Business Recovery Center to meet the needs of businesses and individuals who were affected by affected by the Watch Fire that occurred July 10-17.

    “When disasters strike, our virtual Business Recovery Centers are key to helping business owners and residents get back on their feet,” Sánchez said. “At these virtual centers, people can connect directly with our specialists to apply for disaster loans and learn about the full range of programs available to rebuild and move forward in their recovery journey.”

  • MIL-OSI China: Germany, China seek broader opportunies for bilateral cooperation

    Strong cooperation between Germany and China is vital for maintaining global economic stability, particularly amid rising geopolitical tensions, according to Christian Scharpf, mayor of Ingolstadt in southern Bavaria.

    Scharpf made the remarks during an interview with Xinhua at the “10th Bavarian China Day” here on Wednesday. The event, organized by the municipal government and the Chinese Consulate General in Munich, drew more than 120 officials and business leaders from both countries, underscoring the promising prospects for bilateral collaboration.

    This year marks the 10th anniversary of the comprehensive strategic partnership between China and Germany, which has delivered significant progress in trade and economic cooperation, said Lin Kai, acting consul general at the Chinese consulate in Munich.

    Highlighting the deep ties between China and the German state of Bavaria, Lin said that around 500 Chinese companies have established operations in Bavaria. Meanwhile, over 600 Bavarian enterprises, including Siemens, Audi, BMW, and Allianz, have set up branches and made investments in China.

    Tobias Gotthardt, state secretary at the Bavarian Ministry of Economic Affairs, Regional Development and Energy, said that China has been Bavaria’s most important trading partner for years, with bilateral trade volume reaching 53 billion euros (57.5 billion U.S. dollars) in 2023. Bavaria’s exports to China have remained strong, while imports from China have nearly doubled over the past three years, he added.

    Gotthardt stressed the importance of foreign trade for the state and Germany as a whole, noting that the Chinese market is indispensable.

    “Cooperation in areas such as mechanical engineering, automotive, and energy and environmental technologies has been built on a foundation of trust over many years,” said Gotthardt.

    He expressed optimism that this collaboration will continue to drive economic growth and address global challenges like sustainability. “We must remain focused on cooperation in areas where it is possible.”

    Yu Guangsheng, deputy head of the investment promotion at China’s Ministry of Commerce, mentioned that German investments in China reached an all-time high in the first half of this year, while Chinese investments in Germany surged by 42 percent year-on-year in 2023. “Companies from both countries are demonstrating their confidence in bilateral economic relations and partnerships through tangible investments,” he said.

    During the event, Ingolstadt and Changchun, a major city in northeast China, announced the establishment of a strategic economic partnership.

    Scharpf underscored the longstanding relationship between Ingolstadt, home to Audi’s headquarters, and Changchun, where China’s automotive giant FAW Group is based. He noted that economic and cultural exchanges between the two cities have been active for years, and expressed hope for even deeper cooperation in the future.

    The mayor voiced his belief that the two countries still have vast potential for collaboration, particularly in areas like climate protection, sustainable development, as well as education and cultural exchanges.

    Regarding the European Union’s (EU) recent tariff policy on electric vehicles from China, experts at the event criticized protectionism, and advocated for the promotion of free trade and mutual development between the EU and China.

    Gotthardt warned that the tariffs could escalate trade conflicts and undermine the principles of free trade. “A tariff-free alternative would undoubtedly be a better solution for all parties involved,” he said.

    Georg Rosenfeld, an economic official from Ingolstadt, echoed this sentiment, saying that protectionism and trade barriers are detrimental. He called for open and fair competition, as well as mutual trust which is essential to fostering such competition. (1 euro = 1.08 U.S. dollar)

    Detailed maps are now available to outline the 19 highway upgrades that will pave the way from the Port of Newcastle to the Central-West Orana Renewable Energy Zone (REZ).

    ‘Port to REZ’ upgrades will be funded by the Australian and NSW governments, with $128.5 million announced towards 320 kilometres of road upgrades and ancillary works.

    The upgrades will enable the transportation of wind turbines and other crucial components needed for wind and solar farms and the transmission network that connects them.

    The Energy Corporation of NSW (EnergyCo) and Transport for NSW are working together to deliver the improved roads, ensuring they can comfortably accommodate transportation of materials required, whilst also improving road safety for local communities.

    The 19 specific locations identified as pinch points are on the Golden Highway between the Port of Newcastle and Elong Elong, as well as a section of the Castlereagh Highway.

    German Chancellor Olaf Scholz on Thursday expressed his opposition to tariff conflicts while delivering a statement to the press in Brussels.

    Scholz stressed that such conflicts lead nowhere and emphasized the importance of using the World Trade Organization to resolve trade disputes.

    Speaking on the sidelines of the European Council meeting, Scholz reiterated his stance against escalating tariff tensions with China, a point he also made in a speech to the Bundestag, Germany’s lower house of parliament, the previous day.

    He noted that major German carmakers, along with 17 EU countries, oppose the imposition of tariffs on China.

    While highlighting the need for Germany to boost its competitiveness in the electric vehicle market, Scholz emphasized that this should not be achieved through tariffs.

    A comprehensive industrial system for China’s intelligent connected vehicle sector has basically taken shape, covering products and technologies such as basic chips, sensors, computing platforms and chassis control, Minister of Industry and Information Technology Jin Zhuanglong said Thursday.

    Jin made the remarks during the opening ceremony of the 2024 World Intelligent Connected Vehicles Conference in Beijing.

    China leads the world in human-machine interaction and is rapidly advancing toward breakthroughs in technologies like steer-by-wire and active suspension technologies, among others, the minister noted.

    According to him, the country’s intelligent connected vehicle sector currently boasts nearly 400 “little giant” firms, or novel elites of small and medium-sized enterprises that are engaged in manufacturing, specialize in a niche market and hold cutting-edge technologies.

    Five Chinese lidar companies have ranked among the global top ten in sales, while nine automotive manufacturers are piloting conditionally automated driving models, Jin said.

    To support such rapid industrial development, more than 50 cities in China have designated over 32,000 kilometers of test routes for intelligent connected vehicles and upgraded about 10,000 kilometers of roads with smart technologies.

    The 2024 World Intelligent Connected Vehicles Conference, running from Oct. 17 to 19, has attracted over 250 auto firms and institutions from home and abroad. More than 200 new technologies and products are expected to make their debut at the event.

  • MIL-OSI New Zealand: Drugs, firearms, cash and vehicles seized in Whanganui search warrants

    Police have seized drugs, firearms, cash, motorcycles and cars following raids at two properties in Whanganui last night.

    About 7.30pm, Police teams, including the Armed Offenders Squad, executed search warrants simultaneously in Victoria Avenue and in Springvale.

    A firearm was located and seized, along with 700g methamphetamine, three motorcycles, two vehicles and more than $30,000 in cash.

    A cannabis growing operation was also uncovered.

    One person was taken into custody during the warrants, and another has subsequently presented at Whanganui Police Station in relation to the offending. Both will face drugs and firearms charges and will appear in court at a later date.

    Detective Sergeant Craig Gorringe says the well-executed operation yielded a great result.

    “These individuals threaten public safety through illegal possession of a firearm and supply of drugs to vulnerable members of our community.

    “It’s always satisfying to take firearms and drugs out of the hands of offenders and hold them to account for the significant social harm they cause.

    “We want our communities to feel safe and be safe and we work hard to this end.”

    Police urge anyone who has concerns about criminal offending by gangs in their community to contact Police so this can be investigated.

  • MIL-OSI China: Tesla yet to receive regulatory green light for FSD in China

    Multiple sources told China Daily that Tesla Inc has yet to receive regulatory approval from Chinese authorities to launch its full self-driving or FSD functions in the country and is seeking permission to gather some data on its own to train its autonomous driving system.

    The United States vehicle maker announced last month on the social platform that it expected to launch FSD in China in the first quarter of 2025. “The rollout progress is not expected to mirror the speed as the company itself planned,” several sources close to the matter confirmed.

    They said that the proposal is still pending from various Chinese authorities to evaluate in an all-round way, including technology, data safety, laws and regulations, as well as other relevant standards.

    Though no official green light has been given as of now, the Chinese government will partially support its trial test of FSD functions in some cities, the sources day.

    As data security has been a key obstacle to a full rollout of FSD, two people close to Tesla said that Musk has proposed directly accessing some non-sensitive video data to train its autonomous driving system.

    He also proactively suggested that a dedicated government team could thoroughly assess this video data to ensure its security, one of the sources said.

    Other people acknowledged the matter and said that Chinese authorities didn’t give an immediate response to this request given the current rules and regulations.

    According to the regulations of the Ministry of Natural Resources, automakers and developers of autonomous driving software should either apply for mapping licenses or ask a licensed company to collect, store, transform and process geographic data.

    Currently, foreign firms lack the qualifications to independently gather geographic data and must partner with local entities.

    To comply, Tesla has stored all data collected by its Chinese vehicles in China since 2021 and is cooperating with local companies to collect data to support its driver assistant system.

    The NSW Government has approved the Albury to Illabo section of the 1,600-kilometre Inland Rail project between Brisbane and Melbourne.

    The Critical State Significant Infrastructure (CSSI) project has now been formally approved by the Minister for Planning and Public Spaces, Paul Scully. The approval means the project remains on target for the Australian Rail Track Corporation (ARTC) to begin construction in south-western NSW in early 2025.

    The work will include upgrades to rail tracks, footbridges and road bridges, overhead structures, signal structures and level crossings on agricultural land and through Albury, Culcairn, Henty, Yerong Creek, The Rock, Uranquinty, Wagga Wagga and Junee.

    The project’s approval, includes consent conditions that relate to traffic monitoring, transport infrastructure upgrades and noise and biodiversity management.

    Following the completion of the Inland Rail, Australia’s regional freight capacity will be expanded, meaning less trucks on the road and lower freight industry emissions.

    With a capital investment of $300.8 million for this section of the rail line, the project is a major economic boost for the region on top of the 770 new jobs provided by the project.

    The Albury to Illabo connection is one of seven sections traversing the inland length of NSW and its approval comes weeks after the Minister for Planning and Public Spaces approved the Illabo to Stockinbingal Inland Rail project.

    Around 10:45pm, police received reports that five unknown males allegedly smashed the passenger window of a vehicle parked at McDonalds on First street and threatened the occupants with an edged weapon.

    The victims were able to drive away and avoid further confrontation.

  • MIL-OSI Security: Elements of the 15th MEU Return Home from Deployment Aboard USS Harpers Ferry

    More than 300 Marines and Sailors with the 15th Marine Expeditionary Unit, embarked aboard USS Harpers Ferry (LSD 49), returned home to San Diego Oct. 16 after completing a seven-month deployment in the U.S. 7th and 3rd Fleet areas of operation.

    The deployment, which began on March 19, marked a milestone as it included the first operational use of the Marine Corps’ new amphibious combat vehicles. The experience and insights gained by the ACV Platoon and Battalion Landing Team 1/5 during this deployment have laid the groundwork for refining tactics, logistics, and maintenance practices for future expeditionary operations.

    “Our team aboard Harpers Ferry made lasting contributions in the Indo-Pacific, conducting training while integrated with our allies, in both the Philippines and South Korea,” said Col. Sean Dynan, commanding officer of the 15th MEU. “They accomplished so much during these seven months while taking on the unique responsibility of employing ACVs on their first deployment. The lessons they learned and the procedures they developed with their Navy counterparts will inform future operations for years to come.”

    Elements of the 15th MEU aboard Harpers Ferry included Marines and Sailors from the Command Element, BLT 1/5, and Combat Logistics Battalion 15.

    During the deployment, 15th MEU forces aboard Harpers Ferry engaged in three major exercises. In the U.S. 7th Fleet area of operations, Marines and Sailors joined other elements of the 15th MEU assigned to the amphibious transport dock USS Somerset (LPD 25) in the Philippines for Exercise Balikatan 24. This bilateral exercise, conducted with the Armed Forces of the Philippines, focused on securing key maritime terrain, conducting simulated long-range precision strikes, and enhancing missile defense capabilities.

    During Balikatan, the ACV Platoon conducted a live-fire waterborne gunnery exercise in Oyster Bay, marking the first overseas employment of ACVs. Using their automated remote weapons systems, the ACVs engaged simulated targets afloat and on shore.

    After the conclusion of Balikatan, the 15th MEU’s force aboard Harpers Ferry remained in the Philippines to participate in Archipelagic Coastal Defense Continuum (ACDC) from May 13-24. ACDC included bilateral training with the Philippine Marine Corps’ 3rd Marine Brigade (3MBDE) to bolster coastal defense strategies. The 15th MEU and 3MBDE conducted large-scale coastal defense rehearsals and completed the largest military convoy to date on Palawan Island, moving forces rapidly to simulate a coastal defense scenario.

    ACDC also featured numerous subject matter expert exchanges between BLT 1/5 and CLB-15 with their Philippine counterparts on various topics, such as weapons employment, unmanned aircraft systems integration, tactical combat casualty care, and motorized operations. These exchanges strengthened U.S.-Philippine bilateral military proficiency and improved mutual understanding of defense tactics in the Philippines.

    Following ACDC in the Philippines, the 15th MEU embarked aboard Harpers Ferry and traveled to Okinawa, Japan. On June 24, Alpha Company, BLT 1/5, and the ACV Platoon conducted a ship-to-shore movement, with the ACVs splashing into the waters off White Beach Naval Facility after Alpha Company’s Marines practiced troop egress and transfer procedures. This marked the ACVs’ first time ashore in a foreign country.

    In August, the 15th MEU’s forces aboard the USS Harpers Ferry arrived in South Korea to conduct two weeks of unit-level training (ULT) alongside the Republic of Korea Marine Corps’ 7th Brigade. During this period, the Marines demonstrated the off-road mobility and automated crew-served weapons capabilities of the new ACVs in a series of live-fire exercises.

    The highlight of their month-long stay was Exercise Ssang Yong 24, where Alpha Company embarked the ACVs for a large-scale amphibious landing at Hwajin-ri Beach near Pohang. Meaning “twin dragons,” Ssang Yong featured the first overseas amphibious assault conducted with ACVs, as U.S. and Korean forces landed together, strengthening the ROK-U.S. Alliance and the capability to defend the Korean Peninsula.

    “Working with our allies in South Korea one-on-one at the tactical level was extremely rewarding for both our Marines and the ROK Marines,” said Capt. Erik Lindskog, the Alpha Company commander. “Through the combined training, both live fire and information exchanges, we learned a lot from each other. In South Korea and in the Philippines, we arrived as training partners, worked through language barriers, and we left as friends.”

    Throughout the deployment, the ACVs demonstrated their versatility, maneuverability, and firepower in various scenarios, ranging from beach assaults to coordinated live-fire defense operations. The data and lessons learned from these exercises will help shape the future use of ACVs in amphibious operations and ensure the Marine Corps continues to refine the tactics and procedures necessary for employing this new platform.

  • MIL-OSI Asia-Pac: HKMA introduces multiple measures to support SMEs’ development, upgrade and transformation

         The Hong Kong Monetary Authority (HKMA), together with the banking sector, introduced multiple measures today (October 18) to further support, through financing as well as banking products and services, the continuous development of small and medium-sized enterprises (SMEs) and assist them in expanding new businesses and markets.
          
         Since the launch of the nine SME support measures by the HKMA and the Banking Sector SME Lending Coordination Mechanism (Mechanism) in March this year, a total of around 20 000 SMEs have benefitted from the measures, involving an aggregate credit limit of over HK$44 billion. The HKMA has also been deepening its understanding of the challenges and needs faced by SMEs of different sectors through various channels and platforms, including the Taskforce on SME Lending (Taskforce) which was established in August this year, and engagement sessions with over 50 trade associations and their members from different industry sectors.
          
         While Hong Kong is currently undergoing economic transformation, the HKMA and the banking sector are aware of the needs of SMEs to strive for change and adapt to changes in the market and business operating environment. Taking into account the views of the commercial sector, the HKMA and the banking sector will roll out the following five measures to assist SMEs’ continuous development, upgrade and transformation, and enhance their competitiveness and productivity to cope with new operational challenges:
     
         1. Release of bank capital to facilitate the financing needs of SMEs: The HKMA lowered the countercyclical capital buffer (CCyB) ratio from 1 per cent to 0.5 per cent, and will allow banks to early adopt the preferential treatments for SME exposures under the Basel III capital framework. These policies will release bank capital and thereby enable banks to make use of the additional capital to facilitate the financing needs of SMEs. 

         2. Set aside dedicated funds to support SMEs: The 16 banks that are active in SME lending have set aside a total of over HK$370 billion of dedicated funds for SMEs in their loan portfolio. The funds will allow SME customers to access necessary financing for coping with the evolving business environment. The banks will regularly review and consider scaling up the size of their dedicated funds in response to SMEs’ needs and development.

         3. Launch more credit products and services to assist SMEs’ transformation: Banks will launch more credit products and services to meet the transformation needs of SMEs. Examples include pre-approved credit limits, unsecured loans, cross-border loans, and loans with flexible repayment periods.
     

    On digital transformation, banks will offer e-commerce financing and electronic payment services to enable SMEs in different sectors such as retail, catering and trading to better utilise data and adopt innovative business solutions, so that SMEs can strengthen their marketing and promotion, streamline business processes and save operating costs. 

    On green transformation, banks will actively consider launching relevant advisory services. Through collaboration with green certification agencies, banks can alleviate the costs for SMEs to apply for green certification, thereby supporting their low-carbon transition. Banks will also provide green loans to assist SMEs in purchasing and adopting low-carbon equipment, so as to reduce the SMEs’ own carbon emissions and transform into green suppliers. 

         4. Increase the partial principal repayment options: When an orderly exit from the banking sector’s Pre-approved Principal Payment Holiday Scheme commenced in July 2023, the Mechanism introduced enhanced measures to assist corporates’ gradual return to normal repayment. Since some customers’ partial principal repayment arrangements will expire in early 2025, banks will be accommodative and consider offering more flexible repayment arrangements to help these customers to address challenges encountered during economic transformation. Such arrangements include, for instance, extending the duration of partial principal repayment, offering more options on the proportion and duration of partial principal repayment, or even offering principal moratorium, subject to prudent risk-management principles. The above-mentioned arrangements are also applicable to taxi loans, public light bus loans and commercial vehicle loans taken out by personal customers.

         5. Devote sufficient manpower and resources to implement the enhancements to SME Financing Guarantee Scheme as soon as possible: Banks will allocate adequate resources to process applications and work closely with HKMC Insurance Limited to implement as soon as possible the principal moratorium and other enhanced measures under the SME Financing Guarantee Scheme.

         The HKMA will continue to understand the SME-related business strategies of banks, and maintain close communication with the commercial sectors through the Mechanism and the Taskforce. Seminars and other activities will be organised to promote the SME services, products and schemes offered by the banking sector in the concerted efforts to assist the continuous development, upgrade and transformation of SMEs.
     
    Background
     
    The Banking Sector SME Lending Coordination Mechanism

         The Banking Sector SME Lending Coordination Mechanism was established by the HKMA in October 2019. Participants include 11 banks (Note 1) that are most active in SME lending, the Hong Kong Association of Banks (HKAB) and the HKMC Insurance Limited. During the pandemic, the Mechanism rolled out several rounds of relief measures for corporates, including the Pre-approved Principal Payment Holiday Scheme. In March 2024, the HKMA, together with the Mechanism, launched nine measures to assist SMEs in obtaining bank financing and to support their continuous development.
     
    The Taskforce on SME Lending

         The Taskforce on SME Lending was jointly established by the HKMA and HKAB in August 2024. Participants include representatives of the HKMA, HKAB and 16 banks (Note 2) that are active in SME lending. The Taskforce aims to further strengthen the related work for supporting SMEs in obtaining bank financing at both the individual case and the industry levels. Participating banks of the Taskforce have stated that they would ensure the ongoing effective implementation of the nine SME support measures that were launched previously, and indicated that they had not changed and would not change their risk appetite towards SME financing and related credit approval standards. The participating banks would also strive to treat customers fairly and communicate with customers in an accommodative manner.

  • MIL-OSI China: Ringing through time: Sightseeing on a Beijing ‘dangdang’ bus

    A century ago, Beijing’s first tram service started operation with copper bells that produced clear and crisp rings to signal its arrival and caution pedestrians of its approach. This distinctive “dang” sound become familiar to local residents and eventually earned the tram service’s vehicles the affectionate name of “dangdang” buses. Today, “dangdang” buses can be seen around the capital’s tourist hot spots and still resembling these early trams.
    On Oct. 15, journalists from various media outlets hopped on a few of these old-fashion buses for a cultural heritage excursion along Beijing’s Central Axis. Starting at Qianmen Street, a popular commercial street located along the axis, the excursion was part of “High-Quality Development Research Trip” interview activities and visited 15 cultural heritage sites. From the moment they stepped onto the buses, participants were fully immersed in the capital’s profound historical heritage.

    Besides conveying historical information, Wang also enthusiastically shared that the Great Beijing Central Axis sightseeing bus tour not only attracts local Beijingers who want to reminisce about the old days but also domestic and foreign tourists who come to Beijing for its reputation.
    Since its launch in August, the Great Beijing Central Axis sightseeing bus tour has seen an average of 4,000 passengers daily on their 41 “dangdang” buses, according to Yun Haibing, the director of the Beijing Tourism Distribution Center’s market management department. Yun also said that during the recent National Day holiday demand for bus tickets surged, with approximately 98,000 tourists in total going on guided bus tours.
    In addition to listening to explanations full of Beijing flavor, passengers also sampled some traditional culinary treats, such as Peking Duck, as well as got a taste of local intangible cultural heritage. Through lively allegro performances, participants enjoyed classic stories related to the Central Axis.

    Considered the spine of Beijing’s urban layout, the Central Axis was added to the World Heritage List on July 27, 2024. After receiving this honor, the already well-known scenic spots along the Central Axis saw a rise in their popularity.     As of 1 October 2024, Elodie Berthonneau will take over the position of Vice President Asia-Pacific at Lufthansa Cargo in Singapore. She will head the sales and handling organization in one of the most important markets for Lufthansa Cargo. This includes among others the regions China, Japan, South Korea, Thailand, Vietnam, Singapore, Malaysia, Indonesia, Philippines and Oceania. Berthonneau joins Lufthansa Cargo from Qatar Cargo where she was Vice President Network Planning and Strategic Partnership.

    With more than 25 years of experience in the aviation industry, Berthonneau has held various management positions in sales, pricing, profit management and strategic planning at Qatar Airways and Air France KLM.     On the occasion of President Joseph R. Biden Jr.’s visit to Germany, the United States reaffirms its commitment to deepening the close and historic bond between the two nations as Allies and friends.  For over 75 years, Germany has been a crucial partner in ensuring the stability, security, and prosperity of the transatlantic alliance.  In October 2023, President Biden welcomed President Steinmeier to Washington during German-American Day, underscoring the enduring people-to-people ties between our two countries, including the over 40 million Americans who claim German heritage and strengthen the diverse fabric of the United States.  In February 2024, President Biden welcomed Chancellor Olaf Scholz to the White House, where the two leaders reaffirmed their support for Ukraine’s defense against Russia’s war of aggression, discussed regional stability in the Middle East, and prepared for the NATO Summit in Washington.

    During his visit to Germany, President Biden will underscore our mutual commitment to upholding democracy, combating antisemitism and hatred, and expanding collaboration to promote economic growth and technological innovation.  In addition, he will express gratitude to Germany for its role in hosting approximately 39,000 U.S. service members and its vital contributions to the security of NATO and the broader transatlantic community. 

    The United States and Germany are partners in a wide range of new and continuing initiatives to address the most pressing challenges of our time, some of which are listed below.

    SECURITY AND DEFENSE

    • The United States and Germany cooperate through several multilateral institutions including NATO, the G7, the OSCE, and the UN, to advance security, democracy, and the rule of law globally.
    • As host to the largest U.S. troop presence in Europe and second largest globally, Germany continues to play a critical role as a platform for U.S. military force projection, including support for NATO’s eastern flank and training for Ukrainian soldiers. 
    • Germany has been a key provider of military assistance to Ukraine in its defense against the Kremlin’s aggression.  Contributions include advanced weaponry such as Leopard 2 tanks, air defense systems (such as IRIS-T), artillery, and ammunition. Germany also supplies medical aid, vehicles, and training for Ukrainian forces, continuously adapting its support to Ukraine’s evolving needs in coordination with NATO allies.
    • As announced by President Biden and Chancellor Scholz on July 10, 2024, the United States looks forward to beginning the episodic deployments of its Multi-Domain Task Force in Germany in 2026, as part of planning for enduring stationing of these conventional long-range fire capabilities in the future.
    • Germany plays a key role in the U.S-Italy co-led G7+ Coordination Group for Ukraine Energy Security Support.  Germany has been a leading provider of financial assistance and critical components such as transformers and power generators to support the repair and strengthening of Ukraine’s energy sector in response to Russia’s continued brutal attacks on civilian infrastructure.
    • Germany is a robust partner in the fight against terrorism and terrorism financing, in the Financial Action Task Force, and as part of the Global Coalition to Defeat ISIS (D-ISIS).  On September 30, State Secretary Tobias Lindner joined Secretary Blinken for the D-Isis Ministerial Meeting in Washington, D.C. 
    • Germany will accede to Operation Olympic Defender, a U.S.-led multinational effort intended to strengthen nations’ abilities to deter hostile acts in space, strengthen deterrence against hostile actors, and reduce the spread of debris orbiting the earth. International partners currently include the UK, Canada, and Australia.

    DEFENDING DEMOCRACY

    • As the second-largest provider of assistance to Ukraine after the United States, Germany has provided $37.2 billion (€34 billion) in bilateral assistance since February 2022.  This includes humanitarian assistance, budgetary support, military equipment and training, and funding for Ukraine’s reconstruction.  Germany hosted an international reconstruction conference for Ukraine in Berlin in June 2024 which generated over €60 billion in commitments to Ukraine and emphasized the human dimension of post-war recovery.
    • At the September 2024 United Nations General Assembly, the United States, in partnership with Germany and other international allies, reaffirmed its commitment to supporting democratic transitions as part of the Democracy Delivers Initiative, launched by USAID.  The initiative mobilized over $517 million to provide financial and technical assistance to countries undergoing democratic renewal, including Guatemala, Armenia, and Moldova, with the aim of strengthening global democratic resilience.
    • Germany has increasingly recognized the importance of supporting Taiwan as a like-minded democratic partner.  Education Minister Stark-Watzinger’s visit to Taiwan in 2023 marked the first visit by a German minister to Taiwan in 26 years.  Two German warships recently transited the Taiwan Strait, a visible demonstration of Germany’s commitment to upholding international laws and norms and increasing engagement to maintain a free and open Indo-Pacific region.
    • Germany was one of the first of twenty-one countries to endorse the U.S. government’s Framework to Counter Foreign State Information Manipulation, the U.S. Department of State’s key initiative to galvanize like-minded democracies to respond collectively to the threat posed by disinformation.  

    ECONOMICS & TRADE

    • Germany is the United States’ largest trading partner in Europe, with bilateral trade reaching over $324 billion in goods and services in 2023.  U.S. direct investment in Germany was $193.2 billion in 2023.  In total, German firms employ an estimated 923,600 people in the United States.  Germany is the fourth-largest source of foreign direct investment in the United States and the number one foreign investor in U.S. renewable energy projects.  Germany is currently the third-largest source of foreign direct investment in the United States, with investments worth more than $660 billion based on 2023 data.
    • On September 24, 2024, the United States and Germany held the third round of the U.S.-Germany Economic Dialogue, building on the framework established in the 2021 Washington Declaration.  The talks focused on strengthening collaboration to increase economic security, including cooperation in sectors such as digital technologies and clean energy supply chains.  Both countries committed to enhancing supply chain resilience and advancing sustainability goals.
    • Germany and the United States partner on several initiatives to advance women’s economic security around the world, including bolstering women’s participation in climate sectors through the Women in the Sustainable Economy Initiative, closing the gender digital divide through the Women in the Digital Economy Initiative, and supporting women to join the workforce by investing in efforts to close the global childcare gap through the Invest in Childcare Initiative.

    COMBATTING ANTISEMITISM:

    •  Germany is a global leader and vital partner in the fight against antisemitism and extremism.  Senior officials are unequivocal in condemning antisemitism and federal and state governments have robust strategies for tackling the problem.  In July 2024, Germany co-launched the Global Guidelines for Countering Antisemitism in Buenos Aires, an initiative led by U.S. Special Envoy Deborah Lipstadt.
    • Launched in 2021, The U.S.-Germany Dialogue on Holocaust Issues, plays an essential role in combatting Holocaust distortion online and promoting accurate Holocaust education and commemoration.
    • Germany and the United States cooperate on improving resolution to Nazi-confiscated art to ensure just and fair solutions for survivors and heirs, and salute Germany’s new art restitution policy.

    EDUCATIONAL EXCHANGES

    • The German-American Fulbright program is one of the largest and most varied of the Fulbright Programs worldwide, sponsoring over 40,000 Germans and Americans since its inception in 1952.
    • Established in 2016 as a public-private partnership, each year the USA For You program brings youth from underserved German communities to the United States for a two-week homestay and community service experience.  The program promotes civic engagement and helps counter extremism and xenophobia by fostering cultural understanding.  In 2023, the German government launched a reciprocal Germany for You program, allowing American high school students to visit Germany for a similar exchange, further strengthening transatlantic ties.
    • The Congress-Bundestag Youth Exchange (CBYX), jointly funded by the United States and German governments, supports the transatlantic relationship by fostering year-long academic, homestay, and community service opportunities for 700 American and German youth annually.  Since 1983, CBYX has promoted cross-cultural understanding, professional skills, and mutual awareness of each nation’s history, politics, and society.  With around 15,000 German and 14,000 American participants to date, the program strengthens ties and deepens the transatlantic partnership between the next generation of leaders.
    • The German Bundestag-Bundesrat exchange (CBBSX) program is an annual two-way exchange between German Bundestag and Bundesrat staff and U.S. Congressional staff members.  It was initiated during the 1983 German-American Tricentennial celebration and first implemented in 1984.  Participants focus on the U.S. legislative process and U.S.-German relations; examining U.S. Congress and the U.S. political system.  In 2024 the IVLP brought 10 German Bundestag and Bundesrat staff members to the United States.  For the first time, CBBSX participants also engaged with state and local government.

    SCIENCE, ENVIRONMENT, SPACE, & TECHNOLOGY

    • On January 10, 2024, the United States and Germany held a U.S.-Germany Critical and Emerging Technology Track 1.5 Dialogue to share strategic objectives, outlooks, and lessons learned in technological innovation. The two countries agreed to convene the first of an ongoing AI Dialogue to discuss approaches to AI governance, infrastructure and innovation, and applications of AI for good. They intend to hold the first session of this dialogue in early 2025.
    • Furthering their commitment to monitoring the effects of climate change, the United States and Germany have partnered on space collaboration through NASA’s Gravity Recovery and Climate Experiment Follow-On (GRACE-FO) mission, which monitors Earth’s water movement by tracking shifts in gravity.  This mission provides critical data for managing water resources, monitoring sea levels, and understanding climate change impacts on a global scale.
    • The U.S.-Germany scientific partnership was further strengthened throughfunding from the U.S. National Science Foundation (NSF) and Germany’s Federal Ministry of Education and Research (BMBF) for Collaborative Research in Computational Neuroscience (CRCNS) program, which advances cutting-edge research in brain function and computational neuroscience.  This initiative supports interdisciplinary approaches to understanding neural systems.
    • On September 14, 2023, the United States and Germany held the inaugural U.S.-Germany Space Dialogue, advancing collaboration in space exploration, satellite technology, and space security.  This dialogue promotes joint efforts in planetary science, climate monitoring, and managing space debris, while advancing international norms for responsible space operations.

    CLIMATE & ENERGY

    • In July 2021, the United States and Germany launched the U.S.-Germany Climate and Energy Partnership to deepen collaboration on the policies and sustainable technologies needed to accelerate the global net-zero future.  Notable outcomes of the Partnership include the first U.S.-Germany Climate and Energy Summit held in Pittsburgh September 2022, and the U.S.-German Clean Hydrogen Conference held in Berlin October 2023.
    • Beyond our strong bilateral partnership, the United States and Germany are also intensifying our cooperation to accelerate the clean energy transition and promote clean economic growth in emerging and developing economies.  This includes leveraging and scaling-up our collective technical, policy, and financial support to catalyze investments in clean energy manufacturing and industrial decarbonization in developing countries, leveraging key international platforms such as the Climate Club and Clean Technology Fund.

    GLOBAL DEVELOPMENT

    • The United States participated in the International Humanitarian Conference on Sudan, hosted by France, Germany, and the European Commission on April 15, 2024, to address the vital need for greater humanitarian assistance for the Sudanese people.
    • The U.S. Agency for International Development (USAID) and Germany’s Ministry for Economic Cooperation and Development (BMZ) are strengthening their partnership through a Strategic Development Dialogue.  This initiative focuses on joint efforts to tackle global challenges in climate change, food security, gender equality, health, and G7 development priorities.
    • The United States and Germany have worked closely across multiple presidencies of the G7 Food Security Working Group to support efforts to achieve long-term food and nutrition security.  As most recently affirmed in the Apulia G7 Leaders’ Communiqué, both countries have committed to promoting and supporting multi-stakeholder programs to build climate resilience in our food systems.  These programs include the Vision for Adapted Crops and Soils, launched by the United States in partnership with the African Union and Food and Agriculture Organization of the United Nations.

  • MIL-OSI Security: Mayo — Mayo RCMP investigating a home invasion and a sexualized assault

    On October 15 at 11:04 pm Mayo Detachment responded to a report of a sexualized assault and related motor vehicle collision in Mayo, Yukon. The female driver advised she had purposely struck a light pole in order to escape from a male perpetrator who had committed a sexualized assault.

    Through investigation since that time, police have learned that earlier in the evening of October 15, a male knocked on the door of the female’s residence and then pushed his way inside where he committed a sexualized assault. He demanded the female drive him to Whitehorse. The female drove purposefully into a light pole, the male continued to assault the female and forcibly prevented her from getting out of the vehicle. The female was able to exit the vehicle and yelled for assistance, while the perpetrator fled. The perpetrator is not known to the victim.

    Police in the territory conducted extensive patrols for the perpetrator and did not locate him. The Yukon RCMP Specialized Response Unit are leading this investigation, with assistance of other RCMP units, and are actively working on identifying and apprehending the male.

    Police are unable to provide additional details at this time but will do so as they become available. We encourage the public to stay alert and invite anyone with information regarding this crime or other crimes to come forward. Police encourage the public to report any unusual or suspicious activity to the police, even if at the time, it did not seem suspicious.

    Yukon RCMP continue to investigate this matter and urge anyone who may have information about this crime to report it to the Mayo RCMP at (867) 996-5555. Information can also be provided anonymously through Crime Stoppers at 1-800-222-TIPS (8477).

         The Road Traffic (Registration and Licensing of Vehicles) (Amendment) Regulation 2024 (RLV Amendment Regulation), Road Traffic (Registration and Licensing of Vehicles) (Amendment) (No. 2) Regulation 2024 (RLV (No. 2) Amendment Regulation) and Motor Vehicles Insurance (Third Party Risks) (Amendment) Regulation 2024 (TPR Amendment Regulation) were gazetted today (October 18).     The Amendment Regulations seek to implement an electronic vehicle licence (eVL) of the Transport Department (TD) by obviating the need of vehicle owners to replace their paper-form vehicle licences on each renewal, to simplify the supporting documents required for vehicle licence (VL) applications; as well as to tighten the vehicle registration and licensing regime by introducing a penalty for taking no action on vehicles unlicensed for two years or more.     A spokesman for the Transport and Logistics Bureau said, “The eVL initiative will streamline the process for vehicle licence applications and bring greater convenience to vehicle owners. The TD will issue a notice to the vehicle owners containing the new licensed period in lieu of a paper-form VL, so that the vehicle owners will not need to replace the paper-form VL with a new one on each renewal after its first issuance bearing no expiry date. The amendments to the law will also simplify the documents accompanying a VL application by repealing the requirement of presenting the Vehicle Registration Document; whereas online VL applicants will have the option not to present the scanned copy of policy of insurance or security, but providing information (such as name of the vehicle owner, identity document number of the vehicle owner, vehicle registration mark, etc) to be specified by the Commissioner for Transport.       “Moreover, to address at source the issue of improper abandonment of unlicensed vehicles in a public area, amendments will be made to hold vehicle owners responsible for their vehicles on a continuous basis. The registered owners of vehicles unlicensed for two years or more must, within three months of the date of a notice to be issued by the TD, either have the vehicle relicensed, or cancel the registration of the unlicensed vehicle in accordance with the requirement, failing which will constitute an offence,” the spokesman added.     The Legislative Council (LegCo) Panel on Transport and the Transport Advisory Committee were briefed on the above, and members generally supported and welcomed the proposed arrangements. The Amendment Regulations will be tabled at the LegCo on October 23 for negative vetting. Subject to scrutiny by the LegCo, the RLV Amendment Regulation and TPR Amendment Regulation will be effective from December 30 this year. To allow sufficient time for vehicle owners to take appropriate actions on their unlicensed vehicles, the RLV (No. 2) Amendment Regulation will come into operation on a date to be fixed by notice in the Gazette, tentatively in the fourth quarter of 2025.

    BILL SHORTEN, MINISTER FOR THE NDIS AND GOVERNMENT SERVICES: It’s great to be at Northcott today in Wollongong. The opening of the new multi-use hub is fantastic news for thousands of people with disability. In particular, the hundreds of clients that Northcott looks after every day.

    JOURNALIST: You mentioned in your speech downstairs that it’s a village of hope, and if you can expand on that, and that sort of means?

    SHORTEN: Buildings reflect a society’s values. If we build a brand new shopping centre, it reflects the value that Australians value shopping. But when a community or a group like Northcott build a marvellous, purpose-built building so that people with disabilities can have more fulfilling lives, I think it reflects very positive values. So this is not just a set of walls and windows, some fabulous rooms and a roof. This is a village of hope where people with disability cannot be invisible, where they can help – have dreams, have hopes, make plans and have social interaction. So the values of this building are based on the finest moral foundations of a fair go for people with disability.

    JOURNALIST: Reflecting I guess on your time as the Minister in charge of the NDIS, you’re obviously outgoing at the moment, there were recommendations about how to improve the service that were handed down last year. As you leave your position, what do you think? Do you think those – , yeah, what state do you think you leave the service in?

    SHORTEN: You’re right. I’m very outgoing. I love the NDIS, I bleed it, I was fortunate enough to be able to help create it more than 15 years ago. Coming back into Government, I realised that whilst it was changing lives for the better, hundreds of thousands of lives, it was off track. Money was getting  spent on the wrong things. There were a minority of service providers who were seeking to enrich themselves rather than look after the people they meant to. Australians are very generous. They, I think, don’t mind spending some taxes on Medicare and on looking after people with profound and severe disability. Participants deserve fulfilling lives. So therefore, what we’ve spent the last nearly three years is get it back on track. Now I want to take it above politics. I want to make it politician proof. Now we’ve got the legal authority to outline what you can spend your money on and what you can’t. Who you can spend your money with, with registered providers. We can now make sure that we’ve got a process for clear eligibility, which we’re working on. And I think also most importantly – so who can be in it, what we can spend the money on and who with. We’re clearing that up. We’re clamping down on the fraud and the cheats and the crooks. They’re not welcome anymore. But also what we’re doing is writing a new chapter of inclusion by building supports outside the NDIS. For people who don’t need the full orchestra of the NDIS, but have special needs, and so that the NDIS is not the only lifeboat in the ocean of services for people with disability.

    JOURNALIST: Just on the changes that have been made, I spoke to a provider earlier this morning saying – who’s here in the Illawarra – saying that a lot of clients are I don’t feel like they have enough information about what can and can’t access now, and that’s actually worsening their mental health as well. Are there plans to kind of improve communications in that sense?

    SHORTEN: Good providers should be telling their people what’s going on. I mean, a provider can simply access a website. It’s all there. I get any changes can bring anxiety. If you’re a person with a disability or a family who has fought hard to get a personal budget, when you hear the words change, that’s not what you hear, you hear, am I going to lose something? I don’t want to go backwards. All we’re doing is providing clarity. It’s very easy to access on the NDIA or the National Disability Insurance website. Our providers, they’re meant to be professional. They’re paid to provide services. So I can understand participants taking longer to work out what’s in and what’s out. But a provider should be acquainting themselves with the road rules. You’re not allowed to drive a truck without knowing basic road rules, and providers should do the same.

    JOURNALIST: You talk about eligibility requirements. We have a local in Kiama who’s the name of Bobby English, who’s been campaigning for years to have her partner, who’s over 65 and developed a disability, have him be included in the Scheme. I guess as you’re leaving the position, do you regret not having this issue resolved? And will this be a priority for your successor, I guess?

    SHORTEN: For the person who needs the support, I hope they’re getting support. But for the proposition that the NDIS, to the NDIS should look after people of all ages of disabilities, that would sink the Scheme. The Parliament made it very clear in 2013, when it was legislated, that the NDIS is for people up to 65 and aged care would look after people over 65. When I started campaigning for the NDIS, aged care was in much better shape than disability. What’s happened in the intervening 15 years, 16 years since I first raised it, is aged care had fallen backwards and for all of the problems with the NDIS, it was more generous. I think the answer to the issue of older Australians who acquire a disability after 65 is better support in the aged care system, which is what it’s designed for. And the Labor  Government has been making pretty significant reforms in aged care to improve the support which would be available.

    JOURNALIST: This is your, most likely your last visit to the Illawarra region is it?

    SHORTEN: I don’t know, nice to say, but you know you have –

    JOURNALIST: Well I was going to ask –

    SHORTEN: I’m going to do more farewell trips than Johnny Farnham, but I’ll be coming back, to the South Coast anyway. I’m actually moving from Melbourne to Canberra, so actually I’ll be closer to the Illawarra than I’ve ever been.

    JOURNALIST: Yes, but last in a ministerial – as an announcement, with an announcement sort of thing?

    SHORTEN: Yeah.

    JOURNALIST: in terms of this region in particular, obviously you’re a Federal Minister, but in this area, what do you hope the legacy of your role will be?

    SHORTEN: I’ve been very fortunate to visit the Illawarra in different roles over my working life as a steel union rep with the Australian Workers Union. I’ve been at the north gate BHP. I’ve seen when things have gone bad. So I know this is a an industrial town. People work hard for their money here. Then I had the chance to work in disability here, and I realised it had a very strong culture of support for people with disability in the area, which I think reflects well on the values of the community here. I got to campaign here as Leader of the Opposition for six years. So I’ve seen how this area is reinventing itself and diversifying. And indeed, you know, to the south of the Illawarra has become a very crowded part of Australia. So I’ve seen this community reinvent itself. It works hard and it cares for the people within it. But what I’m pleased is that there’s 5,600 people in the Wollongong region receiving personal budgets of support because of a severe and profound disability, which but for the National Disability Insurance Scheme, they’d be stranded. Families will have kids on non-standard developmental journeys, little precious babies who are two and three. But for the NDIS, they wouldn’t get the sort of support they’re getting now. There’s ageing carers in their 80s who will be drying the dishes at 10:00pm tonight overlooking the, you know, the back window from the kitchen sink. They’ll have that anxiety, who’s gonna look after their adult child when they no longer can? We’re not fully there at fulfilling that promise. But for people in this region, we’re a lot closer to fulfilling a promise that even when you can’t look after the person you love because they have a profound and severe disability, there’ll be someone there.

    JOURNALIST: Bill. Negative gearing is back in the spotlight today, with analysis showing more than 750,000 renters could become homeowners under your policy that you introduced in 2019. Is it time for the Federal Government to consider changes to negative gearing and capital gains tax concessions?

    SHORTEN: Well, unfortunately, Mr. Morrison won the election, so I didn’t quite introduce my policies but thank you for the compliment. Listen, the Government said that we’re going to focus on supply, that negative gearing is not on the agenda. I think that’s fine. We did take a series of policies to 2019. They were narrowly rejected. I think the Government’s got it right where we’re going to focus on supply. I’d encourage the Liberals and the Greens political party to get out of the way. They’re not – we want to build more houses. They’re delaying that. I mean, I have to say of Mr Dutton’s Opposition. They won’t lead, they won’t follow, and they won’t get out of the way. That’s a problem for renters.

    JOURNALIST: Should the Prime Minister have bought an expensive home so close to the election in the middle of a housing crisis?

    SHORTEN: Oh, it’s so up to him. It’s his business. Good luck to him and Jodie. Again, what I see is people are focusing on one house. I wish the Opposition and the Greens would focus as hard on the tens of thousands of houses that we want to support, and they are just on the Prime Minister’s house.

    JOURNALIST: You did used to call Turnbull, at the time, Mr. Harbourside mansion back in the day, saying he was out of touch. Should Albanese have waited until after the election to buy his own?

    SHORTEN: I think the difference between Malcolm Turnbull and Prime Minister Anthony Albanese is chalk and cheese. Mr. Albanese has worked very hard. He comes from or he came from a tough background. I just wish the very best for him and Jodie in their future. But the other thing is I’ve got no doubt that Prime Minister Albanese will lead us to the next election and successfully.

    JOURNALIST: But just in terms of cost of living, do you think the Reserve Bank should hold off on cutting interest rates?

    SHORTEN: That’s a decision for the Reserve Bank. But I do know that 3 million mortgagees are doing it tough. I do know that the economy in large part is doing it tough. You know, it’s great that Labor’s been able to create a million jobs, and that shows you the focus of the Government. But people are doing it hard. It’ll be up to the Reserve Bank when they cut rates, but that can’t come too soon as far as I’m concerned.

    JOURNALIST: Can I ask one more just for our Canberra colleagues? Your new position that you’ll be taking up, will you be launching a review into the governance of UC?

    SHORTEN: Uh, I’ll wait until I get there. What I said about my new job is that until I finish my current job, I won’t be talking about my new job. But the day I start there, then I’m open for – the shop is open for interviews. Thanks.

    Stronger guarantees, AI rules and ban on unfair trading 10 min read

    The Federal Government has signalled its commitment to advancing major consumer law reforms with three key announcements this week that included proposals to strengthen consumer guarantees, ban unfair trading practices and introduce artificial intelligence (AI) specific protections—all of which could significantly alter the landscape for both suppliers and manufacturers. 

    With Government seeking feedback on these reforms, companies should stay informed and actively engage in consultation processes to ensure any changes are fit for purpose and take into consideration relevant business concerns. In addition, companies should consider how these proposals could impact their businesses and take steps to ensure compliance and mitigate risks.

    In this Insight, we provide an update on the proposals so far and their potential implications for business.

    Moves to strengthen the consumer guarantees regime

    On 16 October 2024, the Government announced plans to introduce new civil prohibitions and penalties for breaches of the consumer guarantees and supplier indemnification (CGSI) provisions of the ACL. The announcement was accompanied by a Consultation Paper seeking stakeholder feedback on how the proposed prohibitions and penalties should be designed.

    This announcement builds on a consultation undertaken in 2021 on ways to improve CGSI provisions of the ACL and incorporates findings from the 2023 Australian Consumer Survey, including that consumers find it difficult to obtain remedies for consumer guarantees failures. The Consultation Paper notes that:

    • for low-cost goods, consumers are less likely to enforce their statutory rights when it is cheaper and easier to ‘just buy another one’ or to pay for a repair; and
    • for high-value goods, consumers may struggle to understand the process involved in making a complaint and/or find it prohibitively time-consuming, costly or difficult to pursue one.

    The proposed reforms seek to respond to a range of concerns with the status quo, including that:

    • the difficulties outlined above mean costs can be transferred from a non-compliant supplier or manufacturer to a consumer and lead to poorer outcomes for consumers and the economy;
    • suppliers and manufacturers lack incentives to comply with the consumer guarantees; and
    • some suppliers may also face difficulties obtaining indemnification from manufacturers and/or face retaliatory behaviours if they seek to be indemnified.

    The Government is seeking to respond to the concerns outlined above by introducing reforms that would:

    • prohibit suppliers from refusing to provide remedies to consumers where there has been a major failure under the consumer guarantees (remedy failure prohibition);
    • prohibit manufacturers from failing to indemnify suppliers;
    • make it unlawful for a manufacturer to retaliate against a supplier for seeking indemnification following a consumer guarantees failure; and
    • introduce civil penalties for contraventions of the prohibitions above, as well as an ability for regulators to issue infringement notices or pursue litigation where they have reasonable grounds to believe a contravention has occurred.

    The Consultation Paper notes that the introduction of these prohibitions would enable ACL regulators to enforce the CGSI provisions in circumstances where rights are currently only enforceable by affected consumers and businesses. The Paper also acknowledges a submission made by the ACCC that, if regulators were able to take direct enforcement action, this would likely lead to greater judicial consideration of the consumer guarantees and result in greater clarity in the law.

    Key issues the Government is seeking feedback on include:

    • whether any aspects of the consumer guarantees need to be clarified prior to the introduction of prohibitions and penalties, noting concerns have previously been raised regarding whether penalties are appropriate in circumstances where concepts such as ‘reasonable consumer’ and ‘major failure’ are difficult to apply in practice;
    • whether the remedy failure prohibition should apply to all goods and services or whether a value threshold should be applied and/or only be applied to new motor vehicles;
    • at what amount an infringement notice or maximum civil penalty should be set; and
    • if it is appropriate to factor in depreciation when determining an appropriate refund amount, noting that, at present, where there has been a major failure, a consumer is entitled to a replacement or full refund even where they have had the benefit of the use of a product for an extended period of time.

    Treasury will engage with targeted stakeholders on the proposed design of the civil prohibitions and penalties and is seeking public feedback by Thursday 14 November 2024.

    Anticipated ban on unfair trading practices takes shape

    On Wednesday 16 October 2024, the Prime Minister’s office announced it will legislate a ban on unfair trading practices. The announcement is long awaited and follows the Federal Treasury’s consultation on the introduction of such a prohibition, which took place between August and November 2023 (the 2023 Consultation). The ACCC has previously recommended that an unfair trading practices prohibition be introduced into the ACL in a number of contexts, including the final report of the 2019 Digital Platforms Inquiry.

    The Government’s media release states that the reforms are about ‘easing the cost of living and getting a fair go for consumers and suppliers’. It non-exhaustively identifies the following practices that the reforms will address:

    • subscription traps: arduous and confusing steps that make cancelling a subscription difficult;
    • drip pricing: practices where fees are hidden or added throughout the stages of a purchase;
    • deceptive or manipulative online practices: practices that aim to confuse or overwhelm consumers, omit or hide material information, or create a false sense of urgency (such as warnings that a customer only has limited time to purchase a product);
    • dynamic pricing: changing the price of a product during the transaction process;
    • accounts and information provisions: requiring consumers to set up an account and provide unnecessary information to make an online purchase; and
    • reporting of issues: making it difficult for a consumer to contact a business when they have a problem with a product or service.

    The Government is yet to release any specific legislative drafting or design for consultation and has foreshadowed a final reform proposal in the first half of 2025.

    Enhancing Australian consumer law to address AI

    On 15 October 2024, Treasury released a Discussion Paper which examines whether the ACL remains fit for purpose to protect consumers from the potential harms of the use of AI. The ACL currently contains a combination of both general and specific consumer protections which are technology-neutral, and Treasury is consulting on whether any changes to the ACL targeted specifically towards AI-enabled goods and services are necessary.

    Treasury has indicated that new and targeted consumer protections may be introduced:

    • Specific prohibitions on false and misleading representations in relation to AI and emerging technologies. Treasury raised concerns in relation to the opacity of AI systems and difficulty in predicting AI system behaviour, such as erroneous output and unwanted bias, which may increase the risk of false or misleading representations about AI-enabled goods and services, and misleading and deceptive conduct in general. In light of this, Treasury is considering whether specific prohibitions in relation to false and misleading representations, targeted towards AI-enabled goods and services, are necessary to ensure the ACL is fit for purpose in the future. Recently, the Federal Trade Commission (FTC) took law enforcement action in the United States against the alleged use of AI technology in a deceptive and unfair manner.
    • Specific consumer guarantees provisions targeted towards AI and emerging technologies. Treasury has considered views that the unique characteristics of AI may require new consumer guarantees, eg guarantees relating to cybersecurity, interoperability and the provision of software updates for a reasonable period. Treasury acknowledged that some cybersecurity risks of certain AI-enabled goods will be captured by the Government’s ongoing 2023-2030 Australian Cyber Security Strategy, but it is still considering the need for bespoke consumer protections for digital products overall, such as those adopted in the United Kingdom under the Consumer Rights Act 2015 (UK).
    • New product safety standards targeted towards AI and emerging technologies. There are currently no mandatory AI-specific safety standards for consumer goods or product-related services, and Treasury is assessing whether current safety standards (which include the current Voluntary AI Safety Standard) effectively guarantee the safe and responsible use of AI-enabled goods and services. Treasury is considering options for mandatory guardrails in this consultation. See our Insight on preparing for voluntary AI standards and mandatory legislation for more information.
    • Prescriptions under the unfair contract terms (UCT) regime. Treasury has noted stakeholder concerns about the possible risks to consumers arising from terms that exclude supplier and manufacturer liability in relation to AI-enabled goods and services, and is currently considering whether such terms (and similar) should be deemed as UCTs.

    Treasury has flagged that there is a need for greater clarity in the ACL in relation to AI and emerging technologies, due to the technology-neutral nature of the current language of the ACL. In principle, the existing general ACL framework should be able to address AI-related concerns, but there is uncertainty over the following issues:

    • The definition of AI-enabled goods and services, and whether this fits within the current definitions under the ACL. Whether something is a ‘good’ or a ‘service’ affects the remedies available under consumer guarantees, particularly considering the specific liability imposed on manufacturers of goods with safety defects. AI-enabled goods and services are generally a ‘mixed supply’ of goods and services, but consumers cannot claim for both a faulty good and service arising from a single transaction. Treasury is seeking to clarify this distinction for consumers in the context of AI-enabled goods and services.
    • Potential limitations of principles-based consumer guarantees. The current consumer guarantees regime contains a range of principles-based provisions that include concepts such as ‘fitness for purpose’, ‘acceptable quality’ and ‘due care and skill’. Treasury has received concerns that it is unclear how these principles-based standards may apply in the context of AI-enabled goods and services. An example is the concept of ‘durability’, which is currently set out under the ACL as a factor for assessing the acceptable quality of a product.

    Treasury has identified particular difficulties that consumers may face when accessing remedies related to AI and emerging technologies. It noted the following concerns regarding the applicability of a manufacturer’s liability for goods with safety defects (as under the ACL) in relation to AI-enabled goods and services:

    • The evidentiary burden of establishing a causal link between the safety defect and consumer loss and damage. The specific characteristics of AI systems, such as opacity, autonomous behaviour and complexity, may make it more difficult for consumers to meet this burden of proof. Treasury is considering approaches from other jurisdictions, such as that in the EU under the proposed AI Liability Directive, which includes a ‘presumption of causality’ where a number of conditions are met, shifting the onus to manufacturers to demonstrate that no causal link to consumer loss or damage exists.
    • Defences available to manufacturers. There is a concern that the current defences listed under the ACL available to manufacturers may not be appropriate for AI-enabled goods and services. For example, the defence that the safety defect did not exist at the time that a good was supplied reflects a traditional position that manufacturers retain little or no ongoing control over the goods that they supply, which is not always applicable to AI-enabled goods and services.

    The deadline for stakeholder feedback and written submissions on Treasury’s review of AI and the ACL is Tuesday, 12 November 2024.

  • MIL-OSI USA: What is Air Quality?

    Clean air is essential for healthy living, but according to the World Health Organization (WHO), almost 99% of the global population breathes air exceeding their guideline limits of air pollution. “Air quality is a measure of how much stuff is in the air, which includes particulates and gaseous pollutants,” said Kristina Pistone, a research scientist at NASA Ames Research Center. Pistone’s research covers both atmospheric and climate areas, with a focus on the effect of atmospheric particles on climate and clouds. “It’s important to understand air quality because it affects your health and how well you can live your life and go about your day,” Pistone said. We sat down with Pistone to learn more about air quality and how it can have a noticeable impact on human health and the environment.

    There are six main air pollutants regulated by the Environmental Protection Agency (EPA) in the United States: particulate matter (PM), nitrogen oxides, ozone, sulfur oxides, carbon monoxide, and lead. These pollutants come from from natural sources, such as the particulate matter that rises into the atmosphere from fires and desert dust, or from human activity, such as the ozone generated from sunlight reacting to vehicle emissions.

    Air quality influences health and quality of life. “Just like we need to ingest water, we need to breathe air,” Pistone said. “We have come to expect clean water because we understand that we need it to live and be healthy, and we should expect the same from our air.”
    Poor air quality has been tied to cardiovascular and respiratory effects in humans. Short-term exposure to nitrogen dioxide (NO2), for example, can cause respiratory symptoms like coughing and wheezing, and long-term exposure increases the risk of developing respiratory diseases such as asthma or respiratory infections. Exposure to ozone can aggravate the lungs and damage the airways. Exposure to PM2.5 (particulates 2.5 micrometers or smaller) causes lung irritation and has been linked to heart and lung diseases.
    In addition to its impacts on human health, poor air quality can damage the environment, polluting bodies of water through acidification and eutrophication. These processes kill plants, deplete soil nutrients, and harm animals.

    Air quality is similar to the weather; it can change quickly, even within a matter of hours. To measure and report on air quality, the EPA uses the United States Air Quality Index (AQI). The AQI is calculated by measuring each of the six primary air pollutants on a scale from “Good” to “Hazardous,” to produce a combined AQI numeric value 0-500.
    “Usually when we’re talking about air quality, we’re saying that there are things in the atmosphere that we know are not good for humans to be breathing all the time,” Pistone said. “So to have good air quality, you need to be below a certain threshold of pollution.” Localities around the world use different thresholds for “good” air quality, which is often dependent on which pollutants their system measures. In the EPA’s system, an AQI value of 50 or lower is considered good, while 51-100 is considered moderate. An AQI value between 100 and 150 is considered unhealthy for sensitive groups, and higher values are unhealthy to everyone; a health alert is issued when the AQI reaches 200. Any value over 300 is considered hazardous, and is frequently associated with particulate pollution from wildfires.

    Air quality sensors are a valuable resource for capturing air quality data on a local level.In 2022, the Trace Gas GRoup (TGGR) at NASA Ames Research Center deployed Inexpensive Network Sensor Technology for Exploring Pollution, or INSTEP: a new network of low-cost air quality sensors that measures a variety of pollutants. These sensors are capturing air quality data in certain areas in California, Colorado, and Mongolia, and have proven advantageous for monitoring air quality during California’s fire season.
    The 2024 Airborne and Satellite Investigation of Asian Air Quality (ASIA-AQ) mission integrated sensor data from aircraft, satellites, and ground-based platforms to evaluate air quality over several countries in Asia. The data captured from multiple instruments on these flights, such as the Meteorological Measurement System (MMS) from NASA Ames Atmospheric Science Branch, are used to refine air quality models to forecast and assess air quality conditions.
    Agency-wide, NASA has a range of Earth-observing satellites and other technology to capture and report air quality data. In 2023, NASA launched the Tropospheric Emissions: Monitoring of Pollution (TEMPO) mission, which measures air quality and pollution over North America. NASA’s Land, Atmosphere Near real-time Capability for Earth Observations (LANCE) tool provides air quality forecasters with measurements compiled from a multitude of NASA instruments, within three hours of its observation.

    In addition to the EPA’s website, which houses air-quality related sources, the EPA also has a platform called AirNow, which reports the local AQI across the United States and allows users to check air quality levels in their area. Pistone also recommends looking at Purple Air’s real-time map, which displays PM data taken from a crowd-sourced network of low-cost sensors and translates those measurements to estimate AQI.          The Director-General of Civil Aviation, Mr Victor Liu, led a Hong Kong delegation comprising representatives from the Civil Aviation Department (CAD) and the Hong Kong International Aviation Academy (HKIAA), to attend the 59th Conference of Directors General of Civil Aviation, Asia and Pacific Regions, organised by the International Civil Aviation Organization (ICAO), in Cebu, the Philippines.     The theme for this year’s Conference was “Shaping the Future of Aviation: Sustainable, Resilient, and Inclusive”. The five-day Conference, with over 320 participants from 44 member states, administrations and international organisations, concluded on a high note today (October 18). Discussion and information papers covering a wide range of subjects, including aviation safety, air navigation, aviation security, aviation and the environment, aviation technologies, as well as regional co-operation, were submitted by aviation authorities and industry organisations to the Conference.     During the Conference, Mr Liu moderated the discussion of an agenda item on aviation safety. The discussion covered a wide range of subjects, including safety management, safety culture and promotion, and applications of various artificial intelligence and innovation technologies.     The CAD submitted four papers to the Conference in response to the theme topic. Among them, the paper titled “Operationalisation of Autonomous Vehicles at the Hong Kong International Airport: A Regulatory Perspective” shared the successful experience of the application of autonomous vehicle technology to enhance safety and efficiency of airport operations in Hong Kong. The other three papers discussed the opportunities and challenges of applying artificial intelligence across various aspects of aviation, shared the CAD’s experience in utilising advanced technologies to enhance weather-related collaborative decision making in air traffic management, and shared information on the successful hosting of the Asia Pacific Region Innovation & Capacity Building Symposium 2023 under the theme “Uniting the Strength of Innovation for Building a Seamless Sky”, jointly organised by the Civil Aviation Administration of China, the CAD and the HKIAA in December 2023. The papers received recognition and support from delegates.     This year, the HKIAA set up an exhibition booth during the Conference to showcase its multidisciplinary training opportunities for aviation professionals. The HKIAA also submitted a paper to the Conference to share Hong Kong’s initiatives in addressing the training needs of the Asia Pacific region.     During their stay in Cebu, the CAD delegation attended side meetings with representatives from different aviation authorities and industry organisations such as the European Union Aviation Safety Agency, the Federal Aviation Administration, and the International Air Transport Association. Views on matters of mutual interest were shared, and ways to strengthen co-operation were explored with the aim of facilitating aviation developments.     ???The CAD will continue to maintain close co-operation with its aviation partners and continue to support the ICAO’s global aviation development initiatives.

  • MIL-OSI Security: Indian National Is Sentenced To Prison For $20 Million Dollar Fraud Scheme Involving Fake Cryptocurrency Exchange Websites

    CHARLOTTE, N.C. – A citizen of the Republic of India was sentenced to prison today for stealing more than $20 million from hundreds of victims through the use of fake or “spoofed” websites mimicking the cryptocurrency exchange website Coinbase, announced Dena J. King, U.S. Attorney for the Western District of North Carolina. U.S. District Judge Kenneth D. Bell ordered Chirag Tomar, 31, to serve 60 months in prison followed by two years of supervised release.

    Jason Byrnes, Special Agent in Charge of the United States Secret Service, Charlotte Field Office, joins U.S. Attorney King in making today’s announcement.

    According to filed court documents and today’s sentencing hearing, from as early as June 2021, Tomar and his co-conspirators engaged in a spoofing scheme to steal millions in cryptocurrency from hundreds of victims located worldwide and in the United States, including in the Western District of North Carolina. Spoofing, as it pertains to cybercrime, is when a malicious cyber actor disguises an email address, sender name, or website URL to convince victims they are interacting with a trusted source. Court documents show that Tomar and his co-conspirators executed the fraud by spoofing Coinbase, one of the largest virtual currency exchanges in the world, that allows customers to buy, sell or trade cryptocurrencies.

    Coinbase operated a “Pro” version of its exchange, which was found at the URL “Pro.Coinbase.Com.” According to court documents, Tomar and his co-conspirators spoofed the Coinbase Pro website by using a similar fake URL, CoinbasePro.Com, and created a fraudulent website to mimic the authentic website. Once victims entered their login credentials into the fake website, an authentication process was triggered. In some instances, victims were tricked into providing their login and authentication information of the real Coinbase website to fraudsters. Other times, victims were tricked into allowing fake Coinbase representatives to execute remote desktop software, which enabled fraudsters to gain control of victims’ computers and access their legitimate Coinbase accounts. The fraudsters also impersonated Coinbase customer service representatives and tricked the users into providing their two-factor authentication codes to the fraudsters over the phone. Once the fraudsters gained access to the victims’ Coinbase accounts, the fraudsters quickly transferred the victims’ Coinbase cryptocurrency holdings to cryptocurrency wallets under the fraudsters’ control.

    Court documents show that, in February 2022, a victim located in the Western District of North Carolina attempted to log into his Coinbase account through the fraudulent website. The spoof website immediately notified the victim that his account was locked and prompted the victim to use a number provided to call a fake Coinbase representative. The fake representative tricked the victim into providing his two-factor authentication information, ultimately gaining access into the victim’s real Coinbase account. Using the information, fraudsters stole cryptocurrency from the victim’s Coinbase wallet worth over $240,000.

    According to court records, Tomar used the victims’ stolen log-in credentials to access the victim accounts and transfer the victims’ cryptocurrency holdings to wallets controlled by Tomar. After Tomar received the stolen cryptocurrency, he would convert it to other forms of cryptocurrency and move the funds amongst many wallets controlled by Tomar. Ultimately, the cryptocurrency was converted into cash which was then distributed to Tomar and his co-conspirators.

    Tomar used the victims’ funds to pay for his lavish lifestyle, including to purchase Audemars Piguet and other expensive watches, to buy luxury vehicles like Lamborghinis and Porsches, and to make trips to Dubai, Thailand and elsewhere.

    On December 20, 2023, Tomar was arrested at the Atlanta airport upon entering the United States. On May 20, 2024, Tomar pleaded guilty to wire fraud conspiracy. Tomar remains in federal custody and will be transferred to the custody of the Federal Bureau of Prisons upon designation of a federal facility. 

    U.S. Attorney King commended the U.S. Secret Service for their investigation of the case and thanked the FBI in Nashville for their invaluable assistance.

  • MIL-OSI Security: Charlotte Man Is Sentenced To Prison For Armed Robberies Of Two Convenience Stores

    CHARLOTTE, N.C. – Thomas Lagene Franklin, 56, of Charlotte, was sentenced today to 15 years in prison followed by three years of supervised release for the armed robbery of two local convenience stores, announced Dena J. King, U.S. Attorney for the Western District of North Carolina.

    Robert M. DeWitt, Special Agent in Charge of the Federal Bureau of Investigation (FBI), Charlotte Division, and Chief Johnny Jennings of the Charlotte Mecklenburg Police Department, join U.S. Attorney King in making today’s announcement.

    According to court documents and court proceedings, on August 7, 2022, at approximately 3:30 a.m., a black vehicle pulled up alongside a male victim who was walking toward his hotel room in Charlotte. The driver of the vehicle, later identified as Franklin, demanded money from the victim. When the victim replied that he did not have any money, Franklin fired multiple shots at the victim striking him in the leg before driving away.

    According to filed court documents, on August 9, 2022, Franklin robbed at gunpoint the Circle K convenience store located at 2833 Freedom Drive, in Charlotte. Court records show that, at approximately 1:45 a.m., Franklin entered the store wearing a bucket-style fishing hat with clear safety glasses and a black surgical mask. Upon entering the store, Franklin posed as a customer, brought items to the counter, and gave the clerk money to pay for those items. When the clerk opened the register, Franklin pulled a small silver semiautomatic handgun from his pocket, pointed it at the clerk, and demanded money in the register. The clerk complied and Franklin fled the scene.

    According to court records, later the same day, the 7-Eleven convenience store located at 8315 Steele Creek Road, in Charlotte, was robbed at gunpoint in a similar fashion as the Circle K

    robbery. At approximately 6:50 a.m., Franklin entered the store dressed identical to the robber from the Circle K robbery. Once again, Franklin acted as a customer and pretended to buy and pay for his items. When the store clerk opened the register, Franklin pulled out a small silver semi-automatic handgun and demanded money. The store clerk gave Franklin money and Franklin fled the scene. CMPD officers arrested Franklin the following day. A firearm recovered over the course of the arrest was identified as the gun used in the shooting and the two robberies.

    On February 7, 2024, Franklin pleaded guilty to two counts of Hobbs Act robbery and one count of possession of a firearm by a convicted felon. He is currently in federal custody and will be transferred to the custody of the Federal Bureau of Prisons upon designation of a federal facility.

    U.S. Attorney King commended the FBI and CMPD for their investigation of the case.

  • MIL-OSI Security: Over 6 million illegally exported pills seized in international operation against drug trafficking network

    The criminal group, which operated throughout Europe, bought pills from other criminal networks in Serbia. The pills, used to treat anxiety, seizures and insomnia, were then hidden in tyres, in cars, which were transported on lorries, and in clothing to be taken to Romania and Estonia. After arriving in Romania or Estonia, the pills were transported on to the Nordic countries. Members of the criminal group in Finland and Norway acted as distributors and sold the pills on the streets. The sale of the pills was highly profitable for the criminal group. The pills seized during the operations done by the national authorities has a market value of approximately EUR 12.5 million.

    To dismantle the intricate network of criminals, the Romanian authorities launched an investigation into the group. Given the transnational nature of the criminal group, with activities in Romania, Estonia, Finland, and Serbia, international cooperation between the authorities started, supported by Eurojust and Europol.

    A joint investigation team (JIT) was set up at Eurojust between Romanian, Estonian, Finnish and Serbian authorities to collect and exchange information and evidence directly, and carry out joint operations.

    To investigate the activity of the criminal group, special investigative techniques such as control delivery and undercover investigator were successfully used by the authorities of all the countries involved. To this end, Eurojust facilitated the coordination and execution in Hungary, Slovakia, Poland, Lithuania and Latvia of European Investigation Orders issued by Romania. Following these actions, 39 people were arrested, and more than 4 million prescription pills were seized.

    After these measures, the JIT continued their investigations to halt the activities of the criminal group and bring them to justice.

    A large-scale international operation on 17 October coordinated from Eurojust’s headquarters in The Hague, led to the arrest of 14 people in Romania, 11 people in Serbia and 1 person in Finland. 41 houses searches were carried out simultaneously in Romania, 19 in Serbia and one in Finland.

    Items seized during the operation include large quantities of pills, cash, mobile phones, firearms and luxury cars. 2 houses have been also seized in Romania. Europol facilitated the overall operation by liaising with the operating authorities, processing the available data and deploying two specialists with mobile offices to support the action day.
